which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title III of the Social Security Act to improve the accuracy of payment of unemployment compensation benefits, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Eliminate Fraudulent Unemployment Insurance Benefits Act</short-title></quote>.</text></section><section id="id7718364204954488b8461dcd8e5057e8"><enum>2.</enum><header>Timing of payments to certain continued claimants</header><subsection commented="no" display-inline="no-display-inline" id="id9cdf5f125f4a46d38f59ec18726c4b78"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 303 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/503">42 U.S.C. 503</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idcaf42e37f0304b30abbab4271e142219"><enum>(1)</enum><text>in subsection (a)(1), by striking <quote>Such methods of administration</quote> and inserting <quote>Subject to subsection (n), such methods of administration</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idda04ea87848b4a23be9c6520bb9d7b49"><enum>(2)</enum><text>by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id707E90E8E57D4D66B306C9B59FB7B113"><subsection commented="no" display-inline="no-display-inline" id="id47d8c0b7c1144a31a2b171c99b82e7eb"><enum>(n)</enum><header>Timing of payments to certain continued claimants</header><paragraph commented="no" display-inline="no-display-inline" id="id3c06bece1d5c402aa822de9f8f0362d2"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">For purposes of determining when unemployment compensation is due under subsection (a)(1), in the case of a continued claimant who has been determined ineligible by the State agency and such determination is in the appeal process, the State agency shall withhold unemployment compensation benefits otherwise payable to such individual until the date on which—</text><subparagraph commented="no" display-inline="no-display-inline" id="idacf1e124d9074d58a863969a0d16ee76"><enum>(A)</enum><text display-inline="yes-display-inline">the individual's appeal is no longer pending before the State; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4d29344a02954fd3b7c6e3d687cf97c0"><enum>(B)</enum><text display-inline="yes-display-inline">the State agency determines that such individual is eligible for such payment.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idee90d8491bb64dd5873651de3984dac9"><enum>(2)</enum><header>Payment upon determination</header><text>For purposes of paragraph (1)(B), if a State agency determines that a claimant is eligible for unemployment compensation benefits, the State agency shall pay to the claimant within 5 business days the benefits withheld from the claimant in accordance with paragraph (1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idaa4de5a809ee48cb9ce2cae706eebb58" commented="no"><enum>(b)</enum><header>Effective date</header><text>The requirements of subsection (a) shall apply to weeks of unemployment beginning on or after the earlier of—</text><paragraph id="ide862d1924adb4b08be905fdc48398455" commented="no"><enum>(1)</enum><text>the date the State changes its statutes, regulations, or policies in order to comply with such requirements; or</text></paragraph><paragraph id="iddf46fba777c24ad2af68f16ca941c357" commented="no"><enum>(2)</enum><text>the date that is 2 years after the date of enactment of this Act.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id29b464c7d1054634b285fb39ffb7bb6f"><enum>3.</enum><header>Guidance on denying or revoking eligibility for unemployment compensation</header><subsection id="id0682f5a6c6ae4b91b8a41fc318486d18"><enum>(a)</enum><header>In general</header><text>Not later than 270 days after the date of enactment of this Act, the Secretary of Labor (in this section referred to as the <quote>Secretary</quote>), in coordination with the Inspector General of the Department of Labor (in this section referred to as the <quote>Inspector General</quote>), shall issue guidance for States regarding best practices for denying eligibility for unemployment compensation for initial claimants and declaring continued claimants ineligible.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id52a7592677114e84a9bdb7ae7b039172"><enum>(b)</enum><header>Considerations</header><text>In issuing the guidance under subsection (a), the Secretary and the Inspector General shall consider the following:</text><paragraph commented="no" display-inline="no-display-inline" id="id970c83159b2a418795fdb13ae059e49d"><enum>(1)</enum><text>Accepted rationales for ineligibility determinations, including—</text><subparagraph commented="no" display-inline="no-display-inline" id="idaceb762e38f048acaaa4cf18c4c951de"><enum>(A)</enum><text>fraudulent activity, such as any dishonest response, use of a synthetic identity, or certification of inaccurate or deceptive personally-identifiable information;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id86f34a1acbf74f65ba57cdbad0486752"><enum>(B)</enum><text>nonresponse; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2c3d702f20534ad3ad8e6805cac22eb9"><enum>(C)</enum><text>any other rationale determined appropriate by the Secretary and the Inspector General.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfde57e7c977c4c52803b9b90c035e52e"><enum>(2)</enum><text>Specific examples of each accepted rationale identified under paragraph (1).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida50396d5c249447780af4544947c9ff0"><enum>(3)</enum><text>The level of risk associated with each accepted rationale identified under paragraph (1).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id14ad715d0e214708a5983a87ed5f51e1"><enum>(4)</enum><text>Any other considerations determined appropriate by the Secretary and the Inspector General.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idd92f935008ea41fd901c67201c35cc82"><enum>(c)</enum><header>Updates</header><text>The Secretary, in coordination with the Inspector General, shall update the guidance issued under subsection (a) not less than once every 3 years.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id9c067d099aa740fcb2caa247121db647"><enum>(d)</enum><header>Definitions</header><text>For purposes of this section:</text><paragraph commented="no" display-inline="no-display-inline" id="ida6861690c0a546e8a425a4f2f68155ce"><enum>(1)</enum><header>Dishonest response</header><text>The term <term>dishonest response</term> means, with respect to a response from a claimant to file an initial claim or a claim for continued eligibility for unemployment compensation, a response that—</text><subparagraph commented="no" display-inline="no-display-inline" id="idc18fe75fa05d4dcab1df9ffbcee25a92"><enum>(A)</enum><text display-inline="yes-display-inline">is untrue; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3db59548c47f46d3b5c2ea7cf2c5eb00"><enum>(B)</enum><text display-inline="yes-display-inline">may include false personally-identifiable information, reporting of earnings, or employment history. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5139fd61b70a462ca3c03b56421381a1"><enum>(2)</enum><header>Personally-identifiable information</header><text><italic></italic>The term <term>personally-identifiable information</term> means information that is linked or reasonably linkable to an individual, such as a physical address, place of residency, phone number, driver’s license number, social security number, employee identification number, identification number provided by the State, or any other information determined appropriate by the Secretary of Labor. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id26bf424975b649f597ee30504716fb9c"><enum>(3)</enum><header>Synthetic identity</header><text>The term <term>synthetic identity</term> means, with respect to a claim for unemployment compensation, an identity that is used by a claimant to fraudulently apply for such compensation that—</text><subparagraph commented="no" display-inline="no-display-inline" id="id07b217a3b60b45c6a634c322b732f845"><enum>(A)</enum><text display-inline="yes-display-inline">does not reflect a real individual; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id88eb8452517d4adfb4aff4891089e5f0"><enum>(B)</enum><text display-inline="yes-display-inline">may use real or seemingly real personally-identifiable information.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
