<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>2d Session</session><legis-num>S. 5557</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20241217" legis-day="20241216">December 17 (legislative day, December 16), 2024</action-date><action-desc><sponsor name-id="S287">Mr. Cornyn</sponsor> (for himself and <cosponsor name-id="S355">Mr. Cruz</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require identification in medical records of the Department of Defense of the affiliation of certain non-Department of Defense health care providers, and for other purposes.</official-title></form><legis-body><section id="id9162ce0d90574c5b9abb817e373585c6" section-type="section-one"><enum>1.</enum><header>Identification in patient medical records of affiliation of certain non-Department of Defense health care providers</header><subsection commented="no" display-inline="no-display-inline" id="id90db098a4dc34f859be31da4f38d2d73"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/55">Chapter 55</external-xref> of title 10, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/10/1091">section 1091</external-xref> the following new section: </text><quoted-block style="USC" display-inline="no-display-inline" id="H7D3D3D05EAC24D3CBEFFD9A35ABD7A92"><section commented="no" display-inline="no-display-inline" id="H11BF720EF2894238B561DC1DC737A2A8"><enum>1091a.</enum><header>Identification in patient medical records of affiliation of certain non-Department of Defense health care providers</header><subsection id="H374FC226015846388B284258E018583B"><enum>(a)</enum><header>Requirement</header><text>The Secretary of Defense shall ensure that medical records of the Department of Defense include the organizational affiliation of any independent health care contractor identified in such medical records.</text></subsection><subsection id="HF3BE0556642E4FE69A57732952D12AFD" commented="no"><enum>(b)</enum><header>Independent health care contractor defined</header><text display-inline="yes-display-inline">In this section, the term <term>independent health care contractor</term> means a health care provider who meets the following criteria:</text><paragraph id="HBF2AE038059A49FB8E91F8D999A4BDD6" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">The health care provider is a nonpersonal services contractor, or an employee of such a contractor, pursuant to subpart 37.4 of the Federal Acquisition Regulation, or other applicable regulation.</text></paragraph><paragraph id="H915459ADCD104AFCAFA9D8AE27738D2B" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">The health care provider provides health care services under this chapter in any military medical treatment facility (as defined in section 1073c(i) of this title) or other location under the jurisdiction of the Secretary of Defense, including an operational clinic.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idae3fee4183db4be3b959d52c55fac00f" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by inserting after the item relating to section 1091 the following new item:</text><quoted-block style="USC" id="id61cb8369-7d61-4d47-bb4a-d64ae0ba8a90"><toc><toc-entry level="section">1091a.
