which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To reform the inspection process of housing assisted by the Department of Housing and Urban Development, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>HUD Inspection Reform and Capital Improvement Act of 2023</short-title></quote>.</text></section><section id="id894DEB21BF594A8C939CC7CED6B693F7"><enum>2.</enum><header>Definition</header><text display-inline="no-display-inline">In this Act, the term <term>Secretary</term> means the Secretary of Housing and Urban Development.</text></section><section section-type="subsequent-section" id="H7C0A7E8424C94CC1AB8874570BFE4C7F"><enum>3.</enum><header>Reduction in grade or pay or removal for misconduct or performance of employees of the Department of Housing and Urban Development</header><subsection id="HFE507CDD3DEB4123B854422177302601"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 7(c) of the Department of Housing and Urban Development Act (<external-xref legal-doc="usc" parsable-cite="usc/42/3535">42 U.S.C. 3535(c)</external-xref>) is amended—</text><paragraph id="idDA6BEFDC97BE45DE8682EAD1663A01DD"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>The Secretary is authorized</quote> and inserting the following: “<header-in-text level="subsection" style="OLC">Employment, compensation, authority, and duties of personnel</header-in-text>.—</text><quoted-block style="OLC" display-inline="no-display-inline" id="id498D9E0FF957498EA326DCA0C446F75F"><paragraph id="idAB1D54E0EBEE48BD8B561F9EADD31846"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary is authorized</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="idA1C56F715A574CE3A8F7BCE207A1A5CF"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H1FDEF6F2594F477E8832DE9CDC92CF60"><paragraph id="HA4070CD84578429691A901509CBB23BC"><enum>(2)</enum><header>Reduction in grade or pay or removal for misconduct or performance of employees</header><subparagraph id="id0D7B0F725FD945D3B46752DD79800502"><enum>(A)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this paragraph—</text><clause id="HD4A0801BE87C43A9AB7971EF8A3A71EF"><enum>(i)</enum><text>the term <term>covered employee</term>—</text><subclause id="id92EB6704230F47D4AE9F26521CEBBB0F"><enum>(I)</enum><text>means an individual holding a position in the civil service in the Department; and</text></subclause><subclause id="id43BB8D0D99264160889283AA4191B455"><enum>(II)</enum><text>does not include any individual—</text><item id="H86EE858E108244DCA96A944B49662445"><enum>(aa)</enum><text display-inline="yes-display-inline">holding in a position described under sections 5312 through 5316 of title 5, United States Code (relating to the Executive Schedule);</text></item><item id="HF55F4FC887D14816B5D929B92BB9C667"><enum>(bb)</enum><text display-inline="yes-display-inline">holding a position as a limited term appointee, limited emergency appointee, or noncareer appointee in the Senior Executive Service, as defined under paragraphs (5), (6), and (7), respectively, of section 3132(a) of title 5, United States Code; or</text></item><item id="HD2A5F1FACA814CBDB179BFFF9A7522FE"><enum>(cc)</enum><text display-inline="yes-display-inline">holding a position of a confidential or policy-determining character under schedule C of subpart C of part 213 of title 5, Code of Federal Regulations;</text></item></subclause></clause><clause id="H47327DBAE9424674AE455229CD7FF4A7"><enum>(ii)</enum><text display-inline="yes-display-inline">the term <term>grade</term> means a level of classification under a position classification system;</text></clause><clause id="HB91CEF45AD884D93A1B269A8B05B1BE4"><enum>(iii)</enum><text display-inline="yes-display-inline">the term <term>misconduct</term> includes neglect of duty, malfeasance, or failure to accept a directed reassignment or to accompany a position in a transfer of function; and</text></clause><clause id="HC0CCAD96C3904AB08B9884AEC8B60DC8"><enum>(iv)</enum><text display-inline="yes-display-inline">the term <term>pay</term> means the rate of basic pay fixed by law or administrative action for the position held by a covered employee.</text></clause></subparagraph><subparagraph id="H6B75DD27AB7E4596847E7F3A18B6CC85"><enum>(B)</enum><header>Actions covered</header><text display-inline="yes-display-inline">This paragraph—</text><clause id="idACD3EA6DDE184BE49F0CBFA78835AA3F"><enum>(i)</enum><text display-inline="yes-display-inline">applies to a reduction in grade or pay or removal; and</text></clause><clause id="id1CC7F868788343D991CA0F77A7EB531B"><enum>(ii)</enum><text display-inline="yes-display-inline">does not apply to—</text><subclause id="H7C48F474A5C6455DB0DFE94FF7F78F7C"><enum>(I)</enum><text>a reduction in grade or pay or removal under section 7512 of title 5, United States Code;</text></subclause><subclause id="H380273E442234058B2FCEDF94D453A92"><enum>(II)</enum><text>a reduction in grade or pay or removal under section 7521 of title 5, United States Code;</text></subclause><subclause id="HE92C17E9C01247789F60F267743AFB60"><enum>(III)</enum><text display-inline="yes-display-inline">a removal under section 7532 of title 5, United States Code; or</text></subclause><subclause id="H78DEDC461FAC4B3D9B5288A1F230D773"><enum>(IV)</enum><text>a removal under section 3592, 3595, or 7543 of title 5, United States Code.</text></subclause></clause></subparagraph><subparagraph id="H1D0AECFC82EA4A49B15D60609F29326A"><enum>(C)</enum><header>Cause and procedure</header><clause id="H0629A8446F344CF68A3165E30A465162"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, under regulations prescribed by the Office of Personnel Management, the Secretary may, if the Secretary determines that the misconduct or performance of a covered employee warrants such action—</text><subclause id="H5B69003EF5A04A5CAC11ED8F89C9F858"><enum>(I)</enum><text>remove the covered employee from the civil service;</text></subclause><subclause id="HAEE25124352343B0A50DFB43C00F981F"><enum>(II)</enum><text display-inline="yes-display-inline">reduce the grade of the covered employee; or</text></subclause><subclause id="HF380815DF0C14A68A3CE63337BAFEFB0"><enum>(III)</enum><text display-inline="yes-display-inline">reduce the pay of the covered employee.</text></subclause></clause><clause id="H833975645ECD47F2AB800C0154D9A62A"><enum>(ii)</enum><header>Reduction in grade</header><text display-inline="yes-display-inline">A covered employee subject to a reduction in grade under clause (i)(II) shall, beginning on the date on which the reduction takes effect, receive the annual rate of pay applicable to the reduced grade.</text></clause><clause id="HA6F506E140A9439B8F692DC7C0B67008"><enum>(iii)</enum><header>Appeal procedures</header><subclause id="idCA01191EADC248DEB17F2D48E6534924"><enum>(I)</enum><header>In general</header><text>Subject to subclause (II) and clause (iv), any reduction in grade or pay or removal under this paragraph may be appealed to the Merit Systems Protection Board under section 7701 of title 5, United States Code.</text></subclause><subclause id="HCF23E884A53046B1A0271B6D141A1AA6"><enum>(II)</enum><header>Time for appeal</header><text display-inline="yes-display-inline">An appeal under subclause (I) may only be made if such appeal is made not later than 7 days after the date of such reduction in grade or pay or removal.</text></subclause></clause><clause id="H23F0C7BAC7454855A8C6D164B05CAE9D"><enum>(iv)</enum><header>Review on appeal</header><subclause id="id89F154EAF2F4442AA7975D9F5A55085F"><enum>(I)</enum><header>In general</header><text>Upon receipt of an appeal under clause (iii), the Merit Systems Protection Board shall refer the appeal to an administrative law judge pursuant to section 7701(b)(1) of title 5, United States Code. The administrative law judge shall expedite any such appeal under such section and, in any such case, shall issue a decision not later than 45 days after the date on which the Board receives the appeal.</text></subclause><subclause id="H18D03B1C94694536A34B1DC5348207A6"><enum>(II)</enum><header>Information and assistance</header><text display-inline="yes-display-inline">To the maximum extent practicable, the Secretary shall provide to the Merit Systems Protection Board, and to any administrative law judge to whom an appeal under this paragraph is referred, such information and assistance as may be necessary to ensure an appeal under this paragraph is expedited.</text></subclause><subclause id="H397C1625047F429487FD1C18217A81D4"><enum>(III)</enum><header>Finality</header><text display-inline="yes-display-inline">Not­with­stand­ing any other provision of law, including section 7703 of title 5, United States Code, the decision of an administrative law judge under subclause (I) shall be final and shall not be subject to any further appeal.</text></subclause><subclause commented="no" id="H6B7491A03A1344B0B0078C37BE44BED0"><enum>(IV)</enum><header>Delayed decision</header><item commented="no" id="idAE6C7AADB80E45078A997DD2B51DEE37"><enum>(aa)</enum><header>In general</header><text display-inline="yes-display-inline">In any case in which the administrative law judge cannot issue a decision in accordance with the 45-day requirement under subclause (I), the reduction in grade or pay or removal shall be final.</text></item><item commented="no" id="id44D46CEBA1B24C989932BE909D4B33B7"><enum>(bb)</enum><header>Explanation</header><text display-inline="yes-display-inline">In a case described in item (aa), the Merit Systems Protection Board shall, not later than 14 days after the date on which the reduction in grade or pay or removal becomes final, submit to Congress a report that explains the reasons why a decision was not issued in accordance with that requirement.</text></item></subclause><subclause id="HA8B0428C3C404D069777B71DC05AC96C"><enum>(V)</enum><header>No stays</header><text display-inline="yes-display-inline">The Merit Systems Protection Board or administrative law judge may not stay any reduction in grade or pay or removal action under this paragraph.</text></subclause><subclause id="HEF07EF881D344601A634742C8BFC134E"><enum>(VI)</enum><header>Effect of appeal of removal</header><text display-inline="yes-display-inline">During the period beginning on the date on which a covered employee appeals a removal from the civil service under this paragraph and ending on the date on which the administrative law judge issues a final decision on such appeal, the covered employee may not receive any pay, awards, bonuses, incentives, allowances, differentials, student loan repayments, special payments, or benefits.</text></subclause></clause><clause id="H335DB4374514426186C126779529C876"><enum>(v)</enum><header>Whistleblower protection</header><text display-inline="yes-display-inline">In the case of a covered employee seeking corrective action (or on behalf of whom corrective action is sought) from the Office of Special Counsel based on an alleged prohibited personnel practice described in section 2302(b) of title 5, United States Code, the Secretary may not reduce the grade or pay or remove the covered employee under this paragraph without the approval of the Special Counsel under section 1214(f) of title 5, United States Code.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H8BF29AA085914F29A09912BDC4B23156"><enum>(b)</enum><header>Application</header><text display-inline="yes-display-inline">The authority under paragraph (2) of section 7(c) of the Department of Housing and Urban Development Act, as added by subsection (a), shall apply to any covered employee (as defined in such paragraph) appointed before, on, or after the date of enactment of this Act.</text></subsection><subsection id="HEFF1CDCBF79F4B76A827759C2853294E"><enum>(c)</enum><header>Conforming amendments</header><text display-inline="yes-display-inline">Title 5, United States Code, is amended—</text><paragraph id="H3812A924A10D4A92BA693ED66413838A"><enum>(1)</enum><text>in section 4303(f)—</text><subparagraph id="H121FB0DA865C4A9685DF0BA6CE9FD2A6"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (3), by striking <quote>or</quote> at the end;</text></subparagraph><subparagraph id="H09B23B6CC7C14DCC85ECB34B3433E4E7"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (4), by striking the period at the end and inserting <quote>, or</quote>; and</text></subparagraph><subparagraph id="H146EB46241DC4514A3D7FA794F2635FB"><enum>(C)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="HC7531B3B24794C13BC9127D6E2C38C31"><paragraph id="H7A38F084DD854FE78D83415A3D693F4A"><enum>(5)</enum><text display-inline="yes-display-inline">the reduction in grade or removal of an employee under section 7(c)(2) of the Department of Housing and Urban Development Act (<external-xref legal-doc="usc" parsable-cite="usc/42/3535">42 U.S.C. 3535(c)(2)</external-xref>).</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H20920E15C68B44B7B76E99EAE1DFDEE2"><enum>(2)</enum><text>in section 7512—</text><subparagraph id="HB6F8CE9F5EC24E9C84EF0F22F1283349"><enum>(A)</enum><text>in subparagraph (E), by striking <quote>, or</quote> and inserting a comma;</text></subparagraph><subparagraph id="HC5747AE24DBE46109D6E99626521A9CB"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (F), by striking the period at the end and inserting <quote>, or</quote>; and</text></subparagraph><subparagraph id="H14CD7E234C6A44EB9AD8601A04A245AA"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H2B1A9EB4E43549F8B55223F6724F63D4"><subparagraph id="H554D9373C2BA43BFA585F16C0834570F" indent="up1"><enum>(G)</enum><text display-inline="yes-display-inline">a reduction in grade or pay or removal under section 7(c)(2) of the Department of Housing and Urban Development Act (<external-xref legal-doc="usc" parsable-cite="usc/42/3535">42 U.S.C. 3535(c)(2)</external-xref>).</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HBA3B1EE6FF914C968FC7BE0F50638FFE"><enum>(3)</enum><text>in section 7521(b), in the matter following paragraph (5)—</text><subparagraph id="HA1A2964D1ADB4ED0AAF8F562B8EE2AC0"><enum>(A)</enum><text>in subparagraph (B), by striking <quote>or</quote> at the end;</text></subparagraph><subparagraph id="H5AF56D0B21624788990E6F543FB07370"><enum>(B)</enum><text>in subparagraph (C), by striking the period at the end and inserting <quote>; or</quote>; and</text></subparagraph><subparagraph id="H3FC2D14DE4D244129C820969A936B68C"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HBE52A1264E084253BDD60693B7B2E071"><subparagraph id="H6362CE67D3094890B8ABEB97B44EF8E2" indent="up1"><enum>(D)</enum><text display-inline="yes-display-inline">a reduction in grade or pay or removal under section 7(c)(2) of the Department of Housing and Urban Development Act (<external-xref legal-doc="usc" parsable-cite="usc/42/3535">42 U.S.C. 3535(c)(2)</external-xref>).</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HEC8EC12F4822421C9208BBAB5C2F4B43"><enum>(4)</enum><text display-inline="yes-display-inline">in section 7542, by striking <quote>or to a removal under section 3592 or 3595 of this title</quote> and inserting <quote>to a removal under section 3592 or 3595 of this title, to an action under section 713 of title 38, or to a reduction in grade or pay or removal under section 7(c)(2) of the Department of Housing and Urban Development Act (<external-xref legal-doc="usc" parsable-cite="usc/42/3535">42 U.S.C. 3535(c)(2)</external-xref>)</quote>.</text></paragraph></subsection></section><section id="idcf11d0fc148249fd98df93e2be0981ab"><enum>4.</enum><header>Enforcement of physical condition standards and tenant protection</header><text display-inline="no-display-inline">Section 8(o) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f(o)</external-xref>), as amended by section 101(b)(2)(B) of division Q of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>; 134 Stat. 2163), is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id37D7D7EA154E44A9BD8B6A137798D648"><paragraph id="id3A2C8754F931496D97C58E7194E54107"><enum>(22)</enum><header>Maintenance of property</header><text>Any entity receiving housing assistance payments with respect to dwelling units covered by a housing assistance payments contract shall—</text><subparagraph id="idF40235E1B9274BE99ECA4E53490BF0EF"><enum>(A)</enum><text>maintain decent, safe, and sanitary conditions at those dwelling units, as determined by the Secretary; and</text></subparagraph><subparagraph id="idA5B68403C9EF4775B1D48ED6AD16F91E"><enum>(B)</enum><text>comply with any standards under applicable State or local laws, rules, ordinances, or regulations relating to the physical condition of those dwelling units.</text></subparagraph></paragraph><paragraph id="id1B74C29A5B3C4A53A9220BE62587C70A"><enum>(23)</enum><header>Enforcement of physical condition standards</header><subparagraph id="idBDF0B5CD483C42809E63CDE1821A5A4D"><enum>(A)</enum><header>In general</header><text>The Secretary shall take action under subparagraph (C) against an entity with a housing assistance payments contract for project-based assistance with respect to a multifamily housing project if—</text><clause id="id73FFC7C1FC4047978A43F3F1DCACFA98"><enum>(i)</enum><text>the project receives a Uniform Physical Condition Standards (in this paragraph referred to as <quote>UPCS</quote>) inspection score of not more than 45;</text></clause><clause id="id08830A73C33A47F0A89D3E04BAA169EE"><enum>(ii)</enum><text>the entity fails to certify in writing to the Secretary within 3 days of receiving the score under clause (i) that all exigent health and safety deficiencies identified by the inspector at the project have been corrected; or</text></clause><clause id="id28A70BD7F64A4060A0F71B6539D30C64"><enum>(iii)</enum><text>the project receives a UPCS inspection score of more than 45 and less than 59 and has received consecutive scores of less than 60 on UPCS inspections.</text></clause></subparagraph><subparagraph id="idBB797F08A6534CE99076FB5CA1A38C5D"><enum>(B)</enum><header>Applicability</header><text>Subparagraph (A) shall—</text><clause id="id38BC619BF7B642A6A4B2053A016DA92A"><enum>(i)</enum><text>apply with respect to insured and noninsured projects with dwelling units receiving assistance under this section other than under paragraph (13); and</text></clause><clause id="id1D4B7280054549FA9AB966CE3AE41E9F"><enum>(ii)</enum><text>not apply to dwelling units receiving assistance with capital or operating funds under section 9.</text></clause></subparagraph><subparagraph id="id1166C533A99547648E5249F0A2C8B5B7"><enum>(C)</enum><header>Notification and enforcement</header><clause id="idB306528DCC124000B005681DE4281023"><enum>(i)</enum><header>In general</header><text>If an entity violates clause (i), (ii), or (iii) of subparagraph (A), the Secretary shall notify the entity and provide an opportunity for response not later than 15 days after the date on which the results of the UPCS inspection are issued.</text></clause><clause id="id246EF3BAA8834FE18E4969FF738C6AD1"><enum>(ii)</enum><header>Plan and notice of default</header><text>If violations remain at a project after the 15-day period described in clause (i), the Secretary shall—</text><subclause id="idDACDDFECBDA94D9A952C83001E0BF802"><enum>(I)</enum><text>develop a plan to bring the project into compliance not later than 30 days after the date on which the results of the UPCS inspection are issued; and</text></subclause><subclause id="id89EA6D75232A49AF9C1EC842EA233892"><enum>(II)</enum><text>provide the owner, the tenants of the property, the local government, any mortgagees, and any contract administrator of the project with a Notice of Default with a specified timetable, determined by the Secretary, for correcting all deficiencies.</text></subclause></clause><clause id="idF4A6B5CB7BEF46D490D276EEA1A0411B"><enum>(iii)</enum><header>Withdrawal of notice of default</header><text>If an appeal submitted by the entity results in a UPCS inspection score of not less than 60, the Secretary may withdraw a Notice of Default issued under clause (ii)(II).</text></clause><clause id="id1348F35B0DD34B84A86547AB681A5818"><enum>(iv)</enum><header>Penalties</header><text>If, at the end of the timetable described in clause (ii)(II), the entity fails to fully correct all deficiencies in the project, the Secretary may—</text><subclause id="id953bb601f96a4c9e9438a72a15889840"><enum>(I)</enum><text>require immediate replacement of project management with a management agent approved by the Secretary;</text></subclause><subclause id="idb46c52e73c894fb8afa717493ed49443"><enum>(II)</enum><text>impose civil money penalties, which—</text><item id="id81145C64E323495E9B1AD8C5EE87FBAE"><enum>(aa)</enum><text>shall be used solely for the purpose of supporting safe and sanitary conditions at the property, as designated by the Secretary, with priority given to the tenants of the property affected by the penalty; and</text></item><item id="idB382EEB1C54F49FA89FECBC87402C049"><enum>(bb)</enum><text>shall not be payable out of project income;</text></item></subclause><subclause id="id380d3176fed34ed0b9750daea8751342"><enum>(III)</enum><text>abate the housing assistance payments contract under this section, including partial abatement, as determined by the Secretary, until all deficiencies have been corrected;</text></subclause><subclause id="id3c6ebf3c527a43eb90bdd853443e8d20"><enum>(IV)</enum><text>pursue transfer of the project to an owner, approved by the Secretary under established procedures, which will be obligated to promptly make all required repairs and to accept renewal of the housing assistance payments contract as long as such renewal is offered;</text></subclause><subclause id="id8b1e3ecb2e9f457cb56a5de764c29975"><enum>(V)</enum><text>transfer the existing housing assistance payments contract under this section to another project or projects and owner or owners;</text></subclause><subclause id="id9f986ec0962e411cb949cca5f54fb801"><enum>(VI)</enum><text>pursue exclusionary sanctions, including suspensions or de­bar­ments from Federal programs;</text></subclause><subclause id="idcbd7bb0a6d284ace9e83498941709f65"><enum>(VII)</enum><text>seek judicial appointment of a receiver to manage the property and cure all project deficiencies or seek a judicial order of specific performance requiring the owner to cure all project deficiencies;</text></subclause><subclause id="iddb2eabf56fa64e01a2387240ba94c2a7"><enum>(VIII)</enum><text>work with the owner, lender, or other related party to stabilize the property in an attempt to preserve the property through compliance, transfer of ownership, or an infusion of capital provided by a third party that requires time to effectuate; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id13f5bcd7858c48d5b8f05a0d88a0561e"><enum>(IX)</enum><text>take any other regulatory or contractual remedies available as deemed necessary and appropriate by the Secretary.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8D21DBF7CFC940568BC518C47CBDB906"><enum>(D)</enum><header>Contracts</header><clause commented="no" display-inline="no-display-inline" id="idDB03CD0A5321425696F23F1810FA973A"><enum>(i)</enum><header>In general</header><text>The Secretary shall take appropriate steps to ensure that project-based contracts remain in effect, subject to the exercise of contractual abatement remedies to assist relocation of tenants for major threats to health and safety after written notice to and informed consent of the affected tenants and use of other remedies under this paragraph.</text></clause><clause commented="no" display-inline="no-display-inline" id="id8BCD9D32C23D40CB82AA8991BB7D94F7"><enum>(ii)</enum><header>Other assistance</header><text>To the extent the Secretary determines, in consultation with the tenants and the local government, that a property is not feasible for continued rental assistance payments under this section or other housing programs, based on consideration of the costs of rehabilitating and operating the property and all available Federal, State, and local resources, including rent adjustments under section 524 of the Multifamily Assisted Housing Reform and Affordability Act of 1997 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref> note; title V of <external-xref legal-doc="public-law" parsable-cite="pl/105/65">Public Law 105–65</external-xref>) and environmental conditions that cannot be remedied in a cost-effective fashion, the Secretary may, in consultation with the tenants of the property, contract for project-based rental assistance payments with an owner or owners of other existing housing properties, or provide other rental assistance.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idEA68E7C6E75E45A7AC94E0E04841CD04"><enum>(E)</enum><header>Report</header><clause commented="no" display-inline="no-display-inline" id="id913AFCFA4760463DAD131C7BBC924164"><enum>(i)</enum><header>In general</header><text>The Secretary shall, on a quarterly basis, issue a publicly available report on all properties covered by this paragraph that—</text><subclause commented="no" display-inline="no-display-inline" id="id179A329484A64B41A99DD05EF6D01620"><enum>(I)</enum><text>are assessed through UPCS inspections; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id4820520525FB401097E37A8BC3A70338"><enum>(II)</enum><item commented="no" display-inline="yes-display-inline" id="id3668FE8C72C742718AF5C143C564BD54"><enum>(aa)</enum><text>have a UPCS inspection score of less than 60; or</text></item><item commented="no" display-inline="no-display-inline" id="idE527D76210F540F4A963249F2AB69CAE" indent="up1"><enum>(bb)</enum><text>received an unsatisfactory management and occupancy review during the 36-month period preceding the report.</text></item></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idB4E8C03AA26840A2BA44BEEF2C8EC723"><enum>(ii)</enum><header>Contents</header><text>Each report issued under clause (i) shall—</text><subclause id="id5eaf1eb8710c471ea48f586ca3167396"><enum>(I)</enum><text>include, for each property covered by the report—</text><item id="id2FD4970135124E168B2B4EF775C08DCF"><enum>(aa)</enum><text>the UPCS inspection score and date of inspection; and</text></item><item id="id6658FB4DDF0B4F7DADA5221AFE36D95B"><enum>(bb)</enum><text>the ownership interest and management of the property;</text></item></subclause><subclause id="id36031F9F90F846CE93E6AD8EF6538856"><enum>(II)</enum><text>identify—</text><item id="id95F7689C81FB4376BE06D52958F8EF0E"><enum>(aa)</enum><text>the enforcement actions being taken to address the physical conditions of the properties covered by the report, including imposition of civil monetary penalties and termination of subsidies; and</text></item><item id="idFD162EBC3E3E435EB8101ECCD539CC7F"><enum>(bb)</enum><text>properties that have been identified multiple times as having the physical conditions described in item (aa);</text></item></subclause><subclause id="id6ca55a145ae941d9b05c3aa28cf0830c"><enum>(III)</enum><text>identify actions that the Secretary is taking to—</text><item id="idEBC088425A8E44A5AB54AEA71868837C"><enum>(aa)</enum><text>remediate all health and safety concerns; and</text></item><item id="id16A545A3FC4D4FED9790E8917852B8C2"><enum>(bb)</enum><text>protect tenants of the properties covered by the report; and</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="idc3fa3fdfa87949939fc9acf0e176759d"><enum>(IV)</enum><text>include any administrative or legislative recommendations to further improve the living conditions at each property covered under a housing assistance payments contract.</text></subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC29E70AED531490CAA7D9FE0C6D22514"><enum>(24)</enum><header>Tenant protection</header><subparagraph commented="no" display-inline="no-display-inline" id="idD603EE2D1E8549F3A70FA020A1AFBEDF"><enum>(A)</enum><header>In general</header><text>The Secretary may provide tenant-based assistance for dwelling units covered under a project-based assistance subsidy contract if—</text><clause commented="no" display-inline="no-display-inline" id="id9DFA2BE87071480E8DA760200C51388D"><enum>(i)</enum><text>the owner of the dwelling units has received a Notice of Default; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idE7441B84CF604DE09DF7C9F15DEA6D91"><enum>(ii)</enum><text>the dwelling units pose an imminent health and safety risk to the tenants of the dwelling units.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idFE82A555104D45AC9F7FF4A6B2C1A9CF"><enum>(B)</enum><header>Reimbursements</header><text>To the extent that the Secretary determines that dwelling units described in subparagraph (A) are not feasible for continued rental assistance payments or transfer of the project-based assistance subsidy contract associated with those dwelling units to another project or projects and owner or owners, any remaining amounts associated with those dwelling units shall be recaptured and used to reimburse amounts used for tenant-based assistance under subparagraph (A).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id33b84b3074c74812a8888c09580a315a"><enum>5.</enum><header>Reports on Real Estate Assessment Center inspections</header><subsection id="id4562605F044B4D5D902028EB932321D5"><enum>(a)</enum><header>Annual HUD report</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of this Act, and annually thereafter, the Secretary shall issue a publicly available report on the website of the Department of Housing and Urban Development (in this section referred to as the <quote>Department</quote>) regarding Real Estate Assessment Center (in this section referred to as <quote>REAC</quote>) inspections of all properties assisted, insured, or both, under a program of the Department, which shall include—</text><paragraph id="id98e8dedb902d47de835319d376e77f40"><enum>(1)</enum><text>the percentage of all inspected properties that received a REAC-inspected score of less than 65 during the 48-month period preceding the report;</text></paragraph><paragraph id="ide56fd984e15a4768ad5ded15cd21ea4c"><enum>(2)</enum><text>the number of properties in which the most recent REAC-inspected score represented a decline relative to the previous REAC-inspected score;</text></paragraph><paragraph id="id95ef40d01048484c93d1cf0d2d8bd3b2"><enum>(3)</enum><text>a list of the 10 metropolitan statistical areas with the lowest average REAC-inspected scores for all inspected properties; and</text></paragraph><paragraph id="id9e170f1753204a9eaf751e463c074739"><enum>(4)</enum><text>a list of the 10 States with the lowest average REAC-inspected scores for all inspected properties.</text></paragraph></subsection><subsection id="idf7c05033976f43cea3a6158621a1ed7a"><enum>(b)</enum><header>GAO report</header><text>The Comptroller General of the United States shall issue a publicly available report on the website of the Government Accountability Office with recommendations for how REAC inspections of all properties assisted, insured, or both, under a program of the Department should be reformed and improved.</text></subsection></section><section id="idC779CD83570745089CE56E7E38DF2CA4"><enum>6.</enum><header>Budget-based rental adjustments for certain properties receiving project-based rental assistance that underwent Mark-to-Market</header><subsection id="idE9CEF25472004F0CA7159526586DFEE0"><enum>(a)</enum><header>Definition</header><text>In this section, the term <term>eligible property</term> means a property that—</text><paragraph id="idDF6107E9114B409DA361E8A6E5118427"><enum>(1)</enum><text>receives project-based rental assistance under section 8 of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref>);</text></paragraph><paragraph id="id46AF9270448D4A71ADBFC5136E7C7023"><enum>(2)</enum><text>underwent a mortgage restructuring under subtitle A of the Multifamily Assisted Housing Reform and Affordability Act of 1997 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref> note; title V of <external-xref legal-doc="public-law" parsable-cite="pl/105/65">Public Law 105–65</external-xref>); and</text></paragraph><paragraph id="id5614C90DCA0E4020B51473DC70479183"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idFDD6C07F4E6D4A839B722A774983C89F"><enum>(A)</enum><text>has been transferred to a different owner due to the failure of a prior owner to meet Uniform Physical Condition Standards;</text></subparagraph><subparagraph id="idC2A9BE1835EB4D6CA116985A2273C218" indent="up1"><enum>(B)</enum><text>received a failing Uniform Physical Condition Standard score under a prior owner; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idEBF7CB54CF384A25B203BECCCA1F35A5" indent="up1"><enum>(C)</enum><text>requires substantial rehabilitation, including the replacement of major systems, in order to ensure the long term sustainability of the property, as determined by a capital needs assessment and as approved by the Secretary.</text></subparagraph></paragraph></subsection><subsection id="id18379309897F44518D18F9DAEBE23D21"><enum>(b)</enum><header>Authority</header><text>The Secretary may, at the request of the owner of the property, approve the adjustment of rent on a budget basis (within the meaning of section 401.412(b) of title 24, Code of Federal Regulations, or any successor regulation) for an eligible property if the owner—</text><paragraph id="idd932582749124335889785b6ece3000a"><enum>(1)</enum><text>demonstrates that—</text><subparagraph id="id350078045000450DB29837F16633DD6B"><enum>(A)</enum><text>the available operating revenue is insufficient to operate and maintain the property; and</text></subparagraph><subparagraph id="id42906a47c41e4e3b86f719b367b87f90"><enum>(B)</enum><text>a rent adjustment is necessary to support financing for rehabilitation; and</text></subparagraph></paragraph><paragraph id="id7d6cfc95b73f48c88ce57597d806d8b7"><enum>(2)</enum><text>submits a rehabilitation plan to extend the useful life of the property for not less than 25 years, including remediation of all existing health, sanitation, and safety concerns.</text></paragraph></subsection><subsection id="idb21074ead3a845ca97c3203b2fd757f1"><enum>(c)</enum><header>Reporting requirement</header><text>During the period during which a property for which a budget-based rental adjustment is approved under subsection (b) is being rehabilitated, the owner of the property shall submit to the Secretary a quarterly report that includes—</text><paragraph id="id5F449CFE2D1E4769A5B933E9089A541A"><enum>(1)</enum><text>a description of the progress made on, and expenses incurred for, capital improvements and debt service;</text></paragraph><paragraph id="id1E26F38D3AA44F1DB7D8FC5BDD4FE8E0"><enum>(2)</enum><text>a detailed list of outstanding improvements;</text></paragraph><paragraph id="id1A2992E010B74F21800836136B3EA0CF"><enum>(3)</enum><text>the expected completion date for each outstanding improvement described in paragraph (2); and</text></paragraph><paragraph id="id40CFB54B693649F8BF4DC5F8D5652444"><enum>(4)</enum><text>any other information required by the Secretary.</text></paragraph></subsection></section><section id="id7A14AE9D994E4C3580814CFC4586BE2C"><enum>7.</enum><header>Codification of Uniform Physical Condition Standards inspection timelines for units receiving project-based rental assistance</header><subsection id="idA888FBF9E37446DB906D1CF4EAA99FD6"><enum>(a)</enum><header>Definition</header><text>In this section, the term <term>covered property</term> means a property that receives project-based rental assistance under section 8 of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f</external-xref>).</text></subsection><subsection id="id89444594BAC14014BF9B295C1C3DEC9D"><enum>(b)</enum><header>Scoring and ranking of physical condition</header><text display-inline="yes-display-inline">The Secretary shall score and rank the physical condition of covered properties in accordance with this section.</text></subsection><subsection id="idb83c4450bfbd48d4aa8006716ced1b3d"><enum>(c)</enum><header>Methodology for ranking</header><paragraph id="id25DF0AD441894864BDB785E695C5802C"><enum>(1)</enum><header>In general</header><text>The Secretary shall score each covered property on the basis of a 100-point scale.</text></paragraph><paragraph id="idAF50DFD51CC44E2288564F96A670D641"><enum>(2)</enum><header>Fractions</header><text>In scoring a covered property under paragraph (1), the Secretary shall round—</text><subparagraph id="idA807ED21CBE6466BBCBE14C831BB05E2"><enum>(A)</enum><text>a score that includes a fraction below one half point to the next lower full point; and</text></subparagraph><subparagraph id="id9C038D705E564B93808EF9A7F1E25516"><enum>(B)</enum><text>a score that includes a fraction of one half point or higher to the next higher full point.</text></subparagraph></paragraph></subsection><subsection id="idF28F642443B341A48E1306773B5069FB"><enum>(d)</enum><header>Designations and frequency of inspections</header><paragraph id="idE3847F09B88E4B72887B14613E3CF526"><enum>(1)</enum><header>Standard 1 performing property</header><text>The Secretary shall—</text><subparagraph id="id7E9A272D40414AFAA3A539FB8A91E903"><enum>(A)</enum><text>designate a covered property that receives a score of not less than 90 points on its physical condition inspection as a standard 1 performing property; and</text></subparagraph><subparagraph id="idBE07CFB928ED4470B78C11B9E2C92215"><enum>(B)</enum><text>conduct a physical inspection of a standard 1 performing property once every 3 years.</text></subparagraph></paragraph><paragraph id="idB63FC3292A2B4CBBBC8469C227D4BF18"><enum>(2)</enum><header>Standard 2 performing property</header><text>The Secretary shall—</text><subparagraph id="idF80127DDE02340D7A104C86EC0EFE1D0"><enum>(A)</enum><text>designate a covered property that receives a score of not less than 80 points and less than 90 points on its physical condition inspection as a standard 2 performing property; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB8EFBBF2E25E4F9BBC461720DAB13670"><enum>(B)</enum><text>conduct a physical inspection of a standard 2 performing property once every 2 years.</text></subparagraph></paragraph><paragraph id="idD2D978BFBC9C49DDA24DFEF6E0084778"><enum>(3)</enum><header>Standard 3 performing property</header><text>The Secretary shall—</text><subparagraph id="idEF2DC74CC7C3435F9650355396F787E9"><enum>(A)</enum><text>designate a covered property that receives a score of less than 80 points on its physical condition inspection as a standard 3 performing property; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idECBDDBD00F014A4E982ECD580C91ED41"><enum>(B)</enum><text>conduct a physical inspection of a standard 3 performing property every year. </text></subparagraph></paragraph></subsection><subsection id="id8ac663b9497d47188a41cf3cb090b9c8"><enum>(e)</enum><header>Special requirements</header><text>If a covered property receives a score in the range of a standard 1 performing property or standard 2 performing property on its physical condition inspection and has been cited by the Secretary as having an exigent health and safety deficiency, the property—</text><paragraph id="id5A6CAA5A434245608D13ABDFBD685C35"><enum>(1)</enum><text>shall only shall be designated as a standard 1 performing property or standard 2 performing property, respectively, if the owner resolves the deficiency; and</text></paragraph><paragraph id="idC08DB53B215D4276984C064E61B7C6BB"><enum>(2)</enum><text>shall be designated as a standard 3 performing property if the owner does not resolve the deficiency.</text></paragraph></subsection><subsection id="ide821fe44ef7a4587ab84168913ea02b8"><enum>(f)</enum><header>Authority To delay inspections</header><paragraph id="idAABBD1C0B88144F7A92C78612F66C365"><enum>(1)</enum><header>In general</header><text>Notwithstanding subsection (d), the Secretary may delay the physical inspection of a covered property that is undergoing a substantial rehabilitation.</text></paragraph><paragraph id="id31743588C8844B2F97536A4F7C639735"><enum>(2)</enum><header>Definition</header><text>For purposes of this subsection, the term <term>substantial rehabilitation</term>, with respect to a covered property, means a physical rehabilitation for the long-term sustainability of the property where the costs of the rehabilitation exceed 25 percent of the property's replacement cost (calculated based on fair market value) after completion of all required repairs, replacements, and improvements.</text></paragraph></subsection></section></legis-body></bill>
