which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 23, United States Code, to establish a grant program to rebuild and improve transportation infrastructure at urban waterfronts, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Constructing Resilient and Enduring Waterfronts Act</short-title></quote> or the <quote><short-title>CREW Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="ide952fcb3851c4592932d541ccb010752"><enum>2.</enum><header>Constructing Resilient and Enduring Waterfronts program</header><subsection commented="no" display-inline="no-display-inline" id="ida2aed62c81064171a44c86dbc5196ca4"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/1">Chapter 1</external-xref> of title 23, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="idA3E335A18ECB4A1696DF572C1F41FD07"><section commented="no" display-inline="no-display-inline" id="ide3ce443ad9f24638b41f7cff5cce8609"><enum>180.</enum><header>Constructing Resilient and Enduring Waterfronts program</header><subsection id="id4ccdf7b407a14de7afe5fe678981e750"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="id6ddc985a68a24df98e66a9984d61b7b3"><enum>(1)</enum><header>Program</header><text display-inline="yes-display-inline">The term <term>program</term> means the Constructing Resilient and Enduring Waterfronts program established under subsection (b). </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ideba528d1f003445b99cb3978c92d36f6"><enum>(2)</enum><header>Urban waterfront</header><text>The term <term>urban waterfront</term> means an area of land within an urbanized area that is in the vicinity of a major river, lake, estuary, or ocean that—</text><subparagraph commented="no" display-inline="no-display-inline" id="id6134748fcb07486b9ed347e020e8bd32"><enum>(A)</enum><text display-inline="yes-display-inline">includes land immediately adjacent to that body of water; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5fdde6cdafa9464b9d4792ad7cea4965"><enum>(B)</enum><text display-inline="yes-display-inline">is planned or used for multiple uses, including residential and commercial uses, public parks and green space, and infrastructure to support such uses. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2b9c2f69b7314ca38ca75cd26699cbc5"><enum>(3)</enum><header>Urban waterfront development plan</header><text display-inline="yes-display-inline">The term <term>urban waterfront development plan</term> means a plan that—</text><subparagraph commented="no" display-inline="no-display-inline" id="id7a325aaaec0148f8991a2966de716410"><enum>(A)</enum><text display-inline="yes-display-inline">considers the improvement of all, or 1 or more parts, of an urban waterfront for the purposes of economic development, housing, safety, and resilience to flooding and extreme weather; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idee597da51f034a3583700950927ae34e"><enum>(B)</enum><text display-inline="yes-display-inline">identifies a need for not less than $200,000,000 in investments for transportation, public spaces, and other infrastructure at the urban waterfront. </text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id42a219164b8745e28b4d581536c2ed46"><enum>(b)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary shall establish a program, to be known as the <quote>Constructing Resilient and Enduring Waterfronts program</quote>, to provide grants, on a competitive basis, to rebuild and improve transportation infrastructure at urban waterfronts.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idcf26b8686a104c70a6e9cc427b35a755"><enum>(c)</enum><header>Purposes</header><text display-inline="yes-display-inline">The purposes of the program are—</text><paragraph commented="no" display-inline="no-display-inline" id="idd5fbe570991a4715850bb7289605502c"><enum>(1)</enum><text display-inline="yes-display-inline">to improve the resilience of public space and public infrastructure from extreme weather events, flooding, and rising sea levels;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id248a9ec48061498f8298581080b5219e"><enum>(2)</enum><text display-inline="yes-display-inline">to improve circulation and access to waterfront resources for the general public;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf8b02fc827b84ee083c1a71b582c5258"><enum>(3)</enum><text display-inline="yes-display-inline">to unlock the economic benefits of urban waterfronts; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb50865728ba144ae8e90d873f4bcf0d3"><enum>(4)</enum><text display-inline="yes-display-inline">to restore and improve air quality and water quality at urban waterfronts.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idcccd5637f7bd4890aae6b02336c99cef"><enum>(d)</enum><header>Eligible entities</header><text display-inline="yes-display-inline">An entity eligible to receive a grant under the program is any of the following:</text><paragraph commented="no" display-inline="no-display-inline" id="id89a632d9766e4795b3eb8e3bda8ad014"><enum>(1)</enum><text display-inline="yes-display-inline">A State or political subdivision of a State.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id13edbe4967b4472fbac70b8822890f12"><enum>(2)</enum><text display-inline="yes-display-inline">A metropolitan planning organization.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id88e3036d1b68480e863fb690b7ed545a"><enum>(3)</enum><text display-inline="yes-display-inline">A unit of local government. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb5702ee623aa438e968f2dfcb2454f1e"><enum>(4)</enum><text display-inline="yes-display-inline">A special purpose district or public authority established for the purpose of implementing an urban waterfront development plan.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6beb71dbeaf94976bfb2ed248bef488a"><enum>(5)</enum><text>A nonprofit entity established and authorized by a State to implement an urban waterfront development plan.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idfb21a4cdae3541b0ba156f4c970a5059"><enum>(e)</enum><header>Application</header><text display-inline="yes-display-inline">To be eligible to receive a grant under the program, an eligible entity described in subsection (d) shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require. </text></subsection><subsection commented="no" display-inline="no-display-inline" id="id18be304e20ab4adbb1aff566a7eea686"><enum>(f)</enum><header>Eligible costs</header><text display-inline="yes-display-inline">Funds from a grant under the program may be used for—</text><paragraph commented="no" display-inline="no-display-inline" id="iddb33abbc2509437da0bdb6901c7a99e8"><enum>(1)</enum><text display-inline="yes-display-inline">reconstruction and realignment of the street network at the urban waterfront in order—</text><subparagraph commented="no" display-inline="no-display-inline" id="idf68a59ea5c614c8ea0b1f429ed34155d"><enum>(A)</enum><text display-inline="yes-display-inline">to expand access to the waterfront to larger numbers of visitors;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id08269461f35d4a2596faa5cd535fc98f"><enum>(B)</enum><text display-inline="yes-display-inline">to calm traffic; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6636b5c65d0c4acb9428c69f78c3a8d5"><enum>(C)</enum><text display-inline="yes-display-inline">to provide safer conditions for people using nonmotorized transportation;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id014ec521dc23498c9e51f2ffa25c42be"><enum>(2)</enum><text>construction of pedestrian walkways at the urban waterfront;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id92d7e88bb55e4188b7c3f5afe5abe42a"><enum>(3)</enum><text>construction or improvement of green infrastructure at the urban waterfront—</text><subparagraph commented="no" display-inline="no-display-inline" id="idc864856607ad468797ff947ad67f2acd"><enum>(A)</enum><text display-inline="yes-display-inline">to improve natural conditions;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id390d0d3d381f4734946145e4e796ee5b"><enum>(B)</enum><text display-inline="yes-display-inline">to strengthen resilience; or </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id38c4817c206a4164a97fd43bb35a5059"><enum>(C)</enum><text display-inline="yes-display-inline">to provide flood protection;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8cc928571c58416a92617ebf6399102e"><enum>(4)</enum><text>construction or improvement of infrastructure at the urban waterfront providing resilience and protection against flooding and sea level rise, such as seawalls;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb870b83299a5478093305a2f45eb3761"><enum>(5)</enum><text>activities to repair or improve utilities required by or associated with construction of roadways or other transportation infrastructure at the urban waterfront;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id66e55b9a9c9044eca4593517710623d4"><enum>(6)</enum><text>changes or improvements to stormwater infrastructure at the urban waterfront; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0d891c00324e4152a0a0a3bf9839ea3d"><enum>(7)</enum><text>installation, replacement, or repair of lighting, signage, or planting at the urban waterfront; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1d4fd28fa05641c492417c1b679bd16d"><enum>(8)</enum><text>activities eligible under section 133(h). </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id994f586399e544e89d49f65fd580a9ea"><enum>(g)</enum><header>Urban waterfront development plan</header><paragraph commented="no" display-inline="no-display-inline" id="id56c13a11334a4381a212ec3394337002"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">To be eligible to receive a grant under the program, an eligible entity described in subsection (d) shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="id18a4c29c18e34916890c469aa5dfe226"><enum>(A)</enum><text display-inline="yes-display-inline">demonstrate that there is in effect for the urban waterfront an urban waterfront development plan that was developed by the applicable unit of local government through a robust process of public engagement; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3b11e9ad20f2417cbe6099dea0257026"><enum>(B)</enum><text display-inline="yes-display-inline">demonstrate that the urban waterfront development plan has taken into consideration the best available science and data regarding the vulnerabilities of the urban waterfront to flooding caused by sea level rise or extreme weather events; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4f3deae9e7f843e2b4e507c1e4e434d7"><enum>(C)</enum><text display-inline="yes-display-inline">demonstrate the need for implementing the project as part of the urban waterfront development plan in terms of the progress the project would make toward achieving 1 or more purposes described in subsection (c). </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4bd74ad31e0d4d41a69fcf38df991fbf"><enum>(2)</enum><header>Multiple existing plans</header><text>The Secretary may determine that an eligible entity has made the demonstration described in paragraph (1)(A) through a combination of existing plans.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id489288db57534cd4a20df7dc656dd0d0"><enum>(3)</enum><header display-inline="yes-display-inline">Inclusion</header><text display-inline="yes-display-inline">A project eligible to be carried out under the program shall be within the scope of the applicable urban waterfront development plan.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id9d4dbc8a4cc24021ba2264e72aad1b25"><enum>(h)</enum><header>Grant amount</header><text display-inline="yes-display-inline">A grant provided under the program shall be not less than $30,000,000.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idbfeb64d6236944c4b8833a99a6156c1c"><enum>(i)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated out of the Highway Trust Fund (other than the Mass Transit Account) to carry out the program $300,000,000 for each of fiscal years 2027 through 2031.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id78fa802626cd46d5a1a7241e862999b7"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/1">chapter 1</external-xref> of title 23, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/23/179">section 179</external-xref> the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id62E85D93A284423787CF93770D3DEF89"><toc><toc-entry level="section" bold="off">180.
