Entrepreneurship</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish a grant program under the Small Business Administration, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Small Business Opportunity Grants Act of 2024</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="ide8801e8c0f44465588773ef118d31317"><enum>2.</enum><header>Definitions</header><subsection commented="no" display-inline="no-display-inline" id="idfca252d2fa414a9ca104c12bfa3370b4"><enum>(a)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Small Business Administration.</text></subsection><subsection id="id0403d81f409548989f7e949dbc95914d" commented="no"><enum>(b)</enum><header>Community development financial institution</header><text>The term <term>community development financial institution</term> has the meaning given the term in section 103 of the Riegle Community Development and Regulatory Improvement Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/12/4702">12 U.S.C. 4702</external-xref>).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idd523a926f8a94db0a790e7a89dbe2ddf"><enum>(c)</enum><header display-inline="yes-display-inline">Covered lender</header><text>The term <term>covered lender</term> means a lender authorized under section 3(a)(2)(B).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id30660bdcb22e42d985588be82fcd20f0"><enum>(d)</enum><header>Covered grant</header><text>The term <term>covered grant</term> means a grant issued by a covered lender.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idee9ba4962eca403d84c0fcfc4d9467cb"><enum>(e)</enum><header display-inline="yes-display-inline">Eligible recipient</header><text display-inline="yes-display-inline">The term <term>eligible recipient</term> means an eligible small business concern.</text></subsection><subsection id="id4b30bcb404b848c0b24b26c76d41e489" commented="no"><enum>(f)</enum><header>Minority Depository Institution</header><text>The term <term>minority depository institution</term> has the meaning given the term in section 308 of the Financial Institutions Reform, Recovery, and Enforcement Act of 1989 (<external-xref legal-doc="usc" parsable-cite="usc/12/1463">12 U.S.C. 1463</external-xref> note). </text></subsection><subsection id="id1bea326c84354edf8636189bce11f508"><enum>(g)</enum><header>Rural area</header><text>The term <term>rural area</term> means any county or other political subdivision of a State, the District of Columbia, or a territory or possession of the United States that is designated as a rural area by the Bureau of the Census.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="idaf6d94c41b5140479a4978d43b27be26"><enum>3.</enum><header>Grant program</header><subsection id="id2385594874434f829b9648eae3072a27"><enum>(a)</enum><header>Grant program</header><paragraph commented="no" display-inline="no-display-inline" id="id14c12de82e754e7a95a75db2e7f8fcc5"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator shall establish a grant program in accordance with this subsection for the purpose of awarding grants to individuals or entities who meet the criteria established under paragraph (2).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddc54934e76c14cd89e427bbfaa6b8ac5"><enum>(2)</enum><header>Eligibility criteria</header><subparagraph commented="no" display-inline="no-display-inline" id="idfc29279713fc4014a3b7737b400d30d1"><enum>(A)</enum><header>Grant recipients</header><text display-inline="yes-display-inline">The Administrator shall, in accordance with the limits described in paragraph (4), award a grant to an eligible recipient if—</text><clause commented="no" display-inline="no-display-inline" id="id548efade0cbd4c80b282ab69985f28d5"><enum>(i)</enum><text>the eligible recipient is located in—</text><subclause commented="no" display-inline="no-display-inline" id="id17ae2f50c9dc4bd0b8584a007b081be2"><enum>(I)</enum><text display-inline="yes-display-inline">a low- to moderate-income community;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id6faa1129119844bc88ef79e515d6d3b5"><enum>(II)</enum><text>a HUBZone, as that term is defined in section 31(b) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/657a">15 U.S.C. 657a(b)</external-xref>);</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id5e08c4ecc034421386977ff13149b545"><enum>(III)</enum><text>a rural area; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="ide062a9104bfc486791ff7d5ece06c4ea"><enum>(IV)</enum><text>any area for which a disaster declaration or determination described in subparagraph (A), (B), (C), or (E) of section 7(b)(2) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(b)(2)</external-xref>) has been made that has not terminated more than 2 years before the date (or later, as determined by the Administrator) on which a grant is made to the small business concern under the program, except that, in the case of a major disaster described in subsection (b)(2)(A) of such section, that period shall be 5 years;</text></subclause></clause><clause id="id466c600c33cb4a15b81f13b3064011cc"><enum>(ii)</enum><text>more than 50 percent of the employees of the eligible recipient reside in a low- or moderate-income community;</text></clause><clause id="ideb439456f14c4b94868cc4f7d938c5f2"><enum>(iii)</enum><text>the eligible recipient is a new business;</text></clause><clause id="id08b2e9a4941749eda5759bb4ca5124b2"><enum>(iv)</enum><text>the eligible recipient is owned and controlled by socially and economically disadvantaged individuals, as described in paragraphs (5) and (6)(A), respectively, of section 8(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/637">15 U.S.C. 637(a)</external-xref>) which the Administrator, in carrying out the program, shall presume includes Black Americans, Hispanic Americans, Native Americans, Asian Pacific Americans, and other minorities;</text></clause><clause id="iddfac6ff67a174b6aa3d7fc6ad71b7760"><enum>(v)</enum><text>the eligible recipient is owned and controlled by women;</text></clause><clause id="id8d32fdea43a54f25af0490477386a497"><enum>(vi)</enum><text>the eligible recipient is owned and controlled by veterans or spouses of veterans;</text></clause><clause id="idf27dd2245f954a5f950d6947321adcf2"><enum>(vii)</enum><text>the eligible recipient is owned and controlled by a member of an Indian Tribe individually identified (including parenthetically) in the most recent list published pursuant to section 104 of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5131">25 U.S.C. 5131</external-xref>);</text></clause><clause id="idb5eb3c82a0dd4988bb986194707c70fb"><enum>(viii)</enum><text>the eligible recipient is owned and controlled by an individual who has completed a term of imprisonment in a Federal, State, or local jail or prison; or</text></clause><clause id="id6a68dd8868f04a129649f76f0e78e568"><enum>(ix)</enum><text>the eligible recipient is owned and controlled by an individual with a disability, as that term is defined in section 3 of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12102">42 U.S.C. 12102</external-xref>).</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8098dadadb104b0588049079a3dad952"><enum>(B)</enum><header>Lenders</header><text>The Administrator shall, in accordance with the limits described in paragraph (4), award a grant to a lender if the lender is—</text><clause commented="no" display-inline="no-display-inline" id="id2500e378b4f3492fafcff9a33f139929"><enum>(i)</enum><text display-inline="yes-display-inline">a community development financial institution;</text></clause><clause commented="no" display-inline="no-display-inline" id="id67fec6baf6f84489b268aff2d5ae33c0"><enum>(ii)</enum><text display-inline="yes-display-inline">a minority depository institution;</text></clause><clause commented="no" display-inline="no-display-inline" id="id322b7170bae044e18b7ada1c7c419ec8"><enum>(iii)</enum><text display-inline="yes-display-inline">a lender under the Microloan Program established under subsection (m) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(m)</external-xref>);</text></clause><clause commented="no" display-inline="no-display-inline" id="idb9d0e44321394f50aa17cc9e57cf6013"><enum>(iv)</enum><text display-inline="yes-display-inline">a development company that is certified under title V of the Small Business Investment Act of 1958 (<external-xref legal-doc="usc" parsable-cite="usc/15/695">15 U.S.C. 695 et seq.</external-xref>); or</text></clause><clause commented="no" display-inline="no-display-inline" id="id39c663cee3ec4caa9e7962cfb78d90ba"><enum>(v)</enum><text display-inline="yes-display-inline">a Community Advantage Small Business Lending Company, as described in section 120.10 of title 13, Code of Federal Regulations.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida40a0e1d525244f8b52b677a23a483fb"><enum>(3)</enum><header>Limits</header><subparagraph commented="no" display-inline="no-display-inline" id="idc42455a37cbc4cfb91c623af3bd5ffb9"><enum>(A)</enum><header>Number of grants</header><text display-inline="yes-display-inline">The number of grants awarded under this subsection shall not exceed 1,000,000 grants.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id576de7cf58644ef6b5804c9eedd6f7f4"><enum>(B)</enum><header display-inline="yes-display-inline">Amount of forgiveness</header><text display-inline="yes-display-inline">The amount of a grant awarded to an eligible recipient under this subsection shall not exceed $20,000.</text></subparagraph><subparagraph id="id8394941617b840729be96d247c40d497"><enum>(C)</enum><header>No limit on other loans or grants</header><text>Notwithstanding any other provision of law, small business concerns receiving a covered grant under this Act shall not be prohibited from receiving another loan or grant.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id8ccb7da273c745e18c2a9a0be7b86f21"><enum>(b)</enum><header>Technical Assistance Grant Program</header><text>The Administrator shall establish a grant program to provide management and technical assistance to covered lenders making grants under this Act.</text></subsection><subsection id="id6c67d434afd74ad5886eb88ba0cba1b5" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header>Regulations</header><text>The Administrator shall promulgate regulations related to the grant programs under this section not later than 180 days after the date of enactment of this Act. </text></subsection><subsection id="idc06b75faf9b54b39896c1e8085fc7b44"><enum>(d)</enum><header>Authorization of Appropriations</header><text>There are authorized to be appropriated such sums as may be necessary to carry out this section for fiscal year 2025. </text></subsection></section><section commented="no" display-inline="no-display-inline" id="id33670433607946479256724ac09cd5b5"><enum>4.</enum><header>Reporting requirements for grants</header><subsection commented="no" display-inline="no-display-inline" id="id3e268ac196ce461da114388364bf4412"><enum>(a)</enum><header>Data collection</header><text>With respect to each covered grant under this Act, the Administrator shall collect data on the eligible recipient of the covered grant, which shall include the gender, race, ethnicity, sex, age, Tribal affiliation, socioeconomic status, and disability status of each eligible recipient.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id62cf426637fa47a890de1ac6a72608cc"><enum>(b)</enum><header>Publication</header><paragraph commented="no" display-inline="no-display-inline" id="id164061c757bf46eaa7ae396be83ca5cc"><enum>(1)</enum><header>In general</header><text>The Administrator shall make publicly available on the website of the Small Business Administration, in a disaggregated format, the data collected under subsection (a), which shall be updated not later than 7 days after the date on which a covered grant is approved.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id37ad9a1ec4384831a463e7a216e142d9"><enum>(2)</enum><header>Privacy considerations</header><text>In publishing the data under paragraph (1), the Administrator shall take all necessary steps to protect the privacy of any individual whose personally identifiable information is included in that data.</text></paragraph></subsection></section></legis-body></bill>
