which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To extend the statute of limitations for offenses relating to pandemic-era programs to be 10 years.</official-title></form><legis-body><section id="id260e6dd82ab74813ba4592ba4de49199" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fraudulent Covid Funds Recovery Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id0a133e17327d43c5af7d8791fbcbc52e"><enum>2.</enum><header display-inline="yes-display-inline">Statute of limitations for offenses relating to pandemic-era programs</header><subsection commented="no" display-inline="no-display-inline" id="id5db26d7209d64c81bee97e092a99e411"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section— </text><paragraph commented="no" display-inline="no-display-inline" id="idc774e8b938f74b208306c5a3b644a3f5"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>pandemic-era law</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="ida43198554db1454f9f2b4f53e9b735b2"><enum>(A)</enum><text>the Coronavirus Preparedness and Response Supplemental Appropriations Act, 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/123">Public Law 116–123</external-xref>; 134 Stat. 146); </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4f1bcc84f7564164916b2e51bce0a1d8"><enum>(B)</enum><text>the Families First Coronavirus Response Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/127">Public Law 116–127</external-xref>; 134 Stat. 177); </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idebc393e5c8df4b6e93820fc78d6ac2cd"><enum>(C)</enum><text>the CARES Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/136">Public Law 116–136</external-xref>; 134 Stat. 281); </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id62f06f4c0723475887089467ce718f90"><enum>(D)</enum><text>the Paycheck Protection Program and Health Care Enhancement Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/139">Public Law 116–139</external-xref>; 134 Stat. 620); </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2fee8535dd9c43749a004335bf32bac7"><enum>(E)</enum><text>divisions M and N of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>; 134 Stat. 1182); </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1f29d1b292dd4e0e9ee7bf0e50e43c93"><enum>(F)</enum><text display-inline="yes-display-inline">the American Rescue Plan Act of 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/117/2">Public Law 117–2</external-xref>; 135 Stat. 4); or</text></subparagraph><subparagraph id="id436570bb29144fe68c66d304eaa58a2c" commented="no" display-inline="no-display-inline"><enum>(G)</enum><text>an amendment made by a law described in subparagraphs (A) through (F); and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbd5208b80ffe4dfeb5c4b1c1d9841976"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>pandemic-era program offense</term> means an offense involving conduct that relates to or involves— </text><subparagraph commented="no" display-inline="no-display-inline" id="id315182b4bf514431bc61c353fba4199c"><enum>(A)</enum><text display-inline="yes-display-inline">a program, project, or activity that was authorized or established by, or was carried out under, a pandemic-era law; or </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id48a8baf45f5f466480783cf24334f87a"><enum>(B)</enum><text display-inline="yes-display-inline">funding provided under a pandemic-era law. </text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ide82c787c25b94abd9f05ba17a57ab0d8"><enum>(b)</enum><header>Extension of statute of limitations</header><text>No person shall be prosecuted, tried, or punished for any pandemic-era offense unless the indictment is found or the information is instituted— </text><paragraph commented="no" display-inline="no-display-inline" id="idbb7ccdf4db9e4d018b833edafd3a6ecb"><enum>(1)</enum><text display-inline="yes-display-inline">notwithstanding section 3282(a) of title 18, United States Code, within 10 years after such offense shall have been committed; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id878099869a2f44c19801d313abe66b55"><enum>(2)</enum><text>within such longer period of years after such offense shall have been committed as is otherwise provided by law. </text></paragraph></subsection></section></legis-body></bill>
