Appropriations for tank car research and development.</toc-entry></toc></subsection></section><section id="idd825ba661275482da62d9f968401614b"><enum>2.</enum><header>Defined term</header><text display-inline="no-display-inline">In this Act, the term <term>Secretary</term> means the Secretary of Transportation.</text></section><section id="id14a8a70076b44d4581b38638252fa03f"><enum>3.</enum><header>Safety requirements for trains transporting hazardous materials</header><subsection id="ide7af9c1e61db4b8985d0eb23ae8366fc"><enum>(a)</enum><header>Rulemaking</header><text>Not later than 1 year after the date of the enactment of this Act, the Secretary shall issue regulations, or modify existing regulations, establishing safety requirements, in accordance with subsection (b), with which a shipper or rail carrier operating a train transporting hazardous materials that is not subject to the requirements for a high-hazard flammable train under section 174.310 of title 49, Code of Federal Regulations, shall comply with respect to the operation of each such train and the maintenance of specification tank cars.</text></subsection><subsection id="idee3f3aa3f37e460da77851c9bfe7574d"><enum>(b)</enum><header>Requirements</header><text>The regulations issued pursuant to subsection (a) shall require shippers and rail carriers—</text><paragraph id="id5c6410f54c784da184550e8e797de77f"><enum>(1)</enum><text>to provide advance notification and information regarding the transportation of hazardous materials described in subsection (a) to each State emergency response commissioner, the tribal emergency response commission, or any other State or tribal agency responsible for receiving the information notification for emergency response planning information;</text></paragraph><paragraph id="idee91570335e64c4a92f076b002b96bca"><enum>(2)</enum><text>to include, in the notification provided pursuant to paragraph (1), a written gas discharge plan with respect to the applicable hazardous materials being transported; and</text></paragraph><paragraph id="iddfcff48508454309862695b28a33bdf4"><enum>(3)</enum><text>to reduce or eliminate blocked crossings resulting from delays in train movements.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id05cd4b38037041fd9f84bd83517a7cc7"><enum>(c)</enum><header>Additional requirements</header><text display-inline="yes-display-inline">In developing the regulations required under subsection (a), the Secretary shall include requirements regarding—</text><paragraph id="id398762dabd764adb9303fb5e50c827eb"><enum>(1)</enum><text>train length and weight;</text></paragraph><paragraph id="id35c586d22c9746828f096ce12f789bfc"><enum>(2)</enum><text>train consist;</text></paragraph><paragraph id="id28e7d3502d714f2fb71cd5bd8608c59d"><enum>(3)</enum><text>route analysis and selection;</text></paragraph><paragraph id="id28f619fb55154019834cf622a5cb51e7"><enum>(4)</enum><text>speed restrictions;</text></paragraph><paragraph id="id2bf625f796d642c09f820debf97886a7"><enum>(5)</enum><text>track standards;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida46e8b8d1e3e402b87c947dd5aaeff5a"><enum>(6)</enum><text display-inline="yes-display-inline">track, bridge, and rail car maintenance;</text></paragraph><paragraph id="idDF82853B7906480FB2E88068708FEEC8"><enum>(7)</enum><text>signaling and train control;</text></paragraph><paragraph id="idb6d9bb668cc74a209e8df8188227e78b"><enum>(8)</enum><text>response plans; and</text></paragraph><paragraph id="id4dfd628e68af4151a9c715f7816d35db"><enum>(9)</enum><text>any other requirements that the Secretary determines are necessary.</text></paragraph></subsection><subsection id="id99dbf935c05e4c2887b98c5a88607b70"><enum>(d)</enum><header>High-Hazard flammable trains</header><text>The Secretary may modify the safety requirements for trains subject to section 174.310 of title 49, Code of Federal Regulations, to satisfy, in whole or in part, the rulemaking required under subsection (a).</text></subsection></section><section id="idae4842e0e98c4ede85e499634f494bb2"><enum>4.</enum><header>Rail car inspections</header><subsection commented="no" display-inline="no-display-inline" id="idcc55dbb3a24a45bda21c3109ef8cd681"><enum>(a)</enum><header display-inline="yes-display-inline">Rulemaking</header><paragraph commented="no" display-inline="no-display-inline" id="idf646a738a2934829850a427f40c8e482"><enum>(1)</enum><header display-inline="yes-display-inline">Inspection requirements</header><text display-inline="yes-display-inline">Not later than 1 year after date of the enactment of this Act, the Secretary shall review and update, as necessary, applicable regulations under chapters I and II of subtitle B of title 49, Code of Federal Regulations—</text><subparagraph id="id09b7d9f42c8f4baa9726ee05f3f5104f"><enum>(A)</enum><text>to create minimum time requirements that a qualified mechanical inspector must spend when inspecting a rail car or locomotive; and</text></subparagraph><subparagraph id="id7dd6247321934630b5d6238a1d4a5438"><enum>(B)</enum><text>to ensure that all rail cars and locomotives in train consists that carry hazardous materials are inspected by a qualified mechanical inspector at intervals determined by the Secretary.</text></subparagraph></paragraph><paragraph id="id6d3c14f8dd224c06aa998707df6fe7c4"><enum>(2)</enum><header>Abbreviated pre-departure inspection</header><text>The Secretary shall immediately amend section 215.13(c) of title 49, Code of Federal Regulations (permitting an abbreviated pre-departure inspection procedure) with respect to rail cars in train consists carrying hazardous materials.</text></paragraph></subsection><subsection id="id719fe97ca2e2426aab82af8657e971f0"><enum>(b)</enum><header>Audits</header><paragraph id="id63cd2f5cc15b42f5baff35a80d0c61d2"><enum>(1)</enum><header>In general</header><text>Not later than 60 days after the date of the enactment of this Act, the Secretary shall initiate audits of Federal rail car inspection programs, subject to the requirements under part 215 of title 49, Code of Federal Regulations, which—</text><subparagraph id="ide5fbca297cd34a23a6458c991b0166be"><enum>(A)</enum><text>consider whether such programs are in compliance with such part 215;</text></subparagraph><subparagraph id="idd481e0d9596d465cafa8c289a7f1aff4"><enum>(B)</enum><text>assess the type and content of training and performance metrics that such programs provide rail car inspectors;</text></subparagraph><subparagraph id="id6d55ead783944c5f96b2ee0e325d4b3a"><enum>(C)</enum><text>determine whether such programs provide inspectors with adequate time to inspect rail cars;</text></subparagraph><subparagraph id="idbcd9783e11a149c6a3df28e4b38cccb2"><enum>(D)</enum><text>determine whether such programs reflect the current operating practices of the railroad carrier; and</text></subparagraph><subparagraph id="id03f88c570b7b40689952aeed0826be7e"><enum>(E)</enum><text>ensure that inspection programs are not overly reliant on train crews.</text></subparagraph></paragraph><paragraph id="idad1d2f08fb594eb9bc18a30c8db40ffd"><enum>(2)</enum><header>Audit scheduling</header><text>The Secretary shall—</text><subparagraph id="id76ba4b27b8554af5a835f8f7da8e6fc8"><enum>(A)</enum><text>schedule the audits required under paragraph (1) to ensure that—</text><clause id="id4fd3d1d3c0c4401fbfd1015c14fd2292"><enum>(i)</enum><text>each Class I railroad is audited not less frequently than once every 5 years; and</text></clause><clause id="iddc41092b4a7a43c0a7ffe0575d159e52"><enum>(ii)</enum><text>a select number, as determined by the Secretary, of Class II and Class III railroads are audited annually; and</text></clause></subparagraph><subparagraph id="idaa3ee3b46c604cb694a27f7c8000183b"><enum>(B)</enum><text>conduct the audits described in subparagraph (A)(ii) in accordance with—</text><clause commented="no" display-inline="no-display-inline" id="id5681891fe11645ed9a543ded56c9a616"><enum>(i)</enum><text display-inline="yes-display-inline">the Small Business Regulatory Enforcement Fairness Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/5/601">5 U.S.C. 601</external-xref> note); and </text></clause><clause commented="no" display-inline="no-display-inline" id="idc0885c58b0f844c38be686517bb99e4d"><enum>(ii)</enum><text display-inline="yes-display-inline">appendix C of part 209 of title 49, Code of Federal Regulations.</text></clause></subparagraph></paragraph><paragraph id="iddf8311f27c2b4ac59bb82b3d386c9180"><enum>(3)</enum><header>Updates to inspection program</header><text>If, during an audit required under this subsection, the auditor identifies a deficiency in a railroad's inspection program, the railroad shall update the program to eliminate such deficiency.</text></paragraph><paragraph id="idd7ef80bb47744f0ba79c0d27a55bda85"><enum>(4)</enum><header>Consultation and cooperation</header><subparagraph id="id2b9ca596e3f840998e6ec985f8ccf935"><enum>(A)</enum><header>Consultation</header><text>In conducting any audit required under this subsection, the Secretary shall consult with the railroad being audited and its employees, including any nonprofit employee labor organization representing the mechanical employees of the railroad.</text></subparagraph><subparagraph id="id93bd12942dde47d69dcdb1dfa91e5743"><enum>(B)</enum><header>Cooperation</header><text>The railroad being audited and its employees, including any nonprofit employee labor organization representing mechanical employees, shall fully cooperate with any audit conducted pursuant to this subsection—</text><clause id="id9d02853e2cfa4d71a3afb5e8b1edc37d"><enum>(i)</enum><text>by providing any relevant documents requested; and</text></clause><clause id="idc37543a0fb83497fb8a07debde26eb85"><enum>(ii)</enum><text>by making available any employees for interview without undue delay or obstruction.</text></clause></subparagraph><subparagraph id="id623c3036a8844511bcd68dbff92a7065"><enum>(C)</enum><header>Failure to cooperate</header><text>If the Secretary determines that a railroad or any of its employees, including any nonprofit employee labor organization representing mechanical employees of the railroad is not fully cooperating with an audit conducted pursuant to this subsection, the Secretary shall electronically notify the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation of the Senate</committee-name> and the <committee-name committee-id="">Committee on Transportation and Infrastructure of the House of Representatives</committee-name> of such noncooperation.</text></subparagraph></paragraph></subsection><subsection id="idcc9e8651c26f412098c61d54db7394d9"><enum>(c)</enum><header>Review of regulations</header><text>The Secretary shall triennially determine whether any update to part 215 of title 49, Code of Federal Regulations, is necessary to ensure the safety of rail cars transported by rail carriers.</text></subsection><subsection id="id3f476826bda24fa6aa1ee35b3fafd511"><enum>(d)</enum><header>Annual report</header><text>The Secretary shall publish an annual report on the public website of the Federal Railroad Administration that—</text><paragraph commented="no" display-inline="no-display-inline" id="ide0f0f349269848898d2fda2dc6a60f38"><enum>(1)</enum><text display-inline="yes-display-inline">summarizes the findings of the prior year's audits; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id804efa716ae54ea3b6e859a3cff5246e"><enum>(2)</enum><text display-inline="yes-display-inline">summarizes any updates made pursuant to this section; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id43a04325890c4ca1a8135ceb42d00d83"><enum>(3)</enum><text display-inline="yes-display-inline">excludes any confidential business information or sensitive security information. </text></paragraph></subsection><subsection id="id6815ebc9e32448c881930c431ff8702e"><enum>(e)</enum><header>Rule of construction</header><text>Nothing in this section may be construed—</text><paragraph id="id15baeaa5d1f0460caa3533a8d613a5a7"><enum>(1)</enum><text>to limit the deployment of pilot programs for the installation, test, verification, and review of automated rail and train inspection technologies; or</text></paragraph><paragraph id="id7171e144513443969e6dbb8a84fe33ad"><enum>(2)</enum><text>to direct the Secretary to waive any existing inspection requirements under chapter I or II of subtitle B of title 49, Code of Federal Regulations, as part of pilot programs. </text></paragraph></subsection></section><section id="ida267c54c426e4a4891012557f6a03ec9"><enum>5.</enum><header>Defect detectors</header><subsection id="idf0897525d6a242db8f49a8b0f6e2b0a8"><enum>(a)</enum><header>Rulemaking</header><text>Not later than 1 year after the date of the enactment of this Act, the Secretary shall issue regulations establishing requirements for the installation, repair, testing, maintenance, and operation of wayside defect detectors for each rail carrier operating a train consist carrying hazardous materials.</text></subsection><subsection id="idd936ff7417704b6ca85614ab7b16a662"><enum>(b)</enum><header>Requirements</header><text>The regulations issued pursuant to subsection (a) shall include requirements regarding—</text><paragraph id="idd8a22d266b4a41bd82a80b80dc00f106"><enum>(1)</enum><text>the frequency of the placement of wayside defect detectors, including a requirement that all Class I railroads install a hotbox detector along every 10-mile segment of rail track over which trains carrying hazardous materials operate; </text></paragraph><paragraph id="id00b5aace4e8f4e50b7b6d3018bc2437b"><enum>(2)</enum><text>performance standards for such detectors;</text></paragraph><paragraph id="idf5c8c6d7ee29447abe22a006fb1fc665"><enum>(3)</enum><text>the maintenance and repair requirements for such detectors;</text></paragraph><paragraph id="idd7bc91b4f4c94acc89001f9c0d887b78"><enum>(4)</enum><text>reporting data and maintenance records of such detectors;</text></paragraph><paragraph id="id104e4113c22742d9a601964341fe2cc3"><enum>(5)</enum><text>appropriate steps the rail carrier must take when receiving an alert of a defect or failure from or regarding a wayside defect detector; and</text></paragraph><paragraph id="id355a2df2aede49b28351a53a1d0ae463"><enum>(6)</enum><text>the use of hotbox detectors to prevent derailments from wheel bearing failures, including—</text><subparagraph id="id1f2cc40e42ef413180d2a4c3a53245bc"><enum>(A)</enum><text>the temperatures, to be specified by the Secretary, at which an alert from a hotbox detector is triggered to warn of a potential wheel bearing failure; and</text></subparagraph><subparagraph id="id2ea795d8c252488c83960fb7c58ba296"><enum>(B)</enum><text>any actions that shall be taken by a rail carrier upon receiving an alert from a hotbox detector of a potential wheel bearing failure.</text></subparagraph></paragraph></subsection><subsection id="id7366c2330a864b089034a256c4b864d9"><enum>(c)</enum><header>Defect and failure identification</header><text>The Secretary shall specify the categories of defects and failures that wayside defect detectors covered by regulations issued pursuant to subsection (a) shall address, including—</text><paragraph id="id0605794c5eac46deb0a5094be6250649"><enum>(1)</enum><text>axles;</text></paragraph><paragraph id="id349cf3fe395c4c5986f5cc3c4cfb0276"><enum>(2)</enum><text>wheel bearings;</text></paragraph><paragraph id="id0e0beecd3b41431b922242b69bbfcfdf"><enum>(3)</enum><text>brakes;</text></paragraph><paragraph id="id8c43214979804a1eb647e2beaef7cb9f"><enum>(4)</enum><text>signals;</text></paragraph><paragraph id="ide8145b0cfb50445caa3bbeb5ab134790"><enum>(5)</enum><text>wheel impacts; and</text></paragraph><paragraph id="idcc5dbbbc48cf4b4e8bebdcdd0e5095a3"><enum>(6)</enum><text>other defects or failures specified by the Secretary. </text></paragraph></subsection></section><section id="idbb455e44acd24317813dc49c6346830f"><enum>6.</enum><header>Safe Freight Act of 2023</header><subsection id="id6ded9f77c0284450925a92bce36a8021"><enum>(a)</enum><header>Short title</header><text>This section may be cited as the <quote><short-title>Safe Freight Act of 2023</short-title></quote>.</text></subsection><subsection id="id62d54e0a73e94a43878c0ae356c4d726"><enum>(b)</enum><header>Freight train crew size</header><text>Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/201">chapter 201</external-xref> of title 49, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/49/20153">section 20153</external-xref> the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id94685f2a83cd499e8da0e0242fddfaf1"><section id="id16e47124f5eb4adeb3216cfccb22d92d"><enum>20154.</enum><header>Freight train crew size safety standards</header><subsection commented="no" display-inline="no-display-inline" id="id4bba2c20affb46a797040eeeae9daa2b"><enum>(a)</enum><header display-inline="yes-display-inline">Minimum crew size</header><text>No freight train may be operated without a 2-person crew consisting of at least 1 appropriately qualified and certified conductor and 1 appropriately qualified and certified locomotive engineer.</text></subsection><subsection id="id6e732ffd476f444ca7a58922aa597544"><enum>(b)</enum><header>Exceptions</header><text>Except as provided in subsection (c), the requirement under subsection (a) shall not apply with respect to—</text><paragraph id="id4fb2a3e081d244079a09e6a32f7492c6"><enum>(1)</enum><text>train operations on track that is not a main line track;</text></paragraph><paragraph id="id63a17aa0f5b5436c936623969018334c"><enum>(2)</enum><text>a freight train operated—</text><subparagraph id="idd04cb23b030d464089f5eda65382a89a"><enum>(A)</enum><text>by a railroad carrier that has fewer than 400,000 total employee work hours annually and less than $40,000,000 annual revenue (adjusted for inflation, as calculated by the Surface Transportation Board Railroad Inflation- Adjusted Index and Deflator Factor Table);</text></subparagraph><subparagraph id="idbae1366790fa4bc0a8ca053ff8549830"><enum>(B)</enum><text>at a speed of not more than 25 miles per hour; and</text></subparagraph><subparagraph id="id21505df71fd644b99d35dc8671e9f4b7"><enum>(C)</enum><text>on a track with an average track grade of less than 2 percent for any segment of track that is at least 2 continuous miles;</text></subparagraph></paragraph><paragraph id="id91f4acb728d0472ab19b4a80aea6b5dd"><enum>(3)</enum><text>locomotives performing assistance to a train that has incurred mechanical failure or lacks the power to traverse difficult terrain, including traveling to or from the location where assistance is provided;</text></paragraph><paragraph id="idffa5880a62d348869f4483afa61d5f8b"><enum>(4)</enum><text>locomotives that—</text><subparagraph id="idd65ade019e7b4e7281eacc194c67b89a"><enum>(A)</enum><text>are not attached to any equipment or are attached only to a caboose; and</text></subparagraph><subparagraph id="id9fdbd717a2114124a9a852d6f7f8c870"><enum>(B)</enum><text>do not travel further than 30 miles from the point of origin of such locomotive; and</text></subparagraph></paragraph><paragraph id="id097f99486406458ab4c0dc81fecf8f01"><enum>(5)</enum><text>train operations staffed with fewer than a 2-person crew at least 1 year before the date of enactment of this section, if the Secretary determines that such operations achieve an equivalent level of safety as would result from compliance with the requirement under subsection (a).</text></paragraph></subsection><subsection id="id0431d92f926a4b52863f866f81cca093"><enum>(c)</enum><header>Trains ineligible for exception</header><text>The exceptions under subsection (b) may not be applied to—</text><paragraph id="id52267cede4804b939234c5d09acc4716"><enum>(1)</enum><text>a train transporting 1 or more loaded cars carrying material toxic by inhalation (as defined in section 171.8 of title 49, Code of Federal Regulations);</text></paragraph><paragraph id="idcb322bef81d04d7fa6980b5439ca94be"><enum>(2)</enum><text>a train transporting—</text><subparagraph commented="no" display-inline="no-display-inline" id="idfffa4514a3704a76ad12a74765425a86"><enum>(A)</enum><text display-inline="yes-display-inline">20 or more loaded tank cars of a Class 2 material or a Class 3 flammable liquid in a continuous block; or </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb97de4a5a9414ef684d6c6e7f48ecfa6"><enum>(B)</enum><text display-inline="yes-display-inline">35 or more loaded tank cars of a Class 2 material or a Class 3 flammable liquid throughout the train consist; or</text></subparagraph></paragraph><paragraph id="iddd3fadac64aa43f09becea78199ac00a"><enum>(3)</enum><text>a train with a total length of at least 7,500 feet.</text></paragraph></subsection><subsection id="ide41af6a82a34452faf481dc305126137"><enum>(d)</enum><header>Waiver</header><text>A railroad carrier may seek a waiver of the requirements under this section in accordance with section 20103(d).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idf1a86953e3c8451bb301ce3d0a22219c"><enum>(c)</enum><header>Clerical amendment</header><text>The analysis for subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/201">chapter 201</external-xref> of title 49, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/49/20153">section 20153</external-xref> the following:</text><quoted-block style="USC" id="id3253cfab-1a9e-483b-b2ca-38e20a20f24d"><toc><toc-entry level="section" idref="id16e47124f5eb4adeb3216cfccb22d92d">20154. Freight train crew size.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section commented="no" display-inline="no-display-inline" id="id0b490fb307d546bfa4bb789e0b0ac7ae"><enum>7.</enum><header>Increasing maximum civil penalties for violations of rail safety regulations</header><subsection id="id8148ea2eabf1434c95ef9fdde6195476"><enum>(a)</enum><header>Civil penalties related to transporting hazardous materials</header><text>Section 5123(a) of title 49, United States Code, is amended—</text><paragraph id="id914935592fc643f9a8bbc3bb6c2fc170"><enum>(1)</enum><text>in paragraph (1), in the matter preceding subparagraph (A), by striking <quote>$75,000</quote> and inserting <quote>the greater of 0.5 percent of the person's annual income or annual operating income or $750,000</quote>; and</text></paragraph><paragraph id="id0befdb5e22c54cbcad25b0386a23e6a8" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>in paragraph (2), by striking <quote>$175,000</quote> and inserting <quote>the greater of 1 percent of the person's annual income or annual operating income or $1,750,000</quote>.</text></paragraph></subsection><subsection id="ide79df32dbea448a4b064ab2b0948ce3f"><enum>(b)</enum><header>General violations of chapter 201</header><text>Section 21301(a)(2) of title 49, United States Code, is amended—</text><paragraph id="id64b47a3a52864441bf725e580897cd39"><enum>(1)</enum><text>by striking <quote>$25,000.</quote> and inserting <quote>the greater of 0.5 percent of the person's annual income or annual operating income or $250,000</quote>; and</text></paragraph><paragraph id="id60546679244043fb86cf4e77e90cae9e"><enum>(2)</enum><text>by striking <quote>$100,000.</quote> and inserting <quote>the greater of 1 percent of the person's annual income or annual operating income or $1,000,000</quote>.</text></paragraph></subsection><subsection id="idb3eb449b52054d51a0eac663536b4050"><enum>(c)</enum><header>Accident and incident violations of chapter 201; violations of chapters 203 through 209</header><text>Section 21302(a) is amended—</text><paragraph id="id9ea1941793ab42958eeb114f6ab91775"><enum>(1)</enum><text>in paragraph (1), by striking <quote>203–209</quote> each place it appears and inserting <quote>203 through 209</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id30ab66ef0f5d4a479f6975f128b5c833"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (2)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id37c0421c6d6740ce8a802c76313d368e"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>$25,000</quote> and inserting <quote>the greater of 0.5 percent of the person's annual income or annual operating income or $250,000</quote>; and</text></subparagraph><subparagraph id="id2e8c47dcc2874a5f8985f30bb4468692"><enum>(B)</enum><text>by striking <quote>$100,000</quote> and inserting <quote>the greater of 1 percent of the person's annual income or annual operating income or $1,000,000</quote>.</text></subparagraph></paragraph></subsection><subsection id="id5164abcca27e4a0e8e5c10b930455d3f"><enum>(d)</enum><header>Violations of chapter 211</header><text>Section 21303(a)(2) is amended—</text><paragraph id="ide955d293b9dd4862bbaf8ef2cc4e0b54"><enum>(1)</enum><text>by striking <quote>$25,000.</quote> and inserting <quote>the greater of 0.5 percent of the person's annual income or annual operating income or $250,000</quote>; and</text></paragraph><paragraph id="ida4bc170c1c1d4d75b603887a41819dce"><enum>(2)</enum><text>by striking <quote>$100,000.</quote> and inserting <quote>the greater of 1 percent of the person's annual income or annual operating income or $1,000,000</quote>.</text></paragraph></subsection></section><section id="id4c914143cc0b4c9bb23bf05a545e6e96"><enum>8.</enum><header>Safer tank cars</header><subsection id="id4432543d195a47d0ac763f8a76514644"><enum>(a)</enum><header>Phase-Out schedule</header><text>Beginning on May 1, 2025, a rail carrier may not use DOT–111 specification railroad tank cars that do not comply with DOT–117, DOT–117P, or DOT–117R specification requirements, as in effect on the date of enactment of this Act, to transport Class 3 flammable liquids regardless of the composition of the train consist.</text></subsection><subsection id="ida885b5d5fa464480acd2f03e61b0754b"><enum>(b)</enum><header>Conforming regulatory amendments</header><paragraph id="ida3dedea0581c418fb5239a6dccc299b8"><enum>(1)</enum><header>In general</header><text>The Secretary—</text><subparagraph id="id615dd3675af047aab9e9d670fa7537b0"><enum>(A)</enum><text>shall immediately remove or revise the date-specific deadlines in any applicable regulations or orders to the extent necessary to conform with the requirement under subsection (a); and</text></subparagraph><subparagraph id="idaff0ffcedcc844d7a015aa033fe2a61c"><enum>(B)</enum><text>may not enforce any date-specific deadlines or requirements that are inconsistent with the requirement under subsection (a).</text></subparagraph></paragraph><paragraph id="idfabffa82ae5a440295aeeaa04a5712f9"><enum>(2)</enum><header>Rule of construction</header><text>Except as required under paragraph (1), nothing in this section may be construed to require the Secretary to issue regulations to implement this section.</text></paragraph></subsection></section><section id="id9bfb22ab5aec4061834d1168cb64c891"><enum>9.</enum><header>Hazardous materials training for first responders</header><subsection id="id6a3f22d262d345adbbf16418944417fc"><enum>(a)</enum><header>Annual registration fee</header><text>Section 5108(g) of title 49, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB0EFB76B2D604154A76BCB0F834012F8"><paragraph id="id3666286ade5940358ac357a8a4c4c1f6"><enum>(4)</enum><header>Additional fee for class I rail carriers</header><text>In addition to the fees collected pursuant to paragraphs (1) and (2), the Secretary shall establish and annually impose and collect from each Class I rail carrier a fee in an amount equal to $1,000,000.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id34deaf0b7413473486963beb22ed6ce8"><enum>(b)</enum><header>Assistance for local emergency response training</header><text>Section 5116(j)(1)(A) of title 49, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id2d8a9ab4110d421b97715c882845e1df"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>liquids</quote> and inserting <quote>materials</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc5b84e12a65349fe9e49a54a449b061e"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (3), by amending subparagraph (A) to read as follows: </text><quoted-block style="OLC" display-inline="no-display-inline" id="idD02B686290B246CB96373F057B98B9B7"><subparagraph commented="no" display-inline="no-display-inline" id="id4945f0618e6c4781bbe1a4cdc5655a02"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">To carry out the grant program established pursuant to paragraph (1),the Secretary may expend, during each fiscal year—</text><clause commented="no" display-inline="no-display-inline" id="id1b759a0bf7a6490baeeefa69a534ef5d"><enum>(i)</enum><text display-inline="yes-display-inline">the amounts collected pursuant to section 5108(g)(4); and</text></clause><clause commented="no" display-inline="no-display-inline" id="id3920a49572d749b98c71e024651d0b2a"><enum>(ii)</enum><text display-inline="yes-display-inline">any amounts recovered during such fiscal year from grants awarded under this section during a prior fiscal year.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id5863ad19230d41b08cc0b7880ddabecc"><enum>(c)</enum><header>Supplemental training grants</header><text>Section 5128(b)(4) of title 49, United States Code is amended by striking <quote>$2,000,000</quote> and inserting <quote>$4,000,000</quote>.</text></subsection></section><section id="idf6f42f218e284f9d9f647bbe59832ed4"><enum>10.</enum><header>Rail safety infrastructure research and development grants</header><subsection id="ide8e2000f0c964a37ae59dbb27b0dcf0b"><enum>(a)</enum><header>Research requirement</header><text>The Administrator of the Federal Railroad Administration shall award grants, in accordance with section 22907 of title 49, United States Code, and the restrictions and limitations on eligibility for Class I railroads under such section, for research and development of wayside defect detectors to better prevent the derailment of trains transporting hazardous materials.</text></subsection><subsection id="ide08f31ee755643bca7bcad5608e46621"><enum>(b)</enum><header>Funding</header><paragraph commented="no" display-inline="no-display-inline" id="ida14b3ef5d959465a8970d702ac4ceb6c"><enum>(1)</enum><header>Appropriation</header><text display-inline="yes-display-inline">There is appropriated to the Federal Railroad Administration, out of any funds in the Treasury not otherwise appropriated, $22,000,000, which shall be used for the grants authorized under subsection (a) for the improvement and research of wayside defect defectors and the prevention of derailments of trains containing hazardous materials. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3d2bac06b6a74bea90ea30b6374bf9ca"><enum>(2)</enum><header>Availability of funding</header><text display-inline="yes-display-inline">Amounts appropriated under this subsection shall remain available until expended</text></paragraph></subsection></section><section id="idc6b7cf05d8ff4c2989ba8dcedc382058"><enum>11.</enum><header>Appropriations for tank car research and development</header><text display-inline="no-display-inline">There is appropriated to the Pipeline and Hazardous Materials Safety Administration, out of any funds in the Treasury not otherwise appropriated, $5,000,000, which shall be used for expenses related to the development of—</text><paragraph commented="no" display-inline="no-display-inline" id="id397822331a2e46118d82fa17cb0572d0"><enum>(1)</enum><text display-inline="yes-display-inline">stronger, safer tank cars and valves for tank cars; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4b35d684be234faba9960ba402c5e919"><enum>(2)</enum><text display-inline="yes-display-inline">other tank car safety features. </text></paragraph></section></legis-body></bill>
