which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish appropriate penalties for cocaine-related offenses, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Start Making Adjustments and Require Transparency in Cocaine Sentencing Act</short-title></quote> or the <quote><short-title>SMART Cocaine Sentencing Act</short-title></quote>.</text></section><section id="id3F0CD6B928314A24ABE3CE3B32F2D1D5"><enum>2.</enum><header>Penalties for cocaine-related offenses</header><subsection id="id848a98c8b0e64ff7a17fefab01555288"><enum>(a)</enum><header>In general</header><paragraph id="id3560a69bd60e4570b5b35b15d62fa6cd"><enum>(1)</enum><header>Controlled substances act</header><text>Section 401(b)(1) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/841">21 U.S.C. 841(b)(1)</external-xref>) is amended—</text><subparagraph id="id70fef705a7e34765b5c0c6295a7697bb"><enum>(A)</enum><text>in subparagraph (A)—</text><clause id="id134e074c2d2343fe8837ce018b7a193b"><enum>(i)</enum><text>in clause (ii), in the matter preceding subclause (I), by striking <quote>5 kilograms</quote> and inserting <quote>4 kilograms</quote>; and</text></clause><clause id="ide8bad1cc330f43c491203d7e676ea3ff"><enum>(ii)</enum><text>in clause (iii), by striking <quote>280 grams</quote> and inserting <quote>1,600 grams</quote>; and</text></clause></subparagraph><subparagraph id="id318a4dd63161425daea98912f2cc8ed9"><enum>(B)</enum><text>in subparagraph (B)—</text><clause id="ida3026f6093084a609956185cce9b8c15"><enum>(i)</enum><text>in clause (ii), in the matter preceding subclause (I), by striking <quote>500 grams</quote> and inserting <quote>400 grams</quote>; and</text></clause><clause id="id41f9b77b19214c59bbff88c0f16426a6"><enum>(ii)</enum><text>in clause (iii), by striking <quote>28 grams</quote> and inserting <quote>160 grams</quote>.</text></clause></subparagraph></paragraph><paragraph id="id0549f1b2e0114e24b3a252a647912ae0"><enum>(2)</enum><header>Controlled substances import and export act</header><text>Section 1010(b) of the Controlled Substances Import and Export Act (<external-xref legal-doc="usc" parsable-cite="usc/21/960">21 U.S.C. 960(b)</external-xref>) is amended—</text><subparagraph id="id4f423a44688d4d0dbba607e79ec862e2"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="id7846934ee045476781abd214b2eed488"><enum>(i)</enum><text>in subparagraph (B), in the matter preceding clause (i), by striking <quote>5 kilograms</quote> and inserting <quote>4 kilograms</quote>;</text></clause><clause id="ide8fac4758b87473b977bd762ab0792c3"><enum>(ii)</enum><text>in subparagraph (C), by striking <quote>280 grams</quote> and inserting <quote>1,600 grams</quote>; and</text></clause><clause id="id6c01bf58e30a45c49c2fb7e3138a09e8"><enum>(iii)</enum><text>in subparagraph (H), by striking the period at the end and inserting a semicolon; and</text></clause></subparagraph><subparagraph id="id28d1d084e6bf46b1b518660e6995e9c6"><enum>(B)</enum><text>in paragraph (2)—</text><clause id="idac78c59bca5b4c34967ec6809f529f68"><enum>(i)</enum><text>in subparagraph (B), in the matter preceding clause (i), by striking <quote>500 grams</quote> and inserting <quote>400 grams</quote>;</text></clause><clause id="ideec1fd9738b04ed5b13d84713b75f19a"><enum>(ii)</enum><text>in subparagraph (C), by striking <quote>28 grams</quote> and inserting <quote>160 grams</quote>; and</text></clause><clause id="idde2401313f564b058b818a55092930dd"><enum>(iii)</enum><text>in subparagraph (H), by striking the period at the end and inserting a semicolon.</text></clause></subparagraph></paragraph></subsection><subsection id="id216f8c45ba28458ab9cb6444339e4a1b"><enum>(b)</enum><header>Attorney General certification</header><paragraph id="id3197578218c0495f9309338e9b54dc55"><enum>(1)</enum><header>In general</header><text>For a defendant sentenced before the date of enactment of this Act, the Attorney General shall submit to the court that sentenced the defendant a certification regarding whether, in the opinion of the Attorney General, the sentence of the defendant should be reduced, as if the amendments made by subsection (a) were in effect at the time the offense was committed. In making a certification under this paragraph, the Attorney General shall consider the factors in section 3553(a) of title 18, United States Code.</text></paragraph><paragraph id="ide2ec9166f1454c1185c82d69d9cf421c"><enum>(2)</enum><header>Resentencing</header><text>If the Attorney General submits a certification under paragraph (1) indicating that, in the opinion of the Attorney General, the sentence of the defendant should be reduced, as if the amendments made by subsection (a) were in effect at the time the offense was committed, the court that imposed the sentence of the defendant may impose such a reduced sentence. </text></paragraph></subsection></section><section id="id1F29B6219B9D48F3ADE5155645088D49"><enum>3.</enum><header>Federal research</header><subsection id="idc436a064a793463a8225a53df8772dce"><enum>(a)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Attorney General, in coordination with the Administrator of the Drug Enforcement Administration and the Secretary of Health and Human Services, shall review and submit to the Committee on the Judiciary and the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on the Judiciary and the Committee on Energy and Commerce of the House of Representatives a report on—</text><paragraph id="id2eb12baa51404f4fa5041a27209935ee"><enum>(1)</enum><text>the average individual dosage amount of both powder cocaine and cocaine base;</text></paragraph><paragraph id="iddc4d5d60fff342c09bc0f7f5ea88f56b"><enum>(2)</enum><text>the lethality of both powder cocaine and cocaine base as measured by individual dosage;</text></paragraph><paragraph id="ide86e8f560da34737b200f2d14d407e2a"><enum>(3)</enum><text>the impact on lethality that polysubstance use, specifically as to synthetic drugs such as fentanyl and fentanyl-related substances, has on both powder cocaine and cocaine base users;</text></paragraph><paragraph id="idace1fe77f4e34f90923a9642388342af"><enum>(4)</enum><text>the addictiveness of both powder cocaine and cocaine base;</text></paragraph><paragraph id="id4daea62ef1584ecbb2ca015e02ee013c"><enum>(5)</enum><text>the violence attributed to or associated with both powder cocaine and cocaine base, which may include but is not limited to, criminal charges, statutory enhancements, criminal history, and recidivism data; and</text></paragraph><paragraph id="idf6697712075b48c798686ac504646d2c"><enum>(6)</enum><text>the impact on addictiveness that polysubstance use, specifically as to synthetic drugs such as fentanyl and fentanyl-related substances, has on both powder cocaine and cocaine base users.</text></paragraph></subsection><subsection id="id1f22d896d2e445e3997a152a0af77bcc"><enum>(b)</enum><header>Report by United States sentencing commission</header><paragraph id="id9e8ea4a6d2c645e6982afece7f87462b"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the United States Sentencing Commission shall submit to Congress and publicly issue a report regarding cocaine offenses and offenders. </text></paragraph><paragraph id="id6e7c1ecc5d54495e87168d8ccb12c5b9"><enum>(2)</enum><header>Contents</header><text>The report under paragraph (1) shall include—</text><subparagraph id="idce426a8928504a0c83a08e856c38a53e"><enum>(A)</enum><text>an analysis of data available to the Commission on Federal cocaine offenses and offenders;</text></subparagraph><subparagraph id="idc356bff3f2564ca3a6f984d3b5f79734"><enum>(B)</enum><text>an updated description of the forms of cocaine, methods of use, effects, dependency potential, effects of prenatal exposure, and prevalence of cocaine use;</text></subparagraph><subparagraph id="iddbce0f0ada464418b713503366ef6feb"><enum>(C)</enum><text>an updated description of trends in cocaine trafficking patterns, price, and use;</text></subparagraph><subparagraph id="idedd06db450cd43d083826060d1ffd313"><enum>(D)</enum><text>a review of State sentencing policies and an examination of the interaction of State penalties with Federal prosecutorial decisions;</text></subparagraph><subparagraph id="id0580da3237e946a1ab1b6750fedc8d0b"><enum>(E)</enum><text>a review of recent Federal case law developments relating to Federal cocaine sentencing; and</text></subparagraph><subparagraph id="ide34f1abde9fe4725a5aebb1c5e8fa7a3"><enum>(F)</enum><text>recommendations to Congress.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
