which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Energy Policy Act of 2005 to limit Federal funding of the procurement of certain buses under the Clean School Bus program, and for other purposes.</official-title></form><legis-body><section id="id7642D7F7605145FA92B5BC35E42BA205" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Secure School Buses Act of 2024</short-title></quote>.</text></section><section id="id7ED29E72843E4729B082190F427871AD"><enum>2.</enum><header>Limitation on procurement under Clean School Bus program</header><text display-inline="no-display-inline">Section 741 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16091">42 U.S.C. 16091</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="idadaa24c2392b45228299819f4cceab12"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id2fd4f4f5e36f4a05b1467a8658fe4b1a"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating paragraph (8) as paragraph (9); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id79012f9e12d0481398d9f04ed3ca4561"><enum>(B)</enum><text>by inserting after paragraph (7) the following:</text><quoted-block display-inline="no-display-inline" id="id67443f4fee724f5c803f763addad8bdc" style="OLC"><paragraph id="iddff23d067aeb4e5890f842c53209e0b9"><enum>(8)</enum><header>Limitation on procurement of certain school buses</header><subparagraph id="idc7681321fa644428adec869486cf662a"><enum>(A)</enum><header>Limitation on use</header><text>Except as provided in subparagraph (C), financial assistance made available under this subsection shall not be used in awarding a contract or subcontract to an entity on or after the date of enactment of the <short-title>Secure School Buses Act of 2024</short-title> for the procurement of a school bus for use in accordance with paragraph (5) if the manufacturer of the school bus is owned or controlled by, is a subsidiary of, is contractually tied to, or is otherwise related legally or financially to a corporation based in a country that—</text><clause id="idcef76d6c02e344c380187c419a8fd40e"><enum>(i)</enum><text>is identified as a nonmarket economy country (as defined in section 771(18) of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1677">19 U.S.C. 1677(18)</external-xref>)) as of the date of enactment of the <short-title>Secure School Buses Act of 2024</short-title>;</text></clause><clause id="idf6c7c765426941baadd72a6b0c4d1ebe"><enum>(ii)</enum><text>was identified by the United States Trade Representative in the most recent report required by section 182 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2242">19 U.S.C. 2242</external-xref>) as a priority foreign country under subsection (a)(2) of that section; and</text></clause><clause id="id2db571f5fd194a9189fc2bc5f234cf7e"><enum>(iii)</enum><text>is subject to monitoring by the United States Trade Representative under section 306 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2416">19 U.S.C. 2416</external-xref>).</text></clause></subparagraph><subparagraph id="id88ab716124a44d76b29a6a1e74dd387a"><enum>(B)</enum><header>International agreements</header><text>This paragraph shall be applied in a manner consistent with the obligations of the United States under international agreements.</text></subparagraph><subparagraph id="idb7bb6af5652e4645b5daa831701efc84"><enum>(C)</enum><header>Exceptions</header><clause commented="no" display-inline="no-display-inline" id="iddbe80685db3848e8b13923e12b5d5613"><enum>(i)</enum><header display-inline="yes-display-inline">Prior contracts</header><subclause commented="no" display-inline="no-display-inline" id="id57fe9a042b4c4d76a13a30995b14b9b3"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to subclause (II), this paragraph shall not apply to any contract or subcontract made by an eligible recipient with a school bus manufacturer described in subparagraph (A) if the manufacturer and the eligible recipient have a contract for school bus procurement that was executed before the date of enactment of the <short-title>Secure School Buses Act of 2024</short-title>.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idd2dbb496884f4f6fba0374acbca3d8bf"><enum>(II)</enum><header>Exclusion</header><text display-inline="yes-display-inline">For purposes of subclause (I), the term <term>contract or subcontract</term> does not include an option, an amendment, or an extension of the original contract that is exercised or executed on or after the date of enactment of the <short-title>Secure School Buses Act of 2024</short-title>.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="ide854cf3c61234bf68d420bbda1fd9981"><enum>(ii)</enum><header>Minority relationships and investments</header><subclause commented="no" display-inline="no-display-inline" id="iddd7cc6b9aaa94129add2bf0436cdb3bb"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">For purposes of this paragraph but subject to subclause (II), the term <term>otherwise related legally or financially</term> does not include—</text><item commented="no" display-inline="no-display-inline" id="id3475147b0b0a4cd08433ba0c50b07abe"><enum>(aa)</enum><text display-inline="yes-display-inline">a minority relationship or investment; or</text></item><item commented="no" display-inline="no-display-inline" id="id2c93f6d37623481d8ed2c4b2fcad01fa"><enum>(bb)</enum><text display-inline="yes-display-inline">a relationship with or investment in a subsidiary, joint venture, or other entity based in a country described in subparagraph (A) that does not export school buses for use in the United States.</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="id1792972576eb4bd8801f9aad966a2624"><enum>(II)</enum><header>Corporations based in the People's Republic of China</header><text display-inline="yes-display-inline">Notwithstanding subclause (I)(aa), for purposes of this paragraph, the term <term>otherwise related legally or financially</term> includes a minority relationship or investment if the relationship or investment involves a corporation based in the People's Republic of China.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5ca6ccd327574d7e8006f8836fdc5336"><enum>(2)</enum><text>in subsection (c)(3)(E), by striking <quote>subsection (b)(7)</quote> and inserting <quote>subsection (b)(9)</quote>.</text></paragraph></section></legis-body></bill>
