which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To support and fund the Federal procurement of clean energy products, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Buy Green Act of 2024</short-title></quote>.</text></section><section id="idc9b99c89a7e144f682925d70573260b6"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="ida3250467cd184e438f35b6bd037ac822"><enum>(1)</enum><header>Appropriate committees of Congress</header><text>The term <term>appropriate committees of Congress</term> means—</text><subparagraph id="id020120e9887f45f1ba14b772103d0a62"><enum>(A)</enum><text>the Committee on Commerce, Science, and Transportation of the Senate;</text></subparagraph><subparagraph id="id6a316e24468040468ce126eb0beae902"><enum>(B)</enum><text>the Committee on Environment and Public Works of the Senate;</text></subparagraph><subparagraph id="idf65306d3106f465684efc234649e09da"><enum>(C)</enum><text>the Committee on Transportation and Infrastructure of the House of Representatives; and</text></subparagraph><subparagraph id="idc952ce7e15714c248799cd94ab9768f0"><enum>(D)</enum><text>the Committee on Energy and Commerce of the House of Representatives.</text></subparagraph></paragraph><paragraph id="id40a3e13ff35841fdb8511bf9f3530a18"><enum>(2)</enum><header>Clean power</header><text>The term <term>clean power</term> means power derived from a renewable energy source.</text></paragraph><paragraph id="id308cbdf8256d4531a587ae703d9fe403"><enum>(3)</enum><header>Covered product</header><subparagraph id="iddd614203c1f340b992ac483db45e6814"><enum>(A)</enum><header>In general</header><text>The term <term>covered product</term> means—</text><clause id="idc8df02503b0644ba8052d692da56c2f3"><enum>(i)</enum><text>energy—</text><subclause id="id3d8ff7f9a2c64a72bf0be4a4573b27a0"><enum>(I)</enum><text>used to power a facility; and</text></subclause><subclause id="idb23be5c0a20c4fb1b55d9aa441f12c3e"><enum>(II)</enum><text>the production of which comes from a renewable energy source; and</text></subclause></clause><clause id="idf1ce0324cae04ed29bfc769062dafe3a"><enum>(ii)</enum><text>a product that—</text><subclause id="iddf416195d04a408a919a060e3b88b22f"><enum>(I)</enum><text>is produced or manufactured—</text><item id="id455d2397c87f4a63b40ef0dd5140345d"><enum>(aa)</enum><text>in the United States (including the territories of the United States);</text></item><item id="idfb0c24508ea94040b093fada3816e897"><enum>(bb)</enum><text>in accordance with all relevant energy efficiency, environmental preference, and safety designations; and</text></item><item id="idb6ebe356e4b340e3af27cb05a7542e7d"><enum>(cc)</enum><text>by an entity that complies with the labor requirements under section 6; and</text></item></subclause><subclause id="id4cb71a3f3b6b41f4bbc7abfb0b8599eb"><enum>(II)</enum><text>reduces energy usage during the lifecycle of the product by—</text><item id="idc16838d2a5e94a73b083a79b35037db8"><enum>(aa)</enum><text>minimizing energy, water, or material resources associated with the product;</text></item><item id="id58380b72c54c4512a0fd2600d8e124ac"><enum>(bb)</enum><text>increasing opportunities for reuse and recycling due to the durability or repairability of the product; and</text></item><item id="id6742f0ea59364b3e8ad4bf3a2c46af41"><enum>(cc)</enum><text>improving environmental and human health impacts, including by encouraging a shift away from more energy-intensive or resource-extraction-intensive products.</text></item></subclause></clause></subparagraph><subparagraph id="id59e00c5a33684fd5bfbe8a54de27581d"><enum>(B)</enum><header>Inclusions</header><text>The term <term>covered product</term> includes a product described in subparagraph (A)(ii) that—</text><clause id="id535f22725df04e659faddd076f15169b"><enum>(i)</enum><text>is a nonmotorized alternative mode of transportation;</text></clause><clause id="id2057207e8c8d461f8bc76ef6edf110e1"><enum>(ii)</enum><text>is a zero-emission vehicle;</text></clause><clause id="id4f59107ce5c64641b587a846115b6da9"><enum>(iii)</enum><text>is a zero-emission form of public transportation, including high-speed rail;</text></clause><clause id="id26f0537cd9cc47bf925d527bd241cec4"><enum>(iv)</enum><text>is a product or low-carbon material used to design, construct, or retrofit buildings, including a product bearing the Green Seal certification;</text></clause><clause id="ide16fd8a8b7a34bd2b1f93d38a915f479"><enum>(v)</enum><text>improves the energy efficiency measures of facilities to make facilities environmentally responsible;</text></clause><clause id="idd82df8253c6347b3957fa5551b0ebc32"><enum>(vi)</enum><text>is a product used to maintain or clean buildings;</text></clause><clause id="idd5267c2088e347358803ca33054f5898"><enum>(vii)</enum><text>is an appliance certified under the Energy Star program established under section 324A of the Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6294a">42 U.S.C. 6294a</external-xref>);</text></clause><clause id="idd1065347d964480c9d800d228de90b04"><enum>(viii)</enum><text>is an electronics product bearing the Electronic Product Environmental Assessment Tool certification; or</text></clause><clause id="id60ca735a222a4573ab90502bc119d8e3"><enum>(ix)</enum><text>is an energy storage technology.</text></clause></subparagraph></paragraph><paragraph id="id6085d621a3844d3a97e11fb270232f09"><enum>(4)</enum><header>Covered small business</header><text>The term <term>covered small business</term> means—</text><subparagraph id="id0b1870807d974edf9f4d0afde6e06991"><enum>(A)</enum><text>a small business concern owned and controlled by socially and economically disadvantaged individuals (as defined in section 8(d)(3)(C) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/637">15 U.S.C. 637(d)(3)(C)</external-xref>));</text></subparagraph><subparagraph id="id670916054d86446881ecdfcc39058353"><enum>(B)</enum><text>a small business concern owned and controlled by women (as defined in section 3 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>)); and</text></subparagraph><subparagraph id="idf405157d559b40bd83bb597a6ca61de8"><enum>(C)</enum><text>a small business concern owned and controlled by veterans (as defined in section 3 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>)).</text></subparagraph></paragraph><paragraph id="idb2b6c9823ed94838a01c79692f8697ad"><enum>(5)</enum><header>Eligible material</header><text>The term <term>eligible material</term> means a material for which the Secretary establishes a maximum global warming potential under section 4(b).</text></paragraph><paragraph id="id50094ff19a854c0eaa191d7852c09456"><enum>(6)</enum><header>Environmentally responsible</header><text>The term <term>environmentally responsible</term>, with respect to a facility or manufacturing capability, means that—</text><subparagraph id="idb0ab705c5603456a8b7243e903d06a38"><enum>(A)</enum><text>the facility or manufacturing capability is in compliance with, or carried out in accordance with, as applicable, all relevant energy efficiency, environmental preference, and safety designations; and</text></subparagraph><subparagraph id="iddd3b2fa0a2594d85a7a48c3d1f83c61e"><enum>(B)</enum><text>in the case of a facility, the facility is built or retrofitted with materials that minimize the use of—</text><clause id="id564ee7f6662b4ba4b08a6840f7099a52"><enum>(i)</enum><text>energy;</text></clause><clause id="idf8646b67861d493d89d49bcb728af740"><enum>(ii)</enum><text>water;</text></clause><clause id="ida929eed9b9f640798d8df740b6c912b8"><enum>(iii)</enum><text>waste; and</text></clause><clause id="id2a6dc55a582e46c7bd70bbb110cf0666"><enum>(iv)</enum><text>material resources that produce pollutants or toxins, as determined by the Secretary.</text></clause></subparagraph></paragraph><paragraph id="id5dd0836ece484f5e8fe6a4a05a07f10c"><enum>(7)</enum><header>Federal building</header><text>The term <term>Federal building</term> has the meaning given the term in section 551 of the National Energy Conservation Policy Act (<external-xref legal-doc="usc" parsable-cite="usc/42/8259">42 U.S.C. 8259</external-xref>).</text></paragraph><paragraph id="id9cf03b4a7dfd46d98fe43382d34f5264"><enum>(8)</enum><header>Frontline, vulnerable, and disadvantaged community</header><text>The term <term>frontline, vulnerable, and disadvantaged community</term> means a community—</text><subparagraph id="id0e40cbf5b5184bd896b59f5f4f50c7b6" commented="no"><enum>(A)</enum><text>in an area described in section 301(a) of the Public Works and Economic Development Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3161">42 U.S.C. 3161(a)</external-xref>);</text></subparagraph><subparagraph id="id73e1aa3b43d0481295390f323bf5484d" commented="no"><enum>(B)</enum><text>in which climate change, pollution, or environmental destruction has exacerbated systemic racial, regional, social, environmental, gender, and economic injustices by disproportionately affecting Black, Brown, and Indigenous peoples, other communities of color, migrant communities, deindustrialized communities, depopulated rural communities, the poor, low-income workers, women, the elderly, the unhoused, people with disabilities, or youth;</text></subparagraph><subparagraph id="idc8005ffbc2c34e129a7bf032fd5e86ed" commented="no"><enum>(C)</enum><text>eligible for assistance under the Justice40 Initiative described in section 223 of Executive Order 14008 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> note; relating to tackling the climate crisis at home and abroad); or</text></subparagraph><subparagraph id="id5d1b3d0699794e908a12cb02b9182aed" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text>located in a census tract that has a high energy burden. </text></subparagraph></paragraph><paragraph id="id623dd0da2ec441eba11257d5c4f14217"><enum>(9)</enum><header>Fund</header><text>The term <term>Fund</term> means the Clean Energy Fund established under section 3(a).</text></paragraph><paragraph id="idd1fc7b45fd384598b77b9fe5145e0c34"><enum>(10)</enum><header>Global warming potential</header><text>The term <term>global warming potential</term>, with respect to an eligible material, means a measure that indicates how much energy the emissions of 1 ton of gases associated with the life cycle of that eligible material, including the manufacture, use, and disposal of that eligible material, will absorb, on average, over a given period of time, relative to the emissions of 1 ton of carbon dioxide.</text></paragraph><paragraph id="idc78a1664d54e4faeaa5c3df0ffff5bf4"><enum>(11)</enum><header>Oversight advisory board</header><text>The term <term>Oversight Advisory Board</term> means the Green Procurement Oversight Advisory Board established under section 7.</text></paragraph><paragraph id="idded734622166430a9b631085d5fe6c4a"><enum>(12)</enum><header>Renewable energy source</header><text>The term <term>renewable energy source</term> means energy generated from a renewable source, including the following renewable energy sources:</text><subparagraph id="id608cf48e5eec4f1e806e504a312e8cb6"><enum>(A)</enum><text>Solar, including electricity.</text></subparagraph><subparagraph id="ida613a561d08a4fce8606b2acbba4f680"><enum>(B)</enum><text>Wind.</text></subparagraph><subparagraph id="id9d95f85e6f904a7b9ce282f21e683755"><enum>(C)</enum><text>Ocean, including tidal, wave, current, and thermal.</text></subparagraph><subparagraph id="id03bd60d76a71482695cd75039eca8c11"><enum>(D)</enum><text>Geothermal, including electricity and heat pumps.</text></subparagraph><subparagraph id="id14ef972003ce4e38bf3973f97703a361"><enum>(E)</enum><text>Hydroelectric generation capacity achieved from increased efficiency or additions of new capacity at an existing hydroelectric project that was placed in service on or after January 1, 1999.</text></subparagraph><subparagraph id="idad1e8e9b1ad645898efbca36f4bdd94c"><enum>(F)</enum><text>Hydrogen derived from a renewable source of energy.</text></subparagraph><subparagraph id="idce009a3ed2624a3c9d1812bc2a80a9eb"><enum>(G)</enum><text>Thermal energy generated by any of the sources described in subparagraphs (A) through (F).</text></subparagraph></paragraph><paragraph id="id6cb5e65ff77b4ae3bffa5444ffa743c9"><enum>(13)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Energy.</text></paragraph><paragraph id="idd757fe69da694b9b917799182a9dc26c"><enum>(14)</enum><header>Small business</header><text>The term <term>small business</term> has the meaning given the term <term>small business concern</term> in section 3 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>).</text></paragraph></section><section id="idf6f16692b63040ef9a649fb5d752dfea"><enum>3.</enum><header>Establishment of Clean Energy Fund</header><subsection id="id1d0778b86579406786b034800c5ceee4"><enum>(a)</enum><header>In general</header><text>Not later than January 1, 2026, the Secretary shall establish a fund in the Department of Energy, to be known as the <quote>Clean Energy Fund</quote>.</text></subsection><subsection id="id5d8b4260eaf6432da1a674c3a54e41e2"><enum>(b)</enum><header>Use of fund</header><paragraph id="id6ac4f60adfcf4be18f36c2991ed2fef1"><enum>(1)</enum><header>In general</header><text>The Secretary shall—</text><subparagraph id="ida06d9c6dbc8d4651b4345692f371326c"><enum>(A)</enum><text>use amounts in the Fund—</text><clause id="idb1c1fc8314be4962863f226d9c8eb685"><enum>(i)</enum><text>to purchase covered products for use by the Secretary, including covered products relating to information technology and general supplies and services, in accordance with subsection (g) and section 5;</text></clause><clause id="idd379023130e84d449c162602cefa383f"><enum>(ii)</enum><text>to establish and carry out the grant programs under subsections (c) and (d); and</text></clause><clause id="id54e1894b96284a92949374fe21f1f85b"><enum>(iii)</enum><text>to carry out the Federal building activities described in subsection (e); and</text></clause></subparagraph><subparagraph id="id3bf587bcc35c4a5b880b6b952a483f64"><enum>(B)</enum><text>transfer amounts from the Fund—</text><clause id="id485613d34bb14eeab23175422f45d08b"><enum>(i)</enum><text>to 1 or more Federal agencies (excluding the Department of Defense)—</text><subclause id="id2d09d4851bda4b9583e3799564fe2e7b"><enum>(I)</enum><text>to purchase covered products for use by the Federal agency, in accordance with subsection (g) and section 5; and</text></subclause><subclause id="id064e0ea189f343e480359f92d82707da"><enum>(II)</enum><text>to carry out the Federal building activities described in subsection (e); and</text></subclause></clause><clause id="ideea270cabb1a4e8e8be8da14b37926e5"><enum>(ii)</enum><text>to the Administrator of General Services to carry out subsection (f).</text></clause></subparagraph></paragraph><paragraph id="idcde40d279d004e0381f3ae74ba1aed59"><enum>(2)</enum><header>Purchases from small businesses</header><text>Of the amounts from the Fund made available to a Federal agency in a fiscal year, the head of the Federal agency shall ensure that not less than 20 percent is used to purchase covered products from small businesses and covered small businesses.</text></paragraph></subsection><subsection id="idebe24f8252f34c98848cb8cb313f6796"><enum>(c)</enum><header>State, tribal, and local government grant program</header><paragraph id="id286e3b10596d435a86f4f9527718b684"><enum>(1)</enum><header>In general</header><text>Not later than January 1, 2026, the Secretary, in coordination with the Secretary of the Treasury, shall establish a green procurement grant program under which the Secretary shall provide grants on a competitive basis to States, Indian Tribes, and units of local government to purchase covered products for use by the State, Indian Tribe, or unit of local government, as applicable, in accordance with subsection (g), section 5, and the labor requirements under section 6.</text></paragraph><paragraph id="idf1f1753918bc46e5bd2800c75a664495"><enum>(2)</enum><header>Selection of grant recipients</header><text>The Secretary shall—</text><subparagraph id="ide289e588078b4ebc95e384d6d88c9543"><enum>(A)</enum><text>share with the Oversight Advisory Board applications received under the grant program established under paragraph (1); and</text></subparagraph><subparagraph id="idd4057e4d67294b1ba00dccdad90af843"><enum>(B)</enum><text>in coordination with the Secretary of the Treasury, select grant recipients under that program after receiving the recommendations of the Oversight Advisory Board relating to grant recipients.</text></subparagraph></paragraph><paragraph id="id1bb46a236e4c4c0a83a99c16fd28c711"><enum>(3)</enum><header>Distribution of grants</header><text>Of the amounts available in the Fund in a fiscal year to carry out the program under paragraph (1), the Secretary shall ensure that—</text><subparagraph id="idb40f1f8d2d10404f9b58c413ab2087cc"><enum>(A)</enum><text>not less than 60 percent, but not more than 65 percent, of the amount of a grant awarded to a State, Indian Tribe, or unit of local government shall be used to purchase covered products for use in urban areas located in or under the jurisdiction of the State, Indian Tribe, or unit of local government, as applicable;</text></subparagraph><subparagraph id="idda94dddf2d23489e8794aeabc19a4c36"><enum>(B)</enum><text>not less than 40 percent of the amount of a grant awarded to a State, Indian Tribe, or unit of local government shall be used to purchase covered products for use in frontline, vulnerable, and disadvantaged communities located in or under the jurisdiction of the State, Indian Tribe, or unit of local government, as applicable; and</text></subparagraph><subparagraph id="idd5ca94e892354d828d0ca65738326278"><enum>(C)</enum><text>not less than 20 percent of the amount of a grant awarded to a State, Indian Tribe, or unit of local government shall be used to purchase covered products from small businesses and covered small businesses.</text></subparagraph></paragraph><paragraph id="id5fcea4c0764b4df7adf122bcb4475eed"><enum>(4)</enum><header>Priority for school bus electrification</header><text>In providing grants under paragraph (1), the Secretary shall give priority to States, Indian Tribes, and units of local government that will use the grant for the electrification of school buses in frontline, vulnerable, and disadvantaged communities and subsequently in all other communities located in or under the jurisdiction of the State, Indian Tribe, or unit of local government, as applicable.</text></paragraph><paragraph id="id1da46efa0cc543e48982148179eeb912"><enum>(5)</enum><header>Duration of grant</header><text>Funds provided under a grant under paragraph (1) shall be available to the State, Indian Tribe, or unit of local government receiving the grant for not less than 3 years after the date on which the funds are provided.</text></paragraph></subsection><subsection id="idda97f2a5aa024028be6431c316be3033"><enum>(d)</enum><header>Industry grants</header><paragraph id="idaa8b9e8b4cf14cd89fa58ca6ef065472"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="id19199963a62646f59bedc5f22805b907"><enum>(A)</enum><header>Eligible entity</header><clause id="id66b915e0f32a49e2b86576aecaa01ded"><enum>(i)</enum><header>In general</header><text>The term <term>eligible entity</term> means a company that—</text><subclause id="idc7d404b40c8242b59b1c6b816efdd8e4"><enum>(I)</enum><text>is organized under the laws of the United States or any jurisdiction within the United States; or</text></subclause><subclause id="id02da27d6cd6d49e9885a605dc8fb29fd"><enum>(II)</enum><text>is otherwise subject to the jurisdiction of the United States.</text></subclause></clause><clause id="id1235e45217674d449be794bb2e737063"><enum>(ii)</enum><header>Exclusion</header><text>The term <term>eligible entity</term> does not include a foreign branch of a company described in clause (i).</text></clause></subparagraph><subparagraph id="ide52546aecb2f474fae7858ba39685f1f"><enum>(B)</enum><header>Greenhouse gas emissions</header><text>The term <term>greenhouse gas emissions</term> means emissions of any of the following gases:</text><clause id="id7fe176166b2e40309c3e846cc93ecab8"><enum>(i)</enum><text>Carbon dioxide.</text></clause><clause id="id6d2b23e5f288452d88966370fd4967ce"><enum>(ii)</enum><text>Methane.</text></clause><clause id="id7e874e8322a0487a8dc0afbbf6352fc2"><enum>(iii)</enum><text>Nitrous oxide.</text></clause><clause id="idbb2a58f30683440396af076617a5e153"><enum>(iv)</enum><text>Hydrofluorocarbons.</text></clause><clause id="idb4b4f35309a7445c88867e8c0d96c3d5"><enum>(v)</enum><text>Perfluorocarbons.</text></clause><clause id="id0e896bc11c8841639c5432d512e25d5e"><enum>(vi)</enum><text>Sulfur hexafluoride.</text></clause><clause id="ida674e4ccfd6b4b76833afe48675a99ce"><enum>(vii)</enum><text>Nitrogen trifluoride.</text></clause></subparagraph></paragraph><paragraph id="idae31cfa13274455492926f9b9c51d0c1"><enum>(2)</enum><header>Establishment</header><text>Not later than January 1, 2026, the Secretary shall establish a program under which the Secretary shall provide grants, on a competitive basis, to eligible entities—</text><subparagraph id="id19a19241423e4e8a9e432a03d9c5a7b8"><enum>(A)</enum><text>to retrofit or otherwise upgrade facilities that produce covered products, including to make those facilities environmentally responsible; and</text></subparagraph><subparagraph id="idb47d65ec16414363815a67fdd7aaa40b"><enum>(B)</enum><text>for the development of environmentally responsible manufacturing capabilities to bolster the production of covered products, including by—</text><clause id="id4406c31d675c433daedb3cf229c11c0d"><enum>(i)</enum><text>constructing new environmentally responsible facilities in the United States for the production of covered products; and</text></clause><clause id="idef1fec8b39624f50bae9cd33973364db"><enum>(ii)</enum><text>retrofitting or otherwise upgrading existing facilities in the United States—</text><subclause id="id920f559a782e4c8aaa930f28202ce3eb"><enum>(I)</enum><text>to produce covered products; and</text></subclause><subclause id="id9694523c47ab4c9ea8022bf05c15d59c"><enum>(II)</enum><text>to make those facilities environmentally responsible.</text></subclause></clause></subparagraph></paragraph><paragraph id="id9e46525cc793481fb50d918980c1b751"><enum>(3)</enum><header>Selection of grant recipients</header><text>In providing grants under paragraph (2), the Secretary shall—</text><subparagraph id="id142da5af8cc94a56a5a50019bdfa57a2"><enum>(A)</enum><text>share grant applications with the Oversight Advisory Board;</text></subparagraph><subparagraph id="ide855f512613845d4b691612e140980ed"><enum>(B)</enum><text>select grant recipients after receiving the recommendations of the Oversight Advisory Board relating to grant recipients;</text></subparagraph><subparagraph id="id2622812aeffe45fc825e59ffe115dc04"><enum>(C)</enum><text>consider—</text><clause id="ida8b4306c86304cdea4415e411807669d"><enum>(i)</enum><text>any labor, health or safety, or discrimination charges filed against the eligible entity in the preceding 2 years;</text></clause><clause id="id8a828cd66f264fc897fb0d87a0a8045a"><enum>(ii)</enum><text>any violations of the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/151">29 U.S.C. 151 et seq.</external-xref>) reported to the National Labor Relations Board in the preceding 2 years;</text></clause><clause id="id37fd0e32abeb48cabe9c49b63803c0a7"><enum>(iii)</enum><text>as applicable, whether wages and benefits for auto workers are not less than the industry standards for wages and benefits for auto workers who are represented by a labor organization;</text></clause><clause id="idddda417f9405429da498642415283918"><enum>(iv)</enum><text>whether jobs created for purposes of activities supported through the grant will be permanent positions, rather than temporary or contingent positions;</text></clause><clause id="id25b30b83c3ba40d1bf208c16b31300bc"><enum>(v)</enum><text>whether training required under the Occupational Safety and Health Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/29/651">29 U.S.C. 651 et seq.</external-xref>) will be provided for employees, including any safety supervisors;</text></clause><clause id="id7206329e8db74430ad8fc959c894de38"><enum>(vi)</enum><text>the policy of the eligible entity with respect to coverage of workers’ compensation; and</text></clause><clause id="id463c4b13bba344f387e036a8396a9d02"><enum>(vii)</enum><text>whether the work sites that will be used for activities supported through the grant have independent health and safety monitoring policies; and</text></clause></subparagraph><subparagraph id="id3219ea84143c4f2cb4f12723151e77bb"><enum>(D)</enum><text>prioritize applications that specify that the eligible entity—</text><clause id="idebf8304331f64f72b4a6aee08fd19e55"><enum>(i)</enum><text>participates or will participate in a registered apprenticeship program; or</text></clause><clause id="id998755ed46dc4cacb69839ac7f16f7b6"><enum>(ii)</enum><text>prioritizes the employment of individuals trained and certified by labor organizations, or joint labor-management organizations, that promote a skilled workforce with high standards for quality and safety.</text></clause></subparagraph></paragraph><paragraph id="id6c63768fc9fb4e238aa4ae6c301b2310"><enum>(4)</enum><header>Requirement</header><text>An eligible entity receiving a grant under paragraph (2) shall comply with the labor requirements under section 6 with respect to the activities carried out using, or otherwise supported by, the grant.</text></paragraph><paragraph id="id5dae8c935d5e48b69b0f0d50339a10ad"><enum>(5)</enum><header>Submission of environmental product declaration</header><text>The Secretary shall require each eligible entity to which the Secretary awards a grant under paragraph (2) to submit to the Secretary, for each eligible material proposed to be used in the applicable project—</text><subparagraph id="idfc489431d7c14e4e962b10df8aa0fff9"><enum>(A)</enum><text>a current, facility-specific, Type III environmental product declaration (as defined by the International Organization for Standardization standard 14025); or</text></subparagraph><subparagraph id="id099c8b28edec4f95838ec5e7268ccfd1"><enum>(B)</enum><text>a declaration made under a similarly robust life cycle assessment method that has—</text><clause id="id23fc4cdab8244e7aa3d0f488a674e263"><enum>(i)</enum><text>uniform standards in data collection consistent with that standard;</text></clause><clause id="id227aa16a3c86489586df6607dd310d61"><enum>(ii)</enum><text>industry acceptance; and</text></clause><clause id="id38de4f7ba9974e6eb3902d6fa91c4fed"><enum>(iii)</enum><text>integrity.</text></clause></subparagraph></paragraph><paragraph id="id6530e64cbd3b49bbbbb08894a4c6122c"><enum>(6)</enum><header>Certifications</header><text>The Secretary shall require that any application for a grant under paragraph (2) shall include a certification that the facility-specific global warming potential for any eligible material proposed to be used in that project does not exceed the maximum acceptable global warming potential established under paragraph (1) of section 4(b) (as adjusted under paragraph (2)(A)(ii) of that section, if applicable) for that eligible material.</text></paragraph><paragraph id="id730f7daec54a4a2097df6e8e95600a12"><enum>(7)</enum><header>Goal</header><text>In carrying out this subsection, the Secretary shall strive to achieve a continuous reduction of greenhouse gas emissions over time.</text></paragraph><paragraph id="id5eb4de02ce20454faa035d420164ae53"><enum>(8)</enum><header>Purchases from small businesses</header><text>Of the amounts made available under subsection (j) in a fiscal year to carry out the grant program established under paragraph (2), the Secretary shall ensure that not less than 20 percent is used to provide grants under that program to eligible entities that are small businesses or covered small businesses.</text></paragraph><paragraph id="id57f5b67ebb7b4b818e27a29b07be9d18"><enum>(9)</enum><header>Report on implementation and effectiveness</header><text>Not later than January 1, 2026, the Secretary shall submit to the appropriate committees of Congress and the Oversight Advisory Board a report describing—</text><subparagraph id="id22414c58211644f287354cb94aadb169"><enum>(A)</enum><text>any obstacles to the implementation of the grant program established under this subsection;</text></subparagraph><subparagraph id="id13d92aecbda042798671f1ee437d161c"><enum>(B)</enum><text>the effectiveness of the grant program in reducing—</text><clause id="id4cf93050abb243598892523b7208ce12"><enum>(i)</enum><text>greenhouse gas emissions; and</text></clause><clause id="id80844cd470ec4939b4d2ac991eb73186"><enum>(ii)</enum><text>the global warming potential for eligible materials; and</text></clause></subparagraph><subparagraph id="id44c93a7ea0a44a54bc0c02e42ec3244a"><enum>(C)</enum><text>the effectiveness of the grant program in—</text><clause id="idf19e5b8941694d6ca47a39f784b27c1c"><enum>(i)</enum><text>creating and maintaining jobs in the United States that comply with the labor requirements under section 6; and</text></clause><clause id="id7114f21b1a054305b17cbeaad5df82f8"><enum>(ii)</enum><text>protecting the rights of workers in the United States, including the right of certain workers to organize and bargain collectively.</text></clause></subparagraph></paragraph></subsection><subsection id="id9766757dc60e45ef8d84f79267d23961"><enum>(e)</enum><header>Federal building activities</header><text>The Federal building activities referred to in subsection (b) are, with respect to a Federal agency, activities—</text><paragraph id="id55e60e40927943609ecfa5f2528b4bda"><enum>(1)</enum><text>to construct new, modern Federal buildings of that Federal agency, including new hospitals, medical centers, and clinics in the case of the Department of Veterans Affairs, that are sustainable and resilient, including through the purchase of low-carbon materials for that construction; and</text></paragraph><paragraph id="id39f7cba967fd46da93ebb929c002bd78"><enum>(2)</enum><text>to modernize, and improve the sustainability and resilience of, Federal buildings of that Federal agency, including hospitals, medical centers, and clinics in the case of the Department of Veterans Affairs, including through—</text><subparagraph id="id6b4ae11114494f4d9bbb2a35c344a10c"><enum>(A)</enum><text>the purchase of low-carbon materials for retrofitting, remodeling, or otherwise improving Federal buildings; and</text></subparagraph><subparagraph id="ide31c638eabd7480588e33b5c2dd52914"><enum>(B)</enum><text>the purchase of clean power for Federal buildings.</text></subparagraph></paragraph></subsection><subsection id="id9867898648e84464b32fc3a7ad748f7e"><enum>(f)</enum><header>Replacement of Federal Fleet</header><text>Using amounts from the Fund, the Administrator of General Services shall purchase zero-emission vehicles to replace the existing Federal fleet (as defined by the term <term>fleet</term> in section 301 of the Energy Policy Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/42/13211">42 U.S.C. 13211</external-xref>)) so that by the end of fiscal year 2033 the entire Federal fleet consists of zero-emission vehicles.</text></subsection><subsection id="ide44846c586354ba0872283faee0471d9"><enum>(g)</enum><header>Priority for purchasing covered products</header><text>A Federal agency, State, Indian Tribe, or unit of local government purchasing covered products pursuant to this section shall give priority to purchasing covered products that—</text><paragraph id="id426cd679afc247f3a3bfaa9985dbfc56"><enum>(1)</enum><text>are made from renewable and recycled resources (including biobased products);</text></paragraph><paragraph id="id3f353af50a764fd590e1e53bd56df378"><enum>(2)</enum><text>have lower lifecycle emissions than comparable products; and</text></paragraph><paragraph id="id38dd59ffca034f6780059e9609ad59bd"><enum>(3)</enum><text>are designed for—</text><subparagraph id="id4bf769493fc14869b82ad2766357d4ea"><enum>(A)</enum><text>reducing environmental impacts; and</text></subparagraph><subparagraph id="id064dc4cd99c245feb57a2b35e1c4ca69"><enum>(B)</enum><text>recycling.</text></subparagraph></paragraph></subsection><subsection id="id656e56ee4125485f83fdc8d1c11509d1"><enum>(h)</enum><header>Buy american</header><paragraph id="idaacbafa2957a4aa18355418ca4d50619"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/41/83">Chapter 83</external-xref> of title 41, United States Code, shall apply with respect to purchases of covered products made pursuant to this section—</text><subparagraph id="id75439abbf2914a8ab6c996f7bde6e203"><enum>(A)</enum><text>by a Federal agency; and</text></subparagraph><subparagraph id="id113843d905f84edfb4d1e310921032fa"><enum>(B)</enum><text>in the case of purchases by a non-Federal entity, in the same manner in which that chapter applies to the Federal Government.</text></subparagraph></paragraph><paragraph id="id7c843ccfc8ca4393a3f2b3f302412b9b"><enum>(2)</enum><header>Exceptions and waivers</header><text>The Secretary shall, to the maximum extent practicable, minimize the number of exceptions and waivers granted under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/41/83">chapter 83</external-xref> of title 41, United States Code, with respect to purchases of covered products made pursuant to this section.</text></paragraph></subsection><subsection id="id83f29db20ab6437caad6e69d7c64b126"><enum>(i)</enum><header>Report</header><text>Not less frequently than once each fiscal year, the Secretary shall submit to the appropriate committees of Congress and the Oversight Advisory Board a report that—</text><paragraph id="idc38b3a4941ed4beebb0bc5f57738c4d1"><enum>(1)</enum><text>describes the activities carried out using amounts in the Fund, including data on the clean power purchased under subsection (e)(2)(B);</text></paragraph><paragraph id="id58d3399d017f43dfb4ee3b45f9a69a72"><enum>(2)</enum><text>includes data on the covered products purchased pursuant to those activities; and</text></paragraph><paragraph id="id4a9f79ef382f44028dcd2983ebd134df"><enum>(3)</enum><text>includes data on compliance with subsection (h).</text></paragraph></subsection><subsection id="id0ddc08ccac5a4736b8b47e4c12afa495"><enum>(j)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Fund $1,500,000,000,000 for the period of fiscal years 2026 through 2035, to remain available until January 1, 2045, of which not less than—</text><paragraph id="ide380bac3a3df4e8894ae6acba2f837d1"><enum>(1)</enum><text>$750,000,000,000 shall be used to carry out the grant program established under subsection (c); and</text></paragraph><paragraph id="id45d0c6b4a3f54c1aa31cae40c042a2c2"><enum>(2)</enum><text>$250,000,000,000 shall be used to carry out the grant program established under subsection (d).</text></paragraph></subsection></section><section id="id19999ed0d93b402dbe13b265e85db442"><enum>4.</enum><header>Procurement practices for the Department of Energy</header><subsection id="idc3ff04edcb1745d180abcebb8e29c428"><enum>(a)</enum><header>Senior procurement officer</header><text>The Secretary shall—</text><paragraph id="id966607aa24dd432ab70443cc27737d7e"><enum>(1)</enum><text>be designated as the senior procurement officer for the Department of Energy; and</text></paragraph><paragraph id="id7eb93c0b200e4b97904c9d004afaed06"><enum>(2)</enum><text>coordinate with the Director of the Office of Management and Budget in carrying out procurement for the Department of Energy.</text></paragraph></subsection><subsection id="ide0e2a72783e94f8595f623fb033982d7"><enum>(b)</enum><header>Maximum acceptable global warming potential of eligible materials</header><paragraph id="id7a06ef8e7c70408696bd0421731c9789"><enum>(1)</enum><header>Establishment</header><subparagraph id="id0ad1ba9cb77e46b3a9c3aad9287d4e92"><enum>(A)</enum><header>In general</header><text>Not later than January 1, 2025, the Secretary shall establish, and publish in the Federal Register—</text><clause id="idf7f72387690244fa8174fd816d5808dc"><enum>(i)</enum><text>an initial list of materials for which the Secretary shall establish a maximum acceptable global warming potential under this subsection; and</text></clause><clause id="idab77030041ad4ca19aee803b7a19273d"><enum>(ii)</enum><text>the maximum acceptable global warming potential for each material identified on that list, as determined in accordance with subparagraph (B).</text></clause></subparagraph><subparagraph id="idcd8d3eb82a8b46cea8d997c6fa50dc4e"><enum>(B)</enum><header>Requirements</header><clause id="ideea2d787868c4011abed402725742845"><enum>(i)</enum><header>Industry average</header><subclause id="id5be154b8492648cfa2f9740b3bf1be62"><enum>(I)</enum><header>In general</header><text>The maximum acceptable global warming potential for an eligible material under subparagraph (A) shall be expressed as a number that is equal to the industry average of facility-specific global warming potential emissions for that eligible material, as determined under subclause (II).</text></subclause><subclause id="id3008de2cd7184920994fbf30815ca058"><enum>(II)</enum><header>Determination</header><text>The Secretary shall determine the industry average described in subclause (I) for an eligible material by consulting nationally or internationally recognized databases of environmental product declarations.</text></subclause></clause><clause id="idcaea53092d1a425cb840f83ec10e64f7"><enum>(ii)</enum><header>Consistency with environmental product declaration</header><text>Each maximum acceptable global warming potential established under subparagraph (A) shall be established in a manner that is consistent with the requirements of an environmental product declaration.</text></clause></subparagraph><subparagraph id="idd27a8ebbbbe44efabea46c0ad5270e54"><enum>(C)</enum><header>Report</header><text>Not later than January 1, 2026, the Secretary shall submit to the appropriate committees of Congress and the Oversight Advisory Board a report that describes the method that the Secretary used to develop the maximum global warming potential for each eligible material under subparagraph (A).</text></subparagraph></paragraph><paragraph id="idc16f59e2756e40f69a997ebe628fe431"><enum>(2)</enum><header>Review and adjustment</header><subparagraph id="id83aefde665464716ab419885f0c8694e"><enum>(A)</enum><header>In general</header><text>Not later than January 1, 2029, and every 3 years thereafter through 2045, the Secretary—</text><clause id="idcdafdd182b92412f997075dda9ac4d44"><enum>(i)</enum><text>shall review the maximum acceptable global warming potential established under paragraph (1) for each eligible material; and</text></clause><clause id="id68d63f15c3d34c80a8798aa352fe44fa"><enum>(ii)</enum><text>may adjust that maximum acceptable global warming potential for an eligible material downward to reflect industry improvements if the Secretary, based on the process described in paragraph (1)(B)(i)(II), determines that the industry average has changed.</text></clause></subparagraph><subparagraph id="idd520f29dfd72442d92e90064cb3aae99"><enum>(B)</enum><header>Publication</header><text>If the Secretary adjusts the maximum acceptable global warming potential of an eligible material downward under subparagraph (A)(ii), the Secretary shall publish the updated maximum global warming potential in the Federal Register.</text></subparagraph><subparagraph id="idcf88dcc1714343d19dd1e0a3a940f866"><enum>(C)</enum><header>Prohibition</header><text>After establishing the maximum acceptable global warming potential for an eligible material under paragraph (1), the Secretary may not adjust that maximum acceptable global warming potential upward.</text></subparagraph></paragraph></subsection></section><section id="ide518a829dd2a4db2b380f544d1fc1330"><enum>5.</enum><header>Requirements for procurement of covered products</header><text display-inline="no-display-inline">An entity procuring a covered product pursuant to this Act shall ensure that the procurement—</text><paragraph id="id8c314579e4e2427e89c74f736c7f5c87"><enum>(1)</enum><text>is conducted in compliance with all applicable laws regarding fair and open competition in contracting;</text></paragraph><paragraph id="id14aabdc53cd742fdbb0d48472161bd65"><enum>(2)</enum><text>is subject to appropriate cost controls;</text></paragraph><paragraph id="idcbb0f5d40d5047b6aa2448e1b6058ef0"><enum>(3)</enum><text>provides for whistleblower protections for employees of contractors and subcontractors;</text></paragraph><paragraph id="iddda42bb4dc3a47a9a2e6bab0b41ba6e1"><enum>(4)</enum><text>requires contractors and subcontractors to retain records pertinent to contract performance;</text></paragraph><paragraph id="idf07b6f03991a4ecdbbe62f26f6fc07ed"><enum>(5)</enum><text>requires contractors to submit to the entity audited financial statements covering the contract performance period; and</text></paragraph><paragraph id="idb3260c03d88c4a8582efaebe82d3cba8"><enum>(6)</enum><text>is conducted in compliance with section 552 of title 5, United States Code (commonly known as the <quote>Freedom of Information Act</quote>) and other applicable open records laws.</text></paragraph></section><section id="id6413238417ac4e8698c8a310ef66cb36"><enum>6.</enum><header>Labor requirements</header><subsection id="id24a365897af34ed3bef74e12ff2cf936"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idd2b45e44c3924f6da24c914cd168c602"><enum>(1)</enum><header>Covered activities</header><text>The term <term>covered activities</term> means—</text><subparagraph id="ida11d4d6b9b024737ab4ba50547542427"><enum>(A)</enum><text>with respect to a covered entity described in subparagraph (A) of paragraph (2), activities involving producing or manufacturing a covered product; or</text></subparagraph><subparagraph id="ida331e2321a784918b11dad6182de18b7"><enum>(B)</enum><text>with respect to a covered entity described in subparagraph (B) of such paragraph, activities supported by the grant described in such subparagraph.</text></subparagraph></paragraph><paragraph id="id14ea5ca04ae44fe08523df12468bca7c"><enum>(2)</enum><header>Covered entity</header><text>The term <term>covered entity</term> means—</text><subparagraph id="id3db9de0844d04d5cadfd5d47c571c934"><enum>(A)</enum><text>an entity producing or manufacturing a covered product; or</text></subparagraph><subparagraph id="id15f9304522c748eaa43e9c086764e2d8"><enum>(B)</enum><text>an entity receiving a grant under this Act.</text></subparagraph></paragraph></subsection><subsection id="id10c3fdfe8a67469c9c5a8a94acd63ea3"><enum>(b)</enum><header>Requirements</header><text>The labor requirements under this section with respect to a covered entity are each of the following:</text><paragraph id="idb1b4a45beb7042f3a7ef08561e814e23"><enum>(1)</enum><header>Minimum wage</header><subparagraph id="id8378c9b63c324d5f9e6f970ab12f123c"><enum>(A)</enum><header>In general</header><text>All employees employed in the performance of covered activities shall be paid at a rate of not less than—</text><clause id="id37fbdfad49be4844a274bd4cc23a2e84"><enum>(i)</enum><text>$17.00 an hour, beginning on the date of enactment of this Act; and</text></clause><clause id="id8a2ada276774418192a0ad514a6521b2"><enum>(ii)</enum><text>beginning on the date that is 1 year after such date of enactment, and annually thereafter, the amount in effect under this subparagraph for the preceding year, increased by the annual percentage increase, if any, in the median hourly wage of all employees as determined by the Bureau of Labor Statistics and rounded up to the nearest multiple of $0.05 (if not otherwise a multiple of $0.05).</text></clause></subparagraph><subparagraph id="idb5744ffd83834315b203498f7cd3675c"><enum>(B)</enum><header>Calculation</header><text>In calculating the annual percentage increase in the median hourly wage of all employees for purposes of subparagraph (A)(ii), the Secretary of Labor, through the Bureau of Labor Statistics, shall—</text><clause id="idc231540bc8b54dbfa159c951a3c0832b"><enum>(i)</enum><text>compile data on the hourly wages of all employees to determine such a median hourly wage; and</text></clause><clause id="id23320a7f9e75478b96f6230dc02fca84"><enum>(ii)</enum><text>compare such median hourly wage for the most recent year for which data are available with the median hourly wage determined for the preceding year.</text></clause></subparagraph><subparagraph id="id44becbeff08f4f5997cbc4e58390c0c2"><enum>(C)</enum><header>Prevailing wages for laborers and mechanics</header><clause id="idde3095d6f4834f3d8591584e330a5ba4"><enum>(i)</enum><header>In general</header><text>All laborers and mechanics employed by a covered entity in the performance of construction, alteration, or repair work carried out with respect to covered activities shall be paid wages at rates not less than the greater of—</text><subclause id="id3adae56247834be09470a2f24fab3743"><enum>(I)</enum><text>the rates prevailing on similar construction in the locality as determined by the Secretary of Labor in accordance with subchapter IV of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/40/31">chapter 31</external-xref> of title 40, United States Code; or</text></subclause><subclause id="ida68db1dc4a10435b9a5f579881b84f6a"><enum>(II)</enum><text>the rate required under subparagraph (A).</text></subclause></clause><clause id="id6d71c7b1f5bf452d8038e27727abd4f2"><enum>(ii)</enum><header>Authorities</header><text>With respect to the labor standards specified in clause (i)(I), the Secretary of Labor shall have the authority and functions set forth in Reorganization Plan Numbered 14 of 1950 (64 Stat. 1267; 5 U.S.C. App.) and section 3145 of title 40, United States Code.</text></clause></subparagraph><subparagraph id="idbe213924607b439693629c6252ffa929"><enum>(D)</enum><header>Requirements applicable to vehicle production</header><clause id="id358a1413580d4c73b7d486bcb4b4ab0f"><enum>(i)</enum><header>Definitions</header><text>In this subparagraph:</text><subclause id="iddec97a2ad12b45058666ae073176d487"><enum>(I)</enum><header>Covered production worker</header><text>The term <term>covered production worker</term> means a worker who—</text><item id="id3430700f64814296b80d4db83b574ebf"><enum>(aa)</enum><text>is employed by an establishment in the Motor Vehicle Manufacturing industry (Code 3361 of the North American Industry Classification System);</text></item><item id="idb172a2d6e3454888a69e262314262e55"><enum>(bb)</enum><text>is directly involved in the production of a vehicle; and</text></item><item id="id62ee74388c4849cf9a67eb1fd5df60dd"><enum>(cc)</enum><text>is not a manager, engineer, or involved in research and development, or does not have a skilled trade.</text></item></subclause><subclause id="ide9ffc94310354ea994663e90e82d4bd7"><enum>(II)</enum><header>Industry standard wage rate</header><text>The term <term>industry standard wage rate</term>, with respect to covered production workers, means the median wage rate for all covered production workers, as determined by the Secretary of Labor in accordance with clause (iv).</text></subclause><subclause id="id52394f5b5cef46bcb5ee5eaee59b2f99"><enum>(III)</enum><header>Top earning wage rate</header><text>The term <term>top earning wage rate</term> means the value of the wage rate for which 75 percent of covered production workers earn less, as determined by the Secretary of Labor in accordance with clause (iv).</text></subclause></clause><clause id="idd30871e7578744b8bf53c4dcc9d44831"><enum>(ii)</enum><header>Minimum wage rate</header><text>Notwithstanding any other requirement in this section, the covered entity shall ensure that—</text><subclause id="id912de4f2224847bca09bdbbdbb2554bb"><enum>(I)</enum><text>the average rate of pay for all covered production workers employed, directly by a manufacturer or through a subcontractor or employment services agency, in the performance of covered activities is not less than the industry standard wage rate for covered production workers; and</text></subclause><subclause id="id919e8fcc030d4211b5892932cba3dc09"><enum>(II)</enum><text>all covered production workers described in subclause (I) are paid not less than the rate in effect under subparagraph (A).</text></subclause></clause><clause id="id937f292c9a734f479b231a3275102e31"><enum>(iii)</enum><header>Pathway to top earning wage rate</header><text>The covered entity shall ensure that all covered production workers employed, directly by a manufacturer or through a subcontractor or employment services agency, in the performance of covered activities, are covered by a policy determined in a labor organization contract or a written company policy that provides, to the extent practicable, a pathway for such workers to earn the top earning wage rate not later than 7 years after beginning such employment.</text></clause><clause id="id8cf27fd40ec44723b7944dbb326359c5"><enum>(iv)</enum><header>Determining wages of workers in the industry</header><text>For purposes of this subparagraph, in determining for a year the industry standard wage rate and the top earning wage rate, the Secretary of Labor shall use the National Industry-Specific Occupational Employment and Wage Estimates, for the preceding year, for the Motor Vehicle Manufacturing industry (Code 3361 of the North American Industry Classification System) for the occupation of Assemblers and Fabricators (Occupational Code 51–2000 of the Occupational Employment Statistics of the Bureau of Labor Statistics). </text></clause></subparagraph></paragraph><paragraph id="id51639d282be14943af0d9b3976249146"><enum>(2)</enum><header>Employee protective arrangements</header><text>The covered entity shall ensure the interests of employees employed in the performance of covered activities shall be protected under arrangements the Secretary of Labor concludes are fair and equitable in accordance with section 5333(b) of title 49, United States Code, and meet the requirements of such section. Any solicitation for a grant under this Act shall specify the arrangements.</text></paragraph><paragraph id="id8069e948f4e5424982cb745f50361ac8"><enum>(3)</enum><header>Neutrality toward organized labor</header><text>The covered entity shall have—</text><subparagraph id="ide12d6436bebe4379a802157142b5ce55"><enum>(A)</enum><text>an explicit policy of neutrality with regard to—</text><clause id="ide61bd453b6394d1b962880f14400f056"><enum>(i)</enum><text>labor organizing for the employees of the covered entity employed in the performance of covered activities; and</text></clause><clause id="id2d7a9333895a4fec99a13f9d0c88a9c1"><enum>(ii)</enum><text>such employees’ choice to form and join labor organizations; and</text></clause></subparagraph><subparagraph id="id677fe7cbf6184f24b081d47ee8d22433"><enum>(B)</enum><text>policies that require—</text><clause id="idd57d36c66a4d4fc7b09341226559aa83"><enum>(i)</enum><text>the posting and maintenance of notices in the workplace to such employees of their rights under the National Labor Relations Act (<external-xref legal-doc="usc" parsable-cite="usc/29/151">29 U.S.C. 151 et seq.</external-xref>); and</text></clause><clause id="idc6bbf3e3af334f89b098a032e85be5a8"><enum>(ii)</enum><text>that such employees are, at the beginning of their employment in the performance of covered activities, provided notice and information regarding the employees' rights under such Act.</text></clause></subparagraph></paragraph><paragraph id="id22186b68ca494754b65f700288a9989a"><enum>(4)</enum><header>Paid family and medical leave</header><text>The covered entity shall have an explicit policy providing all employees employed in the performance of any covered activity not less than 12 workweeks of paid leave in a 12-month period for any purpose described in section 102(a)(1) of the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(a)(1)</external-xref>), in accordance with regulations promulgated by the Secretary of Labor.</text></paragraph><paragraph id="id55e72681f9f94e82b9442bfa2efa548a"><enum>(5)</enum><header>Fair scheduling</header><subparagraph id="id6134eb1182f047da8248f8a1eab70f10"><enum>(A)</enum><header>In general</header><text>The covered entity shall have an explicit policy for fair scheduling for employees employed in the performance of any covered activity, which shall include—</text><clause id="idfeadcc8510284fac981e24cc43a71411"><enum>(i)</enum><text>an opportunity for the employee to request—</text><subclause id="id630bac9e6f284d79911f4b66258fee6d"><enum>(I)</enum><text>an adjustment in the number of hours, work location, or times of the employee's work schedule;</text></subclause><subclause id="id9a5c0eeb583c435281a1af695d9de6ff"><enum>(II)</enum><text>a change in the amount of notification provided to the employee regarding the work schedule; or</text></subclause><subclause id="id82db6c30428e4946935ac3717342ec3b"><enum>(III)</enum><text>the minimizing of fluctuations in the number of hours the employee is scheduled to work on a daily, weekly, or monthly basis; and</text></subclause></clause><clause id="id9f2c6253438a4faf81a994abdcb06c7c"><enum>(ii)</enum><text>a timely, good faith interactive process through which the covered entity and employee discuss the employee's request under clause (i) and the covered entity grants the request or suggests any alternatives that might meet the employee's needs.</text></clause></subparagraph><subparagraph id="id6ca66f0e00644af3bc381694762b9a5e"><enum>(B)</enum><header>Exception</header><text>Subparagraph (A) shall not apply to any employee covered by a valid collective bargaining agreement if—</text><clause id="id5e4ce4a400464af6b08d8b3b8b0d3649"><enum>(i)</enum><text>the terms of the collective bargaining agreement include terms that govern work scheduling practices; and</text></clause><clause id="id0a1c722ba79a48ae9f0e4b4a4cf14afc"><enum>(ii)</enum><text>the provisions of such subparagraph are expressly waived in such collective bargaining agreement.</text></clause></subparagraph></paragraph><paragraph id="idc85be7ca44b948c4a2a8104cb8810bfa"><enum>(6)</enum><header>Preferences in hiring</header><text display-inline="yes-display-inline">The covered entity shall have explicit policies that provide—</text><subparagraph id="id5cd87bfeed374cb2904e8e7aee82cac5"><enum>(A)</enum><text>a preference for local hiring for all covered activities, consistent with applicable Federal law and subject to rules issued by the Secretary of Labor; and</text></subparagraph><subparagraph id="idae7ce00c1a8d49d394fa41b0439b8267"><enum>(B)</enum><text>a preference for the hiring of individuals from frontline, vulnerable, or disadvantaged communities for covered activities.</text></subparagraph></paragraph><paragraph id="id2559cfcfe52f44b1a76e06250080ddd1"><enum>(7)</enum><header>Requirement regarding subcontractors</header><text>The covered entity shall require that each subcontractor of the covered entity for covered activities comply with the requirements of this subsection with respect to all employees of the subcontractor employed in the performance of the covered activities.</text></paragraph></subsection><subsection id="idf3d4bc6e86274deca69a1f71cdda1c35"><enum>(c)</enum><header>Determining employment relationship</header><text>For purposes of this section, an individual performing any service in the performance of covered activities for a covered entity shall be considered an employee, and not an independent contractor, of that covered entity, unless—</text><paragraph id="id0482bacbae0e47f4b51bc069391abbae"><enum>(1)</enum><text>the individual is free from control and direction in connection with the performance of the service, both under the contract for the performance of service and in fact;</text></paragraph><paragraph id="id6612cb2c5ce54d9498e0805f52714780"><enum>(2)</enum><text>the service is performed outside the usual course of the business of the covered entity; and</text></paragraph><paragraph id="id3d6125ab30f34721b6ca45453bfbc133"><enum>(3)</enum><text>the individual is customarily engaged in an independently established trade, occupation, profession, or business of the same nature as that involved in the service performed. </text></paragraph></subsection></section><section id="id431581356636462d82b4ace33497fa8a"><enum>7.</enum><header>Green procurement oversight advisory board</header><subsection id="iddf1fbcfcfa7149b0b362bb4468d9bb0a"><enum>(a)</enum><header>In general</header><text>There is established a Green Procurement Oversight Advisory Board within the Department of Energy.</text></subsection><subsection id="id0bcc3b727929420c82427db14f29b93b"><enum>(b)</enum><header>Coordination</header><text>The Oversight Advisory Board shall carry out its activities in coordination with the Office of Federal Sustainability and the Office of Management and Budget.</text></subsection><subsection id="idf7765ea9e498422a88c70502e80c8420"><enum>(c)</enum><header>Membership</header><text>The members of the Oversight Advisory Board shall—</text><paragraph id="id91bde9c96bb64526ba9b99ce6d9ed4d6"><enum>(1)</enum><text>be appointed by the Secretary of Energy; and</text></paragraph><paragraph id="id89457e966f0845ce908850b62348ca68"><enum>(2)</enum><text>consist of—</text><subparagraph id="id0f7f1c53c3f14243b8186a6e06399c25"><enum>(A)</enum><text>experts on procurement and clean energy, including scientists, from Federal and State agencies;</text></subparagraph><subparagraph id="id5af12b55b6434992af381ac13dc0856e"><enum>(B)</enum><text>1 or more representatives from—</text><clause id="id2c8b274ef0294f89852b121ba3d655d2"><enum>(i)</enum><text>each of—</text><subclause id="id321312443b764d4889d608bb6d59687c"><enum>(I)</enum><text>the Office of Science and Technology Policy;</text></subclause><subclause id="id581621826e024c38a7d57c0bd39dea88"><enum>(II)</enum><text>the General Services Administration; and</text></subclause><subclause id="id7e7ff1ff7f3e4271994167f8b182c514"><enum>(III)</enum><text>the Council on Environmental Quality;</text></subclause></clause><clause id="idd1920669efb9497f9abd2bf48b1c0647"><enum>(ii)</enum><text>environmental justice organizations; and</text></clause><clause id="id2459e97bd60244849833a45d1a086f26"><enum>(iii)</enum><text>unionized labor groups; and</text></clause></subparagraph><subparagraph id="idb2aa67057920454292096f7289eba7e6"><enum>(C)</enum><text>chief financial officers of private companies.</text></subparagraph></paragraph></subsection><subsection id="id32528506d3c144be91b7ac641d120af1"><enum>(d)</enum><header>Functions</header><text>The Oversight Advisory Board shall—</text><paragraph id="id5e40f97746fa45a6aecfb57663e147fc"><enum>(1)</enum><text>oversee the procurement of covered products by Federal agencies pursuant to this Act, including to ensure that procurement of those products is carried out—</text><subparagraph id="idd617023b8c894dc38fcdbe7de09a7127"><enum>(A)</enum><text>efficiently and in accordance with relevant contracting and labor laws, including open competition requirements;</text></subparagraph><subparagraph id="id6ae768443f6748d1b20794aaec0d983b"><enum>(B)</enum><text>in compliance with relevant conflict of interest requirements;</text></subparagraph><subparagraph id="idd2d9a28ee2a74fb59f313b5b0bae84ac"><enum>(C)</enum><text>in a manner that—</text><clause id="id495ef14d9a294d4bac1aef3b9239a0ab"><enum>(i)</enum><text>promotes open competition; and</text></clause><clause id="idaf367cad77ae480d8aa51239e8dfb195"><enum>(ii)</enum><text>prevents frauds; and</text></clause></subparagraph><subparagraph id="ide29daba744ec4755bc0eb322446c947b"><enum>(D)</enum><text>by Federal agency personnel sufficiently trained to ensure responsible procurement practices pursuant to this Act and the goals of this Act;</text></subparagraph></paragraph><paragraph id="ide0b6eaf20e5d4b8c88662ed899405024"><enum>(2)</enum><text>offer recommendations relating to the selection of recipients of grants under the grant programs established under this Act, with the goal of ensuring that grant recipients will use the grant funds—</text><subparagraph id="id47054957bca1455e9d5ff32047e29afd"><enum>(A)</enum><text>efficiently and in accordance with relevant contracting and labor laws, including open competition requirements;</text></subparagraph><subparagraph id="idd296e8df2272456e9951f7e4ade1dc01"><enum>(B)</enum><text>in compliance with relevant conflict of interest requirements;</text></subparagraph><subparagraph id="id15b2831625e549b99446414929b053c4"><enum>(C)</enum><text>in a manner that—</text><clause id="idd141c0533a984d7e95cb3c1107072194"><enum>(i)</enum><text>promotes open competition; and</text></clause><clause id="id687f2663a40c405f8ec4424fb9bc843e"><enum>(ii)</enum><text>prevents frauds; and</text></clause></subparagraph><subparagraph id="idbe549485df5f41088322f441222488e1"><enum>(D)</enum><text>by personnel sufficiently trained to ensure responsible procurement practices pursuant to this Act and the goals of this Act; and</text></subparagraph></paragraph><paragraph id="id8183c051395a400abad8bc98591f4bce"><enum>(3)</enum><text>submit an annual report to the Comptroller General of the United States, Congress, and the President describing—</text><subparagraph id="id3d2994d14caa41f480b72a85dcd618f1"><enum>(A)</enum><text>the procurement of covered products by Federal agencies pursuant to this Act; and</text></subparagraph><subparagraph id="id7c0a9bde07734b04b1d3709fc2584dd6"><enum>(B)</enum><text>the recommendations made by the Oversight Advisory Board under paragraph (2).</text></subparagraph></paragraph></subsection><subsection id="id5f801f27d2934ffa823ab32da94b0490"><enum>(e)</enum><header>Authorities</header><text>The Oversight Advisory Board—</text><paragraph id="id57db473c839d4b8ba50b927eb18c12ac"><enum>(1)</enum><text>shall have the authority to issue subpoenas; and</text></paragraph><paragraph id="idbc9887f7ec064176a47c3d0a4862ed9e"><enum>(2)</enum><text>may refer parties that engage in fraud in connection with a procurement contract entered into by a Federal agency pursuant to this Act to the appropriate Federal law enforcement authority.</text></paragraph></subsection><subsection id="ided666492ca284fb489a069b60aab2e4c"><enum>(f)</enum><header>Treatment as advisory committee</header><text>The Oversight Advisory Board is an advisory committee (as defined in section 1001 of title 5, United States Code).</text></subsection></section><section id="id4b233dc1f7ce4cfba366f74fa7842351"><enum>8.</enum><header>Oversight by Comptroller General</header><text display-inline="no-display-inline">The Comptroller General of the United States shall—</text><paragraph id="idc5f2e5ae4ea94e2785b214122eeca5e5"><enum>(1)</enum><text>conduct oversight of the funds appropriated under this Act to ensure transparency and compliance with all applicable requirements; and</text></paragraph><paragraph id="id83dfe17f269d4a808e080c888396e833"><enum>(2)</enum><text>shall make publicly available an annual report that—</text><subparagraph id="idbbf913eabf234153b4b12a33ba08a9c6"><enum>(A)</enum><text>evaluates the efficacy of the programs established under this Act; and</text></subparagraph><subparagraph id="ide527b009a7db4521babfe3a99cc6ada7"><enum>(B)</enum><text>makes recommendations for any improvements to those programs. </text></subparagraph></paragraph></section></legis-body></bill>
