<section id="id16c24e957d7f42848fd7c6d5faef7e9c"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="id38ec75aba02045c793717ec51776e4af"><enum>(1)</enum><header>Carbon removal credit</header><text>The term <term>carbon removal credit</term> means 1 metric tonne of carbon dioxide or equivalent (tCOe) that—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="idacaea98243214c218ed4a52d51c906f8"><enum>(A)</enum><text display-inline="yes-display-inline">is removed through marine carbon dioxide removal and durably stored; </text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="id4b190a49226e480da186d538cdc9dfcb"><enum>(B)</enum><text display-inline="yes-display-inline">is unique, registered, and validated; and</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="idf0be2c0ace354c1390ef8afed19660ef"><enum>(C)</enum><text display-inline="yes-display-inline">may be traded on a voluntary carbon market and retired after purchase. </text></subparagraph></paragraph> <paragraph id="ide433c992ab7e45b98ed8cf1e642ffb5f"><enum>(2)</enum><header>Coastal waters</header><text>The term <term>coastal waters</term> has the meaning given that term in section 304 of the Coastal Zone Management Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/16/1453">16 U.S.C. 1453</external-xref>).</text></paragraph> 
<paragraph id="id1797dc66dc99448b83f1a9cc139d5a04"><enum>(3)</enum><header>Contiguous zone</header><text>The term <term>contiguous zone</term> has the meaning given that term in section 502 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1362">33 U.S.C. 1362</external-xref>).</text></paragraph> <paragraph id="id5bac343fe7cb445195752bd8ea1c31c5"><enum>(4)</enum><header>Exclusive economic zone</header><text>The term <term>exclusive economic zone</term> has the meaning given that term in section 3532 of the Maritime Security and Fisheries Enforcement Act (<external-xref legal-doc="usc" parsable-cite="usc/16/8001">16 U.S.C. 8001</external-xref>). </text></paragraph> 
<paragraph id="ida7b95bcc90d748f788e5ea57b09fea35"><enum>(5)</enum><header>Indian</header><text>The term <term>Indian</term> has the meaning given that term in section 6151 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7491">20 U.S.C. 7491</external-xref>).</text></paragraph> <paragraph id="idb10177746d28420da1b68f13615034db"><enum>(6)</enum><header>Indian tribal government</header><text>The term <term>Indian tribal government</term> means the recognized governing body of any Indian or Alaska Native tribe, band, nation, pueblo, village, community, component band, or component reservation, individually identified (including parenthetically) in the list published most recently as of the date of the enactment of this Act pursuant to section 104 of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5131">25 U.S.C. 5131</external-xref>).</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="idbe4fd3cda5f74e0c99fed85bd7dabc9e"><enum>(7)</enum><header>Interagency working group</header><text>The term <term>interagency working group</term> means the interagency working group established under section 104. </text></paragraph> <paragraph id="idea99714fa3014d5599078a5e071c92d9"><enum>(8)</enum><header>Internal waters</header><text>The term <term>internal waters</term> means the waters shoreward of the baseline of the territorial seas, which is normally the mean low water line along the coast of the United States.</text></paragraph> 
<paragraph id="ida2dc492aa6944cda9c053cc1a6d2750b"><enum>(9)</enum><header>Marine carbon dioxide removal</header><text>The term <term>marine carbon dioxide removal</term> means an intentional intervention in the marine environment that results in the net removal of carbon dioxide from the atmosphere as measured on a life-cycle basis, taking into account all greenhouse gasses measured in carbon dioxide equivalents.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="ida81241dd7cdc4ce3ae27abb70613b6cc"><enum>(10)</enum><header>National sea grant college program</header><text>The term <term>national sea grant college program</term> means the program maintained under section 204(a) of the National Sea Grant College Program Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1123">33 U.S.C. 1123(a)</external-xref>). </text></paragraph> 
<paragraph id="idd6ccdde0ba28471195a4336942bd5543"><enum>(11)</enum><header>Native American individual or entity</header><text>The term <term>Native American individual or entity</term> means—</text> <subparagraph id="idae611dd7cadb474fb670f6586f3ac6a0"><enum>(A)</enum><text>an Indian;</text></subparagraph> 
<subparagraph id="id9ff645ee373945699240d7bf900f756c"><enum>(B)</enum><text>a Native Hawaiian;</text></subparagraph> <subparagraph id="id25843bde6e414b1385df064ac4694ef8"><enum>(C)</enum><text>a Tribal organization;</text></subparagraph> 
<subparagraph id="idc6d2dbd8bea945ef800d2953650e42f9"><enum>(D)</enum><text>the Office of Hawaiian Affairs; or</text></subparagraph> <subparagraph id="id38e7597f338a4af6b8cabeed5d9f0dfc"><enum>(E)</enum><text>a Native Hawaiian organization.</text></subparagraph></paragraph> 
<paragraph id="id038a9705e59d4239abcdf5b719039685"><enum>(12)</enum><header>Native Hawaiian</header><text>The term <term>Native Hawaiian</term> has the meaning given that term in section 6207 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7517">20 U.S.C. 7517</external-xref>).</text></paragraph> <paragraph id="id20c61490441c494da6c6f910f066f734"><enum>(13)</enum><header>Native Hawaiian organization</header><text>The term <term>Native Hawaiian organization</term> means a private nonprofit organization that—</text> 
<subparagraph id="idfbb06299b13747d2a92f8bbaf6dc33a8"><enum>(A)</enum><text>serves and represents the interests of Native Hawaiians;</text></subparagraph> <subparagraph id="id77b2fadd78184f00850304900dd29703"><enum>(B)</enum><text>has as its primary and stated purpose the provision of services to Native Hawaiians;</text></subparagraph> 
<subparagraph id="iddeedc960e78b4b42934d489009a248f7"><enum>(C)</enum><text>has Native Hawaiians serving in substantive policymaking positions; and</text></subparagraph> <subparagraph id="id9d2ab0e0f9834c3b9d5d02cc6bd0d43b"><enum>(D)</enum><text>is recognized for having expertise in Native Hawaiian affairs.</text></subparagraph></paragraph> 
<paragraph id="ide4627f57caf143988b4df82c1779761b"><enum>(14)</enum><header>Office of Hawaiian Affairs</header><text>The term <term>Office of Hawaiian Affairs</term> has the meaning given that term in section 6207 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7517">20 U.S.C. 7517</external-xref>).</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id7a2fcbfe7d8244878549c68177acc634"><enum>(15)</enum><header>Program</header><text>The term <term>Program</term> means the program established and maintained under section 101.</text></paragraph> 
<paragraph id="id0af7b69e6a0f44cdbbebe1e3ef6b316b"><enum>(16)</enum><header>Protocol</header><text>The term <term>protocol</term> means a systematic approach for generating a carbon removal credit that follows a transparent and thorough science-based methodology—</text> <subparagraph id="id4580d5f282dc4cd281785e9b684aefff"><enum>(A)</enum><text>for the development of projects to remove greenhouse gas emissions or sequester carbon; and</text></subparagraph> 
<subparagraph id="idbc0b5be21b054781bbd0363dd3994b29"><enum>(B)</enum><text>for demonstrating how to measure, monitor, report, and verify the removal of greenhouse gas emissions or carbon sequestration by projects described in subparagraph (A). </text></subparagraph></paragraph> <paragraph id="id982468611d71427d9e5c6e0dfb344634"><enum>(17)</enum><header>Relevant congressional committees</header><text>The term <term>relevant congressional committees</term> means—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="id80298c8aa9f0458797213ccaed2c42c1"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on Commerce, Science, and Transportation of the Senate; </text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="id3604b69ad47f49c099f88382bab5ac3e"><enum>(B)</enum><text display-inline="yes-display-inline">the Committee on Natural Resources of the House of Representatives; and</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="iddc5a470e6cf1459cb81f509f798440fc"><enum>(C)</enum><text display-inline="yes-display-inline">the Committee on Science, Space, and Technology of the House of Representatives. </text></subparagraph></paragraph> <paragraph id="idea277f8581af4ffe98a1723c34f119ed"><enum>(18)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Commerce.</text></paragraph> 
<paragraph id="id146efdc2caa947e1ba0c36632c8b5a68"><enum>(19)</enum><header>Standard</header><text>The term <term>standard</term> means a broad principle or set of criteria established to ensure the credibility and integrity of a carbon removal credit or marine carbon dioxide removal by providing guidance on measurement, monitoring, reporting, and verification of greenhouse gas removals.</text></paragraph> <paragraph id="idb4de0abc94c94b79ae98a6971ec54aa7"><enum>(20)</enum><header>State</header><text>The term <term>State</term> means any of the several States of the United States, the District of Columbia, the Commonwealth of Puerto Rico, the United States Virgin Islands, American Samoa, Guam, and the Commonwealth of the Northern Mariana Islands.</text></paragraph> 
<paragraph id="id45a1d2aeb85542e2941c689d572e1e99"><enum>(21)</enum><header>Territorial seas</header><text>The term <term>territorial seas</term> has the meaning given that term in section 502 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1362">33 U.S.C. 1362</external-xref>). </text></paragraph> <paragraph id="id2195e31bad4f4753b8025f89d877af0c"><enum>(22)</enum><header>Tribal organization</header><text>The term <term>Tribal organization</term> has the meaning given that term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph> 
<paragraph id="id6f2b2e0e697946c7a1d8cde4ab90f118" commented="no"><enum>(23)</enum><header>Voluntary carbon market </header><text>The term <term>voluntary carbon market</term> means a voluntary market through which carbon removal credits may be bought or sold. </text></paragraph></section> <section id="ida8c5e2be113c4d32b9aaac213d95477f"><enum>3.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are—</text> 
<paragraph id="id8bbda6a7688745fcaf9fe9b826c8ddc5"><enum>(1)</enum><text>to support research, development, and field trials of safe and responsible marine carbon dioxide removal;</text></paragraph> <paragraph id="id0529f35117d3494baf164b4e221fa43d"><enum>(2)</enum><text>to ensure robust monitoring and protection of coastal and marine ecosystems; and</text></paragraph> 
<paragraph id="idbe91b3ef4eca4c2b8586cddf5fdda2e5"><enum>(3)</enum><text>to coordinate Federal actions on marine carbon dioxide removal.</text></paragraph></section> <section commented="no" display-inline="no-display-inline" id="id55b80910a145400983fa6686ed321b2c"><enum>4.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this Act shall be construed in derogation of applicable law regulating or restricting the use of the contiguous zone, the territorial seas, the exclusive economic zone of the United States, or coastal waters other than internal waters.</text></section> 
<section id="id34a30c4bab764327b4cf62897f9b6c3f"><enum>5.</enum><header>Research security</header><text display-inline="no-display-inline">The activities authorized under this Act shall be carried out in a manner consistent with subtitle D of title VI of the Research and Development, Competition, and Innovation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/19231">42 U.S.C. 19231 et seq.</external-xref>). </text></section> <title id="ide3a3dda7cace43e2bc7ccd58c1dedd44"><enum>I</enum><header>Matters relating to the National Oceanic and Atmospheric Administration</header> <section id="id2f84d50f34a34d81bb506409c9af6e25"><enum>101.</enum><header>Establishment of program for advancing marine carbon dioxide removal</header> <subsection id="id5a2c7174df174947a6c7f1184081ec69"><enum>(a)</enum><header>In general</header><text>The Secretary, through the National Oceanic and Atmospheric Administration and in consultation with the interagency working group, shall establish, not later than 90 days after the date of the enactment of this Act, and maintain a program to support and conduct activities to advance the science and understanding of marine carbon dioxide removal consistent with the objectives and focal areas described in subsection (b). </text></subsection> 
<subsection id="id3ae5774607294b0183ca2408f2de566f"><enum>(b)</enum><header>Objectives and focal areas</header> 
<paragraph id="idbebaad41e5ee4b178be1070153152cd0"><enum>(1)</enum><header>Objectives</header><text>In carrying out the Program, the Secretary shall seek to—</text> <subparagraph id="idbcfc22ea25c9489e97f9098731f271a7"><enum>(A)</enum><text>generate, through research, development, and field trials, the necessary knowledge, theoretical basis, and empirical evidence to evaluate—</text> 
<clause id="idc908665c73064009a1fb0650ae0163dd"><enum>(i)</enum><text>the efficacy of marine carbon dioxide removal, including measurability, durability, magnitude, and additionality;</text></clause> <clause id="id36ed068f3e3049aa94021a13263ea9d3"><enum>(ii)</enum><text>environmental and ecosystem responses to marine carbon dioxide removal; and</text></clause> 
<clause id="id7c6e25faf11444eb8b45075528852f92"><enum>(iii)</enum><text>the social and economic impacts, including on public health and safety, of marine carbon dioxide removal to adjacent and associated coastal communities; and</text></clause></subparagraph> <subparagraph id="idbe27976d8ad6446b89bed67856c6ec61"><enum>(B)</enum><text>apply the knowledge described in subparagraph (A) to—</text> 
<clause id="idc6e8c12039db4da7a67f0554d99c8295"><enum>(i)</enum><text>develop best practices for how marine carbon dioxide removal efficacy is measured, monitored, reported, and verified;</text></clause> <clause id="id1eaa08b274ee409a8a61c1c03ab5ca1b"><enum>(ii)</enum><text>establish a methodology for defining actionable thresholds of environmental and ecosystem impacts for the deployment of marine carbon dioxide removal;</text></clause> 
<clause id="id1eac9c5d0af74e87889d59b23728aee6"><enum>(iii)</enum><text>evaluate and recommend marine carbon dioxide removal approaches that could be safe and effective for larger-scale deployment for climate mitigation, considering potential positive and negative climate, environmental, and social outcomes;</text></clause> <clause id="id72c0ff319ef246f798beb3b70c727874"><enum>(iv)</enum><text>evaluate the sustainability of marine carbon dioxide removal approaches, including resource requirements, life-cycle efficiency of net carbon removal on a carbon dioxide equivalent basis, scalability, and potential for cost reductions; </text></clause> 
<clause id="id7b4b2dc9e2364295b66c761290c63b0c"><enum>(v)</enum><text>analyze viable commercialization pathways and requisite enabling conditions for safe and effective marine carbon dioxide removal; and</text></clause> <clause id="id561ece42884e43a5a699cc787bfdb6d3"><enum>(vi)</enum><text>as necessary or appropriate, support the implementation of this Act. </text></clause></subparagraph></paragraph> 
<paragraph id="iddd4110d7d6744dfa83b5d6da8d5f6504"><enum>(2)</enum><header>Focal areas</header><text>In carrying out the Program, the Secretary shall support and conduct activities to advance the science and understanding of—</text> <subparagraph id="id49b2e644a4e941498fdf7a17937e953d"><enum>(A)</enum><text>ocean alkalinity enhancement;</text></subparagraph> 
<subparagraph id="id8a76786cb39044b7a5fc6fca4f69b99f"><enum>(B)</enum><text>electrochemical engineering approaches;</text></subparagraph> <subparagraph id="id968f639ec7e6487aa38b42e14e3a1f07"><enum>(C)</enum><text>macroalgae cultivation;</text></subparagraph> 
<subparagraph id="idd524dd7f00084c96ac8e7f074b8e3574"><enum>(D)</enum><text>nutrient fertilization;</text></subparagraph> <subparagraph id="idb9b7728b8a3f4fb28db905f2351ffa5c"><enum>(E)</enum><text>artificial upwelling and downwelling;</text></subparagraph> 
<subparagraph id="id8b441fdb4acb4036b48e3a4e50dc6adc"><enum>(F)</enum><text>coastal marine ecosystems as a natural climate solution; and</text></subparagraph> <subparagraph id="idd0f1f7c4a81f49dead0afb85b2f825d5"><enum>(G)</enum><text>other marine carbon dioxide removal approaches as the Secretary considers appropriate.</text></subparagraph></paragraph></subsection> 
<subsection id="id9a6873a7b45943a69b0d803840e82608"><enum>(c)</enum><header>Grants</header> 
<paragraph id="id0b36720f21344e58b1f6213f71159ba1"><enum>(1)</enum><header>In general</header><text>In carrying out the Program, the Secretary shall award grants, on a competitive basis, to fund research in accordance with the objectives described in subsection (b)(1) and the Federal research plan described in section 104.</text></paragraph> <paragraph id="id6fb62cf1354b47bfa239a091b260feca"><enum>(2)</enum><header>Code of conduct</header><text>The Secretary shall require grantees under this subsection conducting activities in the field to abide by the code of conduct established under section 104.</text></paragraph> 
<paragraph id="idec8a348473444830bb93e05f08244b18"><enum>(3)</enum><header>Funding for engagement and consultation</header> 
<subparagraph commented="no" display-inline="no-display-inline" id="id6ef0bb3a9a904781b76fcfe996ef47bf"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subparagraph (B), not more than 15 percent of the value of any grant awarded under this subsection may be expended in support of engagement and consultation activities.</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="idea0003949e8e474aa0592294ed51ce72"><enum>(B)</enum><header>Exception</header><text display-inline="yes-display-inline">The limitation described in subparagraph (A) shall not apply to any grant awarded for a proposal the primary focus of which is the study of outreach, engagement, or social science. </text></subparagraph></paragraph></subsection> 
<subsection id="id4e40850aa7ff4001a614d5e9a763dc66"><enum>(d)</enum><header>Additional authority</header><text>The Secretary may enter into contracts, public-private partnerships, cooperative agreements, or other financial agreements in furtherance of this Act.</text></subsection> <subsection id="id4a00e71a24c04b3abcf492c04850c9f3"><enum>(e)</enum><header>Data management</header> <paragraph commented="no" display-inline="no-display-inline" id="id9ae6123ba7d64a3f914d79c4171b79a5"><enum>(1)</enum><header>Strategies</header><text display-inline="yes-display-inline">The Secretary, in cooperation with such partners as the Secretary considers relevant, shall develop and implement data management strategies to ensure all non-proprietary data collected pursuant to this Act are— </text> 
<subparagraph commented="no" display-inline="no-display-inline" id="idc788e6fe3ebb467a8d81a1e5e2f23991"><enum>(A)</enum><text display-inline="yes-display-inline">properly stewarded for the long-term; and </text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="id7f3009c2b08b49aeaf4fa27416a10361"><enum>(B)</enum><text display-inline="yes-display-inline">findable, accessible, interoperable, and reusable. </text></subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="ided970a5cc86748b9a892bbac03bd68f6"><enum>(2)</enum><header>Implementation; preservation and curation</header><text display-inline="yes-display-inline">The Secretary shall—</text> <subparagraph commented="no" display-inline="no-display-inline" id="ide8294b1d244d421ba28566098de96443"><enum>(A)</enum><text display-inline="yes-display-inline">ensure management of data collected under this Act is implemented in accordance with—</text> 
<clause commented="no" display-inline="no-display-inline" id="ide90b2da013b445728fd5b5a97079b35a"><enum>(i)</enum><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code; and </text></clause> <clause commented="no" display-inline="no-display-inline" id="id7bd73205ca804299bb267ae3caaffc54"><enum>(ii)</enum><text display-inline="yes-display-inline">the Foundations for Evidence-Based Policymaking Act of 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/435">Public Law 115–435</external-xref>; 132 Stat. 5529) and the amendments made by that Act; and</text></clause></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="ideba1cf2ea1f048948bc88a13aad0ea73"><enum>(B)</enum><text display-inline="yes-display-inline">preserve and curate such data in accordance with <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/31">chapter 31</external-xref> of title 44, United States Code (commonly known as the <quote>Federal Records Act of 1950</quote>), in order to maximize use of such data.</text></subparagraph></paragraph></subsection> <subsection id="id01eb837716b544b2b1dde18944cfdb8c" commented="no" display-inline="no-display-inline"><enum>(f)</enum><header>International coordination</header><text>In carrying out this section, the Secretary shall coordinate with the Secretary of State and appropriate international entities.</text></subsection></section> 
<section id="idE72A55701CE34041A44B8E5E2366A7B3"><enum>102.</enum><header>Monitoring of marine carbon dioxide removal</header> 
<subsection id="id242cc2bf353f42098b1217c356ed1f15"><enum>(a)</enum><header>In general</header><text>For field activities conducted as part of the Program, the Secretary shall, as practicable, provide or otherwise develop the instrumentation, infrastructure, and personnel for efficient and rigorous monitoring to—</text> <paragraph id="id3bf231a956d44e989795ce0cc99b1bde"><enum>(1)</enum><text>understand and minimize negative ecosystem, community, and economic impacts related to marine carbon dioxide removal; and</text></paragraph> 
<paragraph id="idb3b935e22c0346408b55e0cdee2a67b9"><enum>(2)</enum><text>maximize co-benefits of marine carbon dioxide removal for communities and ecosystems.</text></paragraph></subsection> <subsection id="id7a37ceaa8ec341f98153ff93de379370"><enum>(b)</enum><header>Monitoring goals</header><text>In carrying out subsection (a), the Secretary shall—</text> 
<paragraph id="idf9661ab8c9a846e693dd68be40a0b309"><enum>(1)</enum><text>use monitoring assets to achieve the objectives described in section 101(b)(1);</text></paragraph> <paragraph id="id061dacf1fb4348e191cfbb0edd1eb85c"><enum>(2)</enum><text>support compliance with applicable environmental law;</text></paragraph> 
<paragraph id="id8284bba4fc754061ab9248f818060df4"><enum>(3)</enum><text>support rigorous, science-based approaches for the research, development, and trialing of technologies for marine carbon dioxide removal;</text></paragraph> <paragraph id="id9cb12ba465934fa2aa3484db193a4813"><enum>(4)</enum><text>develop and improve technologies for monitoring, modeling, analyzing, remediating, or mitigating impacts from marine carbon dioxide removal;</text></paragraph> 
<paragraph id="id800a1856ad3947a2a6db38042e8cd283"><enum>(5)</enum><text>study ecosystem responses to marine carbon dioxide removal technology; and</text></paragraph> <paragraph id="id1364da7f671f4979b332c721419564eb"><enum>(6)</enum><text>collect data to inform the development of uniform standards and protocols for marine carbon dioxide removal, including—</text> 
<subparagraph id="id49e01498f2884bd59d29700c3d36f47b"><enum>(A)</enum><text>the amount of carbon dioxide removed from the ocean and the atmosphere attributable to marine carbon dioxide removal;</text></subparagraph> <subparagraph id="ide56f5ffceec4431389b9b1ae992f0bab"><enum>(B)</enum><text>the duration of carbon sequestration and risk of reversal of sequestration, as applicable;</text></subparagraph> 
<subparagraph id="id780c7d0695724c63a4b8c7d2aaa46e83"><enum>(C)</enum><text>for marine carbon dioxide removal technologies that rely on an energy source, the amount of energy consumed by the technology; and</text></subparagraph> <subparagraph id="id3e42b16336be414e8392206bf17c65cd"><enum>(D)</enum><text>other metrics the Secretary considers necessary or advisable.</text></subparagraph></paragraph></subsection> 
<subsection id="ide2a953d4c940428e951c987f1588c905"><enum>(c)</enum><header>Technical assistance</header><text>To support the development of reliable, fair, and efficient voluntary carbon markets and best practices, the Secretary, in consultation with the Secretary of the Treasury and the Secretary of Energy, may provide technical assistance to promote consistency, reliability, effectiveness, efficiency, and transparency, including through protocol documents and details relating to—</text> <paragraph id="id1b3bb08ef32d471db54321abb796a125"><enum>(1)</enum><text>calculations;</text></paragraph> 
<paragraph id="id4d38680b3781458ebcdd30a4c78d29b4"><enum>(2)</enum><text>sampling methodologies;</text></paragraph> <paragraph id="id6c70aaa986364e009f149adcb0fc1ff5"><enum>(3)</enum><text>accounting principles;</text></paragraph> 
<paragraph id="id69efc646084649abbe8679772af69730"><enum>(4)</enum><text>systems for measurement, monitoring, reporting, and verification; and</text></paragraph> <paragraph id="id8de41080fa6e43f7b6e9314e5177f16d"><enum>(5)</enum><text>methods to account for additionality, durability and duration of carbon storage, leakage, and, as appropriate, avoidance of double counting.</text></paragraph></subsection> 
<subsection id="id158fae709a8c42859ec6676ad0431539"><enum>(d)</enum><header>Public-Private-Academic partnerships</header><text>The Secretary may examine and develop models for public-private-academic partnerships to efficiently monitor marine carbon dioxide removal, including with respect to—</text> <paragraph id="iddff1a7ae41f240598b66135d22678d09"><enum>(1)</enum><text>data sharing and standardization;</text></paragraph> 
<paragraph id="idfadccc8de45549c6b1bbbf483da72376"><enum>(2)</enum><text>cost sharing;</text></paragraph> <paragraph id="id5094aa37d79340a7aa673ae2f90d5083"><enum>(3)</enum><text>in-kind contributions; and</text></paragraph> 
<paragraph id="idf1e9e3af24804a8aa725a99933a195d0"><enum>(4)</enum><text>contracts and grants for third-party monitoring activities.</text></paragraph></subsection> <subsection id="idac0f968965db416d8bb2ee848cba51f0"><enum>(e)</enum><header>Contracts</header><text>In carrying out this section, the Secretary may enter into contracts the Secretary considers necessary or advisable.</text></subsection> 
<subsection id="id40cac3e12b9942668e1733ca91327f63"><enum>(f)</enum><header>Unlimited right data</header> 
<paragraph commented="no" display-inline="no-display-inline" id="id1eface935a3a435095f8bef032bfa680"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to contracts protecting confidential proprietary data, the Secretary shall make monitoring data collected, and protocols created, under this section available to the public at no cost and with no restrictions on copying, publishing, distributing, citing, adapting, or otherwise using such data or protocols.</text></paragraph> <paragraph id="id1075320b4fff435a9d99bfd747c9c68e"><enum>(2)</enum><header>Limitation</header><text>The Secretary may enter into cooperative research and development agreements that restrict data sharing and ensure protection of intellectual property for such users of research areas designated or established under section 103 as the Secretary considers appropriate.</text></paragraph></subsection></section> 
<section id="idE0796D6448924C9EBB47DD08DF28446E"><enum>103.</enum><header>Research areas for marine carbon dioxide removal</header> 
<subsection id="id9e12dad852594d159d9b6d00e2041ae7"><enum>(a)</enum><header>In general</header><text>In carrying out the Program, the Secretary may—</text> <paragraph commented="no" display-inline="no-display-inline" id="id001cca02910347baa074aac557f8ab72"><enum>(1)</enum><text display-inline="yes-display-inline">designate federally administered oceanic, coastal, estuarine, riverine, or terrestrial areas for research related to one or more marine carbon dioxide removal approaches; or </text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="ide86fbac3294d401aabdfe0d61318e622"><enum>(2)</enum><text display-inline="yes-display-inline">award grants to eligible entities to establish such areas for such research. </text></paragraph></subsection> <subsection id="id7b7ece10d59e4e429b2ed3ba9d8245c4"><enum>(b)</enum><header>Purpose</header><text>The purpose of the research areas designated or established under this section shall be to enable—</text> 
<paragraph id="id1e5e42115d764e769a543f1f1973c680"><enum>(1)</enum><text>the basic and applied science needed to achieve the objectives described in section 101(b)(1), including through—</text> <subparagraph id="id1c89bc97df854d3684d61ff7c75a4ee3"><enum>(A)</enum><text>bench-scale, mesocosm, and wet lab experiments; and</text></subparagraph> 
<subparagraph id="id1252046a3f4a4c628bdc094066e27f76"><enum>(B)</enum><text>field trials, other field research, and demonstration projects;</text></subparagraph></paragraph> <paragraph id="id7cc92144690541ffb4391d300731bc33"><enum>(2)</enum><text>coordinated permitting and compliance with applicable environmental law, engagement and consultation with relevant stakeholders, and risk mitigation;</text></paragraph> 
<paragraph id="id4fc434f56b8844d19828298617c2a181"><enum>(3)</enum><text>sensing networks that can reliably return accurate observations across a wide field of variables in support of the monitoring goals set forth in section 102(b);</text></paragraph> <paragraph id="id75a7194b5e3f44a9b5facf94238da416"><enum>(4)</enum><text>a community of practice among Federal and non-Federal researchers, entrepreneurs, and other stakeholders;</text></paragraph> 
<paragraph id="id4397cf3a8d944aaaae05f35f5326564f"><enum>(5)</enum><text>the incubation or acceleration of businesses that can safely deploy—</text> <subparagraph commented="no" display-inline="no-display-inline" id="idf756eb45ee8341b3a1c855fcbe36c808"><enum>(A)</enum><text display-inline="yes-display-inline">marine carbon dioxide removal; or</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="id5274d4c2c061490186319069295bb0bc"><enum>(B)</enum><text display-inline="yes-display-inline">technologies to measure, monitor, report, or verify approaches; and</text></subparagraph></paragraph> <paragraph id="idd7424afb9a8443458eac52d7fa70c273"><enum>(6)</enum><text>long-term community engagement and participation in marine carbon dioxide removal activities.</text></paragraph></subsection> 
<subsection id="idc6d374624cfc4e2ebb50f32f3fee1628"><enum>(c)</enum><header>Inventory</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary shall—</text> <paragraph commented="no" display-inline="no-display-inline" id="id7792c759d02c448587afcedac7f5def4"><enum>(1)</enum><text display-inline="yes-display-inline">conduct an inventory of existing Federal facilities and oceanic, coastal, estuarine, riverine, or terrestrial areas that may be suitable for designation as federally administered research areas under this section;</text></paragraph> 
<paragraph id="id05c2e251262b4590875d30a0fde22774"><enum>(2)</enum><text>submit the inventory to the interagency working group for review;</text></paragraph> <paragraph id="id3cde43dfbba7448cb2563596760e73d1"><enum>(3)</enum><text>following submittal of the inventory under paragraph (2), publish the inventory to the Federal Register for public comment; and</text></paragraph> 
<paragraph id="id3aaa86f840bd4775a5f07340e27a9f7b"><enum>(4)</enum><text>use such public comments to inform the selection of research areas.</text></paragraph></subsection> <subsection id="idfb9abf59b9e24e4bb23a6ac5cae65a58"><enum>(d)</enum><header>Grants</header> <paragraph commented="no" display-inline="no-display-inline" id="id793888fa5dd34ff5b48820ea91f3ac8c"><enum>(1)</enum><header>Eligible entities</header><text display-inline="yes-display-inline">For purposes of grants under this section, an eligible entity is any of the following: </text> 
<subparagraph commented="no" display-inline="no-display-inline" id="id737e56b291c84ca692f0597fda18d853"><enum>(A)</enum><text>A National Laboratory (as defined in section 2 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/15801">42 U.S.C. 15801</external-xref>)). </text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="id1db4505b71ef48ff84acd44ac997228b"><enum>(B)</enum><text>An institution of higher education (as defined in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>)). </text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="id15bda6a862024a2f9467943f5111850b"><enum>(C)</enum><text>A State, local, or Indian tribal government. </text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="id4ad216a2ef2349d4b0936a1071511373"><enum>(D)</enum><text>Any other private or public entity. </text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="idb7ec1431a63e4fc085d110dd7d225684"><enum>(E)</enum><text>A consortium of entities described in any of subparagraphs (A) through (D). </text></subparagraph></paragraph> <paragraph id="iddf59f3a7469c457a8da3054fb4669ccc"><enum>(2)</enum><header>Applications</header><text>An eligible entity seeking a grant under this section shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require.</text></paragraph> 
<paragraph id="idb79efe16ef1a4f2ebc5b6713cc952f84"><enum>(3)</enum><header>Private sector investment</header><text>In awarding grants under this section, the Secretary shall seek to leverage private sector investment, to the extent possible. </text></paragraph></subsection> <subsection id="id914f67079d4b4c33ac87ad692305a70c"><enum>(e)</enum><header>Suitability assessment</header> <paragraph id="idd1e4045203b040dba1ebf50b65ca2cd8"><enum>(1)</enum><header>In general</header><text>The Secretary shall assess the suitability of each research area under consideration for designation or establishment under this section. </text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="idC06146550A214DAE8BB565986C1CF1DC"><enum>(2)</enum><header>Data; tools; considerations</header><text display-inline="yes-display-inline">In carrying out paragraph (1), the Secretary—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id9BA378769EF14A208EB24A7A7677627A"><enum>(A)</enum><text display-inline="yes-display-inline">shall use relevant scientific, social, and economic data, including baseline environmental data and any assessments of baseline environmental data; and</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="id48EF1AAFBA1C4647BB2D2EE5A033EF1D"><enum>(B)</enum><text display-inline="yes-display-inline">may—</text> <clause commented="no" display-inline="no-display-inline" id="id7007A51DA81F4485947283210B157804"><enum>(i)</enum><text display-inline="yes-display-inline">develop and employ marine spatial planning tools; and </text></clause> 
<clause commented="no" display-inline="no-display-inline" id="id06FE6111110441D49170612C756842DF"><enum>(ii)</enum><text>consider non-contiguous areas that are proximate to one another and connected by ecological or oceanographic factors. </text></clause></subparagraph></paragraph> <paragraph id="id81a77885fa184770b622d1ad30303cce"><enum>(3)</enum><header>Factors</header><text>In carrying out paragraph (1), the Secretary may assess the following: </text> 
<subparagraph id="id389941eb964d4a14ba52a7299d212212"><enum>(A)</enum><text>Matters relating to oceanographic and ecological characteristics, including— </text> <clause id="id255B90A62A5C44879DD52A13BF066A3C"><enum>(i)</enum><text>proximity and access to geologic storage formations;</text></clause> 
<clause id="id3534C73DF82B4FD995CE188267746E03"><enum>(ii)</enum><text>impacts to coastal and marine ecosystems, biodiversity, protected species, and the habitat of such species;</text></clause> <clause id="idF1CAB4D8FCBD40F8BBC63E318EC0535C"><enum>(iii)</enum><text>proximity and impacts to existing protected areas, such as marine monuments and sanctuaries; and</text></clause> 
<clause id="idCDD18C2F64FE40E4B54908AA02AF7CC2"><enum>(iv)</enum><text>bathymetry, ocean circulation, and carbon chemistry baselines.</text></clause></subparagraph> <subparagraph id="id0AF7BA62942D4CE58F93C9CCC3CE44DE"><enum>(B)</enum><text>Matters relating to human uses and communities, including—</text> 
<clause id="id973438bebb4349df862f946d17b4f274"><enum>(i)</enum><text>current and possible future human uses of the research area and the areas in reasonable proximity to the research area; </text></clause> <clause id="id53E8FB3225AA49BF9A6EA4A6730B92C0"><enum>(ii)</enum><text>availability of existing sensor networks, technology, infrastructure, and land-based facilities;</text></clause> 
<clause id="id3C4011FED325476A9BF4AB8788FC2E1E"><enum>(iii)</enum><text>where appropriate, potential colocation with existing infrastructure such as desalination plants, ships, moorings, and renewable energy; and</text></clause> <clause id="idABAAE13B996B4181BA9808F49B6D61BC"><enum>(iv)</enum><text>potential socioeconomic or sociocultural impacts on adjacent coastal communities, including Native American individuals or entities.</text></clause></subparagraph> 
<subparagraph id="id448b31ef97cb4f0ebc0354bb455fbe60"><enum>(C)</enum><text>Potential downstream impacts beyond the research area. </text></subparagraph> <subparagraph id="idEC31BE50ED4441EAAB4B26EE6D0DAB2E"><enum>(D)</enum><text>Such other factors as the Secretary considers appropriate, in consultation with—</text> 
<clause id="id414BDA8B44BE484B85C90F9CF802E8BD"><enum>(i)</enum><text>States or Indian tribal governments that are in reasonable proximity to the research area; or</text></clause> <clause id="idD573AF9F052842AB8A420A86C387BB89" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text>the interagency working group. </text></clause></subparagraph></paragraph></subsection> 
<subsection id="id59884cb634364401b4492106e7d365a1"><enum>(f)</enum><header>Terms and conditions</header> 
<paragraph id="idedf1f143af354f7b90a987dfe1de25ea"><enum>(1)</enum><header>In general</header><text>For each research area designated or established under this section, and subject to subsection (i), the Secretary shall develop terms and conditions by which all users of the research area shall abide.</text></paragraph> <paragraph id="id98d23b5d1a5e4690b2dae311a87879e4"><enum>(2)</enum><header>Elements</header><text>At a minimum, the terms and conditions developed under this subsection shall include—</text> 
<subparagraph id="id07a5ea33cccd4bf2815cdc27d9a7e9b4"><enum>(A)</enum><text>a requirement for any user of the research area to abide by the code of conduct established under section 104;</text></subparagraph> <subparagraph id="ide5eef02b6250417d8eac25212875dc95"><enum>(B)</enum><text>stewardship, management, and conservation measures that incorporate local and traditional knowledge, to the greatest extent practicable;</text></subparagraph> 
<subparagraph id="id996f3f77854c4d2b8f700538634459b9"><enum>(C)</enum><text>a requirement for the user to develop and follow a plan to—</text> <clause commented="no" display-inline="no-display-inline" id="idfafda807a2414caa943824ec9f5ed354"><enum>(i)</enum><text display-inline="yes-display-inline">mitigate risks and conflicts regarding local ecological conditions, biological sensitivities, protected resources, and commercial and human uses;</text></clause> 
<clause id="ide9ed2be37b6d48a096d552965039182e"><enum>(ii)</enum><text>monitor ecosystem responses within, and in reasonable proximity to, the research area;</text></clause> <clause id="id18e999c9d26c4b8c914dd82f54803b67"><enum>(iii)</enum><text>address potential environmental degradation resulting from activities at the research area; and</text></clause> 
<clause id="id686d2dbe69f54f81896bc156c72a67d5"><enum>(iv)</enum><text>following the expiration of a research area, remove—</text> <subclause id="id29dd3bf8fae141bab819f1fca3546cfb"><enum>(I)</enum><text>the user’s fixtures, furnishings, equipment; and</text></subclause> 
<subclause id="id97c167394bf24707b5e43272d4a7a95b"><enum>(II)</enum><text>any improvements made to the research area; </text></subclause></clause></subparagraph> <subparagraph id="idb9734d0e3c6e462aace475c130008e09"><enum>(D)</enum><text>clear, objective thresholds of environmental harm that require the immediate cessation of a user’s activities at the research area;</text></subparagraph> 
<subparagraph id="idb4877f85b90b4164b7ba9a0f734f4bbf"><enum>(E)</enum><text>the user’s consent for—</text> <clause commented="no" display-inline="no-display-inline" id="idb8c4e9c9033644179f4bf2acea97c7be"><enum>(i)</enum><text display-inline="yes-display-inline">remote monitoring of the user’s activities and the impacts of those activities on the environment; and </text></clause> 
<clause commented="no" display-inline="no-display-inline" id="idb13e9a3d40f048f1be5c8520367ea928"><enum>(ii)</enum><text display-inline="yes-display-inline">regular and unannounced inspections of the user’s activities by the advisory board for the research area appointed under subsection (j);</text></clause></subparagraph> <subparagraph id="id8cf5f269ef2e400189a380fe61fd198d"><enum>(F)</enum><text>a requirement that the user will comply with all applicable law and policies; and</text></subparagraph> 
<subparagraph id="ided00ce0d46af4fd7b1076df92f02c85c"><enum>(G)</enum><text>additional terms and conditions as the Secretary considers necessary or appropriate in furtherance of this Act.</text></subparagraph></paragraph></subsection> <subsection id="id601997332fa6427ab62d831c3d325c91"><enum>(g)</enum><header>Duration</header> <paragraph commented="no" display-inline="no-display-inline" id="ide72ef53fae7d41cbb319e8d678d8417b"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The duration of research areas designated or established under this section shall be determined as provided in this subsection.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="id79808f8ff0a24fd79eba10678f77cf55"><enum>(2)</enum><header>Research areas administered by a Federal agency</header> 
<subparagraph commented="no" display-inline="no-display-inline" id="idb6ea03fefa6c42c0aef683488abaf9ed"><enum>(A)</enum><header display-inline="yes-display-inline">Reassessment</header><text>Not less frequently than once every 5 years, the Secretary shall reassess each research area administered by a Federal agency to ensure that the research area advances the purpose set forth in subsection (b), the research area is suitable under subsection (e), and users of the research area are in compliance with applicable terms and conditions developed under subsection (f). </text></subparagraph> <subparagraph id="ide2d4e66105ad400ba125987e572a9775"><enum>(B)</enum><header>Termination of activities</header><text>If, pursuant to a reassessment carried out with respect to a research area under subparagraph (A), the Secretary finds that the research area does not advance the purpose set forth in subsection (b), the research area is not suitable under subsection (e), or users of the research area are noncompliant with applicable terms and conditions developed under subsection (f), the Federal agency administering the research area shall—</text> 
<clause commented="no" display-inline="no-display-inline" id="idceabd7c01d8a446aad70cc135f8b68ba"><enum>(i)</enum><text display-inline="yes-display-inline">terminate activities at the research area; and </text></clause> <clause commented="no" display-inline="no-display-inline" id="idb03199624a3e442b91aee26432d049fd"><enum>(ii)</enum> <subclause commented="no" display-inline="yes-display-inline" id="id3749b9ff0d214ec8afb0afff8ec4e949"><enum>(I)</enum><text>close down operations at the research area pursuant to applicable terms and conditions; or </text></subclause> 
<subclause commented="no" display-inline="no-display-inline" id="id81674612518d43acb84c84e65434b992" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">remediate the research area to comport with subsections (b), (e), and (f).</text></subclause></clause></subparagraph></paragraph> <paragraph id="ide9865f51d4694cad986ef92ef0a6165a"><enum>(3)</enum><header>Research areas administered by an eligible entity</header> <subparagraph id="ide64b7d0123524c2e8417842f86204e56"><enum>(A)</enum><header>Initial period</header><text>An eligible entity administering a research area under this Act may carry out activities at the research area for an initial period of 5 years. </text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="idfe5d9fa8583d43c980a0757957dbc9a2"><enum>(B)</enum><header>Reassessment</header><text>Before the conclusion of an initial period for a research area described in subparagraph (A), the Secretary shall reassess the research area to ensure that the research area advances the purpose set forth in subsection (b), the research area is suitable under subsection (e), and users of the research are in compliance with applicable terms and conditions developed under subsection (f). </text></subparagraph> <subparagraph id="id1c7be38181964376885ee11b48483a0f"><enum>(C)</enum><header>Additional period</header><text>If, pursuant to a reassessment carried out with respect to a research area under subparagraph (B), the Secretary finds that the research area advances the purpose set forth in subsection (b), the research area is suitable under subsection (e), and users of the research area are in compliance with applicable terms and conditions developed under subsection (f), the Secretary may authorize the eligible entity administering the research area to carry out activities at the research area for a single, additional period of 5 years. </text></subparagraph> 
<subparagraph id="id841A63E19BBE4EC6AA41CA77A54F659D"><enum>(D)</enum><header>Termination of activities</header><text>If, pursuant to a reassessment carried out with respect to a research area under subparagraph (B), the Secretary finds that the research area does not advance the purpose set forth in subsection (b), the research area is not suitable under subsection (e), or users of the research area are noncompliant with applicable terms and conditions developed under subsection (f), the eligible entity administering the research area shall—</text> <clause commented="no" display-inline="no-display-inline" id="id91B49759348C4AD9AC594DAC97E75DC8"><enum>(i)</enum><text display-inline="yes-display-inline">terminate activities at the research area; and </text></clause> 
<clause commented="no" display-inline="no-display-inline" id="id960330DD91D04455BFB8531121CDB6A0"><enum>(ii)</enum> 
<subclause commented="no" display-inline="yes-display-inline" id="idDBF44CAADB204747976646E20DF95948"><enum>(I)</enum><text>close down operations at the research area pursuant to applicable terms and conditions; or </text></subclause> <subclause id="idC611D2C03AC24BC6B087829E51DBB470" indent="up1" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">remediate the research area to comport with subsections (b), (e), and (f). </text></subclause></clause></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="id721b874e854f4e7f95a1b23c5f2601e2"><enum>(E)</enum><header>Reestablishment</header><text display-inline="yes-display-inline">In order to allow for continuity of operations, not later than 1 year prior to the conclusion of an additional 5-year period for a research area authorized under subparagraph (C), the eligible entity administering the research area may reapply for the establishment of the research area under this section.</text></subparagraph></paragraph></subsection> <subsection id="id153c3023d7cd43b5aea9c5bc3ecfc7f0"><enum>(h)</enum><header>Community benefits</header><text>For each research area designated or established under this section, and subject to subsection (i), the Secretary shall develop, to the extent possible, opportunities to deliver benefits to communities with interest in the research area, such as—</text> 
<paragraph id="id6f5ce6f77b3344358b253e13274d61a5"><enum>(1)</enum><text>community benefit agreements;</text></paragraph> <paragraph id="id5a41d23937224a578297e0f581f450f2"><enum>(2)</enum><text>workforce development opportunities;</text></paragraph> 
<paragraph id="id51cecf19c11a40a1b574a7e95f4c1259"><enum>(3)</enum><text>mitigation measures;</text></paragraph> <paragraph id="id4c5fab76835f45d3b7ce44bac614ff61"><enum>(4)</enum><text>public education efforts; and</text></paragraph> 
<paragraph id="id901e842d720f4dba90df51fee6a9f563"><enum>(5)</enum><text>other socioeconomic or educational benefit schemes.</text></paragraph></subsection> <subsection id="ide10c2bf87d4d46c29ed4e17560407ab9"><enum>(i)</enum><header>Engagement or consultation; partnerships</header><text>In carrying out subsections (f) and (h), the Secretary—</text> 
<paragraph id="id38b803f516234e1eb3c8d38835e74136"><enum>(1)</enum><text>shall engage or consult, as appropriate, regarding the terms and conditions and community benefits described in such subsections with—</text> <subparagraph id="id132b2320957d47028a8fa70fc6167891"><enum>(A)</enum><text>State, local, and Indian tribal governments with jurisdiction over any part of the research area;</text></subparagraph> 
<subparagraph id="idf2a544284af54d23ae4066d10e242d65"><enum>(B)</enum><text>members of communities proximate to the research area, including relevant recreational and commercial users, academic institutions, Native American individuals or entities, and nongovernmental organizations; and</text></subparagraph> <subparagraph id="id5549ad2b46f945c4938178a7428e9eed"><enum>(C)</enum><text>other stakeholders as the Secretary considers necessary to ensure full and fair engagement with potentially impacted community members; and</text></subparagraph></paragraph> 
<paragraph id="id30f94b696ed1427c865b460109627364"><enum>(2)</enum><text>may leverage existing partnerships and assets to support meaningful public participation, including—</text> <subparagraph id="id0e17038fa63a41739e616c8e78768419"><enum>(A)</enum><text>the national sea grant college program;</text></subparagraph> 
<subparagraph id="idfddbf505481e43b0b29adc91d989f113"><enum>(B)</enum><text>Regional Ocean Partnerships; and</text></subparagraph> <subparagraph id="id808cf2db74c647ddbb4e3ab9c8bda3b1" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text>the Regional Collaboration Network. </text></subparagraph></paragraph></subsection> 
<subsection id="id32ca2b3ffafc467d938b33c2a7229e4e"><enum>(j)</enum><header>Advisory boards</header> 
<paragraph id="idaeca40c28e424fe1b92e3b0a19985157"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (3), the Secretary shall appoint an advisory board to support oversight of each research area designated or established under this section, consisting of—</text> <subparagraph id="ide02d7d8a91d54c0db7fa15ce63a60480"><enum>(A)</enum><text>one or more representatives of each Federal agency participating in activities at the research area;</text></subparagraph> 
<subparagraph id="ideb31a1df032d499096e0cf6ae0a1b9e2"><enum>(B)</enum><text>one or more representatives of each State, county, or Indian tribal government adjacent to the research area;</text></subparagraph> <subparagraph id="idfff6bd173d1a407bad9ba14f92d40ea0"><enum>(C)</enum><text>one or more members from each community adjacent to the research area;</text></subparagraph> 
<subparagraph id="id8a7a521182d34cb78aa963a37d9b0c91"><enum>(D)</enum><text>one or more representatives of the users of the research area; and</text></subparagraph> <subparagraph id="id1de630c0e1ed4e3c9541a6542ea33751"><enum>(E)</enum><text>additional members as the Secretary considers appropriate. </text></subparagraph></paragraph> 
<paragraph id="id5448ca0c7df74a349dad97d73411bdbb"><enum>(2)</enum><header>Duties</header> 
<subparagraph commented="no" display-inline="no-display-inline" id="idc4c38811350c47388b7b6eec4e5dc8bc"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">A board appointed under this subsection shall—</text> <clause id="idfbf6eb08cc0d4e789dde8b5381f61ffa"><enum>(i)</enum><text>monitor the delivery of community benefits, compliance with the applicable terms and conditions, and, as necessary or advisable, inspections of activities at the research area;</text></clause> 
<clause id="id4984a98dd8184cb1847364fd5f67490b"><enum>(ii)</enum><text>meet regularly with the Secretary to provide advice and guidance for the management, conservation, and stewardship of the research area;</text></clause> <clause id="id7741b962b9fd43d5bdde0c60b91984fb"><enum>(iii)</enum><text>provide advice and recommendations to the Secretary on whether a proposed use or user of the research area should be allowed; and</text></clause> 
<clause id="id3748c5d0367641b8a185f5c8c540093f"><enum>(iv)</enum><text>take other actions to support the safe, effective, orderly, and lawful operation of the research area at the discretion of the Secretary. </text></clause></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="id75c0b5dde26d479e853936f7c380dc7b"><enum>(B)</enum><header>Additional duties</header><text>Upon the request of a board appointed under this subsection, the Secretary may assign additional duties to the board as the Secretary considers appropriate. </text></subparagraph></paragraph> 
<paragraph id="ide97009540bd34c9c8f67c1b62d8e6ebb"><enum>(3)</enum><header>Special rule for Regional Ocean Partnerships</header><text>At the discretion of the Secretary or upon the request of a State, local, or Indian tribal government, the Secretary may request that the Regional Ocean Partnership in which the research area is located carry out the duties described in paragraph (2) instead of appointing a board as provided in paragraph (1). </text></paragraph></subsection></section> <section id="idFB92FAAEFBE445CCBE6CD003160F0128"><enum>104.</enum><header>Interagency working group for marine carbon dioxide removal</header> <subsection id="id61B73B6067844933B29C29BA68EEECD6"><enum>(a)</enum><header>In general</header><text>There is established an interagency working group for marine carbon dioxide removal under the Subcommittee on Ocean Science and Technology of the National Science and Technology Council. </text></subsection> 
<subsection id="id757493ADD31542E4BFC5C7181CCCB269"><enum>(b)</enum><header>Membership</header><text>The interagency working group shall be composed of one or more representatives from each of the following:</text> <paragraph id="idCAF0FE6B2290461B8039AF8DAE93548C"><enum>(1)</enum><text>The Army Corps of Engineers.</text></paragraph>

<subsection id="id6F41EC972E704E77933FB5711566DFB3" commented="no"><enum>(c)</enum><header>Co-Chairs</header><text>One or more representatives from the National Oceanic and Atmospheric Administration and one or more representatives from the Department of Energy shall serve as co-chairs of the interagency working group.</text></subsection> <subsection commented="no" display-inline="no-display-inline" id="idFB123D73842A49F389A351965D463A1E"><enum>(d)</enum><header>Meetings</header><text display-inline="yes-display-inline">The interagency working group shall meet not less frequently than once each year, at the call of the co-chairs.</text></subsection> 
<subsection id="ide33283e1c49c4344b1c7d9d97f7827e0" commented="no"><enum>(e)</enum><header>Duties</header><text>The interagency working group shall—</text> <paragraph id="idb589a36701454aafb26e53d2df72ac78"><enum>(1)</enum><text>not later than 90 days after the date of the enactment of this Act, establish a plan to coordinate Federal research on marine carbon dioxide removal in accordance with subsection (f);</text></paragraph> 
<paragraph id="id81f4676742484022857e62b5b686dd4c"><enum>(2)</enum><text>not later than 1 year after the date of the enactment of this Act—</text> <subparagraph commented="no" display-inline="no-display-inline" id="id0ec155e954434ce280464b6af90d7f90"><enum>(A)</enum><text display-inline="yes-display-inline">establish a code of conduct in accordance with subsection (g); and </text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="id929c166170154963a4312c910b185625"><enum>(B)</enum><text display-inline="yes-display-inline">standardize the implementation of that code of conduct;</text></subparagraph></paragraph> <paragraph id="id7074bcb4fb524bfc9e1c9bffd041f0a8"><enum>(3)</enum><text>coordinate efforts among Federal agencies to support compliance with existing law;</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="ida2dddc72dacd41ceabe077ff90aa53e7"><enum>(4)</enum><text display-inline="yes-display-inline">support research and development of safe and effective marine carbon dioxide removal;</text></paragraph> <paragraph id="ida2ad3f08d706446884405bf1ec9ee0c4"><enum>(5)</enum><text>coordinate Federal funding opportunities in a manner that avoids duplication of funding and research efforts and maximizes funding for marine carbon dioxide removal; </text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="idaf637e4fc06c4e7fbe3a9718f7628e2e"><enum>(6)</enum><text display-inline="yes-display-inline">as appropriate, provide recommendations to—</text> <subparagraph id="iddb8a48522bac46ae89d820f3e0716a1f"><enum>(A)</enum><text>support the transition from research to operations of safe and effective marine carbon dioxide removal; and</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="idbd03485342414168b26c67a8185728a2"><enum>(B)</enum><text display-inline="yes-display-inline">integrate marine carbon dioxide removal into voluntary carbon markets;</text></subparagraph></paragraph> <paragraph id="idafb4bcabeb0d45969c879d6aac37a444"><enum>(7)</enum><text>publish and submit the biennial report required by section 105;</text></paragraph> 
<paragraph id="idda0ac9dc0b30447181d42299842a415f"><enum>(8)</enum><text>not later than 90 days after the date on which the interagency working group receives the inventory submitted under section 103(c), review the inventory and provide recommendations to the Secretary for the selection of research areas; </text></paragraph> <paragraph id="id899eeb65ead24648b81d683697d87f33" commented="no"><enum>(9)</enum><text>ensure the public availability of and public access to the results of marine carbon dioxide removal research in accordance with subsection (h); and</text></paragraph> 
<paragraph id="id4d54a581ab914e7ea2baff48ec7f088d"><enum>(10)</enum><text>take other actions, as the interagency working group considers necessary, to coordinate Federal support for safe and effective marine carbon dioxide removal. </text></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="idfcfe47fc83e6467c9d177a40a1026faa"><enum>(f)</enum><header>Federal research plan</header> <paragraph id="id24009A5B75F44CE3AFC27F8548728A37" commented="no"><enum>(1)</enum><header>Adoption of existing plans</header><text>In carrying out subsection (e)(1), the interagency working group may adopt one or more research plans prepared by agencies represented on the interagency working group or through other interagency efforts.</text></paragraph> 
<paragraph id="id67775A12F104463B8E19B6D4E235B477" commented="no"><enum>(2)</enum><header>Updates</header><text>Not later than 5 years after the date on which the plan described in subsection (e)(1) is established, and every 5 years thereafter, the interagency working group shall update the plan. </text></paragraph> <paragraph id="id22C8DFAC39AE4BC0B4F0C79AA7147EA8" commented="no"><enum>(3)</enum><header>Requirements</header><text>The plan described in subsection (e)(1) shall—</text> 
<subparagraph id="id30284257B5634E71B742D891B6064EE8" commented="no"><enum>(A)</enum><text>prioritize public engagement and ecosystem impacts; and</text></subparagraph> <subparagraph id="id7F201ED3390C43C1A814C8EAF305BB90" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>further the objectives and focal areas described in section 101(b).</text></subparagraph></paragraph></subsection> 
<subsection id="id14de4b828a4e47068d1e0b91e5995e8a"><enum>(g)</enum><header>Code of conduct</header> 
<paragraph id="id5b639f5f248744d58fa235e9dfa53ff8"><enum>(1)</enum><header>In general</header><text>The interagency working group shall, after publication and an opportunity for public comment in the Federal Register, establish a code of conduct for research relating to marine carbon dioxide removal (in this subsection referred to as the <quote>code of conduct</quote>). </text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="id0edeb59ef53744d280fe5652278b16f8"><enum>(2)</enum><header>Adoption by agencies</header><text>The agencies represented on the interagency working group shall adopt the code of conduct. </text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="id07ffa48d9db84327b855fef3ae4e4ad3"><enum>(3)</enum><header>Applicability</header><text>Each grantee under this Act conducting activities in the field and each user of a research area designated or established under section 103 shall abide by the code of conduct.</text></paragraph> <paragraph id="id50c56434500b4151a7e96f4602412558"><enum>(4)</enum><header>Minimum substantive requirements</header><text>The code of conduct shall, at minimum, require—</text> 
<subparagraph id="iddecaf557f74640f3bb4b5c49e4462be0"><enum>(A)</enum><text>open access to research data, findings, codes of conduct, mitigation plans, and scientific publications arising from the research;</text></subparagraph> <subparagraph id="id0830616f3ac34895a6228f914d9d17cb"><enum>(B)</enum><text>that open-water testing is preceded and informed by laboratory, mesocosm, and modeling research;</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="id8476f6c5b6b34922af8cde6732b1798e"><enum>(C)</enum><text display-inline="yes-display-inline">public disclosure of funding sources;</text></subparagraph> <subparagraph id="ide26429b636154b12a318920ef75ae656"><enum>(D)</enum><text>educational materials and community learning opportunities to increase awareness and literacy of proposed research activities, findings, risks, uncertainties, potential benefits, and the distribution of anticipated benefits and harms;</text></subparagraph> 
<subparagraph id="idd56b893f5e3448d29e5811aa90c58a83"><enum>(E)</enum><text>opportunities for interested stakeholders to provide input on research design;</text></subparagraph> <subparagraph id="id1005b21fe8b74b26a49703fc6d2098c2"><enum>(F)</enum><text>where applicable, solicitation and incorporation of local and traditional knowledge into research design and decisions;</text></subparagraph> 
<subparagraph id="id149f05fe44014fc3a167d38d1b8ec161"><enum>(G)</enum><text>reasonable efforts to deconflict research with existing commercial and human uses;</text></subparagraph> <subparagraph id="idc38df0ec04fb4d8faf46f4edb089dbdb"><enum>(H)</enum><text>for each experiment, a mitigation plan that describes—</text> 
<clause id="id9643889e2e6045ce81646a6822b857d0"><enum>(i)</enum><text>potential ecosystem responses;</text></clause> <clause id="idf84bc57c835941b8bda23f806b9b3797"><enum>(ii)</enum><text>potential social outcomes, including to health and safety;</text></clause> 
<clause id="idf6c2fac30f53443fab7d6695ff76f363"><enum>(iii)</enum><text>any measures taken to minimize harm; and</text></clause> <clause id="idd6c122c7e31f4be7932467c78d709c7c"><enum>(iv)</enum><text>liability and guidelines for remediation of adverse impacts, including environmental degradation, resulting from research;</text></clause></subparagraph> 
<subparagraph id="id887a992c3a604e1482d97da2e80ee17e"><enum>(I)</enum><text>compliance with all applicable domestic and international laws and policies; and</text></subparagraph> <subparagraph id="ide1a5839389b44b56921a5ad3ad62c4a2"><enum>(J)</enum><text>other requirements or best practices, as the interagency working group determines necessary, to assess and communicate positive and negative social and environmental impacts and uncertainties.</text></subparagraph></paragraph> 
<paragraph id="id965a1c5da95349b0abfa5e9a9bf56a47"><enum>(5)</enum><header>Minimum engagement requirements</header><text>In fulfilling the requirements described in paragraph (4), grantees and users described in paragraph (3) shall maximize participation of and consultation with, at minimum—</text> <subparagraph id="id2e8bbe2f194642e8a96c45a6b2d5a31f"><enum>(A)</enum><text>State, local, and Indian tribal governments with jurisdiction over any part of the area in which field research relating to marine carbon dioxide removal is conducted;</text></subparagraph> 
<subparagraph id="ida4d51a13e1fb4b83bc87cab6614b233e"><enum>(B)</enum><text>members of communities proximate to the area, including relevant recreational and commercial users, academic institutions, Native American individuals or entities, and nongovernmental organizations; and</text></subparagraph> <subparagraph id="id7c118fcadec84d98a51c05be55c4c63e"><enum>(C)</enum><text>other stakeholders as the head of the Federal agency providing resources for the grantee or user considers necessary to ensure full and fair engagement with potentially impacted community members.</text></subparagraph></paragraph> 
<paragraph id="id4aeb813f94fb4e468617587339004f83"><enum>(6)</enum><header>Updates</header><text>Not less frequently than once each year for the first 5 years following the date of the enactment of this Act, and once every 5 years thereafter, the interagency working group shall review, and, as appropriate update, the code of conduct to ensure that it remains timely and relevant.</text></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="idc72f140f00574ba4a693d956f754a303"><enum>(h)</enum><header>Public availability and access</header> <paragraph commented="no" display-inline="no-display-inline" id="idfbc29985544341bea9adf3b96ecc2427"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>Subject to contracts protecting confidential proprietary data, the interagency working group may make research papers and other results generated under this Act available to the public at no cost and with no restrictions on copying, publishing, distributing, citing, adapting, or otherwise using such papers or results.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="idc7945ce5727943f397aebbcea0ed62a4"><enum>(2)</enum><header>Portal</header><text>Not later than 1 year after the date of the enactment of this Act, the interagency working group shall establish a new portal or designate an existing information portal to ensure, while protecting sensitive proprietary information, that data and information on marine carbon dioxide removal generated under this Act, or by other Federal programs and relevant stakeholders, is easily, digitally accessible, including information that would be useful to policymakers, researchers, and other stakeholders for advancing research or evaluating the deployment of marine carbon dioxide removal. </text></paragraph></subsection> <subsection id="id682f370429374ee4ab182b95dc257376"><enum>(i)</enum><header>Memorandum of agreement</header><text>Not later than 90 days after the date of the enactment of this Act, the members of the interagency working group shall enter into a memorandum of agreement to implement this Act. </text></subsection></section> 
<section id="id1410b1608b9244e388e3aee008336302"><enum>105.</enum><header>Biennial report on marine carbon dioxide removal</header> 
<subsection id="id03fba334bb9646d49e04dacd9d11a500"><enum>(a)</enum><header>In general</header><text>Not later than 2 years after the date of the enactment of this Act, and not less frequently than once every 2 years thereafter, the interagency working group shall—</text> <paragraph commented="no" display-inline="no-display-inline" id="id9a84c3b74449428ea6a531af2fc89817"><enum>(1)</enum><text display-inline="yes-display-inline">publish a report on marine carbon dioxide removal carried out pursuant to this Act, in accordance with subsection (c); and </text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="idf4eede3bb261495e9a8b2071511fc71e"><enum>(2)</enum><text display-inline="yes-display-inline">submit the report to the relevant congressional committees. </text></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="id6fb641e44ecf4dc9bf249e891af2fbd5"><enum>(b)</enum><header>Elements</header><text display-inline="yes-display-inline">Each report required by subsection (a) shall include, for the period covered by the report, the following: </text> 
<paragraph id="idb30d2b7108644237a075765f392969c2"><enum>(1)</enum><text>A description of progress made toward the objectives described in section 101(b)(1), including—</text> <subparagraph id="idaede4e6d0efe4cc5bc3ea61b07533d22"><enum>(A)</enum><text>findings generated under subparagraph (A) of such section and the information on which those findings are based; and</text></subparagraph> 
<subparagraph id="idcf285a4c809a4fc0bb8c6d5784ebad83"><enum>(B)</enum><text>efforts and outcomes related to subparagraph (B) of such section. </text></subparagraph></paragraph> <paragraph id="id105b0463e2344e30b46255f6461ab674"><enum>(2)</enum><text>A summary of the activities conducted at all research areas designated or established under section 103, including—</text> 
<subparagraph id="id8de2167591274d1cbf25a86273ad0149"><enum>(A)</enum><text>the number of entities and personnel using each research area for marine carbon dioxide removal; and </text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="id1da145001f654c3e8afc2db832986869"><enum>(B)</enum><text display-inline="yes-display-inline">the specific marine carbon dioxide removal approaches studied or deployed.</text></subparagraph></paragraph> 
<paragraph id="idad1f2d3b2c284e59866df0a9db5adcfb"><enum>(3)</enum><text>A summary of key findings from data collection and monitoring, including—</text> <subparagraph id="idb54a6839f0db4a57ba5131b778414441"><enum>(A)</enum><text>the amount of carbon dioxide removed from the ocean and the atmosphere, as measured on a life-cycle basis, by each removal technology;</text></subparagraph> 
<subparagraph id="id25bf4edb73b049eebc2580488417298d"><enum>(B)</enum><text>whether a particular removal technology results in net removals of greenhouse gasses from the atmosphere over its life cycle, and the duration of sequestration, as applicable;</text></subparagraph> <subparagraph id="ida551e5ff8c664919b4b2b8474ade906b"><enum>(C)</enum><text>for removal technologies that rely on an energy source, the amount of energy consumed by the technology; and</text></subparagraph> 
<subparagraph id="id137a0a9cc3b24ebd89c4210ec01af6e9"><enum>(D)</enum><text>any other metrics the interagency working group considers necessary or advisable.</text></subparagraph></paragraph> <paragraph id="id44e3e995b76340a794bb2c149e4c9407"><enum>(4)</enum><text>A summary of research findings, knowledge gaps, and future research priorities.</text></paragraph> 
<paragraph id="id36585470a99c4fc096cbfcd89fa73814"><enum>(5)</enum><text>An assessment of the permitting regime regulating marine carbon dioxide removal that includes recommendations for improved efficiency or coordination, as applicable. </text></paragraph> <paragraph id="id00acdd534c414b7fb5d286c45dbb9ba2"><enum>(6)</enum><text>An identification of barriers in resources, capacity, technology, infrastructure, or expertise to advancing the science and application of marine carbon dioxide removal.</text></paragraph> 
<paragraph id="idf2d8bfe3c85f4e94b6f0cd55105b352a"><enum>(7)</enum><text>Strategic updates to the objectives described in section 101(b)(1). </text></paragraph> <paragraph id="id0b79b581feae4c0a8b29b361cab645a6"><enum>(8)</enum><text>Any additional matters the interagency working group considers relevant. </text></paragraph></subsection> 
<subsection id="id05a2193c94a8474bb4b9de424055d35f" commented="no"><enum>(c)</enum><header>Public availability</header><text>The interagency working group shall—</text> <paragraph commented="no" display-inline="no-display-inline" id="id7b103e62b9a14961989d4cc06b4aca33"><enum>(1)</enum><text display-inline="yes-display-inline">publish each report required by subsection (a) on a publicly accessible website; and </text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="id11ef1ba034474cd5a1ddb40465d2d414"><enum>(2)</enum><text display-inline="yes-display-inline">make each such report available to the public at no cost and with no restrictions on copying, publishing, distributing, citing, adapting, or otherwise using the report.</text></paragraph></subsection></section> <section id="idd89231587cdd46a9a5fd9f98a4d6cbf3"><enum>106.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated to the Under Secretary of Commerce for Oceans and Atmosphere to carry out this title—</text>

<subsection id="ida83338967a454665902a724a3be60dae"><enum>(a)</enum><header>Research</header><text>The Director of the National Science Foundation shall award grants to support the Federal research plan described in section 104, including research related to—</text> <paragraph id="id90291e63b0f04f7a90ca9b5e1c7157ad"><enum>(1)</enum><text>the efficacy of marine carbon dioxide removal, including measurability, magnitude of greenhouse gas removal, durability, and additionality;</text></paragraph> 
<paragraph id="ideefeeba8b86345558fb3b5fa7483932c"><enum>(2)</enum><text>ecosystem responses to and social dimensions of marine carbon dioxide removal;</text></paragraph> <paragraph id="id83b63071968d49359e1b003c6aeff8ae"><enum>(3)</enum><text>tools and technologies to support understanding and measurement of the efficacy and environmental impacts of marine carbon dioxide removal; and</text></paragraph> 
<paragraph id="idc01ddfecf0df4dd1a97344b6a4b6fab7"><enum>(4)</enum><text>other relevant research areas, as determined by the Director of the National Science Foundation.</text></paragraph></subsection> <subsection id="idb44ddb606e174ff0858caf7490038d60"><enum>(b)</enum><header>Coordination</header><text>In carrying out subsection (a), the Director of the National Science Foundation shall coordinate with the heads of appropriate Federal agencies, including the Secretary.</text></subsection> 
<subsection id="id174eb93c133545559d340b27eecaee33"><enum>(c)</enum><header>Science workforce development</header><text>The Director of the National Science Foundation shall leverage, as appropriate, the existing scientific training, workforce development programs, and networks of the National Science Foundation to build and expand scientific capacity and expertise related to marine carbon dioxide removal.</text></subsection></section> </title> <title id="idAE533F673C5B47708E215E48EC8E835E"><enum>III</enum><header>Matters relating to the National Aeronautics and Space Administration</header> <section id="id195f05f5ff4d4f28b4bf18a317db17b7"><enum>301.</enum><header>Measuring marine carbon dioxide removal from space</header> <subsection id="id23b3ed83b8f74b468ca2e8c0ec293f85"><enum>(a)</enum><header>Marine carbon dioxide removal activities</header><text>To the extent practicable, the Administrator of the National Aeronautics and Space Administration (referred to in this title as the <quote>Administrator</quote>) shall ensure that the capabilities and assets of the National Aeronautics and Space Administration are used to advance understanding of the efficacy and impacts of marine carbon dioxide removal and to support the Federal research plan described in section 104, including by—</text> 
<paragraph id="id6be1258d27ff46bea22ed21e02314d6e"><enum>(1)</enum><text>leveraging the research portfolio of the National Aeronautics and Space Administration;</text></paragraph> <paragraph id="idd746a2f7a46f48f88fd292a10a7a5010"><enum>(2)</enum><text>enhancing the monitoring and modeling programs of the National Aeronautics and Space Administration to incorporate relevant data for marine carbon dioxide removal;</text></paragraph> 
<paragraph id="id25c4451706e34bc580196d2af39d4501"><enum>(3)</enum><text>leveraging and aligning the Mission Directorates of the National Aeronautics and Space Administration; and</text></paragraph> <paragraph id="id7ba53e49686144b28730bab8107381ee"><enum>(4)</enum><text>carrying out any other relevant activity, as determined by the Administrator.</text></paragraph></subsection> 
<subsection id="idf1c8fce8c95a4a84aca6b9135a656fff"><enum>(b)</enum><header>Coordination and program consistency</header><text>In carrying out the activities described in subsection (a), the Administrator shall coordinate with the head of any appropriate Federal agency, including the Under Secretary of Commerce for Oceans and Atmosphere, to ensure that the research activities of the National Aeronautics and Space Administration are carried out in cooperation with the efforts of such agency.</text></subsection></section> <section id="id301c3fc8b2a54256b6300f97892e3bfd"><enum>302.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated to Administrator to carry out this title—</text>

<subsection id="id9f267d61dbbd472b9d051a25bae827dd"><enum>(a)</enum><header>Marine carbon dioxide removal initiative</header><text>The Under Secretary of Commerce for Standards and Technology shall carry out an initiative to develop and standardize benchmark materials, measurements, data, and models to accelerate innovation in and validate performance of materials and technologies for marine carbon dioxide removal.</text></subsection> <subsection id="idb74dbbff10264218bd705749f3c66d5d"><enum>(b)</enum><header>Coordination</header><text>In carrying out the activities described in subsection (a), the Under Secretary of Commerce for Standards and Technology shall coordinate with the heads of such Federal agencies as the Under Secretary considers appropriate, including the Under Secretary of Commerce for Oceans and Atmosphere.</text></subsection> 
<subsection id="id64771e7e6cae4493a2e87aa6dfc3da71" commented="no"><enum>(c)</enum><header>International engagement</header><text>The Under Secretary of Commerce for Standards and Technology, in coordination with the Secretary of State, shall engage international bodies to promote global adoption of the standards referred to in subsection (a).</text></subsection></section> <section id="id4a79c525da8445f9bafc96a6352abf38"><enum>402.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated to the Under Secretary of Commerce for Standards and Technology to carry out this title—</text>
