Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To restrict car manufacturers and other companies from selling consumer car-related data, increase transparency regarding data practices, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Car Privacy Rights Act of 2024</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="idf8b879d0854344efa771e2e894e81b5d"><enum>2.</enum><header>Restricting the sharing or selling of consumer car-related data</header><subsection id="idfd55e25f1e6b43b3ac6cafaccc63ca3e"><enum>(a)</enum><header>In general</header><text>Subject to subsections (b) and (c), it shall be unlawful for a covered entity to share or sell any consumer car-related data of a consumer unless— </text><paragraph commented="no" display-inline="no-display-inline" id="idc44c7cacd9ae45cfbd0e41caf52227d7"><enum>(1)</enum><text display-inline="yes-display-inline">the covered entity provides the consumer— </text><subparagraph commented="no" display-inline="no-display-inline" id="idd64e334e6a1e41af9e433fe4c7009b8f"><enum>(A)</enum><text display-inline="yes-display-inline">a notice that—</text><clause commented="no" display-inline="no-display-inline" id="id939cd8ab743b43b9af42bbe859899394"><enum>(i)</enum><text display-inline="yes-display-inline">the covered entity intends to share or sell such data;</text></clause><clause commented="no" display-inline="no-display-inline" id="idc3b24c00ce374d9dba642e6b53a9c646"><enum>(ii)</enum><text>is provided in a clear and conspicuous standalone disclosure that describes each instance the covered entity plans to share or sell such data;</text></clause><clause commented="no" display-inline="no-display-inline" id="id74fa45e40be44b20b34837daee3f6532"><enum>(iii)</enum><text>states for each specific category of such data if the covered entity is sharing or selling such data in order to provide a service requested by the consumer or for another purpose;</text></clause><clause commented="no" display-inline="no-display-inline" id="idfe8f72ca6ab44ab0b427eb438a4bc818"><enum>(iv)</enum><text>is written in easy-to-understand language; </text></clause><clause commented="no" display-inline="no-display-inline" id="id62aa3ed96a2a47bdaae7b04b48bcc403"><enum>(v)</enum><text>is provided by a means that would be reasonably anticipated by the consumer given the relationship between the consumer and the covered entity; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id81596b1a540f461f8cc28bb7c536322d"><enum>(vi)</enum><text>is accessible to persons with disabilities; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idf7a3ecb010ee4442ad2a2bd1a286be2d"><enum>(B)</enum><text>an opportunity to explicitly grant affirmative express consent to allow the covered entity to share or sell such data; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ideb80bab42da94a0c83c7600d5a0cf27d"><enum>(2)</enum><text display-inline="yes-display-inline">the consumer explicitly grants such affirmative express consent.</text></paragraph></subsection><subsection id="idd4cccb3451bd4239b87ddd457f13af46"><enum>(b)</enum><header>Revocation of consent</header><text>If a consumer grants affirmative express consent to allow a covered entity to share or sell the data of such consumer pursuant to subsection (a)(2), the covered entity shall allow such consumer to easily revoke such consent directly through the website of the covered entity, or application of the covered entity, or through direct mail. </text></subsection><subsection id="idaad15fcf91ad4eefa971bb16f00f371a"><enum>(c)</enum><header>Exception</header><text>Subsection (a) shall not apply to any data a covered entity shares with the National Highway Traffic Safety Administration.</text></subsection></section><section id="id1e9670704e4c40d0b51e79da98d0910f"><enum>3.</enum><header>Reporting of consumer data privacy practices</header><subsection commented="no" display-inline="no-display-inline" id="idd5e150b1bfe84e59990150440640853e"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text>Not later than 120 days after the date of enactment of this Act and annually thereafter, each car manufacturer and motor vehicle insurance company shall submit a report to the Commission regarding their consumer data privacy practices, including any consumer car-related data that are being collected, the purpose behind such data being collected, what entities are being shared or sold such data, and an overview of their data sharing practices.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id0902907e27e34a60bc43dbabef3f96c1"><enum>(b)</enum><header>FTC report</header><text display-inline="yes-display-inline">Not later than 180 days after the date described in subsection (a) and annually thereafter, the Commission shall submit to Congress and publish on the website of the Commission a report containing a summary of the information described in subsection (a).</text></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id95dbb14e594d47158ae377c5cd7f083e"><enum>4.</enum><header display-inline="yes-display-inline">Guidance or rulemaking regarding car manufacturers addressing domestic violence issues related to their applications</header><text display-inline="no-display-inline">Not later than 180 days after the date of enactment of this Act, the Commission, in consultation with the Federal Communications Commission and the National Highway Traffic Safety Administration, shall issue guidance or promulgate regulations regarding how car manufacturers can address domestic violence issues related to any application of a car manufacturer that has the capability to determine the precise geolocation of an individual, consumer car, or device.</text></section><section commented="no" display-inline="no-display-inline" id="id508485d3558d4ac0be9bf383604eab31"><enum>5.</enum><header>Enforcement</header><subsection commented="no" display-inline="no-display-inline" id="ida2ce0f3be4b246aaad3bf3284ae3e555"><enum>(a)</enum><header>Unfair or deceptive acts or practices</header><text display-inline="yes-display-inline">A violation of this Act or a regulation promulgated under this Act shall be treated as a violation of a rule defining an unfair or deceptive act or practice under section 18(a)(1)(B) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idf8b6359a48f2417d9e87c39eea4668b6"><enum>(b)</enum><header>Powers of the Commission</header><paragraph commented="no" display-inline="no-display-inline" id="iddf7c5d4285054bcf89a461d25ec067c6"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Commission shall enforce this Act in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>) were incorporated into and made a part of this Act.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9381b6ac080d4df1bcd97018dea00f9b"><enum>(2)</enum><header>Privileges and immunities</header><text display-inline="yes-display-inline">Any person who violates this Act or a regulation promulgated under this Act shall be subject to the penalties and entitled to the privileges and immunities provided in the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>).</text></paragraph><paragraph id="id672cff93ed2a4655b5366e52bbb2eeba" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header>Authority preserved</header><text>Nothing in this section shall be construed to limit the authority of the Commission under any other provision of law.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="iddbeeb67462e146508c773e5aa91c3822"><enum>(4)</enum><header>Rulemaking</header><text>The Commission shall promulgate in accordance with section 553 of title 5, United States Code, such rules as may be necessary to carry out this Act.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="ide37b67bff21e4c039b499dcbd593d70a"><enum>6.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="idb0ff49850c234282b5acb53c739d4b99"><enum>(1)</enum><header>Affirmative express consent</header><text>The term <term>affirmative express consent</term> means an affirmative act by a consumer that—</text><subparagraph commented="no" display-inline="no-display-inline" id="id39e1b2dc1ca4447298c73487c88d6d41"><enum>(A)</enum><text display-inline="yes-display-inline">clearly communicates the authorization of the consumer for an act or practice;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id735387216e6e479bab7750ec1a367848"><enum>(B)</enum><text>is provided in response to a notice that meets the requirements of section 2(a)(1)(A); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idba50cedd75124e579067a95be586a56c"><enum>(C)</enum><text>is not— </text><clause commented="no" display-inline="no-display-inline" id="id42c4a458bed346dcaa92675b12d5a7b8"><enum>(i)</enum><text display-inline="yes-display-inline">acceptance of general or broad terms of service or a similar document;</text></clause><clause commented="no" display-inline="no-display-inline" id="ida0592c5ee69a4ee6af538505fd9c3b73"><enum>(ii)</enum><text>accomplished by hovering over, muting, pausing, or closing a given piece of content; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id8f3979f9d4244daf8850d77d0151472b"><enum>(iii)</enum><text>acceptance of an agreement obtained through the use of false, fraudulent, or materially misleading means.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id24a6c8a8ae7f475cbfcaddbc0421ae3b"><enum>(2)</enum><header>Application</header><text>The term <term>application</term> means a software program that runs on the operating system of a device.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idacf8ccfb127b40dca640325dbda8e138"><enum>(3)</enum><header display-inline="yes-display-inline">Commission</header><text>The term <term>Commission</term> means the Federal Trade Commission. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb3327fc714bd4892b8f689612e570c96"><enum>(4)</enum><header>Consumer</header><text>The term <term>consumer</term> means an individual who is a citizen or resident of, or located in, the United States.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id59e988dd1bf74a44a6d8fdfac0855884"><enum>(5)</enum><header>Consumer car</header><text>The term <term>consumer car</term> means a motor vehicle, as defined in section 30102 of title 49, United States Code, that is owned, leased, or operated by a consumer, but excluding any motor vehicle owned, leased, or operated in a commercial or employment context. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id59f4013eb5e64e2b866bc8d3cd6b9b7b"><enum>(6)</enum><header>Consumer car-related data</header><text>The term <term>consumer car-related data</term> means any information, including derived data and unique identifiers, that is—</text><subparagraph commented="no" display-inline="no-display-inline" id="idaafaa89bb82b4c14b0268be916738aef"><enum>(A)</enum><text display-inline="yes-display-inline">linked or reasonably linkable, alone or in combination with other information, to an identified or identifiable individual or a device; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ideb28f0b008164ec78f8df3d32c91285b"><enum>(B)</enum><text>collected or derived from and describes the historic operation, condition, status, or precise geolocation of a consumer car or its occupants.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id48304394def6479890e33e736409f6c7"><enum>(7)</enum><header display-inline="yes-display-inline">Covered entity</header><text>The term <term>covered entity</term> means any person that collects the consumer car-related data of an individual, including car manufacturers, insurance companies, and companies that collect such data through digital applications. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf6f1cba9b9b44e839ede8baa468fc57a"><enum>(8)</enum><header>Device</header><text>The term <term>device</term> means any electronic equipment capable of collecting, processing, retaining, or transferring consumer car-related data, including such devices equipped on a consumer car.</text></paragraph><paragraph id="id3eace2b0b2ae4a3da72cc04ab2cb72e3"><enum>(9)</enum><header>Precise Geolocation</header><text>The term <term>precise geolocation</term> means information that reveals the past or present physical location of an individual, consumer car, or device with sufficient precision to identify—</text><subparagraph commented="no" display-inline="no-display-inline" id="id518504b0f368431fb6cbefc3ee243009"><enum>(A)</enum><text>street-level location information of such individual, consumer car, or device; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb2c547ce5b114d98a6e2ade9760373e8"><enum>(B)</enum><text>the location of such individual, consumer car, or device within a range of 1,850 feet or less.</text></subparagraph></paragraph></section></legis-body></bill>
