which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide grants to States, Indian Tribes, and Tribal organizations for activities to increase the availability of child care options and to support the child care workforce, and for other purposes. </official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Childcare Supply Improvement Act of 2024</short-title></quote>.</text></section><section id="id81770667DD9749E5B7E2E06F3DB460E5"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id52C3D5D6688C4184B60151A88D1B8515"><enum>(1)</enum><header>Allotment percentage</header><text>The term <term>allotment percentage</term>, with respect to a State, means the allotment percentage determined for the State in accordance with section 658O(b)(4) of the Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9858m">42 U.S.C. 9858m(b)(4)</external-xref>).</text></paragraph><paragraph commented="no" id="id8653A0F1AE5F46CF9D2792502AD30A98"><enum>(2)</enum><header>Child</header><text>The term <term>child</term> means an individual—</text><subparagraph commented="no" id="id4097603f1089464f888584799ebc9c06"><enum>(A)</enum><text>who is age 5 or younger; or</text></subparagraph><subparagraph commented="no" id="id027119a7272e48d1b6436342bddd9ad1"><enum>(B)</enum><text>who has not yet entered kindergarten.</text></subparagraph></paragraph><paragraph commented="no" id="idC5899873AB6B460FBA65CA35B2651CA5"><enum>(3)</enum><header>Child with a disability</header><text>The term <term>child with a disability</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="H9B6047B12F994CF1ABB209F60C208A42"><enum>(A)</enum><text display-inline="yes-display-inline">a child with a disability, as defined in section 602 of the Individuals with Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1401">20 U.S.C. 1401</external-xref>), except the term <quote>child</quote> shall be limited to a child as defined in paragraph (2);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5F0C547877824BFDB1C4779AF6ABC6F9"><enum>(B)</enum><text display-inline="yes-display-inline">a child who is eligible for early intervention services under part C of the Individuals with Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1431">20 U.S.C. 1431 et seq.</external-xref>);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H078FB38ABC2E4FB6BC89B216AD22F8B3"><enum>(C)</enum><text display-inline="yes-display-inline">a child who is eligible for services under section 504 of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/794">29 U.S.C. 794</external-xref>); or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3B1D1CE8598F4A2DB7C3EE94AFD33EEB"><enum>(D)</enum><text display-inline="yes-display-inline">a child with a disability, as the term <quote>disability</quote> is defined by the State involved.</text></subparagraph></paragraph><paragraph commented="no" id="id0F388ABD54AE4B20831E11392EE73AA7"><enum>(4)</enum><header>Child care program</header><text>The term <term>child care program</term>—</text><subparagraph commented="no" id="id7F2709747FFB486DABE31ECECD8D942D"><enum>(A)</enum><text>means any program—</text><clause commented="no" id="id53C0BD2884554DDDBDDAFF32F8A68282"><enum>(i)</enum><text>that provides child care or education for children, in any setting or through any funding source; and</text></clause><clause commented="no" id="id9B911BAA25D94ECFA3E79AAE7F99066F"><enum>(ii)</enum><text>that is licensed to provide such care or education under licensing requirements applicable in the State or is exempt from such requirements; and</text></clause></subparagraph><subparagraph commented="no" id="id00E108C736674788997838F67F0A11E9"><enum>(B)</enum><text>includes—</text><clause commented="no" id="id3D1E06112E574EE5918CE0F81B72BCE4"><enum>(i)</enum><text>any program operated by a center-based child care provider or a family child care provider;</text></clause><clause commented="no" id="id0AD973697C4D4BDBB3399698D96B3A88"><enum>(ii)</enum><text>child care provided by relatives, friends, or neighbor caregivers;</text></clause><clause commented="no" id="id6c17433c629d4f75b854428f7562e9ad"><enum>(iii)</enum><text>any preschool program funded by the Federal Government, a State, or a local educational agency; or</text></clause><clause commented="no" id="iddd10a6a1ec7a411dbf8922cb29c0254e"><enum>(iv)</enum><text>a Head Start program, including an Early Head Start program, under the Head Start Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9831">42 U.S.C. 9831 et seq.</external-xref>).</text></clause></subparagraph></paragraph><paragraph id="id17158622B41A4D798E75F9F8F755E94A"><enum>(5)</enum><header>Child care provider</header><text>The term <term>child care provider</term> means the staff of a child care program.</text></paragraph><paragraph id="id9844C226F3CC4617AE1DF90527F2CB4E"><enum>(6)</enum><header>Eligible community development financial institution</header><text>The term <term>eligible community development financial institution</term> means—</text><subparagraph id="idf72c0330909849f391439d8da41c1ce9"><enum>(A)</enum><text>a community development financial institution (as defined in section 103 of the Community Development Banking and Financial Institutions Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/12/4702">12 U.S.C. 4702</external-xref>)) that has been certified by the Community Development Financial Institutions Fund under section 1805.201 of title 12, Code of Federal Regulations, or any successor regulation; or</text></subparagraph><subparagraph id="idd3bce48d5767427f82731c60756e0f75"><enum>(B)</enum><text>an organization that—</text><clause id="id99e1aed413aa4401b6755bc5991879ac"><enum>(i)</enum><text>is described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986;</text></clause><clause id="iddc86dddbd9054d1aa301ecf9e9e7a00c"><enum>(ii)</enum><text>is exempt from taxation under section 501(a) of such Code; and</text></clause><clause id="id4f0047ab046a46da827c3e975af2035f"><enum>(iii)</enum><text>has demonstrated experience in—</text><subclause id="id111a897b2a3848f090d3ffab43fe50aa"><enum>(I)</enum><text>providing technical or financial assistance for the acquisition, construction, renovation, or improvement of child care facilities;</text></subclause><subclause id="id0d1a71758f7849e5b18c3f72982bce67"><enum>(II)</enum><text>providing technical, financial, or managerial assistance to child care providers; and</text></subclause><subclause id="id36a8adfa1f824d35af1b3513ab7bb05d"><enum>(III)</enum><text>securing private sources of capital financing for child care or other low-income community development.</text></subclause></clause></subparagraph></paragraph><paragraph commented="no" id="id9B52B8E1F6F340A89B1C5DF19DCAAAA4"><enum>(7)</enum><header>Family child care provider</header><text>The term <term>family child care provider</term> has the meaning given the term in section 658P of the Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9858n">42 U.S.C. 9858n</external-xref>).</text></paragraph><paragraph id="id74AA6976847547FE81E4B09EA1F7C1FC"><enum>(8)</enum><header>Indian Tribe; Tribal organization</header><text>The terms <term>Indian Tribe</term> and <term>Tribal organization</term> have the meanings given the terms <quote>Indian tribe</quote> and <quote>tribal organization</quote> in section 658P of the Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9858n">42 U.S.C. 9858n</external-xref>).</text></paragraph><paragraph commented="no" id="id99A82ECFB33E4BFAAC9260002DB499BD"><enum>(9)</enum><header>Interrater reliability</header><text>The term <term>interrater reliability</term> has the meaning given the term in section 637 of the Head Start Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9832">42 U.S.C. 9832</external-xref>).</text></paragraph><paragraph id="id0D8DE71A09584C85B27904CA8C4E1C60"><enum>(10)</enum><header>Local or regional entity</header><text>The term <term>local or regional entity</term> means—</text><subparagraph id="id63ee4638abad43c181a0f27929c60836"><enum>(A)</enum><text>an agency administering a Head Start program, including an Early Head Start program, under the Head Start Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9831">42 U.S.C. 9831 et seq.</external-xref>);</text></subparagraph><subparagraph commented="no" id="idc62515a0b7ac426a9506030c5d9875fb"><enum>(B)</enum><text>a State or local agency responsible for administering a child care program, including a local agency responsible for administering a child care program that is a home visiting program for children;</text></subparagraph><subparagraph id="ida2c78610f5fd46209c83738f0b41dae9"><enum>(C)</enum><text>a local early childhood advisory council or coalition;</text></subparagraph><subparagraph id="id97a90bbaf2204d139c0bb71e6ff59bc1"><enum>(D)</enum><text>a local or regional child care resource and referral organization described in section 658E(c)(3)(B)(iii) of the Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9858c">42 U.S.C. 9858c(c)(3)(B)(iii)</external-xref>);</text></subparagraph><subparagraph id="id00DF557748974DB2889DA5D97221AB1E"><enum>(E)</enum><text>an eligible community development financial institution;</text></subparagraph><subparagraph id="id13AD2494EC6E4E1EBCDEDF78AE782A90"><enum>(F)</enum><text>a nonprofit organization, professional association, or community-based organization with expertise in child care; or</text></subparagraph><subparagraph id="id318bd676d9c4451f852e6fdddd433778"><enum>(G)</enum><text>a consortium of entities described in any of subparagraphs (A) through (F).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9A70289913C84DDD888015FEB07F4233"><enum>(11)</enum><header>School lunch factor</header><text>The term <term>school lunch factor</term> has the meaning given the term in section 658O(b)(3) of the Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9858m">42 U.S.C. 9858m(b)(3)</external-xref>).</text></paragraph><paragraph id="id8792B3A2BC8641F69DFB0E5C797783C5"><enum>(12)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Health and Human Services.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD4216B1344944F9CB992BEDBF0E4C7B7"><enum>(13)</enum><header display-inline="yes-display-inline">State</header><text display-inline="yes-display-inline">The term <term>State</term> has the meaning given the term in section 658P of the Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9858n">42 U.S.C. 9858n</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id25651EAF542944C0B5B79B460B275CB4"><enum>(14)</enum><header>Young child factor</header><text>The term <term>young child factor</term> has the meaning given the term in section 658O(b)(2) of the Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9858m">42 U.S.C. 9858m(b)(2)</external-xref>).</text></paragraph></section><section id="idCC35DA78235F4F0F80E56994079DE06F"><enum>3.</enum><header>Child care supply improvement program</header><subsection id="id96FDD8ED48954131B173A2A2978ED065"><enum>(a)</enum><header>Establishment</header><text>The Secretary shall establish a program to award to States, Indian Tribes, and Tribal organizations—</text><paragraph id="id14C45B64C38042958516FFC996A752DF"><enum>(1)</enum><text>grants for child care facilities in accordance with section 4; and</text></paragraph><paragraph id="id992F886879CC4D9D993C21AD0A503E81"><enum>(2)</enum><text>grants for the purpose of carrying out the activities described in section 5.</text></paragraph></subsection><subsection id="id58EAC86EC6574071A35B233A5B4FEE82"><enum>(b)</enum><header>Application process</header><text>A State, Indian Tribe, or Tribal organization seeking a grant under this Act shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary may reasonably require.</text></subsection><subsection commented="no" id="idF23DDB950C7D481B85014CD2B22A5F51"><enum>(c)</enum><header>Grant amounts</header><paragraph commented="no" id="idED5140B2F07C475A98E237FD6E7127B0"><enum>(1)</enum><header>In general</header><text>Each State, Indian Tribe, or Tribal organization that submits an application meeting the requirements of the Secretary under subsection (b) shall be entitled to a grant in an amount that is determined in accordance with the reservations and allotments under this subsection.</text></paragraph><paragraph commented="no" id="id8AE6CD5B97224D75B17B2C25FB854D5A"><enum>(2)</enum><header>Amounts reserved</header><subparagraph commented="no" id="id89735C4C0DB14F86BF2CD3B16767CD47"><enum>(A)</enum><header>Territories and possessions</header><text>The Secretary shall reserve not to exceed one-half of 1 percent of the amount appropriated under section 8 in each fiscal year for payments to Guam, American Samoa, the Virgin Islands of the United States, and the Commonwealth of the Northern Mariana Islands to be allotted in accordance with their respective needs.</text></subparagraph><subparagraph commented="no" id="id17DDEBEA29C7441EB3D164E769308B14"><enum>(B)</enum><header>Indian Tribes</header><text>The Secretary shall reserve not less than 4 percent of the amount appropriated under section 8 in each fiscal year for grants to Indian Tribes and Tribal organizations that submit an application meeting the requirements of the Secretary under subsection (b).</text></subparagraph></paragraph><paragraph commented="no" id="id92736E3AFCA8449B849101C38AAF03CE"><enum>(3)</enum><header>State allotments</header><text>From the amount appropriated under section 8 for each fiscal year that is remaining after the reservations under paragraph (2), the Secretary shall allot to each State an amount equal to the sum of—</text><subparagraph id="IDC09CC4A31120404787219DA2FA2FF382"><enum>(A)</enum><text>an amount that bears the same ratio to 50 percent of such remainder as the product of the young child factor of the State and the allotment percentage of the State bears to the sum of the corresponding products for all States; and</text></subparagraph><subparagraph id="IDC34118AB910F405483AF5A990DEBD3F4"><enum>(B)</enum><text>an amount that bears the same ratio to 50 percent of such remainder as the product of the school lunch factor of the State and the allotment percentage of the State bears to the sum of the corresponding products for all States.</text></subparagraph></paragraph></subsection></section><section id="id61E510A9373F40459D219B61B0DA2DE5"><enum>4.</enum><header>Grants for child care facilities</header><subsection id="idc2a1babc0d7044f49e6f45ffd4368d84"><enum>(a)</enum><header>In general</header><text>A grant awarded under section 3(a)(1) shall be used to award a subgrant to an eligible community development financial institution, which may partner with other local or regional entities, for the purpose of—</text><paragraph id="idD9E9F8DEAF974E8FACFAC9576134B9AF"><enum>(1)</enum><text>providing technical or financial assistance for the acquisition, construction, or improvements of child care facilities;</text></paragraph><paragraph id="ida928e45bf5394db6be636fee93a8e791"><enum>(2)</enum><text>providing technical, financial, or managerial assistance to child care programs;</text></paragraph><paragraph id="idD0FAA55DC03B4370B9762D4278E4D418"><enum>(3)</enum><text>subject to subsection (b), renovating child care facilities to comply with State or local health and safety requirements;</text></paragraph><paragraph id="idA567D67B28DB4682B5293FB7D0CF1AD7"><enum>(4)</enum><text>establishing low-cost—</text><subparagraph id="id40C7C5D474994032937DC6FEC4396F85"><enum>(A)</enum><text>loan programs for child care programs; or</text></subparagraph><subparagraph id="idB0A8327173CA497EA2C6E88FB6916CA5"><enum>(B)</enum><text>loan forgiveness programs for child care programs in accordance with subsection (c); or</text></subparagraph></paragraph><paragraph id="id461e6c28e7b8497ca357d413ef547c57"><enum>(5)</enum><text>developing and piloting local, voluntary best practices related to community zoning standards to support the provision and expansion of child care services.</text></paragraph></subsection><subsection commented="no" id="id0f22fc77e2ee4d54a4895bcebeeaee1d"><enum>(b)</enum><header>Residential renovations</header><text>A renovation to a private residence in which a family child care provider provides child care services may be supported through a grant under section 3(a)(1), only if necessary to comply with State or local health and safety requirements. Such a renovation may include—</text><paragraph commented="no" id="id4B9637BE69E34C09BC9868182D75E8F4"><enum>(1)</enum><text>indoor or outdoor modifications, including such modifications to support accessibility for children with disabilities; or</text></paragraph><paragraph commented="no" id="id52EF2371CF2C4B3F819CDF712E8A3C79"><enum>(2)</enum><text>lead remediation and abatement activities.</text></paragraph></subsection><subsection id="idb3745681ed7c44ec8813a1f23565f3d9"><enum>(c)</enum><header>Loan forgiveness programs</header><text>A loan forgiveness program supported under subsection (a)(4)(B)—</text><paragraph id="id4E0F946E32824169B0A5EDB110A4989A"><enum>(1)</enum><text>shall provide loan forgiveness for child care programs over a period of time;</text></paragraph><paragraph id="idF7A45A3BD1334281AE0845D2D4C179FC"><enum>(2)</enum><text>shall prioritize loan forgiveness for child care programs that are or become licensed, regulated, or registered under State law and become nationally accredited or rated under a tiered quality rating system described in section 658G(b)(3) of the Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9858e">42 U.S.C. 9858e(b)(3)</external-xref>); and</text></paragraph><paragraph id="idaa5db7f9091a4b1da8a2b1fab222cb6d"><enum>(3)</enum><text>may prioritize child care programs—</text><subparagraph id="idF19F998E947B418788F0433EC01870E3"><enum>(A)</enum><text>providing high-quality care for infants and toddlers during non-traditional hours;</text></subparagraph><subparagraph id="id38FBC169E32447D78D7C8CF3CE5A8B45"><enum>(B)</enum><text>providing inclusive care for children with disabilities;</text></subparagraph><subparagraph id="id30596960438642DCB2E11F0DBB436498"><enum>(C)</enum><text>serving children in a geographic area for which there is a shortage of child care; or</text></subparagraph><subparagraph id="id80DBDC2331884823A053E59475E7533E"><enum>(D)</enum><text>that otherwise meet the needs identified in the community needs assessment conducted by the State, Indian Tribe, or Tribal organization under section 6.</text></subparagraph></paragraph></subsection></section><section id="id8DC9A8014E41467B99D6C341A449A88B"><enum>5.</enum><header>Grants for quality services, compliance requirements, business support, and administrative improvement activities</header><subsection id="idDC8A7127D2AB464A8DCEB7BCF7F9294D"><enum>(a)</enum><header>Subgrants</header><text>A State, Indian Tribe, or Tribal organization awarded a grant under section 3(a)(2) may make subgrants to, or partner with, local or regional entities to carry out any activity supported by the grant in accordance with this section.</text></subsection><subsection id="id71FB3E79EA5A489BA029DD86320E1C89"><enum>(b)</enum><header>Activities</header><text>A grant awarded under section 3(a)(2) shall be used for any of the following activities:</text><paragraph commented="no" id="id3708F944CF5844C6A99E2199296DF719"><enum>(1)</enum><text>Activities to provide—</text><subparagraph commented="no" id="id30D4CB175BD04C39AD35DF566B6A4860"><enum>(A)</enum><text>pathways for child care programs operating legally without a child care license to obtain such license;</text></subparagraph><subparagraph commented="no" id="id0192658EE2FB40509EED6FB6116C9A82"><enum>(B)</enum><text>pre-licensing orientation for individuals seeking a child care license;</text></subparagraph><subparagraph commented="no" id="idC8E054782E1749EA8B000381676B9CD9"><enum>(C)</enum><text>technical assistance throughout the child care licensing process; or</text></subparagraph><subparagraph id="id4d1a0ba64ebb4eaeb99229c33d1a6e01"><enum>(D)</enum><text>pathways to accreditation of child care programs and quality improvement for such programs, including entry into or improvement on a tiered quality rating system described in section 658G(b)(3) of the Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9858e">42 U.S.C. 9858e(b)(3)</external-xref>).</text></subparagraph></paragraph><paragraph id="idafab28bccf3c49b88e9856348b7e94aa"><enum>(2)</enum><text>Activities, in accordance with subsection (c), to provide ongoing, job-embedded professional development for child care programs, including structured training, coaching, mentoring, professional development visits, and peer support activities, or professional opportunities, to reduce isolation of child care providers, including through cohort-based models.</text></paragraph><paragraph commented="no" id="id7FDE61FA75F54F3D8F8B696739CD01CC"><enum>(3)</enum><text>Activities to provide business start-up support for child care programs as described in subsection (d).</text></paragraph><paragraph commented="no" id="id510bd6bb93f34f689cb7c7312de34698"><enum>(4)</enum><text>Activities to improve the administration of child care programs, by States, Indian Tribes, or Tribal organizations, which shall include activities as described in subsection (e).</text></paragraph></subsection><subsection commented="no" id="idEB2360EB419D4B7FB05EEC5A058242E5"><enum>(c)</enum><header>Professional development activities</header><paragraph commented="no" id="id379E932E8BAD4E539C73379A5E4313DA"><enum>(1)</enum><header>Accessibility</header><text>The professional development activities described in subsection (b)(2) shall—</text><subparagraph commented="no" id="id284FBA3409784EFEA96002F05FFBE0F4"><enum>(A)</enum><text>be appropriate, relevant, accessible, and affordable for family child care providers in home-based settings; and</text></subparagraph><subparagraph commented="no" id="idE0ACF1B44B9D4A9C87363705E35093DB"><enum>(B)</enum><text>be culturally responsive and linguistically appropriate for the applicable community.</text></subparagraph></paragraph><paragraph commented="no" id="id5D4ACB9858714BA2A533F33AEE3B2AE7"><enum>(2)</enum><header>Activities</header><text>Such professional development activities may include—</text><subparagraph commented="no" id="id89ED27A114324CEB97929E657EFBF745"><enum>(A)</enum><text>assistance for child care providers in obtaining qualified, temporary substitute child care or reimbursing such child care providers for obtaining such child care;</text></subparagraph><subparagraph commented="no" id="id79FC949680AB40779D69A084A93E346F"><enum>(B)</enum><text>the creation, expansion, or replication of staffed family child care networks;</text></subparagraph><subparagraph commented="no" id="id8D36828B4DFD460CAAB0EB50412EE6DC"><enum>(C)</enum><text>the creation, expansion, or replication of infant-toddler specialist networks; and</text></subparagraph><subparagraph commented="no" id="id0f90328228664c52be9f33bf394ca61c"><enum>(D)</enum><text>cross-sector training and partnership opportunities for teachers and staff of—</text><clause commented="no" id="id82712A074E264E9481452DF61C784485"><enum>(i)</enum><text>Head Start programs, including Early Head Start programs, under the Head Start Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9831">42 U.S.C. 9831 et seq.</external-xref>);</text></clause><clause commented="no" id="id9896D830128D49F58C81FA53BF4715D0"><enum>(ii)</enum><text>early intervention programs;</text></clause><clause commented="no" id="idB039D55E68AA4B3A9AFB64EA24830659"><enum>(iii)</enum><text>infant and early childhood mental health programs;</text></clause><clause commented="no" id="id5C0D07D2A2EE445FA957F042ABCBFA3A"><enum>(iv)</enum><text>home visiting child care programs;</text></clause><clause commented="no" id="idDAAF21A8BE674D778B6388E740651C45"><enum>(v)</enum><text>State-funded prekindergarten and preschool programs that receive funds under part A of title I of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311 et seq.</external-xref>); or</text></clause><clause commented="no" display-inline="no-display-inline" id="id13FF8E548CD64C38BFE7C14A78A2385B"><enum>(vi)</enum><text>any other child care program.</text></clause></subparagraph></paragraph></subsection><subsection commented="no" id="idF970D07CAA234885B3C13D6E77181C52"><enum>(d)</enum><header>Business start-Up activities</header><text>The business-start up activities described in subsection (b)(3)—</text><paragraph commented="no" id="id9FE039400B6A458A89AA75464EDD1B39"><enum>(1)</enum><text>shall—</text><subparagraph commented="no" id="id4436ebf3fe644335a36adc0d58edb0b9"><enum>(A)</enum><text>promote sound, sustainable business practices, including business planning practices, to child care programs, including through orientations for child care programs and related programs, such as the child and adult care food program established under section 17 of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1766">42 U.S.C. 1766</external-xref>);</text></subparagraph><subparagraph commented="no" id="id1ebc08881d9e422f91dcc1ad0eb81346"><enum>(B)</enum><text>provide financial aid or technical assistance to assist child care providers in complying with licensing requirements, or health and safety requirements;</text></subparagraph><subparagraph commented="no" id="id8b2c33091f8746fd8155febf062fbd8b"><enum>(C)</enum><text>provide technical assistance or financial assistance for costs associated with beginning a business, including costs for equipment or supplies, including diapers and diapering supplies; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7CF717A0E78C4677BCCC63DCE7EADF10"><enum>(D)</enum><text>develop shared service models for child care programs with respect to business activities including accounting, marketing, communications, health insurance, and legal support activities; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idAE6AD7F5FEF84F67950AB96EDEFA0B9D"><enum>(2)</enum><text>may include activities to promote innovative solutions or support the development of innovative models or arrangements for child care providers, such as co-located child care programs or employer-sponsored child care programs, which may be identified through the community needs assessment conducted by the State, Indian Tribe, or Tribal organization under section 6.</text></paragraph></subsection><subsection commented="no" id="id46F62792BA894F93BC11F3770D5FBCF9"><enum>(e)</enum><header>Improving administration</header><paragraph commented="no" id="id32AABDB8C3C343728C46C11EE1B4452C"><enum>(1)</enum><header>In general</header><text>The activities described in subsection (b)(4) shall include activities to—</text><subparagraph commented="no" id="idABE3A51C6AB649F488121BC1DCD4791A"><enum>(A)</enum><text>improve data collection with respect to child care services, including the collection of information by States under section 658K of the Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9858i">42 U.S.C. 9858i</external-xref>);</text></subparagraph><subparagraph commented="no" id="idA889E08B20C24161B45DEF936CDD4130"><enum>(B)</enum><text>improve coordination between States and Indian Tribes or Tribal organizations receiving assistance under such Act, the Head Start Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9831">42 U.S.C. 9831 et seq.</external-xref>), or this Act;</text></subparagraph><subparagraph commented="no" id="id5BF905A343C04C29AFB6B65D6035F107"><enum>(C)</enum><text>improve coordination between States and local governments with respect to licensing and other regulatory requirements for child care providers, and, if applicable, the State’s tiered quality rating system described in section 658G(b)(3) of the Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9858e">42 U.S.C. 9858e(b)(3)</external-xref>);</text></subparagraph><subparagraph commented="no" id="id1478E382669A486CA4DD1D0D9AFBA79F"><enum>(D)</enum><text>increase interrater reliability in licensing inspections or other evaluations of child care programs by training licensing inspectors of child care providers and providing such inspectors with additional professional development;</text></subparagraph><subparagraph commented="no" id="id4D7CBE8B8C66489D8CAB702313CBBC19"><enum>(E)</enum><text>identify and eliminate barriers to child care licensure, such as through reducing fees for background checks, translating licensing regulations into languages other than English, collaborating with housing authorities or local governments, or addressing other barriers that may be identified through the community needs assessment conducted under section 6; or</text></subparagraph><subparagraph commented="no" id="idAA1467051BAB4BCB93310B2E50131F54"><enum>(F)</enum><text>improve the functionality of activities related to State and local regulatory requirements, including requirements with respect to licensing and licensing inspections, in accordance with paragraph (2).</text></subparagraph></paragraph><paragraph commented="no" id="idA37BFD41AEDB4F16935255859FC7730B"><enum>(2)</enum><header>Functionality activities</header><text>The activities described in paragraph (1)(F) may include developing modern technology in accordance with paragraph (3) to assist and improve with—</text><subparagraph commented="no" id="id9C58052028864C838992D1011996B3FA"><enum>(A)</enum><text>outreach, including communication to child care providers of—</text><clause commented="no" id="idFD6301D52B474B4EBEE326F52B4AEB5D"><enum>(i)</enum><text>licensing and other regulatory requirements described in subparagraph (K) of section 658E(c)(2) of the Child Care and Development Block Grant Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/9858c">42 U.S.C. 9858c(c)(2)</external-xref>); and</text></clause><clause commented="no" id="id6DD137B417BB422F8265F60EB968010C"><enum>(ii)</enum><text>health and safety requirements described in subparagraph (I) of such section;</text></clause></subparagraph><subparagraph commented="no" id="id188AC6AA1B2241758BF481BE389375AF"><enum>(B)</enum><text>enforcement of the requirements described in clauses (i) and (ii) of subparagraph (A);</text></subparagraph><subparagraph commented="no" id="id62E5336420E74A5593DFB96066521690"><enum>(C)</enum><text>assistance to child care providers in complying with such requirements; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4072CC43C1AC4EFA9ADC0573BDBA97FC"><enum>(D)</enum><text>efforts to streamline State and local paperwork requirements for child care providers without diminishing any health and safety requirements applicable to such providers.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id66CD1D3D280941FB93886211BD0C82BF"><enum>(3)</enum><header>Modern technology</header><text>Any modern technology developed under paragraph (2) shall—</text><subparagraph commented="no" id="idebdbdc95f3da4b70a7c5983eb105eccd"><enum>(A)</enum><text>focus on the needs of child care providers subject to the requirements described in clauses (i) and (ii) of paragraph (2)(A); and</text></subparagraph><subparagraph commented="no" id="idf5b6d39fec204bc2a4d9a4dff24e5b93"><enum>(B)</enum><text>take into consideration, to the extent possible, best practices related to technology development practices, including user-centered design, as detailed in applicable Federal guidelines, such as the Digital Services Playbook.</text></subparagraph></paragraph></subsection></section><section id="idDE8789E6F974408798CBECA70BC02B35"><enum>6.</enum><header>Community needs assessment</header><subsection id="id28C703334590474A8CB45B9148799EAD"><enum>(a)</enum><header>In general</header><text>Each State, Indian Tribe, or Tribal organization receiving a grant under this Act shall, prior to undertaking any activity supported by such a grant, conduct an assessment of the needs of the State, Indian Tribe, or Tribal organization with respect to issues including—</text><paragraph id="id075A67F0D8594A439611203987D55B03"><enum>(1)</enum><text>the overall supply of child care programs, including the supply of high-quality child care programs;</text></paragraph><paragraph id="idAC90CA259E0442328699567A0EA1BF56"><enum>(2)</enum><text>geographic shortages and diversity of child care providers;</text></paragraph><paragraph id="id56D9969874E14D5CAB85EDC707B041DA"><enum>(3)</enum><text>child care offered during nontraditional hours;</text></paragraph><paragraph id="idEE224B8C6F144B8A880892AF9FCE35BB"><enum>(4)</enum><text>cultural and linguistic needs of children, parents, and child care providers; and</text></paragraph><paragraph id="id5F5266406E2B4148B90EC6461029926D"><enum>(5)</enum><text>relevant trends in child care supply and demand.</text></paragraph></subsection><subsection id="id4B545B6A853A40619740A2A4752B173D"><enum>(b)</enum><header>Consultation</header><text>In preparing the needs assessment required under subsection (a), the State, Indian Tribe, or Tribal organization shall consult with parents, child care stakeholder groups, relevant local governments, interested businesses and employers, related professional associations, and community-based organizations.</text></subsection><subsection id="idA1105A3DC26140F4BEEBCE46A9E3DFE9"><enum>(c)</enum><header>Results</header><text>A State, Indian Tribe, or Tribal organization receiving a grant under this Act shall—</text><paragraph id="id97981DCE7B664D129C4E38323671D8E6"><enum>(1)</enum><text>use the results of the needs assessment required under subsection (a) to determine how to use the funds awarded through such grant to address the needs of children, parents, and child care providers; and</text></paragraph><paragraph id="ideda7411779c74ea883c7cfe322f06cbf"><enum>(2)</enum><text>to the greatest extent possible, use the funds awarded through such grant in proportion to the needs determined through such assessment to increase the supply of high-quality child care, which may include a focus on a particular issue described in any of paragraphs (1) through (5) of subsection (a).</text></paragraph></subsection></section><section commented="no" id="id5cc47d237ae04a43a2b47cc108b15a00"><enum>7.</enum><header>Administrative requirements</header><subsection commented="no" id="id5191DBD0639E48ADA1231BEBF65E2B34"><enum>(a)</enum><header>Supplement and not supplant</header><text>Funds made available through a grant or subgrant under this Act shall supplement, and not supplant, other Federal, State, or local funds that are available for child care programs or other family engagement programs.</text></subsection><subsection commented="no" id="id93cd41c748eb40dcb56d1c418ce377ce"><enum>(b)</enum><header>Maintenance of effort</header><text>A State, Indian Tribe, or Tribal organization that receives funds through a grant under this Act for a fiscal year shall maintain the fiscal effort provided by the State, Indian Tribe, or Tribal organization for the activities supported by such funds at a level equal to or greater than the level of such fiscal effort for the preceding fiscal year.</text></subsection><subsection commented="no" id="id371db28a385d4f7789c4d4aa5d2e4509"><enum>(c)</enum><header>Voluntary participation</header><text>A State, Indian Tribe, or Tribal organization that receives a grant under this Act shall ensure that family participation in any program supported by such grant shall be voluntary and not preclude the family from participating in any other Federal, State, or local program.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="idaaf8870f66bb442aa433d644c88b3a07"><enum>8.</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated such sums as may be necessary to carry out this Act.</text></section></legis-body></bill>
