<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>1st Session</session><legis-num>S. 519</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20230216">February 16, 2023</action-date><action-desc><sponsor name-id="S396">Mrs. Blackburn</sponsor> (for herself, <cosponsor name-id="S395">Mrs. Hyde-Smith</cosponsor>, <cosponsor name-id="S416">Mrs. Britt</cosponsor>, <cosponsor name-id="S397">Mr. Braun</cosponsor>, and <cosponsor name-id="S381">Mr. Rounds</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit individuals charged with or convicted of human trafficking or drug trafficking offenses committed near the border of the United States from receiving Federal benefits.</official-title></form><legis-body><section id="id03E859E29F4A49F1AF48710ADDD07CA9" section-type="section-one"><enum>1.</enum><header>Prohibition on Federal benefits for human traffickers and drug traffickers</header><subsection id="id1359E3673C4C48CAB5FC026981EE2662"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section—</text><paragraph id="id5C4EAD049FDB499AADBD8B6C098D96FE"><enum>(1)</enum><text>the term <term>covered trafficking offense</term> means a human trafficking offense or a drug trafficking offense for which any portion of the course of conduct constituting the human trafficking offense or drug trafficking offense occurred at an international border of the United States or within the territorial waters of the United States; </text></paragraph><paragraph id="id0B48C0B3AE3145AD9F605168ED25FA61"><enum>(2)</enum><text>the term <term>drug trafficking offense</term> means any Federal offense that includes as an element of the offense the distribution of a controlled substance (as defined in section 102 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>)); </text></paragraph><paragraph id="id5447e80374c646bcb13ed146b8b49043"><enum>(3)</enum><text>the term <term>Federal benefit</term>—</text><subparagraph id="idf7f95eb71e7a4930b6c5b28602627f05"><enum>(A)</enum><text>means the issuance of any grant, contract, loan, professional license, or commercial license provided by an agency of the United States or by appropriated funds of the United States; and</text></subparagraph><subparagraph id="id5e614ca9a9434c3798f57298afede6bf"><enum>(B)</enum><text>includes any retirement, welfare, Social Security, health, disability, veterans, public housing, or other similar benefit; and</text></subparagraph></paragraph><paragraph id="id2D17AFEE93DF449CB5C8DF444C0EF8B4"><enum>(4)</enum><text>the term <term>human trafficking offense</term> means an offense under— </text><subparagraph id="idCBC066504C854F9F96090F21FB13C6FB"><enum>(A)</enum><text>section 1581, 1583, 1584, 1589, 1590, 1591, 2251A, 2421, 2422, or 2423 of title 18, United States Code; or </text></subparagraph><subparagraph id="id991AA05D181C4CFCAFF7684DC4DA82AF"><enum>(B)</enum><text>section 274(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1324">8 U.S.C. 1324(a)</external-xref>). </text></subparagraph></paragraph></subsection><subsection id="id6B318A7B92934E0C91D422ADFCB48B4B"><enum>(b)</enum><header>Prohibition on benefits</header><text>An individual who is indicted for, charged in an information with, or convicted of a covered trafficking offense shall be ineligible for any Federal benefit.</text></subsection><subsection id="id8CD622A1F2334410AE3AEFB92DBBB68C"><enum>(c)</enum><header>Termination of prohibition for individuals not convicted</header><text>If, for each covered trafficking offense with which an individual is charged, the charge is dismissed or the individual is found not guilty of the covered trafficking offense—</text><paragraph id="idB6950C3B190540B89F77449A12576A5E"><enum>(1)</enum><text>the ineligibility of the individual for any Federal benefit under subsection (b) shall terminate; and</text></paragraph><paragraph id="id546D6DFEB3C44AF995F8048AF58E0439"><enum>(2)</enum><text>the Federal Government shall pay to the individual any pecuniary Federal benefit that was not paid to the individual because the individual was ineligible for the Federal benefit under subsection (b). </text></paragraph></subsection></section></legis-body></bill>
