<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>2d Session</session><legis-num>S. 5273</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20240925">September 25, 2024</action-date><action-desc><sponsor name-id="S275">Ms. Cantwell</sponsor> (for herself and <cosponsor name-id="S229">Mrs. Murray</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SLIA00">Committee on Indian Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To take certain land in the State of Washington into trust for the benefit of the Quinault Indian Nation, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H549F632687494EF29F1B17849A0B0537"><section section-type="section-one" id="H5FB03DDF1B61477F9F1ECF2DE893F7AB"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Quinault Indian Nation Land Transfer Act</short-title></quote>.</text></section><section id="H64268B7392224CD38497BE56BDEDA342"><enum>2.</enum><header>Land taken into trust for the benefit of the Quinault Indian Nation</header><subsection id="HB4FF4C8D54E5445486F97959C7FC39EF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to valid existing rights, the approximately 72 acres of land located in the State of Washington and generally depicted as <quote>Allotment 1157</quote> on the map entitled <quote>Quinault Indian Nation Land Transfer Act</quote> and dated February 2, 2024, shall be administratively transferred from the Forest Service to the Department of the Interior and taken into trust for the benefit of the Quinault Indian Nation.</text></subsection><subsection id="HB0C487F30FC24E618BBD4197F3300B71"><enum>(b)</enum><header>Land part of reservation; Administration</header><text>The land taken into trust under subsection (a) shall be—</text><paragraph id="HF0248CC405A94290B96E5A25B45BE9B3"><enum>(1)</enum><text>part of the Quinault Indian Reservation; and</text></paragraph><paragraph id="H2FC23623DC484619A68623FAE0E6D259"><enum>(2)</enum><text>administered by the Secretary of the Interior in accordance with the laws and regulations generally applicable to property held in trust by the United States for an Indian Tribe.</text></paragraph></subsection><subsection id="H7533F1908379405CA7339DBF171745A5"><enum>(c)</enum><header>Gaming prohibited</header><text display-inline="yes-display-inline">The land taken into trust under subsection (a) shall not be eligible for gaming under the Indian Gaming Regulatory Act (<external-xref legal-doc="usc" parsable-cite="usc/25/2701">25 U.S.C. 2701 et seq.</external-xref>).</text></subsection><subsection id="H16588F1FB18D49D6BAEC3932CE6F3605"><enum>(d)</enum><header>No impact on treaty rights</header><text>Nothing in this Act affects treaty rights under the Treaty between the United States and the Qui-nai-elt and Quil-leh-ute Indians, done at the Qui-nai-elt River July 1, 1855, and Olympia January 25, 1856 (12 Stat. 971) (commonly known as the <quote>Treaty of Olympia</quote>).</text></subsection><subsection id="H1FE76A26B1AE48CFBEAFF0B6B07B10B5"><enum>(e)</enum><header>Hazardous materials</header><text>For purposes of the taking of land into trust under subsection (a), the Secretary of the Interior—</text><paragraph id="HF4C7EB4CADBD4286AD18077AA5249C0F"><enum>(1)</enum><text>shall meet disclosure requirements for hazardous substances, pollutants, or contaminants under section 120(h) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9620">42 U.S.C. 9620(h)</external-xref>); and</text></paragraph><paragraph id="H60C48979E3F74008919C741156A234CD"><enum>(2)</enum><text>shall not otherwise be required to remediate or abate those hazardous substances, pollutants, or contaminants.</text></paragraph></subsection></section></legis-body></bill>
