definitions of male and female.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HD997DFC49FD34D67A1B4F109E208EDD4"><section section-type="section-one" id="H52B21A7E81A5474BA06DB8288B574E4B"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Defining Male and Female Act of 2024</short-title></quote>. </text></section><section id="HFD7F1EA531AA4EDC881B8D63253038E7"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="HC3EEFBF9DF68432EADA9915F90F6AE86"><enum>(1)</enum><text display-inline="yes-display-inline">In human beings, there are two—and only two—sexes: male and female, which refer to the two body structures (phenotypes) that, in normal development, correspond to one or the other gamete—sperm for males and ova for females.</text></paragraph><paragraph id="H357CAF03360E425BADBF46274C637D58"><enum>(2)</enum><text>Every individual is either male or female.</text></paragraph><paragraph id="H549AF2E28FEE42478BF7E165D1B819BC"><enum>(3)</enum><text>An individual’s sex can be observed or clinically verified at or before birth.</text></paragraph><paragraph id="H3A1028CE8ACF47848A806A8B58BD491A"><enum>(4)</enum><text>Rare disorders of sexual development are not exceptions to the binary nature of sex.</text></paragraph><paragraph id="H10D26DF840DE4DAC8BAD005FE2824346"><enum>(5)</enum><text>In no case is an individual’s sex determined by stipulation or self-identification.</text></paragraph><paragraph id="H20685E7775064AA3B544FA2C3CBEFCF5"><enum>(6)</enum><text>There is increasing confusion about the definition of sex as a biological truth, the implications of sex, and its relationship to concepts and terms including sex assigned at birth, gender, gender identity, gender role, gender expression, and experienced gender.</text></paragraph><paragraph id="H6D31AFBD2AD74A539C295B01DA8AEFE4"><enum>(7)</enum><text>Confusion and ambiguities surrounding the definitions of sex, male, female, and related terms can hinder individual efforts to enjoy equal treatment under the law.</text></paragraph><paragraph id="HA8930E2C83F84207AA15DDEAA4AC8271"><enum>(8)</enum><text>Legal equality of the two sexes—male and female—does not imply that the sexes are identical to each other or are the same in every respect.</text></paragraph><paragraph id="H233D336EC9304738920038D0E6BFEAA5"><enum>(9)</enum><text>With respect to the two sexes—male and female—separate facilities or sports leagues established because of or organized according to physical differences between the sexes do not constitute unequal treatment under the law.</text></paragraph><paragraph id="H6B3B6A896FF54E2AB0449452301E1F78"><enum>(10)</enum><text>Physical differences between males and females are enduring, and the two sexes are not fungible.</text></paragraph><paragraph id="H4923C047E4CD404197BF4AC37560F715"><enum>(11)</enum><text display-inline="yes-display-inline">To prevent further efforts to undermine the longstanding meaning and understanding of sex, male, female, and related terms, it is necessary for Congress to reaffirm and codify the meaning of these terms. </text></paragraph></section><section id="H89FC9516B0CC45ABB7FAD1B47363F51C"><enum>3.</enum><header>Definition of <quote>sex</quote>, <quote>male</quote>, <quote>female</quote>, and related terms</header><text display-inline="no-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/1/1">Chapter 1</external-xref> of title 1, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idC5763956A1564556B9D2CFFD45B42E9C"><section id="H0BFCCE2BBA874B07B1D167BF74E042EC"><enum>9. </enum><header>Definition of <quote>sex</quote>, <quote>male</quote>, <quote>female</quote>, and related terms</header><text display-inline="no-display-inline">In determining the meaning of any Act of Congress, or of any ruling, regulation, or interpretation of the various departments and Federal agencies of the United States, the word—</text><paragraph id="HD024A2D3DCD14DEE9B69A6E230A87EAF"><enum>(1)</enum><text><term>boy</term> means a minor human male;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6c0ac81641894b14b1be0270d1b37064"><enum>(2)</enum><text display-inline="yes-display-inline"><term>father</term> means a male parent;</text></paragraph><paragraph id="H7523B56A065A4827B5533ACD3264EA85" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline"><term>female</term>, when used to refer to a natural person, means an individual who naturally has, had, will have, or would have, but for a congenital anomaly or intentional or unintentional disruption, the reproductive system that at some point produces, transports, and utilizes eggs for fertilization;</text></paragraph><paragraph id="HA1D24555D6C3472398C150CDE5B434BF" commented="no"><enum>(4)</enum><text><term>gender</term>, when used alone to refer to males, females, or the natural differences between males and females—</text><subparagraph commented="no" display-inline="no-display-inline" id="id6372c7266d5d4760a3b8333cee24a8e5"><enum>(A)</enum><text display-inline="yes-display-inline">shall be considered a synonym for sex; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id53d2da8fca1542c98253e6933ce01952"><enum>(B)</enum><text>shall not be considered a synonym or short-hand expression for gender identity, experienced gender, gender expression, or gender role, </text></subparagraph><continuation-text continuation-text-level="paragraph"> except that this definition shall not apply when the term <term>gender</term> is used in conjunction with other words or as an adjective to modify other words, or when context or explicit definition in law indicates otherwise; </continuation-text></paragraph><paragraph id="H2A02A3C3A4094F038A654E836967CDB8"><enum>(5)</enum><text><term>gender identity</term> does not mean sex or gender;</text></paragraph><paragraph id="HE3CAF6CD2E014E5285FFC55DD41DEA4D"><enum>(6)</enum><text><term>girl</term> means a minor human female;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfec2d369f7614a239837fdb7b9552038"><enum>(7)</enum><text display-inline="yes-display-inline"><term>male</term>, when used to refer to a natural person, means an individual who naturally has, had, will have, or would have, but for a congenital anomaly or intentional or unintentional disruption, the reproductive system that at some point produces, transports, and utilizes sperm for fertilization;</text></paragraph><paragraph id="idfc66431ffb854cd69d1e366bc1780db7"><enum>(8)</enum><text><term>man</term>, except when used as a generic reference to human beings, means an adult human male; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4000953b4df14092b6e747605c50ea2a"><enum>(9)</enum><text><term>mother</term> means a female parent;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide6cb99251c364343865036c5cb2bc9d0"><enum>(10)</enum><text display-inline="yes-display-inline"><term>sex</term>, when referring to an individual’s sex, shall be understood to refer to either male or female, as biologically determined and defined by this section; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id34adc46234834e3dbb07f8d36c23ca6a"><enum>(11)</enum><text display-inline="yes-display-inline"><term>woman</term> means an adult human female.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
