which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title XVIII of the Social Security Act to provide for payment for services of radiologist assistants under the Medicare program, and for other purposes. </official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Medicare Access to Radiology Care Act of 2024</short-title></quote>.</text></section><section id="id2660635db0964480995302bd306b9cc8"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following findings:</text><paragraph id="idf9df559e887246b597253858ccae5ac6"><enum>(1)</enum><text>Radiologist assistants are advanced-level radiographers who are critically important members of the radiologist-led team.</text></paragraph><paragraph id="idee90701f6f404c4c8b9541996eb4d38a"><enum>(2)</enum><text>Radiologist assistants work strictly under the supervision of a radiologist to promote high standards of patient care by assisting radiologists in the diagnostic and interventional imaging environment.</text></paragraph><paragraph id="id35cad7984f6c4c928c399569c5ae5ed1"><enum>(3)</enum><text>In every jurisdiction authorizing radiologists assistants to practice, they are only permitted to furnish services when delegated by and under the supervision of a radiologist.</text></paragraph><paragraph id="iddb2c8257c1f5480db3d1aae6c6e5e4cf"><enum>(4)</enum><text>Radiologist assistants value their working and professional relationships with radiologists and have never sought, nor do they seek, the ability to practice independent of radiologists.</text></paragraph><paragraph id="id48ca1ccce9964f628c5db6fe83aff096"><enum>(5)</enum><text>While radiologist assistants perform various valuable professional services and may make and communicate initial observations to the radiologist, radiologist assistants are not qualified to perform interpretations (preliminary, final, or otherwise) of any radiological examination.</text></paragraph><paragraph id="ide9234449ff2f411e99a811d8900fba95"><enum>(6)</enum><text>Removing barriers to care rendered by radiologist assistants under the supervision of a radiologist will provide value-based, efficient solutions to improve patient outcomes while ensuring patient safety.</text></paragraph></section><section id="idbe5a4de649d24033ba9ade7d4c84ad81"><enum>3.</enum><header>Medicare payment for radiologist assistant services</header><subsection id="ide568983b15bc4e629773976ec3e76a70"><enum>(a)</enum><header>Coverage</header><text>Section 1861 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x</external-xref>) is amended—</text><paragraph id="idd3ad5a4566ae4091adc4a0d803768611"><enum>(1)</enum><text>in subsection (s)(2)(K)—</text><subparagraph id="id5785788339e243faa2fb60db94fc719a"><enum>(A)</enum><text>in clause (ii), by striking the semicolon at the end and inserting <quote>, and</quote>; and</text></subparagraph><subparagraph id="ide400cac36da3409e8272463783e754d8"><enum>(B)</enum><text>by adding at the end the following new clause:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idc9cdd9d837174304be79d0d95e9892a6"><clause id="id73cc85b9be9949688ec82ff3c0435dad" indent="up2"><enum>(iii)</enum><text>radiologist assistant services (as defined in subsection (nnn)(1));</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="ide23b633029914c2c87b24ac6507c6fce"><enum>(2)</enum><text>by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idb63006b83f60496d96a04306c7a25845"><subsection id="id0662a0ac354b4874b5ec7b981b3c34c9"><enum>(nnn)</enum><header>Radiologist assistant services; radiologist assistant</header><paragraph commented="no" display-inline="no-display-inline" id="ida7a318b0d38e4be48c1bf14599296000"><enum>(1)</enum><header>Radiologist assistant services</header><text display-inline="yes-display-inline">The term <term>radiologist assistant services</term> means—</text><subparagraph id="id16ea24f4cfda471cb129f789e05616f0"><enum>(A)</enum><text>services which would be physicians’ services if furnished by a physician (as defined in subsection (r)(1)) and which are performed by a radiologist assistant (as defined in paragraph (2)) under the supervision of a radiologist;</text></subparagraph><subparagraph id="id754bbc97d0a74752bc255374f15b8eb2"><enum>(B)</enum><text>services which the radiologist assistant is legally authorized to perform by the State in which the services are performed; and</text></subparagraph><subparagraph id="id67eb7310bcd44797918fa912562bb823"><enum>(C)</enum><text>such services and supplies furnished as an incident to such services as would be covered under subparagraph (A) if furnished incident to a physician’s professional service, but only if no facility or other provider charges or is paid any amounts with respect to the furnishing of such services.</text></subparagraph></paragraph><paragraph id="idab0295de69514b5b9b46209177bb7870"><enum>(2)</enum><header>Radiologist assistant</header><text>The term <term>radiologist assistant</term> means a radiographer who is certified by the American Registry of Radiologic Technologists as a registered radiologist assistant or by the Certification Board for Radiology Practitioner Assistants as a radiology practitioner assistant to perform radiologist assistant services.</text></paragraph><paragraph id="id54aeef87debc45b9956550252e09140a"><enum>(3)</enum><header>Rules of construction</header><text>Nothing in this subsection shall be construed as affecting—</text><subparagraph id="id31660ef4327b4734b0874cd4e077ba2d"><enum>(A)</enum><text>coverage of and payment for the technical component (including the technical component of a global fee) with respect to imaging services under this title as in effect before the date of the enactment of this subsection;</text></subparagraph><subparagraph id="id0d7b9fcb2a3540d9968007c475a77980"><enum>(B)</enum><text>the amount of payment made for physicians’ services under this title when furnished solely by a radiologist; or</text></subparagraph><subparagraph id="id5826f0ff892d462b9602aef12834ebbe"><enum>(C)</enum><text>the amount of payment made under this title for services furnished by a covered facility setting (as defined in section 1848(a)(10)(B)).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id076445e234364498ba75de1d22d75fcd"><enum>(b)</enum><header>Payment in relation to physician fee schedule</header><paragraph id="id41ec428c38cb4390ae89d0a622e9858d"><enum>(1)</enum><header>Payment level</header><text>Section 1833(a)(1)(O) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395l">42 U.S.C. 1395l(a)(1)(O)</external-xref>) is amended by striking <quote>or clinical nurse specialists</quote> and inserting <quote>clinical nurse specialists, or radiologist assistants</quote>.</text></paragraph><paragraph id="id1935c074431c496ba2cee1679eea4a0f"><enum>(2)</enum><header>Application of fee schedule in hospital, ambulatory surgical center settings</header><text>Section 1848(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-4">42 U.S.C. 1395w–4(a)</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0920af1221ca4aac96d6b4db1169c2ad"><paragraph id="id38979e8d33c245109bff23b482621001"><enum>(10)</enum><header>Application of fee schedule for radiologist assistant services in hospital, ambulatory surgical center settings</header><subparagraph id="id92dcbe0c4e0e4a50b436bdbd9a3fdc37"><enum>(A)</enum><header>In general</header><text>In the case of radiologist assistant services (as defined in section 1861(nnn)(1)) furnished in a covered facility setting (as defined in subparagraph (B)), payment for such services furnished in such setting shall be made to the supervising radiologist in the amount determined pursuant to section 1833(a)(1)(O).</text></subparagraph><subparagraph id="id4b80953e297349c38ccbd4de76dc6dd8"><enum>(B)</enum><header>Covered facility setting defined</header><text>In this paragraph, the term <term>covered facility setting</term> means—</text><clause id="idb79ce0852c8e4e46a72170955bf43a94"><enum>(i)</enum><text>a hospital or critical access hospital;</text></clause><clause id="idd9bb9a6fcfe840fe9e6506b8b4e842cd"><enum>(ii)</enum><text>an ambulatory surgical center; and</text></clause><clause id="id07362455f8854980ad2b6e27f22c173c"><enum>(iii)</enum><text>such other providers of services as the Secretary may specify.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="ida164cccdc9d74df7927fdb6239e8c227"><enum>(3)</enum><header>Payment to supervising radiologist</header><text>Section 1842(b)(6) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395u">42 U.S.C. 1395u(b)(6)</external-xref>) is amended in the first sentence—</text><subparagraph id="id36a172514af542e1a9cc1d97b9f27388"><enum>(A)</enum><text>by striking <quote>and</quote> before <quote>(J)</quote>; and</text></subparagraph><subparagraph id="idbad06cb925e44d80943b0c84053d1dfa"><enum>(B)</enum><text>by inserting before the period at the end the following: <quote>, and (K) in the case of services described in section 1861(s)(2)(K)(iii) (relating to radiologist assistant services), payment shall be made to the supervising radiologist</quote>.</text></subparagraph></paragraph></subsection><subsection id="id1f173e82dc8e4844b5cf7a053eacf1f4"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to services furnished on or after January 1, 2025. </text></subsection></section></legis-body></bill>
