<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>2d Session</session><legis-num>S. 5346</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20241119">November 19, 2024</action-date><action-desc><sponsor name-id="S317">Mr. Barrasso</sponsor> (for himself, <cosponsor name-id="S353">Mr. Schatz</cosponsor>, <cosponsor name-id="S398">Mr. Cramer</cosponsor>, and <cosponsor name-id="S422">Mr. Welch</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title XIX of the Social Security Act to establish a minimum Medicaid disproportionate share hospital allotment for States.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Delivering Support for Hospitals Act</short-title></quote> or the <quote><short-title>DSH Act</short-title></quote>.</text></section><section id="idE4ED46BA5F7146219CE7E3E3B0A397C1"><enum>2.</enum><header>Minimum Medicaid DSH allotment</header><text display-inline="no-display-inline">Section 1923(f)(6) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r-4">42 U.S.C. 1396r–4(f)(6)</external-xref>) is amended by adding at the end the following new subparagraph:</text><quoted-block id="id0F202D0ED1894DB08AD52A6AA367C523" style="OLC" act-name=""><subparagraph id="id49FEDF8E08F648D9897514F728742696"><enum>(C)</enum><header>Minimum DSH allotment for fiscal years after 2024</header><clause id="id8B94B42A456D46049F09FBE29738602E"><enum>(i)</enum><header>In general</header><text>Notwithstanding the table set forth in paragraph (2) or the reductions required under paragraph (7), for fiscal year 2025 and each succeeding fiscal year, the DSH allotment for any State shall not be less than the minimum DSH allotment amount established for the fiscal year under clause (ii).</text></clause><clause id="id3552E3518E054D64ABB79136DEBD5211"><enum>(ii)</enum><header>Minimum DSH allotment amount</header><text>The minimum DSH allotment amount established under this clause—</text><subclause id="id3318D6DA97984C50BF8887F4FBB033D1"><enum>(I)</enum><text>for each of fiscal years 2025 through 2029, shall be equal to $20,000,000; and</text></subclause><subclause id="id6E1A5E4989314D1A8D10F5D96B5483D2"><enum>(II)</enum><text>for fiscal year 2030 and each succeeding fiscal year, shall be equal to the minimum DSH allotment amount established under this clause for the preceding fiscal year, subject to an increase for inflation as provided in paragraph (3)(A).</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
