which was read twice and referred to the <committee-name committee-id="SSFR00">Committee on Foreign Relations</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit United States Government assistance to the Government of the People's Republic of China and affiliated entities, and for other purposes.</official-title></form><legis-body><section id="id629ec31f58c344a382e475d9317d2783" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>End Assistance to China Act</short-title></quote>.</text></section><section section-type="subsequent-section" commented="no" display-inline="no-display-inline" id="id50c2002107d14e88801ba3f24cd7ad6e"><enum>2.</enum><header display-inline="yes-display-inline">Limitation on United States assistance to China</header><subsection commented="no" display-inline="no-display-inline" id="idc4b21d05bddb43a6ab4294af4f2fbe58"><enum>(a)</enum><header display-inline="yes-display-inline">Defined term</header><text>In this Act, the term <term>United States assistance</term> has the meaning given the term <term>foreign assistance</term> in section 634(b)(1) of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2394">22 U.S.C. 2394(b)(1)</external-xref>).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id8eb0abe8557c4823a28396e7e3951d42"><enum>(b)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in subsections (c) and (d), no United States assistance may be provided to—</text><paragraph commented="no" display-inline="no-display-inline" id="id5add3349ed744006b9c798ab971216ab"><enum>(1)</enum><text display-inline="yes-display-inline">the Government of the People's Republic of China; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9464ad62daa448a696d9b01a3810a300"><enum>(2)</enum><text>the Chinese Communist Party or any affiliated organization;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id985667b7c7eb4fb584a16bc6707a3459"><enum>(3)</enum><text display-inline="yes-display-inline">any entity owned or controlled by the Government of the People's Republic of China or the Chinese Communist Party; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1004fb2c68e94dcb98a0f1a6dded164f"><enum>(4)</enum><text>any entity, including any nongovernmental organization, which would use such assistance to facilitate or engage directly in assistance work in the People's Republic of China, including Hong Kong.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id35f63259ca554279a35b0f87cfab22e8"><enum>(c)</enum><header>Exceptions</header><text>The prohibition described in subsection (b) shall not apply to any entity described in subsection (b)(4) that will use United States assistance—</text><paragraph id="idc7ab92d45b634ba78435e230587003ad"><enum>(1)</enum><text>to promote human rights or democratic development; or</text></paragraph><paragraph id="idd0fc8bf7d4544d08b0c94049f5ee9a6a"><enum>(2)</enum><text>to support livelihood development, cultural preservation, education, health initiatives, or environmental conservation in Tibetan communities.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id3975653f4a884965b016d540dc5f4631"><enum>(d)</enum><header>Waiver</header><text>The President may waive the application of subsection (b)(4) in circumstances in which—</text><paragraph commented="no" display-inline="no-display-inline" id="id694af318fa6042f986656826b5a193a7"><enum>(1)</enum><text display-inline="yes-display-inline">the proposed United States assistance will be used—</text><subparagraph commented="no" display-inline="no-display-inline" id="idc6020a4e54364c6685d25fcb03f07f58"><enum>(A)</enum><text display-inline="yes-display-inline">to combat wildlife trafficking or illegal, unreported, or unregulated fishing;</text></subparagraph><subparagraph id="id5aed1b892d8d48aa94a1df688a305c1f" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>to support efforts to prevent the proliferation of chemical, biological, radiological, or nuclear weapons, including materials used to construct or deliver such weapons; or</text></subparagraph><subparagraph id="idff23ade58c3e448b9a601d7960330127"><enum>(C)</enum><text>to provide emergency humanitarian assistance or disaster relief; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc3f4c239f28540178bcee46a1d5a4d7b"><enum>(2)</enum><text>the President submits to Congress, before such United States assistance is obligated or expended for such purpose, a notification explaining—</text><subparagraph commented="no" display-inline="no-display-inline" id="id655ea2923a064cab9e05ffbde844836c"><enum>(A)</enum><text>the provision of such United States assistance for such purpose is in the national interest of the United States; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2fbe8e10ff8f4105980c936be84c8501"><enum>(B)</enum><text>why the People's Republic of China is unable to provide the necessary funding for the applicable use described in paragraph (1).</text></subparagraph></paragraph></subsection></section></legis-body></bill>
