referred to the <committee-name committee-id="SSVA00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 38, United States Code, to establish a commission to review operations at the Veterans Health Administration and submit to Congress reports with respect to that review, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>VetPAC Act of 2024</short-title></quote>.</text></section><section id="idc617234a583b418d9d8f49be8c4ccae6"><enum>2.</enum><header>Establishment of Veterans Health Administration Policy Advisory Commission</header><subsection id="idae35d16be0dd43c7a05d2cf78cabdf4f"><enum>(a)</enum><header>In general</header><text>Subchapter I of chapter 73 of title 38, United States Code, is amended by adding at the end the following new section:</text><quoted-block style="USC" display-inline="no-display-inline" id="id2131DA120C35463C8592AF70B7863B92"><section id="id3c9e00479cec4652966d3cd181fa63df"><enum>7310B. </enum><header>Veterans Health Administration Policy Advisory Commission</header><subsection id="id26ba0536fe054bcb8123ade3ad5fc501"><enum>(a)</enum><header>Establishment</header><text>There is established the Veterans Health Administration Policy Advisory Commission (in this section referred to as the <quote>Commission</quote>).</text></subsection><subsection id="idf3c28273aed24e3b91ccec96801ad5cf"><enum>(b)</enum><header>Membership</header><paragraph commented="no" display-inline="no-display-inline" id="id535609bebf2441e983fdf04904f9c5ce"><enum>(1)</enum><header>Composition</header><text display-inline="yes-display-inline">The Commission shall be composed of 17 members appointed by the Comptroller General of the United States, of which not fewer than 2 shall be veterans.</text></paragraph><paragraph id="id5520c8aac52a4325ad821388ce1b8eb5"><enum>(2)</enum><header>Qualifications</header><subparagraph id="id542af4fe2d2c4083acbda105866fb15b"><enum>(A)</enum><header>In general</header><text>An individual is eligible for appointment to the Commission under paragraph (1) if the individual has significant expertise in operating or advising large medical systems, including expertise in quality of care, staffing issues, information technology, artificial intelligence in health care, medical supply chains, procurement of medical supplies, medical facility construction or leasing, medical facility architecture or engineering, medical research, and managed care plans and networks.</text></subparagraph><subparagraph id="id92d2fe7897d6478195a525cba253e114"><enum>(B)</enum><header>Experience of members</header><text>In appointing members under paragraph (1), the Comptroller General shall select individuals from backgrounds that reflect the broad diversity of health care received by veterans, including nonprofit health systems, public and private health systems, care furnished by the Veterans Health Administration, and care furnished by the Department of Defense.</text></subparagraph></paragraph><paragraph id="id90ce94f4ada84f2888895b6e41feb13e"><enum>(3)</enum><header>Ethical disclosure</header><text>A member of the Commission shall be considered an employee of Congress whose compensation is disbursed by the Secretary of the Senate for purposes of applying subchapter I of chapter 131 of title 5, United States Code, except that a member of the Commission is required to file public financial disclosure reports without regard to their number of days of service or rate of pay. </text></paragraph></subsection><subsection id="id27aab0da367741b4a7e20181be47bfce"><enum>(c)</enum><header>Period of appointment; vacancies</header><paragraph id="idc3f16999ec4347a3ae273964438fa440"><enum>(1)</enum><header>Terms</header><text>A member of the Commission shall be appointed under subsection (b)(1) for a term of 5 years, except that the Comptroller General shall designate staggered terms for the members first appointed.</text></paragraph><paragraph id="id988821b102224df28c96966e5ad90b7a"><enum>(2)</enum><header>Vacancies</header><subparagraph id="ide95551aed8f1410d8cc84ae12272936d"><enum>(A)</enum><header>In general</header><text>A vacancy on the Commission shall be filled in the manner in which the original appointment was made and shall be subject to any conditions that applied with respect to the original appointment.</text></subparagraph><subparagraph id="id9fb153c66f7a47e8a7e71d4cfbb3b9fa"><enum>(B)</enum><header>Filling unexpired term</header><text>An individual chosen to fill a vacancy shall be appointed for the unexpired term of the member replaced.</text></subparagraph></paragraph><paragraph id="id0e8e19aa3e3a4ef28020c25690634aa3"><enum>(3)</enum><header>Expiration of terms</header><text>The term of any member shall not expire before the date on which the member’s successor takes office.</text></paragraph></subsection><subsection id="id59851c930b2143d9aa1f8b4f5bf1c6b0"><enum>(d)</enum><header>Meetings</header><paragraph id="id47ac3255b246445ea0374157d40b1265"><enum>(1)</enum><header>Frequency</header><text>The Commission shall meet at the call of the Chairman, but not less frequently than once per year.</text></paragraph><paragraph id="idd164f8ed03214de787cd8372251bc273"><enum>(2)</enum><header>Quorum</header><text>A majority of the members of the Commission shall constitute a quorum, but a lesser number of members may hold meetings.</text></paragraph></subsection><subsection id="id7f318c4d4fed4d1380692f16eff432a7"><enum>(e)</enum><header>Chairman and Vice Chairman</header><text>The Comptroller General shall designate one member of the Commission as Chairman and one member of the Commission as Vice Chairman, at the time of appointment of such member and for the term of appointment of such member, except that in the case of vacancy of the Chairmanship or Vice Chairmanship, the Comptroller General may designate another member for the remainder of that member’s term.</text></subsection><subsection id="id09904f3a41964d358f93e14db405458b"><enum>(f)</enum><header>Duties of the Commission</header><paragraph id="id6a9a0ef298804a1082aa3548e84928f3"><enum>(1)</enum><header>Review</header><text>The Commission shall—</text><subparagraph id="id61baf74901814a24b88e7c1c5d74510e"><enum>(A)</enum><text>review operations at the Veterans Health Administration; and</text></subparagraph><subparagraph id="id8d72177b6f23406a9576a5ee755b02a5"><enum>(B)</enum><text>prepare reports for Congress based on such review, including recommendations to Congress.</text></subparagraph></paragraph><paragraph id="idfa4e7a795f0649c79e6f7678bc397d00"><enum>(2)</enum><header>Topics to be reviewed</header><text>In conducting a review under paragraph (1)(A), the Commission shall include periodic reviews of the following, taking into consideration other independent assessments in selecting topics to limit duplicative efforts:</text><subparagraph id="idaccf5d5cce774f198abad844a6f2a7f0"><enum>(A)</enum><text>Information technology infrastructure at medical facilities of the Department, including with respect to electronic health record systems.</text></subparagraph><subparagraph id="ida68b3e84b1414f55ba179c700fcdc2ea"><enum>(B)</enum><text>Referrals to care at facilities of the Department and under the Veterans Community Care Program under section 1703 of this title, and factors impacting those referrals.</text></subparagraph><subparagraph id="id805d5a48ab114844846ff2cec66039fa"><enum>(C)</enum><text>Access and wait times at medical facilities of the Department and under the Veterans Community Care Program, including both primary and specialty care, and factors impacting those wait times.</text></subparagraph><subparagraph id="idaa53ebe060934beb8d16ff32c2492c72"><enum>(D)</enum><text>The quality of health care furnished by the Department and through the Veterans Community Care Program.</text></subparagraph><subparagraph id="ida99929c28ced4c21a7accd9f4ad112c4"><enum>(E)</enum><text>Workforce issues, including workforce performance, recruitment, and retention factors.</text></subparagraph><subparagraph id="id400e5f5f277949c9a52d7ff66dce1319"><enum>(F)</enum><text>Patient satisfaction and customer service at medical facilities of the Department and through the Veterans Community Care Program.</text></subparagraph><subparagraph id="idef8e2374c27b4dbd9b503734e768b5f1"><enum>(G)</enum><text>The training of health care providers and the standards of care at facilities of the Department and in the Veterans Community Care Program.</text></subparagraph><subparagraph id="id04999c2b29964443b9b379569a9c1555"><enum>(H)</enum><text>The long-term budgetary outlook of the Veterans Health Administration, as well as key components driving budgetary changes over time.</text></subparagraph><subparagraph id="id9afa644de6bd4173b131aa6961a88b1c"><enum>(I)</enum><text>Procurement of supplies at medical facilities of the Department.</text></subparagraph><subparagraph id="id174f4f59241a47a894909cb5785f20b8"><enum>(J)</enum><text>The research program of the Department, including both internal and external research.</text></subparagraph><subparagraph id="id0708282b3ad141e0bc3e9de30bbab740"><enum>(K)</enum><text>Hospital construction, leasing, and capital requirements.</text></subparagraph><subparagraph id="ida5efd259994d498286f0573ce490e481"><enum>(L)</enum><text>The interaction of care under the Medicare program under title XVIII of the Social Security Act (42 U.S.C. 1395 et seq.), the Medicaid program under title XIX of such Act (42 U.S.C. 1396 et seq.), the TRICARE program under chapter 55 of title 10, and commercial health care plans with care furnished by the Veterans Health Administration.</text></subparagraph></paragraph><paragraph id="id657a2bfa56a24fd7bc4c40a1018d8c2c"><enum>(3)</enum><header>Issues regarding veteran health care delivery generally</header><text>In carrying out the requirements of this subsection, the Commission shall review the effect of policies under this title on the delivery of health care services to veterans and assess the implications of changes in health care delivery for veterans in the United States.</text></paragraph><paragraph id="ide843ffb8a21245ccb7a049d757d0dc81" commented="no"><enum>(4)</enum><header>Transmittal of certain reports</header><text>If the Secretary or the Inspector General of the Department of Veterans Affairs submits to Congress (or a committee of Congress) a report that is required by law and that relates to policies for health care furnished under the laws administered by the Secretary, the Secretary shall transmit a copy of that report to the Commission.</text></paragraph><paragraph id="id50c51c271e624cf3bc1864d8212cb656"><enum>(5)</enum><header>Consultation and additional reviews and studies</header><subparagraph id="idde6176a17b07454eaade6ffb286a3cb5"><enum>(A)</enum><header>Consultation</header><text>In carrying out the requirements of this subsection, the Commission shall consult periodically with the chairmen and ranking members of the Committee on Veterans’ Affairs of the Senate and the Committee on Veterans’ Affairs of the House of Representatives regarding the agenda of the Commission and progress towards achieving that agenda.</text></subparagraph><subparagraph id="idc775cfecfa95462d93ef710384f2fa5a"><enum>(B)</enum><header>Additional reviews and reports</header><text>The Commission may conduct additional reviews, and may submit additional reports to the Committee on Veterans’ Affairs of the Senate and the Committee on Veterans’ Affairs of the House of Representatives, from time to time on such topics relating to the activities of the Commission as may be requested by the Chairman and members  and as the Commission determines appropriate.</text></subparagraph><subparagraph id="id00c1bf72086e4a16ac74c2d94e4ab6c7"><enum>(C)</enum><header>Special studies</header><text>The Commission may conduct special studies requested by the chairman or ranking member of the Committee on Veterans’ Affairs of the Senate or the Committee on Veterans’ Affairs of the House of Representatives and as the Commission determines appropriate.</text></subparagraph></paragraph><paragraph id="id28eabf968ae94f5bae3ba4ff302e708c"><enum>(6)</enum><header>Budgetary considerations</header><text>Before making any recommendations to Congress, the Commission shall examine the budget consequences of such recommendations, directly or through consultation with appropriate expert entities.</text></paragraph><paragraph id="id18f7756329174de7a25c052c14facce1"><enum>(7)</enum><header>Report</header><subparagraph id="ide086a3d0d2b547cdac18b538daa89ff7"><enum>(A)</enum><header>In general</header><text>By not later than March 15 of each year, the Commission shall submit to Congress a report containing the results and recommendations from the review conducted under paragraph (1).</text></subparagraph><subparagraph id="id3cf0fd3d6e5c4d5083ed2af0a940ad0e"><enum>(B)</enum><header>Inclusion of recommendations</header><text>A recommendation may be included in a report under subparagraph (A) if a simple majority of the members of the Commission vote to include the recommendation in the report.</text></subparagraph></paragraph></subsection><subsection id="idbe5e46942d214835acd821b4f2d4c5cf"><enum>(g)</enum><header>Powers of Commission</header><paragraph id="id2f8c1698ccd44b859e2ec66891b89519"><enum>(1)</enum><header>In general</header><text>The Commission may—</text><subparagraph id="idf905f23a2aed409e96e938890e2ece2f"><enum>(A)</enum><text>employ and fix the compensation of an Executive Director (at a rate of pay not greater than that provided for level III of the Executive Schedule under section 5314 of title 5) and such other personnel as may be necessary to carry out the duties of the Commission, without regard to the provisions of title 5 governing appointments in the competitive service;</text></subparagraph><subparagraph id="ideeb90b60f9094724a8daeeb607b509db"><enum>(B)</enum><text>seek such assistance and support as may be required in the performance of its duties from appropriate departments and agencies of the United States or departments or agencies of a State;</text></subparagraph><subparagraph id="id3228c217e5104a4484129df8e42213f6"><enum>(C)</enum><text>enter into contracts or make other arrangements, as may be necessary for the conduct of the work of the Commission (without regard to section 3709 of the Revised Statutes (41 U.S.C. 5));</text></subparagraph><subparagraph id="ide686f558d987447c99d08f0676d8c678"><enum>(D)</enum><text>make advance, progress, and other payments that relate to the work of the Commission;</text></subparagraph><subparagraph id="id60fab117bd844803895ae4eb4cdcca24"><enum>(E)</enum><text>provide transportation and subsistence for individuals serving the Commission without compensation; and</text></subparagraph><subparagraph id="id5c2cf56f947242f5bfe64c17fbfbc943"><enum>(F)</enum><text>prescribe such rules and regulations as the Commission determines necessary with respect to the internal organization and operation of the Commission.</text></subparagraph></paragraph><paragraph id="id7491c9ec97ac461bb346e86cb508acd4"><enum>(2)</enum><header>Data collection</header><text>In order to carry out its functions, the Commission shall—</text><subparagraph id="id702272fdf3b04026a11174219746bb7b"><enum>(A)</enum><text>utilize existing information, both published and unpublished, if possible, collected and assessed either by its own staff or under other arrangements made in accordance with this section;</text></subparagraph><subparagraph id="idc6b64d653b984497bd0f9e3e59ea46a0"><enum>(B)</enum><text>carry out, or award grants or contracts for, original research and experimentation, if existing information is inadequate; and</text></subparagraph><subparagraph id="idd344a110101440a1aef871beae1d1269"><enum>(C)</enum><text>adopt procedures allowing any interested party to submit information for use by the Commission in making reports and recommendations.</text></subparagraph></paragraph><paragraph id="id5bbb8b16dd584d8f9c86d57d40dfda0a"><enum>(3)</enum><header>Information from Federal agencies</header><subparagraph commented="no" display-inline="no-display-inline" id="id892ee2d337f34f9f84d2778757572e49"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Commission may secure directly from any relevant department or agency of the United States health care information the Chairman determines would be helpful to enable the Commission to carry out this section.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6e373ae828c6410f99544f8ffd34ecb4"><enum>(B)</enum><header>Timing</header><text display-inline="yes-display-inline">Upon request of the Chairman, the head of a department or agency of the United States shall furnish information requested under subparagraph (A) to the Commission on an agreed upon schedule or not later than 180 days after the date of the request.</text></subparagraph></paragraph></subsection><subsection id="idb034b182ffc24a249bfc0f108c32bf28"><enum>(h)</enum><header>Compensation</header><paragraph commented="no" display-inline="no-display-inline" id="id98edb80ad9344629a8d29ea522649c56"><enum>(1)</enum><header>Members</header><subparagraph commented="no" display-inline="no-display-inline" id="idb3685957fd7f4e92aeed0a6d3b460dc4"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">While conducting the business of the Commission (including travel time), a member of the Commission shall be entitled to compensation at the per diem equivalent of the rate provided for level IV of the Executive Schedule under section 5315 of title 5.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ida071a23cd033463d8cc3e4e1673a4266"><enum>(B)</enum><header>Travel expenses</header><text display-inline="yes-display-inline">While conducting the business of the Commission away from home and the regular place of business of the member, a member may be allowed travel expenses, as authorized by the Chairman.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfa5bb5abc1274edc9686dc7a5ad95d07"><enum>(2)</enum><header>Physician comparability allowance for personnel</header><text display-inline="yes-display-inline">The Commission may provide a physician comparability allowance to physicians serving as personnel of the Commission in the same manner as physicians of the Federal Government may be provided such an allowance by an agency under section 5948 of title 5, and for such purpose, subsection (i) of such section shall apply to the Commission in the same manner as it applies to the Tennessee Valley Authority.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idccfd187b20384923b04e64018c0c2bd2"><enum>(3)</enum><header>Treatment of personnel</header><text display-inline="yes-display-inline">For purposes of pay (other than pay of members of the Commission) and employment benefits, rights, and privileges, all personnel of the Commission shall be treated as if they were employees of the United States Senate. </text></paragraph></subsection><subsection id="idf86b2c015b994b4ba3ca041fc2d016bf"><enum>(i)</enum><header>Detail of Federal employees</header><text>An employee of the Federal Government may be detailed to the Commission without reimbursement and without interruption or loss of civil service status or privileges.</text></subsection><subsection id="ideed21fedb7134ca29b119f26d225e365"><enum>(j)</enum><header>Access of congressional support agencies to information</header><text>The Commission shall provide to the Comptroller General, the Congressional Research Service, and the Congressional Budget Office unrestricted access to all deliberations, records, and nonproprietary data of the Commission not later than 30 days after such access is requested.</text></subsection><subsection id="idb5e42d58751e475d8d0d451c12b43afb"><enum>(k)</enum><header>Authorization of appropriations</header><paragraph id="id1195d0adf83c4ddebdb62a331ee63022"><enum>(1)</enum><header>Request for appropriations</header><text>The Commission shall submit requests for appropriations in the same manner as the Comptroller General submits requests for appropriations, but amounts appropriated for the Commission shall be separate from amounts appropriated for the Comptroller General.</text></paragraph><paragraph id="idbaa187154c844049b422df87cf006554"><enum>(2)</enum><header>Authorization</header><text>There are authorized to be appropriated such sums as may be necessary to carry out this section.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id7502db2f18e24016a9252a8be924b4b9"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by inserting after the item relating to section 7310A the following new item:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8A1BC90D39404CD8BAA1EB929E10B2C6"><toc><toc-entry level="section" bold="off">7310B. Veterans Health Administration Policy Advisory Commission.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id8cab02be6b3345288871fda56c7b3e77"><enum>(c)</enum><header>Initial appointment</header><text>Not later than 280 days after the date on which amounts are first appropriated to the Veterans Health Administration Policy Advisory Commission established under section 7310B of title 38, United States Code, as added by subsection (a), the Comptroller General of the United States shall make initial appointments of members to the Commission under subsection (b)(1) of such section.</text></subsection></section></legis-body></bill>
