committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To authorize a grant program for educational institutions to analyze, digitize, and map historic records relating to housing discrimination, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Mapping Housing Discrimination Act</short-title></quote>.</text></section><section id="id45484C80016F4AF79ACD4F27A7622103"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to support—</text><paragraph id="id2DCA9EDDE81D44E4A4D91803A668E205"><enum>(1)</enum><text display-inline="yes-display-inline">efforts by educational institutions to conduct primary analysis and digitization of historic housing discrimination patterns since 1850;</text></paragraph><paragraph id="id0DC49415049A4F8F9A8738828259F127"><enum>(2)</enum><text display-inline="yes-display-inline">efforts by local governments to digitize property deeds and other historic records relating to housing discrimination; and</text></paragraph><paragraph id="idF5D9A371BE874113A799282A00F3F4A5"><enum>(3)</enum><text>the creation of a national, publicly available database of local records of housing discrimination patterns since 1850.</text></paragraph></section><section id="id9EA60614FD05406099C4DAED1BB06BBF"><enum>3.</enum><header>Grant program</header><subsection id="id84BAC4D4C5224D318091D35D190C3C63"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idBC70A73CEC7C44DF9376134AA14131CC"><enum>(1)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term>—</text><subparagraph id="id0319BE85DE5C49E7948D711F6FB927D5"><enum>(A)</enum><text>means an institution of higher education (as defined in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>)); and</text></subparagraph><subparagraph id="id36E34270E72F447098D9EE8AEE2BB0F9"><enum>(B)</enum><text>includes a minority-serving institution.</text></subparagraph></paragraph><paragraph id="id60CF2595B7D646CCB86112F47D1D8371"><enum>(2)</enum><header>Historic housing discrimination record</header><text>The term <term>historic housing discrimination record</term> means—</text><subparagraph id="id54D5ADAEF3724276BCFE5B75228686D3"><enum>(A)</enum><text>a deed or other historic property record originating after 1850 in which there is evidence of housing discrimination, which may include—</text><clause id="id71A6D43D76BE434090D1EEEFC282734B"><enum>(i)</enum><text>a racial covenant or other provision in a property deed that was legally enforceable on the date on which the racial covenant or other provision was written; or</text></clause><clause id="id696010C0F86540C786C7EBADC7D8385F"><enum>(ii)</enum><text>racially or ethnically restrictive language in any agreement entered into by the developer of a subdivision, a neighborhood association, a real estate operator, or a group of property owners; or</text></clause></subparagraph><subparagraph id="id940936C8612C4F1C98F5237E7769128F"><enum>(B)</enum><text>a State law, a local ordinance, or a document that presents evidence of a State law or local ordinance, that—</text><clause id="idCC0D95431E9F4D6396E7807071421ADC"><enum>(i)</enum><text>originated after 1850; and</text></clause><clause id="idB24DE3D4F18A4A05A7A99C749BF14E4D"><enum>(ii)</enum><text>permitted housing discrimination against a protected class under the Fair Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/3601">42 U.S.C. 3601 et seq.</external-xref>).</text></clause></subparagraph></paragraph><paragraph id="id9CBA665B1D2C477B801F0F0115059819"><enum>(3)</enum><header>Jurisdiction</header><text>The term <term>jurisdiction</term> means—</text><subparagraph id="id489B5AA4C5544ED8BCA30827B7C93A42"><enum>(A)</enum><text>a political subdivision of a State; or</text></subparagraph><subparagraph id="idB99EE69B87304AC6A10C1203B5F9D8A2"><enum>(B)</enum><text>the District of Columbia.</text></subparagraph></paragraph><paragraph id="id217CA6C78C3147959761F990DB7930B4"><enum>(4)</enum><header>Mapping project</header><text>The term <term>mapping project</term> means a project performed with a grant awarded under subsection (b)(1).</text></paragraph><paragraph id="id0969D74707764690A1BFF386D30D0A2F"><enum>(5)</enum><header>Minority-serving institution</header><text>The term <term>minority-serving institution</term> means an institution of higher education described in section 371(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1067q">20 U.S.C. 1067q(a)</external-xref>).</text></paragraph><paragraph id="id03800E6000A14FDB86E7B6876F423141"><enum>(6)</enum><header>Office</header><text>The term <term>Office</term>, except as otherwise specified, means the Office of Policy Development and Research of the Department of Housing and Urban Development.</text></paragraph><paragraph id="id0A7E500FD7614D2AA5F1824331E5D92B"><enum>(7)</enum><header>Office of Fair Housing and Equal Opportunity</header><text>The term <term>Office of Fair Housing and Equal Opportunity</term> means the Office of Fair Housing and Equal Opportunity of the Department of Housing and Urban Development.</text></paragraph><paragraph id="idB6C8AF8116A24B7EB20CA47A0D681E5C"><enum>(8)</enum><header>State</header><text>The term <term>State</term> means any State of the United States.</text></paragraph></subsection><subsection id="id2B3A7F7E325044EAA709C595F70461EE"><enum>(b)</enum><header>Mapping projects</header><paragraph id="id3C26E624FA4C4BC0A812B751CA214075"><enum>(1)</enum><header>In general</header><text>The Office may award grants on a competitive basis to eligible entities for the purpose of performing projects for analyzing, digitizing, and mapping the historic housing discrimination records of not less than 1 jurisdiction.</text></paragraph><paragraph id="idC905CBF675A4412089B6C4DE7FC71549"><enum>(2)</enum><header>Duration and amount</header><subparagraph id="id452EA4C082B04AF8896548B41A158D41"><enum>(A)</enum><header>Duration</header><text>The duration of a mapping project shall be not more than 5 years.</text></subparagraph><subparagraph id="idE29BCC3671DE43848C4CA9EAF94C6E65"><enum>(B)</enum><header>Amount</header><text>In determining the amount of a grant under this section, the Office shall consider—</text><clause id="id494383985ABC4CB3BD7359E66AE66AE9"><enum>(i)</enum><text>the size of the jurisdiction or jurisdictions that are the focus of the mapping project; and</text></clause><clause id="id40BBEF670C3541C499F306A4401DCD4C"><enum>(ii)</enum><text>the estimated duration of the mapping project included in the application of an eligible entity under paragraph (3)(B)(ii).</text></clause></subparagraph></paragraph><paragraph id="id0417A82777FB407AA6BCA8E5E4B399B1"><enum>(3)</enum><header>Applications</header><subparagraph id="id21267821429544CF89F6573425E42B9B"><enum>(A)</enum><header>In general</header><text>An eligible entity desiring a grant under this section shall submit to the Office an application at such time, in such manner, and accompanied by such information as the Office may require.</text></subparagraph><subparagraph id="idE4F5BCC256F74D36967A446C4850BC61"><enum>(B)</enum><header>Contents</header><text>An application submitted by an eligible entity under this paragraph shall include a description of—</text><clause id="idA7C91A764D974E00ABE59FC810074A26"><enum>(i)</enum><text>each jurisdiction that will be the focus of the mapping project;</text></clause><clause id="idC90B02A09AE94CEC80066EFCF7EF4284"><enum>(ii)</enum><text>the estimated duration of the mapping project;</text></clause><clause id="id62EF2F3BB8D84B1C9712A4964AE12BBC"><enum>(iii)</enum><text>any necessary partnership with a jurisdiction to digitize and collect historic housing discrimination records, including any—</text><subclause id="idB13F6D8BC4574F9C9CFB0413B7B7227D"><enum>(I)</enum><text>memorandum of understanding entered into by the eligible entity and the jurisdiction; or</text></subclause><subclause id="idEE4A19258F754321951E2EB0A4AC6A2E"><enum>(II)</enum><text>compensation given to the jurisdiction to aid in document digitization efforts;</text></subclause></clause><clause id="idE19D51FA4FAA47829646E891F34757B9"><enum>(iv)</enum><text>the methodology that the eligible entity will use to—</text><subclause id="id6F21F5EB90894083A3EF7125FD328F8C"><enum>(I)</enum><text>review documents for racial covenants or racially restrictive language;</text></subclause><subclause id="id5F7F9AE2EA5940698760FFFE84B8380E"><enum>(II)</enum><text>compile historic housing discrimination records; and</text></subclause><subclause id="id6CF0B6A067FE44AB8719087CD436499F"><enum>(III)</enum><text>create a spatial dataset of historic housing discrimination records;</text></subclause></clause><clause id="idAC5CE2A93D54452891106EA38E9EB628"><enum>(v)</enum><text>any research the eligible entity has already conducted on historic housing discrimination records in a jurisdiction that will be a focus of the mapping project; and</text></clause><clause id="id103F1A21B7014FA4B041D41EC94C5860"><enum>(vi)</enum><text>if the eligible entity has conducted any research described in clause (v), a plan for coordinating that research with research the eligible entity will perform during the mapping project.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0a5f61d241e241ca83dd7e73b9d46c01"><enum>(C)</enum><header>Preference</header><text>In awarding grants under this section, the Secretary may give preference to eligible entities that are minority-serving institutions.</text></subparagraph></paragraph><paragraph id="id0CF68BB5CAF34D0CAC97275BFA884E66"><enum>(4)</enum><header>Project requirements</header><text>An eligible entity that performs a mapping project shall—</text><subparagraph id="id003792AA5E5C4F87ACF00D1DE068B3FA"><enum>(A)</enum><text>use the data standards developed under paragraph (6) to create and maintain a dataset relating to historic housing discrimination records; and</text></subparagraph><subparagraph id="idCE2822B864804F079CEDAD2D1A81A315"><enum>(B)</enum><text>upon the completion of the mapping project, submit to the Office—</text><clause id="id41991ADB116C4B51AF886D33F1462F74"><enum>(i)</enum><text>the dataset required under subparagraph (A); and</text></clause><clause id="idD633D1CC5ADF4A4E83BD50D2E9B4D33B"><enum>(ii)</enum><text>with respect to the dataset required under subparagraph (A)—</text><subclause id="id20EFEA5A5EFA4B269ED4C93522901CD2"><enum>(I)</enum><text>raw data relating to the dataset;</text></subclause><subclause id="idB06EF240225340AFB7D9B7D2F8CFE6FE"><enum>(II)</enum><text>metadata that describes—</text><item id="idEA21EBBE61894E13AA0C901ACF80DC6D"><enum>(aa)</enum><text>the methodology of the eligible entity in creating the dataset; and</text></item><item commented="no" display-inline="no-display-inline" id="id504C8C2074274EAFAE3C0C52B9B7C62D"><enum>(bb)</enum><text>the dataset; and </text></item></subclause><subclause id="id599C26179A914D1BB7D56D89DAFBBB87"><enum>(III)</enum><text>any other information relevant to the creation of the dataset.</text></subclause></clause></subparagraph></paragraph><paragraph id="id21A00A70805D43EAB9823F553E8611DC"><enum>(5)</enum><header>Use of funds</header><text>An eligible entity may use funds from a grant under this section to—</text><subparagraph id="id01c243ee6e9945aa87c04cc66ad9d581"><enum>(A)</enum><text>confer with other educational institutions or other entities conducting research on historic housing discrimination patterns to develop and adopt best practices for—</text><clause id="idD543E35B5A8041FB9CC4447878DE41BC"><enum>(i)</enum><text>coordination with jurisdictions;</text></clause><clause id="idCC36A3E541124ABEA732BB968977EE04"><enum>(ii)</enum><text>data collection;</text></clause><clause id="id19B1AA292A194D3FB43B598420C094DD"><enum>(iii)</enum><text>the involvement of volunteer researchers in mapping projects; and</text></clause><clause id="id7999B7F1F6734F9388DAE74749B1C647"><enum>(iv)</enum><text>the creation of spatial datasets of historic housing discrimination records;</text></clause></subparagraph><subparagraph id="ide4da207fd06045949952e6fd5c27b2c9"><enum>(B)</enum><text>compensate jurisdictions to aid in the digitization of local property deeds or other records;</text></subparagraph><subparagraph id="id45def7ad8b024bbbb35a868b92e1fca5"><enum>(C)</enum><text>develop or purchase digital tools to identify racial covenants in digitized property deeds or other records;</text></subparagraph><subparagraph id="idA75F71B8117E4BF2A3516C4261BF02E3"><enum>(D)</enum><text>create a spatial dataset of historic housing discrimination records; and</text></subparagraph><subparagraph id="id23c03f33f9884c5da65a4c0acec91392"><enum>(E)</enum><text>make the submission required under paragraph (4)(B).</text></subparagraph></paragraph><paragraph id="id8E0E13EF82A4402A89E8BEFC8C04AB72"><enum>(6)</enum><header>Data standards</header><subparagraph id="id63C038D4F871417F9973537960FA8D21"><enum>(A)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Office, in coordination with the Office of Fair Housing and Equal Opportunity, shall establish a set of uniform data standards for the analysis, digitization, and mapping of historic housing discrimination records with which eligible entities performing mapping projects shall comply.</text></subparagraph><subparagraph id="idB7974E74329247CD82313CA889E77AC8"><enum>(B)</enum><header>Metadata</header><text>The set of uniform data standards established under subparagraph (A) shall include guidance for the creation of the metadata required under paragraph (4)(B)(ii)(II).</text></subparagraph><subparagraph id="id93BB4F6B93C64FE18AFEB607460620D0"><enum>(C)</enum><header>Input</header><text>In developing the uniform data standards under subparagraph (A), the Office shall seek input from educational institutions, civil rights organizations, or other entities conducting research on historic housing discrimination patterns.</text></subparagraph><subparagraph id="id63BF31E8AD7049C098CAD94497DA22BE"><enum>(D)</enum><header>Third-party proposal</header><clause id="id329BFBDE6B454094AC0E28FCC72A33B9"><enum>(i)</enum><header>In general</header><text>The Office may award a grant to, or enter into a contract with, a non-Federal entity on a competitive basis for the purpose of proposing the uniform data standards required to be established under subparagraph (A).</text></clause><clause id="id5D3F06ADBC6D424B89CF0DCE64232B48"><enum>(ii)</enum><header>Input</header><text>A non-Federal entity that proposes uniform data standards under clause (i) shall seek input from the entities described in subparagraph (C).</text></clause></subparagraph></paragraph><paragraph id="idAF4C66D3A29E4C9DA906BF7DE4EC1875"><enum>(7)</enum><header>National database</header><subparagraph id="id0209351B8AD8470A9276457E55AB09B8"><enum>(A)</enum><header>In general</header><clause id="idBA933BCDAB664879865E9DD19C4FA81D"><enum>(i)</enum><header>Creation</header><text>Subject to clause (ii), the Office shall use the data submitted by eligible entities under paragraph (4)(B) to create a national database of historic housing discrimination records.</text></clause><clause id="id5772B7B269464D93AE427D737998E5A6"><enum>(ii)</enum><header>Optional 6-month delay</header><text>At the request of an eligible entity, the Office shall wait to add data submitted by the eligible entity under paragraph (4)(B) to the national database created under clause (i) of this subparagraph until the date that is 180 days after the date on which the eligible entity submitted the data.</text></clause></subparagraph><subparagraph id="id7E3036C03ED244ACACAE774AEA675745"><enum>(B)</enum><header>Public availability</header><clause id="id9F080A2E9D374891B0AD83AE7925013E"><enum>(i)</enum><header>In general</header><text>The Office shall make the database created under subparagraph (A) publicly available at no cost on the website of the Office.</text></clause><clause id="id2A731CF8BAE74DAD90F16C94A35E766E"><enum>(ii)</enum><header>Other information</header><text>At the request of any individual, the Office shall provide the individual with the information submitted by an eligible entity under paragraph (4)(B)(ii).</text></clause></subparagraph><subparagraph id="id875BEE36651F46B3A20D10C718A0E477"><enum>(C)</enum><header>Optional additions</header><text>The Office may import Federal data relating to historic housing discrimination records into the national database created under subparagraph (A).</text></subparagraph></paragraph><paragraph id="idE1270AD6BC494C97933F27DCAC7FA702"><enum>(8)</enum><header>Digitization</header><text>If an eligible entity compensates a jurisdiction for the purpose of digitizing historic housing discrimination records with funds from a mapping project, the jurisdiction shall make those deeds and records publicly available at no cost.</text></paragraph></subsection><subsection id="id96A33397DC0D4656985F824F245DF81A"><enum>(c)</enum><header>Reports</header><paragraph id="idFA52E5CC08CD4478933291916051465F"><enum>(1)</enum><header>Project report</header><text>Not later than 180 days after the date on which an eligible entity receives a grant under this section, and annually thereafter for the duration of the mapping project, an eligible entity performing a mapping project shall submit to the Office a report on the status of the mapping project, which shall include information on the progress of the eligible entity—</text><subparagraph id="id918ABA2A1EFA4A91908AC8077055A5A9"><enum>(A)</enum><text>in community outreach and engagement, including whether volunteers are involved in the mapping project;</text></subparagraph><subparagraph id="id8B54EE0567904D649D89C27FD3483749"><enum>(B)</enum><text>on any necessary collaboration with a jurisdiction for the purpose of digitizing historic housing discrimination records;</text></subparagraph><subparagraph id="idCCAC5AE09D904EF38E80E57E04F5999E"><enum>(C)</enum><text>on data collection and identification of historic housing discrimination records relating to racial discrimination;</text></subparagraph><subparagraph id="idD482FB9FCFF04D01A612AE763CB25C17"><enum>(D)</enum><text>on data collection and the identification of historic housing discrimination records that suggest a pattern of discrimination against individuals with any protected characteristic other than race; and</text></subparagraph><subparagraph id="id20200D83F3C146B3B694FF78D4498C34"><enum>(E)</enum><text>on the creation of the dataset required under subsection (b)(4)(A).</text></subparagraph></paragraph><paragraph id="id1DABBF93C61D4F889BF8DF6685F58F5D"><enum>(2)</enum><header>Report to Congress</header><text>Not later than 1 year after the date of enactment of this Act, and not less frequently than once every 3 years thereafter, the Office shall submit to the Committee on Banking, Housing, and Urban Affairs of the Senate and the Committee on Financial Services of the House of Representatives a report that includes—</text><subparagraph id="id7D0C22A5D40D4349B5A3FFE254AF87F7"><enum>(A)</enum><text>information relating to—</text><clause id="id27983B09903C4219961BECCA3FA2720F"><enum>(i)</enum><text>the status of the grant program established under subsection (b), including a list of the ongoing and completed mapping projects and the jurisdictions that are the focus of those mapping projects;</text></clause><clause id="idF4A177ACEF784A83943BC819E0F338E9"><enum>(ii)</enum><text>the status of the national database required under subsection (b)(7); and</text></clause><clause id="idBB94F3DABEAA4B4294E113545B32132F"><enum>(iii)</enum><text>any research the Office or the Secretary of Housing and Urban Development performs with information from the national database required under subsection (b)(7); and</text></clause></subparagraph><subparagraph id="idD59216A5BA1D4472859942FE34A545B8"><enum>(B)</enum><text>an addendum from the Office of Fair Housing and Equal Opportunity that details—</text><clause id="idD6C7D60AAD2F4228AC94C58B0BD422AC"><enum>(i)</enum><text>the involvement of the Office of Fair Housing and Equal Opportunity in the grant program established under subsection (b), including any coordination with the Office of Policy Development and Research of the Department of Housing and Urban Development; and</text></clause><clause id="id3CBCB9B62C0443EE9D4B039C5DA17765"><enum>(ii)</enum><text>how the grant program established under subsection (b) relates to—</text><subclause id="idE536C43AE069452799720396052AC1A3"><enum>(I)</enum><text>the mission of the Office of Fair Housing and Equal Opportunity to enforce the Fair Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/3601">42 U.S.C. 3601 et seq.</external-xref>); and</text></subclause><subclause id="idAC91418C935647E78AE3B1CAB60B40B3"><enum>(II)</enum><text>any ongoing work of the Office of Fair Housing and Equal Opportunity.</text></subclause></clause></subparagraph></paragraph></subsection><subsection id="id5C3D4DEF21E74E4DAF4C23522AEB6B52"><enum>(d)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Office—</text><paragraph id="idA6FEBC64E2B94FCB8CEF2A543E6B7AC7"><enum>(1)</enum><text>$5,000,000 for each of fiscal years 2024 through 2033 to award grants under subsection (b); and</text></paragraph><paragraph id="id9BD1019893A94081AF649D98AFAA41C4"><enum>(2)</enum><text>$750,000 for each of fiscal years 2024 through 2033, to remain available until expended, for costs associated with carrying out the requirements of this Act.</text></paragraph></subsection></section></legis-body></bill>
