id="id281E10F81EF24D77B23BEEF8B492ECFE"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the National Oceanic and Atmospheric Administration.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id66FA799BE3394D7A88E9914E083B08A2"><enum>(2)</enum><header>Applicant</header><text>The term <term>applicant</term> means an offshore wind lessee or the representative of an offshore wind lessee that submits or is planning to submit to the Secretary a construction and operations plan for an offshore wind project.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id10E74557E288458090104A4DB0FA8D61"><enum>(3)</enum><header>Backbone line</header><text>The term <term>backbone line</term> means a transmission line that connects multiple offshore transmission substations.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4026D18E7D7A484FB1F61DACB5FAEB8C"><enum>(4)</enum><header>Bulk-power system</header><text>The term <term>bulk-power system</term> has the meaning given the term in section 215(a) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824o">16 U.S.C. 824o(a)</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id659B22EB90C34ED68F49DA4E4E868483"><enum>(5)</enum><header>Call area</header><text>The term <term>call area</term> means an area on the outer Continental Shelf that—</text><subparagraph commented="no" display-inline="no-display-inline" id="idDCD3D97A1821461B8A59DC652660604E"><enum>(A)</enum><text display-inline="yes-display-inline">is identified by the Secretary as potentially suitable for offshore wind energy development; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id91618115E0204553A8C9BF828633A5AA"><enum>(B)</enum><text display-inline="yes-display-inline">is designated as a call area by the Secretary.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id944D4270A2FC490C8D4002C3CB65F072"><enum>(6)</enum><header display-inline="yes-display-inline">Draft offshore wind energy area</header><text>The term <term>draft offshore wind energy area</term> means an area that—</text><subparagraph commented="no" display-inline="no-display-inline" id="id693CBC8B575B46ABB94E9B0CA3C58649"><enum>(A)</enum><text display-inline="yes-display-inline">is within a call area; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0438E78F02B94B50BE6DF8A2D5259225"><enum>(B)</enum><text display-inline="yes-display-inline">may be designated as a Wind Energy Area by the Secretary.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide8203e0fd18849659fc665d942bd4781"><enum>(7)</enum><header>Electric Reliability Organization</header><text>The term <term>Electric Reliability Organization</term> has the meaning given the term in section 215(a) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824o">16 U.S.C. 824o(a)</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9cd0ff03a61a4ab4ba89647279422594"><enum>(8)</enum><header>Federal authorization</header><subparagraph id="IDF8DB30AEFD534302B33A3C44D6697D07"><enum>(A)</enum><header>In general</header><text>The term <term>Federal authorization</term> means any authorization required under Federal law in order to site an offshore wind transmission facility.</text></subparagraph><subparagraph id="ID2282A13B965848099112FDDC56719566" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header>Inclusions</header><text>The term <term>Federal authorization</term> includes such permits, special use authorizations, certifications, opinions, or other approvals as may be required under Federal law in order to site an offshore wind transmission facility.</text></subparagraph></paragraph><paragraph id="id359cb327853d48408014f5bead877fc6"><enum>(9)</enum><header>Independent System Operator</header><text>The term <term>Independent System Operator</term> has the meaning given the term in section 3 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/796">16 U.S.C. 796</external-xref>).</text></paragraph><paragraph id="ID569E39A7AE294A8BB8194A9568303F9E"><enum>(10)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> has the meaning given the term in section 4 of the <act-name parsable-cite="ISDA">Indian Self-Determination and Education Assistance Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id21B350B2D2F54741B7D7344D3D4F5447"><enum>(11)</enum><header>Meshed network</header><subparagraph commented="no" display-inline="no-display-inline" id="idC4BEF5F013884D5E91F4CDC0DEC62889"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>meshed network</term> means a networked configuration of power conditioning equipment that allows more than 1 path to transmit offshore wind energy to the onshore electric grid, including—</text><clause commented="no" display-inline="no-display-inline" id="id6503451d0fe14a028b791f0afc33e055"><enum>(i)</enum><text display-inline="yes-display-inline">between 1 or more offshore transmission substations; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id7261cad7995a478dae26ac3b67370cd5"><enum>(ii)</enum><text display-inline="yes-display-inline">from 1 or more offshore transmission substations to 2 or more onshore substations.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB8765ED24B78464880BD1C5282F7EE42"><enum>(B)</enum><header>Inclusions</header><text display-inline="yes-display-inline">A meshed network may include a combination of radial lines and backbone lines.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2837A022FCEA4AF686F81A6C2FBB857C"><enum>(12)</enum><header>Offshore wind energy area</header><text>The term <term>offshore wind energy area</term> means an area that—</text><subparagraph commented="no" display-inline="no-display-inline" id="idD94B1A4342BB407BA4ECB6A7FB90424D"><enum>(A)</enum><text display-inline="yes-display-inline">is within a call area; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idBC9468079F5842DA8CE0EFE4E693CA68"><enum>(B)</enum><text display-inline="yes-display-inline">is designated as a Wind Energy Area by the Secretary.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id24FEEE5B05514C17988933A320AB9225"><enum>(13)</enum><header display-inline="yes-display-inline">Offshore wind generation facility</header><text>The term <term>offshore wind generation facility</term> means a facility that—</text><subparagraph commented="no" display-inline="no-display-inline" id="idF334612D609247E690E178B5A930981A"><enum>(A)</enum><text display-inline="yes-display-inline">is located on the outer Continental Shelf; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id871CDE4E772C48DAA5BEAB2A49ED36CC"><enum>(B)</enum><text display-inline="yes-display-inline">produces electric energy by the use, as a primary energy source, of wind energy.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDEA244C3094148879BFC5233208DA5EF"><enum>(14)</enum><header>Offshore wind transmission facility</header><subparagraph commented="no" display-inline="no-display-inline" id="id9FA6A49E52F84764A89F20378D5ABC61"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>offshore wind transmission facility</term> means a facility such as a line or cable, and any related infrastructure or equipment, such as a substation or converter station, that is used for the transmission of electric energy—</text><clause commented="no" display-inline="no-display-inline" id="id15FCF3E062DE4730984F6FBE722A7A64"><enum>(i)</enum><text display-inline="yes-display-inline">between 2 or more offshore wind generation facilities, including—</text><subclause commented="no" display-inline="no-display-inline" id="id32DBF29168C54F4EAE0D54B2F59A0CE7"><enum>(I)</enum><text display-inline="yes-display-inline">offshore wind generation facilities within a single offshore wind project; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idCDA98824D8074E39A301DEE32D4A91D4"><enum>(II)</enum><text display-inline="yes-display-inline">offshore wind generation facilities in different offshore wind projects; or</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idC5E9C908C9C54A2C9EADA49FD314653D"><enum>(ii)</enum><text>between 1 or more offshore wind generation facilities and an interconnection with an onshore electric grid.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA7501087F0D84CCC86F51263A2337820"><enum>(B)</enum><header>Inclusions</header><text display-inline="yes-display-inline">The term <term>offshore wind transmission facility</term> includes a radial line, a backbone line, and any transmission line.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idac12673e38214f63b6ce6eed7cd43ac6"><enum>(15)</enum><header>Optimal point of interconnection</header><text>The term <term>optimal point of interconnection</term> means a point of interconnection that minimizes—</text><subparagraph commented="no" display-inline="no-display-inline" id="idc0f5816f30024a068dce8144cfad6353"><enum>(A)</enum><text display-inline="yes-display-inline">delays;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id55e0aaf447274d939dc25d1ce8eb7e33"><enum>(B)</enum><text display-inline="yes-display-inline">local impacts; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9d8323a6300f4c4d887f081b9056b867"><enum>(C)</enum><text display-inline="yes-display-inline">the need for grid upgrades.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC40DDF1B3A704D96AD0F221E939193F3"><enum>(16)</enum><header display-inline="yes-display-inline">Outer Continental Shelf</header><text>The term <term>outer Continental Shelf</term> has the meaning given the term in section 2 of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1331">43 U.S.C. 1331</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd4373440115f413d80d33d8dcbd5f795"><enum>(17)</enum><header>Planning area</header><text>The term <term>planning area</term> means a planning area described in the document entitled <quote>2019–2024 National OCS Oil and Gas Leasing Draft Proposed Program</quote> and dated January 2018 (or a subsequent oil and gas leasing program developed under section 18 of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1344">43 U.S.C. 1344</external-xref>)). </text></paragraph><paragraph id="id72D9D120C8884B63905E6FFB4526F6B7"><enum>(18)</enum><header>Radial line</header><text>The term <term>radial line</term> means a transmission line that is used to link 1 or more offshore wind projects to the bulk-power system.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0ecc725ff1584dc7a5ce9686a07539cf"><enum>(19)</enum><header>Regional Transmission Organization</header><text>The term <term>Regional Transmission Organization</term> has the meaning given the term in section 3 of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/796">16 U.S.C. 796</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA244E4F6F93F4E8284E679F07D3C4E5E"><enum>(20)</enum><header display-inline="yes-display-inline">Registered apprenticeship program</header><text display-inline="yes-display-inline">The term <term>registered apprenticeship program</term> means an apprenticeship program registered under the Act of August 16, 1937 (commonly known as the <quote>National Apprenticeship Act</quote>; 50 Stat. 664, chapter 663; <external-xref legal-doc="usc" parsable-cite="usc/29/50">29 U.S.C. 50 et seq.</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4B0F97E4F6FE4C1A91FE9EC7ED3C858A"><enum>(21)</enum><header display-inline="yes-display-inline">Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph><paragraph id="id90419F00516D499F8AA73A2820C2197C"><enum>(22)</enum><header>State</header><text>The term <term>State</term> has the meaning given the term in section 2 of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1331">43 U.S.C. 1331</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC2818958C68847729B181141F3B2B459"><enum>(23)</enum><header>Tribal organization</header><text>The term <term>Tribal organization</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="id0bba6abfe36d45e69050a4dfd19c67a5"><enum>(A)</enum><text display-inline="yes-display-inline">a Tribal organization (as defined in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>)); and</text></subparagraph><subparagraph id="id437f3639f87343a5ad1c911e52aa6224" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>a Native Hawaiian organization (as defined in section 2 of the Native American Graves Protection and Repatriation Act (<external-xref legal-doc="usc" parsable-cite="usc/25/3001">25 U.S.C. 3001</external-xref>)). </text></subparagraph></paragraph></section><subtitle id="ide5f4c53da7e8407690a0f1f9288e461f" style="OLC"><enum>A</enum><header>Offshore wind leadership and coordination</header><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="idE66D53F5193242649365648F222336A4"><enum>111.</enum><header display-inline="yes-display-inline">Offshore Wind Transmission Task Force</header><subsection commented="no" display-inline="no-display-inline" id="id10cf0b07f90145cfacb9456039ac93e3"><enum>(a)</enum><header display-inline="yes-display-inline">Definition of Offshore Wind Transmission Task Force</header><text>In this section, the term <term>Offshore Wind Transmission Task Force</term> means, as applicable—</text><paragraph commented="no" display-inline="no-display-inline" id="idba4040c513c9450aa2cc7427c5125e21"><enum>(1)</enum><text display-inline="yes-display-inline">the National Offshore Wind Transmission Task Force established under subsection (b)(1); or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfc7a59e55df94a6bbae50d10dec990e8"><enum>(2)</enum><text>a regional offshore wind transmission task force established under subsection (b)(2).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idA538D86FCCAE4E45B51829BDA71B055E"><enum>(b)</enum><header display-inline="yes-display-inline">Establishment</header><paragraph commented="no" display-inline="no-display-inline" id="idd1cdf534a6574a9b8c590b65e85a71c6"><enum>(1)</enum><header>National task force</header><text display-inline="yes-display-inline">Subject to paragraph (2), not later than 120 days after the date of enactment of this Act, the Secretary shall establish and chair a national task force, to be known as the <term>National Offshore Wind Transmission Task Force</term>, to coordinate—</text><subparagraph commented="no" display-inline="no-display-inline" id="id7141341D955941F1A43B277F2B03D95C"><enum>(A)</enum><text display-inline="yes-display-inline">the siting and development of offshore wind transmission facilities; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB70CC3692ABB43DAACBA0F2160C7DDF7"><enum>(B)</enum><text display-inline="yes-display-inline">the alignment of the review and authorization processes for offshore wind transmission development, including with respect to projects and activities at the Federal and State levels.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id08760f67ac4e44059e3770efe07b1839"><enum>(2)</enum><header>Regional task forces</header><subparagraph commented="no" display-inline="no-display-inline" id="id673d318cad594525a453ebe2ee0bc09b"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may establish, if the Secretary determines appropriate, in lieu of a national task force under paragraph (1), 1 or more regional offshore wind transmission task forces to coordinate the matters described in subparagraphs (A) and (B) of that paragraph in particular regions, which may include leveraging relevant Intergovernmental Renewable Energy Task Forces of the Bureau of Ocean Energy Management.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idca35bb8d3a2d43ef993a76b025293f30"><enum>(B)</enum><header>Chair</header><text>The Secretary shall select a chair for each regional task force established under subparagraph (A), which may be the head of a regional office of the Bureau of Ocean Energy Management or any other staff member from such regional office, if the Secretary determines appropriate.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id1748FF3EBE42451E9C88D88198C9BDB6"><enum>(c)</enum><header>Members</header><text>An Offshore Wind Transmission Task Force shall include—</text><paragraph commented="no" display-inline="no-display-inline" id="idCC5172EEDF004455B87BBD24AC3042EA"><enum>(1)</enum><text display-inline="yes-display-inline">members representing relevant Federal agencies, including—</text><subparagraph commented="no" display-inline="no-display-inline" id="id0548A0D96D0749D38331BC198CEB3075"><enum>(A)</enum><text display-inline="yes-display-inline">the Department of Energy;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id58CB8EB3D5694562AD7A49311E03FEBE"><enum>(B)</enum><text display-inline="yes-display-inline">the Department of the Interior, including—</text><clause commented="no" display-inline="no-display-inline" id="id561EE2BBF5904BE49403AA93C6D42ADD"><enum>(i)</enum><text Foundation;</text></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="id80C0A359319C439690D8D27F3EA7689A"><enum>(I)</enum><text display-inline="yes-display-inline">the Coast Guard;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id36997A1403B349CE9A6DECA7BDA296A4"><enum>(J)</enum><text>the Maritime Administration;</text></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="idB98F2BE69E0F4B26889B1DDFB6E698CD"><enum>(K)</enum><text display-inline="yes-display-inline">the National Aeronautics and Space Administration; and</text></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="idBC41554FE025496AA63FD4456B6D91B4"><enum>(L)</enum><text>any other Federal agency that the Secretary determines to be appropriate;</text></subparagraph></paragraph><paragraph id="idB3B1C9B426A245808BCDB3F5901BE31F"><enum>(2)</enum><text>members representing relevant State governments, which may include representatives of relevant State agencies, such as public utility commissions or public service commissions, as determined by the Secretary; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3A852A2F20DA41FFA75BEB252E5D218D"><enum>(3)</enum><text>members representing relevant Indian Tribes or Tribal organizations.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id49E42460867D4D498F09F48A601169EE"><enum>(d)</enum><header>Focus</header><text>In carrying out the duties described in subsection (b), an Offshore Wind Transmission Task Force shall—</text><paragraph commented="no" display-inline="no-display-inline" id="id89167E8DC9DF4A69A58B7831A61BF28D"><enum>(1)</enum><text display-inline="yes-display-inline">advise the Secretary and the Secretary of Energy with respect to the identification of preferred routes for transmission cables and optimal points of interconnection under section 132(a), including through the use of models that evaluate spatial suitability;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9fe64efd7c054274a04c908c3fa72d86"><enum>(2)</enum><text>advise the Secretary on existing and future transmission availability in developing draft offshore wind energy areas;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5A4EDC1CA5954F8A8455378793914CF2"><enum>(3)</enum><text>advise the Secretary on matters relating to the rulemaking under section 133(b), any other rulemaking relating to offshore transmission, and regulatory efficiencies relating to offshore transmission;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDC9561FEA8E7433E919E40B60B835C7F"><enum>(4)</enum><text>consider how grant funding, such as grants provided under section 50152 of <external-xref legal-doc="public-law" parsable-cite="pl/117/169">Public Law 117–169</external-xref> (commonly known as the <term>Inflation Reduction Act of 2022</term>) (<external-xref legal-doc="usc" parsable-cite="usc/42/18715a">42 U.S.C. 18715a</external-xref>), can help support development and siting of offshore transmission proposals and relevant onshore grid upgrades; and</text></paragraph><paragraph id="id3848D218A6F24FAD90BE52ADA722D0A3" commented="no" display-inline="no-display-inline"><enum>(5)</enum><text>consider how to support the domestic manufacturing of offshore wind transmission equipment, including through support for memoranda of understanding between the Federal Government and States relating to the offshore wind supply chain, such as the memorandum of understanding entitled <quote>Memorandum of Understanding by and among the United States Department of Energy, the United States Department of the Interior, the United States Department of Commerce, and the United States Department of Transportation and the States of Connecticut, Maine, Maryland, Massachusetts, New Hampshire, New Jersey, New York, North Carolina, and Rhode Island</quote> and dated September 20, 2023.</text></paragraph></subsection></section></subtitle><subtitle id="id17EA70E9DC0A4749983AD840C181615E" style="OLC"><enum>B</enum><header>Offshore wind generation and leasing</header><section id="id9cff8ed477f24d5183fbfbdb5f7ed924"><enum>121.</enum><header>Offshore wind generation and leasing</header><text display-inline="no-display-inline">Section organization</header><text display-inline="yes-display-inline">The term <term>Tribal organization</term> has the meaning given the term in section 101 of the <short-title>COLLABORATE Act</short-title>.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1dcb3a6c97ad4507825cc2d953fb7ee7"><enum>(B)</enum><header display-inline="yes-display-inline">In general</header><clause commented="no" display-inline="no-display-inline" id="idd56e8e9c86364c62a8656b8b8b0e1970"><enum>(i)</enum><header>Leasing schedule for offshore wind energy generation</header><subclause commented="no" display-inline="no-display-inline" id="id2c4c210df3e9471cb66465c527f93686"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, in accordance with clause (ii), shall publish, periodically update, and issue public notice with respect to, a 5-year schedule of areas in which an offshore wind energy area may be available for leasing in the future for purposes of offshore wind energy generation.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id6f0baafb2cd248e98408227358efacad"><enum>(II)</enum><header display-inline="yes-display-inline">Requirements</header><text>A leasing schedule published under subclause (I) shall—</text><item commented="no" display-inline="no-display-inline" id="idbaab828d965e4a55a00bc28c6b1d5e4a"><enum>(aa)</enum><text>be reviewed, and, as determined by the Secretary to be necessary, updated not less frequently than once every 2 years; </text></item><item commented="no" display-inline="no-display-inline" id="id5c2310eade9d4e14abe77b08fca236ad"><enum>(bb)</enum><text>to the maximum extent practicable, indicate—</text><subitem commented="no" display-inline="no-display-inline" id="idb14e2c3861114a49a0639a12ad6bde2b"><enum>(AA)</enum><text display-inline="yes-display-inline">the timing of area identification activities;</text></subitem><subitem commented="no" display-inline="no-display-inline" id="ida366c757a5264c3cb65577473df3aeae"><enum>(BB)</enum><text>the timing of designation of any area to be leased within the applicable area; and</text></subitem><subitem commented="no" display-inline="no-display-inline" id="id8b88867a93f44a3ca70bcea2c8fd066e"><enum>(CC)</enum><text display-inline="yes-display-inline">the timing of each lease sale; and</text></subitem></item><item commented="no" display-inline="no-display-inline" id="id04099effdfee4f40919fc5530b762b32"><enum>(cc)</enum><text display-inline="yes-display-inline">provide an update on the status of each existing offshore wind energy area.</text></item></subclause></clause><clause commented="no" display-inline="no-display-inline" id="ideb0b3d0fc04246498f41e7d269717cb9"><enum>(ii)</enum><header>Liaisons</header><subclause commented="no" display-inline="no-display-inline" id="id21ef6c00f99348bda6223e639ff0be37"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to subclause (III), for each area identified in a lease schedule published under clause (i)(I) or for each research lease granted by the Bureau of Ocean Energy Management, the Secretary and the Administrator shall each appoint a designated liaison from their agencies to conduct outreach to potentially affected groups, including—</text><item commented="no" display-inline="no-display-inline" id="id93ff25bd99154c4196dee1e4ad107ab1"><enum>(aa)</enum><text display-inline="yes-display-inline">States;</text></item><item commented="no" display-inline="no-display-inline" id="id06cbcaaba08749eaacb9760a60a79412"><enum>(bb)</enum><text display-inline="yes-display-inline">local communities;</text></item><item commented="no" display-inline="no-display-inline" id="id37abce67e05c4927ba12933e7b865a63"><enum>(cc)</enum><text display-inline="yes-display-inline">fishermen; </text></item><item commented="no" display-inline="no-display-inline" id="idd8341745d3594f7cba9fe542c4b7fdd9"><enum>(dd)</enum><text>Indian Tribes and Tribal organizations; and</text></item><item commented="no" display-inline="no-display-inline" id="id6d044e0fba3747788e1b46dd13146057"><enum>(ee)</enum><text>other potentially affected groups, as determined by the Secretary and the Administrator.</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="id5ff5d1d095ca43e082764d6c263f75d4"><enum>(II)</enum><header>Discontinuance</header><text>For each area identified in a lease schedule published under clause (i)(I), the Secretary and the Administrator may discontinue a designated liaison if, following a request for information and call for interest, there is no commercial interest in offshore wind in the applicable area.</text></subclause><subclause id="ida6143ce7033c447cb9867b5b7ea8fba3"><enum>(III)</enum><header>Exception</header><text>This clause shall not apply to a draft offshore wind energy area on the outer Continental Shelf existing prior to the date of enactment of the <short-title>COLLABORATE Act</short-title>.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id0f8565147bd34c6cb24b311fc08808fc"><enum>(iii)</enum><header>Area impact study</header><subclause commented="no" display-inline="no-display-inline" id="idf052adcd44944417962467f6e2ec366c"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">Beginning 2 years after the date of enactment of the <short-title>COLLABORATE Act</short-title>, for each area included in a lease schedule published under clause (i)(I), the Secretary shall—</text><item commented="no" display-inline="no-display-inline" id="id483A81B028E94F839F4BE677FA740B17"><enum>(aa)</enum><text display-inline="yes-display-inline">conduct an area impact study to evaluate the potential impact on the human, marine, and coastal environments of the development of wind energy in that area, in order to inform the identification of draft offshore wind energy areas in that area; and</text></item><item display-inline="no-display-inline" commented="no" id="id99F7597C262F4C2DA2AEAD89452F7BF3"><enum>(bb)</enum><text>provide an opportunity for public comment for not less than 30 days.</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="id4d60aa52a40046fea5a8f926ea768694"><enum>(II)</enum><header>Considerations</header><text display-inline="yes-display-inline">In carrying out an area impact study under subclause (I), the Secretary may—</text><item commented="no" display-inline="no-display-inline" id="ideea17ff909064938a7caeaa79f8f1aa0"><enum>(aa)</enum><text>consider the compatibility of development of offshore wind energy in the applicable area with regional and State climate, energy, and conservation planning;</text></item><item commented="no" display-inline="no-display-inline" id="ida3a872d33b184ec2b68249ff36fed1fa"><enum>(bb)</enum><text>use information from available assessments from the National Oceanic and Atmospheric Administration, such as integrated ecosystem assessments;</text></item><item id="id47aba68fdabf4f59b4923e15fce63339"><enum>(cc)</enum><text>identify areas for which there is insufficient science, mapping, and data; and</text></item><item id="idBAFE641121E8402E83783A13384F0D6A"><enum>(dd)</enum><text>undertake additional data collection efforts where science, mapping, and data are found to be insufficient.</text></item></subclause><subclause id="id7c3842524cff47428abbb6a8438ec472"><enum>(III)</enum><header>Methods</header><text>In carrying out an area impact study under subclause (I), the Secretary shall incorporate and use the best available existing science and data, including, at a minimum, appropriate suitability models such as the spatial suitability models developed by the National Centers for Coastal Ocean Science of the National Oceanic and Atmospheric Administration.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="ida3651646476e4266b54d388143a61594"><enum>(IV)</enum><header>Use of data and assessments</header><item commented="no" display-inline="no-display-inline" id="idcb863c1c398e4f8ab648116f3c4a5e05"><enum>(aa)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may use the data and assessments from area impact studies conducted under this clause in determining which portions of an area or region the Secretary should be made available for leasing.</text></item><item commented="no" display-inline="no-display-inline" id="id39c8270fcf5c47d2a1055cc5a7ea52f1"><enum>(bb)</enum><header>Other agencies</header><text>To the extent practicable and as applicable, other Federal agencies may consider the data and assessments from area impact studies conducted under this clause in making permitting and authorization decisions. </text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="id1e840d8ecfad49688decc5ca7810071d"><enum>(V)</enum><header>NEPA applicability</header><text>An area impact study conducted by the Secretary under subclause (I) shall not be considered a major Federal action.</text></subclause><subclause display-inline="no-display-inline" commented="no" id="id86A2D99C22B64962B29780A831995ED5"><enum>(VI)</enum><header>Consultation and support</header><text>In conducting an area impact study under subclause (I), the Secretary may consult with, and request assistance from, other Federal agencies.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id57fff79030c843959c3d6ab8bb2f6da1"><enum>(VII)</enum><header>Study duration</header><text>An area impact study conducted under subclause (I) shall be completed in not more than 2 years.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="ide728d6ce155547efbcf84985906bb15d"><enum>(iv)</enum><header>Grants for capacity building and community engagement</header><subclause commented="no" display-inline="no-display-inline" id="idd9047bd13f024f01b6b0c5546965cfc9"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">On commencement of an area impact study under clause (iii), the Secretary, in collaboration with the Administrator, may award capacity grants to relevant individuals and entities in the applicable region to enhance engagement opportunities relating to environmental reviews, permitting activities, or other authorizations.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id95d49e2c852742d7be83af8a366d5f75"><enum>(II)</enum><header>Purposes</header><text>Grants awarded under this clause shall be for—</text><item commented="no" display-inline="no-display-inline" id="id10006c8e357548a8b4ce4d84db23d635"><enum>(aa)</enum><text display-inline="yes-display-inline">enabling States, Indian Tribes, Tribal organizations, fishermen, universities, and nonprofit organizations that represent the fishing industry or other potentially affected communities and ocean users to compile data, conduct impartial analyses, objectively educate groups and communities, and complete other activities relating to offshore wind environmental reviews, permits, and consultations;</text></item><item commented="no" display-inline="no-display-inline" id="ida340e70f4b5e4344921498f275b72e25"><enum>(bb)</enum><text>engaging in planning activities and in the development of offshore wind for the purposes of—</text><subitem commented="no" display-inline="no-display-inline" id="id32941a2cdb494887accebab0ca150c5e"><enum>(AA)</enum><text display-inline="yes-display-inline">determining potential economic, social, public health, cultural, and environmental impacts; and</text></subitem><subitem commented="no" display-inline="no-display-inline" id="id94cd4fc512d748b49df6ac0cfd75cce0"><enum>(BB)</enum><text display-inline="yes-display-inline">identifying opportunities to mitigate those potentially negative impacts;</text></subitem></item><item commented="no" display-inline="no-display-inline" id="id026175e0e43c46cbbb988c0fc8e6b680"><enum>(cc)</enum><text display-inline="yes-display-inline">facilitating wind energy siting; and</text></item><item commented="no" display-inline="no-display-inline" id="id1d21775151854d25a2e83a29eb025bf0"><enum>(dd)</enum><text display-inline="yes-display-inline">training, hiring of personnel, and other activities designed to increase the capacity of States, Indian Tribes, Tribal organizations, universities, and nonprofit organizations, as applicable, to carry out activities described in items (aa) through (cc).</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="id7f3786cf9b854589a57846e34f96b36b"><enum>(III)</enum><header>Capacity grant funding</header><text>There is authorized to be appropriated to the Secretary to carry out this clause $25,000,000 for each of fiscal years 2026 through 2030, of which not less than 2 percent shall be allocated each fiscal year for use by Indian Tribes and Tribal organizations.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id1bd59f8fcdb245da9ccba0ef909b22fd"><enum>(v)</enum><header>Identification of draft offshore wind energy areas</header><subclause commented="no" display-inline="no-display-inline" id="idecedc0a0fefe4808b6498a8a52a07d18"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">Taking into account the results of public and group engagement and the call for interest under clause (ii), any applicable area impact study under clause (iii), any community engagement activities under clause (iv), and other factors as determined by the Secretary, the Secretary may identify an area as a draft offshore wind energy area.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="ida16afbb0298643279561305e2df72bfc"><enum>(II)</enum><header>Factors for consideration</header><text display-inline="yes-display-inline">In identifying draft offshore wind energy areas under subclause (I), the Secretary shall consider—</text><item commented="no" display-inline="no-display-inline" id="id5c49e5b9441c40b1b99b78d30c039043"><enum>(aa)</enum><text display-inline="yes-display-inline">potential power capacity;</text></item><item commented="no" display-inline="no-display-inline" id="idfb8570515dc14d11990d5f9c9e88559b"><enum>(bb)</enum><text>commercial viability;</text></item><item commented="no" display-inline="no-display-inline" id="id9e04923f7c68480695dba2bbef0386ea"><enum>(cc)</enum><text display-inline="yes-display-inline">existing and future onshore and offshore transmission availability and capacity;</text></item><item commented="no" display-inline="no-display-inline" id="ideb742f481f23467499f29f37c2dbb6c5"><enum>(dd)</enum><text>conflicts with other potential ocean uses, resources, and users;</text></item><item commented="no" display-inline="no-display-inline" id="idD50D5BB7C1AB434A8C86270D8AFF5519"><enum>(ee)</enum><text>prevailing wind direction and minimal wake effects;</text></item><item display-inline="no-display-inline" commented="no" id="id667339FCB0804DE7AE7668898CEE077F"><enum>(ff)</enum><text>distance to shore port infrastructure; and</text></item><item commented="no" display-inline="no-display-inline" id="id4a241c0cc7b04b70a7eb85cb78059d48"><enum>(gg)</enum><text>other requirements under paragraph (4).</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="idcceabdfa888b4673a712663f6f25307a"><enum>(III)</enum><header>Collaboration</header><text>For purposes relating to the identification of draft offshore wind energy areas, the Secretary and the Administrator shall—</text><item commented="no" display-inline="no-display-inline" id="id031560332d9f4ed391e1fbdd529e3e6e"><enum>(aa)</enum><text display-inline="yes-display-inline">engage potentially affected groups identified under clause (ii)(I); and</text></item><item commented="no" display-inline="no-display-inline" id="id180f9e728547481fa0e9add5254aaf00"><enum>(bb)</enum><text display-inline="yes-display-inline">consult with—</text><subitem commented="no" display-inline="no-display-inline" id="ida50303f178e74b2782704b82c5983f79"><enum>(AA)</enum><text display-inline="yes-display-inline">relevant Intergovernmental Renewable Energy Task Forces established by the Secretary;</text></subitem><subitem commented="no" display-inline="no-display-inline" id="idfdec79cca2094bdc922410c2d876a4a9"><enum>(BB)</enum><text display-inline="yes-display-inline">relevant regional ocean partnerships;</text></subitem><subitem commented="no" display-inline="no-display-inline" id="id1d9c306f5664406da4c597a953f834bc"><enum>(CC)</enum><text>fishery management councils; and</text></subitem><subitem commented="no" display-inline="no-display-inline" id="iddad21ae90f6849b6b4cba2486b82271d"><enum>(DD)</enum><text>interstate fisheries commissions.</text></subitem></item></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id848847887eef4198a2c7870be59eb6f0"><enum>(vi)</enum><header>Coexistence fund</header><text>Activities described in subsection (b)(1) of section 204 of the <short-title>COLLABORATE Act</short-title> that are carried out in an area for which a leasing schedule is published under clause (i)(I) shall be eligible for funding provided from the Offshore Wind and Fisheries Coexistence Fund established by subsection (a)(1) of that section.</text></clause><clause commented="no" display-inline="no-display-inline" id="idDAF641ED6DA8491996C78D34AC2AAB5A"><enum>(vii)</enum><header>Fisheries mitigation compensation</header><text>The Secretary, acting through the Director of the Bureau of Ocean Energy Management, shall require offshore wind lease holders to include fisheries compensation as part of the leasing process for offshore wind energy, in accordance with section id="idce488d1c2a83435a8739df165d7db79e"><enum>122.</enum><header>Offshore wind lease auctions</header><subsection commented="no" display-inline="no-display-inline" id="id0a63f0be2ee44f56beebd227fb6ba3d5"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In awarding an offshore wind lease under section 8(p) of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1337">43 U.S.C. 1337(p)</external-xref>), the Secretary may offer bidding credits for nonmonetary factors and commitments made by the bidder—</text><paragraph commented="no" display-inline="no-display-inline" id="idbb75fb2c9aeb426696a59bb645f8eb62"><enum>(1)</enum><text display-inline="yes-display-inline">to support or increase access to registered apprenticeship programs and pre-apprenticeship programs that have an articulation agreement with a registered apprenticeship program for offshore wind energy projects;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide14855e347074b4295227a46e392ad10"><enum>(2)</enum><text>to support development of domestic supply chains for offshore wind projects, including development of ports and other energy infrastructure necessary to facilitate offshore wind energy projects;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idad99c1b959774bdaa3fc2d502291e3ca"><enum>(3)</enum><text>to establish with 1 or more communities or groups that may be potentially impacted by a proposed project, which may include eligible entities (as determined by the Secretary), a community benefit agreement that—</text><subparagraph commented="no" display-inline="no-display-inline" id="id8EACB736C8274B9CB564519B58C99665"><enum>(A)</enum><text>may include workforce agreements, project labor agreements, grants, and nonmonetary investments; and</text></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="id2CC0CF5194AA4E3AAB130C2F88D4B27B"><enum>(B)</enum><text>prioritizes legally binding agreements described in subparagraph (A);</text></subparagraph></paragraph><paragraph id="id80e10b7c189843c593a9ab0a4530c043"><enum>(4)</enum><text>to make investments to evaluate, monitor, improve, and mitigate impacts to the health and biodiversity of ecosystems and wildlife within the leased area, to include relevant ecosystems and wildlife that could be impacted by the proposed offshore wind energy project; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idcc3d1d07d4d34235ac6bab086da3e01f"><enum>(5)</enum><text display-inline="yes-display-inline">to use preferred cable routes identified under section 132(a); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida2259959c1b842f693d539472251a3c7"><enum>(6)</enum><text display-inline="yes-display-inline">to make other investments, as determined appropriate by the Secretary.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id76eace5762d74702b3cdc39b337ea03f"><enum>(b)</enum><header>Bidding credit cap</header><text display-inline="yes-display-inline">In a leasing bid under subsection (a), the combined value of bidding credits for any non-monetary factors or commitments shall not exceed 25 percent of the bid amount for the lease area.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id0479388c14b243f380e0f736af519412"><enum>(c)</enum><header>Requirements</header><text>Section 8(p) of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1337">43 U.S.C. 1337(p)</external-xref>) is amended by striking paragraph (4) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id84C6CFA453F64A4E9AA62E08DFB3F760"><paragraph id="id67c07e16641543159cfd977517889c3a"><enum>(4)</enum><header>Requirements</header><text>The Secretary shall ensure that any activity under this subsection is carried out in a manner that provides for a balance of—</text><subparagraph commented="no" display-inline="no-display-inline" id="idd67f6fff534e4bc691d8db4b06dfe45e"><enum>(A)</enum><text display-inline="yes-display-inline">safety;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3911955d98284d479679c06141fc1e25"><enum>(B)</enum><text display-inline="yes-display-inline">the protection of the environment; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1818dcd0d7754cb1880fba0d43a94080"><enum>(C)</enum><text>the prevention of waste;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd0dcca4eb7d349c2bb3bec21de50ee32"><enum>(D)</enum><text>the conservation of the natural resources of the outer Continental Shelf;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2af2d532fa3443b6aeb71ff35740fcb0"><enum>(E)</enum><text display-inline="yes-display-inline">coordination with relevant Federal agencies and Tribal, State, and local governments;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id499df3bc725641e0bed2c1541625a9a5"><enum>(F)</enum><text display-inline="yes-display-inline">the protection of the national security interests of the United States, including energy security;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide9c2a0f0dc78450d80d674464a22f626"><enum>(G)</enum><text>the protection of correlative rights in the outer Continental Shelf, including the energy generation potential of other offshore renewable energy leases;</text></subparagraph><subparagraph id="idcab8737269764dfdb1db0d93d168c51d"><enum>(H)</enum><text>a fair return to the United States for any lease, easement, or right-of-way under this subsection;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id343a0771b42a45eea0a75515dbca9e65"><enum>(I)</enum><text>prevention of unreasonable interference with other uses of the exclusive economic zone, the high seas, and the territorial seas, as determined by the Secretary;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5ab5f46f48bd4f0a92c9244bed13c27a"><enum>(J)</enum><text display-inline="yes-display-inline">consideration of—</text><clause commented="no" display-inline="no-display-inline" id="ideea3777ac80843c4b75d48cc37f70e57"><enum>(i)</enum><text display-inline="yes-display-inline">the location of, and any schedule relating to, a lease, easement, or right-of-way for an area of the outer Continental Shelf; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id94ca72cf48204600b189c6247b4801dd"><enum>(ii)</enum><text display-inline="yes-display-inline">any other use of the sea or seabed, including use for a fishery or fishery survey, a sealane, a regional coastal observing system or other scientific observation platform such as a buoy, a potential site of a deepwater port, or navigation; </text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf4612536db444cebb6f5eddd649f663f"><enum>(K)</enum><text>public notice and comment on any proposal submitted for a lease, easement, or right-of-way under this subsection; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9dea2b6d8e9047c88057be01ffa08089"><enum>(L)</enum><text display-inline="yes-display-inline">the oversight, inspection, research, monitoring, and enforcement relating to a lease, easement, or right-of-way under this subsection; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id26a4a0b85a8746a6908f6e7c244aa512"><enum>(M)</enum><text display-inline="yes-display-inline">the consideration of any applicable Federal, Tribal, and State renewable energy mandates, targets, and goals.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="idd8da08311875457c96d6a124e14c8bd8"><enum>(d)</enum><header>Project manager</header><paragraph commented="no" display-inline="no-display-inline" id="id40BA845FC49145BC80056A6ACADADC58"><enum>(1)</enum><header>In general</header><text>For each offshore wind project within a lease awarded under section 8(p) of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1337">43 U.S.C. 1337(p)</external-xref>), the Secretary, the Administrator, and the Secretary of the Army, acting through the Chief of Engineers, shall each assign a designated project manager to oversee, commensurate with agency authorities, the offshore wind project from the point of award through the end of the construction process.</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="id9E45A934298D4509ADBB88F67856DC77"><enum>(2)</enum><header>Coordination and collaboration</header><text>A project manager designated under paragraph (1) shall coordinate and collaborate with the applicable project coordinator from the Bureau of Ocean Energy Management for the project.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idfceaf254b1e146b8b42b1d8214024e34"><enum>(e)</enum><header>Site control</header><text>The offshore wind lease holder under this section shall be considered to have site control for purposes of submitting an interconnection request in accordance with the pro forma Large Generator Interconnection Procedures of the Federal Energy Regulatory Commission promulgated pursuant to section 35.28(f) of title 18, Code of Federal Regulations (or successor regulations).</text></subsection></section><section commented="no" display-inline="no-display-inline" id="idf7903d82d9294311aa44c6ed6aa60cdb"><enum>123.</enum><header>Offshore wind permitting and authorizations</header><subsection id="id49032045bd4e489a8d79e84400feadc2"><enum>(a)</enum><header>Construction and operations plan requirements</header><text display-inline="yes-display-inline">The Secretary shall require a construction and operations plan for an offshore wind energy generation project submitted for review and approval under the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1331">43 U.S.C. 1331 et seq.</external-xref>), to include—</text><paragraph commented="no" display-inline="no-display-inline" id="id92862e99b7474f91ac2092c8d5bd54ab"><enum>(1)</enum><text display-inline="yes-display-inline">a list of—</text><subparagraph commented="no" display-inline="no-display-inline" id="iddb44930551834757b829fb110a9f53e9"><enum>(A)</enum><text display-inline="yes-display-inline">all agencies that the applicant consulted with prior to submission of the construction and operations plan, such as—</text><clause commented="no" display-inline="no-display-inline" id="id2fb75a6b993f4545b26dd0ef5ed54f21"><enum>(i)</enum><text display-inline="yes-display-inline">the Military Aviation and Installation Assurance Siting Clearinghouse of the Department of Defense;</text></clause><clause commented="no" display-inline="no-display-inline" id="idcc473be5eda14895914c8aab65ecaaac"><enum>(ii)</enum><text display-inline="yes-display-inline">the National Oceanic and Atmospheric Administration;</text></clause><clause commented="no" display-inline="no-display-inline" id="idf5775ff2e3dd4ea1bbf82d57bcac0645"><enum>(iii)</enum><text display-inline="yes-display-inline">the United States Fish and Wildlife Service;</text></clause><clause commented="no" display-inline="no-display-inline" id="id4552d72a240041e2ba8179104f4c5cb2"><enum>(iv)</enum><text display-inline="yes-display-inline">the Coast Guard;</text></clause><clause commented="no" display-inline="no-display-inline" id="id5692a4125b2f4efd9d0ab946399449ad"><enum>(v)</enum><text display-inline="yes-display-inline">the Corps of Engineers;</text></clause><clause commented="no" display-inline="no-display-inline" id="idd5d3cdd0984f4e609c734730f54c33ed"><enum>(vi)</enum><text display-inline="yes-display-inline">the National Park Service; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id24a17b0d0310477782baf361beafe9d2"><enum>(vii)</enum><text display-inline="yes-display-inline">affected State government agencies;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ided44236143f64e588fc74613d485eb14"><enum>(B)</enum><text display-inline="yes-display-inline">agency points of contact for each agency listed pursuant to subparagraph (A);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5c85a819c8634ef88bad62d27dbd8a80"><enum>(C)</enum><text>the dates of meetings with any agencies listed pursuant to subparagraph (A);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide724ea312a2145b9b0a6d09e2339faca"><enum>(D)</enum><text display-inline="yes-display-inline">the outcomes of the meetings listed pursuant to subparagraph (C); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id967425ddf92246f6b4e656ca8d18feeb"><enum>(E)</enum><text>all Federal, State, Tribal, and local authorizations, approvals, consultations, or permits required to conduct the proposed activities;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3750c7ed4f014261a059e7879a1f8498"><enum>(2)</enum><text display-inline="yes-display-inline">a list cataloguing outreach to potentially affected groups; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id32915dfdb8b540abb6e0c5b4898f5532"><enum>(3)</enum><text display-inline="yes-display-inline">feedback received from potentially affected groups; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida350219d196c4dcba94f277034074d2b"><enum>(4)</enum><text display-inline="yes-display-inline">a notation as to what feedback was incorporated into the plan and an explanation for feedback not incorporated; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id03ce65ab19854370aec33ce6237035e5"><enum>(5)</enum><text>any other requirements, as determined by the Secretary.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id05975770b1e74d52b89e12421ef8e3b0"><enum>(b)</enum><header>Outstanding agency authorizations</header><text>All participating agencies shall issue a decision on all outstanding permits or authorizations not later than 150 days after the Secretary issues the applicable record of decision.</text></subsection><subsection id="id7317acf186924ff3a7c2fcb4f711368d" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header>Coastal Zone Management Act review</header><text>State review under the Coastal Zone Management Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/16/1451">16 U.S.C. 1451 et seq.</external-xref>) shall commence as soon as practicable after the Secretary issues a draft environmental impact statement. </text></subsection></section></subtitle><subtitle id="id5f98fce9ad984c3ea317b41e0d16e60d" style="OLC"><enum>C</enum><header>Offshore wind transmission</header><section commented="no" display-inline="no-display-inline" id="id295381bbdf6b451fa003d41f8f919886"><enum>131.</enum><header>Offshore wind transmission research and development</header><subsection commented="no" display-inline="no-display-inline" id="id3c713efb28a74a679a8f06c0a8517974"><enum>(a)</enum><header>Voluntary design standards</header><paragraph commented="no" display-inline="no-display-inline" id="idafe96d488acd4f7795ca5597a6b8ff95"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of this Act, the Secretary of Energy (referred to in this section as the <term>Secretary</term>) shall initiate the development of recommended network-ready design standards for offshore high-voltage alternating current and high-voltage direct current equipment for voluntary adoption and use by States and the Federal Government.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6c4b2a9e547d4c0e972539c9cc387b44"><enum>(2)</enum><header>Coordination</header><text>In developing recommended network-ready design standards under paragraph (1), the Secretary shall coordinate with—</text><subparagraph commented="no" display-inline="no-display-inline" id="idb658352f043d428882fba47fa2b5dcd8"><enum>(A)</enum><text display-inline="yes-display-inline">the Electric Reliability Organization;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbcccd04c20174bff8086facdc1b646d4"><enum>(B)</enum><text>the Federal Energy Regulatory Commission;</text></subparagraph><subparagraph id="id47925985a9b7422fb2d2fc7184116794"><enum>(C)</enum><text>the Bureau of Ocean Energy Management;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idfd23d91210ee45309a693d62f0ea1782"><enum>(D)</enum><text>other relevant Federal agencies, as the Secretary determines to be necessary;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idcfe458b906694c6b99959434a78f4d9a"><enum>(E)</enum><text display-inline="yes-display-inline">Regional Transmission Organizations and Independent System Operators;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id39c1245e35b04fd4a8b2caa90f5ed126"><enum>(F)</enum><text>the Institute of Electrical and Electronics Engineers; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id84f02338556642c5be44fc1777698578"><enum>(G)</enum><text>other organizations, as the Secretary determines necessary.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id8d3ac6f520394efba13e4dc89e11927e"><enum>(b)</enum><header>Interoperability of offshore transmission infrastructure</header><paragraph id="id8ce98bba84524ed499f2b90e35b2b2b7"><enum>(1)</enum><header>Study</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall conduct, and publish on the website of the Department of Energy a report describing the results of, a study that assesses the need to, and challenges of, developing and standardizing interoperable equipment and systems in support of shared offshore transmission networks, including—</text><subparagraph commented="no" display-inline="no-display-inline" id="id404b6946aa3d48c88b8705bd45354420"><enum>(A)</enum><text display-inline="yes-display-inline">technologies and associated costs;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd29cb90f402949fa8967accf8b04ead4"><enum>(B)</enum><text display-inline="yes-display-inline">timelines for development;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id13929b9c8d3c4f8dacd1b9daaf3e4b20"><enum>(C)</enum><text display-inline="yes-display-inline">parameters of equipment, such as weight and size; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id482c5c9ea7f54a038dce31de5e1fc561"><enum>(D)</enum><text display-inline="yes-display-inline">compatibility of the technologies with fixed and floating offshore generation facilities.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ided2b3a6bb15a427884f84c092a2ba8c5"><enum>(2)</enum><header>Recommendations</header><subparagraph commented="no" display-inline="no-display-inline" id="id6bf3c292e9544f1f8808ac98f5c6db75"><enum>(A)</enum><header>Definition of seam</header><text display-inline="yes-display-inline">In this paragraph, the term <term>seam</term> means a shared geographic or economic boundary between—</text><clause commented="no" display-inline="no-display-inline" id="id8fc593c46aaa4ab5817ea9902b5686ac"><enum>(i)</enum><text display-inline="yes-display-inline">an onshore electric energy transmission system and an offshore electric energy transmission system; or</text></clause><clause commented="no" display-inline="no-display-inline" id="idfa6ecb14a2ff4f35a12e83788d7e78f9"><enum>(ii)</enum><text display-inline="yes-display-inline">the transmission systems of 2 or more offshore wind energy projects.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0121b6e9e82f4fdb975b7c294de07f31"><enum>(B)</enum><header display-inline="yes-display-inline">Interoperability across seams</header><text display-inline="yes-display-inline">The study under paragraph (1) may include recommendations for Congress, State, Tribal, and local governments, manufacturers of electric grid components, systems, and technologies, Regional Transmission Organizations, Independent System Operators, transmission planning regions (as defined by the Federal Energy Regulatory Commission), offshore renewable energy project developers, and appropriate standards organizations to help ensure interoperability across seams. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id00afa911f9694ebbb29d03ee8d327f53"><enum>(3)</enum><header>Industry survey</header><text display-inline="yes-display-inline">The Secretary shall conduct, and use to inform the study under paragraph (1), an offshore wind industry survey that—</text><subparagraph commented="no" display-inline="no-display-inline" id="iddbd426b6791a4f1185423d0b40e5620c"><enum>(A)</enum><text display-inline="yes-display-inline">identifies any existing relevant interoperability standards; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id973e91db278341a18376cf4fcb15377a"><enum>(B)</enum><text display-inline="yes-display-inline">reviews common offshore wind transmission equipment ratings to identify gaps and issues of incompatibility.</text></subparagraph></paragraph><paragraph id="id2bb1c7b89bb14264bf9e39b9e6244e66"><enum>(4)</enum><header>Interoperability standard development program</header><subparagraph commented="no" display-inline="no-display-inline" id="idb6cf374720f543fea330a671dcce7974"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this Act, the Secretary shall establish and implement a program (referred to in this paragraph as the <term>program</term>) to identify, develop, support, and document a standard for the interoperability of electric grid components, systems, and technologies to accelerate the implementation and delivery of electricity generated by offshore renewable energy projects through shared transmission infrastructure. </text></subparagraph><subparagraph id="id55e207230ed0495ab9ede9289265ea09"><enum>(B)</enum><header>Goals</header><text>The goals of developing an interoperability standard under the program shall be—</text><clause id="id57272479fa5340d29b1356c9aa9c9330"><enum>(i)</enum><text>to hasten adoption of shared transmission infrastructure for offshore electricity generation by encouraging cooperation among manufacturers of electric grid components, systems, or technologies, for the purposes of—</text><subclause id="ide11ed0c1174d4d5c86b89420240b1dd0"><enum>(I)</enum><text>maximizing interoperability among the systems, products, tools, and applications of those manufacturers;</text></subclause><subclause id="idc898bc3f4b6b44a4b75a2be6878808a8"><enum>(II)</enum><text>reducing offshore renewable energy project delays and cost overruns;</text></subclause><subclause id="idc4b5df2593a64c59af38f2b80a0c6658"><enum>(III)</enum><text>managing power grid complexity; and</text></subclause><subclause id="iddd69ab767f824a6693dbf02b120b5b00"><enum>(IV)</enum><text>enhancing grid resilience, reliability, and cybersecurity; and</text></subclause></clause><clause id="id98495cba5d374fdb85b7499b894dfe53"><enum>(ii)</enum><text>to establish technical baseline requirements to effectively and securely measure, monitor, control, and protect electricity generation and transmission infrastructure from the point of generation to the control center.</text></clause></subparagraph><subparagraph id="id85914f4b15964b60986bd4ed41b3caf1"><enum>(C)</enum><header>Financial assistance</header><text>In carrying out the program, the Secretary may provide financial assistance to eligible entities (as determined by the Secretary) to carry out activities that—</text><clause id="ida7beb1ac25df45eb928fe4731c336f53"><enum>(i)</enum><text>engage equipment manufacturers and industry stakeholders in collaborative platforms, including workshops and forums;</text></clause><clause id="ide60d6b4ac51f460f8d5a63a354ba667a"><enum>(ii)</enum><text>identify current challenges and propose solutions to improve interoperability; and</text></clause><clause id="idb79516b50cd14e3e9ba089820c4142d8"><enum>(iii)</enum><text>develop an industry interoperability standard that meets the goals described in subparagraph (B) for voluntary implementation.</text></clause></subparagraph><subparagraph id="id5aecd9e5293e4b1483c9b718a0fab4ed"><enum>(D)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary to carry out the program $5,000,000 for fiscal year 2026, to remain available until expended.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id32ce1af26e7d40d9be45dba916752221"><enum>(c)</enum><header>Center of Excellence for Multiterminal High-Voltage Direct Current Testing and Certification</header><paragraph commented="no" display-inline="no-display-inline" id="id5fd597380aba49b396abbfeb1d93aeb6"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 270 days after the date of enactment of this Act, the Secretary shall establish, as a public-private partnership between 1 or more National Laboratories and 1 or more parties described in paragraph (2), a center, to be known as the <term>Center of Excellence for Multiterminal High-Voltage Direct Current Testing and Certification</term>—</text><subparagraph commented="no" display-inline="no-display-inline" id="idb415ba7bbb0e4a0a909d6db9f606bc10"><enum>(A)</enum><text display-inline="yes-display-inline">to test—</text><clause commented="no" display-inline="no-display-inline" id="ideb6762b546604e33aef8e517cb6cf235"><enum>(i)</enum><text display-inline="yes-display-inline">high-voltage direct current components; and </text></clause><clause commented="no" display-inline="no-display-inline" id="id16bf749e99a24e1b98ab79be113e781e"><enum>(ii)</enum><text display-inline="yes-display-inline">interactions—</text><subclause commented="no" display-inline="no-display-inline" id="idcba162a5eebe4bfaba76b1ecd77728d7"><enum>(I)</enum><text display-inline="yes-display-inline">between high-voltage direct current components from different equipment manufacturers; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id527a341fdd114f14ad2e0053a58cd321"><enum>(II)</enum><text display-inline="yes-display-inline">between high-voltage direct current components and alternating current devices; and</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idba09ab2980da4c19ba5fd2713997f8e5"><enum>(B)</enum><text display-inline="yes-display-inline">to ensure the compatibility of different devices before installation.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd72c1a12a3154ae1b93cc278f7bfc63c"><enum>(2)</enum><header>Parties described</header><text>A party referred to in paragraph (1) is—</text><subparagraph commented="no" display-inline="no-display-inline" id="iddfed651bda09483f8851ccb8f5eff477"><enum>(A)</enum><text display-inline="yes-display-inline">a member of the offshore wind industry;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide78a46d5848a4b71b1f6bb283b3fcf4b"><enum>(B)</enum><text>a high-voltage direct current equipment vendor;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idda4d9b03cc864587a6b71fef3f2d03a3"><enum>(C)</enum><text>a transmission provider;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id27e681a3f99149d3a66758345d20b860"><enum>(D)</enum><text>a research university; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida42e44794ddf4014b38641ab5f2047ff"><enum>(E)</enum><text display-inline="yes-display-inline">any other relevant organization, as the Secretary determines to be appropriate.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf5cc0bfb04494453bc11c99683b1b613"><enum>(3)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out this subsection $100,000,000 for fiscal year 2026, to remain available until expended.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id66a6d21916ff4c96b2cc5cda40cf8367"><enum>(d)</enum><header>Offshore wind transmission research and development</header><paragraph commented="no" display-inline="no-display-inline" id="id893ae9fd4c9d4e5ca921f75ba05a29eb"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 270 days after the date of enactment of this Act, the Secretary shall establish a program for, or modify an existing program to include, the research, development, demonstration, and deployment of offshore wind transmission technology, including with respect to—</text><subparagraph commented="no" display-inline="no-display-inline" id="ida18afa69277845eea1fc518ff36687bf"><enum>(A)</enum><text>high-voltage direct current technology;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf76fd95e312b420bae4ee85c70664cca"><enum>(B)</enum><text>offshore transmission, including floating transmission components; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id41d9756396c24e89a1e57e2067b5f9a1"><enum>(C)</enum><text display-inline="yes-display-inline">transmission optimization through grid-enhancing technologies; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0ff0298c70a74517bd56348a751ee937"><enum>(D)</enum><text display-inline="yes-display-inline">capabilities of inverter-based resources, including to increase the reliability and resilience of offshore and onshore transmission and the needed models, data, and tools.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id27472ab03c59497ea24df67d98db1226"><enum>(2)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary to carry out the program established under paragraph (1) $100,000,000 for each of fiscal years 2026 through 2030.</text></paragraph></subsection></section><section id="id1800617f377443d5bccf968adf1921b4"><enum>132.</enum><header>Offshore wind transmission planning</header><subsection commented="no" display-inline="no-display-inline" id="id7e1ad8ddd3bd4899a099f5364bf2f08a"><enum>(a)</enum><header>Identification of preferred routes</header><paragraph commented="no" display-inline="no-display-inline" id="id4c8ddd1f56cc450da944215a3e4ae236"><enum>(1)</enum><header display-inline="yes-display-inline">Initial identification</header><text>Not later than 2 years after the date of enactment of this Act, the Secretary and the Secretary of Energy (referred to in this section as the <term>Secretaries</term>), in coordination with the applicable Offshore Wind Transmission Task Force (as defined in section 111(a)) and relevant Federal agencies involved in the permitting of offshore wind generation facilities and offshore wind transmission facilities, shall identify preferred routes on the outer Continental Shelf for transmission cables and sub-seabed infrastructure (where such routes have not yet been identified)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id8a64489f68f7483f857d7f42734124b0"><enum>(A)</enum><text display-inline="yes-display-inline">between offshore wind generation facilities; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc3e2f529b7714d358aa8cd0c9b56b439"><enum>(B)</enum><text>between offshore wind generation facilities and optimal points of interconnection with onshore electric grids.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idda5bbcd25c5444bb8d82d715c862768e"><enum>(2)</enum><header>Periodic review</header><text>Not less frequently than once every 3 years after the initial identification of preferred routes in accordance with paragraph (1), the Secretaries, in coordination with the applicable Offshore Wind Transmission Task Force (as defined in section 111(a)) and relevant Federal agencies involved in the permitting of offshore wind generation facilities and offshore wind transmission facilities, shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="iddb27591b2ec84c949834858e78fa9125"><enum>(A)</enum><text display-inline="yes-display-inline">determine whether additional preferred routes are needed; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idff8b573c33d94737bc2b20ea85ee500b"><enum>(B)</enum><text>if applicable, identify any additional preferred routes.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id7d9f9f4eeea6428c914fdd18fbbc4cb7"><enum>(b)</enum><header>Considerations</header><paragraph commented="no" display-inline="no-display-inline" id="id9d0d6f375360416dbb8957346bf07c33"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In identifying preferred routes under subsection (a), the Secretaries shall take into account—</text><subparagraph commented="no" display-inline="no-display-inline" id="id4dba7d12a6ec4c8a993ce51099b26bad"><enum>(A)</enum><text>existing rights-of-way and existing sub-seabed infrastructure;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id24bcbdebe7d4465da9fd2720be760e7a"><enum>(B)</enum><text display-inline="yes-display-inline">the optimal points of interconnection between offshore wind generation facilities and onshore electric grids; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida16573fe2d604da5980d0634d52e34e9"><enum>(C)</enum><text display-inline="yes-display-inline">impacts on the marine environment, including critical habitats or protected areas, marine organisms, including protected or endangered species, and other ocean users, including fisheries.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd039a8f9710e4aaeafd94e1cf0e80393"><enum>(2)</enum><header>Planning area studies</header><text>Not later than 1 year after the date of enactment of this Act, and every 3 years thereafter for so long as the Secretary is developing new lease areas for offshore wind development for the applicable planning area, the Secretary of Energy, in coordination with the Secretary, shall conduct 1 or more planning area studies for that planning area to determine the optimal locations for transmission cables in networked and backboned topologies, which shall help to inform the identification of preferred routes under subsection (a).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd1808371567c416386fd1b3ce4cef9f2"><enum>(3)</enum><header>Consideration of studies</header><text>In identifying preferred routes under subsection (a), the Secretaries shall take into account, as appropriate, any applicable findings from—</text><subparagraph commented="no" display-inline="no-display-inline" id="id7583ed20852044b2bff896a8e7f98120"><enum>(A)</enum><text display-inline="yes-display-inline">the Atlantic Offshore Wind Transmission Study carried out by the National Renewable Energy Laboratory of the Department of Energy;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9e635093b54643fb82e72cfd0413f21f"><enum>(B)</enum><text display-inline="yes-display-inline">any subsequent offshore transmission study carried out by the Department of Energy for the Pacific Region or the Gulf of Mexico; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0c4a98e559b2485a9885c620f1c0a35a"><enum>(C)</enum><text>any other relevant offshore wind transmission study.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id1d62b86539e943679ce6541f73f75287"><enum>(c)</enum><header>Designation of Offshore Wind Transmission Corridors</header><paragraph commented="no" display-inline="no-display-inline" id="idc6d23ab484f44219a8d128caf0fb9a17"><enum>(1)</enum><header display-inline="yes-display-inline">Designation</header><text>The Secretary of Energy shall designate each preferred route identified under subsection (a) as an <quote>Offshore Wind Transmission Corridor</quote>.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id862bab049f364791b7d52d6a2a6a60da"><enum>(2)</enum><header>Effect of designation</header><subparagraph commented="no" display-inline="no-display-inline" id="idd21ad47c608a42de8cf90ed80e49bb88"><enum>(A)</enum><header>Eligibility for NIETC funding</header><clause commented="no" display-inline="no-display-inline" id="id026318a4a1ed46e394328beed9557e11"><enum>(i)</enum><header display-inline="yes-display-inline">Definition of national interest electric transmission corridor</header><text>In this subparagraph, the term <term>national interest electric transmission corridor</term> means a national interest electric transmission corridor designated by the Secretary of Energy under section 216(a) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824p">16 U.S.C. 824p(a)</external-xref>).</text></clause><clause commented="no" display-inline="no-display-inline" id="id64964c6f33ab465b98454034f22442e0"><enum>(ii)</enum><header>Eligibility for assistance</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, including section 216(a) the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824p">16 U.S.C. 824p(a)</external-xref>)—</text><subclause commented="no" display-inline="no-display-inline" id="ida19a53a38c4446f08e51b0061b58bd83"><enum>(I)</enum><text display-inline="yes-display-inline">an Offshore Wind Transmission Corridor designated under paragraph (1) shall be considered to be a national interest electric transmission corridor for purposes of any law under which the Secretary of Energy may provide financial or other assistance for a national interest electric transmission corridor or a facility within a national interest electric transmission corridor; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id70baad4f2f7c4b4b927cd6366c53d501"><enum>(II)</enum><text display-inline="yes-display-inline">pursuant to subclause (I), an Offshore Wind Transmission Corridor designated under paragraph (1) and a transmission facility described in clause (iii) shall be eligible for financial and other assistance provided by the Secretary of Energy, including a direct loan or loan guarantee under section 50151 of <external-xref legal-doc="public-law" parsable-cite="pl/117/169">Public Law 117–169</external-xref> (commonly known as the <term>Inflation Reduction Act of 2022</term>) (<external-xref legal-doc="usc" parsable-cite="usc/42/18715">42 U.S.C. 18715</external-xref>), to the same extent as a national interest electric transmission corridor or facility within a national interest electric transmission corridor, as applicable.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id7f7021526bad4877a5d317a0fc20fbf8"><enum>(iii)</enum><header>Transmission facility described</header><subclause commented="no" display-inline="no-display-inline" id="id26fd7b7bd9c14c6483118d320bc0104e"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">A transmission facility referred to in clause (ii)(II) is any cable or other offshore wind transmission facility—</text><item commented="no" display-inline="no-display-inline" id="id5ebbee321b7b4a2c8485709c750ec25a"><enum>(aa)</enum><text display-inline="yes-display-inline">that is located entirely within an Offshore Wind Transmission Corridor;</text></item><item commented="no" display-inline="no-display-inline" id="id3b2fe3ff7abc4423a1b9dd723ef80020"><enum>(bb)</enum><text>that utilizes at least 50 percent of the length of an Offshore Wind Transmission Corridor; or</text></item><item commented="no" display-inline="no-display-inline" id="idf4ae71f6e98743feabc9270c22deaddd"><enum>(cc)</enum><text>with respect to which the Secretary makes the discretionary determination described in subclause (II).</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="ida3fb0d17f4ce465582c051b9b8fd91ad"><enum>(II)</enum><header>Discretionary determination</header><text>At the discretion of the Secretary, the Secretary may determine that a cable or other offshore wind transmission facility is a transmission facility referred to in clause (ii)(II) if the Secretary determines that a majority of the cable or other transmission facility runs parallel to an Offshore Wind Transmission Corridor.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id1badfba8002a47cab94a214a7bed894d"><enum>(iv)</enum><header>Savings provision</header><text display-inline="yes-display-inline">Clause (ii) does not—</text><subclause commented="no" display-inline="no-display-inline" id="id37512314bc624a26aa22346b1cc24e3c"><enum>(I)</enum><text display-inline="yes-display-inline">alter or otherwise affect—</text><item commented="no" display-inline="no-display-inline" id="id19909c28d1ef4df6964fcb97d25710fb"><enum>(aa)</enum><text display-inline="yes-display-inline">the authority of the Federal Energy Regulatory Commission under section 216(b) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824p">16 U.S.C. 824p(b)</external-xref>) (commonly known as the <quote>backstop siting authority</quote> of the Commission);</text></item><item commented="no" display-inline="no-display-inline" id="id7c81526110654edfbb53ad02bbd7c5d0"><enum>(bb)</enum><text>the authority of the Secretary of Energy under subsection (a) or (h) of section 216 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824p">16 U.S.C. 824p</external-xref>); or</text></item><item commented="no" display-inline="no-display-inline" id="id4278db9321d748f5b1584f66825c6545"><enum>(cc)</enum><text>any other authority of a Federal, State, local, or Tribal agency or authority, or interstate compact, with respect to a national interest electric transmission corridor; or</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="id075b7cc5667c42289168a113486efbfa"><enum>(II)</enum><text>render an Offshore Wind Transmission Corridor subject to any authority described in subclause (I).</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3857d63c3ee64d5bae2c1c8ffdfe1169"><enum>(B)</enum><header>Transmission facilitation program</header><text>Notwithstanding any other provision of law, a transmission cable in an Offshore Wind Transmission Corridor designated under paragraph (1) shall be considered to be an eligible electric power transmission line (as defined in section 40106(a) of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/42/18713">42 U.S.C. 18713(a)</external-xref>)) for purposes of that section.</text></subparagraph><subparagraph id="id520c31fe1a5e4a4d83898dc5c067ecc2"><enum>(C)</enum><header>DOE program to fund survey work</header><clause commented="no" display-inline="no-display-inline" id="id35e090ed8b1643498f252207e723f819"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary of Energy shall establish a program to provide funding for geotechnical and geophysical surveys and marine resource assessments relating to the siting of transmission cables or other offshore wind transmission facilities proposed to be located within an Offshore Wind Transmission Corridor.</text></clause><clause commented="no" display-inline="no-display-inline" id="idcae8736bd8034ca2bce7cfac6fd37fea"><enum>(ii)</enum><header>Requirement</header><text display-inline="yes-display-inline">Funds provided under the program established under clause (i) shall be used for geotechnical and geophysical survey work to determine the suitability of 1 or more locations, including any potential route, for a transmission cable or other offshore wind transmission facility within the applicable Offshore Wind Transmission Corridor.</text></clause><clause commented="no" display-inline="no-display-inline" id="id5ba5d468e34644af964047fd393e2f2c"><enum>(iii)</enum><header>NEPA applicablility</header><text>The provision of funds under the program established under clause (i), and the use of those funds in accordance with clause (ii), shall not be considered a major Federal action (as defined in section 111 of the <act-name parsable-cite="NEPA69">National Environmental Policy Act of 1969</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/4336e">42 U.S.C. 4336e</external-xref>)) for purposes of that <act-name parsable-cite="NEPA69">Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>).</text></clause><clause commented="no" display-inline="no-display-inline" id="idcd9815ced0734bc2b76d1066313e0020"><enum>(iv)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary of Energy to carry out this subsection $100,000,000 for each of fiscal years 2025 through 2030.</text></clause></subparagraph></paragraph></subsection><subsection id="id1ac958a2b49147febe48ca72e2a791f7" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header>NEPA applicability</header><text>The identification of preferred routes under subsection (a) and the designation of Offshore Wind Transmission Corridors under subsection (c) shall not be considered a major Federal action (as defined in section 111 of the <act-name parsable-cite="NEPA69">National Environmental Policy Act of 1969</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/4336e">42 U.S.C. 4336e</external-xref>)) for purposes of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>).</text></subsection></section><section id="idf5ae098a2be041f9b2fe840138bde139"><enum>133.</enum><header>Offshore wind transmission siting, permitting, and authorizations</header><subsection commented="no" display-inline="no-display-inline" id="ida9fbbdc722e849748ce3b9b4e997979c"><enum>(a)</enum><header>Lead agency</header><paragraph id="id0adbfbac6d5346b2b5bf45b8428ad3f9"><enum>(1)</enum><header>In general</header><text>With respect to an offshore wind transmission facility, the Department of the Interior shall act as the lead agency for purposes of coordinating all applicable Federal authorizations and related environmental reviews of the facility.</text></paragraph><paragraph id="id3e265ad3e45b413f9fa302d03a1731a3"><enum>(2)</enum><header>Deadlines and milestones</header><text>As head of the lead agency, the Secretary shall establish prompt and binding intermediate milestones and ultimate deadlines for the review of, and Federal authorization decisions relating to, the proposed facility.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idb036f82f389b42ffb7733d4ebd16ce59"><enum>(b)</enum><header>Rulemaking</header><paragraph commented="no" display-inline="no-display-inline" id="ida753f7e6a7dc42308fc1b2d015cc3677"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 18 months after the date of enactment of this Act, the Secretary, in coordination with other relevant Federal agencies, shall issue, pursuant to section 5 of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1334">43 U.S.C. 1334</external-xref>), a final rule relating to Federal authorizations for offshore wind transmission facilities.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8a90f3d817604618ad5f82183ca2b315"><enum>(2)</enum><header>Considerations</header><text>In carrying out paragraph (1), the Secretary shall consider—</text><subparagraph commented="no" display-inline="no-display-inline" id="idabd34f7ce4b04b7587bfb44e642a1d74"><enum>(A)</enum><text display-inline="yes-display-inline">establishing 1 or more procedures for soliciting information about existing and potential rights-of-way;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id282e3e92807b4b65b6170c96b1ff2cd1"><enum>(B)</enum><text>establishing a process for determining interest in the use of 1 or more rights-of-way, including backboned or meshed rights-of-way;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id51b4b9e1a2f341729531bbff201ff1bd"><enum>(C)</enum><text>establishing a process for the issuance of rights-of-way, on a competitive or noncompetitive basis, as appropriate, which may include consideration of whether a developer—</text><clause commented="no" display-inline="no-display-inline" id="id2b136b2c94634f8e854d2c4a01cfd937"><enum>(i)</enum><text display-inline="yes-display-inline">has an award from a State via a competitive process;</text></clause><clause commented="no" display-inline="no-display-inline" id="id6ed5d937bb75420d862c9ba253d410be"><enum>(ii)</enum><text display-inline="yes-display-inline">has an existing agreement to interconnect a transmission project; or </text></clause><clause commented="no" display-inline="no-display-inline" id="idc677d300d44743bfb85821170f9472a6"><enum>(iii)</enum><text display-inline="yes-display-inline">has submitted an interconnection request in accordance with the pro forma Large Generator Interconnection Procedures promulgated pursuant to section 35.28(f) of title 18, Code of Federal Regulations (or successor regulations);</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6aa25ace25c947009a0e6e09b9c51b48"><enum>(D)</enum><text>any requirements relating to environmental reviews for—</text><clause commented="no" display-inline="no-display-inline" id="id6fff4ecb571a4429836fa84b9fc14508"><enum>(i)</enum><text display-inline="yes-display-inline">independent transmission projects; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idc48fc400f757448e8c7bdcac20277435"><enum>(ii)</enum><text>transmission projects within existing rights-of-way; and</text></clause></subparagraph><subparagraph id="id8a02dba50102466481162c1ac669b18c" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text>the requirements described in section 8(p)(4) of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1337">43 U.S.C. 1337(p)(4)</external-xref>).</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id68adb6cb935544b380b0e59ae1d980f2"><enum>(c)</enum><header>Amendment</header><text>Section 8(p)(3) of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1337">43 U.S.C. 1337(p)(3)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id8e310a8c4178409cb5ef206adfdde9e5"><enum>(1)</enum><text>by striking <quote>, the Secretary shall issue a lease, easement, or right-of-way</quote> and inserting the following: “(<external-xref legal-doc="usc" parsable-cite="usc/43/1337">43 U.S.C. 1337</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/109/58">Public Law 109–58</external-xref>), the id="idc8e51b33b28449eb885db949b74d681d"><enum>134.</enum><header>Reliability standards for offshore transmission</header><subsection commented="no" display-inline="no-display-inline" id="id9723ac44f20544ac8dd0868a81a8bbfc"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="id511f76fdfa7f423996add63ab30d6c41"><enum>(1)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Energy Regulatory Commission.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idae49fbb7c558477f9391d21d6bcfefb5"><enum>(2)</enum><header>Reliability standard</header><text display-inline="yes-display-inline">The term <term>reliability standard</term> has the meaning given the term in section 215(a) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824o">16 U.S.C. 824o(a)</external-xref>).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id2e67065cf8334394b3d929248653bda3"><enum>(b)</enum><header display-inline="yes-display-inline">Requirement</header><text>Not later than 90 days after the date of enactment of this Act, the Commission, in accordance with section 215(d)(5) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824o">16 U.S.C. 824o(d)(5)</external-xref>), shall order the Electric Reliability Organization to file with the Commission a reliability standard relating to planning for offshore transmission that evaluates and, as necessary, provides clarity with respect to—</text><paragraph commented="no" display-inline="no-display-inline" id="id933bfc5da8ad46c4b289950255fc52ab"><enum>(1)</enum><text display-inline="yes-display-inline">credible multiple contingencies of subsea cables within a common corridor;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idff16fe1590d9411eaa8f9c45c1d6b3b8"><enum>(2)</enum><text>credible multiple contingencies of high-voltage direct current bipole topologies with dedicated metallic return; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id55adf2064358405c9ff9f889680c21c7"><enum>(3)</enum><text>generator definitions for large distributed energy generation plans composed of multiple individual generators within planning contingency standards.</text></paragraph></subsection></section><section id="idaee5bc0291a14bb9b836a0de9a1d276b"><enum>135.</enum><header>Inclusion of offshore wind energy in interregional transmission planning</header><subsection commented="no" display-inline="no-display-inline" id="id85054fce796d4da5b130c32bb217d937"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text>With respect to any interregional transmission planning described in subsection (b), and any rulemaking relating to that interregional transmission planning, the Federal Energy Regulatory Commission (referred to in this section as the <term>Commission</term>) shall require the consideration of—</text><paragraph commented="no" display-inline="no-display-inline" id="id7faa478723224d9f93d42e575a2b03d2"><enum>(1)</enum><text display-inline="yes-display-inline">multivalue cost allocation methodologies that evaluate the economic, reliability, and public policy benefits of a networked transmission system that incorporates offshore wind generation and transmission; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide0f498629d1d4c97be1ceb95f9a8e2a4"><enum>(2)</enum><text display-inline="yes-display-inline">the reliability, resilience, and resource adequacy of integrating offshore wind into transmission systems.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idc4663d5284384d1b817e7cb231bb86b6"><enum>(b)</enum><header>Interregional transmission planning described</header><text>The interregional transmission planning referred to in subsection (a) is any interregional transmission planning that the Commission requires to be carried out by—</text><paragraph commented="no" display-inline="no-display-inline" id="id449c6aeb27cc4f1581aed35a527c6234"><enum>(1)</enum><text display-inline="yes-display-inline">public utility transmission providers;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc97552d6bf9849d9bebff49e39b5c477"><enum>(2)</enum><text display-inline="yes-display-inline">Regional Transmission Organizations;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idcbb6e91ac06246e9bd077548b71d9330"><enum>(3)</enum><text display-inline="yes-display-inline">Independent System Operators; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd022737843904d8bb9de1d0a80b0f485"><enum>(4)</enum><text>any combination of regions or entities described in paragraphs (1) through (3).</text></paragraph></subsection></section><section id="id19187bb57c994617a65750526a5bda6f"><enum>136.</enum><header>Coastal State integration of offshore wind energy</header><subsection id="idf7a09b5aeef840d9a3bc9b4bb80d91e1"><enum>(a)</enum><header>In general</header><text>Section 111(d) of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2621">16 U.S.C. 2621(d)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idb7325c65ff4e4b31a5dae9f77fba7d32"><paragraph id="idc4100d2dacf94100b35de6927cb900cf"><enum>(22)</enum><header>Offshore wind integration</header><subparagraph commented="no" display-inline="no-display-inline" id="idc509771fee6044c581b23f13f7bd81b2"><enum>(A)</enum><header display-inline="yes-display-inline">Definition of coastal State</header><text>In this paragraph, the term <term>coastal State</term> has the meaning given the term <term>coastal state</term> in section 304 of the Coastal Zone Management Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/16/1453">16 U.S.C. 1453</external-xref>).</text></subparagraph><subparagraph id="id78E6D2054C7C4C369566561621C1A7BA"><enum>(B)</enum><header>Incorporation of offshore wind energy</header><text>Each coastal State shall—</text><clause commented="no" display-inline="no-display-inline" id="id7ec1fdee99a348d29cfb1ccc05aea094"><enum>(i)</enum><text display-inline="yes-display-inline">consider how to incorporate offshore wind generation and transmission into the electricity distribution system of the coastal State, including—</text><subclause commented="no" display-inline="no-display-inline" id="iddff6a4de740049059444ae0eb51c9226"><enum>(I)</enum><text display-inline="yes-display-inline">the optimal points of interconnection (as defined in section 101 of the <short-title>COLLABORATE Act</short-title>), including consideration of—</text><item commented="no" display-inline="no-display-inline" id="id7db0a466f8da4e53bfbfb88530c7459b"><enum>(aa)</enum><text display-inline="yes-display-inline">any Offshore Wind Transmission Corridors designated under section 132(c)(1) of that Act;</text></item><item commented="no" display-inline="no-display-inline" id="id2525c2f55e9a4f7691191a8f09fe955b"><enum>(bb)</enum><text display-inline="yes-display-inline">any national interest electric transmission corridors designated under section 216(a) of the Federal Power Act (<external-xref legal-doc="usc" parsable-cite="usc/16/824p">16 U.S.C. 824p(a)</external-xref>);</text></item><item commented="no" display-inline="no-display-inline" id="id9c962f4c71944b329d5a4dffee3ec3fe"><enum>(cc)</enum><text display-inline="yes-display-inline">existing or permitted transmission lines; and</text></item><item commented="no" display-inline="no-display-inline" id="id92eac7b4a2ae4e7aa05df0f4dc8413f8"><enum>(dd)</enum><text display-inline="yes-display-inline">the potential for retiring or aged fossil fuel plants to provide system capacity; </text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="idc9846f99547d4ba4a7a81eb5e085f6db"><enum>(II)</enum><text>onshore upgrades to facilitate interconnection;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id20371b6e165e47a6a9be7d11ad370c4d"><enum>(III)</enum><text>design standards to support a networked offshore transmission system, including design standards developed under section 131(a) of the <short-title>COLLABORATE Act</short-title>;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="ide5c8b39acd414e4cad89757106954da7"><enum>(IV)</enum><text>any identified points of interconnection in State transmission solicitations for procurement; and</text></subclause><subclause id="id4f0887b1333e4084a5479b7922fcb0e2"><enum>(V)</enum><text>State policies and procurement goals;</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id35e3180288204f7283b304498e53193e"><enum>(ii)</enum><text display-inline="yes-display-inline">modify integrated resource plans to account for—</text><subclause commented="no" display-inline="no-display-inline" id="idfb45ce25289e4bc9aaf685e6f6123e4e"><enum>(I)</enum><text display-inline="yes-display-inline">the matters considered under clause (i);</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id186b2413e5ef4d77b429a4ab6fc47b30"><enum>(II)</enum><text>existing single-source contingency limits;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id8f6cdc822316497b8bdb4d9388d94021"><enum>(III)</enum><text>the adoption of the standard published by the Institute of Electrical and Electronic Engineers Standards Association entitled <quote>Standard for Interconnection and Interoperability of Inverter-Based Resources Interconnecting with Associated Transmission Electric Power Systems</quote> and numbered IEEE 2800 into utility interconnection requirements; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id84e25cf6f7284d85919d2124f723e000"><enum>(IV)</enum><text>the use of grid-enhancing technologies;</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idd02bd6573943491c9b438fb1160693ab"><enum>(iii)</enum><text>establish design standards described in clause (i)(III); and</text></clause><clause commented="no" display-inline="no-display-inline" id="id0f956c74f201454987bfa12ca03254e9"><enum>(iv)</enum><text>incorporate the consideration of the matters described in clause (i) into State planning processes relating to electric energy transmission and distribution.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idb47f12c066754507947ca888de465bfc"><enum>(b)</enum><header>Compliance</header><paragraph id="idccb08e5517d34f759cafad59e68d97e4"><enum>(1)</enum><header>Time limitation</header><text>Section 112(b) of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2622">16 U.S.C. 2622(b)</external-xref>) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="id304cf5cec1c7427096c51af7a78be227"><enum>(A)</enum><text>in paragraph (8), by indenting subparagraph (B) appropriately; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddf42036f884745da82a8a20d6e15e4f4"><enum>(B)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA2F36B1450B14FD484BB69D876CDFA60"><paragraph id="id7e5d97f421e74cab80f7c50e08e1fcd4"><enum>(9)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idb18308bd2cb74d7fb906abca71fd8728"><enum>(A)</enum><text>Not later than 1 year after the date of enactment of this paragraph, with respect to each coastal State (as defined in paragraph (22)(A) of section 111(d)), each State regulatory authority (with respect to each electric utility for which the State has ratemaking authority) and each nonregulated electric utility shall commence consideration under section 111, or set a hearing date for consideration, with respect to the standard established by paragraph (22) of section 111(d).</text></subparagraph><subparagraph id="idCF04AFA849164238808468225F3516A7" indent="up1"><enum>(B)</enum><text>Not later than 2 years after the date of enactment of this paragraph, with respect to each coastal State (as defined in paragraph (22)(A) of section 111(d)), each State regulatory authority (with respect to each electric utility for which the State has ratemaking authority), and each nonregulated electric utility shall complete the consideration and make the determination under section 111 with respect to the standard established by paragraph (22) of section 111(d).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id28fadb33b8264785bb796fc4f14a04b4"><enum>(2)</enum><header>Failure to comply</header><text>Section 112(c) of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2622">16 U.S.C. 2622(c)</external-xref>) is amended by adding at the end the following: <quote>In the case of the standard established by paragraph (22) of section 111(d), the reference contained in this subsection to the date of enactment of this Act shall be deemed to be a reference to the date of enactment of that paragraph (22).</quote>.</text></paragraph><paragraph id="ida5feac3ff4a5450989f0f61e78f58ef9"><enum>(3)</enum><header>Prior State actions</header><subparagraph id="id5c9c44db45a249569a86f924f043cbad"><enum>(A)</enum><header>In general</header><text>Section 112 of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2622">16 U.S.C. 2622</external-xref>) is amended—</text><clause id="id91AD20376B3147B2907D704BC882DE23"><enum>(i)</enum><text>in subsection (h), in the subsection heading, by striking <quote><header-in-text style="OLC" level="subsection">Other</header-in-text></quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idae02d55acfc344809ff37b1a8a8937d6"><enum>(ii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8cd3facbc33a4e73bc62336e722e0861"><subsection id="id5c75f1438619403bb22e6671bf0eab4e"><enum>(i)</enum><header>Prior State actions</header><text>Subsections (b) and (c) shall not apply to the standard established by paragraph (22) of section 111(d) in the case of any electric utility in a State if, before the date of enactment of this subsection—</text><paragraph id="id5a43369be3624842b580cc82a22d777d"><enum>(1)</enum><text>the State has implemented for the electric utility the standard (or a comparable standard);</text></paragraph><paragraph id="id8608613c92e248628faeea88c1847a0f"><enum>(2)</enum><text>the State regulatory authority for the State or the relevant nonregulated electric utility has conducted a proceeding to consider implementation of the standard (or a comparable standard) for the electric utility; or</text></paragraph><paragraph id="id362e066ac81e40348d0fdcaccb256ce1"><enum>(3)</enum><text>the State legislature has voted on the implementation of the standard (or a comparable standard) for the electric utility during the 3-year period ending on that date of enactment.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="id1C788637F828466D959E91E3583F7434" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header>Cross reference</header><text>Section 124 of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" general</header><text display-inline="yes-display-inline">The requirements of sections 111(d)(22) and 112(b)(9) of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2621">16 U.S.C. 2621(d)(22)</external-xref>, 2622(b)(9)), and any related provisions of that Act (as amended by paragraph (2), or subparagraph (A)(ii) or (B) of paragraph (3), of subsection (b)), shall apply to each coastal State (as defined in section 304 of the Coastal Zone Management Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/16/1453">16 U.S.C. provision</header><text>Nothing in this subsection alters or otherwise affects the application of any provision of the Public Utility Regulatory Policies Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/16/2601">16 U.S.C. 2601 et seq.</external-xref>) not added or amended by—</text><subparagraph commented="no" display-inline="no-display-inline" id="idaec265ae2c9a41c9973c573c1ca4739b"><enum>(A)</enum><text display-inline="yes-display-inline">subsection (a);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf1e07ee56049418baf0a311b949caf60"><enum>(B)</enum><text>paragraph (1)(B) or (2) of subsection (b); or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd717eb43ec2d431f8c1b30dfd9a0d125"><enum>(C)</enum><text display-inline="yes-display-inline">subparagraph (A)(ii) or (B) of subsection (b)(3).</text></subparagraph></paragraph></subsection></section></subtitle><subtitle id="ida9081b11929c4b06acbdd0491671e6e9" style="OLC"><enum>D</enum><header>Miscellaneous</header><section id="ida13a01596f63473b8be2efc2d3e010c2"><enum>141.</enum><header>Judicial review</header><subsection commented="no" display-inline="no-display-inline" id="id3a1db7e751d6406cbb5a0838844554fe"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 23(c)(2) of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1349">43 U.S.C. 1349(c)(2)</external-xref>) is amended by inserting <quote>, any issuance of a final lease, easement, or right-of-way pursuant to section 8(p)(1), and any approval, modification, or disapproval of any plan for construction or operations on such a lease, easement, or right-of-way</quote> after <quote>under this Act</quote>.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id796bf5e3c126412ba1b5af907c3e2f65"><enum>(b)</enum><header>Applicability</header><text display-inline="yes-display-inline">The amendment made by subsection (a)—</text><paragraph commented="no" display-inline="no-display-inline" id="idd55eb68c99194173b3a24bdca52e8a86"><enum>(1)</enum><text display-inline="yes-display-inline">shall apply with respect to any action brought pursuant to section 23(c)(2) of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1349">43 U.S.C. 1349(c)(2)</external-xref>) that is filed on or after the date of enactment of this Act; and</text></paragraph><paragraph id="idb44343da3d034251abe8ff2415cb0a7e" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>shall not apply with respect to any action described in paragraph (1) that is filed before that date of enactment. </text></paragraph></subsection></section></subtitle></title><title id="idCC6A3590C3D74BC99AD0EEF0C3AE6E1D" style="OLC"><enum>II</enum><header>Fisheries</header><section id="idf184c84408b2458a9352919d5a762e2b"><enum>201.</enum><header>Offshore Wind Energy Fisheries Compensation Fund</header><text display-inline="no-display-inline">The Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1331">43 U.S.C. 1331 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block id="id4A7274F858AF4CE283B5389CAC22A544" display-inline="no-display-inline" style="OLC"><section id="id3b0266f6fd1b4916b560e2ee0d54169f"><enum>34.</enum><header>Offshore Wind Energy Fisheries Compensation Fund</header><subsection commented="no" display-inline="no-display-inline" id="idce21cd1dd73b461f9faad95ce92f188e"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment</header><paragraph commented="no" display-inline="no-display-inline" id="ide008ced38fe849b08e3340ddfc3b7f92"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">There is established in the Treasury of the United States a fund, to be known as the <quote>Offshore Wind Energy Fisheries Compensation Fund</quote> (referred to in this section as the <quote>Fund</quote>). </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id00a5bd4774da4e22ae2f298cd3a1449c"><enum>(2)</enum><header>Purpose</header><subparagraph commented="no" display-inline="no-display-inline" id="id0e2eb848b3be4acbb339914e4e0211d5"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Fund shall be available to the Secretary of Commerce without fiscal year limitation as a revolving fund for the purpose of making payments to compensate eligible recipients for losses caused by the planning, pre-construction survey, construction, maintenance, operation, and decommissioning of offshore wind energy facilities on the outer Continental Shelf within the jurisdiction of a State that participates in the Fund. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id048ae7531f0142eba4bb01cb96b0191a"><enum>(B)</enum><header>Required participation</header><text>Each offshore wind lease holder and project sponsor shall be required to provide amounts into the Fund as described in subsection (b), unless the offshore wind lease holder or project sponsor is in a State that is not participating in the Fund pursuant to paragraph (3).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf12e26775ec94c5780f4830cbf632e8e"><enum>(3)</enum><header>State participation</header><subparagraph commented="no" display-inline="no-display-inline" id="idec5211abfd1f43ee8fcaeb79fb8fd7ec"><enum>(A)</enum><header display-inline="yes-display-inline">Required participation</header><text>Each State that does not have an existing or under development fisheries compensation fund or a comparable program shall participate in the Fund with respect to projects within the jurisdiction of the State.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id89f55978b50349759a8d2a374f22fda5"><enum>(B)</enum><header>Election to opt-in</header><text display-inline="yes-display-inline">Each State that has an existing or under development fisheries compensation fund or a comparable program is not required to participate in the Fund, but may elect to opt-into participation in the Fund with respect to projects within the jurisdiction of the State.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id10dc1cedd06c42babf0ac2b0c4a3916c"><enum>(C)</enum><header>Payment into one fund</header><text display-inline="yes-display-inline">An offshore wind lease holder or project sponsor shall only provide amounts into the Fund or a State's fisheries compensation fund, and not both.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8cd900905205414596e16f10c224b384"><enum>(4)</enum><header>Fund use; resources</header><text display-inline="yes-display-inline">The Fund shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="id38bf727b29754678b5e87f3044bf1f6d"><enum>(A)</enum><text display-inline="yes-display-inline">be used by the Secretary of Commerce to provide to eligible recipients payments for claims described under subsection (c); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id93f40955866d4e1d9872a7688f2a7a3e"><enum>(B)</enum><text display-inline="yes-display-inline">consist of—</text><clause id="id895efc879aa142b5a951dea84076d193"><enum>(i)</enum><text>revenues received from investments made under paragraph (5); and</text></clause><clause commented="no" display-inline="no-display-inline" id="id7c7bb094460f4bda87a384fb2c2f0866"><enum>(ii)</enum><text display-inline="yes-display-inline">amounts collected pursuant to subsection (b). </text></clause></subparagraph></paragraph><paragraph id="id5af58709172247a6a660ad3aeece86c1"><enum>(5)</enum><header>Investment</header><subparagraph commented="no" display-inline="no-display-inline" id="idbbda5a266e674479b88520f3051d3ede"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Amounts in the Fund that are not currently needed for the purposes of the Fund shall be—</text><clause commented="no" display-inline="no-display-inline" id="id262ef9849d9d4484b84f367441c6e7c7"><enum>(i)</enum><text display-inline="yes-display-inline">kept on deposit in appropriate interest-bearing accounts that shall be established by the Secretary of the Treasury; or </text></clause><clause commented="no" display-inline="no-display-inline" id="idcc85d3f6e86e4d27af59f9b1efbad9c7"><enum>(ii)</enum><text display-inline="yes-display-inline">invested in obligations of, or guaranteed by, the United States. </text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb043c2f1478446278622d8c8ded8d271"><enum>(B)</enum><header>Revenue accrual</header><text display-inline="yes-display-inline">Any revenue accruing from such deposits and investments described in subparagraph (A) shall be deposited in the Fund. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfd7d6bacfa15403eaf693078bc0aa2dc"><enum>(6)</enum><header>Division of fund</header><subparagraph commented="no" display-inline="no-display-inline" id="id7985665d9ce14140af68b99cdb8ede7e"><enum>(A)</enum><header>In general</header><clause commented="no" display-inline="no-display-inline" id="id39a8490cc2e7493a974c0eb90593a110"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">The Fund shall be divided into 3 separate geographic area accounts based on the jurisdiction of the Atlantic States Marine Fisheries Commission, the Gulf States Marine Fisheries Commission, and the Pacific States Marine Fisheries Commission. </text></clause><clause commented="no" display-inline="no-display-inline" id="id861bf85ef56c4de89ca5724618b7cde1"><enum>(ii)</enum><header>Additional accounts</header><text display-inline="yes-display-inline">In addition to the 3 separate geographic area accounts described in clause (i), the Secretary of Commerce may add 1 or more separate geographic area accounts into which the Fund shall be divided.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7be9d2581d9748cc8e812744d2159570"><enum>(B)</enum><header>Amounts in accounts</header><text display-inline="yes-display-inline">The division of amounts in each geographic area account of the Fund shall be based on the leasing activity for offshore wind energy in the geographic area of the account and payments from amounts in each account of the Fund shall address losses in the applicable geographic area.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id6f43b2e1433c4a97b56365db7650cd30"><enum>(b)</enum><header>Fisheries mitigation compensation</header><paragraph commented="no" display-inline="no-display-inline" id="id6c805144bc544017a925362e95049040"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, acting through the Director of the Bureau of Ocean Energy Management—</text><subparagraph commented="no" display-inline="no-display-inline" id="ida21a46b4ecc644ffa80371aab842776c"><enum>(A)</enum><text display-inline="yes-display-inline">shall require offshore wind lease holders in States that are participating in the Fund to include fisheries compensation as part of the leasing process for offshore wind energy under section 33, including by providing to the Secretary, for deposit into the Fund, amounts determined to be appropriate by the Secretary pursuant to paragraph (2), which shall be separate from any other fees, payments, or other amounts, and paid in one lump sum at final investment decision; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5852176c073c46f9ac944e1bef20877f"><enum>(B)</enum><text display-inline="yes-display-inline">shall require project sponsors in States that are participating in the Fund to provide to the Secretary, for deposit into the Fund, an additional amount equal to 5 percent of any amount required to be provided for deposit into the Fund under subparagraph (A), of which additional amount—</text><clause commented="no" display-inline="no-display-inline" id="id1cfd058982cd450b8def5f3bbef5b23e"><enum>(i)</enum><text display-inline="yes-display-inline">40 percent shall be available to the Secretary to cover the administrative expenses of carrying out this section; and</text></clause><clause commented="no" display-inline="no-display-inline" id="ide2d9000b9e524c2cbea9598240d914d5"><enum>(ii)</enum><text>60 percent shall be available to the Secretary of Commerce to cover the administrative expenses of carrying out this section;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id063c00051bd24f59bfdffa9192cd28cf"><enum>(C)</enum><text display-inline="yes-display-inline">shall deposit any amounts received under subparagraph (A) or (B) in the Fund; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id982ddd81ec3c415ba856d5f4b6525529"><enum>(D)</enum><text>shall require the designated liaisons appointed under section 8(p)(11)(B)(ii) to conduct outreach to fishermen on the availability of compensation from the Fund pursuant to this section.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1243a68713bf4c7585cf7e87189607d2"><enum>(2)</enum><header>Establishment of formula to calculate amounts to be paid</header><subparagraph commented="no" display-inline="no-display-inline" id="id415cb5f376ae45168650b4f663ca0568"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary, in coordination with the Administrator of the National Oceanic and Atmospheric Administration, shall establish a formula to calculate the amounts to be paid by each project sponsor into the Fund.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1f9353d7aa3a4bd8b3a029324e4098a2"><enum>(B)</enum><header>Reevaluation of formula</header><text display-inline="yes-display-inline">The Secretary shall evaluate and potentially adjust the formula established under subparagraph (A) not less often than every 5 years.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7b2a6c1efa53413f8982380f9d561d0c"><enum>(C)</enum><header>State authority</header><text>Nothing in this paragraph shall be construed to diminish or otherwise alter a State's authority pursuant to the Coastal Zone Management Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/16/1451">16 U.S.C. 1451 et seq.</external-xref>).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc48a35f1716e4e64a98ac649857cd141"><enum>(3)</enum><header>Applicability</header><text>The requirements described in this subsection shall not apply to a project sponsor that issued a notice of intent to prepare a draft environmental impact statement with respect to the project before the date the Fund is established under subsection (a).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idde65c07affcd4b2c88eb5a8274c72fac"><enum>(c)</enum><header display-inline="yes-display-inline">Claims process</header><paragraph commented="no" display-inline="no-display-inline" id="ida56552e32ea244448e2cb0892aacfdb2"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Commerce—</text><subparagraph commented="no" display-inline="no-display-inline" id="id47ae99ed422341138b42a956a17088bd"><enum>(A)</enum><text display-inline="yes-display-inline">in collaboration with relevant agencies that hold relevant fisheries data, such as State agencies, Regional Fishery Management Councils, and the applicable Interstate Marine Fisheries Commission, shall establish a process to file, process, and verify claims for purposes of making payments from the Fund; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id311f646cc51f451c8b7ade6f07949508"><enum>(B)</enum><text display-inline="yes-display-inline">shall make payments to eligible recipients from the Fund—</text><clause commented="no" display-inline="no-display-inline" id="idd48fd170a20a40be9cfa133e386019c0"><enum>(i)</enum><text display-inline="yes-display-inline">in accordance with this section; and </text></clause><clause commented="no" display-inline="no-display-inline" id="id88d353c2628c4959a0c31b3ed30f1442"><enum>(ii)</enum><text display-inline="yes-display-inline">in consultation with Interstate Marine Fisheries Commissions, at the discretion of the Secretary of Commerce. </text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id394b064e2a914e8bae2f4e158e60bdbb"><enum>(2)</enum><header>Restrictions</header><text>The Secretary of Commerce may not make a payment from the Fund—</text><subparagraph commented="no" display-inline="no-display-inline" id="id736307b70b11450aa45a255c50cc5845"><enum>(A)</enum><text display-inline="yes-display-inline">for gear loss or damage;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id46497ee3b83147f28a314b0d6ec8f3b6"><enum>(B)</enum><text display-inline="yes-display-inline">for loss caused by the negligence or fault of the claimant; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id714f6218ab044dda8b4794e4a201a3f7"><enum>(C)</enum><text>for loss caused by events or occurrences unrelated to planning, pre-construction survey, construction, maintenance, operation, or decommissioning of offshore wind energy projects on the outer Continental Shelf; or </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id69af89e80dea4ac8b20778f2243926bf"><enum>(D)</enum><text>for any portion of loss that may be compensated by insurance. </text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id2cbe8413ec7547b484c4ebafc11cec8f"><enum>(d)</enum><header display-inline="yes-display-inline">Payment amounts and mitigation grants</header><paragraph commented="no" display-inline="no-display-inline" id="idcc31df747fe24a3bb7ad931ddc7023d6"><enum>(1)</enum><header display-inline="yes-display-inline"><italic></italic>In general</header><text>Payments made, including direct payments, under this section from the Fund shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="id1fa8f46d9d504a58991a8d9dc674c096"><enum>(A)</enum><text>be based on the scope of the verified claim;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id61a42fa5bbf946dd8cd278b90b695473"><enum>(B)</enum><text>be fair and provided efficiently and in a transparent manner; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2bc2b6bf57994b648647f6d30c78b8d6"><enum>(C)</enum><text>if the eligible recipient receiving the payment has or will receive direct compensation for the verified claim pursuant to a community benefit agreement or other agreement between such eligible recipient and a holder of a lease, easement, or right-of-way, be reduced by an amount that is equal to the amount of such direct compensation.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id56ff9faf031e4415a32d91ae342e975f"><enum>(2)</enum><header>Mitigation grants</header><text>If the Secretary of Commerce determines that there are sufficient amounts in a geographic area account of the Fund, as described in subsection (a)(6), to provide payments for all verified claims at any given time, the Secretary may use not more than $20,000,000 of amounts in the geographic area account of the Fund that are in excess of the amount necessary to provide payments for all verified claims to provide grants to eligible recipients, and other entities determined appropriate by the Secretary, to mitigate the potential effects of development of an offshore wind energy project, including by paying for gear modifications, navigation technology improvements, and other measures, including training, to enhance safety. </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id333d255ba55848b0b26c1f0a17f7c553"><enum>(e)</enum><header display-inline="yes-display-inline">Advisory group</header><paragraph id="idbee8f397dec342f2b9f525e4068c61fa"><enum>(1)</enum><header>Establishment</header><text>The Secretary of Commerce, in coordination with the Secretary of the Treasury, shall establish and convene an advisory group not less frequently than twice a year that shall provide recommendations on the development and administration of this section.</text></paragraph><paragraph id="id79b59068148a4b0490db8fe2ec3d4deb"><enum>(2)</enum><header>Membership</header><text>The advisory group established under paragraph (1) shall—</text><subparagraph id="id85301665e4b14ac1a8955416065d061a"><enum>(A)</enum><text>be comprised of individuals—</text><clause id="id1770eab45a424c719895e45b3aa7e595"><enum>(i)</enum><text>appointed by the Secretary of Commerce; and</text></clause><clause id="iddcff57e547144771bc50120d661293d5"><enum>(ii)</enum><text>representing the geographic diversity of areas impacted by the development of offshore wind energy projects; and</text></clause></subparagraph><subparagraph id="idbc0953f4629447d8bea67cf47ca17512"><enum>(B)</enum><text>include representatives from—</text><clause id="idd8fd0e22838e44a199ef0c1b254a0d91"><enum>(i)</enum><text>recreational fishing interests;</text></clause><clause id="idfdc00ba48aa34b0bae5b2d483f98fb48"><enum>(ii)</enum><text>commercial fishing interests;</text></clause><clause id="id46a14dd442e14425b3d017c48f7de566"><enum>(iii)</enum><text>Tribal fishing interests;</text></clause><clause id="id4f5614d77bfc490182b726a12b5d0c47"><enum>(iv)</enum><text>fish processing interests;</text></clause><clause id="id21f51b017bd74be4bc065739f86cc44b"><enum>(v)</enum><text>the National Marine Fisheries Service;</text></clause><clause commented="no" display-inline="no-display-inline" id="id63832df9873e4a48947d2918d5bad9f5"><enum>(vi)</enum><text>the Department of the Interior;</text></clause><clause commented="no" display-inline="no-display-inline" id="id91b946e613ee4f959d3011d4b126d1b0"><enum>(vii)</enum><text>State agencies;</text></clause><clause id="idabeea3e10e89414a8b97a15e471e2169"><enum>(viii)</enum><text>the fisheries science community; </text></clause><clause commented="no" display-inline="no-display-inline" id="idfcc1cd4f38a54a82ae03fd739ec5181a"><enum>(ix)</enum><text display-inline="yes-display-inline">the offshore wind industry; and </text></clause><clause id="idc3c13e5a2c9241a8adeaeb8853a70986"><enum>(x)</enum><text>other fields of expertise necessary to effectively develop and administer this section, as determined by the Secretary of Commerce.</text></clause></subparagraph></paragraph><paragraph id="idbdd16364fdcd4ac3928fbed58f0f92b3"><enum>(3)</enum><header>Travel expenses</header><text>The Secretary of Commerce may provide amounts to any member of the advisory group to pay for travel expenses, including per diem in lieu of subsistence, at rates authorized for an employee of an agency under section 5703 of title 5, United States Code, while away from the home or regular place of business of the member in the performance of the duties of the advisory group. </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id2e4f518cb74240b3aa641391430e8b3b"><enum>(f)</enum><header display-inline="yes-display-inline">Annual report</header><text>The Secretary of Commerce shall submit to Congress, and make publicly available, an annual report on activities carried out under this section, including a description of claims filed and the amount of payments and grants provided. </text></subsection><subsection commented="no" display-inline="no-display-inline" id="id168eb1726b4c407b8a1a9e71c660c84e"><enum>(g)</enum><header display-inline="yes-display-inline">Insufficient funds</header><paragraph commented="no" display-inline="no-display-inline" id="idfe2a3164368846d7ac70b77734d28066"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">If the Secretary, in coordination with the Secretary of Commerce, determines that a geographic area account of the Fund does not contain a sufficient amount to provide payments for all verified claims under this section, the Secretary may, not more than once each calendar year, require each holder of an offshore wind energy lease located within the area covered by the geographic area account to pay an amount specified by the Secretary in accordance with paragraph (2), which shall be deposited into such geographic area account of the Fund. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0c68cd615e474acda717e516b2def46b"><enum>(2)</enum><header>Limit</header><text>No holder of an offshore wind energy lease shall be required to pay an amount under paragraph (1) that is in excess of $3 per acre per year of the leased area.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id4ea0f541efc249caa655cbc2b2a0db47"><enum>(h)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idf44ae0025e4141f6b1921d91f3cb7b59"><enum>(1)</enum><header>Eligible recipient</header><text>The term <term>eligible recipient</term> means—</text><subparagraph id="id83285b7e9fc243169982cb766932655f"><enum>(A)</enum><text>a community, stakeholder, or Tribal interest—</text><clause id="id4e4c5048be334c38b52bc9df5690a98e"><enum>(i)</enum><text>that uses a geographic space of an offshore wind energy lease area, or uses resources harvested from a geographic space of an offshore wind energy lease area; </text></clause><clause id="idd73f9523ccbb4ce382c3171ac38ad5da"><enum>(ii)</enum><text>for which such use is directly and adversely impacted by the development of an offshore wind energy project located in such area; and</text></clause><clause id="id3b9d4aac6a954a8492d5c447b9c4aa74"><enum>(iii)</enum><text>located in the United States, including the territories of the United States; or</text></clause></subparagraph><subparagraph id="id78548898f9a44b718afa18aa2a19349c"><enum>(B)</enum><text>a regional association, cooperative, nonprofit organization, commission, or corporation that—</text><clause id="ideb9a4f4450c14687a148274225fb3cde"><enum>(i)</enum><text>serves, and acts on behalf of, a community, stakeholder, or Tribal interest described in paragraph (1); and </text></clause><clause id="idde016549fa5b4805b37fcd8d9be272b6" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text>is located in the United States, including the territories of the United States.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id24833438a5214acb8bc1bf47f93fd88e"><enum>(2)</enum><header>Interstate Marine Fisheries Commission</header><text display-inline="yes-display-inline">The term <term>Interstate Marine Fisheries Commission</term> means the Atlantic States Marine Fisheries Commission, the Gulf States Marine Fisheries Commission, or the Pacific States Marine Fisheries Commission.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id4672552D7923413BAC44A38D3532B58D"><enum>202.</enum><header>Fishermen's Contingency Fund</header><subsection commented="no" display-inline="no-display-inline" id="id49866d35d7fd414e84832d873cf545f2"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text>Section 401 of the Outer Continental Shelf Lands Act Amendments of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/43/1841">43 U.S.C. 1841</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idf110ab9aa3884291872b40f50eff84ca"><enum>(1)</enum><text display-inline="yes-display-inline">by striking the section heading and designation and all that follows through <quote>term—</quote> in electric energy solely by the use, as the only energy source, of wind; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id016850dee80043058fe5ad37d37d7402"><enum>(B)</enum><text display-inline="yes-display-inline">is located on the outer Continental Shelf.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id6434f02bbfea4f8e9ca8ba5acadbfe8a" commented="no"><enum>(b)</enum><header>Payments by leaseholders</header><text>Section 402(b)(1) of the Outer Continental Shelf Lands Act Amendments of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/43/1842">43 U.S.C. 1842(b)(1)</external-xref>) is amended, in the first sentence—</text><paragraph commented="no" display-inline="no-display-inline" id="idcefc6681eaa74f5896cf2e9ad6395994"><enum>(1)</enum><text>by striking <quote>Act and each holder</quote> and inserting <quote>Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1331">43 U.S.C. 1331 et seq.</external-xref>), and each holder</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" Shelf Lands Act Amendments of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/43/1843">43 U.S.C. 1843</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id20472FAB109643E4BB93BDB16360B40E"><enum>(1)</enum><text>in subsection (a)(2), by inserting <quote>and offshore wind energy site characterization and assessment activities,</quote> after <quote>production activities,</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2A55C70C4CA548E99DA8CA0795B5B1E9"><enum>(2)</enum><text>in subsection (c)(1), in the first sentence, by inserting <quote>, offshore wind energy site characterization and assessment activities, or activities authorized under section 8(p) of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1337">43 U.S.C. 1337(p)</external-xref>)</quote> after <quote>production activities</quote>.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id97b35c18c22b4d119dd284291f8d2d07"><enum>(d)</enum><header>Disbursement of payments</header><text>Section 403(c) of the Outer Continental Shelf Lands Act Amendments of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/43/1843">43 U.S.C. 1843(c)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD2ED7DE55BB049F38F6FD8EF7B7EF346"><paragraph commented="no" display-inline="no-display-inline" id="id22e488e8066147bda26dcb30fdebd830"><enum>(3)</enum><header>Disbursement allocation</header><text>The Secretary shall ensure—</text><subparagraph commented="no" display-inline="no-display-inline" id="id5840358ab7bf41fea14d0b804d89ad8d"><enum>(A)</enum><text display-inline="yes-display-inline">that amounts deposited in the Fund for oil and gas activities shall only be disbursed to compensate claims for oil and gas activities; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc1b79ac697c24378b078eafe7acc4b28"><enum>(B)</enum><text display-inline="yes-display-inline">that amounts deposited in the Fund for offshore wind energy activities shall only be disbursed to compensate claims for offshore wind energy activities.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="id59b8c22596494f40ace3b10f5a37096b"><enum>(e)</enum><header>Burden of proof</header><text>Section 404 of the Outer Continental Shelf Lands Act Amendments of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/43/1844">43 U.S.C. 1844</external-xref>) is amended, in the matter preceding paragraph (1), by inserting <quote>, or offshore wind energy site characterization and assessment activities, as applicable,</quote> after <quote>production</quote>.</text></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="idc7a58980601947ebb376d125cabcbc5f"><enum>203.</enum><header>Grant program for research on the impacts of offshore wind development on fisheries resources</header><subsection commented="no" display-inline="no-display-inline" id="id63ef65d6eb784098a5b357c127b01517"><enum>(a)</enum><header display-inline="yes-display-inline">Grant program</header><paragraph commented="no" display-inline="no-display-inline" id="idf1d41fda48ff4ac790a4daba38d26d41"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary of Commerce, in consultation with the Secretary of the Interior, shall establish and carry out a program to award grants, on a competitive basis, to eligible entities to enable such entities to carry out research that contributes to an understanding of the impacts of all stages of offshore wind energy planning, construction, operation, and decommissioning on fisheries resources, including marine and coastal ecosystems, wildlife, and habitat.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id53592fddad7c42c2bf9ef28f69dbfe6c"><enum>(2)</enum><header>Reservation</header><text>From the amounts appropriated to carry out this section for a fiscal year, the Secretary of Commerce shall reserve 2 percent for use by Indian Tribes and Tribal organizations.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id3f231c98fcb54310af1f328100256e7b"><enum>(b)</enum><header>Applications</header><paragraph id="idf87f4c5e0d4a4c10b95b815d7395d4f5"><enum>(1)</enum><header>In general</header><text>An eligible entity, as determined by the Secretary of Commerce, that desires to receive a grant under this section shall submit an application to the Secretary of Commerce at such time and in such form as the Secretary may require, including a demonstration of how the eligible entity will use the grant funds to further understanding of the impacts of offshore wind energy development on fisheries resources.</text></paragraph><paragraph id="idfa921e952f24409381f2d10fb9a0c0aa"><enum>(2)</enum><header>Priority for inclusion of fishermen; considerations</header><text>The Secretary of Commerce shall, in awarding grants under this section—</text><subparagraph commented="no" display-inline="no-display-inline" id="idb3283ff1714040549439fdf29a910b1c"><enum>(A)</enum><text display-inline="yes-display-inline">give priority to eligible entities that demonstrate engagement with, and collection of input from, the fishing community in the grant development process and include fishermen as active contributors in any research supported under this section; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id95c664b9590141af948e3ea58a7c0b11"><enum>(B)</enum><text display-inline="yes-display-inline">to the extent practicable, consider eligible entities that serve areas that are scheduled for offshore wind development. <italic></italic></text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id9584e490f6fb4018b43434bf3bd582d9"><enum>(c)</enum><header>Eligible uses of funds</header><text>An eligible entity that receives a grant under this section shall use the grant funds for research on any of the following: </text><paragraph id="id3f1f2c8ea4464096ad87907189d00d68"><enum>(1)</enum><text>Understanding the effects of electric and magnetic forces, habitat changes, vibrations, noise, and thermal radiation on any fish populations.</text></paragraph><paragraph id="id8d3c0fc7e55044558bae06328ba6bb0a"><enum>(2)</enum><text>Conducting planning or analysis on how to adapt fisheries surveys to the presence of wind farms.</text></paragraph><paragraph id="idf8c933fd6c10406e953d26631a11782f"><enum>(3)</enum><text>Establishing baseline conditions for benthic habitat and conducting monitoring throughout offshore wind energy operation.</text></paragraph><paragraph id="id6dbc9151bf2e468386d458769a37aa97"><enum>(4)</enum><text>Increasing automated or indirect data collection from fishing vessels.</text></paragraph><paragraph id="idb9b85027fee244c7ab54b091551c4168"><enum>(5)</enum><text>Studying oceanographic changes due to the presence of offshore wind infrastructure, including turbulence and surface wind reduction. </text></paragraph><paragraph id="iddebca99083a442109f4311ebe4796f59"><enum>(6)</enum><text>Studying the socioeconomic impacts of wind energy development on fishermen and their communities, including ability to adapt, resilience to change, and economic impacts. </text></paragraph><paragraph id="id2793348a2af74e52b2d15810065e31ea"><enum>(7)</enum><text>Social science research on how fishermen and communities will be impacted by offshore wind energy development.</text></paragraph><paragraph id="idfb64c30df0f44da39ddb69b7e13e7268"><enum>(8)</enum><text>Examining potential uses of offshore wind turbines, pilings, mooring lines, inter-array cables, transmission cables, and other hard structures as data collection points for scientific research, infrastructure for aquaculture operations, or for other uses.</text></paragraph><paragraph id="id74101a98209c4e0d8cc9d770c489c368"><enum>(9)</enum><text>Finding pathways and opportunities for skill transferability for fishermen to other industries.</text></paragraph><paragraph id="idc785409c2f0c4da5814023be2c5ef3e1"><enum>(10)</enum><text>Infrastructure designs that can facilitate and support biodiversity in the area of the offshore wind project.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idab42418f5e4f4a0d8a4f2b62d94bae43"><enum>(11)</enum><text>Cumulative impacts on highly migratory species from development of offshore wind energy facilities in multiple lease areas in migratory pathways. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb5fe1a998cec448d8de7a4ba5535bf7b"><enum>(12)</enum><text>Understanding impacts from offshore wind energy development on species and oceanographic processes outside the boundaries of wind energy areas. </text></paragraph><paragraph id="id150a05598b504e82abe051a81e48ea3f"><enum>(13)</enum><text>Other topics as recommended—</text><subparagraph commented="no" display-inline="no-display-inline" id="id75dc2c468ff744b9a4515acfb4bbd699"><enum>(A)</enum><text>in consultation with the Standing Committee on Offshore Wind Energy and Fisheries at the National Academies; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id96f2882f18fe413e8f302632aa563b9c"><enum>(B)</enum><text display-inline="yes-display-inline">by studies and reports on offshore wind energy impacts to fisheries resources, including the Fisheries and Offshore Wind Interactions: Synthesis of Science technical memo produced by the Responsible Offshore Development Alliance, the Bureau of Ocean Energy Management, the National Oceanic and Atmospheric Administration, and the Northeast Fisheries Science Center, and other studies and reports of the Bureau of Ocean Energy Management and the National Oceanic and Atmospheric Administration. </text></subparagraph></paragraph></subsection><subsection id="id4c74551fa7d44e978d7765680c4379a2"><enum>(d)</enum><header>Coordination; accessibility of data</header><paragraph commented="no" display-inline="no-display-inline" id="id73142e38aa44435c979d1bddf5714595"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Commerce shall encourage eligible entities that receive a grant under this section to, when practicable and appropriate (as determined by the Secretary of Commerce)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idfb70532f916540f6a7487162cdf6e6ae"><enum>(A)</enum><text display-inline="yes-display-inline">coordinate with the Integrated Ocean Observing System and the Regional Wildlife Science Collaborative for Offshore Wind in conducting research described in subsection (c); and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id30fb82c17df94766a023ef532d7a022d"><enum>(B)</enum><text display-inline="yes-display-inline">make data generated from such research accessible through the Integrated Ocean Observing System.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd3609f0dba3043628fe8b97eb63c8487"><enum>(2)</enum><header>Public accessibility</header><text>An eligible entity that receives a grant under this section shall make data generated from conducting research described in subsection (c) publicly accessible, to the extent consistent with other laws. </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ida96321f74a3e472b9db8bad50c34f76b"><enum>(e)</enum><header>Reporting</header><paragraph commented="no" display-inline="no-display-inline" id="idd74514fe82374f6aaa2e65aa104fc16c"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">An eligible entity that receives a grant under this section shall submit to the Secretary of Commerce a report, at such time and in such form as the Secretary may require, on the results of the use of the grant. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd319b8a6a3904101894f5da245265e07"><enum>(2)</enum><header>Content</header><text display-inline="yes-display-inline">Each report submitted under paragraph (1) shall include any relevant data requested by the Secretary for purposes of tracking the effectiveness of the program established under this section. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida31a8c3f94d34244a847b63c6980066d"><enum>(3)</enum><header>Public availability</header><text>The Secretary of Commerce shall make each report submitted under paragraph (1) publicly available.</text></paragraph></subsection><subsection id="ide56ef170db9d4790a42e81c03d84d033" commented="no" display-inline="no-display-inline"><enum>(f)</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $30,000,000 for each of fiscal years 2025 through 2035, to remain available until expended. </text></subsection></section><section id="idc55c758c02e44e18bca621f300d9a549"><enum>204.</enum><header>Offshore Wind and Fisheries Coexistence Fund</header><subsection commented="no" display-inline="no-display-inline" id="id6b72b469f3d1429caffe093f33af89f7"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment of fund</header><paragraph commented="no" display-inline="no-display-inline" id="id7664EA0ADC214C51AC1717B052920527"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>There is established in the Treasury of the United States a fund, to be known as the <quote>Offshore Wind and Fisheries Coexistence Fund</quote> (referred to in this section as the <quote>Fund</quote>), to be administered by the Administrator of the National Oceanic and Atmospheric Administration (referred to in this section as the <quote>Administrator</quote>).</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="idDFE43D8B1B774422BA7779D89AE35EA4"><enum>(2)</enum><header>Deposits</header><text>The Fund shall consist of such amounts as are appropriated to the Fund under subsection (c).</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="id51B98D3E42DC4A23BDD1D5FF1FD24911"><enum>(3)</enum><header>Use</header><text>Amounts in the Fund shall be used to carry out subsection (b). </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id9D7BE1B8A74448D392B1A84D8BAE343F"><enum>(b)</enum><header display-inline="yes-display-inline">Grant program</header><paragraph commented="no" display-inline="no-display-inline" id="id0d98979350ea464385589e9d8ac245f6"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Administrator, in consultation with the Director of the Bureau of Ocean Energy Management, shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="id4f68fe3089864ec58c66f658ce3a9ae0"><enum>(A)</enum><text display-inline="yes-display-inline">use amounts in the Fund to award grants for research and development of technologies that support the coexistence of offshore wind energy development and other ocean users, including fishing gear and vessel modifications, modifications or updates to radar equipment, and safety equipment or trainings; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5359ac6059b54fee8f427bc28b6e1e1e"><enum>(B)</enum><text display-inline="yes-display-inline">in awarding grants under subparagraph (A), prioritize proposals that include coordination and collaboration between different ocean stakeholders and users, including between fishermen and developers. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4444D70588DC48D2879599FD5798EBBB"><enum>(2)</enum><header>Reservation</header><text>From the amounts appropriated to carry out this section for a fiscal year, the Administrator shall reserve 2 percent for use by Indian Tribes and Tribal organizations. </text></paragraph></subsection><subsection id="id9151e5d8fdac4780ad0c6b33af3eba95" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header>Authorization of
