following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title XXXIII of the Public Health Service Act with respect to flexibility and funding for the World Trade Center Health Program.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>9/11 Responder and Survivor Health Funding Correction Act of 2023</short-title></quote>.</text></section><section id="idB7F6DF8A48C2429EA66B1900B38128C7"><enum>2.</enum><header>Department of Defense, Armed Forces, or other Federal worker responders to the September 11 attacks at the Pentagon and Shanksville, Pennsylvania</header><text display-inline="no-display-inline">Title XXXIII of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300mm">42 U.S.C. 300mm et seq.</external-xref>) is amended—</text><paragraph id="id08469B7593C1485E965DA14913844AA9"><enum>(1)</enum><text>in section 3306 (<external-xref legal-doc="usc" parsable-cite="usc/42/300mm-5">42 U.S.C. 300mm–5</external-xref>)—</text><subparagraph id="id2961BC28D2824D6595606B7A2BDA7479"><enum>(A)</enum><text>by redesignating paragraphs (5) through (11) and paragraphs (12) through (17) as paragraphs (6) through (12) and paragraphs (14) through (19), respectively;</text></subparagraph><subparagraph id="idBA670433AAD14C17A1F1C27D02A5C63F"><enum>(B)</enum><text>by inserting after paragraph (4) the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id49DE0D64B5E546C281DCC2530CDC7D8E"><paragraph id="idD4F2411B14874778AC6A050020D66645"><enum>(5)</enum><text>The term <term>Federal agency</term> means an agency, office, or other establishment in the executive, legislative, or judicial branch of the Federal Government.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id9313A594645B40C39D837F0FC3AC69BF"><enum>(C)</enum><text>by inserting after paragraph (12), as so redesignated, the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id015B0C1CAAFC43D383A45D755DC56629"><paragraph id="id25D6ADC7A11F40B28D4E5A67A380C41D"><enum>(13)</enum><text>The term <term>uniformed services</term> has the meaning given the term in section 101(a) of title 10, United States Code.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id80742162CD4A4F0A814A2B6B3002A17C"><enum>(2)</enum><text>in section 3311(a) (<external-xref legal-doc="usc" parsable-cite="usc/42/300mm-21">42 U.S.C. 300mm–21(a)</external-xref>)—</text><subparagraph id="id8F44C136D859463D948452A33092570F"><enum>(A)</enum><text>in paragraph (2)(C)(i)—</text><clause id="id385C92804ED74160BCA3AF2D16170BB8"><enum>(i)</enum><text>in subclause (I), by striking <quote>; or</quote> and inserting a semicolon;</text></clause><clause id="idB80C97B5B876495294917644AAC56040"><enum>(ii)</enum><text>in subclause (II), by striking <quote>; and</quote> and inserting a semicolon; and</text></clause><clause id="id886EF38ECA0F448D82434458F81C7C3D"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1EE71FC6FF0D4AF1A4FFE8098B1741E7"><subclause id="id44349BC66B854357A38368AFE0CAC630" indent="up1"><enum>(III)</enum><text>was an employee of the Department of Defense or any other Federal agency, worked during the period beginning on September 11, 2001, and ending on September 18, 2001, for a contractor of the Department of Defense or any other Federal agency, or was a member of a regular or reserve component of the uniformed services; and performed rescue, recovery, demolition, debris cleanup, or other related services at the Pentagon site of the terrorist-related aircraft crash of September 11, 2001, during the period beginning on September 11, 2001, and ending on the date on which the cleanup of the site was concluded, as determined by the WTC Program Administrator; or</text></subclause><subclause id="id4DB18BFDB4EA4D0BA21B9EB041E4807E" indent="up1"><enum>(IV)</enum><text>was an employee of the Department of Defense or any other Federal agency, worked during the period beginning on September 11, 2001, and ending on September 18, 2001, for a contractor of the Department of Defense or any other Federal agency, or was a member of a regular or reserve component of the uniformed services; and performed rescue, recovery, demolition, debris cleanup, or other related services at the Shanksville, Pennsylvania, site of the terrorist-related aircraft crash of September 11, 2001, during the period beginning on September 11, 2001, and ending on the date on which the cleanup of the site was concluded, as determined by the WTC Program Administrator; and</text></subclause><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="idAED575309F7B40609AB2E6B473ACB6E9"><enum>(B)</enum><text>in paragraph (4)(A)—</text><clause id="id3B1E944E85AC48B6A43DDF6CAA8C6332"><enum>(i)</enum><text>by striking <quote>(A) <header-in-text level="subparagraph" style="OLC">In general</header-in-text>.—The</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id872E6DF2B871488F911CA0B5AD2EED9D"><subparagraph id="idF6B9385D3BC74E80BB1D47A83A13C5D0"><enum>(A)</enum><header>Limit</header><clause id="id51346F8BCA1D4D0CB73171985839145C"><enum>(i)</enum><header>In general</header><text>The</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause><clause id="idC254CFC0830144DBAD998FAE8A0EAC86"><enum>(ii)</enum><text>by inserting <quote>or subclause (III) or (IV) of paragraph (2)(C)(i)</quote> after <quote>or (2)(A)(ii)</quote>; and</text></clause><clause id="idE1CF00B933D44394BCF189C1D37ADFF5"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5D995F3F067E4D3D9AD9851BEAEEE1E8"><clause id="id02AB8A34B4BF42F297125A7A9E41D253"><enum>(ii)</enum><header>Certain responders to the September 11 attacks at the Pentagon and Shanksville, Pennsylvania</header><text>The total number of individuals who may be enrolled under paragraph (3)(A)(ii) based on eligibility criteria described in subclause (III) or (IV) of paragraph (2)(C)(i) shall not exceed 500 at any time.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph></section><section id="id23F87F2741EF46238155E8DC7DBF0928"><enum>3.</enum><header>Flexibility for certifications under the World Trade Center Health Program</header><subsection id="id1285d6655e0c4a6a9db0f9131616597d"><enum>(a)</enum><header>In general</header><text>Section 3305(a) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300mm-4">42 U.S.C. 300mm–4(a)</external-xref>) is amended—</text><paragraph id="id49A2367EE922404492E9C68C5D75DD71"><enum>(1)</enum><text>in paragraph (1)(A), by inserting <quote>subject to paragraph (6),</quote> before <quote>for</quote>; and</text></paragraph><paragraph id="idC7DA76E779994F87944A31AE914F1907"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id77a086428a3649728110d64d17feb1c9"><paragraph id="id521711bfb493434a9f908d11914078b2"><enum>(6)</enum><header>Licensed health care provider flexibility</header><subparagraph id="idE230983B915C4802957C89B7AFA2A1EC"><enum>(A)</enum><header>In general</header><text>For purposes of an initial health evaluation described in paragraph (1)(A) (including any such evaluation provided under section 3321(b) or through the nationwide network under section 3313), such evaluation may be conducted by a physician or any other licensed health care provider in a category of health care providers determined by the WTC Program Administrator under subparagraph (B).</text></subparagraph><subparagraph id="idBDFAC62DB33646D48232650A71B0816F"><enum>(B)</enum><header>Categories of licensed health care providers</header><text>Not later than 180 days after the date of enactment of the <short-title>9/11 Responder and Survivor Health Funding Correction Act of 2023</short-title>, the WTC Program Administrator shall issue regulations for the categories of licensed health care providers who, in addition to licensed physicians, may conduct evaluations under subparagraph (A) and make determinations under section 3312(b).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idAB3C6389FA674E3CB20A736B548031A3"><enum>(b)</enum><header>Flexibility for WTC responders</header><text display-inline="yes-display-inline">Section 3312(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300mm-22">42 U.S.C. 300mm–22(b)</external-xref>) is amended—</text><paragraph id="idB5ADA9E5BD3842D99D3DD836AB54FE33"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking <quote>physician</quote> each place it appears and inserting <quote>physician or other licensed health care provider in a category determined by the WTC Program Administrator under section 3305(a)(6)(B)</quote>;</text></paragraph><paragraph id="id1C406C917662465E9688360BB205351C"><enum>(2)</enum><text>in paragraph (2)—</text><subparagraph id="idCC894A22B2DE40FABE35C76137F5DB51"><enum>(A)</enum><text>in subparagraph (A)—</text><clause id="id7AC4832AD0E84747A3EA42E41AEA83DA"><enum>(i)</enum><text>in the matter preceding clause (i), by striking <quote>physician</quote> and inserting <quote>physician or other licensed health care provider in a category determined by the WTC Program Administrator under section 3305(a)(6)(B)</quote>;</text></clause><clause id="id4B8231C7FC7D49468304E6DF3F51DA8B"><enum>(ii)</enum><text>in clause (i), by striking <quote>physician</quote> and inserting <quote>physician or other licensed health care provider</quote>; and</text></clause><clause id="idE168FE1B5AD94483B6263D9B91DA929C"><enum>(iii)</enum><text>in clause (ii), by striking <quote>such physician's determination</quote> and inserting <quote>the determination of such physician or other licensed health care provider</quote>; and</text></clause></subparagraph><subparagraph id="id61A63A11F3F444D18098CBF2D8BF8378"><enum>(B)</enum><text>in subparagraph (B)—</text><clause id="id8DBEE81E8E1D42929322B49D8C564454"><enum>(i)</enum><text>in the matter preceding clause (i), by striking <quote>physician determinations</quote> and inserting <quote>determinations by physicians or other licensed health care providers in categories determined by the WTC Program Administrator under section 3305(a)(6)(B)</quote>; and</text></clause><clause id="idC839F6B7C70542AC8D73CFCCD1555681"><enum>(ii)</enum><text>in clause (i), by striking <quote>physician panel</quote> and inserting <quote>panel of physicians or other licensed health care providers in categories determined by the WTC Program Administrator under section 3305(a)(6)(B)</quote>; and</text></clause></subparagraph></paragraph><paragraph id="id9906C25A6A9D410BA62CA0EC27D110B5"><enum>(3)</enum><text>in paragraph (5), by striking <quote>examining physician</quote> and inserting <quote>examining physician or other licensed health care provider in a category determined by the WTC Program Administrator under section 3305(a)(6)(B)</quote>.</text></paragraph></subsection></section><section id="idC65F6162788242209D6C30F399B02254"><enum>4.</enum><header>Criteria for credentialing health care providers participating in the nationwide network</header><text display-inline="no-display-inline">Title XXXIII of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300mm">42 U.S.C. 300mm et seq.</external-xref>) is amended—</text><paragraph id="idCE40F8CA113F4E2B9EF6953DF95B7AE8"><enum>(1)</enum><text>in section 3305(a)(2) (<external-xref legal-doc="usc" parsable-cite="usc/42/300mm-4">42 U.S.C. 300mm–4(a)(2)</external-xref>)—</text><subparagraph id="id900EA5D2D92F4556BFB5C20641124183"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (A)—</text><clause id="id63FC97D888CA450F8F750E739FC59325"><enum>(i)</enum><text display-inline="yes-display-inline">by striking clause (iv); and</text></clause><clause id="id606BDFDECD1240F181FADFD1E587AA81"><enum>(ii)</enum><text>by redesignating clauses (v) and (vi) as clauses (iv) and (v), respectively;</text></clause></subparagraph><subparagraph id="id2E881BCCB9DA4FE3A376DE90CD83AEB9"><enum>(B)</enum><text>by striking subparagraph (B); and</text></subparagraph><subparagraph id="idA55CC1C3DF0C46BD8697D498DC6832FD"><enum>(C)</enum><text>by redesignating subparagraphs (C) and (D) as subparagraphs (B) and (C), respectively; and</text></subparagraph></paragraph><paragraph id="id467BEE9F9F1F41C081B87DEC7DDCEA15"><enum>(2)</enum><text>in section 3313(b)(1) (<external-xref legal-doc="usc" parsable-cite="usc/42/300mm-23">42 U.S.C. 300mm–23(b)(1)</external-xref>), by striking <quote>Data Centers</quote> and inserting <quote>WTC Program Administrator</quote>.</text></paragraph></section><section id="id4f0ba58619494bf29c41b0762356f7ba"><enum>5.</enum><header>Clarifying calculation of enrollment</header><subsection id="id011c2e9ed3d74803b9953d259f872b8a"><enum>(a)</enum><header>Responders</header><text>Section 3311(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300mm-21">42 U.S.C. 300mm–21(a)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4176C9731460442B9AB1E2E742191FC9"><paragraph id="id3c5b4de268ca40b8bf0d8ffdb7e062d3"><enum>(6)</enum><header>Deceased WTC responders</header><text>An individual known to the WTC Program Administrator to be deceased shall not be included in any count of enrollees under this subsection or section 3351.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id6649413f3bad42fc8c3da69330c4e436"><enum>(b)</enum><header>Survivors</header><text>Section 3321(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300mm-31">42 U.S.C. 300mm–31(a)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id478019E0DD7A43249F8FEA0235F386A6"><paragraph id="id6bdc5b82fe3f454397ecc9ee8c6e51b6"><enum>(5)</enum><header>Deceased WTC survivors</header><text>An individual known to the WTC Program Administrator to be deceased shall not be included in any count of certified-eligible survivors under this section or in any count of enrollees under section 3351.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id1CBFED935B0B459DBF24E8D32AF8C419"><enum>6.</enum><header>Time period for adding health conditions to list for WTC responders</header><text display-inline="no-display-inline">Section 3312(a)(6) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300mm-22">42 U.S.C. 300mm–22(a)(6)</external-xref>) is amended—</text><paragraph id="idD235E2103F144B55B0C2744C81C3C5F8"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (B), by striking <quote>90</quote> and inserting <quote>180</quote>; and</text></paragraph><paragraph id="id3FD2D5239E774A91A3FBE1D3960397FB"><enum>(2)</enum><text>in subparagraph (C), in the second sentence, by striking <quote>90</quote> and inserting <quote>180</quote>.</text></paragraph></section><section id="id174CADB861964A58A24275EAE1DCE6CB"><enum>7.</enum><header>Funding for the World Trade Center Health Program</header><subsection id="idF6F1C74E2A904CA39053026BA826FFF7"><enum>(a)</enum><header>Federal funding</header><text display-inline="yes-display-inline">Section 3351 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300mm-61">42 U.S.C. 300mm–61</external-xref>) is amended—</text><paragraph id="idA26C4270703D4753A6F5CA02260CEF32"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)—</text><subparagraph id="id7BD0508817FF4949B987D3DCBFDAA16F"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (2)(A)—</text><clause id="id9A5B4F9233E64D0991819EBC928464CB"><enum>(i)</enum><text>in clause (x), by striking <quote>and</quote>;</text></clause><clause id="id564DB1BA6998476B8B30EB95E446A89F"><enum>(ii)</enum><text>in clause (xi)—</text><subclause id="idF93AFE39FA444D22BE95FC0B241D01F7"><enum>(I)</enum><text>by striking <quote>subsequent fiscal year through fiscal year 2090</quote> and inserting <quote>of fiscal years 2026 through 2033</quote>; and</text></subclause><subclause id="id571697FFA0C14E28B8A8154487A9704B"><enum>(II)</enum><text>by striking <quote>plus</quote> and inserting <quote>and</quote>; and</text></subclause></clause><clause id="id7B2E3502C305448D9043D8373EB2561A"><enum>(iii)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id847EE0E8011840A681E8B132492A0D3E"><clause id="id4B333FE6737B4C7FAF550A4E33C80F8D"><enum>(xii)</enum><text>for each of fiscal years 2034 through 2090— </text><subclause id="id37FAB8B0B8E745C9B896526C183865E9"><enum>(I)</enum><text>the amount determined under this subparagraph for the previous fiscal year (plus the sum of any amount expended in the previous fiscal year from the World Trade Center Health Program Special Fund established under section 3353 or the World Trade Center Health Program Fund for Certain WTC Responders at the Pentagon and Shanksville, Pennsylvania established under section 3354 and any amount expended from the World Trade Center Health Program Fund established under this section in the previous fiscal year that was carried over from any fiscal year prior to the previous fiscal year including as carried over pursuant to a deposit into such Fund under paragraph (6)) multiplied by 1.05; multiplied by</text></subclause><subclause id="id9E057D169CD14A94A0C860CE75B43806"><enum>(II)</enum><text>the ratio of—</text><item id="idCC35920E493440A6BB9BA7BAC821F66B"><enum>(aa)</enum><text>the total number of individuals enrolled in the WTC Program on July 1 of such previous fiscal year; to </text></item><item id="idCF64AA2223444BF7A6727C3EF10E3421"><enum>(bb)</enum><text>the total number of individuals so enrolled on July 1 of the fiscal year prior to such previous fiscal year; plus</text></item></subclause></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="id39744A111BDD42DF8FE6F460B7ADD100"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF422FE6E3B2C4943ABE759C24B66033A"><paragraph id="id7EDF469A7A9C4F5D8B268A87D70E28CA"><enum>(6)</enum><header>Remaining amounts from Special Fund and Pentagon/Shanksville Fund</header><text>Any amounts that remain available, on September 30, 2033, in the World Trade Center Health Program Special Fund under section 3353 or the World Trade Center Health Program Fund for Certain WTC Responders at the Pentagon and Shanksville, Pennsylvania under section 3354 shall be deposited into the Fund.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id0C89529455FE471CA9FBD9CED9055E5D"><enum>(2)</enum><text>in subsection (c)—</text><subparagraph id="idF9E02662A2C44B6A8FFF7FACCDF45386"><enum>(A)</enum><text>in paragraph (4)—</text><clause id="idF9B206C0D369491AB4E2A462DAE8440F"><enum>(i)</enum><text>by amending subparagraph (A) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id89CD3FD188E74FDA93D570CE81432DC8"><subparagraph id="id96E59F7E9BBC41DCBF1FD563EEA8CBCA"><enum>(A)</enum><text>for fiscal year 2023, the amount determined for such fiscal year under this paragraph as in effect on the day before the date of enactment of the <short-title>9/11 Responder and Survivor Health Funding Correction Act of 2023</short-title>;</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause id="id0044F898D36C49DFAD68165D7CCB21AD"><enum>(ii)</enum><text>in subparagraph (B), by striking <quote>2017, $15,000,000</quote> and inserting <quote>2024, $20,000,000</quote>; and</text></clause></subparagraph><subparagraph id="idFEA71597D95A4BCAB8128BA957F24186"><enum>(B)</enum><text>in paragraph (5)—</text><clause id="id147711251A1B4DC99DD3D796DE0BADBA"><enum>(i)</enum><text>by amending subparagraph (A) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD9521804C4AD4265B9A7AA101D38C708"><subparagraph id="id0035A652ED024DE3A177E6A1500D7388"><enum>(A)</enum><text>for fiscal year 2023, the amount determined for such fiscal year under this paragraph as in effect on the day before the date of enactment of the <short-title>9/11 Responder and Survivor Health Funding Correction Act of 2023</short-title>;</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause><clause id="idC7109A4B970C43D18907DCB6EE295F6D"><enum>(ii)</enum><text>by redesignating subparagraph (B) as subparagraph (C); and</text></clause><clause id="id7E90270151934FBCAB85D1E73156A026"><enum>(iii)</enum><text>by inserting after subparagraph (A) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id88EB192252DF47788385A56C28E1F6D8"><subparagraph id="id453E18D0276D448283C38CD0F293CE54"><enum>(B)</enum><text>for fiscal year 2024, the greater of—</text><clause id="id489856FAFD914267AFFD33CB031CF45C"><enum>(i)</enum><text>the amount determined for such fiscal year under this paragraph as in effect on the day before the date of enactment of the <short-title>9/11 Responder and Survivor Health Funding Correction Act of 2023</short-title>; or</text></clause><clause id="idD07850EFB2AA4051BF022876E763B51B"><enum>(ii)</enum><text>$20,000,000; and</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph></subsection><subsection id="id81C74222A5914865861FEC96E4589344"><enum>(b)</enum><header>Additional funding for the World Trade Center Health Program</header><paragraph id="id4DFFF15698B94B6EAFEE42C9F14662C3"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Title XXXIII of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300mm">42 U.S.C. 300mm et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7AA89CEAD843487FBE6F36C710813AE8"><section id="id9FB058114D714435A3C151D8D3FBC025"><enum>3353.</enum><header>Special Fund</header><subsection id="id676370A32FE1488D81C98C5764F94447"><enum>(a)</enum><header>In general</header><text>There is established a fund to be known as the World Trade Center Health Program Special Fund (referred to in this section as the <quote>Special Fund</quote>), consisting of amounts deposited into the Special Fund under subsection (b).</text></subsection><subsection id="id23386688849C4860A56016B794655A19"><enum>(b)</enum><header>Amount</header><text>Out of any money in the Treasury not otherwise appropriated, there is appropriated for fiscal year 2024 $1,784,358,336 for deposit into the Special Fund, which amounts shall remain available in such Fund through fiscal year 2033.</text></subsection><subsection id="id5C269A801E434347843E62C2AEE81629"><enum>(c)</enum><header>Uses of funds</header><text>Amounts deposited into the Special Fund under subsection (b) shall be available, without further appropriation and without regard to any spending limitation under section 3351(c), to the WTC Program Administrator as needed at the discretion of such Administrator, for carrying out any provision in this title (including sections 3303 and 3341(c)).</text></subsection><subsection id="id6E9AA8A2DF8146BB9F82490A1936DCAC"><enum>(d)</enum><header>Remaining amounts</header><text>Any amounts that remain in the Special Fund on September 30, 2033, shall be deposited into the World Trade Center Health Program Fund in accordance with section 3351(a)(6) and remain available in accordance with section 3351(a)(5).</text></subsection></section><section id="idFC1C09DC5AAB465B8D8F35D42861894B"><enum>3354.</enum><header>Pentagon/Shanksville Fund</header><subsection id="idAC5F73308B03403F98C7C2CAA431CBA3"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">There is established a fund to be known as the World Trade Center Health Program Fund for Certain WTC Responders at the Pentagon and Shanksville, Pennsylvania (referred to in this section as the <quote>Pentagon/Shanksville Fund</quote>), consisting of amounts deposited into the Pentagon/Shanksville Fund under subsection (b).</text></subsection><subsection id="idCA074BCA53D04BCE8C44DDFC41ED0D2F"><enum>(b)</enum><header>Amount</header><text>Out of any money in the Treasury not otherwise appropriated, there is appropriated for fiscal year 2024 $257,000,000 for deposit into the Pentagon/Shanksville Fund, which amounts shall remain available in such Fund through fiscal year 2033.</text></subsection><subsection id="id1BC18C8180F647418149FAA6536FB58B"><enum>(c)</enum><header>Uses of funds</header><paragraph id="id8486310AEBB0448CBC7012538468FAE1"><enum>(1)</enum><header>In general</header><text>Amounts deposited into the Pentagon/Shanksville Fund under subsection (b) shall be available, without further appropriation and without regard to any spending limitation under section 3351(c), to the WTC Program Administrator for the purpose of carrying out section 3312 with regard to WTC responders enrolled in the WTC Program based on eligibility criteria described in subclause (III) or (IV) of section 3311(a)(2)(C)(i).</text></paragraph><paragraph id="id6479417CF8AF4821A2514CA8073B5614"><enum>(2)</enum><header>Limitation on other funding</header><text>Notwithstanding sections 3331(a), 3351(b)(1), 3352(c), and 3353(c), and any other provision in this title, for the period of fiscal years 2024 through 2033, no amounts made available under this title other than those amounts appropriated under subsection (b) may be available for the purpose described in paragraph (1).</text></paragraph></subsection><subsection id="id2141512964E14ABE995815F4FF3A1523"><enum>(d)</enum><header>Remaining amounts</header><text display-inline="yes-display-inline">Any amounts that remain in the Pentagon/Shanksville Fund on September 30, 2033, shall be deposited into the World Trade Center Health Program Fund in accordance with section 3351(a)(6) and remain available in accordance with section 3351(a)(5).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id339643AD4C8F4438BF52562F6F7DB2CB"><enum>(c)</enum><header>Conforming amendments</header><text>Title XXXIII of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300mm">42 U.S.C. 300mm et seq.</external-xref>) is amended—</text><paragraph id="id497A09A2AED0479E9D507894907801F6"><enum>(1)</enum><text>in section 3311(a)(4)(B)(i)(II) (<external-xref legal-doc="usc" parsable-cite="usc/42/300mm-21">42 U.S.C. 300mm–21(a)(4)(B)(i)(II)</external-xref>), by striking <quote>sections 3351 and 3352</quote> and inserting <quote>this title</quote>;</text></paragraph><paragraph id="id9D7A6F168831459EA47BBF66BC6FA44C"><enum>(2)</enum><text>in section 3321(a)(3)(B)(i)(II) (<external-xref legal-doc="usc" parsable-cite="usc/42/300mm-31">42 U.S.C. 300mm–31(a)(3)(B)(i)(II)</external-xref>), by striking <quote>sections 3351 and 3352</quote> and inserting <quote>this title</quote>;</text></paragraph><paragraph id="id0F8BEEFE0997482AB9132CECB6ACE68A"><enum>(3)</enum><text>in section 3331 (<external-xref legal-doc="usc" parsable-cite="usc/42/300mm-41">42 U.S.C. 300mm–41</external-xref>)—</text><subparagraph id="idB27549179C7D4B348615E56174601A04"><enum>(A)</enum><text>in subsection (a), by striking <quote>the World Trade Center Health Program Fund and the World Trade Center Health Program Supplemental Fund</quote> and inserting <quote>(as applicable) the Funds established under sections 3351, 3352, 3353, and 3354</quote>; and</text></subparagraph><subparagraph id="id2227BC19CE1D4467AF2E2342131478E8"><enum>(B)</enum><text>in subsection (d)—</text><clause id="idF5082975F7E74A78B7D84982B1A2A8CD"><enum>(i)</enum><text>in paragraph (1)(A), by inserting <quote>or the World Trade Center Health Program Special Fund under section 3353</quote> after <quote>section 3351</quote>; </text></clause><clause id="id1977F041C4F84D99BD50E8107154103E"><enum>(ii)</enum><text>in paragraph (1)(B), by inserting <quote>or the World Trade Center Health Program Fund for Certain WTC Responders at the Pentagon and Shanksville, Pennsylvania under section 3354</quote> after <quote>section 3352</quote>; and</text></clause><clause id="idB4EA03C9D4884D6D94A9719DB21C59BA"><enum>(iii)</enum><text>in paragraph (2), in the flush text following subparagraph (C), by inserting <quote>or the World Trade Center Health Program Fund for Certain WTC Responders at the Pentagon and Shanksville, Pennsylvania under section 3354</quote> after <quote>section 3352</quote>; and</text></clause></subparagraph></paragraph><paragraph id="id27CDA1A8744F490B88B792BE3E0D9DCB"><enum>(4)</enum><text>in section 3351(b)
