which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To allow Federal funds appropriated for kindergarten through grade 12 education to follow the student.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Support Children Having Open Opportunities for Learning Act of 2024</short-title></quote> or the <quote><short-title>SCHOOL Act of 2024</short-title></quote>.</text></section><section id="idD44E0D3C87CE49DD891516422CF1C4F3"><enum>2.</enum><header>Federal funding under the Elementary and Secondary Education Act of 1965 to follow the student</header><subsection commented="no" display-inline="no-display-inline" id="id58f2e34d699445be94ee9755a32d9ebf"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Title VIII of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1588038359D14419AF820FE8F1559B0C"><part id="id5C878C7BD0EE49BCA2B44178418B9909" style="OLC"><enum>H</enum><header>Funds to Follow the Student</header><section section-type="subsequent-section" id="id8C50C203D3D1465F8BEA9612FB161BDA"><enum>8701.</enum><header>Funds to follow the student</header><subsection id="idf089343fc6a74c168d8e50b8978a4766"><enum>(a)</enum><header>In general</header><paragraph id="id07068BD3D8604BF79A9B3DA3FCB2DCB4"><enum>(1)</enum><header>Funds to follow the student</header><text>Notwithstanding any other provision of law and to the extent permitted under State law, a State educational agency shall allocate grant funds provided under titles I, III, IV, V, and VI, for the purposes of ensuring that funding under such titles follows children, whether learning in person or remotely, to the public school, private school, or home school they attend—</text><subparagraph id="idC52051E1C74B484BA49F35E36CCBB0BD"><enum>(A)</enum><text>among the local educational agencies in the State based on the number of eligible children enrolled in the public schools operated by each local educational agency; and</text></subparagraph><subparagraph id="idFDA786CFCF554284AB3A6DAB052514DF"><enum>(B)</enum><text>directly to the eligible children, through education savings accounts, residing in the State who are enrolled in private schools or home schools.</text></subparagraph></paragraph><paragraph id="id3137ab0dbae946519954ece284e80022"><enum>(2)</enum><header>Allowable uses of funds</header><text>Funds allocated under paragraph (1) may be used for, but not limited to—</text><subparagraph id="idb1fe8b4ab21442afac1fcaba72231147"><enum>(A)</enum><text>curriculum and curricular materials;</text></subparagraph><subparagraph id="id72d5d2ad8b1e4226ab02f248a660383b"><enum>(B)</enum><text>books or other instructional materials;</text></subparagraph><subparagraph id="id58bc9e180d174bc1bda7df71780d7352"><enum>(C)</enum><text>technological educational materials;</text></subparagraph><subparagraph id="id68a57897320b41ffbdc7ff69a72f90dc"><enum>(D)</enum><text>online educational materials;</text></subparagraph><subparagraph id="ide79431a704054ab6a38a6d0cb5ea1b58"><enum>(E)</enum><text>tutoring or educational classes outside the home;</text></subparagraph><subparagraph id="idD1ADC3C3D0B848B7B3DB2BB0203FB1FA"><enum>(F)</enum><text>private school tuition;</text></subparagraph><subparagraph id="id6BB813188B264836AF5BF9D3128CE08E"><enum>(G)</enum><text>extracurricular activities;</text></subparagraph><subparagraph id="idb01108c31fb24a4f8f02d2833432d04a"><enum>(H)</enum><text>testing fees;</text></subparagraph><subparagraph id="id0c2677cb4e3c44a39a9549d55139e405"><enum>(I)</enum><text>diagnostic tools; and</text></subparagraph><subparagraph id="id4f1c335bf3044bfb9d924c3c74124aaa"><enum>(J)</enum><text>educational therapies for student with disabilities. </text></subparagraph></paragraph><paragraph id="idEEA88AFC9D2C425CA8DDBBA9E63B0E4B"><enum>(3)</enum><header>Plan</header><subparagraph id="idF8BDDF6A46B0488999BD62442E152390"><enum>(A)</enum><header>In general</header><text>Each State that carries out allocations described in paragraph (1) shall establish a plan whereby the parent or guardian of each eligible child in the State will annually notify the relevant local educational agency of the public school or private school which the child will attend, or if the child will instead attend home school.</text></subparagraph><subparagraph commented="no" id="id197AE462A7C348F4BAC3842738586084"><enum>(B)</enum><header>Data collection</header><text>Information collected under this section by the State shall be used for the sole purposes of calculating the allocation of funds and distribution of funds under this section.</text></subparagraph></paragraph></subsection><subsection id="ida942296efb8e4774b77c58218ee53256"><enum>(b)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idA9AC0571D29A4A0694C9C9205F14E446"><enum>(1)</enum><header>Eligible child</header><text>The term <term>eligible child</term> means a child aged 5 to 17.</text></paragraph><paragraph id="id66C504854C5F4A2DBE10D52DC31A9DB6"><enum>(2)</enum><header>Home school</header><text>The term <term>home school</term> means a home school as defined by the laws of the State in which the eligible child resides. </text></paragraph></subsection><subsection id="iddb40b24093d74e22b384a3b1dbc71544"><enum>(c)</enum><header>Student enrollment in public schools, private schools, and home schools</header><paragraph id="id8b6df43b8fcd4efdb8216306464494fb"><enum>(1)</enum><header>Identification of eligible children</header><text>On an annual basis, on a date to be determined by the State educational agency, each local educational agency that receives grant funding in accordance with subsection (a) shall inform the State educational agency of the number of eligible children enrolled in public schools served by the local educational agency and private schools and home schools located in the school district served by the local educational agency in order to provide allocations for each eligible child in equal amounts regardless of where the child attends school in the State. </text></paragraph><paragraph id="id9e6b41b272b24e90be8e15a3f2ef8a91"><enum>(2)</enum><header>Allocation to local educational agencies and eligible children</header><text>Based on the identification of eligible children in paragraph (1), the State educational agency shall provide—</text><subparagraph id="id677685ACCBF54ED188B8B0B3457C0182"><enum>(A)</enum><text>to a local educational agency an amount equal to the sum of the amount available for each eligible child in the State multiplied by the number of eligible children identified by the local educational agency under paragraph (1) enrolled in public schools served by the local educational agency; and</text></subparagraph><subparagraph id="id09FD3E22A6B74F0093E001F42ED33485"><enum>(B)</enum><text>to an eligible child residing in the State who is enrolled in a private school or home school, through an education savings account, an amount equal to the sum of the amount available for an eligible child in the State.</text></subparagraph></paragraph><paragraph id="id35943f76030d477f9481a2ba5603ad72"><enum>(3)</enum><header>Distribution to public schools</header><text>Each local educational agency that receives funds under paragraph (2)(A) shall distribute such funds to the public schools served by the local educational agency—</text><subparagraph id="ide012bf241ae24b04bbfee06c838bc7db"><enum>(A)</enum><text>based on the number of eligible children enrolled in such schools; and</text></subparagraph><subparagraph id="idfb5493e5f5984215839d9ae522d41fdf"><enum>(B)</enum><text>in a manner that would, in the absence of such Federal funds, supplement the funds made available from non-Federal resources for the education of pupils participating in programs under this Act, and not to supplant such funds (in accordance with the method of determination described in section 1118).</text></subparagraph></paragraph><paragraph id="id535e3d38a2c94464908137c1532c1a19"><enum>(4)</enum><header>Distribution to eligible children</header><text>Each State that carries out allocations described in paragraph (1) shall distribute amounts to the eligible children residing in that State who enroll in a private school or home school—</text><subparagraph id="id0874830f84d440659ceb5848f10d0d93"><enum>(A)</enum><text>through an education savings account, as described in paragraph (2)(B); and</text></subparagraph><subparagraph id="ideaeb425609204ce0a6ffa9fe2fbf9750"><enum>(B)</enum><text>in a manner that would, in the absence of such Federal funds, supplement the funds made available from non-Federal resources for the education of pupils participating in programs under this Act, and not to supplant such funds (in accordance with the method of determination described in section 1118). </text></subparagraph></paragraph></subsection><subsection id="id66860b6c379d454b800e044f10a0b2c2"><enum>(d)</enum><header>Application of participation of children enrolled in private schools</header><text>The provisions of section 1117 shall apply to this section.</text></subsection><subsection id="id3EEC21B03B3F4E6A98AC91559F3CD04B"><enum>(e)</enum><header>Rule of construction</header><paragraph id="idAB080803186D4DFE99FEA2B98DBC810B"><enum>(1)</enum><header>Federally funded school food programs</header><text>Nothing in this section shall be construed to preclude a child eligible for assistance under the free and reduced price school lunch program established under the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751 et seq.</external-xref>) from receiving assistance under such program.</text></paragraph><paragraph id="idB955F769F647483492E3312AE0A7873F"><enum>(2)</enum><header>Prohibition of control over non-public education providers</header><text>Nothing in this section shall permit, allow, encourage, or authorize Federal or State control over non-public education providers.</text></paragraph></subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id1a67d87edb0f4dc896993dc096c07c9f"><enum>(b)</enum><header>Table of contents</header><text>The table of contents in section 2 of the Elementary and Secondary Education Act of 1965 is amended by inserting after the item relating to section 8601 the following: </text><quoted-block style="OLC" id="idd9e4ce25-b6a7-41ce-8eb3-c49a56ac95d5"><toc><toc-entry level="part" idref="id5C878C7BD0EE49BCA2B44178418B9909">PART H—Funds to Follow the Student </toc-entry><toc-entry level="section" idref="id8C50C203D3D1465F8BEA9612FB161BDA">Sec. 8701. Funds to follow the student.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id0F879C960A054063A6E0913E89399B8D"><enum>3.</enum><header>Federal funding under the Individuals with Disabilities Education Act to follow the student</header><subsection commented="no" display-inline="no-display-inline" id="idbdbcfe2b8ef34137b569b21a14b64afa"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Part A of the Individuals with Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1401">20 U.S.C. 1401 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA6D281BAE1F5482A8490AEFE3676C027"><section section-type="subsequent-section" id="idFFA35E548DCD42A193EF4B6CBD65C842"><enum>610A.</enum><header>Funds to follow the student</header><subsection id="id11EBD291C4964CAE8CD036E9BDBF520E"><enum>(a)</enum><header>In general</header><paragraph id="id7A76EA1FDDAA4FA6861DDF8A90F17F19"><enum>(1)</enum><header>Funds to follow the student</header><text>Notwithstanding any other provision of law and to the extent permitted under State law, a State educational agency shall allocate grant funds provided under this Act, for the purposes of ensuring that funding under this Act follows children, whether learning in person or remotely, to the public school, private school, or home school they attend—</text><subparagraph id="idc66eb28c4bbd4db9bb76811acc3c05d1"><enum>(A)</enum><text>among the local educational agencies in the State based on the number of eligible children enrolled in the public schools operated by each local educational agency; and</text></subparagraph><subparagraph id="id209f3d37cb45475b8db20edf75d24625"><enum>(B)</enum><text>directly to the eligible children, through education savings accounts, residing in that State who are enrolled in private schools or home schools.</text></subparagraph></paragraph><paragraph id="ide6490a23a289477b84ea486a75c1546c"><enum>(2)</enum><header>Allowable uses of funds</header><text>Funds allocated under paragraph (1) may be used for, but not limited to—</text><subparagraph id="id0ae4bc86d0f24dca810b6d90cbb55f31"><enum>(A)</enum><text>curriculum and curricular materials;</text></subparagraph><subparagraph id="id546592377dbe4e6bb13e7136ab500988"><enum>(B)</enum><text>books or other instructional materials;</text></subparagraph><subparagraph id="idac4ff1778dce46e0a8eaf39d5ad5d122"><enum>(C)</enum><text>technological educational materials;</text></subparagraph><subparagraph id="idfcb36add59e3492ebf71dbd54996f963"><enum>(D)</enum><text>online educational materials;</text></subparagraph><subparagraph id="id1b5972c961454e57a77d74678122aac9"><enum>(E)</enum><text>tutoring or educational classes outside the home;</text></subparagraph><subparagraph id="id6589B1650E3F4A9688F9616D5B6C1439"><enum>(F)</enum><text>private school tuition;</text></subparagraph><subparagraph id="id6B49AF055A2A40F1B833DB797B22FDF8"><enum>(G)</enum><text>extracurricular activities;</text></subparagraph><subparagraph id="id50e64f913ccb41b8834d54bebbc7549f"><enum>(H)</enum><text>testing fees;</text></subparagraph><subparagraph id="id55f8bcae67504d9294f77220fa085021"><enum>(I)</enum><text>diagnostic tools; and</text></subparagraph><subparagraph id="id58f2ff77102541a493c2c1c7abc44f4f"><enum>(J)</enum><text>educational therapies for student with disabilities. </text></subparagraph></paragraph><paragraph id="id9167963F4BFC4DFDA34B228115E239D0"><enum>(3)</enum><header>Plan</header><subparagraph id="id3760E83ADDA8423EAAD0B838E1504E59"><enum>(A)</enum><header>In general</header><text>Each State that carries out allocations described in paragraph (1) shall establish a plan whereby the parent or guardian of each eligible child in the State will annually notify the relevant local educational agency of the public school or private school which the child will attend, or if the child will instead attend home school.</text></subparagraph><subparagraph commented="no" id="id9cac1c9dbd914a5696ef9ceef3a1dcf0"><enum>(B)</enum><header>Data collection</header><text>Information collected under this section by the State shall be used for the sole purposes of calculating the allocation of funds and distribution of funds under this section. </text></subparagraph></paragraph></subsection><subsection id="id537EEDAB98614B1FB4EEA9EF3BE4A692"><enum>(b)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idF4ECA8BE16C14E28A6E947EB4FD77E4A"><enum>(1)</enum><header>Eligible child</header><text>The term <term>eligible child</term> means a child with a disability who is eligible to receive special education and related services under this Act. </text></paragraph><paragraph id="idED7541C2BB124C03BD1451F68FA82521"><enum>(2)</enum><header>Home school</header><text>The term <term>home school</term> means a home school as defined by the laws of the State in which the eligible child resides. </text></paragraph></subsection><subsection id="idA5A2939440DA4296B01EE2659B22581D"><enum>(c)</enum><header>Student enrollment in public schools, private schools, and home schools</header><paragraph id="id01DF44F2EEE6469C9AF736C2E6329945"><enum>(1)</enum><header>Identification of eligible children</header><text>On an annual basis, on a date to be determined by the State educational agency, each local educational agency that receives grant funding in accordance with subsection (a) shall inform the State educational agency of the number of eligible children enrolled in public schools served by the local educational agency and private schools and home schools located in the school district served by the local educational agency in order to provide allocations for each eligible child in equal amounts regardless of where the child attends school in the State. </text></paragraph><paragraph id="id7F475FCEFBE54A27983063597BDBEE03"><enum>(2)</enum><header>Allocation to local educational agencies and eligible children</header><text>Based on the identification of eligible children in paragraph (1), the State educational agency shall provide—</text><subparagraph id="id6a99fda982a34444975895ed9b1c615a"><enum>(A)</enum><text>to a local educational agency an amount equal to the sum of the amount available for each eligible child in the State multiplied by the number of eligible children identified by the local educational agency under paragraph (1) enrolled in public schools served by the local educational agency; and</text></subparagraph><subparagraph id="idf4238bdfdffe4effadcc311b21fdc0b3"><enum>(B)</enum><text>to an eligible child residing in the State who is enrolled in a private school or home school, through an education savings account, an amount equal to the sum of the amount available for an eligible child in the State.</text></subparagraph></paragraph><paragraph id="idB76FF76EF30B45E6A338BAB1C86418BE"><enum>(3)</enum><header>Distribution to public schools</header><text>Each local educational agency that receives funds under paragraph (2)(A) shall distribute such funds to the public schools served by the local educational agency—</text><subparagraph id="idB67D94A50ED7459B89A35A6433794A72"><enum>(A)</enum><text>based on the number of eligible children enrolled in such schools; and</text></subparagraph><subparagraph id="idFE49666D260645299C03A0253EB12765"><enum>(B)</enum><text>in a manner that would, in the absence of such Federal funds, supplement the funds made available from non-Federal resources for the education of pupils participating in programs under this Act, and not to supplant such funds. </text></subparagraph></paragraph><paragraph id="id6916495baabe46ff85dad4cd6ecd4bd7"><enum>(4)</enum><header>Distribution to eligible children</header><text>Each State that carries out allocations described in paragraph (1) shall distribute amounts to the eligible children residing in that State who enroll in a private school or home school—</text><subparagraph id="id6ae36fdb37c54cc1b536472c771840f3"><enum>(A)</enum><text>through an education savings account, as described in paragraph (2)(B); and</text></subparagraph><subparagraph id="id7ba5fca5010d47a39690dd3611a87400"><enum>(B)</enum><text>in a manner that would, in the absence of such Federal funds, supplement the funds made available from non-Federal resources for the education of pupils participating in programs under this Act, and not to supplant such funds. </text></subparagraph></paragraph></subsection><subsection id="id96B21766DF724035B397C64542133135"><enum>(d)</enum><header>Rule of construction</header><paragraph id="idB302E64FB6EC4DF2A7373F4C25F72D28"><enum>(1)</enum><header>Federally funded school lunch programs</header><text>Nothing in this section shall be construed to preclude a child eligible for assistance under the free and reduced price school lunch program established under the Richard B.
