which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title XVIII of the Social Security Act to provide coverage of contraceptive items and services at no cost-sharing under the Medicare program, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H1100B35E391847B3A35FDB3E09A46906"><section section-type="section-one" id="HFC0078F7F6704495BF161E2D6B64DFDF"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Closing the Contraception Coverage Gap Act</short-title></quote>.</text></section><section id="H195D2E2119F149C79E2E3C3B1758DB51"><enum>2.</enum><header>Providing coverage of contraceptive items and services at no cost-sharing under the Medicare program</header><subsection id="H1F0BE189BBFB4E67B51C5BEFD985E81B"><enum>(a)</enum><header>Part B coverage</header><paragraph id="H4A6A4DF2696D41B7865B0D71B0E386C5"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1861 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x</external-xref>) is amended—</text><subparagraph id="HF1DC91746E504B3690EC0637B47AD2BB"><enum>(A)</enum><text>in subsection (s)(2)—</text><clause id="HC265BCCF4F8C416A812394C6965D1D92"><enum>(i)</enum><text>in subparagraph (JJ), by inserting <quote>and</quote> after the semicolon at the end; and</text></clause><clause id="HA6A61098B420474FADD7E886514D79D9"><enum>(ii)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HDD599D5948274CE597ACAE3C79AF4212"><subparagraph id="H97D3A29802594B29BEF44260DBC1D605" indent="up1"><enum>(KK)</enum><text display-inline="yes-display-inline">contraceptive items and services (as defined in subsection (nnn)) furnished to individuals on or after January 1, 2026.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H3D871F8AFC2746AE84B32FDCC3FAD3CA"><enum>(B)</enum><text>by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H3686B3AB7FAC4CDBB3D16082AC3E44B8"><subsection id="H4D7D31654CC742559034CF523DB83CBA"><enum>(nnn)</enum><header>Contraceptive items and services</header><paragraph id="id763CCDF2F66A463DAD9FDB218D5DAD28"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The term <quote>contraceptive items and services</quote> means items and services furnished by a physician or practitioner (as defined in section 1842(b)(18)(C))—</text><subparagraph commented="no" display-inline="no-display-inline" id="ida85c836b49cb4f388136e095bfc2529b"><enum>(A)</enum><text display-inline="yes-display-inline">that—</text><clause id="H8D80E5CDF7A54779943064799C5A84E8"><enum>(i)</enum><text>align with guidance as of January 12, 2022, issued in accordance with in section 2713(a)(4) of the Public Health Service Act (including patient-centered counseling services); and </text></clause><clause id="HC2EF697DCA7E483D97235A6374DF2056"><enum>(ii)</enum><text>may be furnished for the purpose of contraception; or</text></clause></subparagraph><subparagraph id="idff1b1fb51ec647578185f22651debaff"><enum>(B)</enum><text>that are ancillary clinical services.</text></subparagraph></paragraph><paragraph id="idde9ab839547440b8aedd848f7987c91c"><enum>(2)</enum><header>Ancillary clinical services</header><text>For purposes of paragraph (1)(B), the term <term>ancillary clinical services</term> means—</text><subparagraph id="id06e12832b3d54ee28f4e578482924033"><enum>(A)</enum><text>clinical services that are related to the items and services described in paragraph (1)(A), including consultations, examinations, procedures, device insertion, ultrasound, pain management, patient education, referrals, and counseling; and</text></subparagraph><subparagraph id="id0b2e003ce12c4e1aaf27e76f086bb04c"><enum>(B)</enum><text>follow-up services related to the provision or use of the items and services described in paragraph (1)(A), including management of side effects, counseling for continued adherence, and device removal. </text></subparagraph></paragraph><paragraph id="id5BE916DC61F545A1BCF0EFCF4132F5D4"><enum>(3)</enum><header>Clarification</header><text>The term <quote>contraceptive items and services</quote> includes items and services described in paragraph (1) regardless of whether such items and services are actually furnished for purposes of contraception.</text></paragraph><paragraph id="idF622B8E2962140308D0A61A5E970CF60"><enum>(4)</enum><header>Patient-centered counseling services</header><text>For purposes of paragraph (1)(A), the Secretary shall issue guidance regarding the coverage of patient-centered counseling. Such guidance shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="id78b5fa9deec243cca31135256eea0af2"><enum>(A)</enum><text display-inline="yes-display-inline">align with guidance as of January 12, 2022, issued in accordance with section 2713(a)(4) of the Public Health Service Act.; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide5d5ea6d136e461cb2b7802f99052c22"><enum>(B)</enum><text display-inline="yes-display-inline">include the coverage of counseling to all patients on the full range of contraceptive items and services described in paragraph (1).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H51376CA11A644B93B2E74F944AD75F67"><enum>(2)</enum><header>Payment</header><text display-inline="yes-display-inline">Section 1833 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395l">42 U.S.C. 1395l</external-xref>) is amended—</text><subparagraph id="H0076CC467E3B4DD998C57C3341A36B44"><enum>(A)</enum><text>in subsection (a)(1)—</text><clause id="HB3B02D912EDA4329B03B7A5E3A1AE185"><enum>(i)</enum><text>by striking <quote>and</quote> before <quote>(HH)</quote>; and</text></clause><clause id="H9634D613C5BB427C815239708CB8FA3D"><enum>(ii)</enum><text>by inserting the following before the semicolon: <quote>and (II) with respect to contraceptive items and services (as defined in section 1861(nnn)), the amount paid shall be an amount equal to 100 percent of the lesser of the actual charge for the items and services or the amount determined under a payment basis determined appropriate by the Secretary</quote>; and</text></clause></subparagraph><subparagraph id="HA672ADF716E442F3A4AF2C6173D3E272"><enum>(B)</enum><text>in subsection (b), in the first sentence—</text><clause id="HE14B21A39B514682A6BA12B93E846598"><enum>(i)</enum><text>by striking <quote>, and (13)</quote> and inserting <quote>(13)</quote>; and</text></clause><clause id="H1D76B2D9521A4A0F95C2CD66EE393575"><enum>(ii)</enum><text>by striking <quote>1861(n)..</quote> and inserting <quote>1861(n) , and (14) such deductible shall not apply with respect to contraceptive items and services (as defined in section 1861(nnn)).</quote>.</text></clause></subparagraph></paragraph><paragraph id="H7601CBBB15744C04B7D92FE3619CFB8F"><enum>(3)</enum><header>Exclusion modification</header><text>Section 1862(a)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395y">42 U.S.C. 1395y(a)(1)</external-xref>) is amended—</text><subparagraph id="H3EBE09A0DEB8429DAC9E9E1E7207E6D8"><enum>(A)</enum><text>in subparagraph (O), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="HDFB4355F2A08466D8D7FB30F917B9661"><enum>(B)</enum><text>in subparagraph (P), by striking the semicolon and inserting <quote>, and</quote>; and</text></subparagraph><subparagraph id="HBDC8CDBDFDC944DBBFA62636B43F4253"><enum>(C)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HF021319F130542BF9CABA71A244BFB9D"><subparagraph id="HD5A40C814B5D44DCB1BA0EBC5A11E6AF" indent="up1"><enum>(Q)</enum><text display-inline="yes-display-inline">in the case of contraceptive items and services (as defined in section 1861(nnn)), which are not furnished or ordered by a physician or practitioner (as defined in section 1842(b)(18)(C));</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idf025592c88564171af8e75ede809aaa9"><enum>(4)</enum><header>Quality measures</header><text>The Secretary of Health and Human Services may, for the purposes of ensuring quality in services, develop measures of contraceptive counseling, care, and access, including but not limited to validated survey instruments.</text></paragraph></subsection><subsection id="H1FD30E40FBD74A6F8AFACFB1AA97BCB1"><enum>(b)</enum><header>Part C cost-Sharing for contraceptive items and services</header><paragraph id="HDE9DE1E051BD4C47A5BBF31FE53D419A"><enum>(1)</enum><header>In general</header><text>Section 1852(a)(1)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-22">42 U.S.C. 1395w–22(a)(1)(B)</external-xref>) is amended—</text><subparagraph id="H89A7B5B725E1458490C3F276B58B7298"><enum>(A)</enum><text>in clause (iv)—</text><clause id="HD3B3D3831AC84DC994F649C387C08C2B"><enum>(i)</enum><text>by redesignating subclause (VIII) as subclause (IX); and</text></clause><clause id="H47666AF63D9F499884C3246DA25C21E4"><enum>(ii)</enum><text>by inserting after subclause (VII) the following new subclause:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HF7BA128CF75D4888B87E9A01763638FE"><subclause id="HDC49B5095FCC46F38AE346502515BDBB"><enum>(VIII)</enum><text display-inline="yes-display-inline">Contraceptive items and services (as defined in section 1861(nnn)).</text></subclause><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="HC892F7EA492841A0ABC88FD63CB1A918"><enum>(B)</enum><text>in clause (v), by striking <quote>and (VI)</quote> and inserting <quote>(VI), and (VIII)</quote>.</text></subparagraph></paragraph><paragraph id="HE5BADCA9A2AC4E449037C90827F90BFB"><enum>(2)</enum><header>Effective date</header><text>The amendments made by this subsection shall apply with respect to plan years beginning on or after January 1, 2026.</text></paragraph></subsection><subsection id="HEF9FF947D6D54030859D63247D5B6F45"><enum>(c)</enum><header>Part D coverage and cost-Sharing for contraceptive drugs</header><paragraph id="H345EBA2D275A45E290184381B82AA946"><enum>(1)</enum><header>Coverage</header><text display-inline="yes-display-inline">Section 1860D–4(b)(3)(G) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-104">42 U.S.C. 1395w–104(b)(3)(G)</external-xref>) is amended—</text><subparagraph id="H0222FC2802F84F89A4C49FACE598EC0F"><enum>(A)</enum><text>in clause (ii)(I), by adding at the end the following new sentence: <quote>Such identification shall include the drugs described in clause (iv)(VII).</quote>; and</text></subparagraph><subparagraph id="H7A50B808C6804E238F04BCCEEBE33CEC"><enum>(B)</enum><text>in clause (iv), by adding at the end the following new subclause:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HD33B48061F11448D92C35B56F4964C0C"><subclause id="HF5CE8A6B20E443B4BF43AA8A614287E7"><enum>(VII)</enum><text display-inline="yes-display-inline">Covered part D drugs described in guidelines issued pursuant to section 2713(a)(4) of the Public Health Service Act and that may be furnished for purposes of contraception (regardless of whether such drugs are actually furnished for purposes of contraception).</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HB0754B51B23941EE890A5805FF10A256" commented="no"><enum>(2)</enum><header>Cost-sharing</header><text display-inline="yes-display-inline">Section 1860D–2 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-102">42 U.S.C. 1395w–102</external-xref>) is amended—</text><subparagraph id="H0B9EE5AC0AF0456EA858658A14034CB1" commented="no"><enum>(A)</enum><text>in subsection (b)—</text><clause id="HF6464041B34149859D6C912E749824C9" commented="no"><enum>(i)</enum><text>in paragraph (1)(A), in the matter preceding clause (i), by striking <quote>and (9)</quote> and inserting <quote>, (9), and (10)</quote>;</text></clause><clause commented="no" id="H52692BFD137B4FE9991F7DE91FDE4FCA"><enum>(ii)</enum><text>in paragraph (2)(A), in the matter preceding clause (i), by striking <quote>and (9)</quote> and inserting <quote>, (9), and (10)</quote>;</text></clause><clause commented="no" id="HA8C4E6AA55A041B6A12C8A4430658EEB"><enum>(iii)</enum><text>in paragraph (3)(A), in the matter preceding clause (i), by striking <quote>and (9)</quote> and inserting <quote>(9), and (10)</quote>; and</text></clause><clause id="H9644295E8A8441FB8ACF813E48B2ED66" commented="no"><enum>(iv)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H5A004FACE4F244EF9844BD27DA627A17"><paragraph id="HF98DF259846141B9867060500F752A59" commented="no"><enum>(10)</enum><header>Treatment of cost-sharing for contraceptive drugs</header><text>For plan years beginning on or after January 1, 2026, with respect to a covered part D drug that is described in guidelines issued pursuant to section 2713(a)(4) of the Public Health Service Act and that may be furnished for purposes of contraception (regardless of whether such drug is actually furnished for purposes of contraception)—</text><subparagraph commented="no" id="H255428A3FD54462DB711C859C6C2012C"><enum>(A)</enum><text>the deductible under paragraph (1) shall not apply; and</text></subparagraph><subparagraph commented="no" id="HE54FEE05424B413CAC2F043A7856AFDB"><enum>(B)</enum><text>there shall be no coinsurance or other cost-sharing under this part with respect to such drug.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="HACD7A5B009874595B6B97D2CE52ADA49" commented="no"><enum>(B)</enum><text>in subsection (c), by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H4309FF32A25D430193B542DDE6F77C26"><paragraph id="H506611C17A534E4EBE517C33D54F2E73" commented="no"><enum>(7)</enum><header>Treatment of cost-sharing for contraceptive drugs</header><text>The coverage is provided in accordance with subsection (b)(10).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HBD7DE5225A824BD086DCF6DA0CA297F4" commented="no"><enum>(3)</enum><header>Conforming amendments to cost-sharing for low-income individuals</header><text>Section 1860D–14(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-114">42 U.S.C. 1395w–114(a)</external-xref>) is amended—</text><subparagraph id="HF6E8922C41284072BD52C58E9E6CB27F" commented="no"><enum>(A)</enum><text>in paragraph (1)(D), in each of clauses (ii) and (iii), by striking <quote>paragraph (6)</quote> and inserting <quote>paragraphs (6) and (7)</quote>;</text></subparagraph><subparagraph id="H39D133F7CB3A43C6AE161E766CC77C27" commented="no"><enum>(B)</enum><text>in paragraph (2)—</text><clause id="HFE3C1831756D4EB1ABB27AD6F02D34E8" commented="no"><enum>(i)</enum><text>in subparagraph (B), by striking <quote>and (9)</quote> and inserting <quote>, (9), and (10)</quote>;</text></clause><clause id="HD6F897C9AC8F4189AD5CB359D22E35C5" commented="no"><enum>(ii)</enum><text>in subparagraph (D), by striking <quote>paragraph (6)</quote> and inserting <quote>paragraphs (6) and (7)</quote>; and</text></clause><clause id="H4ACF2A6B2D0548AEBC10BEC9FFDC5446"><enum>(iii)</enum><text>in subparagraph (E), by striking <quote>paragraph (6)</quote> and inserting <quote>paragraphs (6) and (7)</quote>; and </text></clause></subparagraph><subparagraph id="HFCA811FC890C4F21A26CF47B1A252ACC" commented="no"><enum>(C)</enum><text>by adding at the end the following new paragraph:</text><quoted-block id="H9EDECAE1756541408F80E15384D956C8" display-inline="no-display-inline" style="OLC"><paragraph id="H85BE23F4C77E48ABAC15DD714BC952C3" commented="no"><enum>(7)</enum><header>No application of cost-sharing or deductible for contraceptive drugs</header><text>For plan years beginning on or after January 1, 2026, with respect to a covered part D drug that is described in guidelines issued pursuant to section 2713(a)(4) of the Public Health Service Act and that is furnished for purposes of contraception—</text><subparagraph commented="no" id="HB4AF83C8DE1745D292302D537C998734"><enum>(A)</enum><text>the deductible under section 1860D–2(b)(1) shall not apply; and</text></subparagraph><subparagraph id="H10E1F5C501F04CE5B3ED0C1B35A166A9" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>there shall be no cost-sharing under this section with respect to such drug.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H6A7D7102DDCD4A298CCDBBF1356E658D"><enum>(4)</enum><header>Effective date</header><text>The amendments made by this subsection shall apply with respect to plan years beginning on or after January 1, 2026.</text></paragraph></subsection><subsection id="idf6c4fc9dee384fc6b461120f790dc1f7"><enum>(d)</enum><header>Ensuring comparable coverage for dual eligible individuals</header><text>In implementing the amendments made by this section, the Secretary of Health and Human Services shall ensure that the coverage of contraceptive items and services (as defined in section 1861(nnn) of the Social Security Act (as added by subsection (a)) and covered part D drugs described in section 1860D–4(b)(3)(G)(VII) of such Act (as added by subsection (c)(1)) with respect to individuals who are dually eligible for benefits under the Medicare program under title XVIII of such Act and for medical assistance under a State plan under title XIX of such Act (or a waiver of such plan) is at least as comprehensive as the coverage of such items and services and drugs for such individuals under such State plans (or waivers of such plans), as determined by the Secretary based on an annual review of such State plans (and waivers of such plans). </text></subsection></section><section commented="no" display-inline="no-display-inline" id="id14b71c3f03284d65911411f7913f39e4"><enum>3.</enum><header>HHS study and report on prescription drug coverage for Medicare beneficiaries living with disabilities</header><subsection id="id184669AA721247BFB576BF626B29AF56"><enum>(a)</enum><header>Study</header><text>The Secretary of Health and Human Services (in this section referred to as the <quote>Secretary</quote>) shall conduct a study on—</text><paragraph id="id2043A02F3764498B9DEC8AAB20A2757B"><enum>(1)</enum><text>the adequacy of access to prescription drug coverage, including oral contraceptives, among Medicare beneficiaries living with disabilities who are enrolled under the original Medicare fee-for-service program under parts A and B of title XVIII of the Social Security Act (but not enrolled under part C or D of such title XVIII); and </text></paragraph><paragraph id="idA73E08C03C16450C97C58BAE585AFA01"><enum>(2)</enum><text>providing coverage of over-the-counter contraceptive drugs under the Medicare program under such title XVIII with no cost-sharing.</text></paragraph></subsection><subsection id="id5E7379195DF84F7B9B0C74690EC58D68" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall submit to Congress a report on the study conducted under subsection (a), together with recommendations for such legislation and administrative action as the Secretary determines appropriate. </text></subsection></section><section id="id157763B3424D42C5A4677EFA9A677902"><enum>4.</enum><header>GAO study and report on contraceptive coverage requirements under commercial and public health plans</header><subsection id="id3fd196f0da694ff5aba3f33790043b99"><enum>(a)</enum><header>Study</header><text>The Comptroller General of the United States (in this section referred to as the <quote>Comptroller General</quote>) shall conduct a study on the forms of health insurance (including commercial plans and public health programs (including Medicaid, Medicare, and TRICARE)), that are not required by State or Federal law to do one or both of the following: </text><paragraph id="idE326ED74722F4654BBA8314749C7E423"><enum>(1)</enum><text>Cover all forms of contraception approved by the Food and Drug Administration. </text></paragraph><paragraph id="id956FD5F5FD094B71BEBE089EDAA2D7C0"><enum>(2)</enum><text>Waive cost-sharing for such contraception. </text></paragraph></subsection><subsection id="ida728d2730cc14b1c960eecb86383e69b"><enum>(b)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this Act, the Comptroller General shall submit to Congress a report on the study conducted under subsection (a), together with recommendations for such legislation and administrative action as the Comptroller General determines appropriate.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="id337B0D94419244E4AEE7152B30C7DC11"><enum>5.</enum><header>GAO study and report on difference in coverage of contraceptive items and services for dual eligibles</header><subsection id="idAE445CA6D8104F8D99B8DB4214DADD38"><enum>(a)</enum><header>Study</header><text>The Comptroller General of the United States (in this section referred to as the <quote>Comptroller General</quote>) shall conduct a study on the difference in coverage of contraceptive items and services for individuals who are dually eligible for Medicare and Medicaid benefits.</text></subsection><subsection id="idFD6E25FA428341E0A17590B14D97DD6A" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Report</header><text>Not later than 2 years after the date of enactment of this Act, the Comptroller General shall submit to Congress a report on the study conducted under subsection (a), together with recommendations for such legislation and administrative action as the Secretary determines appropriate. </text></subsection></section></legis-body></bill>
