which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title XVI of the Social Security Act to provide that the supplemental security income benefits of adults with intellectual or developmental disabilities shall not be reduced by reason of marriage.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H7CE64EAD98544749BD0F66C2FA8346D6"><section section-type="section-one" id="H3DC212D29D2F45868CF131FFFF3444E1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Eliminating the Marriage Penalty in SSI Act</short-title></quote> or the <quote><short-title>EMPSA Act</short-title></quote>.</text></section><section id="H5EE300D473E14DB683CFFB568F49BC3D"><enum>2.</enum><header>Supplemental security income benefits</header><subsection id="HAB80EDCB34C74948B698A7350B85C6C7"><enum>(a)</enum><header>Eligibility for benefits</header><text>Section 1611(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1382">42 U.S.C. 1382(a)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id226FDA8C34BF4C9A82CB735B36A06C8C"><paragraph id="HD29A2E2CE27E4C4384BEDFED7A14E198" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">Notwithstanding paragraphs (1) and (2), each individual—</text><subparagraph commented="no" display-inline="no-display-inline" id="id99d11bf2043146a6b94138687a98c1d3"><enum>(A)</enum><text display-inline="yes-display-inline">who has attained 18 years of age, </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddf62e506815a4de4a2eb223a99a68b2d"><enum>(B)</enum><text display-inline="yes-display-inline">who is diagnosed with an intellectual or developmental disability, </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfdfd9772b59f46a89215ae2be51c590d"><enum>(C)</enum><text display-inline="yes-display-inline">whose income, other than income excluded pursuant to section 1612(b), is at a rate of not more than the applicable amount determined under paragraph (1)(A), and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id525ecb76abd74cfc92158d9beab6a282"><enum>(D)</enum><text display-inline="yes-display-inline">whose resources, other than resources excluded pursuant to section 1613(a), are not more than the applicable amount determined under paragraph (3)(B),</text></subparagraph><continuation-text continuation-text-level="paragraph">shall be an eligible individual for purposes of this title.</continuation-text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HE429702B3384436EB5510B5ED8A6CBB1"><enum>(b)</enum><header>Amount of benefit</header><text>Section 1611(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1382">42 U.S.C. 1382(b)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H52DCE2EE54A34E85B884B3F2EC638E44"><paragraph id="HCC21BE2804C148BB808CF762A3C86C31" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">Notwithstanding paragraphs (1) and (2), the benefit under this title for an individual described in subsection (a)(4), whether or not the individual has an eligible spouse, shall be payable at the rate in effect for purposes of paragraph (1), reduced by the amount of income, not excluded pursuant to section 1612(b), of such individual.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H61CE269AA99D48AA8AF60FA8085FA22D"><enum>(c)</enum><header>Income and resource deeming rules</header><text>Section 1614(f) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1382c">42 U.S.C. 1382c(f)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H6008EB409A4F4F8EA82D73D37428F338"><paragraph id="HF134194C1E24440D9D745A72EEBEA814" indent="up1"><enum>(5)</enum><text>Notwithstanding paragraph (1), for purposes of determining eligibility for, and the amount of, benefits for an individual described in section 1611(a)(4) who is married, such individual's income and resources shall be deemed to not include any income or resources of such spouse.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="iddfa1183bbf224aaf94b35be230980a6c"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall apply to benefits payable for months that begin more than 180 days after the date of enactment of this Act. </text></subsection></section></legis-body></bill>
