which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the public release of all research supported by the National Institutes of Health.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Scientific Research Accessibility and Transparency Act of 2024</short-title></quote>.</text></section><section id="idba6da4d492da4b32b1464b1608806fb6" commented="no"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds as follows:</text><paragraph id="id32267da2f5754d64a58bf456c3076c2f"><enum>(1)</enum><text>According to the New York Times article, <quote>U.S. Study on Puberty Blockers Goes Unpublished Because of Politics, Doctor Says</quote> (October 23, 2024)—</text><subparagraph commented="no" display-inline="no-display-inline" id="idec2763b5499b4f71b5b935c3d67b9127"><enum>(A)</enum><text>Dr. Johanna Olson-Kennedy led a study funded by the National Institutes of Health concluding that the mental health of children with gender dysmorphia did not improve after taking puberty blockers;</text></subparagraph><subparagraph id="idc79acf5752114b498b2f2e051a385d6e"><enum>(B)</enum><text>Dr. Olson-Kennedy’s team has delayed the release of data from this study because it may be used for political causes with which she personally disagrees;</text></subparagraph><subparagraph id="idc6291cb33a6b4fdeacd2fe6d76e97daa"><enum>(C)</enum><text>the project associated with Dr. Olson-Kennedy’s study has received $9,700,000 in government funding; and</text></subparagraph><subparagraph id="id5ebe99b9a1e0402cae385b4e5c79fb34"><enum>(D)</enum><text>the National Institutes of Health lets researchers independently decide how and when to publish their findings. </text></subparagraph></paragraph><paragraph id="id9ddb422b266c43288d8b362bddecd5c4"><enum>(2)</enum><text>Scientific researchers in the United States have a duty to release properly collected scientific data, even if such data does not comport with the political interests of the researchers.</text></paragraph><paragraph id="id50e9a3fb5f404749bf1cdec16ef61192"><enum>(3)</enum><text>The American public has a right to access data that was collected using taxpayer dollars, regardless of the political interests of the researchers collecting the data. </text></paragraph></section><section id="id320041e122cc4922a794102782663fbc"><enum>3.</enum><header>Publication of NIH research</header><text display-inline="no-display-inline">Part B of title IV of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/284">42 U.S.C. 284 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idCD7DEBD2AF174950B54CBFB485312586"><section id="id1fe975f1e5184903b485e63549e91325"><enum>409K.</enum><header>Publication of research</header><subsection commented="no" display-inline="no-display-inline" id="id49258013a2be4aa8bb510d64eed6b82a"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text>With respect to any research conducted by the National Institutes of Health or with the support of funding made available by the National Institutes of Health, not later than 1 year after the conclusion of the research, the National Institutes of Health or the person receiving such funding, as applicable, shall make available for publication on the website of the National Institutes of Health, and the National Institutes of Health shall publish on such website, in an easily accessible manner—</text><paragraph commented="no" display-inline="no-display-inline" id="id10cdb712e13b4db98a20edc38e62ab19"><enum>(1)</enum><text display-inline="yes-display-inline">a report on such research; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id025008f8e4ba4e378083c35e15ad006a"><enum>(2)</enum><text display-inline="yes-display-inline">if the person conducting such research does not complete a report on the research, all raw data collected through the research.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idf4f17838becd453f9e5e2f2619046d32"><enum>(b)</enum><header>Noncompliance</header><text display-inline="yes-display-inline">Any person that does not comply with the requirements of subsection (a) shall be ineligible for funding from the National Institutes of Health for a period of 5 years, beginning on the date on which the report or raw data was required to be made available for publication in accordance with subsection (a).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
