which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish a grant program to assist projects that use nonlethal coexistence measures to reduce property damage caused by native beavers, a keystone species, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HEE90460C589E42A1A048D06600AB9688"><section section-type="section-one" id="H9BC9993B0CB148BB98D0DCB9497077B0"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Developing Alternative Mitigation Systems for Beavers Act</short-title></quote> or the <quote><short-title>DAMS for Beavers Act</short-title></quote>. </text></section><section id="H90AA187228F748D1AE8E25DF96A69A5B"><enum>2.</enum><header>Beaver damage mitigation grant program</header><subsection id="HF045AF40D2A2489AAB78C881B706E0F9"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="HC3DBA655E7BE455A94430F25E0CE8AA8"><enum>(1)</enum><header>Eligible entity</header><text display-inline="yes-display-inline">The term <term>eligible entity</term> means—</text><subparagraph id="H55F8BEFA2C9544288197F6C51F7418BE"><enum>(A)</enum><text display-inline="yes-display-inline">an Indian Tribe (as defined in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>));</text></subparagraph><subparagraph id="HC9DCFA15890341968F65B6F2A8B5E508"><enum>(B)</enum><text>a State or Tribal agency;</text></subparagraph><subparagraph commented="no" id="H7F8C81079A1E41258CF61E92FE572C90"><enum>(C)</enum><text>a unit of local government;</text></subparagraph><subparagraph id="H0584979335B644699C6464C5867EE332"><enum>(D)</enum><text>a foundation, nonprofit organization, or institution of higher education; and</text></subparagraph><subparagraph commented="no" id="H2C9A0DBD248042FF916B6AD451047FE5"><enum>(E)</enum><text>a partnership between—</text><clause commented="no" id="H723D3078B1094A6EBB429241D92923EC"><enum>(i)</enum><text>1 or more entities described in any of subparagraphs (A) through (D); and</text></clause><clause commented="no" id="H2D654AE293154C0591BA2FA69EC1F2C4"><enum>(ii)</enum><text>an owner of property that has sustained or is at risk of sustaining property damage due to beaver activity.</text></clause></subparagraph></paragraph><paragraph id="H94D8940710674443B158F8194ECA7972"><enum>(2)</enum><header>Nonlethal coexistence measure</header><subparagraph id="H06CA5DD60F434C4794760530D7EEEDFF"><enum>(A)</enum><header>In general</header><text>The term <term>nonlethal coexistence measure</term> means a measure designed to mitigate property damage caused by beavers that does not incorporate—</text><clause id="H0D1BB4FD131A49CCA8EBA99B46CB53DF"><enum>(i)</enum><text>the gripping, trapping, injuring, or killing of a beaver;</text></clause><clause id="HD7C0CBBA313F4D98A2553F4D502704D4"><enum>(ii)</enum><text>the destruction or removal of a beaver dam or lodge, unless the destruction or removal is necessary to install flow management devices; or</text></clause><clause id="H0E71DADE48DB40EF923F50606BEC278C"><enum>(iii)</enum><text>the relocation of a beaver.</text></clause></subparagraph><subparagraph id="H2025CFB25A7446D2A1C8920B45D535CB"><enum>(B)</enum><header>Inclusions</header><text>The term <term>nonlethal coexistence measure</term> includes—</text><clause id="H5931E215DA154575A568E210F0C0B2CA"><enum>(i)</enum><text display-inline="yes-display-inline">fencing used to protect culverts;</text></clause><clause id="H2196109E2B714259BFB7AB79AEE278D3"><enum>(ii)</enum><text>fencing and paint-sand mixtures used to protect trees;</text></clause><clause id="H2A8825B721664EB7BCF5FD0A216361B7"><enum>(iii)</enum><text>fencing used to protect earthen dams from beaver burrowing; and</text></clause><clause id="H2ED98C53F6BE47698FD9D9113CAA2F53"><enum>(iv)</enum><text>flow management devices used to control water levels in beaver ponds.</text></clause></subparagraph></paragraph><paragraph id="H2A3266B356934913905AA7A75797BD8C"><enum>(3)</enum><header>Program</header><text>The term <term>Program</term> means the grant program established under subsection (b).</text></paragraph><paragraph id="HA7ACAC20E64A4E738C4A9A9D5DA58A50" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior, acting through the Director of the United States Fish and Wildlife Service.</text></paragraph></subsection><subsection id="H45AB69FC931144F592050853E95F5F25"><enum>(b)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary shall establish and implement a grant program under which the Secretary may award grants on a competitive basis to eligible entities to carry out projects that use nonlethal coexistence measures—</text><paragraph id="H0C832F8B85934BA5B291A31BD6C8725D"><enum>(1)</enum><text>to reduce property damage caused by beavers; and</text></paragraph><paragraph id="H4DAC6F484B32429D8119F7460BA935B8"><enum>(2)</enum><text>to maintain or enhance habitat for beavers and other wildlife.</text></paragraph></subsection><subsection commented="no" id="H00BC4C3515B140E7A32365F206715AE8"><enum>(c)</enum><header>Administration</header><text>The Secretary may enter into an agreement with the National Fish and Wildlife Foundation established by section 2(a) of the National Fish and Wildlife Foundation Establishment Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3701">16 U.S.C. 3701(a)</external-xref>) to administer the Program in consultation with the United States Fish and Wildlife Service. </text></subsection><subsection id="H14272C72FB474497BB547455B3A00EDD"><enum>(d)</enum><header>Application</header><text>An eligible entity desiring a grant under the Program shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require, which shall include the following:</text><paragraph id="HF48C40D2E905438A9EF59E69BC8E96A8"><enum>(1)</enum><text>A description of the experience, qualifications, and training (including planned training) of the eligible entity with respect to the use of nonlethal coexistence measures.</text></paragraph><paragraph id="H4B6E11D2F86E4BB7B7ED74C1BCF55CF5"><enum>(2)</enum><text>In the case of an application submitted by an eligible entity that is not a State or Tribal wildlife or natural resources management agency (or equivalent), a certification that the eligible entity has consulted with such an agency (or equivalent).</text></paragraph><paragraph id="HC8D5E8286B0C429F991A7D685E9D92CB"><enum>(3)</enum><text display-inline="yes-display-inline">In the case of an application submitted by an eligible entity that is not an owner of the property on which a relevant proposed project will be located, a certification that—</text><subparagraph id="H57B59A908CAF4837B93457A803B3D7B1"><enum>(A)</enum><text>each owner of the property consents to the project; and</text></subparagraph><subparagraph commented="no" id="H143CFB61FEC44D04BEE598AAD4390374"><enum>(B)</enum><text display-inline="yes-display-inline">for the duration of the project, only nonlethal coexistence measures will be used on the property for purposes of reducing property damage caused by beavers (except in the case of a circumstance subject to an exception under subsection (f)(3)(A)).</text></subparagraph></paragraph></subsection><subsection commented="no" id="H9E45504A992641E8B23032DF48128E0E"><enum>(e)</enum><header>Priority</header><text display-inline="yes-display-inline">In awarding grants under the Program, the Secretary may give priority to projects that—</text><paragraph id="H573238919FE04DB2BC347946292A613C"><enum>(1)</enum><text display-inline="yes-display-inline">include monitoring and research that facilitates—</text><subparagraph id="H858D6D46E1B34BC6BACAA9DF87901262"><enum>(A)</enum><text>evaluating the impact of the project;</text></subparagraph><subparagraph id="H6ADB2BF1DD9A4335BB8690DEDDA99A69"><enum>(B)</enum><text>gathering data for use in future projects; and</text></subparagraph><subparagraph id="HCBE5C8BB007C4B0BB3B2AB7B16C2D635"><enum>(C)</enum><text>identifying best practices;</text></subparagraph></paragraph><paragraph commented="no" id="H28DFAB4DFB4545408212127C3A936E10"><enum>(2)</enum><text>include maintenance and adaptive management of nonlethal coexistence measures;</text></paragraph><paragraph id="HD4AB74F2C0F84AA7AB33FABDB1F9E75A"><enum>(3)</enum><text display-inline="yes-display-inline">include educational and outreach activities;</text></paragraph><paragraph id="HF7D318906DFE4ABE887FE37DD0F8DFA7"><enum>(4)</enum><text display-inline="yes-display-inline">have received Federal funding through any program established under title 23, United States Code, or the program established under section 6703(b) of title 49, United States Code, as determined in coordination with the Secretary of Transportation; or</text></paragraph><paragraph id="HFA0F98AC68CA4889875E519F9E3ED542"><enum>(5)</enum><text display-inline="yes-display-inline">satisfy any other criteria the Secretary determines relevant to effectively reducing damage to property by, and maintaining or enhancing habitat for, beavers and other wildlife.</text></paragraph></subsection><subsection id="HB469F807B8474F91A3F60393422A4D81"><enum>(f)</enum><header>Conditions and termination</header><paragraph commented="no" id="HF5D250826E224B26B3F38CC63D2ECBF6"><enum>(1)</enum><header>Conditions</header><text display-inline="yes-display-inline">Except as provided in paragraph (3), as a condition of receiving a grant under the Program, for the duration of a project carried out with grant funds awarded under the Program, an eligible entity may use only nonlethal coexistence measures for purposes of reducing property damage caused by beavers on the property on which the project is carried out.</text></paragraph><paragraph commented="no" id="H754E0AE4CD2847CE911783D5B1977E8F"><enum>(2)</enum><header>Termination</header><text display-inline="yes-display-inline">Except as provided in paragraph (3), the Secretary shall terminate a grant made to an eligible entity under the Program if a measure other than a nonlethal coexistence measure is used on the property on which the relevant project is carried out for purposes of reducing property damage caused by beavers on the property.</text></paragraph><paragraph id="H1F07817A8DE24665AC2D78249EB507C3"><enum>(3)</enum><header>Exceptions</header><subparagraph id="H831795A5A9ED41228B8B74E771D10603"><enum>(A)</enum><header>In general</header><text>Paragraphs (1) and (2) shall not apply if the Secretary determines—</text><clause id="H88E8060EDFFC4F5BA4D27A72665A0856"><enum>(i)</enum><text>that a measure other than a nonlethal coexistence measure is necessary to protect human health or safety;</text></clause><clause id="H39DEE57F9C6E49CDA0E517C46A22AB25"><enum>(ii)</enum><text display-inline="yes-display-inline">in consultation with relevant Federal and State agencies, that a measure other than a nonlethal coexistence measure is necessary to protect a Federal or State flood control or water rights mandate; or</text></clause><clause commented="no" id="H4BE886F67546423E8BB576CB0A700BF2"><enum>(iii)</enum><text display-inline="yes-display-inline">that a project carried out with grant funds awarded under the Program has been implemented for more than 1 year and the project has not sufficiently reduced property damage caused by beavers on the property on which the project is carried out.</text></clause></subparagraph><subparagraph id="HB5ACE40FF63C4BF898D3CBA7D988B5D0"><enum>(B)</enum><header>Documentation</header><text display-inline="yes-display-inline">The Secretary shall maintain a record of each determination made under subparagraph (A).</text></subparagraph></paragraph></subsection><subsection id="H4D47F9069E5F4E5E8289BE4DFCA80F35"><enum>(g)</enum><header>Federal share</header><text>The Federal share of the cost of a project for which a grant is awarded under the Program may not exceed 75 percent.</text></subsection><subsection id="H6825F63A0D444DC6BA71099C689208C0"><enum>(h)</enum><header>Federal agency partnerships</header><text>An eligible entity may enter into a partnership with a Federal agency for assistance in—</text><paragraph id="HAC55327DCAD24F9EA272BBFF13792E47"><enum>(1)</enum><text>applying for a grant under the Program; or</text></paragraph><paragraph id="H140382ABEA9E4D7AA8FF9E1F40896B92"><enum>(2)</enum><text>carrying out a project with a grant awarded the Program.</text></paragraph></subsection><subsection id="HCE1C30166AE042C5A2F4A1FE93B79E2C"><enum>(i)</enum><header>Annual report to Congress</header><text display-inline="yes-display-inline">Not later than 90 days after the end of each fiscal year in which grants are awarded under the Program, the Secretary shall submit to Congress, and make publicly available, a report that includes—</text><paragraph id="H61D7854C537D4691B93201C071CDC1AF"><enum>(1)</enum><text>a detailed description of the projects funded by grants under the Program, including the extent to which such projects represent diverse geographic areas;</text></paragraph><paragraph id="H50459D12BEB14E7995F74B52C9750A7E"><enum>(2)</enum><text>an evaluation of the effectiveness of the Program in selecting projects according to the priorities described in subsection (e); and</text></paragraph><paragraph id="HCFF6742A1FF5476C9A27589250A2A56F"><enum>(3)</enum><text>recommendations to improve the effectiveness of the Program.</text></paragraph></subsection><subsection id="H3C3282A7617445CA8521EA414E253635"><enum>(j)</enum><header>Authorization of appropriations</header><paragraph id="H003E6C4D0D054207AE0EF890D80B9A05"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated to carry out this section $3,000,000 for each of fiscal years 2025 through 2029.</text></paragraph><paragraph id="H11F37E22C69D4E938761C1D21364D250"><enum>(2)</enum><header>Administrative expenses</header><text>Not more than 10 percent of the amounts made available each fiscal year to carry out this section may be used for administrative expenses of the Program.</text></paragraph></subsection></section></legis-body></bill>
