which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Clean Air Act to modify the Methane Emissions Reduction Program, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Methane Emissions Reduction Program Clarifications Act of 2024</short-title></quote> or the <quote><short-title>MERP Clarifications Act of 2024</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id9ad13eb3c6cf46a7951800d1155e565b"><enum>2.</enum><header>Methane emissions and waste reduction incentive program for petroleum and natural gas systems</header><subsection commented="no" display-inline="no-display-inline" id="ide2fb7187ba4e4cbfb2b57e49d1bf3c3f"><enum>(a)</enum><header display-inline="yes-display-inline">Amendments</header><text>Section 136 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7436">42 U.S.C. 7436</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id2d8335e052be4f8e9c0afb8f3d8a6ae5"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (f), by adding at the end the following:</text><quoted-block id="idD30FA3707C914D8A9DB5B8F1E196C02C" style="OLC" act-name=""><paragraph id="id4C8437D354B14496B2F985C550947832"><enum>(8)</enum><header>Exemption for small upstream producers</header><subparagraph commented="no" display-inline="no-display-inline" id="idb383e5079a4e465aa2eedfdcf3b19259"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>The Administrator may not, pursuant to any requirement under this section, impose a reporting requirement or a charge under this section on an applicable facility described in subparagraph (B).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id50BC8AD5B7A84891B9E02A1983E4B299"><enum>(B)</enum><header>Applicable facilities described</header><text display-inline="yes-display-inline">An applicable facility referred to in subparagraphs (A), (C), and (D) is an applicable facility that, as of August 16, 2022—</text><clause commented="no" display-inline="no-display-inline" id="id8FC6309E94AF4B8491D693C6EEDD6B48"><enum>(i)</enum><text display-inline="yes-display-inline">was generating less than 25,000 metric tons of carbon dioxide equivalent of greenhouse gases emitted per year; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id6457E96F8534484FBBC8AC42EA623CE1"><enum>(ii)</enum><text>had 2,500 or fewer full-time employees. </text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida0df8f54446949f4b637e7c772e90514"><enum>(C)</enum><header>No requirement to demonstrate</header><text display-inline="yes-display-inline">The Administrator may not impose a requirement that an applicable facility described in subparagraph (B) demonstrate to the Administrator that the applicable facility meets the requirements described in that subparagraph.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9dd21a23b8224e31b9359f6b09bf8ebd"><enum>(D)</enum><header>Notification</header><clause commented="no" display-inline="no-display-inline" id="id21843738946b432c83ab65ed5c2bd972"><enum>(i)</enum><header display-inline="yes-display-inline">Notice to facility</header><text>Not later than 60 days after the date of enactment of this paragraph, the Administrator shall provide written notice to each applicable facility described in subparagraph (B) that the applicable facility is not subject to the reporting requirements or charges imposed under this section.</text></clause><clause commented="no" display-inline="no-display-inline" id="idb4839d65dd714fdbb6676c3b9514b77a"><enum>(ii)</enum><header>Publication</header><text>The Administrator shall communicate publicly (including through press releases and messages on the website of the Environmental Protection Agency) that the applicable facilities described in subparagraph (B) are not subject to the reporting requirements or charges imposed under this section.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idEAAB6DEECB654BE7B10F3D7E1A9397DC"><enum>(9)</enum><header>Exemption for certain producers</header><text display-inline="yes-display-inline">Notwithstanding any other requirement of this section, the Administrator may not impose a charge under this section on an applicable facility during any period in which the applicable facility—</text><subparagraph commented="no" display-inline="no-display-inline" id="idDBFCC2E2266542C9974C8B483EFEF674"><enum>(A)</enum><text display-inline="yes-display-inline">complies with subpart OOOOb and OOOOc, as applicable, of part 60 of title 40, Code of Federal Regulations (or successor regulations); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDC9DEF13DE974BE48B5BCE9027A85F0E"><enum>(B)</enum><text display-inline="yes-display-inline">is located in a State in compliance with the applicable State implementation plan required under subpart OOOOc of that part (or successor regulations).</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id095682a260df4421b63c687f60d74323"><enum>(2)</enum><text>by striking subsection (g) and inserting the following:</text><quoted-block id="idDE7ED5DC475E428CAFE0954E04D0B6CD" style="OLC" act-name=""><subsection id="id0A41D3466EDE453E88DC1E55C3B4FFEA"><enum>(g)</enum><header>Period</header><text>The Administrator may not impose or collect the charge under subsection (c) until January 1 of the first calendar year that begins after the date on which the Administrator submits to the Committee on Environment and Public Works of the Senate and the Committee on Energy and Commerce of the House of Representatives a written notice that each of the following requirements has been met for a period of not less than 1 year before that January 1:</text><paragraph commented="no" display-inline="no-display-inline" id="idA44B3A3AF09040BBA3FA21069219E98A"><enum>(1)</enum><text display-inline="yes-display-inline">The grants authorized under subsections (a) and (b) have been fully disbursed to all eligible recipients.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF75A840778324DD09C20BA452E1A52E2"><enum>(2)</enum><text display-inline="yes-display-inline">The revisions to subpart W of part 98 of title 40, Code of Federal Regulations, that are required under this section—</text><subparagraph commented="no" display-inline="no-display-inline" id="idE0DD056A053A40A3BA05C60F5D5E5DDD"><enum>(A)</enum><text display-inline="yes-display-inline">ensure the use of emissions factors that have been validated by the Administrator and posted to the website of the Administrator; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9212A06744694E5AADB23F9E2CC18B00"><enum>(B)</enum><text display-inline="yes-display-inline">have been finalized.</text></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id562387d6c27f4c2997ccfcb548e6c193"><enum>(3)</enum><text>by redesignating subsection (i) as subsection (k);</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id46b244d9989c4b3dae06aeab504ba505"><enum>(4)</enum><text display-inline="yes-display-inline">by inserting after subsection (h) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8bf8383702414aff8edcea9827f19cb1"><subsection id="id1ddd91b059ae4aa783425154eb9f45ef"><enum>(i)</enum><header>Public comment period</header><text>Except as provided in section 2(c) of the <short-title>MERP Clarifications Act of 2024</short-title>, any proposed regulation, rule, guidance, or directive with respect to the implementation of this section from the Administrator, the Executive Office of the President, or another Federal agency shall, consistent with subchapter II of chapter 5, and chapter 7, of title 5, United States Code (commonly known as the <quote>Administrative Procedure Act</quote>), be subject to a period of public comment of not less than 90 days.</text></subsection><subsection id="id746d75dc5dd149e38d4db6b602299384"><enum>(j)</enum><header>Dispute resolution procedure</header><text>Not later than 60 days after the date of enactment of this subsection, the Administrator shall, consistent with subchapter II of chapter 5, and chapter 7, of title 5, United States Code (commonly known as the <quote>Administrative Procedure Act</quote>), propose a rule establishing an expedited process for an applicable facility to appeal or dispute the amount of a charge imposed under this section that is separate and apart from any other such process under this Act.</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id04ff23aee8da4f60803be2f892edcfb0"><enum>(5)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7130bbc932bd4615a458b8bfe3062310"><subsection id="idf29d5eee767b46e8b9ebff88db6db8e2"><enum>(l)</enum><header>Sunset</header><paragraph commented="no" display-inline="no-display-inline" id="id8e41dc96e6fe4942b0ca86b088f56102"><enum>(1)</enum><header>Termination of effectiveness</header><subparagraph commented="no" display-inline="no-display-inline" id="idb02995c7a04e4a3ab59a72984b1ebf90"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The authority provided under this section terminates on December 31, 2034.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id280dfa81d1984d6985d1755fbd113554"><enum>(B)</enum><header>Limitations</header><clause commented="no" display-inline="no-display-inline" id="idd8bb81c6db6a4089b1cf1b7e90484eb6"><enum>(i)</enum><header display-inline="yes-display-inline">Reauthorization period</header><text>Notwithstanding any other provision of law or rule of the Senate or House of Representatives, Congress may only amend the date described in subparagraph (A)—</text><subclause commented="no" display-inline="no-display-inline" id="id6f6cf92aec3c4ae58bd89321cef0b386"><enum>(I)</enum><text display-inline="yes-display-inline">through a standalone bill that—</text><item commented="no" display-inline="no-display-inline" id="id55a9d26c24cc4c7ea506945d348b058c"><enum>(aa)</enum><text display-inline="yes-display-inline">is adopted by a <fraction>2/3</fraction> majority in each chamber, based on the whole number of all members of the chamber; and</text></item><item commented="no" display-inline="no-display-inline" id="id1238897e9ece464488e4f06d989287a6"><enum>(bb)</enum><text>for the adoption of which proxy voting shall not be allowed; and</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="id180100a7d6fe4a08bf8de567a416e9d7"><enum>(II)</enum><text>by extending the authorization period for this section in 3-year intervals.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id3b43c87c51c84e0aab798ce7c914cfa8"><enum>(ii)</enum><header>No short-term extension</header><text>Congress may not extend the authorization period for this section for any period less than the period described in clause (i)(II).</text></clause></subparagraph></paragraph><paragraph id="idab2f17bb6ff149f99eae64a165e166a9"><enum>(2)</enum><header>Continued imposition of waste charge</header><subparagraph commented="no" display-inline="no-display-inline" id="id6183719eb20447bfa73b6507f08822ba"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>If this section is not reauthorized by December 31, 2034, the Administrator shall immediately cease all activities with respect to the imposition of the charge under this section.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5b99b54e6eae4902a29dea4a587afede"><enum>(B)</enum><header>Enforcement</header><clause commented="no" display-inline="no-display-inline" id="idc4a58e6fc16d41a4899d21994492625b"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">If the Administrator or the head of any other applicable Federal agency carries out any authority under this section after the date described in subparagraph (A), a party that suffers likely harm from the carrying out of that authority may seek financial compensation from the Federal Government in the appropriate Federal district court.</text></clause><clause commented="no" display-inline="no-display-inline" id="idcf0945e6ad6840df987a32736615ad2c"><enum>(ii)</enum><header>Expedited relief</header><text>A Federal district court shall expedite the consideration of an action described in clause (i) brought by the owner of an applicable facility with 2,500 or fewer full-time employees.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idea49a504d7d54f4db5d9d37b8b3fef5d"><enum>(3)</enum><header>Rescission</header><text display-inline="yes-display-inline">On December 31, 2034, there is rescinded the unobligated balance of amounts made available under subsections (a) and (b) as of that date.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idA9F5CCB02F1D4395BA5A98609FDAF6DF"><enum>(b)</enum><header display-inline="yes-display-inline">Description of requirements and calculations</header><paragraph commented="no" display-inline="no-display-inline" id="idF0B8F7FFE56342668FAA24A09A70B989"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 60 days after the date of enactment of this Act, the Administrator of the Environmental Protection Agency (referred to in this section as the <quote>Administrator</quote>) shall make publicly available, including on the website of the Environmental Protection Agency, an Administrator's Order that includes the following information:</text><subparagraph commented="no" display-inline="no-display-inline" id="id1AB04E304CF44A648B346CCAD0C7BAD5"><enum>(A)</enum><text>Consistent with the Plain Writing Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/5/301">5 U.S.C. 301</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/111/274">Public Law 111–274</external-xref>) and Executive Orders 12866 (<external-xref legal-doc="usc" parsable-cite="usc/5/601">5 U.S.C. 601</external-xref> note; relating to regulatory planning and review), 12988 (<external-xref legal-doc="usc" parsable-cite="usc/28/519">28 U.S.C. 519</external-xref> note; relating to civil justice reform), and 13563 (<external-xref legal-doc="usc" parsable-cite="usc/5/601">5 U.S.C. 601</external-xref> note; relating to improving regulation and regulatory review), an easily understandable explanation of—</text><clause commented="no" display-inline="no-display-inline" id="idD205270994F84A4FAC4F8D578112D947"><enum>(i)</enum><text>the methods used for calculating, for purposes of section 136 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7436">42 U.S.C. 7436</external-xref>)—</text><subclause commented="no" display-inline="no-display-inline" id="idE71E3B2AE9B340379B44BA037FF2D1AB"><enum>(I)</enum><text>the carbon dioxide equivalent of greenhouse gases emitted;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idEEFC078B4D7D41B8A331CE910E8B3F44"><enum>(II)</enum><text>methane intensity; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idF690BCAA87264295BF86FF85B51CB79C"><enum>(III)</enum><text>other emissions factors; and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id8976E7D6BA914970BD5EE0FA556E6120"><enum>(ii)</enum><text>the key calculations necessary to understand the requirements of the program under that section, including the conversion from carbon dioxide emissions to methane emissions necessary for determining the amount of the charge imposed and collected under that section.</text></clause></subparagraph><subparagraph id="idBC611CCCE0D346959478BD8ED729CC20"><enum>(B)</enum><text>The methods and mechanisms (including the methods and mechanisms described in subparagraph (A)(i), as applicable) used to calculate, for each category described in paragraphs (1) through (9) of subsection (d) of that section, the charge imposed and collected pursuant to subsection (c) of that section.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1b97fc5166ce449ebf5fe4c3a6350381"><enum>(C)</enum><text>With respect to the development of any information described in subparagraphs (A)(i) and (B)—</text><clause commented="no" display-inline="no-display-inline" id="id1fcd0550fa844b829d8dbb2355a78422"><enum>(i)</enum><text display-inline="yes-display-inline">a list of the names, including titles, occupations, and biographies, of all consultants (including international and domestic consultants) that assisted in that development;</text></clause><clause commented="no" display-inline="no-display-inline" id="id82cbbaba732e47ddb32cdde8668731a3"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="idedb8c8807f5747358c50d3e33826dca1"><enum>(I)</enum><text>a list of the academic institutions (including any international and domestic academic institutions) that assisted in that development; and</text></subclause><subclause indent="up1" commented="no" display-inline="no-display-inline" id="id3542f268031c4cbf903bad3e95dc35e8"><enum>(II)</enum><text>points of contact for each such academic institution;</text></subclause></clause><clause id="id98a1c7159e6d49c7a49c6f1ca7c8aa92"><enum>(iii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id5e6696b4847c4169aa70a3d2a6d26595"><enum>(I)</enum><text>a list of the nongovernmental institutions (including any international and domestic nongovernmental institutions) that assisted in that development; and</text></subclause><subclause indent="up1" commented="no" display-inline="no-display-inline" id="id5aec1b67712148ab9be7d8799ded7cca"><enum>(II)</enum><text>points of contact for each such nongovernmental institution; and</text></subclause></clause><clause id="idd9877990820e496a823826a4f71de5ed"><enum>(iv)</enum><text>a list of any other organizations the resources or personnel of which were used in any way in that development.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id44622be1858a4e5e854a4f933ea2f886"><enum>(D)</enum><text>A description, including citations and hyperlinks, of all studies used by the Administrator to develop the information described in subparagraphs (A)(i) and (B).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7243a2b8d99a4ab69155e174fb0fab91"><enum>(E)</enum><text>A summary of all other information collected and used by the Administrator to develop the information described in subparagraphs (A)(i) and (B).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id087083AAC9F84246A2D5A9B212FD71AF"><enum>(2)</enum><header>Requirements</header><text>In carrying out paragraph (1), the Administrator shall, in consultation with the owners and operators of applicable facilities (as defined in section 136(d) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7436">42 U.S.C. 7436(d)</external-xref>) with fewer than 2,500 full-time employees, ensure that the documentation required under that paragraph will allow operators subject to a reporting requirement or charge under section 136 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7436">42 U.S.C. 7436</external-xref>) to clearly understand the reporting requirements and calculations required under that section.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idd91c9b8614434953a467db220090bcd4"><enum>(c)</enum><header>Rulemaking requirements</header><text display-inline="yes-display-inline">Except as otherwise provided in this section or an amendment made by this section, any proposed regulation, rule, guidance, or other document required under this section or an amendment made by this section shall be subject to, as applicable—</text><paragraph commented="no" display-inline="no-display-inline" id="ida684b8252ace4839a1be65bae85e301d"><enum>(1)</enum><text>except as provided for in paragraph (2), the notice and comment provisions of section 553 of title 5, United States Code; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0a8045c326014ee7a6e49f7270986e43"><enum>(2)</enum><text>a public comment period of not less than 120 days.</text></paragraph></subsection></section></legis-body></bill>
