which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require Federal agencies to impose in-person work requirements for employees of those agencies and to occupy a certain portion of the office space of those agencies, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Reinforce Occupancy Obligations for Maximized Interagency Efficiency Act</short-title></quote> or the <quote><short-title>ROOMIE Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="idf101aa1819614393bb47ee639b9a3d58"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act: </text><paragraph commented="no" display-inline="no-display-inline" id="ida44dbe758bf044218bf92bbecdf593b5"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of General Services.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7d85ccd6fdca41a4a7cfb7ad56e686b8"><enum>(2)</enum><header>Federal agency</header><text display-inline="yes-display-inline">The term <term>Federal agency</term> has the meaning given the term in section 621 of title 40, United States Code.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id01f01d75ba4e4ba286c877c9207ddd8b"><enum>(3)</enum><header>Federal civilian real property</header><text>The term <term>Federal civilian real property</term> has the meaning given the term in section 3 of the Federal Assets Sale and Transfer Act of 2016 (<external-xref legal-doc="usc" parsable-cite="usc/40/1303">40 U.S.C. 1303</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/114/287">Public Law 114–287</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id840bca2701104398a966e2a070f36b63"><enum>(4)</enum><header>Usable square feet</header><text>The term <term>usable square feet</term> has the meaning given the term by the Administrator.</text></paragraph></section><section id="idd7ba1318c4674685a3bf21a7dbd18cba"><enum>3.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text><paragraph id="id42488b979b5b4272b1a6a9b511d828e0"><enum>(1)</enum><text>according to a 2023 review of Federal agencies by the Government Accountability Office—</text><subparagraph id="id36b9b1bb86ea44eda78d1b7a59fcf95c"><enum>(A)</enum><text>17 Federal agencies <quote>used on average an estimated 25 percent or less of the capacity of their headquarters buildings</quote>; and</text></subparagraph><subparagraph id="ide410f1cc19ff49fc812a55e4580a460a"><enum>(B)</enum><text>1 Federal agency headquarters examined would only occupy 67 percent of the office space of the Federal agency if 100 percent of the employees of the Federal agency worked in-person;</text></subparagraph></paragraph><paragraph id="id6abe8fb2dd2d4b92982b939775da76e3"><enum>(2)</enum><text>according to a 2024 report by the Public Buildings Reform Board established by section 4(a) of the Federal Assets Sale and Transfer Act of 2016 (<external-xref legal-doc="usc" parsable-cite="usc/40/1303">40 U.S.C. 1303</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/114/287">Public Law 114–287</external-xref>)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idfdb2f31743134535a077debb5f8c10dd"><enum>(A)</enum><text display-inline="yes-display-inline">in the National Capital Region, the Federal Government owns or leases almost 90,000,000 square feet of property;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9610aafc890540f399409388ea702e88"><enum>(B)</enum><text>a sample of Federal properties in Washington, D.C., maintained only 12 percent capacity on average;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1191a17af5f1428db77a201b93ba8d2c"><enum>(C)</enum><text><quote>billions of dollars are being expended on buildings that should be disposed of given the new normal of low occupancy</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide928ffaf265244b4b96aba1ac1e443d7"><enum>(D)</enum><text>some Federal agencies have developed cultural expectations that they should retain a <quote>flagship</quote> property despite significant under usage of that property; and</text></subparagraph></paragraph><paragraph id="idaa315129a5654d3da0db36890428b990"><enum>(3)</enum><text>according to a 2023 report by the Office of Audits of the Office of Inspector General of the General Services Administration—</text><subparagraph commented="no" display-inline="no-display-inline" id="id2010bab328984ca584e58fede3270efa"><enum>(A)</enum><text display-inline="yes-display-inline">Federal Government buildings can pose significant health risks if they remain underutilized; and</text></subparagraph><subparagraph id="id870ee97ba329458499c687fa68d96ac8" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">since July 2023, <quote>elevated levels of Legionella</quote>, which is a bacterium that can cause serious infection and death, <quote>were found in six GSA-controlled buildings, all of which are open to the public</quote>.</text></subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="ida992fae18d494410bf7b460a069bbe75"><enum>4.</enum><header>In-person work requirements</header><subsection commented="no" display-inline="no-display-inline" id="id757dbe5cfc0d4ab8afeb497a5cf2c304"><enum>(a)</enum><header>Federal agency policy modification</header><paragraph commented="no" display-inline="no-display-inline" id="iddb8980a69c764f05aaeafc0e041bcff7"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 120 days after the date of enactment of this Act, the head of each Federal agency shall amend the policies of the Federal agency, if necessary, to require—</text><subparagraph commented="no" display-inline="no-display-inline" id="id9d7bc193264043adadbb9bebefeef2cc"><enum>(A)</enum><text display-inline="yes-display-inline">not less than 80 percent of the employees of the Federal agency to work in-person Monday through Friday of each week, not including any day that is a legal public holiday described in section 6103 of title 5, United States Code, as certified by the Director of the Office of Personnel Management; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5a7648cec81b45bc83ca19e99d6c5f2c"><enum>(B)</enum><text>except as provided in paragraph (2), not less than 60 percent of the usable square feet of the office space of the Federal agency in any Federal civilian real property owned, leased, or controlled by the Federal agency to be occupied by employees of the Federal agency, as certified by the Administrator.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd97bd3c4aaf34627bdaf4513b665943b"><enum>(2)</enum><header>Exception</header><subparagraph commented="no" display-inline="no-display-inline" id="idb9bf06e9bc34418b800a502b6c26b3d0"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">If a Federal agency does not employ enough individuals to occupy 60 percent of the usable square feet of the office space of the Federal agency in any Federal civilian real property owned, leased, or controlled by the Federal agency, the head of the Federal agency shall, not later than 1 year after the date of enactment of this Act, prepare and submit to the Administrator, the Committee on Environment and Public Works of the Senate, and the Committee on Transportation and Infrastructure of the House of Representatives an occupancy plan in accordance with subparagraph (B). </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8fd3986e2f2b4de0ace81b4f7d45a747"><enum>(B)</enum><header>Requirements</header><text display-inline="yes-display-inline">An occupancy plan prepared and submitted under subparagraph (A) shall detail how the Federal agency plans to reach 60 percent occupancy in the usable square feet of the office space of the Federal agency in any Federal civilian real property owned, leased, or controlled by the Federal agency through the use of individuals employed by any Federal agency, with special consideration given to individuals employed by different Federal agencies.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id6092708708ca480e909ef17d1665efea"><enum>(b)</enum><header>Report</header><text>Not later than 1 year after the date that is 120 days after the date of enactment of this Act, the Comptroller General of the United States shall submit to Congress a report regarding the implementation of the requirement under subsection (a)(1), as certified by the Director of the Office of Personnel Management and the Administrator, as applicable.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="id0706cc62ec164d9b951217378f07fbde"><enum>5.</enum><header>Noncompliance</header><subsection commented="no" display-inline="no-display-inline" id="idbdf1960240044bb7bb3c61e49ff87f20"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">If a Federal agency fails to comply with section 4(a) by the deadlines described in that section, the Federal agency or the General Services Administration, as applicable, shall sell, terminate, or be prohibited from re-signing the lease for, the applicable Federal civilian real property in accordance with subsection (b) or (c), as applicable.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idaf03f8b268e3465d94134927caa5c8fb"><enum>(b)</enum><header>Property owned or controlled by the Federal agency</header><text display-inline="yes-display-inline">If the Federal agency owns or controls the Federal civilian real property in which the office space described in subsection (a) is located, the Federal agency or the General Services Administration, as applicable, shall sell the Federal civilian real property.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id5e763750563f478c9ca8635c3eb1d9a3"><enum>(c)</enum><header>Property leased by the Federal agency</header><text>If the Federal agency leases the Federal civilian real property in which the office space described in subsection (a) is located, the Federal agency or the General Services Administration, as applicable—</text><paragraph commented="no" display-inline="no-display-inline" id="id8df3e314537c454081e35120c8793b50"><enum>(1)</enum><text display-inline="yes-display-inline">if the lease contains an early termination or other applicable provision—</text><subparagraph commented="no" display-inline="no-display-inline" id="idad29bc2d709d42ce87267cf044d0890b"><enum>(A)</enum><text display-inline="yes-display-inline">shall execute that provision and terminate the lease early; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2a6813e12d8a4a6aa41be46d791ec5e0"><enum>(B)</enum><text>shall not re-sign the lease; or</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id92a8befd0a6c4a14ba723361be210c36"><enum>(2)</enum><text>if the lease does not contain an early termination or other applicable provision, shall not re-sign the lease.</text></paragraph></subsection></section></legis-body></bill>
