which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish a grant program for certain State and local forensic activities, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Carla Walker Act</short-title></quote>.</text></section><section id="ide8ad15e38b11412f8531777d9bf441f2"><enum>2.</enum><header>Grants to improve forensic activities</header><text display-inline="no-display-inline">Title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/34/10101">34 U.S.C. 10101 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idc1735cce7fe44d34999e99db9c0dec9e"><part id="id619e1e327dea4646b7797d266791a48c" style="OLC"><enum>PP</enum><header>Grants to improve forensic activities</header><section id="id92883264ac5f4eeea97d25a62985ffd2"><enum>3061.</enum><header>Definitions</header><text display-inline="no-display-inline">In this part:</text><paragraph commented="no" display-inline="no-display-inline" id="idefcec7b6ce294b74b6001aea112c4792"><enum>(1)</enum><header display-inline="yes-display-inline">Forensic analysis</header><text>The term <term>forensic analysis</term> means an expert examination or test—</text><subparagraph commented="no" display-inline="no-display-inline" id="idb5f18d9cb5ad41798d41301847212246"><enum>(A)</enum><text display-inline="yes-display-inline">required by a law enforcement agency, a prosecutor, a criminal suspect or defendant, or a relevant court; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id004f9ada3c6f43dca8be0276ca299017"><enum>(B)</enum><text display-inline="yes-display-inline">performed on physical evidence, including DNA evidence, for the purpose of determining the connection of the evidence to a criminal act.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id07fc90ff20854b2bb1edc8c9ebed19f6"><enum>(2)</enum><header display-inline="yes-display-inline">Forensic laboratory</header><text>The term <term>forensic laboratory</term> means a facility, entity, or site accredited or pursuing accreditation as described in section 3062(d)(1)(C)(iii) that—</text><subparagraph commented="no" display-inline="no-display-inline" id="id800e79ee0193438293ccb76a91ec2dc0"><enum>(A)</enum><text display-inline="yes-display-inline">offers or performs forensic analysis; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida0de9068c3ba4da3920b87a4224ff5b7"><enum>(B)</enum><text display-inline="yes-display-inline">follows relevant chain of custody requirements for authentication by an appropriate court.</text></subparagraph></paragraph></section><section id="idf71b132839c74576b5ad5e6bac2deed8"><enum>3062.</enum><header>DNA analysis grants</header><subsection commented="no" display-inline="no-display-inline" id="id0e9d0bb2ffb64ee0a69067a8d5b627fa"><enum>(a)</enum><header display-inline="yes-display-inline">Eligible entity defined</header><text>In this section, the term <term>eligible entity</term> means—</text><paragraph id="idD4D770F1351C41B0B83B2E4472CED7ED"><enum>(1)</enum><text>a State;</text></paragraph><paragraph id="id60E5F19BC56F4B81B2D093B9E8E565E7"><enum>(2)</enum><text>a Tribal or local law enforcement agency;</text></paragraph><paragraph id="idB890C9EFEC7D4CD3AF6D6B4F2B207636"><enum>(3)</enum><text>a prosecutor’s office with a forensic laboratory capability;</text></paragraph><paragraph id="id9D6E25FD33C14F529E670780B0374778"><enum>(4)</enum><text>a medical examiner’s office; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id302D560675E4478AA8BC1CF4ADC9167A"><enum>(5)</enum><text>a coroner’s office. </text></paragraph></subsection><subsection id="id88d23e8e7f6d40ff8a56f530a7dee83b"><enum>(b)</enum><header>Authorization of grants</header><text>The Attorney General may award a competitive grant to an eligible entity for the purpose of using any technology used in a forensic laboratory—</text><paragraph commented="no" display-inline="no-display-inline" id="id5771c52b9d6b499289618b373ed746ea"><enum>(1)</enum><text display-inline="yes-display-inline">in order to conduct whole genome sequencing technology to assess at least 100,000 genetic markers ; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id617f41e2f8fb49caabdd17350524b7b1"><enum>(2)</enum><text display-inline="yes-display-inline">that is compatible with multiple genealogical databases permitted to be used by law enforcement agencies under this part to generate investigative leads for criminal investigations or unidentified human remains.</text></paragraph></subsection><subsection id="id17cb0d208f2247aeb386eca6b62b2d62"><enum>(c)</enum><header>Applications</header><text>An eligible entity seeking a grant under this section shall submit to the Attorney General an application at such time and in such form as the Attorney General may require.</text></subsection><subsection id="id4429101ac9554caf8ff9d8394011592a"><enum>(d)</enum><header>Use of grant</header><paragraph commented="no" display-inline="no-display-inline" id="id050ab21cd90e41598222389b07f02784"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">An eligible entity that receives a grant under this section shall use amounts from the grant for any of the following activities:</text><subparagraph id="id57932c1c50e34ce69a4acd9ab41f7dc9"><enum>(A)</enum><text>To carry out DNA analyses of samples collected under applicable legal authority using the technology described in subsection (b) if the submission of such samples to the Combined DNA Index System has failed to produce investigative leads.</text></subparagraph><subparagraph id="ide0436d019e84466dae39d8e62ab5cafd"><enum>(B)</enum><text>To carry out DNA analyses of unidentified human remains reasonably believed by investigators to be the remains of a suspected homicide victim using the technology described in subsection (b) if submission of such samples to the Combined DNA Index System has failed to provide an identity.</text></subparagraph><subparagraph id="iddee5953d3cc04467839713962d508d12"><enum>(C)</enum><text>To outsource an activity described in subparagraph (A) or (B) for the use of technology described in subsection (b) and searching to—</text><clause commented="no" display-inline="no-display-inline" id="id2f33ac470d064afdb291e61412f0f6d0"><enum>(i)</enum><text display-inline="yes-display-inline">an accredited publicly funded forensic laboratory;</text></clause><clause commented="no" display-inline="no-display-inline" id="idc2219fae71a04228a287c161fb1abb2f"><enum>(ii)</enum><text display-inline="yes-display-inline">an accredited nongovernmental forensic laboratory; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id5e1198c886404e7880efcadc1be53f06"><enum>(iii)</enum><text display-inline="yes-display-inline">a nongovernmental forensic laboratory that attests to the Attorney General, in a manner that is legally binding and enforceable, that the nongovernmental forensic laboratory will prepare and apply for such accreditation not later than 2 years after the date on which the nongovernmental laboratory first receives a request for analysis from an eligible entity receiving a grant under this section.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4e9220848fa0482b8b080e83a22dd4c1"><enum>(2)</enum><header>DOJ policy</header><text>An activity carried out using amounts from a grant under this section shall be carried out consistent with the policy of the Department of Justice entitled <quote>Interim Policy on Forensic Genealogical DNA Analysis and Searching</quote> and dated November 1, 2019, or any successor policy, including with respect to communication between custodial Combined DNA Index System laboratories and vendor laboratories.</text></paragraph></subsection><subsection id="id44770abce22641debcca6a383720a188"><enum>(e)</enum><header>Authorization of appropriations</header><paragraph commented="no" display-inline="no-display-inline" id="idc5fceb635d2b489185cbfa5364a4c1dd"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">There are authorized to be appropriated to the Attorney General to carry out this section $5,000,000 for each of fiscal years 2024 through 2028.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb1850226ca0848b2ad51dc19d1754667"><enum>(2)</enum><header>Limitations on use</header><subparagraph commented="no" display-inline="no-display-inline" id="id1f6d4f09024b4b09bceb5f63265a5f1c"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Amounts appropriated to carry out this section—</text><clause commented="no" display-inline="no-display-inline" id="id66ec06c7792347149c52511fff6b31f0"><enum>(i)</enum><text display-inline="yes-display-inline">subject to subparagraph (B), shall only be made available to carry out forensic genetic genealogical analysis; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idf1f323a4a21b4a78bb0b7a4a656ad60b"><enum>(ii)</enum><text display-inline="yes-display-inline">shall not be made available for staffing, training, travel, and equipment.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6884454516954a98b9d3352d04ba43a6"><enum>(B)</enum><header>Administrative costs</header><text display-inline="yes-display-inline">The Attorney General may use not more than 10 percent of amounts appropriated to carry out this section for administrative costs.</text></subparagraph></paragraph></subsection></section><section id="id1376e7a1076847a380f7a2134753b793"><enum>3063.</enum><header>Grants to purchase forensic equipment enabled for forensic genetic genealogy DNA analysis and searching</header><subsection commented="no" display-inline="no-display-inline" id="ide0d192c31c074fb781207a91f300bd3b"><enum>(a)</enum><header>Eligible entity defined</header><text>In this section, the term <term>eligible entity</term> means—</text><paragraph commented="no" display-inline="no-display-inline" id="id8faff2de57a74b87ad8313b51c93196c"><enum>(1)</enum><text display-inline="yes-display-inline">a publicly funded and accredited forensic laboratory;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idef1ccd90348441d4ade965838b722ee0"><enum>(2)</enum><text>a medical examiner's office; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id48efa3efb192432381b34988d42e356e"><enum>(3)</enum><text>a coroner's office.</text></paragraph></subsection><subsection commented="no" id="ide2583a704db345b982477f210e7125ff"><enum>(b)</enum><header>Authorization of grants</header><text>The Attorney General may award a grant to an eligible entity for the purpose of purchasing equipment to deploy forensic genetic genealogical DNA analysis and searching to generate investigative leads for criminal investigations or unidentified human remains.</text></subsection><subsection commented="no" id="id39a5ab229af043b9a5b322109494cd3b"><enum>(c)</enum><header>Applications</header><text>An eligible entity seeking a grant under this section shall submit to the Attorney General an application at such time and in such form as the Attorney General may require.</text></subsection><subsection commented="no" id="idb2c7f2d6e21445c08dedf8e2bd7c2462"><enum>(d)</enum><header>Use of funds</header><text>An eligible entity that receives a grant under this section shall use amounts from the grant to purchase forensic equipment, including supplies, reagents, consumables, and validation expenses, to deploy forensic genetic genealogy techniques, as defined in the Interim Policy on Forensic Genealogical DNA Analysis and Search of the Department of Justice dated November 1, 2019, or any successor policy, as applicable.</text></subsection><subsection commented="no" id="id89d5f77fccd844ad9af3f4f4c0c6a124"><enum>(e)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Attorney General to carry out this section $5,000,000 for each of fiscal years 2024 through 2028.</text></subsection></section><section id="idf48cd6c9ce9e4ffea7f78201fe7c1925"><enum>3064.</enum><header>Administrative provisions</header><subsection id="id739bb23e9b704eba973f346ffdbd77f3"><enum>(a)</enum><header>Regulations</header><text>The Attorney General may promulgate guidelines, regulations, and procedures to carry out this part, including guidelines, regulations, and procedures relating to the submission and review of applications for grants under sections 3062 and 3063.</text></subsection><subsection id="id6ac0f69e031e4522a29c5f5d10c904ac"><enum>(b)</enum><header>Accountability</header><paragraph id="id9238481b85ac4108a41ced8be14618e6"><enum>(1)</enum><header>Records</header><text>An eligible entity that receives a grant under this part shall maintain such records as the Attorney General may require to facilitate an effective audit relating to the receipt of the grant, the use of amounts from the grant, outsourcing activities, and compliance with section VIII, entitled <quote>Sample and Data Control and Disposition</quote>, of the Interim Policy on Forensic Genealogical DNA Analysis and Search of the Department of Justice dated November 1, 2019, or any successor policy.</text></paragraph><paragraph id="id8052622804da458b8dab76cf5dd92c09" commented="no"><enum>(2)</enum><header>Access</header><text>For the purpose of conducting audits and examinations, the Attorney General shall have access to any book, document, or record of an eligible entity that receives a grant under this section, a State or unit of local government within which the eligible entity operates, and any entity to which the eligible entity outsources work using amounts from the grant if the Attorney General determines that the book, document, or record relates to—</text><subparagraph commented="no" display-inline="no-display-inline" id="id1576fe97e96d433bb16cbf90e317f58d"><enum>(A)</enum><text display-inline="yes-display-inline">the receipt of the grant;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3f3dcb46555b4b80b2f0a7735fcb9cc2"><enum>(B)</enum><text display-inline="yes-display-inline">the use of amounts from the grant; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3e00ad38561846519b69e59fb9935432"><enum>(C)</enum><text display-inline="yes-display-inline">compliance with section VIII, entitled <quote>Sample and Data Control and Disposition</quote>, of the Interim Policy on Forensic Genealogical DNA Analysis and Search of the Department of Justice dated November 1, 2019, or any successor policy.</text></subparagraph></paragraph><paragraph id="idd49d877edc564aa7b8a95b3b1585379a"><enum>(3)</enum><header>Suspension and debarment</header><text>In carrying out this part, the Attorney General shall comply with part 180 of title 2, Code of Federal Regulations, or any successor regulation.</text></paragraph></subsection></section><section id="ideedfb17753cf4b9d93744b6af6802317"><enum>3065.</enum><header>Reports</header><text display-inline="no-display-inline">Not later than 1 year after the date on which an eligible entity receives a grant under section 3062 or 3063, the eligible entity shall submit to the Attorney General a report that includes—</text><paragraph commented="no" display-inline="no-display-inline" id="ida147e62585d84b4ab04348aaa8dd9153"><enum>(1)</enum><text display-inline="yes-display-inline">the amount of funding the eligible entity receives from the grant each fiscal year;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idaa74976a836d4145870eff59f4c72495"><enum>(2)</enum><text display-inline="yes-display-inline">the number of cases for which the eligible entity performed testing using forensic genealogical DNA analysis during the previous year; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id99e2d67bb1e44fdea5fdcbfc4d8439e3"><enum>(3)</enum><text display-inline="yes-display-inline">the type of forensic genetic genealogical DNA testing performed by the eligible entity, including—</text><subparagraph commented="no" display-inline="no-display-inline" id="idd858a3eb8e434dca9c579a88adeaafb3"><enum>(A)</enum><text display-inline="yes-display-inline">the name of any laboratory to which the eligible entity outsources the testing;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id255bf022a14e48b3ac2342fef4533bca"><enum>(B)</enum><text display-inline="yes-display-inline">the type of equipment used for the testing; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id593388c4aae5428183b3e653e2970548"><enum>(C)</enum><text display-inline="yes-display-inline">the results of the testing, such as whether the testing resulted in successful victim or perpetrator identification or no identification and the time it took to make the identification;</text></subparagraph></paragraph><paragraph id="ide4f2dfe826664e0c886bcf4dfc15acc3" commented="no"><enum>(4)</enum><text>the number of cases in which forensic genetic genealogical DNA analysis—</text><subparagraph id="id7be4b0f78ec645f2aa343a05d2c5b8fc" commented="no"><enum>(A)</enum><text>resulted in a searchable profile in a publicly available genealogy database;</text></subparagraph><subparagraph id="id365e79379afa4573abdc3a25452ff72e" commented="no"><enum>(B)</enum><text>generated a victim or perpetrator identification;</text></subparagraph><subparagraph id="idfa6a571dd57d485dbadf981bd62b2aa6" commented="no"><enum>(C)</enum><text>did not generate a victim or perpetrator identification; and</text></subparagraph><subparagraph id="id79b56680b26f41a8a405be2fd1daaf7b" commented="no"><enum>(D)</enum><text>directly resulted in an arrest or victim identification; and</text></subparagraph></paragraph><paragraph id="id9178f80c8cf046728e1be10a8c730e98" commented="no"><enum>(5)</enum><text>the average number of days it took to make an identification between the date of sample submission for forensic genetic genealogical DNA testing and the date of delivery of test results to the requesting office or agency.</text></paragraph></section></part><after-quoted-block>.</after-quoted-block></quoted-block></section><section commented="no" display-inline="no-display-inline" id="id64f62898c7e34180bccb3d2297343790"><enum>3.</enum><header>DOJ report</header><text display-inline="no-display-inline">Not later than 2 years after the date of enactment of this Act, the Attorney General, in consultation with the Forensic Laboratory Needs Working Group of the National Institute of Justice, shall submit to Congress a report—</text><paragraph commented="no" display-inline="no-display-inline" id="idfa33e07be5ac44ce84d8dbdb7fb4c8f4"><enum>(1)</enum><text>on the awards and practices reported the Attorney General under section 3064 of title I of the Omnibus Crime Control and Safe Streets Act of 1968, as added by this Act;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id90f9ba2578b340389793cdda0e784382"><enum>(2)</enum><text display-inline="yes-display-inline">on forensic genetic genealogy technologies and how best to implement forensic genetic genealogy into publicly funded forensic laboratories; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc242479cc4294c3e9d83d2dd9c5b6462"><enum>(3)</enum><text display-inline="yes-display-inline">that includes recommendations for—</text><subparagraph commented="no" display-inline="no-display-inline" id="idcafa1c1a567f4874bcd367365d1e83d1"><enum>(A)</enum><text display-inline="yes-display-inline">implementing forensic investigative genetic genealogy technology, including expected funding needs; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id10b3e5ffff944b339a3c0bf80ec84103"><enum>(B)</enum><text display-inline="yes-display-inline">necessary regulations for the use of forensic investigative genetic genealogy technology.</text></subparagraph></paragraph></section></legis-body></bill>
