which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To increase the rate of duty on garlic originating from the People’s Republic of China.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop Eating Waste And Guarantee Excellence for Garlic Assurance and Regulatory Legislation to Inhibit Chinese Imports Tariff Act of 2024</short-title></quote> or the <quote><short-title>SEWAGE GARLIC Imports Tariff Act of 2024</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="idd7eb78903090437c85e1d7b3e0da13d3"><enum>2.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that imports of garlic originating from the People's Republic of China, whether fresh or preserved, should be prohibited. </text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="ida3a9f0c0abde49e695c6adf6d02cbb1e"><enum>3.</enum><header>Duty increase on garlic from the People's Republic of China</header><subsection commented="no" display-inline="no-display-inline" id="id71ce83e71bfa414daa0c060e86099473"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text>An article described in subsection (b) shall be subject to a rate of duty of $100 per kilogram.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id5aaecd8cea154e8faf25f115dc9e4d4e"><enum>(b)</enum><header>Articles described</header><text>An article described in this subsection is any of the following originating from the People's Republic of China:</text><paragraph commented="no" display-inline="no-display-inline" id="id43093dea1a6f4027a674efbe4e0943ea"><enum>(1)</enum><text>Fresh or chilled garlic classified under subheading 0703.20.00 of the Harmonized Tariff Schedule of the United States (in this subsection referred to as the <quote>HTS</quote>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idce99ed0a4031477c91cca484d6a453a7"><enum>(2)</enum><text>Frozen garlic classified under statistical reporting number 0710.80.9755 of the HTS.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id810c8e579def44108ce5ebbad2f20634"><enum>(3)</enum><text>Dried or dehydrated garlic classified under subheading 0712.90.40 of the HTS.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id50bdf6df8aa34dcb9395af52f5c797fc"><enum>(4)</enum><text>Garlic, prepared or preserved otherwise than by vinegar or acetic acid, classified under subheading 2004.90.85 or 2005.99.97 of the HTS.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id24a4899b3fd64879862f7d593b64d833"><enum>(5)</enum><text>Essential oil of garlic classified under statistical reporting number 3301.29.5115 of the HTS.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id2f9553c32a3d4fa48d7af0445f285335"><enum>(c)</enum><header>Applicability</header><text>Subsection (a) applies to articles entered, or withdrawn from warehouse for consumption, on or after the date that is 15 days after the date of the enactment of this Act. </text></subsection></section><section commented="no" display-inline="no-display-inline" id="id31dd6c611154467895ca626bb6ec8c85"><enum>4.</enum><header>Availability of amounts for grant program for domestic growers of garlic</header><subsection commented="no" display-inline="no-display-inline" id="id297f254a083547f398837354fb8bda58"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">There is established in the Treasury of the United States a trust fund, consisting of—</text><paragraph commented="no" display-inline="no-display-inline" id="idf3f72299d61345e2acfebd08414594d1"><enum>(1)</enum><text display-inline="yes-display-inline">amounts transferred to the trust fund under subsection (b); and </text></paragraph><paragraph id="idc8c360ad03f94bf3a73a7d8713972f01"><enum>(2)</enum><text>any amounts that may be credited to the trust fund under subsection (c).</text></paragraph></subsection><subsection id="id21a0adae976e46e48c2a8cc0f47e00eb"><enum>(b)</enum><header>Transfer of amounts</header><paragraph id="id5b82a22d91744e26b36f2dd19577dcfa"><enum>(1)</enum><header>In general</header><text>The Secretary of the Treasury shall transfer to the trust fund established under subsection (a), from the general fund of the Treasury, for fiscal year 2025 and each fiscal year thereafter, an amount equivalent to the amount received into the general fund during that fiscal year and attributable to duties imposed under section 3.</text></paragraph><paragraph id="ida4ab01d428344abba56e51841caf769d"><enum>(2)</enum><header>Frequency of transfers</header><text>The Secretary shall transfer amounts required by paragraph (1) to be transferred to the trust fund established under subsection (a) not less frequently than quarterly.</text></paragraph></subsection><subsection id="id54f91d5bc3974a8b99c946c05aed56c7"><enum>(c)</enum><header>Investment of amounts</header><paragraph id="id2cda1c3a04134159b447ba881883bf11"><enum>(1)</enum><header>Investment of amounts</header><text>The Secretary shall invest such portion of the trust fund established under subsection (a) as is not required to meet current withdrawals in interest-bearing obligations of the United States or in obligations guaranteed as to both principal and interest by the United States.</text></paragraph><paragraph id="idbc3332b1fd5941f69eb8944ba65e9854" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Interest and proceeds</header><text>The interest on, and the proceeds from the sale or redemption of, any obligations held in the trust fund established under subsection (a) shall be credited to and form a part of the trust fund.</text></paragraph></subsection><subsection id="id71a8c74cbbcb4f609430c2b1c4da52b5"><enum>(d)</enum><header>Availability of funds for specialty crop block grants</header><paragraph id="id1641776098994EB890A47C785EAE9382"><enum>(1)</enum><header>In general</header><text>Amounts in the trust fund established under subsection (a) shall be available, without further appropriation, to the Secretary of Agriculture to make grants to States under the specialty crop block grant program established under section 101 of the Specialty Crops Competitiveness Act of 2004 (<external-xref legal-doc="public-law" parsable-cite="pl/108/465">Public Law 108–465</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/7/1621">7 U.S.C. 1621</external-xref> note), to be used by State departments of agriculture to support domestic producers of garlic.</text></paragraph><paragraph id="id40284D7E6B134D368D328E676FF15F57"><enum>(2)</enum><header>Determination</header><text>Notwithstanding subsections (b) and (c) of section 101 of the Specialty Crops Competitiveness Act of 2004 (<external-xref legal-doc="public-law" parsable-cite="pl/108/465">Public Law 108–465</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/7/1621">7 U.S.C. 1621</external-xref> note), the Secretary of Agriculture shall determine the recipients and amounts of grants under paragraph (1) in such manner as the Secretary of Agriculture determines to be appropriate to support domestic producers of garlic.</text></paragraph><paragraph id="id6CAC10F29D424C00BB92A6FD153C3043"><enum>(3)</enum><header>Effect</header><text>Nothing in this subsection shall affect the amount of a grant made to any State under section 101 of the Specialty Crops Competitiveness Act of 2004 (<external-xref legal-doc="public-law" parsable-cite="pl/108/465">Public Law 108–465</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/7/1621">7 U.S.C. 1621</external-xref> note) using funds made available under subsection (l) of that section, as determined under subsections (b) and (c) of that section.</text></paragraph></subsection></section></legis-body></bill>
