which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide for civil monetary penalties for violations of mental health parity requirements.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Parity Enforcement Act of 2024</short-title></quote>.</text></section><section id="H23E5408A167F47AABCE401A14A2FB068"><enum>2.</enum><header>Liability for, enforcement of, and civil monetary penalties for parity violations</header><subsection commented="no" display-inline="no-display-inline" id="idD4F65FC15B5A40F993C7AA1505BDE2A0"><enum>(a)</enum><header>PHSA</header><paragraph commented="no" display-inline="no-display-inline" id="id55f919c262c94777a2c573061118f02b"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 2726(a) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-26">42 U.S.C. 300gg–26(a)</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="idCEF80D633FB94AB9B3C2CB8EB7590571"><paragraph id="id53B2797D51AD400FB220DA522DA91164" commented="no" display-inline="no-display-inline"><enum>(9)</enum><header>Service provider liability</header><text>In the case of a violation of this section by a group health plan or a health insurance issuer offering group or individual health insurance coverage—</text><subparagraph commented="no" display-inline="no-display-inline" id="idc4d9888a1e1c4736aac3a630cdbf51fa"><enum>(A)</enum><text display-inline="yes-display-inline">a plan sponsor or a service provider, including any third-party administrator, managed behavioral health organization, or entity providing pharmacy benefit management services, of such plan or coverage that causes or contributes to such violation shall also be liable for such violation; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2b98b1ea43074d58b46d42d451315a60"><enum>(B)</enum><text display-inline="yes-display-inline">the Secretary shall have the discretion to determine the percentage of liability of between the plan, issuer, sponsor, and service provider, as applicable.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2c55a2e5ca1843f0a39d17c63eb001f7"><enum>(2)</enum><header display-inline="yes-display-inline">Enforcement</header><text>Section 2723 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-22">42 U.S.C. 300gg–22</external-xref>) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="idf806eea4b5454865a4a7fb91deb7b958"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (a)—</text><clause commented="no" display-inline="no-display-inline" id="id2145a52b5f6b480ba3470e773482a670"><enum>(i)</enum><text display-inline="yes-display-inline">in paragraph (1), by adding at the end the following: <quote>In the case of the requirements of subsection (a) of section 2726 with respect to parity in mental health and substance use disorder benefits, each State may require that plan sponsors or service providers, including any third-party administrator, managed behavioral health organization, or entity providing pharmacy benefit management services, of such coverage meet such requirements.</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="ide74f7bd1bd41414894922465f3acab38"><enum>(ii)</enum><text display-inline="yes-display-inline">in paragraph (2), by inserting <quote>, plan sponsors, or service providers, including any third-party administrator, managed behavioral health organization, or entity providing pharmacy benefit management services,</quote> after <quote>health insurance issuers</quote>; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide7c2c57fe0e8455a9dc9458ed0193643"><enum>(B)</enum><text>in subsection (b)(3)—</text><clause id="id6A5B5F5C11444BC0AE1D3DDD442475AB"><enum>(i)</enum><text> in the heading, by striking <quote><header-in-text level="paragraph" style="OLC">genetic information</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">genetic information and parity in mental health and substance use disorder benefits</header-in-text></quote>; and</text></clause><clause id="idC9650841FBA64B3B8DCF1288B92186D0"><enum>(ii)</enum><text> in subparagraph (A), by striking <quote>any failure</quote> and all that follows through <quote>in connection with the plan.</quote> and inserting the following: “any failure of a health insurance issuer or a plan sponsor or any participation in such failure by a service provider, including any third-party administrator, managed behavioral health organization, or entity providing pharmacy benefit management services, in connection with a group health plan—</text><quoted-block id="idF5D693A2275F4A25BEC6060014B896E2" display-inline="no-display-inline" style="OLC"><clause commented="no" display-inline="no-display-inline" id="id5d06c39a4a474a0b90cd3ea0252940e1"><enum>(i)</enum><text display-inline="yes-display-inline">to meet the requirements of subsection (a)(1)(F), (b)(3), (c), or (d) of section 2702 or section 2701 or 2702(b)(1) with respect to genetic information; or</text></clause><clause id="id91DE17074AD640F9B1791A80FCFA1842" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">to meet the requirements of subsection (a) of section 2726 with respect to parity in mental health and substance use disorder benefits.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idc768fb2c7f41418397ccdf06244c74a1"><enum>(b)</enum><header display-inline="yes-display-inline">ERISA</header><paragraph commented="no" display-inline="no-display-inline" id="id022ff7800f44411690d6ea15f1826b9e"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 712(a) of the Employee Retirement Income Security Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/29/1185a">29 U.S.C. 1185a(a)</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="idEFEB38DD30844DCB8DBDA6E85098182E"><paragraph id="id714f3f63003947b8a4ad771002f358de" commented="no" display-inline="no-display-inline"><enum>(9)</enum><header>Service provider liability</header><text>In the case of a violation of this section by a group health plan or a health insurance issuer offering group health insurance coverage—</text><subparagraph commented="no" display-inline="no-display-inline" id="idf0cd7329d8b04ba18030f7e7ec5f902e"><enum>(A)</enum><text display-inline="yes-display-inline">a plan sponsor or a service provider, including any third-party administrator, managed behavioral health organization, or entity providing pharmacy benefit management services, of such plan or coverage that causes or contributes to such violation shall also be liable for such violation; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idae2621b6b9d249629b6e8d1a773d8bc4"><enum>(B)</enum><text display-inline="yes-display-inline">the Secretary shall have the discretion to determine the percentage of liability of between the plan, issuer, sponsor, and service provider, as applicable.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfd1170999a3a4c99a80211e51681c750"><enum>(2)</enum><header>Enforcement</header><text display-inline="yes-display-inline">Section 502 of the Employee Retirement Income Security Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/29/1132">29 U.S.C. 1132</external-xref>) is amended—</text><subparagraph id="HD92FCF68BA0840E490ACDDF9D6F77D72" commented="no"><enum>(A)</enum><text>in subsection (a), by striking paragraph (6) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idDFD79992E4D54EB898C2893D412CE6D4"><paragraph commented="no" display-inline="no-display-inline" id="id17b0f9d729f54f8d8acbf2114674a155"><enum>(6)</enum><text display-inline="yes-display-inline">by the Secretary to collect any civil penalty under this section</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="H6ED9775C407947489A8BD67077AF2E7C" commented="no"><enum>(B)</enum><text>in subsection (b)(3)—</text><clause id="HC19091791BBE4D00B65136D0614EEFF7" commented="no"><enum>(i)</enum><text>by striking <quote>subsections (c)(9) and (a)(6)</quote> and inserting <quote>subsections (c)(9), (c)(10), and (a)(6)</quote>; and</text></clause><clause id="HB461E1065BE5452D979BE65D37C09C38" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text>by striking <quote>under subsection (c)(9))</quote> and inserting <quote>under subsections (c)(9) and (c)(10)), and except with respect to enforcement by the Secretary of section 712</quote>; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8c4203c13c134e528e0ae6c4d3a0c137"><enum>(C)</enum><text display-inline="yes-display-inline">in subsection (c)(10)—</text><clause id="H2C5FD0D9089A49A09BA533AE04D0FDEC"><enum>(i)</enum><text> in the heading, by striking <quote><header-in-text level="paragraph" style="OLC">use of genetic information</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">use of genetic information and parity in mental health and substance use disorder benefits</header-in-text></quote>; and</text></clause><clause id="H21239CF6C54A4D6BB7B43D52B2FB26A7"><enum>(ii)</enum><text> in subparagraph (A)—</text><subclause id="id3bbaf8d7a2c1486690a14a5478b4a3cb"><enum>(I)</enum><text>by striking <quote>any plan sponsor of a group health plan</quote> and inserting <quote>any plan sponsor or service provider, including any third-party administrator, managed behavioral health organization, or entity providing pharmacy benefit management services, of a group health plan</quote>; and</text></subclause><subclause id="id0718e4ad70a9414daeeccf2a56178288" commented="no"><enum>(II)</enum><text>by striking <quote>for any failure</quote> and all that follows through <quote>in connection with the plan.</quote> and inserting the following: “for any failure by such sponsor or issuer, or by participation in such failure by a service provider, in connection with the plan—</text><quoted-block style="OLC" display-inline="yes-display-inline" id="HEE9C9A09A3764C96A59CEAD839E25BB7"><clause id="HBC39889BF2424F49A57C32D5A6EEF6AC"><enum>(i)</enum><text display-inline="yes-display-inline">to meet the requirements of subsection (a)(1)(F), (b)(3), (c), or (d) of section 702 or section 701 or 702(b)(1) with respect to genetic information; or</text></clause><clause id="H5226DD9E95DC428295B9A3A4C6937978"><enum>(ii)</enum><text display-inline="yes-display-inline">to meet the requirements of subsection (a) of section 712 with respect to parity in mental health and substance use disorder benefits.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subclause></clause></subparagraph></paragraph></subsection><subsection id="ideaf67bf380b64d76a28b35702ab0a8d0"><enum>(c)</enum><header>IRC</header><paragraph commented="no" display-inline="no-display-inline" id="idd647e0dda9d443189561ba72f2619475"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/9812">Section 9812(a)</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id02ACB35055874028AEDA298DB400F498"><paragraph id="id1E8D1C09C35D40AEB8389D3519C62DB3" commented="no" display-inline="no-display-inline"><enum>(9)</enum><header>Service provider liability</header><text>In the case of a violation of this section by a group health plan—</text><subparagraph commented="no" display-inline="no-display-inline" id="id288cce4f3bd54b6e9065524e91e37b43"><enum>(A)</enum><text display-inline="yes-display-inline">a plan sponsor or a service provider, including any third-party administrator, managed behavioral health organization, or entity providing pharmacy benefit management services, of such plan that causes or contributes to such violation shall also be liable for such violation; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida93e148d8645464ca7e4ea5dd589717c"><enum>(B)</enum><text display-inline="yes-display-inline">the Secretary shall have the discretion to determine the percentage of liability of between the plan, sponsor, and service provider, as applicable.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="ida552876b63b648c4b65edefc3dc95233" commented="no"><enum>(2)</enum><header>Enforcement</header><text>Section 4980D of such Code is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id303E769902CF40938885F98FA415766C"><subsection id="id88d268761d54445d99366e9ea05e5a70"><enum>(g)</enum><header>Application to service providers</header><text>In the case of a failure of a group health plan to meet the requirements of section 9812, any reference in this section to such group health plan (and the reference in subsection (e)(1) to the employer) shall be treated as including a reference to any person made liable for such failure by section 9812(a)(9).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id6600F0ABD3C5426C87B6965EF12AB12B" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section (other than the amendments made by subparagraphs (A) and (B) of subsection (b)(2)) shall apply with respect to plan years beginning after the date that is 1 year after the date of enactment of this Act.</text></subsection></section></legis-body></bill>
