which was read twice and referred to the <committee-name committee-id="SLIA00">Committee on Indian Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 18, United States Code, to provide Tribal courts and law enforcement with more tools to combat the opioid epidemic.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HD4D330EED7824DDFA20833B1BDD6F315"><section section-type="section-one" id="HD988C721634847B99BDC4456AF0D9DE9"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protection for Reservation Occupants against Trafficking and Evasive Communications Today Act of 2024</short-title></quote> or the <quote><short-title>PROTECT Act of 2024</short-title></quote>.</text></section><section id="H15777FC270AC4940BB2EC6A460B549F9"><enum>2.</enum><header>Tribal court search warrant parity for electronic communications</header><text display-inline="no-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/121">Chapter 121</external-xref> of title 18, United States Code, is amended—</text><paragraph id="H198E511428FD4D658EF2864D03F5C787"><enum>(1)</enum><text>in section 2703—</text><subparagraph id="H063137D491794427B48A2D74AB44786F"><enum>(A)</enum><text>in subsection (a), by striking <quote>issued using State warrant procedures and,</quote> and inserting <quote>issued using State warrant procedures, or, in the case of a Tribal court, issued using the warrant procedures described in section 202 of <external-xref legal-doc="public-law" parsable-cite="pl/90/284">Public Law 90–284</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/25/1302">25 U.S.C. 1302</external-xref>) (commonly known as the <quote>Indian Civil Rights Act of 1968</quote>), or, </quote>; </text></subparagraph><subparagraph id="H3DC13D2F7DB14AA396F629D68962E330"><enum>(B)</enum><text>in subsection (b)(1)—</text><clause id="H4997E8F5C2EA44A6BE1F6B0D6B3C93D9"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>issued using State warrant procedures and,</quote> and inserting <quote>issued using State warrant procedures, or, in the case of a Tribal court, issued using warrant procedures described in section 202 of <external-xref legal-doc="public-law" parsable-cite="pl/90/284">Public Law 90–284</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/25/1302">25 U.S.C. 1302</external-xref>) (commonly known as the <quote>Indian Civil Rights Act of 1968</quote>), or,</quote>; and</text></clause><clause id="H6C699DD6D2FA43EB927025A5B7E8FAF8"><enum>(ii)</enum><text>in subparagraph (B)(i), by striking <quote>authorized by a Federal or State statute</quote> and inserting <quote>authorized by a Federal, Tribal, or State statute</quote> ; and </text></clause></subparagraph><subparagraph id="H6962CFC0246649BA83AEF03FBC3F11D4"><enum>(C)</enum><text display-inline="yes-display-inline">in subsection (c)(1)(A), by striking <quote>issued using State warrant procedures and,</quote> and inserting <quote>issued using State warrant procedures, or, in the case of a Tribal court, issued using the warrant procedures described in section 202 of <external-xref legal-doc="public-law" parsable-cite="pl/90/284">Public Law 90–284</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/25/1302">25 U.S.C. 1302</external-xref>) (commonly known as the <quote>Indian Civil Rights Act of 1968</quote>), or,</quote>; and</text></subparagraph></paragraph><paragraph id="H609DFB3852DE46499B5B77DEC0E63284"><enum>(2)</enum><text>in section 2711—</text><subparagraph id="H5A894E3C65DA40D6B189F871DBA2FFEF"><enum>(A)</enum><text>in paragraph (3)—</text><clause id="H356538EE3D6449C3B09CD61976BE5D81"><enum>(i)</enum><text display-inline="yes-display-inline">in subparagraph (B), by striking <quote>or</quote> at the end;</text></clause><clause id="HFA7970FB190E460D9A137EAF1989DA66"><enum>(ii)</enum><text>in subparagraph (C), by striking <quote>and</quote> at the end and inserting <quote>or</quote>; and</text></clause><clause id="H169B248CEFBC45CABB683717605EF932"><enum>(iii)</enum><text>by inserting at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="HC5380694C9804096A1392D04BA0B882E"><subparagraph id="H0E8FD7CD9FFC42F49A3E114695631CF1"><enum>(D)</enum><text display-inline="yes-display-inline">a court established by the governing body of any Indian or Alaska Native tribe, band, nation, pueblo, village, community, component band, or component reservation individually identified (including parenthetically) on the list published by the Secretary under section 104 of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5131">25 U.S.C. 5131</external-xref>); and</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H89B03CCFB9174584A69C43A502F3382D"><enum>(B)</enum><text>in paragraph (4), by inserting before the period at the end the following: <quote>, or the governing body of any Indian or Alaska Native tribe, band, nation, pueblo, village, community, component band, or component reservation individually identified (including parenthetically) on the list published by the Secretary under section 104 of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5131">25 U.S.C. 5131</external-xref>)</quote>. </text></subparagraph></paragraph></section><section id="H0648A8881F134CA6A7A985B5E955DDF9"><enum>3.</enum><header>Tribal jurisdiction over drug trafficking, related offenses, and firearms</header><text display-inline="no-display-inline">Section 204 of <external-xref legal-doc="public-law" parsable-cite="pl/90/284">Public Law 90–284</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/25/1304">25 U.S.C. 1304</external-xref>) (commonly known as the <quote>Indian Civil Rights Act of 1968</quote>) is amended— </text><paragraph id="H7507180191384875819EC5E2E202ED16"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="HC31857B3386C4164A67C11D61D7FFE47"><enum>(A)</enum><text>in paragraph (5)—</text><clause id="HCCFA7C75C568460783B1B18885B1C395"><enum>(i)</enum><text display-inline="yes-display-inline">in subparagraph (H), by striking <quote>and</quote> at the end;</text></clause><clause id="H038BCF1C4AAE4FFE9BFF8F6B7D85CF3F"><enum>(ii)</enum><text display-inline="yes-display-inline">in subparagraph (I), by striking the period at the end and inserting a semicolon; and</text></clause><clause id="HF2F25AAD5D5C410385E0653DB4CE3E7B"><enum>(iii)</enum><text>by inserting at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="H381EBB1D57644175B2124AC03D43A3BA"><subparagraph id="HA23FED2FCAE7449985052B8FD8E7963E"><enum>(J)</enum><text display-inline="yes-display-inline">drug trafficking and related offenses; and</text></subparagraph><subparagraph id="HFBC1772DA061407A9441032C5515D7F5"><enum>(K)</enum><text>firearms offense.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H87DA97EB024D499CA5F2986E921E0304"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="HCC4F5A7C968443F79863E5DDEDCD6FE6"><paragraph id="HCCD379B6E2D449188415717055A6B778"><enum>(18)</enum><text>The term <term>drug trafficking and related offenses</term> means a violation of the criminal law of the Indian tribe that has jurisdiction over the Indian country where the violation occurs that involves the manufacture, delivery, or possession, or attempt or conspiracy to do the same, of—</text><subparagraph id="HE4B32C089A4E4DA5B7395C7816C3CD3B"><enum>(A)</enum><text>a controlled substance as defined in section 102 of the Controlled Substances Act, (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>);</text></subparagraph><subparagraph id="HACA7EFFD927C4B1FB6254332583D257D"><enum>(B)</enum><text>a counterfeit substance as defined in section 102 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>); or</text></subparagraph><subparagraph id="HB36E6AD66FFC40AEA8D7DF96037A34DE"><enum>(C)</enum><text display-inline="yes-display-inline">drug paraphernalia, as defined in section 422(d) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/863">21 U.S.C. 863(d)</external-xref>).</text></subparagraph></paragraph><paragraph id="H25C58DE471F64E6EACE6A5EC74559A50"><enum>(19)</enum><text>The term <term>firearms offense</term> means a violation of the criminal law of the Indian tribe that has jurisdiction over the Indian country where the violation occurs that involves the use or possession of a firearm in furtherance of a covered crime or the use or possession of a firearm by a person who has been convicted of domestic violence.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H7E465BD10CE845E991147A42104F2060"><enum>(2)</enum><text>in subsection (b)(4)(A), by striking <quote>or assault of Tribal justice personnel,</quote> and inserting <quote>, assault of Tribal justice personnel, drug trafficking or related offenses, or a firearms offense,</quote>. </text></paragraph></section><section commented="no" id="H7B5270BAA78843D98CEA6CF5C459EE9E"><enum>4.</enum><header>Bureau of Prisons Tribal Prisoner Program</header><text display-inline="no-display-inline">Paragraph (2)(B) of section 234(c) of the Tribal Law and Order Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/25/1302a">25 U.S.C. 1302a</external-xref>) is amended by inserting <quote>or offenders convicted pursuant to the exercise of special Tribal criminal jurisdiction described in section 204 of <external-xref legal-doc="public-law" parsable-cite="pl/90/284">Public Law 90–284</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/25/1304">25 U.S.C. 1304</external-xref>) (commonly known as the <quote>Indian Civil Rights Act of 1968</quote>)</quote> after <quote>(comparable to the violent crimes described in section 1153(a) of title 18)</quote>.</text></section></legis-body></bill>
