Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish a State rail formula grant program, to direct the Federal Railroad Administration to create a Green Railroads Fund, to expand passenger rail programs, to address air quality concerns, to establish rail workforce training centers, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>All Aboard Act of 2024</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id2ec79647df7a47e6ba5480d21236f98c"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="id0ec5a7658e9e4d929fb7c427047faf47"><enum>(1)</enum><header>Administration</header><text>The term <term>Administration</term> means the Federal Railroad Administration. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id581f842f7ea84366b87466c856e084f3"><enum>(2)</enum><header display-inline="yes-display-inline">Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Federal Railroad Administration.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idba18038498e14a57942b814764691581"><enum>(3)</enum><header>Amtrak</header><text>The term <term>Amtrak</term> means the National Railroad Passenger Corporation. </text></paragraph><paragraph id="id312808762fdc43df88c7874c91f140c7"><enum>(4)</enum><header>Electrification infrastructure</header><text>The term <term>electrification infrastructure</term>—</text><subparagraph commented="no" display-inline="no-display-inline" id="id39eedd367a8041f2a65a1012e7b8aa9f"><enum>(A)</enum><text display-inline="yes-display-inline">means overhead wire in-motion charging technology and any associated infrastructure necessary for the operation to propel a locomotive or train; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb0e6c6c92aff49208ef09850a395468f"><enum>(B)</enum><text display-inline="yes-display-inline">includes battery electric technology that propels a locomotive or train in railyards and other environments in which catenary infrastructure is difficult to deploy as determined by the Secretary. </text></subparagraph></paragraph><paragraph id="id0fe261c6aebb4ae6a890a3011e007653"><enum>(5)</enum><header>Environmental justice community</header><text>The term <term>environmental justice community</term> means a community with significant representation of individuals of color, low-income individuals, or Tribal and Indigenous individuals, that experiences, or is at risk of experiencing, higher or more adverse human health or environmental effects. </text></paragraph><paragraph id="ide967789ba1f841dd92763f051f4773a3"><enum>(6)</enum><header>Federal-State Intercity Partnership program</header><text>The term <term>Federal-State Intercity Partnership program</term> means the grant program developed and implemented by the Secretary pursuant to section 24911(b) of title 49, United States Code.</text></paragraph><paragraph id="idc11cbd16e3364ae29d5b3ddefc291dcb"><enum>(7)</enum><header>High-performance rail</header><text>The term <term>high-performance rail</term> means an intercity passenger rail service that is designed to meet the current and future market demand for the transportation of people and goods, in terms of capacity, travel times, reliability, and efficiency. </text></paragraph><paragraph id="idbee0350877584ec0ae93c786b8815b47"><enum>(8)</enum><header>Locomotive</header><text>The term <term>locomotive</term> has the meaning given that term in section 1033.901 of title 40, Code of Federal Regulations.</text></paragraph><paragraph id="id5aa1bf5b238746b180ee2fb49a26ceaa"><enum>(9)</enum><header>MU locomotive</header><text>The term <term>MU locomotive</term>, with respect to electric multiple unit and battery-electric multiple unit trains, has the meaning given that term in section 229.5 of title 49, Code of Federal Regulations. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id70E52F7EF62E48BDB0B11E82EE52E428"><enum>(10)</enum><header>Partnership applicant</header><text>The term <term>partnership applicant</term> has the meaning given that term <term>applicant</term> in section 24911 of title 49, United States Code.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idBA6B1AE249A742D6A1B05C3595E65D28"><enum>(11)</enum><header display-inline="yes-display-inline">Secretary</header><text>The term <term>Secretary</term> means the Secretary of Transportation.</text></paragraph><paragraph id="id1CF647989D7D41039C42E8907AC23221" commented="no" display-inline="no-display-inline"><enum>(12)</enum><header>State</header><text>The term <term>State</term> means a State of the United States, the District of Columbia, the Commonwealth of Puerto Rico, Guam, American Samoa, the Commonwealth of the Northern Mariana Islands, the United State Virgin Islands, the Federated States of Micronesia, the Republic of the Marshall Islands, or the Republic of Palau. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf9f880a0b540425193993d97d4cce64a"><enum>(13)</enum><header>Train</header><text>The term <term>train</term> has the meaning given that term in section 221.5 of title 49, Code of Federal Regulations.</text></paragraph><paragraph id="iddd1dc8af6b8d41df8c6f13b1ee0ecba7"><enum>(14)</enum><header>Zero-emission locomotive</header><text>The term <term>zero-emission locomotive</term> means a locomotive that does not emit any criteria pollutant, toxic pollutant, or greenhouse gas from any onboard source of power at any power setting, including any propulsion power that is connected to and moves with the locomotive when it is in motion.</text></paragraph></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="idb24b2f70ce704582940aee50fc278d33"><enum>3.</enum><header display-inline="yes-display-inline">State rail formula funding</header><subsection id="idd8ac3c79c72741ebbb3c91889d6cba9c"><enum>(a)</enum><header>In general</header><text>The Secretary shall establish a formula grant program under which the Secretary shall award grants to States for the development of State rail plans, operations of rail service, and maintenance and expansion of rail infrastructure. </text></subsection><subsection commented="no" display-inline="no-display-inline" id="id3e98e5c3360e42ffb17ee24442adfd9b"><enum>(b)</enum><header>Report required</header><text>Each State that receives a grant under this section shall submit to the Secretary a report describing how the State rail plan and activities—</text><paragraph commented="no" display-inline="no-display-inline" id="id295ec42823fe4181a8b297da4d6eb44c"><enum>(1)</enum><text display-inline="yes-display-inline">include a strategy—</text><subparagraph commented="no" display-inline="no-display-inline" id="id6ef4f24430f841a99bb9e9ee404f5719"><enum>(A)</enum><text display-inline="yes-display-inline">to expand passenger rail service, particularly high-performance rail service, including routes selected under the Corridor Identification and Development Program established under section 25101 of title 49, United States Code; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5d7db44ab60a4688849faa57535b6e95"><enum>(B)</enum><text display-inline="yes-display-inline">to electrify existing freight and passenger rail; and </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1d6f0e875ce049f9bf0d9f7969af9e13"><enum>(2)</enum><text display-inline="yes-display-inline">are consistent with the goals described in subsection (c).</text></paragraph></subsection><subsection id="id801867b0c9b340c8bdf64eb9f6f9b34a"><enum>(c)</enum><header>Goals</header><text>The goals described in this subsection are—</text><paragraph id="id24f6a6bc251f46ad94859d473ac79039"><enum>(1)</enum><text>to support the goal of achieving zero-emission locomotives by 2047;</text></paragraph><paragraph id="id4de07684b8d54697a20a8486e49f2bf5"><enum>(2)</enum><text>to guarantee the national rail network has the capacity to serve a significant portion of freight and passenger movement along the current and projected highest trafficked intercity corridors by 2050;</text></paragraph><paragraph id="id558001f0c53645d8abfe532bdf85fb38"><enum>(3)</enum><text>to achieve zero emissions for—</text><subparagraph commented="no" display-inline="no-display-inline" id="id319aea74e1b84449aca324d585124386"><enum>(A)</enum><text display-inline="yes-display-inline">50 percent of all trains by 2030; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1e17148d2cb444059fbebe2301c97d77"><enum>(B)</enum><text display-inline="yes-display-inline">all new trains by 2035; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6df13ba91fc143a0bcde2e0dadacad24"><enum>(C)</enum><text display-inline="yes-display-inline">all locomotives by 2047;</text></subparagraph></paragraph><paragraph id="id400cade10d86478bb0d946702dfe4ddb"><enum>(4)</enum><text>to reconnect communities divided by railroads through infrastructure improvements that expand freight and passenger rail capacity;</text></paragraph><paragraph id="idb6ef180ec6bb4670aafe4459bf4127ba"><enum>(5)</enum><text>to protect the safety and health of rail workers and nearby communities;</text></paragraph><paragraph id="id5a3ba3c8703f4af7a75530248be9bc41"><enum>(6)</enum><text>to ensure current and future rail infrastructure is climate resilient; </text></paragraph><paragraph id="id3984b19306e3463599d38c176b4f014c"><enum>(7)</enum><text>to realize high-quality service that is trip-time competitive with other intercity travel options; and</text></paragraph><paragraph id="idee3fbc96ac3e41d5b08c375b19577660"><enum>(8)</enum><text>to facilitate a viable mode shift from short-haul flights to passenger rail between targeted city pairs. </text></paragraph></subsection><subsection id="id25dc4d2dd81644db950953f0f8df8125"><enum>(d)</enum><header>Use of funds</header><text>A State awarded a grant under this section may use funds from such grant to advance rail planning and operations by—</text><paragraph id="id2de0fa7188b64d6a83dce2026fba78cf"><enum>(1)</enum><text>hiring and retaining staff;</text></paragraph><paragraph id="id3427b8e730a74c7685684f32bcc0417b"><enum>(2)</enum><text>pooling funds with other States to advance interstate initiatives and projects; </text></paragraph><paragraph id="id65817a4a43694bf296de89d1a57d538e"><enum>(3)</enum><text>making improvements to existing rail infrastructure;</text></paragraph><paragraph id="id86c65916007c429599eb5705777ee9bf"><enum>(4)</enum><text>constructing new rail infrastructure;</text></paragraph><paragraph id="id3284bf4e8def416ab8a159782f387902"><enum>(5)</enum><text>carrying out such other rail activities as the Secretary determines appropriate, including studying the impacts on freight rail operations and ridership and operations coordination; </text></paragraph><paragraph id="idcf34d70016de4cee9ade7d162608cba8"><enum>(6)</enum><text>promoting intercity passenger rail operation; and</text></paragraph><paragraph id="idf0fc20f907384085a67b5813a1a0f26c"><enum>(7)</enum><text>preparing applications for competitive Federal grant programs.</text></paragraph></subsection><subsection id="ida4a394c883e74e66bc4a1663552d3af8"><enum>(e)</enum><header>Formula</header><text>In allocating grant funds among the States, the Administrator shall—</text><paragraph commented="no" display-inline="no-display-inline" id="id514dc1e7999d49229cbaa507556dc9a0"><enum>(1)</enum><text display-inline="yes-display-inline">ensure that each State receives not less than $10,000,000; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id78bd950a0e1a454c9a44066cd0a1c6cf"><enum>(2)</enum><text>apportion the remaining grant funds among the States based on the respective population of such States.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id038b9b9fe5d24dcf892b89b6b8aeefe5"><enum>(f)</enum><header display-inline="yes-display-inline">Technical assistance</header><text>The Administrator, in coordination with the Administrator of the Environmental Protection Agency, the Secretary of Energy, Amtrak, and the Administrator of the Federal Transit Administration, shall provide technical assistance to States and communities to assist with the development of State rail plans.</text></subsection><subsection id="id4f7d4193f0de43bc808e4d8735fdd26a"><enum>(g)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary $3,500,000,000 for the 5-year period beginning on October 1, 2024, to provide grants under this section.</text></subsection></section><section id="id8cd7e8be1bc44eddbb96881aed9b8907"><enum>4.</enum><header>Green Railroads Fund</header><subsection id="idb3c93899763a4268832399381f49c350" commented="no"><enum>(a)</enum><header>In general</header><text>The Secretary, in consultation with the Administrator of the Environmental Protection Agency, may award grants to eligible entities described in subsection (c) to enable or improve electrified rail operations.</text></subsection><subsection id="idf8015d44efcb4f3fa4472c24e1589f39"><enum>(b)</enum><header>Application</header><paragraph id="id64c5285a761143b2955d505f351eafab"><enum>(1)</enum><header>In general</header><text>To apply for a grant under this section an eligible entity shall submit an application to the Secretary in such manner as the Secretary may reasonably require.</text></paragraph><paragraph id="id966a83c182454e0b94c5f0d18dc31fb2"><enum>(2)</enum><header>Requirements</header><text>Each application submitted in accordance with paragraph (1) shall include—</text><subparagraph id="id6cdf5b479a9a4aaaa02e22bf30a97c70"><enum>(A)</enum><text>a plan for robust engagement that details a public notice process that requires—</text><clause commented="no" display-inline="no-display-inline" id="id58160273cc80429db3ef06b1b70f3d29"><enum>(i)</enum><text display-inline="yes-display-inline">notification online and in relevant print sources written in languages used within the area reasonably affected by the proposed grant;</text></clause><clause commented="no" display-inline="no-display-inline" id="id2c2fc86c21824359bbb335c18ddfedad"><enum>(ii)</enum><text display-inline="yes-display-inline">opportunities for public meetings and comment; and </text></clause><clause commented="no" display-inline="no-display-inline" id="id778d5a925c964f5894a6f4bb8481e439"><enum>(iii)</enum><text display-inline="yes-display-inline">other information relevant to the project to be made publicly available; </text></clause></subparagraph><subparagraph id="id690fc3ea481b4f1ea83e2ef663edfa7a"><enum>(B)</enum><text>a plan that details how—</text><clause commented="no" display-inline="no-display-inline" id="id11fb2cae6c014eaba4d23763db5aeaca"><enum>(i)</enum><text display-inline="yes-display-inline">the project will safeguard or improve the local environment and public health; and </text></clause><clause commented="no" display-inline="no-display-inline" id="id39ae5a211617433a9246e920c9b3ccf7"><enum>(ii)</enum><text display-inline="yes-display-inline">environmental and public health stressors will be monitored and minimized during the project; </text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfafe914acfa04608bbe9afc08d58e13d"><enum>(C)</enum><text display-inline="yes-display-inline">a description of wage and apprenticeship requirements for individuals employed to construct, operate, and maintain rail electrification infrastructure; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id56716095d2b64279bcf23a17baf4a453"><enum>(D)</enum><text display-inline="yes-display-inline">a transition plan that examines the impact of the proposed project on the workforce of the eligible entity, including—</text><clause id="id5CC9B2E0FDFB43F9A60563453739F89E" commented="no"><enum>(i)</enum><text>identifying skills gaps, training needs, and retraining needs of the workforce;</text></clause><clause id="id6649698B71CD41C988B02026EB2DDB1A" commented="no"><enum>(ii)</enum><text>a plan to operate and maintain infrastructure of the project using existing insourced workforce;</text></clause><clause id="idF25F342DC2E24B5E9233BC143CE3E981" commented="no"><enum>(iii)</enum><text>a plan to avoid displacement of the workforce and to transition any displaced workers to new jobs created by the project;</text></clause><clause id="idC16D91C1F58642828E799B8740DC631E" commented="no"><enum>(iv)</enum><text>identifying the steps the eligible entity will take to offset any identified negative impact or potential displacement of the workforce, including how the entity will use the funds from the grant and its own funding to implement the transition plan; and</text></clause><clause id="idE8202D9E666B41258199197F23BE0C95" commented="no" display-inline="no-display-inline"><enum>(v)</enum><text>a description of how the eligible entity will work with any organizations representing the workforce to implement the transition plan. </text></clause></subparagraph></paragraph></subsection><subsection id="id9f784ce036544115a65954baa839d621"><enum>(c)</enum><header>Eligible entities</header><text>An eligible entity described in this subsection is any of the following:</text><paragraph id="id0b599162d470448cbab2499237f41218"><enum>(1)</enum><text>A State.</text></paragraph><paragraph id="idf2d31927688b4e968decc5dbf5f67c45"><enum>(2)</enum><text>A group of States.</text></paragraph><paragraph id="id4ff13b999974494c9680c32a9672d6e9"><enum>(3)</enum><text>An interstate compact.</text></paragraph><paragraph id="id16278357f905452387ecfcc573340dd6"><enum>(4)</enum><text>A public agency or a publicly chartered authority established by one or more States.</text></paragraph><paragraph id="idd9957125945c48b8acb853be24b78ecb"><enum>(5)</enum><text>A political subdivision of a State.</text></paragraph><paragraph id="id401c5d4af76f49fab065848cbed28067"><enum>(6)</enum><text>Amtrak or any other rail carrier that provides intercity rail passenger transportation.</text></paragraph><paragraph id="id2fbce00e30074eabaf4b9cc65d257df4"><enum>(7)</enum><text>A class I railroad in partnership with at least 1 of the entities described in paragraphs (1) through (5).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id306d8d2d6e40455da16b27f84d6dd90a"><enum>(8)</enum><text>A class II or III railroad.</text></paragraph><paragraph id="id89422babbb9e4311b86de451ce530d68"><enum>(9)</enum><text>A federally recognized Indian Tribe.</text></paragraph><paragraph id="idad07b4d2607b4721872653707c47a609"><enum>(10)</enum><text>A rail equipment manufacturer in partnership with at least 1 of the entities described in paragraphs (1) through (5).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id18e1d61fa4a5483db64eef925dce112c"><enum>(11)</enum><text>A public utility.</text></paragraph><paragraph id="id2311121f8d6d43c590453cddf2704689" commented="no" display-inline="no-display-inline"><enum>(12)</enum><text>A nonprofit labor organization representing a class or craft of employees of rail carriers or rail carrier contractors. </text></paragraph></subsection><subsection id="id5e98e45844464e7abb2192416e9b27e1"><enum>(d)</enum><header>Use of funds</header><text>An eligible entity awarded a grant under this section may use funds from such grant—</text><paragraph id="id28c3fa5aa443435dba96191eeb7c682b"><enum>(1)</enum><text>to purchase railroad lines and right of way from other railroads that host Amtrak or other intercity passenger rail transportation for new electrification infrastructure;</text></paragraph><paragraph id="id2a1acb2288d74aa38634b8a59c819361"><enum>(2)</enum><text>to rebuild or improve existing locomotives, trains, or MU locomotives to enable such trains and locomotives to use electrification infrastructure;</text></paragraph><paragraph id="idb88d3efc39924a27b8aeb4de85cddd6e"><enum>(3)</enum><text>to install or improve existing rail electrification infrastructure;</text></paragraph><paragraph id="id353af8305a1c4854b8f043704bd39920"><enum>(4)</enum><text>to build new rail corridors with electrification infrastructure;</text></paragraph><paragraph id="id2c12edaf3e754abab6cd32499a9b3ecd"><enum>(5)</enum><text>to update rail yards by adding electrification infrastructure;</text></paragraph><paragraph id="id7c897ed172b14a8888a755132d03d904"><enum>(6)</enum><text>to lease or acquire an easement along a right of way for electrification infrastructure;</text></paragraph><paragraph id="idf972155866e84c10917614f559c7505d"><enum>(7)</enum><text>to purchase or lease electric locomotives, MU locomotives, and trains or rolling stock; </text></paragraph><paragraph id="idcaaa449ee7834155b46ab300f36a278e"><enum>(8)</enum><text>to ensure new electrification infrastructure is climate resilient; </text></paragraph><paragraph id="id94a1b14fcab341c7b44c64d3b052c970"><enum>(9)</enum><text>to engage in robust engagement with communities; and</text></paragraph><paragraph id="idf7948176df2b440d8c3f45c7f672cac3"><enum>(10)</enum><text>for workforce development and training to support the maintenance, deployment, and operation of electric locomotives, MU locomotives, and trains.</text></paragraph></subsection><subsection id="id1325d24f11f2421f809d496f6d38dbd0"><enum>(e)</enum><header>Labor requirements</header><text>A project funded by a grant awarded under this section shall— </text><paragraph id="idb843bbadfef1406f93de095a35769345"><enum>(1)</enum><text>use project labor agreements; </text></paragraph><paragraph id="id9634686490bf4128a4de3573d09664e3" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>use enforceable agreements to hire from local communities; and</text></paragraph><paragraph id="ide70e087312e34e87bde3ed6ea22d50b5"><enum>(3)</enum><text>for any freight train or light engine used in connection with the movement of freight, require a crew consisting of at least 2 individuals, one of whom is certified under regulations promulgated by the Administration as a locomotive engineer pursuant to section 20135 of title 49, United States Code, and the other of whom is certified under regulations promulgated by the Administration as a conductor pursuant to section 20163 of title 49, United States Code.</text></paragraph></subsection><subsection id="id0b1a588e6a884aceb7b48ae747a892ae"><enum>(f)</enum><header>Priority</header><text>In awarding grants under this section, the Secretary shall give priority to projects that will—</text><paragraph id="id044ee47f25e34d57aa00d74aef9b1bdd"><enum>(1)</enum><text>produce air quality benefits in environmental justice communities; and</text></paragraph><paragraph id="ideb4d3c09d0e54255bf2828c3aa22e438"><enum>(2)</enum><text>expand high performance passenger rail.</text></paragraph></subsection><subsection id="idd55bdd82cd1549a5a47923d8d53737b7"><enum>(g)</enum><header>Benefits for other programs</header><text>An eligible entity that receives a grant under this section and is eligible for other rail grant programs described by this Act shall receive priority for additional funding under such programs for rail electrification infrastructure projects. Entities awarded grants under other programs in this Act may be awarded a grant under this section when applicable. </text></subsection><subsection id="idc4de95db923c44c5bfb3649151dffc50"><enum>(h)</enum><header>Study on transmission co-Location with rail electrification infrastructure</header><paragraph id="id86644366d0d94d0d93630bae213f202f"><enum>(1)</enum><header>In general</header><text>The Secretary, in coordination with the Administrator, and in consultation with the Department of Energy, the Federal Energy Regulatory Commission, and any other agency deemed relevant by the Secretary and the Administrator, shall conduct a study to evaluate the feasibility, benefits, equity impacts, and challenges of co-locating high-voltage transmission infrastructure alongside rail corridors as part of efforts to support rail electrification, expand renewable energy capacity, reduce community impacts of new infrastructure, and ensure fair access to infrastructure benefits for all communities.</text></paragraph><paragraph id="id3349dc6ee7404e15854895888755e08a"><enum>(2)</enum><header>Outcomes and recommendations</header><subparagraph id="idbb0437ed12bb4a77906a127264d76bf3"><enum>(A)</enum><header>Interagency task force</header><text>In carrying out the study required under paragraph (1), the Secretary may recommend the establishment of an interagency task force to facilitate ongoing coordination among Federal, state, and local, and private entities to advance projects involving transmission and rail electrification infrastructure.</text></subparagraph><subparagraph id="id6d1010d3dc424b049e964246f6b55e34"><enum>(B)</enum><header>Designated priority corridors</header><text>In carrying out the study required under paragraph (1), the Secretary may—</text><clause commented="no" display-inline="no-display-inline" id="id26c0d19bc8f94a75b02e20bea63da827"><enum>(i)</enum><text display-inline="yes-display-inline">propose a framework to designate priority corridors for co-located transmission and rail electrification projects; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id7eecd0d339dc42fea8469ab4b897a6b6"><enum>(ii)</enum><text display-inline="yes-display-inline">recommend how such projects should be incentivized. </text></clause></subparagraph></paragraph></subsection><subsection id="id28ebf04a7f4944aa841cf0cbcd501681"><enum>(i)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary $50,000,000,000 for the 5-year period beginning on October 1, 2024, to provide grants under this section. </text></subsection></section><section id="id7a5424785d68420f93d5544739953211"><enum>5.</enum><header>Expansion of passenger rail and high-performance rail</header><subsection id="id2da37bf5a23f4e20b95258d12954e408" commented="no"><enum>(a)</enum><header>Federal-State Intercity Partnership program</header><paragraph id="id29522d0de5964560b899aa26bd9c2cc3"><enum>(1)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary for the Federal-State Intercity Partnership program $80,000,000,000 for the 5-year period beginning on October 1, 2024.</text></paragraph><paragraph id="id82dcc36abdb44abfb9c8a3352f674a89" commented="no"><enum>(2)</enum><header>Priority high-performance rail</header><text>Section 24911(d) of title 49, United States Code, is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="idb8f4dfa183744f658ab0ff604f332b48"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (1) through (3) as paragraphs (2) through (4), respectively; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide98c1750b460459782b5e9659c4d7b34"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting before paragraph (2), as redesignated, the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id982006F54F8E42EE8EDCA96EE777B776"><paragraph commented="no" display-inline="no-display-inline" id="id3ed1ebc83e6f4022aa6f24e937d559ef"><enum>(1)</enum><text display-inline="yes-display-inline">the Secretary shall give priority to projects that install or upgrade infrastructure that will enable high-performance passenger rail along new or existing rail corridors regardless of the location of such projects within the United States;</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id4e8f716f0a684a4dbfdb858feb15181e"><enum>(3)</enum><header>Cost benefit analysis</header><text>Section 24911(d)(3)(B)(i) of title 49, United States Code, as redesignated, is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="idb2f496f770ff49079cd77a79ff55e1fe"><enum>(A)</enum><text display-inline="yes-display-inline">in subclause (IV), by striking <quote>; and</quote> and inserting a semicolon;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide17b743ee8cc4e7b9b4f50f9501f1335"><enum>(B)</enum><text display-inline="yes-display-inline">in subclause (V), by inserting <quote>and</quote> after the semicolon at the end; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1eb7af66a5c84e70a2dbeca3348dff19"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id038DD4FA891443A0B35B8265CB1330FA"><subclause commented="no" display-inline="no-display-inline" id="id9f035258cdb143aaa3584ff69af2a307"><enum>(VI)</enum><text>anticipated positive impacts of the project's efforts to electrify the corridor, or make improvements to allow for electrification infrastructure (as defined in the <short-title>All Aboard Act of 2024</short-title>) in the future;</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="id415a904dcc9a49aea7f0972fc02ede8c"><enum>(b)</enum><header>Consolidated Rail Infrastructure and Safety Improvement Program</header><paragraph id="idb0c575a8863a48498f6cc26d5033b517"><enum>(1)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to the Secretary $30,000,000,000 for the 5-year period beginning on October 1, 2024, to provide grants authorized under section 22907 of title 49, United States Code.</text></paragraph><paragraph id="id1d6e721eaf484e8bb41c93741583d993"><enum>(2)</enum><header>Expanded eligibility</header><text>Section 22907(b) of title 49, United States Code, is amended by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="idC28AFEFCF183473CA2BF2C94B9E3CDF7"><paragraph commented="no" display-inline="no-display-inline" id="id20da6a4492d446c3b8c8920feb4005d0"><enum>(14)</enum><text display-inline="yes-display-inline">A class I railroad company only if—</text><subparagraph id="id7fdff2eaccd04532993b781971121071"><enum>(A)</enum><text>the entity uses the funds to install electrification infrastructure;</text></subparagraph><subparagraph id="id547f5230b8e24e74b413b88ed480adee"><enum>(B)</enum><text>the project uses project labor agreements;</text></subparagraph><subparagraph id="idcca3aaa368c64a728857d80c765f1aac"><enum>(C)</enum><text>the project includes enforceable agreements to hire from local communities; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id139aab91ccca44299207057345f7cc7b"><enum>(D)</enum><text display-inline="yes-display-inline">the entity complies with section 22404 of title 49, United States Code; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1f61f6a38e224e2985b67b51cf2b4a33"><enum>(E)</enum><text display-inline="yes-display-inline">the project is in partnership with at least 1 of the entities described in paragraphs (1) through (5).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="id9147961a811546a59dd597df176dd0c7"><enum>(3)</enum><header>Eligible activities</header><text>Section 22907(c) of title 49, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9E8FD85B24C849678B758BE5D4D49956"><paragraph commented="no" display-inline="no-display-inline" id="ida06b76557df347f988b8596548bfd9eb"><enum>(17)</enum><text>Any project to facilitate zero-emission locomotive infrastructure, including projects—</text><subparagraph id="id9e6c17b94e0c4f5e9cc10d099beed13b"><enum>(A)</enum><text>to electrify publicly-owned or Amtrak-owned routes;</text></subparagraph><subparagraph id="idd45f56d9a86c413e98c47531bca75364"><enum>(B)</enum><text>to rehabilitate or improve existing locomotives, MU locomotives, or trains (including engines) to reduce emissions;</text></subparagraph><subparagraph id="id70afd8f8f91e4dc2921bffb9c35d63dc"><enum>(C)</enum><text>to purchase railroad infrastructure and right of way from freight railroads—</text><clause commented="no" display-inline="no-display-inline" id="id22aad62018ac4c328913887b1f6bc4e7"><enum>(i)</enum><text display-inline="yes-display-inline">to expand passenger rail or regional rail; or </text></clause><clause commented="no" display-inline="no-display-inline" id="id2bef4116c4984fa197c0ad32e6270106"><enum>(ii)</enum><text display-inline="yes-display-inline">with the intent to electrify rail in the future;</text></clause></subparagraph><subparagraph id="id123ef1059bd042d99a40d0fbf03c9efa"><enum>(D)</enum><text>to build electrified rail corridors;</text></subparagraph><subparagraph id="id917259a6950c4f86918c89257ba8d8f6"><enum>(E)</enum><text>to electrify rail yards;</text></subparagraph><subparagraph id="id46aab27985c848c98be946ed18a6528c"><enum>(F)</enum><text>to lease or acquire an easement along a right-of-way for electrification;</text></subparagraph><subparagraph id="idfa7b83b54f3749d6a68e93432bd555ee"><enum>(G)</enum><text>to purchase electrification equipment and rolling stock or other zero-emission locomotives, MU locomotives,. and equipment;</text></subparagraph><subparagraph id="ideba12a78744246b0ade201ffd1c28b3b"><enum>(H)</enum><text>to ensure new electrification infrastructure is climate-resilient; and</text></subparagraph><subparagraph id="id8796b5438e5a488e98db9c982ecf0087"><enum>(I)</enum><text>to engage in robust engagement with communities impacted by any new rail infrastructure.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="id3e121a004d5d4555a05b49605fa8eb40"><enum>(4)</enum><header>Requirements</header><text>Section 22907(d) of title 49, United States Code, is amended to read as follows:</text><quoted-block id="idF216E21875714E98971552C751CC1D83" display-inline="no-display-inline" style="OLC"><subsection id="ided4ed4b87a82438093c902e2fa00fcff"><enum>(d)</enum><header>Application process</header><paragraph commented="no" display-inline="no-display-inline" id="id307908156d054aa9b97d1e93d1c43318"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall prescribe the form and manner of filing an application under this section. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id96bbe44e53b14a0eb3310dae859c3c66"><enum>(2)</enum><header>Workforce development requirements</header><text>Each application for a grant under this section shall include a transition plan that examines the impact of the proposed project on the workforce of the eligible entity and includes—</text><subparagraph id="id6E8ADF2F4F0648CB93AB2CDFD7EBFDD4" commented="no"><enum>(A)</enum><text>an identification of skills gaps, training needs, and retraining needs of the workforce;</text></subparagraph><subparagraph id="idD687D8B97842415F800833F35D091C47" commented="no"><enum>(B)</enum><text>a plan to operate and maintain infrastructure of the project using existing insourced workforce;</text></subparagraph><subparagraph id="id269A819C3E2E410FAEC6C3A31C7F84F7" commented="no"><enum>(C)</enum><text>a plan to avoid displacement of the workforce;</text></subparagraph><subparagraph id="id93F0C840B94F44FDA85435CA42923E23" commented="no"><enum>(D)</enum><text>an identification of the steps the eligible entity will take to offset any identified negative impact or potential displacement of the workforce, including how the entity will use the funds from the grant and its own funding to implement the transition plan; and</text></subparagraph><subparagraph id="id26B70BD557D643FC82C2FB5C3B0E13C9" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text>a description of how the eligible entity will work with any organizations representing the workforce to implement the transition plan. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0f32e6d106214f1e8070345c51e4f57e"><enum>(3)</enum><header>Requirements for rail electrification projects</header><text display-inline="yes-display-inline">Each application for a grant for an eligible project described under subsection (c)(17) shall include—</text><subparagraph id="idb634059a5ef74d11a06f3f372816e58a"><enum>(A)</enum><text>plans for robust engagement, early in the project planning process, with communities impacted by any new rail electrification infrastructure;</text></subparagraph><subparagraph id="ide5ebf0ccba99484ea20c995527f498c4" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>plans for hiring from local communities, displaced rail workers, tribal and indigenous communities, and environmental justice communities; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id56816b270a2b406f9e1d54500680c4d5"><enum>(C)</enum><text display-inline="yes-display-inline">a description of wage and apprenticeship requirements for individuals employed to construct, operate, and maintain rail electrification infrastructure.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="idb35b4e45faac4f29a8559d910386ab4e"><enum>(5)</enum><header>Priority for rail electrification</header><text>Section 22907(e) of title 49, United States Code, is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="idd148938a9d4a4a8c811817374bf32546"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (2) and (3) as paragraphs (3) and (4), respectively; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide67a380d1eb340308b4ba70430430290"><enum>(B)</enum><text>by inserting after paragraph (1) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5D3E70FA067C46F6A4A6D3049A3EC2B0"><paragraph commented="no" display-inline="no-display-inline" id="ida6bdc2c0daf34c8184226ee83310115d"><enum>(2)</enum><header>Priority for rail electrification</header><text>In selecting a recipient of a grant for an eligible project, the Secretary shall give priority to a proposed project that includes electrification infrastructure (as defined in the <short-title>All Aboard Act of 2024</short-title>)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idc836ff9b97284505870307877ab1d097"><enum>(A)</enum><text display-inline="yes-display-inline">in freight railyards or corridors in environmental justice communities; and</text></subparagraph><subparagraph id="idc21966c0d7154b9597af31e027170b69"><enum>(B)</enum><text>along new or existing rail corridors.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ida05e4ff42be04ae381d7bd785f486b3f"><enum>(c)</enum><header>Amtrak</header><paragraph commented="no" display-inline="no-display-inline" id="id6bb60c0b9b144c1283927c071e591535"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">There is authorized to be appropriated to the Secretary $30,000,000,000 for the 5-year period beginning on October 1, 2024, for the use of Amtrak.</text></paragraph><paragraph id="idceb437b9a8a742ae87cc72a0b4b0b018" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Climate resilience fund</header><text>Of the funds appropriated to the Secretary pursuant to paragraph (1), $5,000,000,000 shall be used for climate resiliency improvement projects to increase resiliency against climate-related changes in conditions, including flooding risk, sea level rise, extreme storms, coastal erosion, and extreme temperatures. </text></paragraph></subsection><subsection id="id0d1151dfdefd4bd7aa1f8f4b00254252"><enum>(d)</enum><header>Railroad crossing elimination program</header><text>There is authorized to be appropriated to the Secretary $10,000,000,000 for the 5-year period beginning on October 1, 2024, to provide grants under section 22909 of title 49, United States Code.</text></subsection><subsection id="idcd25e195b85042c08bfc78199014a6d9"><enum>(e)</enum><header>Restoration and enhancement program</header><text>There is authorized to be appropriated to the Secretary $1,000,000,000 for the 5-year period beginning on October 1, 2024, to provide grants under section 22908 of title 49, United States Code. </text></subsection><subsection id="id48c61651b0e2414fbbb3a517b645857c"><enum>(f)</enum><header>Grant adjustment To support rail expansion</header><text>Section 24305 of title 49, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idDAD174ABF3F24F2ABB42AE7CFF3416B8"><subsection id="id73f277a5f2674286aa0344273d9df5a4"><enum>(g)</enum><header>Use of Federal grant funds</header><text>Unless specifically prohibited by law or inconsistent with a grant agreement pursuant to which the relevant funding was provided, Amtrak may use grant funding received from the Federal Government to cover any non-Federal share of costs required to be paid under grant programs authorized in title 23 or 49, United States Code, or in other Federal laws, to the extent necessary to advance critical intercity passenger rail investments and further the achievement of Amtrak’s mission.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section commented="no" display-inline="no-display-inline" id="idc44c29726a4e401aba7895c06cf82a7f"><enum>6.</enum><header>Rail air pollution grant program</header><subsection commented="no" display-inline="no-display-inline" id="id13d9966180ea4c11be3a85cb429a044a"><enum>(a)</enum><header>In general</header><text>The Administrator of the Environmental Protection Agency shall establish a program to provide grants under sections 103 and 105 of the Clean Air Act (42 U.S.C. 7403 and 7405) to address the air pollution generated by railyards. </text></subsection><subsection commented="no" display-inline="no-display-inline" id="id907e24adfdff49c8918eaa04d326f873"><enum>(b)</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to the Administrator of the Environmental Protection Agency $500,000,000 for the 5-year period beginning on October 1, 2024, to provide grants under section 105 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7405">42 U.S.C. 7405</external-xref>) to carry out subsection (a). </text></subsection></section><section commented="no" display-inline="no-display-inline" id="idb0f5e1e5972b4c1484a4bd3f62a9157e"><enum>7.</enum><header>Labor protections and workforce development</header><subsection id="id81068d7a77d0425abc32b947a850f76c"><enum>(a)</enum><header>Grant conditions</header><text>Subsections (a), (b), (c), and (d) of section 22905 of title 49, United States Code, shall apply to any grant awarded pursuant to this Act, or funds provided under this Act, as if the grant or funds were awarded under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/229">chapter 229</external-xref> of title 49, United States Code. The conditions of section 22404 of title 49, United States Code, shall apply to any grant awarded pursuant to this Act.</text></subsection><subsection id="idc108d25f2f4e4544bceaa436ccb39438"><enum>(b)</enum><header>Other requirements</header><paragraph commented="no" display-inline="no-display-inline" id="id935dfd5327bf4eb290d1a4f107f443e8"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">All laborers and mechanics employed by contractors or subcontractors in the performance of construction, alternation, or repair work carried out, in whole or in part, with assistance made available under this Act shall be paid wages at rates not less than those prevailing on projects of a character similar in the locality as determined by the Secretary of Labor in accordance with subchapter IV of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/40/31">chapter 31</external-xref> of title 40, United States Code. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfdbaeeb264f645f5ae23ef5819e0e309"><enum>(2)</enum><header>Authority</header><text display-inline="yes-display-inline">With respect to labor standards specified in paragraph (1), the Secretary of Labor shall have the authority and functions set forth in Reorganization Plan Numbered 14 of 1950 (64 Stat. 1267; 5 U.S.C. App.) and sections 3145 of title 40, United States Code. </text></paragraph></subsection><subsection id="id788b97e4e3a4469b9f392e29eab2025c"><enum>(c)</enum><header>Rail workforce training centers</header><paragraph id="id5294cbaaa8654d11880a96442cc47189"><enum>(1)</enum><header>Passenger rail workforce training center</header><subparagraph commented="no" display-inline="no-display-inline" id="id4941932df1384f45b9be5adcdffc3e97"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">There is established within the consolidated workforce training program—</text><clause id="id01a80efb76d64d1f969e56cc872212bb"><enum>(i)</enum><text>a center, which shall be known as the <quote>Passenger Rail Workforce Training Center</quote>, to meet the needs of the passenger rail systems workforce through standards-based training relating to relevant maintenance and operations occupations; and</text></clause><clause id="idf6246dd7aa1246b1a4de42f8017236da"><enum>(ii)</enum><text>expand workforce development efforts in partnership with organized labor including, apprenticeship training programs.</text></clause></subparagraph><subparagraph id="idc5d33fb8c4894118aff2fccf31ed8996"><enum>(B)</enum><header>Duties</header><text display-inline="yes-display-inline">The Passenger Rail Workforce Training Center, in cooperation with nonprofit labor organizations and Amtrak, shall develop and carry out training and educational programs for rail employees serving in the passenger rail workforce.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id62e62302a81f48babd0f802831d5f994"><enum>(2)</enum><header>Freight rail workforce training center</header><text>The Administrator, in partnership with rail carriers and nonprofit labor organizations, shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="id325d6622a0cf4cd0bbe5dbdce7488c67"><enum>(A)</enum><text display-inline="yes-display-inline">establish a consolidated workforce training program for freight railroad personnel;</text></subparagraph><subparagraph id="id08edfcd2b0c142da8b73eb4a0f9a4b8d"><enum>(B)</enum><text>establish a center, which shall be known as the <quote>Freight Rail Workforce Training Center</quote>, to meet the needs of the freight rail systems workforce through standards-based training relating to relevant maintenance and operations occupations; and</text></subparagraph><subparagraph id="id48bcae0ab775408790f527175eb75ef9"><enum>(C)</enum><text>expand, in partnership with organized labor, workforce development efforts, including apprenticeship training programs. </text></subparagraph></paragraph><paragraph id="id2be6cdaa4c85460690f0b02e15c87713"><enum>(3)</enum><header>Training and educational program inclusions</header><text>The training and educational programs developed pursuant to paragraphs (1) and (2) may include courses in recent developments, techniques, and procedures relating to—</text><subparagraph id="idd5c7dfe3648b4902a61d3e0026a86c88"><enum>(A)</enum><text>developing consensus national training standards, in partnership with industry stakeholders, for key rail occupations with demonstrated skill gaps;</text></subparagraph><subparagraph id="id1d4656d876804b708ddcd6adb5a415dc"><enum>(B)</enum><text>establishing regional, State, and local rail training partnerships—</text><clause id="id678854810d984ef398d657225047504d"><enum>(i)</enum><text>to identify and address workforce skill gaps; and</text></clause><clause id="id686e5a81b2534541b46aa8245ddf000d"><enum>(ii)</enum><text>to develop skills needed for—</text><subclause id="idca6b164c42014b17953569774f21cbca"><enum>(I)</enum><text>delivering quality rail service; and</text></subclause><subclause id="id621bc8b980d94ccf93441dfcabadbe90"><enum>(II)</enum><text>supporting employee career advancement;</text></subclause></clause></subparagraph><subparagraph id="id5952289b1d92402c9c28ae5b1ad3f402"><enum>(C)</enum><text>developing programs for the training of frontline workforce, instructors, mentors, and labor-management partnership representatives, in the form of classroom, hands-on, on-the-job, and internet web-based training, to be delivered—</text><clause id="idc45e63d11892402e9e724818584f1e22"><enum>(i)</enum><text>at a national center;</text></clause><clause id="id2178b227a2de49aaa29a99b6ce6fce1f"><enum>(ii)</enum><text>regionally; or</text></clause><clause id="id7115155faabb4881bf6f8078497a8ee6"><enum>(iii)</enum><text>at an individual rail carrier;</text></clause></subparagraph><subparagraph id="id911c01b8f113400d82dea3af17a798c5"><enum>(D)</enum><text>developing training programs for skills relating to existing and emerging rail technologies, such as zero-emission locomotives and trains and zero-emission locomotive infrastructure;</text></subparagraph><subparagraph id="id667ff8a62026432f8c27f6397b560360"><enum>(E)</enum><text>developing improved capacity for safety, security, and emergency preparedness in rail systems and the industry as a whole through—</text><clause id="id6b35fb71316e4bcea9702030d95edd30"><enum>(i)</enum><text>developing the role of the rail workforce in establishing and sustaining safety culture and safety systems in rail; and</text></clause><clause id="id4480db9d88254744b66a015171f12cf8"><enum>(ii)</enum><text>training to address rail workforce roles in promoting health and safety for rail workers, communities adjacent to railroad infrastructure and railyards; and</text></clause></subparagraph><subparagraph id="id4edc564c07f24538a07fd974cadf58f4"><enum>(F)</enum><text>developing rail carrier capacity for career pathway partnerships with schools and other community organizations for recruiting and training underrepresented populations as successful rail employees who can develop careers in the rail industry.</text></subparagraph></paragraph><paragraph id="idaae6052a496f4b4eae67045d996123c7"><enum>(4)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Administrator $500,000,000 for the 5-year period beginning on October 1, 2024, to carry out the Rail Workforce Training Program authorized under this subsection. </text></paragraph></subsection></section></legis-body></bill>
