which was read twice, considered, read the third time, and passed</action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Marine Debris Act to improve the administration of the Marine Debris Program of the National Oceanic and Atmospheric Administration, to improve the administration of the Marine Debris Foundation, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Save Our Seas 2.0 Amendments Act</short-title></quote>.</text></section><section id="id44adb39e5bbd49c1a6124fafa6aaf30f"><enum>2.</enum><header>Modifications to the Marine Debris Program of the National Oceanic and Atmospheric Administration</header><text display-inline="no-display-inline">Section 3(d) of the Marine Debris Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1952">33 U.S.C. 1952(d)</external-xref>) is amended—</text><paragraph id="id5687903fc8614f09830c94d9aa4eb372"><enum>(1)</enum><text>in the subsection heading, by striking <quote><header-in-text style="OLC" level="subsection">and contracts</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="subsection">contracts, and other agreements</header-in-text></quote>;</text></paragraph><paragraph id="id83a157cd2007462d88cc03a177c01e87"><enum>(2)</enum><text>in paragraph (1), by striking <quote>and contracts</quote> and inserting <quote>, contracts, and other agreements</quote>;</text></paragraph><paragraph id="id6dd4b5906b93499299f0a1f6d592c4a9"><enum>(3)</enum><text>in paragraph (2)—</text><subparagraph id="idc63f6122d24f4128aca52dcee711f18a"><enum>(A)</enum><text>in subparagraph (B)—</text><clause id="id6962229ea25a4f2bb4e84ce0b0d70287"><enum>(i)</enum><text>by striking <quote>part of the</quote> and inserting <quote>part of a</quote>; and</text></clause><clause id="id1ec3ce967acd4bd6ac81a437eac80c80"><enum>(ii)</enum><text>by inserting <quote>or (C)</quote> after <quote>subparagraph (A)</quote>; and</text></clause></subparagraph><subparagraph id="id2090bc366b614a88bd98adb06e506580"><enum>(B)</enum><text>in subparagraph (C), in the matter preceding clause (i), by inserting <quote>and except as provided in subparagraph (B)</quote> after <quote>subparagraph (A)</quote>; and</text></subparagraph></paragraph><paragraph id="id688ab351cfba477b84084fcacab75d87"><enum>(4)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id49295bde26e44876ad40c8fda40bc996"><paragraph id="id5f4e9deea7724430b534ecea6b52e6f5"><enum>(7)</enum><header>In-kind contributions</header><text>With respect to any project carried out pursuant to a contract or other agreement entered into under paragraph (1) that is not a cooperative agreement or an agreement to provide financial assistance in the form of a grant, the Under Secretary may contribute on an in-kind basis the portion of the costs of the project that the Under Secretary determines represents the amount of benefit the National Oceanic and Atmospheric Administration derives from the project.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="idb6092898c0404a9484fde22d880adc0d"><enum>3.</enum><header>Modifications to the Marine Debris Foundation</header><subsection id="id203a081bbcde4fae8f06027516a04eec" commented="no"><enum>(a)</enum><header>Status of Foundation</header><text>Section 111(a) of the Save Our Seas 2.0 Act (<external-xref legal-doc="usc" parsable-cite="usc/33/4211">33 U.S.C. 4211(a)</external-xref>) is amended, in the second sentence, by striking <quote>organization</quote> and inserting <quote>corporation</quote>.</text></subsection><subsection id="idd8c6e6ad36414928a75d4719b2aeee29"><enum>(b)</enum><header>Purposes</header><text>Section 111(b)(3) of the Save Our Seas 2.0 Act (<external-xref legal-doc="usc" parsable-cite="usc/33/4211">33 U.S.C. 4211(b)(3)</external-xref>) is amended by inserting <quote>Indian Tribes,</quote> after <quote>Tribal governments,</quote>.</text></subsection><subsection id="id7d7e5a9b80c04b96ac53e94493711870"><enum>(c)</enum><header>Board of directors</header><paragraph id="idfce4f00fa5be4b3aaa99e5a800c5ae8c"><enum>(1)</enum><header>Appointment, vacancies, and removal</header><text>Section 112(b) of the Save Our Seas 2.0 Act (<external-xref legal-doc="usc" parsable-cite="usc/33/4212">33 U.S.C. 4212(b)</external-xref>) is amended—</text><subparagraph id="id02cd30a8374b433483bc078ce546f96f"><enum>(A)</enum><text>by redesignating paragraphs (1) through (5) as paragraphs (2) through (6), respectively; </text></subparagraph><subparagraph id="id8fdf0f9a51424585a8aca70298bfa6d5"><enum>(B)</enum><text>by inserting before paragraph (2) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id89ab347c45594ba582153ea3e85c58dd"><paragraph id="idf8ed5d443d91414a8e571fba0bf10ddc"><enum>(1)</enum><header>Recommendations of Board regarding appointments</header><text>For appointments made under paragraph (2), the Board shall submit to the Under Secretary recommendations on candidates for appointment.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="id11fc8e2724f64d34af03204d168a666b"><enum>(C)</enum><text>in paragraph (2), as redesignated by subparagraph (A), in the matter preceding subparagraph (A)—</text><clause id="id3d454d2a6e7f4be6a8058a15d1464d00"><enum>(i)</enum><text>by striking <quote>paragraph (2)</quote> and inserting <quote>paragraph (3)</quote>;</text></clause><clause commented="no" display-inline="no-display-inline" id="id9480abaa83584be8b3af1e5d58e3355a"><enum>(ii)</enum><text display-inline="yes-display-inline">by striking <quote>and considering</quote> and inserting <quote>considering</quote>; and</text></clause><clause id="idf5e867bf3eb94b518f266da7faa4eea8"><enum>(iii)</enum><text>by inserting <quote>under paragraph (1), and with the approval of the Secretary of Commerce</quote> after <quote>by the Board</quote>;</text></clause></subparagraph><subparagraph id="id326bd6e2131d447fa23f80cc3e08d882"><enum>(D)</enum><text>by amending paragraph (3), as so redesignated, to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id60d587f749874c30b3d974f31b2a56c8"><paragraph id="idc8e8efad14cd410ba1be60d653ccfcb8"><enum>(3)</enum><header>Terms</header><text>Any Director appointed under paragraph (2) shall be appointed for a term of 6 years.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="id9be326e48f414899b0f1444939c1f385"><enum>(E)</enum><text>in subparagraph (A) of paragraph (4), as so redesignated, by inserting <quote>with the approval of the Secretary of Commerce</quote> after <quote>the Board</quote>; and</text></subparagraph><subparagraph id="id77e255da882747d78906f851d4334845"><enum>(F)</enum><text>in paragraph (6), as so redesignated—</text><clause id="idb5639b5373314eaf88e65d680422d58c"><enum>(i)</enum><text>by inserting <quote>the Administrator of the United States Agency for International Development,</quote> after <quote>Service,</quote>; and</text></clause><clause id="idb8ce8c7f049446399f3ca951ae946754"><enum>(ii)</enum><text>by inserting <quote>, and with the approval of the Secretary of Commerce</quote> after <quote>EPA Administrator</quote>.</text></clause></subparagraph></paragraph><paragraph id="id4886b32d6e2b40a6835896e0fe54fccb"><enum>(2)</enum><header>General powers</header><text>Section 112(g) of the Save Our Seas 2.0 Act (<external-xref legal-doc="usc" parsable-cite="usc/33/4212">33 U.S.C. 4212(g)</external-xref>) is amended—</text><subparagraph id="idec769a9735c14471961c9d8b91aee47f"><enum>(A)</enum><text>in paragraph (1)(A), by striking <quote>officers and employees</quote> and inserting <quote>the initial officers and employees</quote>; and</text></subparagraph><subparagraph id="idc78275ac73444fd59215362237b40149"><enum>(B)</enum><text>in paragraph (2)(B)(i), by striking <quote>its chief operating officer</quote> and inserting <quote>the chief executive officer of the Foundation</quote>.</text></subparagraph></paragraph><paragraph id="id8ba1537bae0b4846ab9d8c32825813df"><enum>(3)</enum><header>Chief executive officer</header><text>Section 112 of the Save Our Seas 2.0 Act (<external-xref legal-doc="usc" parsable-cite="usc/33/4212">33 U.S.C. 4212</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF7F58CD2254D4E6BBF3AC71FF2C193FC"><subsection id="id645ac2577e89410683273acace1d775a"><enum>(h)</enum><header>Chief executive officer</header><paragraph id="id332e06d40180463886d2f33f420237ab"><enum>(1)</enum><header>Appointment; removal; review</header><text>The Board shall appoint and review the performance of, and may remove, the chief executive officer of the Foundation.</text></paragraph><paragraph id="id23481bda1fb94b1bbbdc21f2054ee688"><enum>(2)</enum><header>Powers</header><text>The chief executive officer of the Foundation may appoint, remove, and review the performance of any officer or employee of the Foundation.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id4f15b472316c424cb504baf92f96165e"><enum>(d)</enum><header>Powers of Foundation</header><text>Section 113(c)(1) of the Save Our Seas 2.0 Act (<external-xref legal-doc="usc" parsable-cite="usc/33/4213">33 U.S.C. 4213(c)(1)</external-xref>) is amended, in the matter preceding subparagraph (A)—</text><paragraph id="idb4aaacbdd2454f69bb417fc5af6a130e" commented="no"><enum>(1)</enum><text>by inserting <quote>nonprofit</quote> before <quote>corporation</quote>; and</text></paragraph><paragraph id="id2d06c7b0b4694222808662670bf4f67f"><enum>(2)</enum><text>by striking <quote>acting as a trustee</quote> and inserting <quote>formed</quote>.</text></paragraph></subsection><subsection id="id1447c00a01f3445ca75f68500ef53341"><enum>(e)</enum><header>Principal office</header><text>Section 113 of the Save Our Seas 2.0 Act (<external-xref legal-doc="usc" parsable-cite="usc/33/4213">33 U.S.C. 4213</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idc33d787970ef4625ba80bbfed9646f7f"><subsection id="ide78cb0fa1ab64bf1a28bff026076a9ee"><enum>(g)</enum><header>Principal office</header><text>The Board may locate the principal office of the Foundation in the National Capital Region, as such term is defined in section 2674(f)(2) of title 10, United States Code, or a coastal shoreline community.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="ide027b05a1f634d488853bc5aeb52c193"><enum>(f)</enum><header>Best practices; rule of construction</header><text>Section 113 of the Save Our Seas 2.0 Act (<external-xref legal-doc="usc" parsable-cite="usc/33/4213">33 U.S.C. 4213</external-xref>), as amended by subsection (e), is further amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idce04474d81174308863cd4df135aba64"><subsection id="idb6ac5ffbcea84f628ff12beeef0ed992"><enum>(h)</enum><header>Best practices for outreach to Indian Tribes</header><paragraph id="idc838a2c433ce46d9a442ec76213ef120"><enum>(1)</enum><header>In general</header><text>The Foundation shall develop and implement best practices for conducting outreach to Indian Tribes.</text></paragraph><paragraph id="idd7abcadf664540ae9d9e8e7272f70810"><enum>(2)</enum><header>Requirements</header><text>The best practices developed under paragraph (1) shall—</text><subparagraph id="id26271e1f810e4c458aa260a46695f458"><enum>(A)</enum><text>include a process to support technical assistance and capacity building to improve outcomes; and</text></subparagraph><subparagraph id="ide27372aa14024d248b155f58c0c9e14d"><enum>(B)</enum><text>promote an awareness of programs and grants available under this Act.</text></subparagraph></paragraph></subsection><subsection id="id3179ebb519734c938c14021f04011238"><enum>(i)</enum><header>Rule of construction</header><text>Nothing in this Act may be construed—</text><paragraph id="id865589eff2f64ff0984de3c82cff4db6"><enum>(1)</enum><text>to satisfy any requirement for government-to-government consultation with Tribal governments; or</text></paragraph><paragraph id="idd7a42ed261e34486a598664278c1a0e4"><enum>(2)</enum><text>to affect or modify any treaty or other right of any Tribal government.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idf6eaf580c7e9412aabaee97ddd537fd9" commented="no"><enum>(g)</enum><header>Use of funds</header><text>Section 118(a)(2) of the Save Our Seas 2.0 Act (<external-xref legal-doc="usc" parsable-cite="usc/33/4218">33 U.S.C. 4218(a)(2)</external-xref>) is amended by striking <quote>and State and local government agencies</quote> and inserting <quote>, State and local government agencies, United States and international nongovernmental organizations, regional organizations, Indian Tribes, Tribal organizations, and foreign government entities</quote>.</text></subsection></section><section id="id7069ede9b3ea4ccfbe54969409cb66c8"><enum>4.</enum><header>Organization of Marine Debris Act</header><subsection id="idb122ca56560247ac94133206bb176da7" commented="no"><enum>(a)</enum><header>In general</header><text>The Marine Debris Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1951">33 U.S.C. 1951 et seq.</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idad330c51f6ba478da9db7e7eec1581c0"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting before section 3 the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id81D2BF7C5DDE45C183B552F5431F2889"><subtitle id="id6aefc9a53deb40beb8aedcfad055276c" commented="no"><enum>A</enum><header>National Oceanic and Atmospheric Administration and Coast Guard programs</header></subtitle><after-quoted-block>; </after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6848ede136f34ff78bd6d5aadcc7b53a"><enum>(2)</enum><text>by redesignating sections 3 through 6 as sections 101 through 104, respectively; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8739b77a298c4eb49ba9c967763f545d"><enum>(3)</enum><text>by redesignating sections 7 through 10 as sections 131 through 134, respectively; and</text></paragraph><paragraph id="id741FE59DA83F4E35908DA3920196E12E"><enum>(4)</enum><text>by inserting before section 131, as redesignated by paragraph (3), the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9D23395418DB404A9D65EA0B03F7E953"><subtitle id="idD713440ED65D4E189D770255AE980191"><enum>D</enum><header>Administration</header></subtitle><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id48cd7b13c65f4aefb5d38c06c578c5d5"><enum>(b)</enum><header>Marine Debris Foundation</header><text>Subtitle B of title I of the Save Our Seas 2.0 Act (<external-xref legal-doc="usc" parsable-cite="usc/33/4211">33 U.S.C. 4211 et seq.</external-xref>) is—</text><paragraph commented="no" display-inline="no-display-inline" id="id7c5026af375b449dbf2791b73a0d23c6"><enum>(1)</enum><text display-inline="yes-display-inline">transferred to the Marine Debris Act; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9b216130762241dfb8fb24ef0ebe0230"><enum>(2)</enum><text display-inline="yes-display-inline">inserted after section 104 of the Marine Debris Act, as redesignated by subsection (a)(2).</text></paragraph></subsection><subsection id="id36ff027e401f4ccfa694fa4dafccf504" commented="no"><enum>(c)</enum><header>Genius Prize for Save Our Seas Innovations</header><text>Subtitle C of title I of the Save Our Seas 2.0 Act (<external-xref legal-doc="usc" parsable-cite="usc/33/4231">33 U.S.C. 4231 et seq.</external-xref>) is—</text><paragraph commented="no" display-inline="no-display-inline" id="ida3eda8d5aa1945669c04db04061d5888"><enum>(1)</enum><text display-inline="yes-display-inline">transferred to the Marine Debris Act; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id16a151a623d64b968e20b251a8c274f1"><enum>(2)</enum><text display-inline="yes-display-inline">inserted after section 119 of the Marine Debris Act, as transferred and inserted by subsection (b).</text></paragraph></subsection></section><section id="idfc678e5ccc904d29a16fb3e4682cc05d"><enum>5.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 131 of the Marine Debris Act, as redesignated by section 4(a)(3), is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id2d889d2310e24f96a5ee1a71f0f11d17"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (2), (3), (4), (5), (6), and (7) as paragraphs (4), (5), (6), (10), (11), and (12), respectively; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5c6c940b26444371930f8bbd7c2aba5b"><enum>(2)</enum><text display-inline="yes-display-inline">by striking paragraph (1) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idbc0f3c55f0e343bcb81859585ecbd17c"><paragraph id="idd23ead755e0740358952de7dcc6323a2"><enum>(1)</enum><header>Circular economy</header><text>The term <term>circular economy</term> has the meaning given such term in section 2 of the Save Our Seas 2.0 Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/224">Public Law 116–224</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/33/4201">33 U.S.C. 4201</external-xref> note).</text></paragraph><paragraph id="idc857a94c31c247ec8d0b0be2f6e69e66"><enum>(2)</enum><header>Coastal shoreline community</header><text>The term <term>coastal shoreline community</term> means a city or county directly adjacent to the open ocean, a major estuary, or one of the Great Lakes.</text></paragraph><paragraph id="id02117fcf6d1744688d5cd7cbd88ce22c"><enum>(3)</enum><header>EPA Administrator</header><text>The term <term>EPA Administrator</term> means the Administrator of the Environmental Protection Agency.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc50a0dc16ce34f58835f66e05c509dc7"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after paragraph (6), as redesignated by paragraph (1), the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF0A6824ECDC641539457CE328A780DB1"><paragraph id="PH6B3B9435433C4D3C8192AEB2832BA6AC"><enum>(7)</enum><header>Non-federal funds</header><text>The term <term>non-Federal funds</term> means funds provided by—</text><subparagraph id="PHC155E12B1C614DF1A21C42C1875507D8"><enum>(A)</enum><text>a State; </text></subparagraph><subparagraph id="PHFF0D44A41CD34B4BBC0FE91EED7D5F69"><enum>(B)</enum><text>an Indian Tribe; </text></subparagraph><subparagraph id="PH24926C0106C841F282A46725E3DFA4F8"><enum>(C)</enum><text>a territory of the United States; </text></subparagraph><subparagraph id="PH1CADC071AE224AD5B0C8188E9571AAD5"><enum>(D)</enum><text>one or more units of local governments or Tribal organizations; </text></subparagraph><subparagraph id="PHFA29882EA5BE4883B71643E5A227DFCB"><enum>(E)</enum><text>a foreign government; </text></subparagraph><subparagraph id="PHF6DD3F42225B4EF3AA30584673C4100A"><enum>(F)</enum><text>a private for-profit entity; </text></subparagraph><subparagraph id="PH4CEDAA5F67C843B7BC30A356CF36E01C"><enum>(G)</enum><text>a nonprofit organization; or </text></subparagraph><subparagraph id="PHD66256D196154C54B81CF38D47B6328A"><enum>(H)</enum><text>a private individual. </text></subparagraph></paragraph><paragraph id="idd671ce4b91cf4082b324f2815a6d141a"><enum>(8)</enum><header>Nonprofit</header><text>The term <term>nonprofit</term>, with respect to a corporation or other organization, means the corporation or other organization is described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)</external-xref> of the Internal Revenue Code of 1986 and exempt from tax under section 501(a) of such Code. </text></paragraph><paragraph id="idb82b254b19aa4f48aec96f164ffda0b2"><enum>(9)</enum><header>Post-consumer materials management</header><text>The term <term>post-consumer materials management</term> has the meaning given such term in section 2 of the Save Our Seas 2.0 Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/224">Public Law 116–224</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/33/4201">33 U.S.C. 4201</external-xref> note).</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id49c166e8d82749669afc64bc3c261a86"><enum>(4)</enum><text>in paragraph (12), as so redesignated—</text><subparagraph id="idd5f6ed95e83e4ed5a168163d174b38d5"><enum>(A)</enum><text>by redesignating subparagraphs (B), (C), and (D) as subparagraphs (C), (D), and (E), respectively; and</text></subparagraph><subparagraph id="id6290ee2270264343bea46af17b1f4b30"><enum>(B)</enum><text>by inserting after subparagraph (A) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3a1e7d6a287d439cb5aac0a35c6b5191"><subparagraph id="ide60e775b75414d8e84412f6f19921e12"><enum>(B)</enum><text>Indian Tribe;</text></subparagraph><after-quoted-block>;
