<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>2d Session</session><legis-num>S. 5430</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20241205">December 5, 2024</action-date><action-desc><sponsor name-id="S362">Mr. Kaine</sponsor> (for himself and <cosponsor name-id="S327">Mr. Warner</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of the Interior to issue a right-of-way for an emergency exit on certain National Park Service land in the State of Virginia, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H65C05284DFAF4F7583EDC54D9F4A812A"><section section-type="section-one" id="H509C0CA933B046C5BCE8C8219C776466"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Blue Ridge Fire Safety Act of 2024</short-title></quote>.</text></section><section section-type="subsequent-section" id="H7D6A9A71702C405FB8748765C997BD6E"><enum>2.</enum><header>Right-of-way for emergency exit, Blue Ridge Parkway</header><text display-inline="no-display-inline">Section 2 of the Act of June 30, 1936 (49 Stat. 2041, chapter 883; 54 Stat. 250, chapter 277; <external-xref legal-doc="usc" parsable-cite="usc/16/460a-3">16 U.S.C. 460a–3</external-xref>), is amended—</text><paragraph id="HC5B9E95FA87B41CE97F1F83A7A5B0DE3"><enum>(1)</enum><text>by striking <quote>Secretary of the Interior may issue</quote> and inserting the following: “Secretary of the Interior— </text><quoted-block style="OLC" display-inline="no-display-inline" id="HBE921C97F12D4DA68FDBAD6F95E75D47"><paragraph id="H038EFE907E8D4FFA80A738525264FBA4"><enum>(1)</enum><text display-inline="yes-display-inline">may issue</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc9e75d02c5f04075b6512f4cdc40d0ca"><enum>(2)</enum><text>by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="H9BE4A8D4B85E46C1B8B0E5ED354E9138"><enum>(3)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="H3A6AA9A985B6417BA9BB9C39D0DFD2C1"><paragraph id="H5C53F91B8EB243C983F963A7892EA226"><enum>(2)</enum><text display-inline="yes-display-inline">shall issue the right-of-way generally depicted as <quote>Proposed Egress</quote> on the map entitled <quote>Proposed Wintergreen Emergency Egress Near Milepost 9.6</quote>, numbered 601/194,694, and dated September 2024, if the Secretary certifies that—</text><subparagraph commented="no" display-inline="no-display-inline" id="idf758f6683912487e9af0c1c5ce57de77"><enum>(A)</enum><text display-inline="yes-display-inline">an evaluation has been completed of alternatives to the right-of-way for egress that do not cross Federal land that includes evaluating whether existing trails can be converted to roads; </text></subparagraph><subparagraph id="idA0295017727048F4870F6E98FE4DFB02" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>an analysis of expected fire ecology behavior in the event of a fire emergency has been completed with respect to the right-of-way; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd01145abc74a417da0eaef5eaa76a6ea"><enum>(C)</enum><text display-inline="yes-display-inline"> any required reviews with respect to the right-of-way have been completed in accordance with—</text><clause commented="no" display-inline="no-display-inline" id="ide01424179378407b9cdcc58f57fbbc19"><enum>(i)</enum><text display-inline="yes-display-inline">the <act-name parsable-cite="NEPA69">National Environmental Policy Act of 1969</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>); and </text></clause><clause commented="no" display-inline="no-display-inline" id="idac11f2a5e4644d28b198c2d29659af82"><enum>(ii)</enum><text display-inline="yes-display-inline">division A of subtitle III of title 54, United States Code.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
