display-inline="no-display-inline" id="id94d982a451534a429d1449d59ec05987"><enum>(1)</enum><text display-inline="yes-display-inline">by striking subparagraphs (B), (D), and (E); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id87e78f72e11a451183b02d8b90f8e828"><enum>(2)</enum><text>by redesignating subparagraph (C) as subparagraph (B).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id1548e56032d141c5acc344256e14daf0"><enum>(b)</enum><header display-inline="yes-display-inline">Narrowing the definition of qualified alien under PRWORA</header><paragraph commented="no" display-inline="no-display-inline" id="idb4eb9043744a4abe9e9d439276a3f370"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 431(b) of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1641">8 U.S.C. 1641(b)</external-xref>) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="idce7773bdab8b48838070fca1a267b788"><enum>(A)</enum><text>by striking paragraphs (2), (4), and (5); and</text></subparagraph><subparagraph id="idc826688d26da419a825c5a24a9396bc3"><enum>(B)</enum><text>by redesignating paragraphs (3), (6), (7), and (8) as paragraphs (2), (3), (4), and (5), respectively.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide2e26faa6efb42ff9ad4feac515129cd"><enum>(2)</enum><header>Exclusion of individuals paroled into the United States for less than 1 year</header><text>Section 411(a) of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1621">8 U.S.C. 1621(a)</external-xref>) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="idd175dc50316f438eb2f56158ade79e86"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking the comma at the end and inserting <quote>, or</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida25a940321074621a856f6cfb745b503"><enum>(B)</enum><text>in paragraph (2), by striking <quote>or</quote> at the end; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4ed33c42fb80473ab5cd8fe585058b5c"><enum>(C)</enum><text>by striking paragraph (3).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6a09348892434644aa4501d7ce0d8558"><enum>(3)</enum><header display-inline="yes-display-inline">Conforming amendments</header><subparagraph commented="no" display-inline="no-display-inline" id="id49237f5f6d5547b88ba28fe2077e1a7e"><enum>(A)</enum><text display-inline="yes-display-inline">Section 402(a)(2)(A) of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1612">8 U.S.C. 1612(a)(2)(A)</external-xref>) is amended—</text><clause commented="no" display-inline="no-display-inline" id="id366df77d74c447f5a5be0389791fb117"><enum>(i)</enum><text display-inline="yes-display-inline">in the subparagraph heading, by striking <quote><header-in-text style="OLC" level="subparagraph">and asylees</header-in-text></quote>;</text></clause><clause commented="no" display-inline="no-display-inline" id="id37c61bbd49a34dfb8fde1809c1ccf6f6"><enum>(ii)</enum><text display-inline="yes-display-inline">by striking clauses (ii) and (iii); id="id30b3ca449973499aa4b7c7aa5a290b2e"><enum>(B)</enum><text display-inline="yes-display-inline">Section 403(b)(1) of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1613">8 U.S.C. 1613(b)(1)</external-xref>) is amended—</text><clause commented="no" display-inline="no-display-inline" id="id04a401364bfe4eeb94d167e8da506f1d"><enum>(i)</enum><text display-inline="yes-display-inline">in the paragraph heading, by striking <quote><header-in-text style="OLC" level="paragraph">and asylees</header-in-text></quote>;</text></clause><clause commented="no" display-inline="no-display-inline" id="idaef0941240264145b111dd5dbda70ccf"><enum>(ii)</enum><text display-inline="yes-display-inline">by striking subparagraphs (B) and (C); and</text></clause><clause commented="no" display-inline="no-display-inline" id="id97f59927cc8e41278b2dc6dc3b59b45c"><enum>(iii)</enum><text>by redesignating subparagraphs (D) and (E) as subparagraphs (B) and (C), respectively.</text></clause></subparagraph><subparagraph id="idd9b1d34b2a854624bb7bfe2622967dd5"><enum>(C)</enum><text>Section 412 of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1622">8 U.S.C. 1622</external-xref>) is amended—</text><clause commented="no" display-inline="no-display-inline" id="idc96c31b166aa41768dc404569cd417d3"><enum>(i)</enum><text display-inline="yes-display-inline">in subsection (a)—</text><subclause commented="no" display-inline="no-display-inline" id="id6b52d37124b04c64a6f83575e6fded10"><enum>(I)</enum><text display-inline="yes-display-inline">by striking <quote>, a nonimmigrant</quote> and inserting <quote>or a nonimmigrant</quote>; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id47c9939d02344d6ebb85d76d988d0807"><enum>(II)</enum><text display-inline="yes-display-inline">by striking <quote>, or an alien who is paroled into the United States under section 212(d)(5) of such Act for less than one year</quote>; and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id361CE894FB5A4BF2A051165E9F34FCAA"><enum>(ii)</enum><text display-inline="yes-display-inline">in subsection (b)(1)—</text><subclause commented="no" display-inline="no-display-inline" id="id68e6b9af32254f9dbfe6ab626c042a6d"><enum>(I)</enum><text display-inline="yes-display-inline">in the paragraph heading, by striking <quote><header-in-text style="OLC" level="paragraph">and asylees</header-in-text></quote>; </text></subclause><subclause commented="no" display-inline="no-display-inline" id="idD295E2EF95064F15BD8B89F7ADFB4D6A"><enum>(II)</enum><text display-inline="yes-display-inline">by striking subparagraphs (B) and (C); and</text></subclause><subclause id="idCA5E4C12078D4AA8B011A5AC6F428D56" commented="no" display-inline="no-display-inline"><enum>(III)</enum><text>by redesignating subparagraphs (D) and (E) as subparagraphs (B) and (C), respectively.</text></subclause></clause></subparagraph></paragraph></subsection></section><section id="id6d1abc1a88914d378e0bc203d97e2d0b"><enum>3.</enum><header>Verification of citizenship by Head Start agencies</header><subsection id="id06bf2fc08a5b4a669a58dc3189be2a66"><enum>(a)</enum><header>In general</header><text>Section 645 of the Head Start Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9840">42 U.S.C. 9840</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7fc439d816bf4b39ac3c30f2d6959da0"><subsection id="id8587dc4bd36c417498a2e0f3db899db1"><enum>(e)</enum><text>A child shall be considered ineligible for a Head Start program if—</text><paragraph id="idcf434362823e45bf9d6bb4ddcf4e8471"><enum>(1)</enum><text>the child is not—</text><subparagraph id="id116bd10a79f44829aea8a40861c1ca2e"><enum>(A)</enum><text>a citizen of the United States; or</text></subparagraph><subparagraph id="id0cabc71378c645b985a4292c7298b063" commented="no"><enum>(B)</enum><text>an alien who is admitted to the United States as a refugee under section 207 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1157">8 U.S.C. 1157</external-xref>); and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1cf9107481f641cab24973e95a6a36d3"><enum>(2)</enum><text display-inline="yes-display-inline">a parent (including a guardian) of the child is—</text><subparagraph id="idcb5e489ef44c4d23a40ed6e351bc034c"><enum>(A)</enum><text>an alien (as defined in section 101(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)</external-xref>) who is unlawfully present in the United States;</text></subparagraph><subparagraph id="idb864ca850d02468ca53aa9c06712ed29"><enum>(B)</enum><text>an alien granted parole under section 212(d)(5) or 236(a)(2)(B) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(d)(5)</external-xref>, 1126(a)(2)(B));</text></subparagraph><subparagraph id="id32af43cb2781484cafb842d5bfa9c7f4"><enum>(C)</enum><text>an alien granted temporary protected status under section 244 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1254a">8 U.S.C. 1254a</external-xref>);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf2818232b86a4644ad27addad2b85374"><enum>(D)</enum><text>an alien granted asylum under section 208 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1158">8 U.S.C. 1158</external-xref>);</text></subparagraph><subparagraph id="idb9e0abe9357446878ac301da717fd3a8"><enum>(E)</enum><text>an alien granted deferred action or deferred enforced departure, including pursuant to the memorandum of the Department of Homeland Security entitled <quote>Exercising Prosecutorial Discretion with Respect to Individuals Who Came to the United States as Children</quote> issued on June 15, 2012; or</text></subparagraph><subparagraph id="id250c53823c0c42ea868360444c5f8d74"><enum>(F)</enum><text>an alien granted withholding of removal under section 241(b)(3) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1231">8 U.S.C. 1231(b)(3)</external-xref>).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="ide61d5b3bd4f44b1d909743fef8265985" commented="no"><enum>(b)</enum><header>Conforming amendment</header><text>Section 640(a)(5)(B)(i) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9835">42 U.S.C. 9835(a)(5)(B)(i)</external-xref>) is amended by striking <quote>immigrant, refugee,</quote> and inserting <quote>refugee</quote>. </text></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id913210a99b6f48b9a16a3400e840627c"><enum>4.</enum><header>Eligibility for certain Federal health care benefits</header><subsection commented="no" display-inline="no-display-inline" id="id5af2c21fb37e454c8dd22d77495b45b4"><enum>(a)</enum><header display-inline="yes-display-inline">Limiting Medicaid coverage of parolees and TPS and DACA recipients</header><text>Section 1903(v) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396b">42 U.S.C. 1396b(v)</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block id="id1FD3A8E9AF384F419DA6313C0D89F35F" style="OLC" act-name=""><paragraph indent="up1" id="idF18982841A9E45FC8307F271B2FFFB89"><enum>(5)</enum><text>For purposes of paragraph (1), an alien shall not be considered to be lawfully admitted for permanent residence or otherwise permanently residing in the United States under color of law if the alien is—</text><subparagraph id="id83C54509488C4C26941CC6BDBE36B69F" commented="no"><enum>(A)</enum><text>granted parole under section 212(d)(5) or 236(a)(2)(B) of the Immigration and Nationality Act; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id806d432205c540d3946137722d1f5b27"><enum>(B)</enum><text display-inline="yes-display-inline">granted deferred action or deferred enforced departure, including pursuant to the memorandum of the Department of Homeland Security entitled <quote>Exercising Prosecutorial Discretion with Respect to Individuals Who Came to the United States as Children</quote> issued on June 15, 2012;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6c83f9a6d171488eac64ba86fc5e07f0"><enum>(C)</enum><text display-inline="yes-display-inline">granted asylum under section 208 of the Immigration and Nationality Act;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id10121f1aa1f84036a9bfe7558fa90b9e"><enum>(D)</enum><text display-inline="yes-display-inline">granted temporary protected status under section 244 of the Immigration and Nationality Act; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id043eda3c2a824970b3f53098cd94b4a9"><enum>(E)</enum><text display-inline="yes-display-inline">granted withholding of removal under section 241(b)(3) of the Immigration and Nationality Act.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idff6d7f3b445b49d295e91f51155d1a40"><enum>(b)</enum><header>Limiting Medicare coverage of parolees and TPS and DACA recipients</header><text>Title XVIII of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395">42 U.S.C. 1395 et seq.</external-xref>) is amended by adding at the end the following new section:</text><quoted-block id="idEB178E64E1C84885AEB025F32CA6E030" display-inline="no-display-inline" style="OLC"><section commented="no" display-inline="no-display-inline" id="ida9b1f8d8dcc446618d8d1f54b758b1eb"><enum>1899C.</enum><header>Limiting Medicare coverage of parolees and TPS and DACA recipients</header><subsection commented="no" display-inline="no-display-inline" id="iddd0b053fd9dc426eb3367cbed2dc8cbc"><enum>(a)</enum><header>In general</header><text>Notwithstanding section 226, section 226A, section 1818(a), section 1836(a), or any other provision of this title, in no case may an applicable individual (as defined in subsection (b)) be entitled to, or enrolled for, benefits under this title.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id9667ccf0283e4136a1f1ef8ffd299429"><enum>(b)</enum><header>Applicable individual defined</header><text display-inline="yes-display-inline">In this section, the term <term>applicable individual</term> means an alien—</text><paragraph commented="no" display-inline="no-display-inline" id="ida14d6fff327b46bf94d55b8ea49660ae"><enum>(1)</enum><text display-inline="yes-display-inline">granted parole under section 212(d)(5) or 236(a)(2)(B) of the Immigration and Nationality Act; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd892b9fb9c4945259228ac28cee5df33"><enum>(2)</enum><text display-inline="yes-display-inline">granted deferred action or deferred enforced departure, including pursuant to the memorandum of the Department of Homeland Security entitled <quote>Exercising Prosecutorial Discretion with Respect to Individuals Who Came to the United States as Children</quote> issued on June 15, 2012;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbe950681668f4137975e5b79642d10eb"><enum>(3)</enum><text display-inline="yes-display-inline">granted asylum under section 208 of the Immigration and Nationality Act;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id40f085542cb540afa528408c729add0a"><enum>(4)</enum><text display-inline="yes-display-inline">granted temporary protected status under section 244 of the Immigration and Nationality Act; or</text></paragraph><paragraph id="idac3e0c28798c4f3d9f3fcf4d3d03e450" commented="no" display-inline="no-display-inline"><enum>(5)</enum><text display-inline="yes-display-inline">granted withholding of removal under section 241(b)(3) of the Immigration and Nationality Act.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="iddd5f0cab4a9f420a82eb88871c6265fb"><enum>(c)</enum><header>Eligibility for credit for coverage under a qualified health plan</header><paragraph commented="no" display-inline="no-display-inline" id="idfa420cfec9214ef38ec30483144c477c"><enum>(1)</enum><header>In general</header><text>Subparagraph (B) of <external-xref legal-doc="usc" parsable-cite="usc/26/36B">section 36B(c)(1)</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>If</quote> and inserting <quote>Except as provided in subparagraph (F), if</quote>.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id631b93cd131d4d4ba0d8c78070aca9aa"><enum>(2)</enum><header>Disqualified individuals</header><text>Paragraph (1) of <external-xref legal-doc="usc" parsable-cite="usc/26/36B">section 36B(c)</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7C08B162B0204D3981B399B40C567009"><subparagraph commented="no" display-inline="no-display-inline" id="id2a83840fe9d1447493b0f392990920e9"><enum>(F)</enum><header>Disqualified individuals</header><text>The following shall not be treated as an applicable taxpayer:</text><clause commented="no" display-inline="no-display-inline" id="id49dca7566bdd4f3b9f15860051fae3c2"><enum>(i)</enum><text>Any alien granted asylum under section 208 of the Immigration and Nationality Act.</text></clause><clause commented="no" display-inline="no-display-inline" id="id25d26d6a2d254efaa8e41159b9971ff5"><enum>(ii)</enum><text display-inline="yes-display-inline">Any alien granted parole under section 212(d)(5) or 236(a)(2)(B) of the Immigration and Nationality Act.</text></clause><clause commented="no" display-inline="no-display-inline" id="id0e5c0f3afcbd4819aa3b000262f21bab"><enum>(iii)</enum><text>Any alien granted temporary protected status under section 244 of the Immigration and Nationality Act.</text></clause><clause commented="no" display-inline="no-display-inline" id="idadece5201322476f9edba3099aab109a"><enum>(iv)</enum><text>Any alien granted deferred action or deferred enforced departure, including pursuant to 15, 2012.</text></clause><clause commented="no" display-inline="no-display-inline" id="id205eaee61f0049d0ab0881aa8a732e95"><enum>(v)</enum><text display-inline="yes-display-inline">Any alien granted withholding of removal under section 241(b)(3) of the Immigration and Nationality Act.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbbf638cf60a7489092b136845bbd8280"><enum>(3)</enum><header>Conforming amendments</header><text>Subsection (e) of <external-xref legal-doc="usc" amendments made by this subsection shall apply to years, plan years, and taxable years, as applicable, beginning after the date of the enactment of this Act.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id760a342e17b64d96816e2283a798ce82"><enum>(e)</enum><header>Prohibition on Federal funding for Federally qualified health centers that provide services to individuals who are not lawfully present in United States</header><text>A Federally qualified health center (as defined in section 1861(aa) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(aa)</external-xref>)) that provides services (other than services to treat an emergency medical condition, as defined in section 1903(v)(3) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396b">42 U.S.C. 1396b(v)(3)</external-xref>)) to individuals who are not lawfully present in the United States shall not be eligible for—</text><paragraph commented="no" display-inline="no-display-inline" id="idbc8e0c9acc4e42a3b75c4eaccfc258d3"><enum>(1)</enum><text display-inline="yes-display-inline">payment under— </text><subparagraph commented="no" display-inline="no-display-inline" id="idaf3ed2b2807b4f77809e84884d6a2662"><enum>(A)</enum><text display-inline="yes-display-inline">the Medicare program under title XVIII of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395">42 U.S.C. 1395 et seq.</external-xref>);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id96f9ca57435242d9a373d276ecb99b8e"><enum>(B)</enum><text>the Medicaid program under title XIX of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396 et seq.</external-xref>); or</text></subparagraph><subparagraph id="id6b6c6b913d1648faa7d246db30c1d81b"><enum>(C)</enum><text>the Children's Health Insurance Program under title XXI of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397aa">42 U.S.C. 1397aa et seq.</external-xref>);</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9c01199618804d01966d57ff7511a07a"><enum>(2)</enum><text> grant or any other funding under the Public Health Service Act, including a grant under section 330 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/254b">42 U.S.C. 254b</external-xref>); or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id826155c07e344efbaa29f8c3de5b1aec"><enum>(3)</enum><text>any other Federal funding.</text></paragraph></subsection></section><section id="ide2083ecc7dc044c78921b2990414d08c"><enum>5.</enum><header>Housing</header><subsection commented="no" display-inline="no-display-inline" id="idfb79e5ebf14a41ca929fad3b8f2b679a"><enum>(a)</enum><header>Restrictions on use of assisted housing</header><text>Section 214 of the Housing and Community Development Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/1436a">42 U.S.C. 1436a</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id2ff78a9252bd4ec7973e2c15cc1945e9"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="id6998f0e0cbf3476bbe7ae1f8766ae7b6"><enum>(A)</enum><text>in paragraph (3), by striking <quote>or pursuant to the granting of asylum (which has not been terminated) under section 208 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1158">8 U.S.C. 1158</external-xref>)</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6d00465a7ab842d0a84d75abdf255f41"><enum>(B)</enum><text>by striking paragraphs (4) and (5); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idafa7b15a61494936be3720d693bb072b"><enum>(C)</enum><text>by redesignating paragraphs (6) and (7) as paragraphs (4) and (5), respectively;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4478e2c6fc7b470ca2203394866d24e0"><enum>(2)</enum><text>in subsection (b), by striking paragraph (2) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0CE9FDBB002E48B583E4A6DC1C4D831F"><paragraph id="idd37394ffaa45489cb78879e0155cdf57" indent="up1" commented="no"><enum>(2)</enum><text>The Secretary shall not provide financial assistance to a family unless the eligibility of each member of the family has been affirmatively established under the program of financial assistance and under this section.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4825f8fe832d4ee5952e8f5c47fd8fa1"><enum>(3)</enum><text>in subsection (c)(1)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idfc7d9c7df11f4186bf9c57b322219ef9"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>shall take one of the following actions</quote> and all that follows through <quote>Defer the termination</quote> and inserting <quote>shall defer the termination</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc74ac3ee18854a02bdfb076db00676ec"><enum>(B)</enum><text>by inserting <quote>(A)</quote> before <quote>If, following completion</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7aec95303cdb4254adea0edd1c7d701e"><enum>(C)</enum><text>by redesignating clauses (ii) and (iii) as subparagraphs (B) and (C), respectively, and moving the margins 2 ems to the left;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida9129391344c4e54bbb3de97b1fe3a75"><enum>(D)</enum><text>in subparagraph (B), as so redesignated, by striking <quote>clause (iii), any deferral under this subparagraph</quote> and inserting <quote>subparagraph (C), any deferral under this paragraph</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd4f6bc61c5264f10a966142d95e0bb82"><enum>(E)</enum><text>in subparagraph (C), as so redesignated—</text><clause commented="no" display-inline="no-display-inline" id="id12a4f90d04ca4d39b0de0cb4946e6f17"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>clause (ii)</quote> and inserting <quote>subparagraph (B)</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id7dfd7344adc74992bcdba40d1aab4e28"><enum>(ii)</enum><text display-inline="yes-display-inline">by striking <quote>or an individual seeking asylum under section 208 of that Act</quote>;</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7c05c57f244a46fda16e434ec6708b44"><enum>(4)</enum><text>in subsection (i)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id54cd18111c6346f38e48aafb7a2e57a8"><enum>(A)</enum><text>in paragraph (1), by striking <quote>at least the individual or one family member</quote> and inserting <quote>the individual or each family member</quote>;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida6f8ef8b7475469e8caa2088343f66de"><enum>(B)</enum><text>in paragraph (2)—</text><clause commented="no" display-inline="no-display-inline" id="ida7096e7aad0a4e25ae1cf6cab1725b2e"><enum>(i)</enum><text>by striking <quote>United States Housing Act of 1937)—</quote> and all that follows through <quote>in carrying out subsection (d)</quote> and inserting <quote>United States Housing Act of 1937), in carrying out subsection (d)</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id1d30476ee4b04e77b4275eba196c42cc"><enum>(ii)</enum><text>by redesignating clauses (i), (ii), and (iii) as subparagraphs (A), (B), and (C), respectively, and adjusting the margins accordingly; and</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id79308299cd8740fbaa79a3d74ec92958"><enum>(5)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4195F07DE54C4F5CB3EE2F394FEC7D6A"><subsection id="id5cdc1cf8bd5148c1ae681b6b23a81440" commented="no"><enum>(j)</enum><header>Prohibition on eligibility guidelines</header><text>The applicable Secretary shall not issue any guidelines relating to eligibility for financial assistance under this section.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id5f61a113e77f4c48aa6bf8304bdc811e"><enum>(b)</enum><header>Single family housing guaranteed loan program</header><text display-inline="yes-display-inline">Section 502 of the Housing Act of 1949 (<external-xref legal-doc="usc" parsable-cite="usc/42/1472">42 U.S.C. 1472</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF9613B96AAE145EA9683C5D6E33A8277"><subsection id="id765a3497ff0d4b1998e2d47e1f38d961"><enum>(j)</enum><header>Eligibility</header><paragraph commented="no" display-inline="no-display-inline" id="id30ce088f50784fd0a42b20c9f50b5097"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>The Secretary shall make a loan under this section only to—</text><subparagraph commented="no" display-inline="no-display-inline" id="id9527dd06d1f647a9b85eb065b4ca1128"><enum>(A)</enum><text display-inline="yes-display-inline">a citizen of the United States; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6eaa277b16734cd1b3c98773cc69a085"><enum>(B)</enum><text display-inline="yes-display-inline">an occupant or resident of a housing unit that does not include—</text><clause commented="no" display-inline="no-display-inline" id="idf9a4b194c596454397da3a0d2aac1ce1"><enum>(i)</enum><text display-inline="yes-display-inline">any alien (as defined in section 101(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)</external-xref>)) who is unlawfully present in the United States;</text></clause><clause commented="no" display-inline="no-display-inline" id="id8a146e18fd7d4751a364329124828ee3"><enum>(ii)</enum><text>any alien granted asylum under section 208 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1158">8 U.S.C. 1158</external-xref>);</text></clause><clause commented="no" display-inline="no-display-inline" id="ide6c914aea7bc40a19a2c7ee39181c04d"><enum>(iii)</enum><text display-inline="yes-display-inline">any alien granted parole under section 212(d)(5) or 236(a)(2)(B) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(d)(5)</external-xref>, 1126(a)(2)(B));</text></clause><clause commented="no" display-inline="no-display-inline" id="id2afbe38a57cf4461bb8f8f716d0d231e"><enum>(iv)</enum><text display-inline="yes-display-inline">any alien granted temporary protected status under section 244 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1254a">8 U.S.C. 1254a</external-xref>);</text></clause><clause commented="no" display-inline="no-display-inline" id="idd4e071a3a5424a1ebd1dea705cc46f67"><enum>(v)</enum><text display-inline="yes-display-inline">any alien granted deferred action or deferred enforced departure, including pursuant to the memorandum of the Department of Homeland Security entitled <quote>Exercising Prosecutorial Discretion with Respect to Individuals Who Came to the United States as Children</quote> issued on June 15, 2012; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id3a11f377410541c696877fc0beb354dc"><enum>(vi)</enum><text display-inline="yes-display-inline">any alien granted withholding of removal under section 241(b)(3) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1231">8 U.S.C. 1231(b)(3)</external-xref>).</text></clause></subparagraph></paragraph><paragraph id="idF2FFD898C5B94791870EBFD6F2BFED32" commented="no"><enum>(2)</enum><header>Prohibition on eligibility guidelines</header><text>The Secretary shall not issue any guidelines relating to eligibility display-inline="no-display-inline" id="idb911a6024aa54ad7ae77cc291bb7b053"><enum>(1)</enum><text display-inline="yes-display-inline">in section 401(b)(1)(D) (<external-xref legal-doc="usc" parsable-cite="usc/8/1611">8 U.S.C. 1611(b)(1)(D)</external-xref>), by striking <quote>, crisis counseling and intervention, and short-term shelter)</quote> and inserting <quote>and crisis counseling and intervention), excluding housing programs, services, or assistance,</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida7050ba65a804e08af858135101ce6d3"><enum>(2)</enum><text>in section 411(b)(4) (<external-xref legal-doc="usc" parsable-cite="usc/8/1621">8 U.S.C. 1621(b)(4)</external-xref>), by striking <quote>, id="ida99aa007fcae4d9d9c2ed1fe11f3a8d0"><enum>(1)</enum><header>In general</header><text>Paragraph (3) of <external-xref legal-doc="usc" parsable-cite="usc/26/42">section 42(i)</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id14CA69BDD4514BB78C18481714C9AA12"><subparagraph commented="no" display-inline="no-display-inline" id="id744964dc122344f2a74aa6709866ba1f"><enum>(E)</enum><header>Disqualified low-income unit if such unit is occupied by any disqualified individual.</text></clause><clause commented="no" display-inline="no-display-inline" id="idd691f38c339349bb8a05d21691ddadab"><enum>(ii)</enum><header>Disqualified individual</header><text>The term <term>disqualified individual</term> means—</text><subclause id="id8d31a2b32fc74d56abfb1d995984c50e"><enum>(I)</enum><text>any alien (as defined in section 101(a) of the Immigration and Nationality Act) who is unlawfully present in the United States,</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idc53f98d95c4f40abbc00525336267588"><enum>(II)</enum><text display-inline="yes-display-inline">any alien granted asylum under section 208 of the Immigration and Nationality Act,</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id753EFA4FD4CD445DA29E55F142ED0C0A"><enum>(III)</enum><text>any alien granted parole under section 212(d)(5) or 236(a)(2)(B) of the Immigration and Nationality Act,</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id622F58796BE5456389EC43ACE7A5B48D"><enum>(IV)</enum><text>any alien granted temporary protected status under section 244 of the Immigration and Nationality Act,</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id65BD506D7875435382CE345261A2B6DB"><enum>(V)</enum><text>any alien granted deferred action or deferred enforced departure, including pursuant to the memorandum of the Department of Homeland Security entitled <quote>Exercising Prosecutorial Discretion with Respect to Individuals Who Came to the United States as Children</quote> issued on June 15, 2012, and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id149f7fb6d672488284031a240711199a"><enum>(VI)</enum><text>any alien granted withholding of removal under section 241(b)(3) of the Immigration and Nationality Act.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="id38d33fc9c8d949aeabcc31d4b117395b" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Effective date</header><text>The amendment made by this subsection shall apply to all determinations made after the date of the enactment of this Act.</text></paragraph></subsection></section><section id="id729ef40fc752481da7ffe027985d5caa"><enum>6.</enum><header>Identification requirements for child tax credit and earned income tax credit; permanent extension of certain temporary rules for child tax credit</header><subsection commented="no" display-inline="no-display-inline" id="id31474df0771b4bc48b9de8597a46cb18"><enum>(a)</enum><header display-inline="yes-display-inline">Child tax credit</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/24">Section 24</external-xref> of the Internal Revenue Code of 1986 is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idbb883d23a6db4027ab37cd831e8fd66c"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), by striking <quote>$1,000</quote> and inserting <quote>$2,000</quote>,</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id32ec1e3a4bad48c6aff767560f24fd5e"><enum>(2)</enum><text>in subsection (b)(2), by striking subparagraphs (A) through (C) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id064538F3C5DA40E19BA39ADE98939000"><subparagraph commented="no" display-inline="no-display-inline" id="id61cfc8edb7e545abbe96965a445a5d4f"><enum>(A)</enum><text>$400,000 in the case of a joint return, and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id478c1700f11b45cc930a657b02d5cca7"><enum>(B)</enum><text display-inline="yes-display-inline">$200,000 in any other case.</text></subparagraph><after-quoted-block>,</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id90579f778f6d4563a66b5e750a1ece3a"><enum>(3)</enum><text>in subsection (d)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id21b99ee1629f494ea222541791a3e6dd"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1)(B)(i), by striking <quote>$3,000</quote> and inserting <quote>$2,500</quote>, and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idad8452b137d648c69b0a9aa9babfbc83"><enum>(B)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id860E57C27DAF4679A18047464B25BB79"><paragraph commented="no" display-inline="no-display-inline" id="id9602c0e290f742e294f8848b20d1ce54"><enum>(4)</enum><header>Maximum amount of refundable credit</header><subparagraph commented="no" display-inline="no-display-inline" id="id9a61dca29a7a454fa5ffd0753d9a59d4"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The amount determined under paragraph (1)(A) with respect to any qualifying child shall not exceed $1,700, and such paragraph shall be applied without regard to subsection (h).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb6010a43757e471b962dad1e9099b013"><enum>(B)</enum><header>Adjustment for inflation</header><clause commented="no" display-inline="no-display-inline" id="id31ea824fa9914a85a8fe6fe63a12463f"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">In the case of a taxable year beginning after 2024, the $1,700 amount in subparagraph (A) shall be increased by an amount equal to—</text><subclause commented="no" display-inline="no-display-inline" id="idc7c3c277389943ddbf2ea326ad968ceb"><enum>(I)</enum><text display-inline="yes-display-inline">such dollar amount, multiplied by</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idd1335908f04b4dfa81756d419fa8974a"><enum>(II)</enum><text display-inline="yes-display-inline">the cost-of-living adjustment determined under section 1(f)(3) for the calendar year in which the taxable year begins, determined by substituting <quote>2023</quote> for <quote>2016</quote> in subparagraph (A)(ii) thereof.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idf8d282d378cd4284a4db05318646da3e"><enum>(ii)</enum><header>Rounding</header><text display-inline="yes-display-inline">If any increase under this subparagraph is not a multiple of $100, such increase shall be rounded to the next lowest multiple of $100.</text></clause></subparagraph></paragraph><after-quoted-block>,</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id412982d2119a4d1e8a63103dd2f64e00"><enum>(4)</enum><text>by striking subsection (e) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8DC4943037A446FD9322DB25FF3E71EE"><subsection commented="no" id="idB48C3FEB216545DC96D73AD54BA3E29A"><enum>(e)</enum><header>Additional requirements</header><paragraph commented="no" display-inline="no-display-inline" id="id420447fcac754b888dd51e3425385f58"><enum>(1)</enum><header display-inline="yes-display-inline">Identification requirements</header><text>No credit shall be allowed under this section to a taxpayer who does not include on the return of tax for the taxable year—</text><subparagraph commented="no" display-inline="no-display-inline" id="idc79c46fbea054b8b91a3267dfa8c0d12"><enum>(A)</enum><text display-inline="yes-display-inline">the social security number of the taxpayer (and, in the case of a joint return, the social security number of the taxpayer's spouse),</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id884c4176f0424d25bd3f22087ced9c6b"><enum>(B)</enum><text display-inline="yes-display-inline">with respect to any qualifying child, the name and the social security number of such qualifying child, and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1622e3f3c18748099c88989c5b86b593"><enum>(C)</enum><text>for purposes of subsection (h), with respect to any dependent of the taxpayer, the name and the social security number of such dependent.</text></subparagraph></paragraph><paragraph id="id9E3866816C90421CAA40A1710D977276"><enum>(2)</enum><header>Social security number defined</header><text>For purposes of this subsection, the term <term>social security number</term> means, with respect to a return of tax, a social security number issued to an individual by the Social Security Administration, but only if the social security number is issued—</text><subparagraph id="idBBA4A77E4CBA4B9C8730ECB97589316F"><enum>(A)</enum><text>to a citizen of the United States or pursuant to subclause (I) (or that portion of subclause (III) that relates to subclause (I)) of section 205(c)(2)(B)(i) of the Social Security Act, and</text></subparagraph><subparagraph id="id5D334D1C5B7C43D580277710F5E5047F"><enum>(B)</enum><text>before the due date for filing such return for the taxable year.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8bab62de7a314c88b3862154c335f15b"><enum>(3)</enum><header>Citizenship and lawful presence requirements</header><subparagraph commented="no" display-inline="no-display-inline" id="ide55523c7828442aa9c62d9884779db13"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">No credit shall be allowed under this section to a taxpayer unless—</text><clause commented="no" display-inline="no-display-inline" id="id7493af39c3b943568c150c9f0b14da17"><enum>(i)</enum><text display-inline="yes-display-inline">the taxpayer (and, in the case of a joint return, the taxpayer's spouse) satisfy the requirements under subparagraph (B),</text></clause><clause commented="no" display-inline="no-display-inline" id="id23ab0ec87dfe414d8f3e5d4466a9595e"><enum>(ii)</enum><text display-inline="yes-display-inline">with respect to any qualifying child, such child satisfies the requirements under subparagraph (B), and</text></clause><clause commented="no" display-inline="no-display-inline" id="id87cdf8f7a75046289828f426570035ec"><enum>(iii)</enum><text display-inline="yes-display-inline">with respect to any dependent described in subsection (h), such dependent satisfies the requirements under subparagraph (B).</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4266a8e3c8f94b0f90b17abf8fbd8439"><enum>(B)</enum><header>Requirements</header><text display-inline="yes-display-inline">The requirements described in this subparagraph are that the individual—</text><clause commented="no" display-inline="no-display-inline" id="idc858744d0af8447589d054c32a1dd182"><enum>(i)</enum><text display-inline="yes-display-inline">shall be a citizen of the United States or an alien lawfully present in the United States, and</text></clause><clause commented="no" display-inline="no-display-inline" id="idf8e94768f00b4be794ecad688ac21c6d"><enum>(ii)</enum><text display-inline="yes-display-inline">may not be—</text><subclause id="idEDC65CFF33014E9EA866C542A82FFB40"><enum>(I)</enum><text>an alien granted asylum under section 208 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1158">8 U.S.C. 1158</external-xref>),</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idb44f51c9dd4b406c9e30bc2c01f48c37"><enum>(II)</enum><text display-inline="yes-display-inline">an alien granted parole under section 212(d)(5) or 236(a)(2)(B) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(d)(5)</external-xref>, 1126(a)(2)(B)),</text></subclause><subclause id="id9AE12B64EC2646C89A00D421164ADE81"><enum>(III)</enum><text>an alien granted temporary protected status under section 244 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1254a">8 U.S.C. 1254a</external-xref>), </text></subclause><subclause id="idF296AF25834F479FBC7B3DFFB5F5E87D"><enum>(IV)</enum><text>an alien granted withholding of removal under section 241(b)(3) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1231">8 U.S.C. 1231(b)(3)</external-xref>),</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id699919e6c66e4a27a518629e63800833"><enum>(V)</enum><text display-inline="yes-display-inline">any nonimmigrant described in section 101(a)(15) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)</external-xref>), </text></subclause><subclause commented="no" display-inline="no-display-inline" id="idc672be4a370844dca90871c0a81246fc"><enum>(VI)</enum><text display-inline="yes-display-inline">any alien granted deferred action or deferred enforced departure, including pursuant to the memorandum of the Department of Homeland Security entitled <quote>Exercising Prosecutorial Discretion with Respect to Individuals Who Came to the United States as Children</quote> issued on June 15, 2012, or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idee7af4afb74e4c56a19c2f361246e91f"><enum>(VII)</enum><text display-inline="yes-display-inline">an alien who has been issued an employment-based immigrant visa described in section 203(b) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(b)</external-xref>).</text></subclause></clause></subparagraph></paragraph></subsection><after-quoted-block>, and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb092f83de0fb4223a504b8b60d725942"><enum>(5)</enum><text>by striking subsection (h) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idE78010353A664FE1A362F41F3FCF2A76"><subsection commented="no" display-inline="no-display-inline" id="id841f4b20ab7248a99b0dc8868a01519f"><enum>(h)</enum><header>Partial credit allowed for certain other dependents</header><paragraph commented="no" display-inline="no-display-inline" id="id3b3842b66d214d168e3d38427c1a07d5"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>The credit determined under subsection (a) shall be increased by $500 for each dependent of the taxpayer (as defined in section 152) other than a qualifying child described in subsection (c).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddce6dfc529e34783a47f10fe73bb7aeb"><enum>(2)</enum><header>Exception for certain noncitizens</header><text display-inline="yes-display-inline">Paragraph (1) shall not apply with respect to any individual who would not be a dependent if subparagraph (A) of section 152(b)(3) were applied without regard to all that follows <quote>resident of the United States</quote>.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idcfacccb033554471a271c44b1d2735f5"><enum>(b)</enum><header>Earned income tax credit</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/32">Section 32</external-xref> of the Internal Revenue Code of 1986 is amended by inserting after subsection (f) the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6E4CA35E0695428F906AC875B63F27A4"><subsection commented="no" display-inline="no-display-inline" id="id2FFE161201F740CFA100302CF49B99C1"><enum>(g)</enum><header>Citizenship and lawful presence requirements</header><text display-inline="yes-display-inline">No credit shall be allowed under this section to an eligible individual unless—</text><paragraph commented="no" display-inline="no-display-inline" id="id40AF115EEE974EF5A103C1FD5F4B2343"><enum>(1)</enum><text display-inline="yes-display-inline">the individual (and, in the case of a joint return, the individual's spouse) satisfy the requirements described in section 24(e)(3)(B), and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id31F6F2CE5D9E4E20B1CB297B8F941193"><enum>(2)</enum><text display-inline="yes-display-inline">with respect to any qualifying child, such child satisfies the requirements under such section.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id3c1fded07d344b83a7d34c1f2b017aac"><enum>(c)</enum><header display-inline="yes-display-inline">Conforming amendments</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/6213">Section 6213(g)(2)</external-xref> of the Internal Revenue Code of 1986 is amended—</text><paragraph commented="no" id="id3E722CC663C7483ABAD365056BA04D47"><enum>(1)</enum><text>in subparagraph (I), by striking <quote>TIN</quote> and inserting <quote>social security number</quote>, and</text></paragraph><paragraph commented="no" id="id0C7A33E314B3470793D570A43255432E"><enum>(2)</enum><text>by striking subparagraph (L) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB547AC010EB7450F9B82E146A3838CD9"><subparagraph commented="no" display-inline="no-display-inline" id="id6383f97e7e874c6684531e35caf25366"><enum>(L)</enum><text display-inline="yes-display-inline">the inclusion on a return of a TIN required to be included on the return under section 21, 6428, or 6428A, or the inclusion on a return of a social security number required to be included on the return under section 24 or 32, if—</text><clause commented="no" display-inline="no-display-inline" id="id3c6959215bb34eb7a17a232ea2601d37"><enum>(i)</enum><text display-inline="yes-display-inline">such TIN or social security number, as applicable, is of an individual whose age affects the amount of the credit under such section, and</text></clause><clause commented="no" display-inline="no-display-inline" id="id309162620d29427bb2275a16a1817735"><enum>(ii)</enum><text display-inline="yes-display-inline">the computation of the credit on the return reflects the treatment of such individual as being of an age different from the individual's age based on such TIN or social security number, as applicable,</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idf48aa48b498647dbb20b5966401b07d0" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Effective date</header><text>The amendments made by this section shall apply to taxable years beginning after December 31, 2024. </text></subsection></section><section id="id379c0e8f7ab14cd1838448871d369845"><enum>7.</enum><header>Federal Emergency Management Agency prohibitions</header><text display-inline="no-display-inline">The Administrator of the Federal Emergency Management Agency shall not use amounts available to the Federal Emergency Management Agency for the purpose of—</text><paragraph id="ide299b27514dc4d54a69dbb11fa564284"><enum>(1)</enum><text>sheltering and related activities provided by non-Federal entities, including facility improvements and construction, in support of relieving overcrowding in short-term holding facilities of U.S. Customs and Border Protection, including the Shelter and Services Program and any other substantially similar program;</text></paragraph><paragraph id="idf53af69d9b33415c8a5d4fc7b6533253"><enum>(2)</enum><text>the emergency food and shelter program under title III of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11331">42 U.S.C. 11331 et seq.</external-xref>) for the purposes of providing shelter and other services to families and individuals encountered by the Department of Homeland Security, including humanitarian relief awards under the emergency food and shelter program and any other substantially similar program; or</text></paragraph><paragraph id="id484d27da33ed4e46b2e4ae24912ccbd2"><enum>(3)</enum><text>carrying out any program of the Federal Emergency Management Agency that provides assistance to—</text><subparagraph id="id5F97B71A8A0E4771801CEE1401E34614"><enum>(A)</enum><text>an alien (as defined in section 101(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)</external-xref>)) who is unlawfully present in the United States;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4C620D30DED84C59954FB7FC847C8FC4"><enum>(B)</enum><text>an alien granted parole under section 212(d)(5) or 236(a)(2)(B) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(d)(5)</external-xref>, 1226(a)(2)(B)); </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9D75D753BC66435EA2D9BC66FCA63A1D"><enum>(C)</enum><text>an alien granted asylum under section 208 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1158">8 U.S.C. 1158</external-xref>);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDFDE0233FADC43A2A60217F778829F7B"><enum>(D)</enum><text>an alien granted temporary protected status under section 244 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1254a">8 U.S.C. 1254a</external-xref>);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id158E83706E614784BE66B63427B0BF7E"><enum>(E)</enum><text>an alien granted deferred action or deferred enforced departure, including pursuant to the memorandum of the Department of Homeland Security entitled <quote>Exercising Prosecutorial Discretion with Respect to Individuals Who Came to the United States as Children</quote> issued on June 15, 2012; or</text></subparagraph><subparagraph id="id79E03002DC0A4A9D90CEE11E449453E5" commented="no" display-inline="no-display-inline"><enum>(F)</enum><text>an alien granted withholding of removal under section 241(b)(3) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1231">8 U.S.C. 1231(b)(3)</external-xref>). </text></subparagraph></paragraph></section><section id="id09021093ca8b422496cbde91474c79ca"><enum>8.</enum><header>Eligibility for postsecondary financial assistance based on immigration status</header><text display-inline="no-display-inline">Section 484(a)(5) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1091">20 U.S.C. 1091(a)(5)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id00cf92195a5f4220b071ac1bdf04d345"><paragraph id="id45d4f71a961e4283a45acaa27eaa0ac9"><enum>(5)</enum><text>be a citizen, national, or permanent resident of the United States; and</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section commented="no" display-inline="no-display-inline" id="idd3dcb5e360eb4c7aa8253bee426461ab"><enum>9.</enum><header>Reducing ESEA funding for sanctuary jurisdictions</header><text display-inline="no-display-inline">Subpart 2 of part F of title VIII of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7901">20 U.S.C. 7901 et seq.</external-xref>) is amended by adding at the end the following: </text><quoted-block id="id4E1F3422E7844B45AA50CD2BF50FE7E4" display-inline="no-display-inline" style="OLC"><section commented="no" display-inline="no-display-inline" id="id2c4bbfe426ed4d8fae302d34c05dae84"><enum>8549D.</enum><header>Funding reductions for Sanctuary jurisdictions</header><subsection commented="no" display-inline="no-display-inline" id="id55a45c2825b84908a59e7928230e07f5"><enum>(a)</enum><header>Funding reductions for sanctuary jurisdictions</header><paragraph commented="no" display-inline="no-display-inline" id="id968099d34d7745e093b25e04ff72cb81"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this Act, if the Secretary determines for a fiscal year that a State or political subdivision of a State is a sanctuary jurisdiction, the Secretary shall reduce the allotment or grant that is otherwise authorized under any provision of this Act for the State educational agency of such State or for the eligible entity of such political subdivision, as applicable, by 50 percent for such fiscal year.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id761f91b694244ae8b9447f963e2c7364"><enum>(2)</enum><header>Reallotment</header><text display-inline="yes-display-inline">In any case in which the Secretary reduces an allotment or grant to a State educational agency or eligible entity under paragraph (1) for a fiscal year, the Secretary shall reallot an amount for such fiscal year equal to such reduction to the remaining State educational agencies of States that are not sanctuary jurisdictions or eligible entities of political subdivisions that are not sanctuary jurisdictions, in accordance with the applicable requirements of that allotment or grant.</text></paragraph></subsection><subsection id="id44b7cae9c8194e138abd6c2777477ff1"><enum>(b)</enum><header>Subgrants</header><paragraph commented="no" display-inline="no-display-inline" id="idBA1CA19CCB8746609C03BB71A37E877D"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this Act, if the Secretary determines for a fiscal year that a political subdivision of a State is a sanctuary jurisdiction, the State educational agency shall reduce the subgrant amount otherwise authorized under this Act for an eligible entity of such sanctuary jurisdiction by 50 percent for such fiscal year.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id19418D3CD3DF489BB66A2382BBF7E7DB"><enum>(2)</enum><header>Reallotment</header><text display-inline="yes-display-inline">In any case in which a State educational agency reduces a subgrant to an eligible entity under paragraph (1) for a fiscal year, the State educational agency shall reallocate an amount for such fiscal year equal to such reduction to eligible entities of the State that are not eligible entities of sanctuary jurisdictions, in accordance with the applicable requirements of that subgrant. </text></paragraph></subsection><subsection id="id7026373be09e43739511e556548ed882"><enum>(c)</enum><header>Sanctuary jurisdiction</header><text display-inline="yes-display-inline">The term <term>sanctuary jurisdiction</term> means a State or a political subdivision of a State, including a city, county, township, school district, or other political subdivision, with laws, ordinances, regulations, directives, policies, or practices that obstruct Federal and local law enforcement agencies from enforcing Federal immigration law, including—</text><paragraph id="id30b846da128f48a2babe26f640fc92b2"><enum>(1)</enum><text>prohibiting employees from sending, receiving, maintaining, or exchanging with any Federal, State, or local government entity, information regarding the citizenship or the lawful or unlawful immigration status of any individual; or</text></paragraph><paragraph id="idd0569980f06148ecbdd1a0387140ce89" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>denying a request lawfully made by the Department of Homeland Security under section 236 or 287 of the Immigration and Nationality Act 16 (8 U.S.C. 1226 and 1357) to comply with a detainer for, or notify about the release of, an individual.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="ide4195a1925434a26948c573cc52e1657"><enum>10.</enum><header>Limitation on refugee resettlement and other services for certain Haitian immigrants</header><subsection commented="no" display-inline="no-display-inline" id="id663d4da23297427189491af1eec28810"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 501 of the Refugee Education Assistance Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/8/1522">8 U.S.C. 1522</external-xref> note) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="ide21c4f0901924e92a0c84c20cf85cb71"><enum>(1)</enum><text>by striking <quote>Cuban and Haitian entrants</quote> each parsable-cite="pl/104/193">Public Law 104–193</external-xref>) is amended by striking <quote>Cuban and Haitian entrant</quote> each place it appears and inserting <quote>Cuban entrant</quote>.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5b8df3911f684ba4b6e021edc59fd20d"><enum>(2)</enum><text>Section 1611(c)(5) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1382">42 U.S.C. 1382(c)(5)</external-xref>) is amended by striking <quote>Cuban and Haitian entrants</quote> and inserting <quote>Cuban entrants</quote>.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id35490b01435541f99bcd1bfa19dd5c57"><enum>11.</enum><header>Prohibiting participation in Federal benefit programs until a satisfactory immigration status is verified</header><text display-inline="no-display-inline">Section 1137(d) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1320b-7">42 U.S.C. 1320b–7(d)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id5a4c8480c72746389234a091453d2b5c"><enum>(1)</enum><text>in paragraph (2)(A), by striking <quote>the Immigration and Naturalization Service</quote> and inserting <quote>the Department of Homeland Security or the Department of Justice, as applicable,</quote>;</text></paragraph><paragraph id="id460db227f68742c1bd9537115c2edd3d"><enum>(2)</enum><text>in paragraph (3), in the matter preceding subparagraph (A)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id0c5e30afd39641418f1e854792de6603"><enum>(A)</enum><text>by striking <quote>the Immigration and school meals</header><subsection commented="no" display-inline="no-display-inline" id="ida8fd4b454eb648d4b53e09ad85d43cc0"><enum>(a)</enum><header display-inline="yes-display-inline">WIC</header><text display-inline="yes-display-inline">Section 17(d) of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1786">42 U.S.C. 1786(d)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA5375B83ABA24D268CD293A793719239"><paragraph id="idE3579F5F84AD47478548DC985686F5BC"><enum>(4)</enum><header>Citizenship requirements</header><text>An infant or a child shall be considered ineligible for the program under this section if—</text><subparagraph id="id23000E2844234EF794325A3EE2AD193F"><enum>(A)</enum><text>the infant or child is not—</text><clause id="id305CCAFF769A43CAA67B7028654E8C4B"><enum>(i)</enum><text>a citizen of the United States; or</text></clause><clause id="id370DB454CDA7418DA621A3935980ED9F" commented="no"><enum>(ii)</enum><text>an alien who is admitted to the United States as a refugee under section 207 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1157">8 U.S.C. 1157</external-xref>); and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id867AECEA45BD4062865F7CDACB760EFB"><enum>(B)</enum><text display-inline="yes-display-inline">a parent (including a guardian) of the infant or child is—</text><clause id="id073D3A9B49554ADFAF12F5043C1E54F0"><enum>(i)</enum><text>an alien (as defined in section 101(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)</external-xref>) who is unlawfully present in the United States;</text></clause><clause id="idCF311FD9D6834347951DE454B6CCB2E5"><enum>(ii)</enum><text>an alien granted asylum under section 208 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1158">8 U.S.C. 1158</external-xref>);</text></clause><clause commented="no" display-inline="no-display-inline" id="id3809e73b497043e683390af402881157"><enum>(iii)</enum><text display-inline="yes-display-inline">an alien granted parole under section 212(d)(5) or 236(a)(2)(B) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(d)(5)</external-xref>, 1126(a)(2)(B));</text></clause><clause id="id70C26ECC8B8F4D919061DAB5DF7173AE"><enum>(iv)</enum><text>an alien granted temporary protected status under section 244 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1254a">8 U.S.C. 1254a</external-xref>);</text></clause><clause id="id076F487EAE114799AF8F99621BC0C834"><enum>(v)</enum><text>an alien granted deferred action or deferred enforced departure, including pursuant to the memorandum of the Department of Homeland Security entitled <quote>Exercising Prosecutorial Discretion with Respect to Individuals Who Came to the United States as Children</quote> issued on June 15, 2012; or</text></clause><clause id="idD20726BBB51E42A38265BBCA0219BF01"><enum>(vi)</enum><text>an alien granted withholding of removal under section 241(b)(3) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1231">8 U.S.C. 1231(b)(3)</external-xref>).</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id318E4A691B5F40E0B2FB05E7CBA66A72"><enum>(b)</enum><header>School meals</header><text display-inline="yes-display-inline">Section 9(b) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1758">42 U.S.C. 1758(b)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4EB38A2DB1E44C56ACCEC20461B73853"><paragraph id="id20D60D9B246144A3BC6B5F67631C8000"><enum>(16)</enum><header>Citizenship requirements</header><text>A child shall be considered ineligible for free or reduced price lunch under this Act and free or reduced price breakfast under section 4 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1773">42 U.S.C. 1773</external-xref>) if—</text><subparagraph id="id19468D539A0844B38E63AD8148B1B4C2"><enum>(A)</enum><text>the child is not—</text><clause id="idCF9FB5FEB69647C0B4EDB3FE140D6085"><enum>(i)</enum><text>a citizen of the United States; or</text></clause><clause id="idDD214CC3EE904269A9370A80E67105A0" commented="no"><enum>(ii)</enum><text>an alien who is admitted to the United States as a refugee under section 207 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1157">8 U.S.C. 1157</external-xref>); and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id61687A33777D4C22A6EED133411CC2F6"><enum>(B)</enum><text display-inline="yes-display-inline">a parent (including a guardian) of the child is—</text><clause id="idF582B7C552BA40DC882D206BE3D860E1"><enum>(i)</enum><text>an alien (as defined in section 101(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)</external-xref>) who is unlawfully present in the United States;</text></clause><clause id="idA433CC5AEBF14098A19C1E502832BF2B"><enum>(ii)</enum><text>an alien granted asylum under section 208 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1158">8 U.S.C. 1158</external-xref>);</text></clause><clause commented="no" display-inline="no-display-inline" id="iddb56dfb86d7b4604a8d012c295b991ef"><enum>(iii)</enum><text display-inline="yes-display-inline">an alien granted parole under section 212(d)(5) or 236(a)(2)(B) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(d)(5)</external-xref>, 1126(a)(2)(B));</text></clause><clause id="idB7E7A28B6529436590760A9A7A9ED86F"><enum>(iv)</enum><text>an alien granted temporary protected status under section 244 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1254a">8 U.S.C. 1254a</external-xref>);</text></clause><clause id="idEE1212B1F6DA498E8C0CACE1EC5FA815"><enum>(v)</enum><text>an alien granted deferred action or deferred enforced departure, including pursuant to the memorandum of the Department of Homeland Security entitled <quote>Exercising Prosecutorial Discretion with Respect to Individuals Who Came to the United States as Children</quote> issued on June 15, 2012; or</text></clause><clause id="id7B81E11EFBA74B8C9878272D26C0B4A7"><enum>(vi)</enum><text>an alien granted withholding of removal under section 241(b)(3) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1231">8 U.S.C. 1231(b)(3)</external-xref>).</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="idd8fdef0b34014a2ca63fe49c83514309"><enum>13.</enum><header>Restrictions on use of Community Development Block Grant funds and Federal funding by tax-exempt organizations</header><subsection id="id7f68b3136b4b4dc2aa0c0ad2444a670c"><enum>(a)</enum><header>Restriction on CDBG funding</header><text>Section 105 of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5305">42 U.S.C. 5305</external-xref>) is amended by adding at the end the following:</text><quoted-block id="id96F943A67B4E46619BD131EB65DDED0C" display-inline="no-display-inline" style="OLC"><subsection commented="no" display-inline="no-display-inline" id="ida409c6c5b2be419fab5553f688a92dd2"><enum>(i)</enum><header>Prohibition on monetary contributions or in-Kind goods or services for non-citizens</header><text>A recipient of a grant under this title may not use any grant funds to provide monetary contributions or in-kind goods or services to—</text><paragraph id="id9ca2672166d44e4c93653591b1afd275"><enum>(1)</enum><text>any alien (as defined in section 101(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)</external-xref>)) who is unlawfully present in the United States;</text></paragraph><paragraph id="idc2b75f94bec54662ae58fe8834d89bf1"><enum>(2)</enum><text>any alien paroled into the United States under section 212(d)(5) or 236(a)(2)(B) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(d)(5)</external-xref>, 1226(a)(2)(B));</text></paragraph><paragraph id="ida52ea33b2e1a44f78f6d6674b2eda954"><enum>(3)</enum><text>any alien granted asylum under section 208 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1158">8 U.S.C. 1158</external-xref>);</text></paragraph><paragraph id="ida5bf5521fa0a4707ba81c815810afb38"><enum>(4)</enum><text>any alien granted temporary protected status under section 244 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1254a">8 U.S.C. 1254a</external-xref>);</text></paragraph><paragraph id="idb7e6726c33484dd6ae326956cfac09d1"><enum>(5)</enum><text>any alien granted deferred action or deferred enforced departure, including pursuant to the memorandum of the Department of Homeland Security entitled <quote>Exercising Prosecutorial Discretion with Respect to Individuals Who Came to the United States as Children</quote> issued on June 15, 2012; or</text></paragraph><paragraph id="id57dc66f181d2439bb9de541be5d4bd54" commented="no" display-inline="no-display-inline"><enum>(6)</enum><text>any alien granted withholding of removal under section 241(b)(3) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1231">8 U.S.C. 1231(b)(3)</external-xref>).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id0b0f026a8d634905bdbf7afe8732b27e"><enum>(b)</enum><header display-inline="yes-display-inline">Restriction on use of Federal funding by tax-Exempt organizations</header><paragraph id="id70a8918aa2b84ee0a5554fe5a05f4aaa"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/501">Section 501</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id348D292A8FE54AEE976644EF187E6128"><subsection commented="no" display-inline="no-display-inline" id="id131c3078d6f3487eb8ad5bd6377603c1"><enum>(s)</enum><header>Prohibition of support to certain non-citizens</header><text>Notwithstanding subsection (a), an organization which is described in subsection (c)(3) shall not be exempt from taxation under subsection (a) for any taxable year if, at any time during such taxable year, such organization uses any Federal grant, appropriation, or other Federal funding to provide monetary support, services, or in-kind contributions to—</text><paragraph id="id8f079ac42b554eac9e4a8db096c885d3"><enum>(1)</enum><text>any alien (as defined in section 101(a) of the Immigration and Nationality Act) who is unlawfully present in the United States,</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id939cb514c7744a3fb2c8fe7774ff1021"><enum>(2)</enum><text display-inline="yes-display-inline">any alien granted parole under section 212(d)(5) or 236(a)(2)(B) of the Immigration and Nationality Act,</text></paragraph><paragraph id="id98279df2bb0c43e984d0ba2c7a9b8762"><enum>(3)</enum><text>any alien granted temporary protected status under section 244 of the Immigration and Nationality Act,</text></paragraph><paragraph id="id0d317ccf121d4a9b9b4f92dc23dbddfa"><enum>(4)</enum><text>any alien granted deferred action or deferred enforced departure, including pursuant to the memorandum of the Department of Homeland Security entitled <quote>Exercising Prosecutorial Discretion with Respect to Individuals Who Came to the United States as Children</quote> issued on June 15, 2012, or</text></paragraph><paragraph id="idd17ea0b441cb41f0969754ba865eca68"><enum>(5)</enum><text>any alien granted withholding of removal under section 241(b)(3) of the Immigration and Nationality Act.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id02f1ee8f2520401095b632618a73c844"><enum>(2)</enum><header>Effective date</header><text>The amendment made by this subsection shall apply to taxable years beginning after December 31, 2024.</text></paragraph></subsection></section><section id="id16137ddb84304c8287c8e4dc0f30fd75"><enum>14.</enum><header>Implementing regulations and guidance</header><text display-inline="no-display-inline">The head of each appropriate agency shall promulgate such rulemaking and guidance as may be required to carry out this Act and the amendments made by this Act.</text></section></legis-body></bill>
