legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151(c)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HBF4037F28D66432B8E78073B25359CFD"><subsection id="HFAE7EE30CD034F75B944FDFBBCDC5394"><enum>(c)</enum><header>Worldwide level of family-Sponsored immigrants</header><paragraph display-inline="no-display-inline" id="HB6CF1F322071423FAC15B5B5D8F86C81"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The worldwide level of family-sponsored immigrants under this subsection for a fiscal year is equal to the sum of—</text><subparagraph id="H0D488F22BD7A484CB0D1B031706F6062"><enum>(A)</enum><text>480,000;</text></subparagraph><subparagraph id="HDE49F35C87D843D4900184E97D826508"><enum>(B)</enum><text>the number computed under paragraph (2); and</text></subparagraph><subparagraph id="HDFC2470D63FC46209018B27A87602DD9"><enum>(C)</enum><text>the number computed under paragraph (3).</text></subparagraph></paragraph><paragraph display-inline="no-display-inline" id="HCF3038AE8508411D8B395397AEACEA9E"><enum>(2)</enum><header>Unused visa numbers from previous fiscal year</header><text>The number computed under this paragraph for a fiscal year is the difference, if any, between—</text><subparagraph id="H3FE5A905C618492AB03A2146EEE11FE8"><enum>(A)</enum><text display-inline="yes-display-inline">the worldwide level of family-sponsored immigrant visas established for the previous fiscal year; and</text></subparagraph><subparagraph id="HCFDC3A0B03AE4C0DA5A7519127657CDA"><enum>(B)</enum><text>the number of visas issued under section 203(a), subject to this subsection, during the previous fiscal year.</text></subparagraph></paragraph><paragraph display-inline="no-display-inline" id="HBAEBC65E8B8F42B6A44C0DA644D3FE26"><enum>(3)</enum><header>Unused visa numbers from fiscal years 1992 through 2023</header><text display-inline="yes-display-inline">The number computed under this paragraph is the difference, if any, between—</text><subparagraph id="HE4CBBFC41D614388AEE48751DDF594EB"><enum>(A)</enum><text display-inline="yes-display-inline">the difference, if any, between—</text><clause id="H507EF85E91B7470993EDD154353E6EA0"><enum>(i)</enum><text display-inline="yes-display-inline">the sum of the worldwide levels of family-sponsored immigrant visas established for fiscal years 1992 through 2023; and</text></clause><clause id="H37BC096310F247EB88724E5F811B5565"><enum>(ii)</enum><text>the number of visas issued under section 203(a), subject to this subsection, during such fiscal years; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H36700DBCCD7E4C04876199A2822962D3"><enum>(B)</enum><text display-inline="yes-display-inline">the number of unused visas from fiscal years 1992 through 2023 that were issued after fiscal year 2023 under section 203(a), subject to this subsection.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H7CE1E562911C4DA0B78A6F31A4093D05"><enum>(b)</enum><header>Worldwide level of employment-Based immigrants</header><text>Section 201(d) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151(d)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" id="H8CCBF69CF1BB4B51994708126BA79005"><subsection id="H1D0459F256D94B5187AE18E09B740599"><enum>(d)</enum><header>Worldwide level of employment-Based immigrants</header><paragraph id="H6BC97EE9BE054C069FC2942C1C921EFB"><enum>(1)</enum><header>In general</header><text>The worldwide level of employment-based immigrants under this subsection for a fiscal year is equal to the sum of—</text><subparagraph id="HD49EE41C41794B79947C5C888C43F22B"><enum>(A)</enum><text>140,000;</text></subparagraph><subparagraph id="H66AAC00A52754F5A9658918EBFFA7955"><enum>(B)</enum><text>the number computed under paragraph (2); and</text></subparagraph><subparagraph id="H6CC3E006DAFD46C181FC833ED3E67147"><enum>(C)</enum><text>the number computed under paragraph (3).</text></subparagraph></paragraph><paragraph id="H04FFCC51F4D94D72815F91257244FC61"><enum>(2)</enum><header>Unused visa numbers from previous fiscal year</header><text>The number computed under this paragraph for a fiscal year is the difference, if any, between—</text><subparagraph id="H3131A17BD7644EC2BC38D26128ACAA87"><enum>(A)</enum><text>the worldwide level of employment-based immigrant visas established for the previous fiscal year; and</text></subparagraph><subparagraph id="H3132B9E4095D4002900DED34C9B67C7A"><enum>(B)</enum><text>the number of visas issued under section 203(b), subject to this subsection, during the previous fiscal year.</text></subparagraph></paragraph><paragraph id="H5AB336AE03B24B05891DF94AE35528C0"><enum>(3)</enum><header>Unused visa numbers from fiscal years 1992 through 2023</header><text display-inline="yes-display-inline">The number computed under this paragraph is the difference, if any, between—</text><subparagraph id="H5B110CA5206B437E8BC032742C46D356"><enum>(A)</enum><text display-inline="yes-display-inline">the difference, if any, between—</text><clause id="H319082EABBDF45B1860E054B5911387D"><enum>(i)</enum><text>the sum of the worldwide levels of employment-based immigrant visas established for each of fiscal years 1992 through 2023; and</text></clause><clause id="HF49B0657AAE34E9581F540929F71189A"><enum>(ii)</enum><text>the number of visas issued under section 203(b), subject to this subsection, during such fiscal years; and</text></clause></subparagraph><subparagraph id="H62E47D64EA8F404BB394E5A388A878E8"><enum>(B)</enum><text>the number of unused visas from fiscal years 1992 through 2023 that were issued after fiscal year 2023 under section 203(b), subject to this subsection.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" id="H3006B01085F94184B1EF4C319415E911"><enum>(c)</enum><header>Aliens not subject to direct numerical limitations</header><text>Section 201(b) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151(b)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H35F7391A7D124CC4BE95C16DACABBE50"><paragraph commented="no" id="H59FA626F917A4B9F9F2CC302F719EE53"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HEE5046C949FB4F67B9C7ED2646106CB5"><enum>(A)</enum><text>Aliens who are beneficiaries (including derivative beneficiaries) of approved immigrant petitions bearing priority dates more than ten years prior to the alien's application for admission as an immigrant or adjustment of status.</text></subparagraph><subparagraph commented="no" id="HFCD73D5CCD7E49798E1BA394EC0B0557" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">Aliens described in section 203(d).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="H44D5FB9030B645EFB0D55C0E2D636596"><enum>(d)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall take effect on the date which is 60 days after the date of the enactment of this Act.</text></subsection></section><section id="H33191C0D88864880993976CA37B14A13"><enum>102.</enum><header>Reclassification of spouses, permanent partners, and minor children of legal permanent residents as immediate relatives</header><subsection id="H72C3CA9CF3164AB0BB6D07DE94D854A6"><enum>(a)</enum><header>In general</header><text>Section 201(b)(2) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151(b)(2)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H655328C00A564A0F8749CBE7CE757DE2"><paragraph id="H603CAA79953F468DBAEBB4CDA125B006"><enum>(2)</enum><header>Immediate relative</header><subparagraph id="H3A18671EB88F456A81EDAD2D6F60E621"><enum>(A)</enum><header>In general</header><clause id="HFD05AB216F354617BB3A7A48C049F1BC"><enum>(i)</enum><header>Immediate relative defined</header><text>In this subparagraph, the term <term>immediate relative</term> means a child, spouse, permanent partner, or parent of a citizen of the United States or a child, spouse, or permanent partner of a lawful permanent resident (and for each family member of a citizen or lawful permanent resident under this subparagraph, such individual’s spouse, permanent partner, or child who is accompanying or following to join the individual), except that, in the case of parents, such citizens shall be at least 21 years of age.</text></clause><clause id="HC46FD52B060B407AABFB92EAFDBD9D3C"><enum>(ii)</enum><header>Previously issued visa</header><text>Aliens admitted under section 211(a) on the basis of a prior issuance of a visa under section 203(a) to their accompanying parent who is an immediate relative.</text></clause><clause id="H1B14C78150C9473A8ECC2C536A78C47A"><enum>(iii)</enum><header>Parents and children</header><text>An alien who was the child or parent of a citizen of the United States or a child of a lawful permanent resident at the time of the citizen’s or resident’s death if the alien files a petition under section 204(a)(1)(A)(ii) within 2 years after such date or prior to reaching 21 years of age.</text></clause><clause id="HFD42FE42329A461D93E12CC04519F093"><enum>(iv)</enum><header>Spouse or permanent partner</header><text display-inline="yes-display-inline">An alien who was the spouse or permanent partner of a citizen of the United States or lawful permanent resident for not less than 2 years at the time of the citizen’s or resident’s death or, if married for less than 2 years at the time of the citizen’s or resident’s death, proves by a preponderance of the evidence that the marriage or permanent partnership was entered into in good faith and not solely for the purpose of obtaining an immigration benefit and was not legally separated from the citizen or resident (or, in the case of a permanent partnership, whose permanent partnership was not terminated) at the time of the citizen’s or resident’s death, and each child of such alien, shall be considered, for purposes of this subsection, an immediate relative after the date of the citizen’s or resident’s death if the spouse or permanent partner files a petition under section 204(a)(1)(A)(ii) before the date on which the spouse or permanent partner remarries or enters a permanent partnership with another person.</text></clause><clause id="HEDBA79D2ACFB4601A76EDF5F3F41342C"><enum>(v)</enum><header>Special rule</header><text>For purposes of this subparagraph, an alien who has filed a petition under clause (iii) or (iv) of section 204(a)(1)(A) remains an immediate relative if the United States citizen or lawful permanent resident spouse, permanent partner, or parent loses United States citizenship or residence on account of the abuse.</text></clause></subparagraph><subparagraph id="H7775F54CB0554AE2AED4D90871917E94"><enum>(B)</enum><header>Birth during temporary visit abroad</header><text>Aliens born to an alien lawfully admitted for permanent residence during a temporary visit abroad.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H594C1E567F614DC5856C342086C7DF35"><enum>(b)</enum><header>Allocation of immigrant visas</header><text>Section 203(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(a)</external-xref>) is amended—</text><paragraph id="HE1D0773B108443298C97EF4D8619DE89"><enum>(1)</enum><text>in paragraph (1), by striking <quote>23,400</quote> and inserting <quote>127,200</quote>;</text></paragraph><paragraph id="H59ADD57A18FF470CB2ED7F2EEA4F5BE8"><enum>(2)</enum><text>by striking paragraph (2) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H73B31812826C452F82AF32C7A8380051"><paragraph id="HA3C340E099334EDD9D53BB3215B06853"><enum>(2)</enum><header>Unmarried sons without permanent partners and unmarried daughters without permanent partners of permanent resident aliens</header><text>Qualified immigrants who are the unmarried sons without permanent partners or unmarried daughters without permanent partners (but are not the children) of an alien lawfully admitted for permanent residence shall be allocated visas in a number not to exceed 80,640, plus any visas not required for the class specified in paragraph (1).</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H4F0210DE5C1A4B7A8B3E098957C41263"><enum>(3)</enum><text>in paragraph (3), by striking <quote>23,400</quote> and inserting <quote>80,640</quote>; and</text></paragraph><paragraph id="H433E2D9C37074A159DB5477E0A71B5B4"><enum>(4)</enum><text>in paragraph (4), by striking <quote>65,000</quote> and inserting <quote>191,520</quote>.</text></paragraph></subsection><subsection id="H849DE71C6F8D44C6AAF4CFEEDF67EDC3"><enum>(c)</enum><header>Technical and conforming amendments</header><paragraph id="H0538E33C697E4132BAAE9975566B0F9F"><enum>(1)</enum><header>Rules for determining whether certain aliens are immediate relatives</header><text>Section 201(f) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151(f)</external-xref>) is amended—</text><subparagraph id="HC6CDCA4525414F8DBEDEDF8C2CE784F2"><enum>(A)</enum><text>in paragraph (1), by striking <quote>paragraphs (2) and (3),</quote> and inserting <quote>paragraph (2),</quote>;</text></subparagraph><subparagraph id="H3606A64BA3AB48B1BCB228C558609967"><enum>(B)</enum><text>by striking paragraph (2);</text></subparagraph><subparagraph or 5 percent</quote>.</text></section><section id="HB5A1FD500E64466D8607F259EAF530DB"><enum>104.</enum><header>Promoting family unity</header><subsection id="H5139EF194E174451906C448ABE9D7E8F"><enum>(a)</enum><header>Repeal of three- and ten-Year and permanent bars</header><text display-inline="yes-display-inline">Section 212(a)(9) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(9)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HA262AEA8D2EC418287200F3F681755E9"><paragraph id="HEF858A337697461B86F87B8C401BB3BA"><enum>(9)</enum><header>Aliens previously removed</header><subparagraph id="H27CE8537BA4C4A04A0219847DB187A9E"><enum>(A)</enum><header>Arriving alien</header><text display-inline="yes-display-inline">Any alien who has been ordered removed under section 235(b)(1) or at the end of proceedings under section 240 initiated upon the alien's arrival in the United States and who again seeks admission within 5 years of the date of such removal (or within 20 years in the case of a second or subsequent removal or at any time in the case of an alien convicted of an aggravated felony) is inadmissible.</text></subparagraph><subparagraph id="HB2A975B95DF546DD8FDA89B618734CE3"><enum>(B)</enum><header>Other aliens</header><text display-inline="yes-display-inline">Any alien not described in subparagraph (A), and who seeks admission within 10 years of the date of such alien's departure or removal (or within 20 years of such date in the case of a second or subsequent removal or at any time in the case of an alien convicted of an aggravated felony), is inadmissible if the alien—</text><clause id="HFA801DB4165349F394D14C7B4CE9D3CB"><enum>(i)</enum><text>has been ordered removed under section 240 or any other provision of law; or</text></clause><clause id="HFA16F15EDBD0410E9A41894E6CC955F8"><enum>(ii)</enum><text>departed the United States while an order of removal was outstanding.</text></clause></subparagraph><subparagraph id="H0861D55CB3424AD1B78F23ACC4A17AA9"><enum>(C)</enum><header>Exception</header><text>Subparagraphs (A) and (B) shall not apply to an alien seeking admission within a period if, prior to the date of the alien's reembarkation at a place outside the United States or attempt to be admitted from foreign contiguous territory, the Secretary of Homeland Security has consented to the alien's reapplying for admission.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H6747404FFFF64BF597EFB5D948574B23"><enum>(b)</enum><header>Misrepresentations</header><text>The Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101 et seq.</external-xref>) is amended—</text><paragraph id="HC62056208F654024A6CAF96E65CA873C"><enum>(1)</enum><text display-inline="yes-display-inline">by amending section 212(a)(6)(C)(ii) (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(6)(C)(ii)</external-xref>) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H2D46C6048DBC47BFBAE402A6603E65AE"><clause id="H0E57209A678E47F094211EB8CA55F16D"><enum>(ii)</enum><header>Misrepresentation of citizenship</header><subclause id="H60A0B46FCF2B43B5B7C0F87C3EB4AB80"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">Any alien who willfully misrepresents, or has willfully misrepresented, himself or herself to be a citizen of the United States for any purpose or benefit under this Act (including section 274A) or any Federal or State law is inadmissible.</text></subclause><subclause id="HE5708E587D554C29A0E382F6D8B90025"><enum>(II)</enum><header>Exception</header><text>In the case of an alien making a misrepresentation described in subclause (I), if the alien was under the age of 21 at the time of making such misrepresentation that he or she was a citizen, the alien shall not be considered to be inadmissible under any provision of this subsection based on such misrepresentation.</text></subclause></clause><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="HBBAB994411444B9BA8D9C12F3E724311"><enum>(2)</enum><text display-inline="yes-display-inline">in section 212(a)(6)(C)(iii) (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(6)(C)(iii)</external-xref>), by striking <quote>of clause (i)</quote>;</text></paragraph><paragraph id="H1F84CB663D2049EBAEB5FE33F3B87C8B"><enum>(3)</enum><text display-inline="yes-display-inline">by amending subsection (i)(1) of section 212 (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(i)(1)</external-xref>) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HB4C429F949C64440B63077AC3F88F6F7"><subsection id="H9FECB611E18846038F5BFD85FD24998D"><enum>(i)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H60369F56411A4F539F77FB56580BB2AE"><enum>(1)</enum><text display-inline="yes-display-inline">The Attorney General or the Secretary of Homeland Security may, in the discretion of the Attorney General or the Secretary, waive the application of subsection (a)(6)(C) in the case of an immigrant who is the parent, spouse, permanent partner, son, or daughter of a United States citizen or of an alien lawfully admitted for permanent residence, or an alien granted classification under clause (iii) or (iv) of section 204(a)(1)(A), if it is established to the satisfaction of the Attorney General or the Secretary that the admission to the United States of such alien would not be contrary to the national welfare, safety, or security of the United States.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HDB461C47F44747FDA58109E9DDC32AF9"><enum>(4)</enum><text display-inline="yes-display-inline">by amending section 237(a)(3)(D) (<external-xref legal-doc="usc" parsable-cite="usc/8/1227">8 U.S.C. 1227(a)(3)(D)</external-xref>) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H553E24AFE2B246EEA39CDEEE9FEF0A17"><subparagraph id="HAB2F485A05A0437990995C4CEE4C902C"><enum>(D)</enum><header>Misrepresentation of citizenship</header><clause id="H2AA62D02D84548678C0BACA1FFF7AB21"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Any alien who willfully misrepresents, or has willfully misrepresented, himself to be a citizen of the United States for any purpose or benefit under this Act (including section 274A) or any Federal or State law is deportable.</text></clause><clause id="H46E844F4323D451494680364F17B932E"><enum>(ii)</enum><header>Exception</header><text>In the case of an alien making a misrepresentation described in subclause (i), if the alien was under the age of 21 at the time of making such misrepresentation that he or she was a citizen, the alien shall not be considered to be deportable under any provision of this subsection based on such misrepresentation.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H5C3B8F8EF6CF4723A5E5F7F255DBA0C0"><enum>(c)</enum><header>Waivers of inadmissibility</header><text>Section 212 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182</external-xref>) is amended by inserting after subsection (b) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HAC772430E82F44EB9DF51FFB28C5CE79"><subsection id="HB7FED114D2E4405ABA36DADB41F75015"><enum>(c)</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the Secretary of Homeland Security or the Attorney General may waive the operation of any one or more grounds of inadmissibility set forth in this section for humanitarian purposes, to assure family unity, or when it is otherwise in the public interest. This waiver shall be available to individuals eligible for relief under subsection (h).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HE1956CE6D1AF49D3A224AD4E41B7E305"><enum>(d)</enum><header>Waivers of deportability</header><text>Section 237 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1227">8 U.S.C. 1227</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H44BEDFE0766B4851A33D5AB53E55A2CC"><subsection id="H2DCC4A5D8BBE4DB290A6323748424EA4"><enum>(e)</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the Secretary of Homeland Security or the Attorney General may waive the operation of any one or more grounds of removal set forth in this section for humanitarian purposes, to assure family unity, or when it is otherwise in the public interest.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H194BFEFEABF547BBA5FAC8BAF7FCCF08"><enum>105.</enum><header>Relief for orphans, widows, and widowers</header><subsection id="H00A626B5AA084B438E74C768ACA31291"><enum>(a)</enum><header>In general</header><paragraph id="HFA85B5341F1248FAB1EF2A1FD34C0F16"><enum>(1)</enum><header>Special rule for orphans, spouses, and permanent partners</header><text>In applying clauses (iii) and (iv) of section 201(b)(2)(A) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name>, as added by section 102(a) of this Act, to an alien whose citizen or lawful permanent resident relative died before the date of the enactment of this Act, the alien relative may file the classification petition under section 204(a)(1)(A)(ii) of such Act, as amended by section 102(c)(4)(A)(i)(II) of this Act, not later than 2 years after the date of the enactment of this Act.</text></paragraph><paragraph id="H5F6EA8D89EE54323BE9D1C9F14EC2396"><enum>(2)</enum><header>Eligibility for parole</header><text>If an alien was excluded, deported, removed, or departed voluntarily before the date of the enactment of this Act based solely upon the alien’s lack of classification as an immediate relative (as defined in section 201(b)(2)(A)(iv) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name>, as amended by section 102(a) of this Act) due to the death of such citizen or resident—</text><subparagraph id="H8E02F0AF12A243109C31C24E05E8772D"><enum>(A)</enum><text>such alien shall be eligible for parole into the United States pursuant to the Secretary of Homeland Security’s discretionary authority under section 212(d)(5) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(d)(5)</external-xref>); and</text></subparagraph><subparagraph id="H04F0337024014364B201EC6E8694F5AF"><enum>(B)</enum><text>such alien’s application for adjustment of status shall be considered notwithstanding section 212(a)(9) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(9)</external-xref>).</text></subparagraph></paragraph><paragraph id="H338ECD32319F48EEACE3D8219251E170"><enum>(3)</enum><header>Eligibility for parole</header><text>If an alien described in section 204(l) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1154">8 U.S.C. 1154(l)</external-xref>), was excluded, deported, removed, or departed voluntarily before the date of the enactment of this Act—</text><subparagraph id="H98BC4823282C42179ABEDF1DC7A0BEF8"><enum>(A)</enum><text>such alien shall be eligible for parole into the United States pursuant to the Secretary of Homeland Security’s discretionary authority under section 212(d)(5) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(d)(5)</external-xref>); and</text></subparagraph><subparagraph id="H495475033271497683CD3C8C97190F4D"><enum>(B)</enum><text>such alien’s application for adjustment of status shall be considered notwithstanding section 212(a)(9) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(9)</external-xref>).</text></subparagraph></paragraph></subsection><subsection id="HA0C3CEC22F684B1F840CEF52E394E7D3"><enum>(b)</enum><header>Processing of immigrant visas and derivative petitions</header><paragraph id="H29C42994546E4C8CBC8944D38F56085C"><enum>(1)</enum><header>In general</header><text>Section 204(b) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1154">8 U.S.C. 1154(b)</external-xref>) is amended—</text><subparagraph id="H07F14A656AC84FDD8DA356C67B87715F"><enum>(A)</enum><text>by striking <quote>After an investigation</quote> and inserting the following:</text><quoted-block style="OLC" id="H69901E8072AF4CBC910784A24D5650E2"><paragraph id="H50A0049E65424126A6E48440745C0F94"><enum>(1)</enum><header>In general</header><text>After an investigation</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H383BB5E1FEA2410F84414E9394481F02"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H4B5A1665CC134A4BA621BDC91C75B430"><paragraph id="H37FBC745E17B471B8E3402191E4B8249"><enum>(2)</enum><header>Death of qualifying relative</header><subparagraph id="HE65E7E5440FE405EAABAD2A669578C5B"><enum>(A)</enum><header>In general</header><text>Any alien described in subparagraph (B) whose qualifying relative died before the completion of immigrant visa processing may have an immigrant visa application adjudicated as if such death had not occurred. An immigrant visa issued before the death of the qualifying relative shall remain valid after such death.</text></subparagraph><subparagraph id="HA69F5E2CF6874EAAA3BCD0444ECFF928"><enum>(B)</enum><header>Alien described</header><text>An alien described in this subparagraph is an alien who—</text><clause id="H8680EDE057E04AFDA0C96EBE9032A427"><enum>(i)</enum><text>is an immediate relative (as described in section 201(b)(2)(A));</text></clause><clause id="HD7E9D6305ACD4AC681386BB244CFC73B"><enum>(ii)</enum><text>is a family-sponsored immigrant (as described in subsection (a) or (d) of section 203);</text></clause><clause id="HCDE4DC16CC4E40E4A43A5A2CBA50EF65"><enum>(iii)</enum><text>is a derivative beneficiary of an employment-based immigrant under section 203(b) (as described in section 203(d)); or</text></clause><clause id="HC1F7C5D99ECB4E7FAC7F5D46B26ECA63"><enum>(iv)</enum><text>is the spouse, permanent partner, or child of a refugee (as described in section 207(c)(2)) or an asylee (as described in section 208(b)(3)).</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H457C637AE6B443F18E2B80B433D8DFB2"><enum>(2)</enum><header>Transition period</header><subparagraph id="HC836D77D41A44FC3BC186BC82F63B33B"><enum>(A)</enum><header>In general</header><text>Notwithstanding a denial or revocation of an application for an immigrant visa for an alien whose qualifying relative died before the date of the enactment of this Act, such application may be renewed by the alien through a motion to reopen, without fee.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H96EC1A0CAF7044F4A4C8304208D21369"><enum>(B)</enum><header>Inapplicability of bars to entry</header><text>Notwithstanding section 212(a)(9) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(9)</external-xref>), an alien’s application for an immigrant visa shall be considered if the alien was excluded, deported, removed, or departed voluntarily before the date of the enactment of this Act.</text></subparagraph></paragraph></subsection><subsection id="H34D42FC01A2F4492B4DA255FF77C2E80"><enum>(c)</enum><header>Naturalization</header><text>Section 319(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1430">8 U.S.C. 1430(a)</external-xref>) is amended—</text><paragraph id="HB6757BFDB7E6468897920BFEF6E1F619"><enum>(1)</enum><text>by inserting <quote>or permanent partner</quote> after <quote>spouse</quote> each place such term appears;</text></paragraph><paragraph id="H3A5DEC7603DF4B628083170C2F53698C"><enum>(2)</enum><text>by inserting <quote>(or, if the spouse is deceased, the spouse was a citizen of the United States)</quote> after <quote>citizen of the United States</quote>; and</text></paragraph><paragraph id="H51DEB87EE01747F5AC880383D3754A1C"><enum>(3)</enum><text>by inserting <quote>or permanent partnership</quote> after <quote>marital union</quote>.</text></paragraph></subsection><subsection commented="no" id="HAA7F4B40F6214DB881AE32129746FB05"><enum>(d)</enum><header>Waivers of inadmissibility</header><text>Section 212 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182</external-xref>) is amended—</text><paragraph id="HCF5FC1D28F92441F8DBAAEDA17CD3E29"><enum>(1)</enum><text>by redesignating the second subsection (t) as subsection (u); and</text></paragraph><paragraph id="H5D9115AFF0014F58B425AC62319AF293"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HDB71E52682EF410D8B909EC21D99EFD7"><subsection commented="no" id="H289A5CA1B00A45BF87DE0ACA7F23E09D"><enum>(v)</enum><header>Continued waiver eligibility for widows, widowers, and orphans</header><text display-inline="yes-display-inline">In the case of an alien who would have been statutorily eligible for any waiver of inadmissibility under this Act but for the death of a qualifying relative, the eligibility of such alien shall be preserved as if the death had not occurred and the death of the qualifying relative shall be the functional equivalent of hardship for purposes of any waiver of inadmissibility which requires a showing of hardship.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" id="H23515AD64543422E8903DE6C7A2A1727"><enum>(e)</enum><header>Surviving relative consideration for certain petitions and applications</header><text display-inline="yes-display-inline">Section 204(l)(1) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1154">8 U.S.C. 1154(l)(1)</external-xref>) is amended—</text><paragraph id="H32762D15E816469C87DC8C26801E46CF"><enum>(1)</enum><text>by striking <quote>who resided in the United States at the time of the death of the qualifying relative and who continues to reside in the United States</quote>; and</text></paragraph><paragraph id="H1DE90B4A621C4AF8BA9203418CF7CB99"><enum>(2)</enum><text>by striking <quote>any related applications,</quote> and inserting <quote>any related applications (including affidavits of support),</quote>.</text></paragraph></subsection><subsection id="HA832F39951C040F69B8F2E6980A92834"><enum>(f)</enum><header>Immediate relatives</header><text>Section 201(b)(2)(A)(i) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151(b)(2)(A)(i)</external-xref>) is amended by striking <quote>within 2 years after such date</quote>.</text></subsection><subsection id="HC9F001F06E074492A08A47345B3C2D00"><enum>(g)</enum><header>Family-Sponsored immigrants</header><text>Section 212(a)(4)(C)(i) is amended—</text><paragraph id="HD9F0A7C7656A4005A790E9AB60307205"><enum>(1)</enum><text>in subclause (I), by striking <quote>, or</quote> and inserting a semicolon;</text></paragraph><paragraph id="H70A701009F774D7DB95B123CEDC12086"><enum>(2)</enum><text>in subclause (II), by striking <quote>or</quote> at the end; or</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="H61FB68B7DB124AEBAADECFFCDCC95950"><enum>106.</enum><header>Exemption from immigrant visa limit for certain veterans who are natives of the Philippines</header><subsection id="HC0E3143A692E4281ABE9A0E00B252C3D"><enum>(a)</enum><header>Short title</header><text display-inline="yes-display-inline">This section may be cited as the <quote><short-title>Filipino Veterans Family Reunification Act</short-title></quote>.</text></subsection><subsection id="HE80AB88551DC4D6B89DB7D3854B66A62"><enum>(b)</enum><header>Aliens not subject to direct numerical limitations</header><text display-inline="yes-display-inline">Section 201(b)(1) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151(b)(1)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HA9540B9575EA48C58E44D8CF4CA35B78"><subparagraph id="H91CD15CE5F1245D98ED8EA73F2005CB5" indent="up1"><enum>(F)</enum><text>Aliens who are eligible for an immigrant visa under paragraph (1) or (3) of section 203(a) and who have a parent who was naturalized pursuant to section 405 of the Immigration Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/8/1440">8 U.S.C. 1440</external-xref> note).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H79ACA66C66E143B5B874C4BB54E897E1"><enum>107.</enum><header>Fiancée child status protection</header><subsection id="HD8752D8B015B434E83C009D11D366FB6"><enum>(a)</enum><header>Definition</header><text>Section 101(a)(15)(K)(iii) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(K)(iii)</external-xref>) is amended by inserting <quote>, if a determination of the age of such minor child is made using the age of the alien on the date on which the petition is filed with the Secretary of Homeland Security to classify the alien’s parent as the fiancée or fiancé of a United States citizen (in the case of an alien parent described in clause (i)) or as the spouse or permanent partner of a United States citizen under section 201(b)(2)(A)(i) (in the case of an alien parent described in clause (ii))</quote> before the semicolon at the end.</text></subsection><subsection id="H8C8A958B214243B5BE2282464A1D287A"><enum>(b)</enum><header>Adjustment of status authorized</header><text>Section 214(d) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(d)(1)</external-xref>) is amended—</text><paragraph id="HFB94BC5BC8D14DF6880FBC481970B29B"><enum>(1)</enum><text>by redesignating paragraphs (2) and (3) as paragraphs (3) and (4), respectively; and</text></paragraph><paragraph id="H74C34E6897614BF7961BBF8A8850EC7D"><enum>(2)</enum><text>in paragraph (1), by striking <quote>In the event</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H33A8F768BC9D44E7AB435A52890DD3F2"><paragraph id="HACE4494470084309B742157CC970B4CB" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HE86E3840501C4450AF138EAF54D29F76"><enum>(A)</enum><text>If an alien does not marry the petitioner under paragraph (1) within 3 months after the alien and the alien’s minor children are admitted into the United States, such alien and children shall be required to depart from the United States. If such aliens fail to depart from the United States, they shall be removed in accordance with sections 240 and 241.</text></subparagraph><subparagraph id="H3E246348567547DEBBB2C8B69DB20F12" indent="up1"><enum>(B)</enum><text>Subject to subparagraphs (C) and (D), if an alien marries the petitioner described in section 101(a)(15)(K)(i) within 3 months after the alien is admitted into the United States, the Secretary of Homeland Security or the Attorney General, subject to the provisions of section 245(d), may adjust the status of the alien, and any minor children accompanying or following to join the alien, to that of an alien lawfully admitted for permanent residence on a conditional basis under section 216 if the alien and any such minor children apply for such adjustment and are not determined to be inadmissible to the United States.</text></subparagraph><subparagraph id="H72AA3D07C9E34C6CA4C598A035FF6BA2" indent="up1"><enum>(C)</enum><text>Paragraphs (5) and (7)(A) of section 212(a) shall not apply to an alien who is eligible to apply for adjustment of his or her status to an alien lawfully admitted for permanent residence under this section.</text></subparagraph><subparagraph id="H4CA1EC800BE04FEFB55BF7BF496AC829" indent="up1"><enum>(D)</enum><text>An alien eligible for a waiver of inadmissibility as otherwise authorized under this Act shall be permitted to apply for adjustment of his or her status to that of an alien lawfully admitted for permanent residence under this section.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HE54AF2F642D74409BCD15B51E373B0FB"><enum>(c)</enum><header>Age determination</header><text>Section 245(d) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1155">8 U.S.C. 1155(d)</external-xref>) is amended—</text><paragraph id="H0E5BB40E139443D49168E37FE6D3B0F1"><enum>(1)</enum><text>by inserting <quote>(1)</quote> before <quote>The Attorney General</quote>; and</text></paragraph><paragraph id="HAFA1266A7B3749EE9AA03A97E09BF99A"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H5BC20BB6077D45ADA574E81734D594DC"><paragraph id="HEA576DACEB2F4EBDAD3CA1B97D17BECA" indent="up1"><enum>(2)</enum><text>A determination of the age of an alien admitted to the United States under section 101(a)(15)(K)(iii) shall be made, for purposes of adjustment to the status of an alien lawfully admitted for permanent residence on a conditional basis under section 216, using the age of the alien on the date on which the petition is filed with the Secretary of Homeland Security to classify the alien’s parent as the fiancée or fiancé of a United States citizen (in the case of an alien parent admitted to the United States under section 101(a)(15)(K)(i)) or as the spouse or permanent partner of a United States citizen under section 201(b)(2)(A)(i) (in the case of an alien parent admitted to the United States under section 101(a)(15)(K)(ii)).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H5FFE6A0C323546C4934AB3BEE9B31768"><enum>(d)</enum><header>Effective date</header><paragraph id="H97CEB9846A28413496B53413D16E9F71"><enum>(1)</enum><header>In general</header><text>The amendments made by this section shall be effective as if included in the Immigration Marriage Fraud Amendments of 1986 (<external-xref legal-doc="public-law" parsable-cite="pl/99/639">Public Law 99–639</external-xref>).</text></paragraph><paragraph id="HB826303848B14A92BF4B5F3FC4522EE2"><enum>(2)</enum><header>Applicability</header><text>The amendments made by this section shall apply to all petitions or applications described in such amendments that—</text><subparagraph id="H2A5265D4D76A4F1988302EF59296829B"><enum>(A)</enum><text>are pending as of the date of the enactment of this Act; or</text></subparagraph><subparagraph id="H82F3832039C04746AB1E87BC90A75A09"><enum>(B)</enum><text>have been denied, but would have been approved if such amendments had been in effect at the time of adjudication of the petition or application.</text></subparagraph></paragraph><paragraph id="H2C4F183C8993448BBADDE4B2F0347A50"><enum>(3)</enum><header>Motion to reopen or reconsider</header><text>A motion to reopen or reconsider a petition or application described in paragraph (2)(B) shall be granted if such motion is filed with the Secretary of Homeland Security or the Attorney General not later than 2 years after the date of the enactment of this Act.</text></paragraph></subsection></section><section id="H221147349AD546D39D2E5CF69BC2E565"><enum>108.</enum><header>Equal treatment for all stepchildren</header><text display-inline="no-display-inline">Section 101(b)(1)(B) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(b)(1)(B)</external-xref>) is amended by striking <quote>, provided the child had not reached the age of eighteen years at the time the marriage creating the status of stepchild occurred</quote>.</text></section><section id="H0AADA76C8F354644AB3FABD193E9F4D4"><enum>109.</enum><header>Retention of priority dates</header><text display-inline="no-display-inline">Section 203 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153</external-xref>) is amended—</text><paragraph id="H199FB1323532417E8C144E4A7414BC11"><enum>(1)</enum><text display-inline="yes-display-inline">by amending subsection (h)(3) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HAB0A1635244F4C05ADB3DE0B882776A3"><paragraph id="H58E13E99CBA04619926FF00FC1138261"><enum>(3)</enum><header>Retention of priority date</header><text display-inline="yes-display-inline">If the age of an alien is determined under paragraph (1) to be 21 years of age or older for the purposes of subsections (a)(2)(A) and (d), and a parent of the alien files a family-based petition for such alien, the priority date for such petition shall be the original priority date issued upon receipt of the original family- or employment-based petition for which either parent was a beneficiary.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H9FC6E9F2AE59498C8986BC2C808ECC00"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HE39CD91413364CA5A4A89A5D4A664963"><subsection id="H525A69F2C198445AA7ACAF583CF48DF7"><enum>(i)</enum><header>Permanent priority dates</header><text display-inline="yes-display-inline">The priority date for any family- or employment-based petition shall be the date of filing of the petition with the Secretary of Homeland Security (or the Secretary of State, if applicable), unless the filing of the petition was preceded by the filing of a labor certification with the Secretary of Labor, in which case that date shall constitute the priority date. The beneficiary of any petition shall retain his or her earliest priority date based on any petition filed on his or her behalf that was approvable when filed, regardless of the category of subsequent petitions.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HF81D448B17B147279C620D0456C35CF3"><enum>110.</enum><header>Relief for spouses and children on other visas</header><subsection id="HC085B89E2BD64E3499855D285E3DFE2C"><enum>(a)</enum><header>Work authorization for holders</header><text>Section 214 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H2D4BC445DF61451EA30F1EB84D9B87E8"><subsection id="HE2D84C151F07424090CD0A269AE8CF1B"><enum>(s)</enum><text>In the case of an alien spouse or child over the age of 16 admitted under subparagraphs (E), (H), (L), and (O) of section 101(a)(15)(H) who is accompanying or following to join a principle alien admitted under such section, the Secretary shall authorize such nonimmigrant to engage in employment in the United States and provide the nonimmigrant with an <quote>employment authorized</quote> endorsement or other appropriate work permit.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H20D20DE193F8426190AD01B2FCA68923"><enum>(b)</enum><header>Protecting H–4 children who age out of status</header><paragraph id="HDFD4D95718FC4F328F44DAEDA53D6742"><enum>(1)</enum><text display-inline="yes-display-inline">Section 214(g)(4) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(g)</external-xref>) is amending by inserting at the end</text><quoted-block style="OLC" display-inline="yes-display-inline" id="H26C3C334A04A4F22BF87F7B87BFCF212"><text>The following exceptions apply:</text><subparagraph id="H3D3FB60C47F54338925A5DD89610D229"><enum>(A)</enum><text display-inline="yes-display-inline">Any alien who—</text><clause id="HDACAA3FBC11F430CA24EB766B228355C"><enum>(i)</enum><text display-inline="yes-display-inline">is the beneficiary of a petition filed under section 204(a) of that Act for a preference status under paragraph (1), (2), or (3) of section 203(b) of that Act; and</text></clause><clause id="HA789A3D4EC6A4A04BB84F189E7718BC3"><enum>(ii)</enum><text>is eligible to be granted that status but for application of the per country limitations applicable to immigrants under those paragraphs, may apply for, and the Attorney General may grant, an extension of such nonimmigrant status until the alien’s application for adjustment of status has been processed and a decision made thereon.</text></clause></subparagraph><subparagraph id="H97BDBCF72F3E4505BB2A812647FDCA11"><enum>(B)</enum><text>The children, accompanying or following to join, an alien described in (A) shall be eligible to apply for and receive an extension of their nonimmigrant status, regardless of their age, so long as—</text><clause id="H7AC0682555684ABB8CA449FACD9AB3DC"><enum>(i)</enum><text>the parent of a minor described in (A) maintains their nonimmigrant status; and</text></clause><clause id="HD2A3CC5E28E14AE3B021C025D54C477A"><enum>(ii)</enum><text>the alien was under 18 years of age when they were first granted nonimmigrant status as an alien accompanying or following to join, the nonimmigrant parent.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HD8DDBB065EA042B3B66DC70669F8251D"><enum>(2)</enum><text>Section 203(h) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(h)</external-xref>) is amended by inserting at the end of the paragraph:</text><quoted-block style="OLC" id="HAEBD74183161414B9986DBEF7A4C8D1F"><paragraph id="HF05CC5C5EEA24CB2A22FA0C511DA05E9"><enum>(5)</enum><text>Notwithstanding paragraph (1), a determination of whether an alien described under section 204(g)(4)(B) satisfies the age requirement for purposes of a derivative visa or adjustment of status application under paragraph (1), (2), or (3) of section 203(b) of the Immigration and Nationality Act shall be made using the age of the alien on the date the petitioner files a petition on behalf of the parent beneficiary with the Secretary of Homeland Security (or the Secretary of State, if applicable), unless the filing of the petition was preceded by the filing of a labor certification with the Secretary of Labor, in which case that date shall be used to identify the age.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="HFA8F4956496E49ACB8EE30084875F7C8"><enum>111.</enum><header>Extension of the application period for certain aliens present in the United States for adjustment of status</header><text display-inline="no-display-inline">Section 245(i) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1255">8 U.S.C. 1255(i)</external-xref>) is amended—</text><paragraph id="HAE6BD7FB0B1C49BB86CA294BC5E10B79"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph id="HDA441404E4954978BAEE7F67DB511400"><enum>(A)</enum><text>in subparagraph (A), in the undesignated matter following clause (ii), by striking the semicolon and inserting <quote>; and</quote>;</text></subparagraph><subparagraph id="HEEB36AED7922405C9A0F991D3E65A215"><enum>(B)</enum><text>in subparagraph (B)—</text><clause id="H21119144992041A1B476B0D0FA6C96E5"><enum>(i)</enum><text>in clause (i), by striking <quote>April 30, 2001</quote> and inserting <quote>the date that is not later than 5 years after the date of the enactment of the Reuniting Families Act</quote>; and</text></clause><clause id="H71BF29BF941B4508BEF786037154E995"><enum>(ii)</enum><text>in clause (ii), by striking <quote>; and</quote> and inserting a period; and</text></clause></subparagraph><subparagraph id="H9A32071632FA4CE6A6441B5A1E855CEB"><enum>(C)</enum><text>by striking subparagraph (C); and</text></subparagraph></paragraph><paragraph id="H0AD453D600534DFD93F184F7F5BF9E39"><enum>(2)</enum><text>by amending paragraph (3)(B) to read as follows:</text><quoted-block style="OLC" id="H37D0559E4DD644EC99A272828BB29EB4"><subparagraph id="H32C2AB2575684C08BED1F71E212F9577" indent="up2"><enum>(B)</enum><text>Any remaining portion of such fees remitted under such paragraphs shall be deposited into the Immigration Examinations Fee Account established under section 286(m).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HD2E65F19B9D94FCB9393E233499F4504"><enum>112.</enum><header>Expansion of cancellation of removal</header><subsection id="H48E60DA967504BD89BBDE2103CD64701"><enum>(a)</enum><header>In general</header><text>Section 240A of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1229b">8 U.S.C. 1229b</external-xref>) is amended—</text><paragraph id="H247DA17DA3044F8B838DA5E7F6278D18"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="H5FF1524C865143D985FD3AC2ED7DCD47"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="H89626D98888F4D03906A39C41E4B069F"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>10</quote> and inserting <quote>7</quote>; and</text></clause><clause id="H8D93AB8E0E8F4BC9ADCC5B2D5723B254"><enum>(ii)</enum><text>by amending subparagraph (D) to read as follows:</text><quoted-block style="OLC" id="HB95638E394BF4C3D80BE4D4A3CBC5A45"><subparagraph id="H1FD482EBCCF94E408561FE48941AC372"><enum>(D)</enum><text>establishes that removal would result in extreme hardship to—</text><clause id="H67929B4549C547A3AFA44AFFA00733DD"><enum>(i)</enum><text>the alien; or</text></clause><clause id="HE0AE5AB957F04457BCC74D6C8D14A149"><enum>(ii)</enum><text>the alien’s spouse or permanent partner, parent, or child who is a citizen of the United States or an alien lawfully admitted for permanent residence.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="HE3FDB7D62C5A45318C440B6D7B10CE51"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="HFF816187AD614A1F8593CE533A23B974"><paragraph id="H8829CA76EDDA4F76A3637775F0D1E617"><enum>(7)</enum><header>Affirmative Application process</header><subparagraph id="H5A5657FCC62E4175A43B849A315ED01C"><enum>(A)</enum><header>In general</header><text>The Secretary of Homeland Security may cancel the removal of, and adjust to the status of an alien lawfully admitted for permanent residence, an alien described in paragraph (1) or (2), who—</text><clause id="H1FF1A97B1D6649EABEB11611184966D6"><enum>(i)</enum><text>demonstrates that the alien is the spouse, permanent partner, parent, son or daughter, or legal guardian of a citizen of the United States; and</text></clause><clause id="H89F4A89F34854EF0A546BA9EB1DEF4B9"><enum>(ii)</enum><text>submits to the Secretary of Homeland Security an application at such time, in such manner, and containing such information as the Secretary may reasonably require.</text></clause></subparagraph><subparagraph id="H611042FB11AC4BD6B8D91F8C2E182A09"><enum>(B)</enum><header>Numerical limitations</header><text>Notwithstanding any other provision of law, an alien admitted to the United States under this section shall not be subject to any numerical limitation.</text></subparagraph></paragraph><after-quoted-block>; and</text></paragraph><paragraph id="H8F3587BF41DA4F2FB6D2406525A05569"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text><quoted-block id="H87735638A2BE44BBB7522F020804D039"><paragraph id="H146A92F53F524A88952621B2AF57DB97" indent="up1"><enum>(4)</enum><text>Paragraph (1) and section 204(g) shall not apply with respect to a permanent partnership if the alien establishes by clear and convincing evidence to the satisfaction of the Secretary of Homeland Security that the permanent partnership was entered into in good faith and in accordance with section 101(a)(52) and the permanent partnership was not entered into for the purpose of procuring the alien’s admission as an immigrant and no fee or other consideration was given (other than a fee or other consideration to an attorney for assistance in preparation of a lawful petition) for the filing of a petition under section 204(a) or 214(d) with respect to the alien permanent partner. division B of <external-xref legal-doc="public-law" parsable-cite="pl/106/386">Public Law 106–386</external-xref>) is amended by striking <quote>or spouse</quote> and inserting <quote>, spouse, or permanent partner</quote>.</text></paragraph></subsection></section><section id="H57A9C3F4200649ECB67836F018DC18BD"><enum>223.</enum><header>Nationality at birth</header><text display-inline="no-display-inline">Section 301 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1401">8 U.S.C. 1401</external-xref>) is amended by adding at the end the following:</text><quoted-block style="traditional" display-inline="no-display-inline" id="H9E82044E88D14519903085E2C697D101"><subsection id="H39497279068D49ADAB2F7355AA1640E7"><enum>(i)</enum><text display-inline="yes-display-inline">Any reference to “a person born of parents” in this section shall include the following:</text><paragraph id="HF25EF40F8D1F4516A256393A57B77FC9"><enum>(1)</enum><text display-inline="yes-display-inline">Any legally recognized parent-child relationship formed within the first year of a person’s life regardless of any genetic or gestational relationship.</text></paragraph><paragraph id="H3B39566B4A65402B93C5120BC27674EF"><enum>(2)</enum><text>Either parent of a child born through Assisted Reproductive Technology who is legally recognized as a parent in the relevant jurisdiction regardless of any genetic or gestational relationship.</text></paragraph><paragraph id="H20A5A98BF975482B838CE1B2A20E446A"><enum>(3)</enum><text>The spouse of a parent at the time of birth, where both of the following apply:</text><subparagraph id="H57192DD2BEFD48DC916360591F0CFEF9"><enum>(A)</enum><text display-inline="yes-display-inline">At least one parent is a legally recognized parent.</text></subparagraph><subparagraph id="H1DFD9E38E45C4598A8A9C305D1D1429C"><enum>(B)</enum><text display-inline="yes-display-inline">The marriage occurred before the child’s birth and is recognized in the United States, regardless of where the parents reside.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></title><title id="HBFE88BB5D33E4E1498E5FBE6B2FC93E5"><enum>III</enum><header>Promoting diversity and protecting against discrimination in our immigration system</header><section id="H341913A64DA043C8A73D4BD739C1FEF7"><enum>301.</enum><header>Increasing diversity visas</header><text display-inline="no-display-inline">Section 201(e) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151(e)</external-xref>) is amended by striking <quote>55,000</quote> and inserting <quote>80,000</quote>.</text></section><section id="H5E58957631E54F1CA775C457C2C49412"><enum>302.</enum><header>Addressing the impact of the Muslim and African bans</header><text display-inline="no-display-inline">Section 201 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H07DB1CFC564C4B4FA309463FA96D13E1"><subsection id="H59F8CD00AF6F4591B3D8DCE90D548CCD"><enum>(g)</enum><header>Diversity visas</header><text>Notwithstanding section 204(a)(1)(I)(ii)(II), an immigrant visa for an alien selected in accordance with section 203(e)(2) in fiscal year 2017, 2018, 2019, 2020, 2021, or 2022 shall remain available to such alien (and the spouse and children of such alien) if—</text><paragraph id="H7EF46D03D5544D00B0D510F941D7BBAB"><enum>(1)</enum><text>the alien was refused a visa, prevented from seeking admission, or denied admission to the United States solely because of Executive Order 13769, Executive Order 13780, Presidential Proclamation 9645, or Presidential Proclamation 9983; or</text></paragraph><paragraph id="H573353D426294A539E29365DAE58886E"><enum>(2)</enum><text>because of restrictions or limitations on visa processing, visa issuance, travel, or other effects associated with the COVID–19 public health emergency—</text><subparagraph id="H396965D89C8E4561AA6B27CB8E66B8B1"><enum>(A)</enum><text>the alien was unable to receive a visa interview despite submitting an Online Immigrant Visa and Alien Registration Application (Form DS–260) to the Secretary of State; or</text></subparagraph><subparagraph id="H2ECF45EF9C7948E0B25DDB9550206EF1"><enum>(B)</enum><text>the alien was unable to seek admission or was denied admission to the United States despite being approved for a visa under section 203(c).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></title><title id="H16A0B4CEDBB1455A9C5D7906E3AC1124"><enum>IV</enum><header>Addressing the needs of refugee families</header><section id="H1D465B52AB90453F8D3902FA4634740F"><enum>401.</enum><header>Prioritization of family reunification in refugee resettlement process</header><subsection id="HC35D959DCEDF4BCBBEF39B1D2212C4A1"><enum>(a)</enum><header>In general</header><text>The Secretary of State shall prioritize refugees seeking reunification with relatives living in the United States, regardless of the nationality of such refugees.</text></subsection><subsection id="H8D344CC842CA40E7B0BA289F5E9CB2B8"><enum>(b)</enum><header>Regulations</header><paragraph id="HD7E9706DEC6D4C7BB6AA2C2053DB3753"><enum>(1)</enum><header>In general</header><text>The Secretary of State, in consultation with the Secretary of Homeland Security, shall promulgate regulations to ensure that an individual seeking admission to the United States as a refugee shall not be excluded from being interviewed for refugee status based on—</text><subparagraph id="H15910187F3064ED0990C5719CCBBA107"><enum>(A)</enum><text>a close family relationship to a citizen or lawful permanent resident of the United States;</text></subparagraph><subparagraph id="HA633FE04037045B38E2AC5F57D1CDBF8"><enum>(B)</enum><text>a potential qualification of the individual for an immigrant visa; or</text></subparagraph><subparagraph id="HB182D1CF0B2A4368982336E933220C67"><enum>(C)</enum><text>a pending application by the individual for admission to the United States.</text></subparagraph></paragraph><paragraph id="H6DB0FCCB68A5435F84784E135B5DB38F"><enum>(2)</enum><header>Simultaneous consideration</header><text>The regulations promulgated under paragraph (1) shall ensure that an applicant for admission as a refugee is permitted to pursue simultaneously admission to the United States—</text><subparagraph id="H90E46B9776784F0FB3C0D40FCBA46D53"><enum>(A)</enum><text>as a refugee; and</text></subparagraph><subparagraph id="HBFD9D69D4C2B42EE89D3B95390A9FE12"><enum>(B)</enum><text>under any visa category for which the applicant may be eligible.</text></subparagraph></paragraph></subsection><subsection id="HD112AF260EAD4853B8558E888612AC68"><enum>(c)</enum><header>Notice of separate travel</header><text>In the case of an applicant for admission under section 207 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1157">8 U.S.C. 1157</external-xref>) the application of whom is placed on hold for more than three months and one or more members of the family of the applicant have separate pending applications for admission under such section, the Secretary of Homeland Security shall—</text><paragraph id="H66D81284F9A94EF9A90B57B3C04566DE"><enum>(1)</enum><text>notify any individual on that case who is eligible to travel separately of the option to separate the case of the individual from the family unit; and</text></paragraph><paragraph id="HD958011FBF2E41A899DEF85F65A68FED"><enum>(2)</enum><text>permit the individual to travel based on the satisfaction by the individual of all security and other requirements for a refugee application.</text></paragraph></subsection><subsection id="HF4D485264C67492F9394513535F82514"><enum>(d)</enum><header>Use of embassy referrals</header><paragraph id="H95DF97A2729D439EA200C861476B48DE"><enum>(1)</enum><header>In general</header><text>The Secretary of State shall set forth a plan to ensure that each United States embassy and consulate is equipped and enabled to refer individuals in need of resettlement to the United States refugee admissions program.</text></paragraph><paragraph id="HCE4DA1EFE5DD4FBCB2E8ABBE20F9F440"><enum>(2)</enum><header>Training</header><text>The Secretary of State shall undertake training for embassy personnel to ensure that each embassy and consulate has sufficient knowledge and expertise to carry out this paragraph.</text></paragraph></subsection></section><section id="H0A06911175824D0AAC6BF3D3DCDEBB3A"><enum>402.</enum><header>Priority 3 family reunification cases</header><subsection id="HC4AD3747D3B443F08C9F6FBE48C5BCB2"><enum>(a)</enum><header>In general</header><text>Because of the importance of reuniting immediate refugee families who have been separated while fleeing from persecution, Priority 3 processing shall be made available to individuals of all nationalities, including stateless individuals.</text></subsection><subsection id="H251C7007F0ED40E096ACEA6FA7D6273C"><enum>(b)</enum><header>Universal eligibility for all nationalities</header><paragraph id="H8328A1BE6C3A4D2F8E28746B6B12429F"><enum>(1)</enum><header>In general</header><text>Eligible Priority 3 Affidavit of Relationship filers will include those admitted in asylum, refugee, or Afghan and Iraqi special immigrants admitted under section 1059 of the National Defense Authorization Act for Fiscal Year 2006 (<external-xref legal-doc="public-law" parsable-cite="pl/109/163">Public Law 109–163</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref> note), section 1244 of the Refugee Crisis in Iraq Act of 2007 (<external-xref legal-doc="public-law" parsable-cite="pl/110/181">Public Law 110–181</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/8/1157">8 U.S.C. 1157</external-xref> note), and section 602 of the Afghan Allies Protection Act of 2009 (<external-xref legal-doc="public-law" parsable-cite="pl/111/8">Public Law 111–8</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref> note).</text></paragraph><paragraph id="H180A7C2532544D92A649587FAB76076E"><enum>(2)</enum><header>Eligible affidavit of relationship files</header><text>Eligible Affidavit of Relationship (referred to in this section as <quote>AOR</quote>) filers include individuals who are lawful permanent residents of the United States or United States citizens who initially were admitted to the United States in a status described in paragraph (1).</text></paragraph></subsection><subsection id="H205C54FFBF9D449082D3659CCCB42778"><enum>(c)</enum><header>Requirements</header><text>The United States-based filer shall be at least 18 years of age at the time that the AOR is filed. The filer shall file the AOR not later than 5 years after the date they were admitted as a refugee or special immigrant or were granted asylum. The Secretary of State may reject any AOR for a relationship that does not comport with public policy, such as underage or plural marriages.</text></subsection><subsection id="H3E6DF54DCB404B44B7E3CB770731BDDD"><enum>(d)</enum><header>Family members included</header><paragraph id="H3E526F0BF245419DBA18FB6AA2188220"><enum>(1)</enum><header>In general</header><text>The following family members of the United States-based family members are qualified for Priority 3 access:</text><subparagraph id="H999517230E26482E9D17F63E0A0E4B88"><enum>(A)</enum><text>Spouse or permanent partner.</text></subparagraph><subparagraph id="HE9C9F13A98D146589F88F56F2381AE36"><enum>(B)</enum><text>Unmarried children who are younger than 21 years of age.</text></subparagraph><subparagraph id="H50B9E262265041A79717EB15E4B5CABD"><enum>(C)</enum><text>Parents.</text></subparagraph></paragraph><paragraph id="H7F0F2069DAC6440DA127DE0B2908883B"><enum>(2)</enum><header>Partners</header><text>The Secretary of State may allow a qualifying individual to file for Priority 3 access for a partner of any gender if the filer can provide evidence of a relationship with the partner for at least one year overseas prior to the submission of the AOR and considered that person to be his or her spouse or life partner, and that the relationship is ongoing, together with evidence that legal marriage was not an obtainable option due to social or legal prohibitions.</text></paragraph></subsection><subsection id="H06DF665E3A5F4CD38531AFA6781C4903"><enum>(e)</enum><header>Derivative refugee status</header><text>In addition to the qualifying family members of a United States-based individual identified above, the qualifying family member’s spouse or permanent partner, as well as unmarried children younger than 21 years of age, may derive refugee status from the principal applicant for refugee status.</text></subsection><subsection id="HDAD12A057AF74298B297E9390C3B29E1"><enum>(f)</enum><header>Additional qualifying family members</header><text display-inline="yes-display-inline">On a case-by-case basis, an individual may be added to a qualifying family member’s Priority 3 case if that individual—</text><paragraph id="H5F8380DAE87B4B0DB146FA0A2D205BD1"><enum>(1)</enum><text>lived in the same household as the qualifying family member in the country of nationality or, if stateless, last habitual residence;</text></paragraph><paragraph id="HA10DB34EA19B4705B90299669711130F"><enum>(2)</enum><text>was part of the same economic unit as the qualifying family member in the country of nationality or, if stateless, last habitual residence; and</text></paragraph><paragraph id="H3F65501003AE4C4C925946D7D64C8998"><enum>(3)</enum><text>demonstrates exceptional and compelling humanitarian circumstances that justify inclusion on the qualifying family member’s case.</text></paragraph></subsection></section><section id="HE237E3E5CC8F4B13A0E95057FA4F2B79"><enum>403.</enum><header>Admission of refugee families and timely adjudication</header><text display-inline="no-display-inline">Section 207(c)(2) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1157">8 U.S.C. 1157(c)(2)</external-xref>) is amended to read as follows:</text><quoted-block style="traditional" id="HEC8EA9B200EF4E128F3042474ADF5F3A"><paragraph id="H3AB98DFB295C4A11B3166DA88D428409" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HC25D10C144A04346BB4560A93701A9BD"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="H46C9C7CF6C9C4A80AB705AE0022A2DB6"><enum>(i)</enum><text>Irrespective of the date on which such refugee was admitted to the United States, the spouse or permanent partner, or a child (as defined in section 101(b)(1)) of any refugee, or the parent or de facto guardian (as determined by the Secretary of Homeland Security) of such a child who qualifies for admission under paragraph (1), if not otherwise entitled to admission under such paragraph and not described in section 101(a)(42)(B), shall be entitled to the same admission status as such refugee if—</text><subclause id="H813759752BAC4D978775D88D5FB7996F" indent="up1"><enum>(I)</enum><text>accompanying, or following to join, such refugee; and</text></subclause><subclause id="H0A82F9BC3F7940A6B4CFB54DD29A5BCF" indent="up1"><enum>(II)</enum><text>admissible (except as otherwise provided under paragraph (3)) as an immigrant under this chapter.</text></subclause></clause><clause id="HDDFF15F9793048AE905E9AE4D2FA6A42" indent="up2"><enum>(ii)</enum><text>The admission to the United States of a spouse or permanent partner, child, parent, or guardian described in clause (i) shall not be charged against the numerical limitation established in accordance with the appropriate subsection under which the refugee’s admission is charged.</text></clause></subparagraph><subparagraph id="H22FFA9398BB3471D957C219FFF2435FA" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">A mother or father who seeks to accompany, or follow to join, an alien child granted admission as a refugee under this subsection shall continue to be classified as a parent for purposes of this paragraph if the alien child attains 21 years of age while the application filed under this paragraph is pending.</text></subparagraph><subparagraph id="HBE043666FD714A77A72983A6E105DB94" indent="up1"><enum>(C)</enum><text>The parent or de facto guardian (as determined by the Secretary of Homeland Security) of a refugee child admitted under this section and was admitted under the Unaccompanied Refugee Minors Program (as described in subparagraph (D), (E), or (H) of section 101(b)(1)) shall be treated in accordance with subparagraph (A) if such parent or guardian seeks to follow to join such refugee child and the minor consents to being joined by such individual.</text></subparagraph><subparagraph id="H21D80E509565417A947EB8E799EF3503" indent="up1"><enum>(D)</enum><clause commented="no" display-inline="yes-display-inline" id="H24F40ECAFE65435993D36458DB635578"><enum>(i)</enum><text>Not later than 1 year after the date on which an application for refugee status is filed under this paragraph—</text><subclause id="H3E708C8DB0F44BB1B3EAA51F59DFF351" indent="up1"><enum>(I)</enum><text>required screenings and background checks shall be completed; and</text></subclause><subclause id="H1D8B6335FAB949A8A1D9CCF0EA2ECCFA" indent="up1"><enum>(II)</enum><text>the application shall be adjudicated.</text></subclause></clause><clause id="HA65E7EDC78634F81B4BE1D4CE679C844" indent="up1"><enum>(ii)</enum><text>The adjudication of an application may exceed the timeframe under clause (i) only in exceptional circumstances in which additional time to process an application is necessary to satisfy national security concerns, if the Secretary of Homeland Security has—</text><subclause id="HB37F40E735BE4B3FBDDE46EAE7AA089F"><enum>(I)</enum><text>made a determination that the applicant meets the requirements for refugee status under this section; and</text></subclause><subclause id="HE6E77E962AF3422495146627ECD265C3"><enum>(II)</enum><text>notified the applicant of such determination.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></title></legis-body></bill>
