Code of 1986 to establish a tax credit for Qualified Community College Bonds, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Community College Infrastructure Financing Act</short-title></quote>.</text></section><section id="id751B1735F85C43849694BC1FB81D8385"><enum>2.</enum><header>Tax Credit for Qualified Community College Bonds</header><subsection id="idABC9BB93CC604444B08517C1051CEB7E"><enum>(a)</enum><header>In general</header><text>Part IV of subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by inserting after subpart G the following new subpart:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id908AA89681C941168A7C4DBDF0588D49"><subpart id="idEF02943EA362478B9AB5F2944C9C3464" style="OLC"><enum>H</enum><header>Qualified Community College Bonds</header><section id="id6E1DDE1B39A14FE9B79B6A54D932F707"><enum>54.</enum><header>Qualified Community College Bonds</header><subsection id="id9E0332469C6A4F1888D6DC118FC7BFC2"><enum>(a)</enum><header>Qualified community college bonds</header><text>For purposes of this subchapter, the term <term>qualified community college bond</term> means any bond issued as part of an issue if—</text><paragraph id="id8FEF121F4DE24CB3B5C62CB5C7751417"><enum>(1)</enum><text>95 percent of the available project proceeds of such issue are to be used for a qualified purpose with respect to a qualified community college,</text></paragraph><paragraph id="idA45CE1683F0B4D5881293A51D8B67234"><enum>(2)</enum><text>the bond is issued by a State, local, or Indian tribal government in consultation with the jurisdictions of which such college is located, and</text></paragraph><paragraph id="idAEDFCBBC5B5B40B1BE5657C5A9E85F24"><enum>(3)</enum><text>the issuer—</text><subparagraph id="idA5ABD6EA1B1D4D17AEAD9D77F6A0A5FF"><enum>(A)</enum><text>designates such bond for purposes of this section, and</text></subparagraph><subparagraph id="idD328F8DED10145329D673ADBF92ABA82"><enum>(B)</enum><text>certifies that it has the written approval of the governing body and the State higher education agency for such bond issuance.</text></subparagraph></paragraph></subsection><subsection id="idF96ACD9A3EE7441DB0350488F796C7DA"><enum>(b)</enum><header>Limitation on amount of bonds designated</header><paragraph id="id99B098E426564DD7ACA9B3984A2F8697"><enum>(1)</enum><header>National limitation</header><text>There is a national community college bond limitation of $1,000,000,000 for each calendar year.</text></paragraph><paragraph id="idF15455166B254715BE62F119E67FA05C"><enum>(2)</enum><header>Allocation of limitation</header><subparagraph id="id1798E99FC49E445A80159F6151D79712"><enum>(A)</enum><header>In general</header><text>The national community college bond limitation for a calendar year shall be allocated by the Secretary to any governing body which—</text><clause id="idB846EE75EDFF4EEC842A0C0FAA940663"><enum>(i)</enum><text>has submitted an application described in subparagraph (C), and </text></clause><clause id="id35382CEDF7824737A5283B60C396457E"><enum>(ii)</enum><text>pursuant to the considerations described in subparagraphs (C) and (D), the Secretary (in consultation with the Secretary of Education) has approved an allocation of such limitation under this paragraph.</text></clause></subparagraph><subparagraph id="id54A70B045A764A4EB5BE051EFF1B79C4"><enum>(B)</enum><header>Cumulative limitation per State</header><text>For purposes of subparagraph (A), the total amount of allocations made to qualified community colleges located with a State for any calendar year shall not exceed an amount equal to 10 percent of the national community college bond limitation for such calendar year.</text></subparagraph><subparagraph id="id0A2E555AF297433A8C962E939501DB48"><enum>(C)</enum><header>Applications</header><text>An application described in this subparagraph shall include such information as the Secretary (in consultation with the Secretary of Education) may require, including the following:</text><clause commented="no" display-inline="no-display-inline" id="id6f5b48995cea460fa82a718a6382d6e3"><enum>(i)</enum><text>A description of—</text><subclause id="id03EC72E53F934238984546EB2588F74A"><enum>(I)</enum><text>the financial sustainability of the proposal, including how the governing body will leverage other sources of funding, and</text></subclause><subclause id="id75555CCB0BE64067AE5EE9567C1EFA99"><enum>(II)</enum><text>how the qualified purposes proposed with respect to the qualified community college will fill an unmet need within a qualified area.</text></subclause></clause><clause id="idCBA6E293942D46E880564AB3AA3FE0C8"><enum>(ii)</enum><text>Any relevant approvals with respect to the proposal that have been granted by any applicable State, local, or Indian Tribal government or appropriate accrediting body.</text></clause><clause commented="no" display-inline="no-display-inline" id="idf5d4411bcd8d4dc39a89221186537af6"><enum>(iii)</enum><text>A certification that the governing body—</text><subclause commented="no" display-inline="no-display-inline" id="id8313ed1ed48943a9a85653e69df1b26e"><enum>(I)</enum><text display-inline="yes-display-inline">has consulted with the jurisdictions in which the qualified community college is, or will be, located, and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idf955ed657c9646939cf06cedb0a1b791"><enum>(II)</enum><text>has the written approval of the State higher education agency for the proposal.</text></subclause></clause><clause id="idE18524BA5C884A3BB5CFFB82A88FDAFA"><enum>(iv)</enum><text>In the case of an application proposing to establish a new qualified community college, in addition to the requirements described in clauses (i), (ii), and (iii)—</text><subclause id="id3B8E7B5A9AAA4355936F58F78E30018E"><enum>(I)</enum><text>whether such proposal has received approval from the State higher education agency, and </text></subclause><subclause id="id2C0149F4DACF47E290A306570C66FD1D"><enum>(II)</enum><text>a description of the sustainability of such qualified community college, including any commitment from any State, local, or Indian Tribal government to provide additional funding for such college.</text></subclause></clause></subparagraph><subparagraph id="id4C4D490A965442EC95ACC0AE373C7EE1"><enum>(D)</enum><header>Priority for allocations</header><text>For purposes of making allocations under this paragraph, the Secretary (in consultation with the Secretary of Education) shall—</text><clause commented="no" display-inline="no-display-inline" id="id7b15fce485ba45c5a23e350cfbe8e5b1"><enum>(i)</enum><text display-inline="yes-display-inline">give highest priority to any proposed qualified community college which will serve the residents of—</text><subclause id="id5741D28846D5462EBA1905BD02C2F2B1"><enum>(I)</enum><text>the State's largest metropolitan statistical area which does not contain an institution described in subsection (c)(5)(A), or</text></subclause><subclause id="id7299F4A9CC304FB9B48A088324952FEE"><enum>(II)</enum><text>if subclause (I) does not apply, the largest micropolitan statistical area within such State which does not contain an institution described in such subsection,</text></subclause></clause><clause id="id5DCD5735358E471FBAA86BFDCB1B7067"><enum>(ii)</enum><text>after application of clause (i), give high priority to any governing body which—</text><subclause commented="no" display-inline="no-display-inline" id="id5ccd9a6cd1e440d4b9a0d6999c5eacee"><enum>(I)</enum><text display-inline="yes-display-inline">has or will have a partnership with—</text><item commented="no" id="idDAAD3505142F4E649B27D705D18C83A4"><enum>(aa)</enum><text>1 or more local high schools (as defined in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>)), including a dual or concurrent enrollment program (as defined in such section),</text></item><item commented="no" id="id432BC0C9EE664C2C81DC165FB950BCE6"><enum>(bb)</enum><text>a 4-year institution of higher education that includes a credit-transfer agreement or articulation agreement (as defined in section 486A(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1093a">20 U.S.C. 1093a(a)</external-xref>)) for students at the qualified community college, or </text></item><item id="idF6DE00610CA14F21A06F0A3EE6433681"><enum>(cc)</enum><text>a State workforce development board established under section 101 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3111">29 U.S.C. 3111</external-xref>), or</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="id0f8b55fee18a44f8b1a442d27705392c"><enum>(II)</enum><text>is the governing body of, or has or will have a partnership with, an institution which is—</text><item id="id2e4f3499cdc84572a473c364660a8e9c"><enum>(aa)</enum><text>a part B institution (as defined in section 322 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1061">20 U.S.C. 1061</external-xref>)),</text></item><item id="id05eb9b127d7b4e40991258ca56337344"><enum>(bb)</enum><text>a Historically Black Graduate Professional School (as identified in section 326(e) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1063b">20 U.S.C. 1063b(e)</external-xref>)),</text></item><item id="id965730141a784566b051a25a9913666f"><enum>(cc)</enum><text>a Hispanic-serving institution (as defined in section 502(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1101a">20 U.S.C. 1101a(a)</external-xref>)),</text></item><item id="id557a5f3bcfed475887d603ec1624ed5d"><enum>(dd)</enum><text>a Tribal College or University (as defined in section 316(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1059c">20 U.S.C. 1059c(b)</external-xref>)),</text></item><item id="id0979e79681f8442eaade485ad7b94004"><enum>(ee)</enum><text>an Alaska Native-serving institution or a Native Hawaiian-serving institution (as such terms are defined in section 317(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1059d">20 U.S.C. 1059d(b)</external-xref>)),</text></item><item id="id4efc34e20e524fbd934d90f2ac6b6a86"><enum>(ff)</enum><text>a Predominantly Black institution (as defined in section 371(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1067q">20 U.S.C. 1067q(c)</external-xref>)),</text></item><item id="id24a21bdf52cf4e29af3cbe2c3a50f7fc"><enum>(gg)</enum><text>an Asian American and Native American Pacific Islander-serving institution (as defined in section 371(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1067q">20 U.S.C. 1067q(c)</external-xref>)), or</text></item><item id="idd6f11b30541d4dc2b5f4488d732dce28"><enum>(hh)</enum><text>a Native American-serving nontribal institution (as defined in section 371(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1067q">20 U.S.C. 1067q(c)</external-xref>)), and</text></item></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id333dcab90608447cb2a5d8c76f253cbe"><enum>(iii)</enum><text display-inline="yes-display-inline">after application of clauses (i) and (ii), give priority to any governing body which, in carrying out a new construction or renovation project using any available project proceeds from the issuance of any qualified community college bond, plans to use not less than 80 percent of such proceeds for construction or renovation that is certified, verified, or consistent with the applicable provisions of—</text><subclause id="id4A0F845597324BF790BDC6776B85C109"><enum>(I)</enum><text>the Leadership in Energy and Environmental Design green building rating standard of the United States Green Building Council,</text></subclause><subclause id="id0E72CAD937C14C44A4AC7011AF603E07"><enum>(II)</enum><text>the Living Building Challenge green building certification program developed by the International Living Future Institute,</text></subclause><subclause id="idF01AAB36F20C48A48A61247E127A2F3A"><enum>(III)</enum><text>a green building rating program developed by the Collaborative for High-Performance Schools that is designated as CHPS Verified, or</text></subclause><subclause id="idFE4C5DB3C03C438393BB5F7FDD6DE796"><enum>(IV)</enum><text>a green building program that—</text><item id="id17CEE11A15DC43B88C309003EB58E04C"><enum>(aa)</enum><text>has standards that are equivalent to or more stringent than the standards of a program described in subclause (I), (II), or (III),</text></item><item id="id428CE0E324954202861BAAA34289B873"><enum>(bb)</enum><text>is adopted by the State or another jurisdiction with authority over the qualified community college, and</text></item><item id="id0F040EF880FF4CED9C9EBEBAFF39FEAE"><enum>(cc)</enum><text>includes a verifiable method to demonstrate compliance with the program. </text></item></subclause></clause></subparagraph></paragraph><paragraph id="idE0632872F81D44CDA8B7B645D2BC4E60"><enum>(3)</enum><header>Designation subject to limitation amount</header><text>The maximum aggregate face amount of bonds issued during any calendar year which may be designated under subsection (a) with respect to any qualified community college shall not exceed the limitation amount allocated to the governing body of such college under paragraph (2) for such calendar year.</text></paragraph></subsection><subsection id="id02F56636A3E1447697A8F18DF104BCD8"><enum>(c)</enum><header>Definitions</header><text>For purposes of this section—</text><paragraph id="idDA13097CCC764C5081F70D01C91252F7"><enum>(1)</enum><header>Governing body</header><text>The term <term>governing body</term> means—</text><subparagraph id="id70D42825ED744A2DA03392859D29586E"><enum>(A)</enum><text>the board of trustees or other governing organization of a qualified community college, or</text></subparagraph><subparagraph id="idC18D45D5AA054C3396BA3ACB48A1684C"><enum>(B)</enum><text>a State, local, or Indian Tribal government (or any political subdivision thereof), or any combination of local educational agencies or municipalities, that participates or proposes to participate in the establishment and operation of a qualified community college.</text></subparagraph></paragraph><paragraph id="id5BB901EF3BF14BC48D50DEE128081C95"><enum>(2)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term> has the meaning given the term in section 101(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>).</text></paragraph><paragraph id="idD22F1BE4630A420E98E37856B0079AD9"><enum>(3)</enum><header>Local educational agency</header><text>The term <term>local educational agency</term> has the meaning given the term in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>), except such term shall include any elementary school or secondary school funded by the Bureau of Indian Education, notwithstanding section 8101(30)(C) of such Act.</text></paragraph><paragraph id="id9F3DDAD7D09F4062A5FD9121BBE72416"><enum>(4)</enum><header>Qualified area</header><text>The term <term>qualified area</term> means any of the following:</text><subparagraph id="id6699858D19C3410FA4CC5B196D190E7B"><enum>(A)</enum><text>A city, metropolitan statistical area, or county that does not contain any institution described in paragraph (5)(A).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id144596EAD0884D1B82AA250BE0022C61"><enum>(B)</enum><text>A low-income community (as defined in section 45D(e)). </text></subparagraph></paragraph><paragraph id="idFF4C00F21AD74FDB9D81075A09F19DC3"><enum>(5)</enum><header>Qualified community college</header><text>The term <term>qualified community college</term> means a public institution of higher education—</text><subparagraph id="idD093C441300B4676ADA7B5C52F6428CA"><enum>(A)</enum><text>at which the highest degree that is predominantly awarded to students is an associate degree (including 2-year tribally controlled colleges under section 316 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1059c">20 U.S.C. 1059c</external-xref>) and public 2-year institutions of higher education),</text></subparagraph><subparagraph id="idBD9C555DC63D4962BBC47F54B428FDF3"><enum>(B)</enum><text>that is established by and operated under the supervision of a governing body in conjunction with the State, local, and Indian tribal governments whose residents will be served by such institution, and</text></subparagraph><subparagraph id="id1A60950E4E3A4CE7AFB74C3BE18005EC"><enum>(C)</enum><text>that is located within a qualified area.</text></subparagraph></paragraph><paragraph id="id5BF76E20A8D242859EDAD6BE602782B9"><enum>(6)</enum><header>Qualified purpose</header><text>The term <term>qualified purpose</term> means—</text><subparagraph id="id64615B2A22CD4E7C8F772F801E8BF091"><enum>(A)</enum><text>establishing and operating a qualified community college,</text></subparagraph><subparagraph id="idEC7FB6DC63CA42279D3AA3BF89498224"><enum>(B)</enum><text>expanding an existing qualified community college to a qualified area,</text></subparagraph><subparagraph id="idD53633265D3B4C2887B66E3FC8E92352"><enum>(C)</enum><text>constructing, rehabilitating, repairing, upgrading, enhancing, or expanding any facility owned or to be used by a qualified community college to carry out the educational purposes (including instructional and research purposes) of such college,</text></subparagraph><subparagraph id="idAA977AA2C2CC45929522FBEE1765BA8F"><enum>(D)</enum><text>providing equipment for use by students at a qualified community college,</text></subparagraph><subparagraph id="id20841647597447F2919DAD9EB25274F4"><enum>(E)</enum><text>investing in online resources or broadband access projects to deliver community college services to qualified areas, or developing course materials for education to be provided by a qualified community college, provided that such uses do not collectively account for more than 10 percent of the amount allocated under subsection (b)(2) to the governing body for such college,</text></subparagraph><subparagraph id="id4D184B5346E44789A4A6F6FD111FBE8B"><enum>(F)</enum><text>training professors and other school personnel at a qualified community college, provided that such use does not account for more than 5 percent of the amount allocated under subsection (b)(2) to the governing body for such college, </text></subparagraph><subparagraph id="id777CE9184A054B98B8B362D7B07BFDE6"><enum>(G)</enum><text>constructing, rehabilitating, repairing, upgrading, enhancing, or expanding any on-campus facility to be used by a qualified community college to—</text><clause id="idD1C5F5B520CE44C8AE207838C3F058AC"><enum>(i)</enum><text>provide childcare to students and staff, provided that such use does not account for more than 10 percent of the amount allocated under subsection (b)(2) to the governing body for such college, or</text></clause><clause id="idB6790C567D4C446A9AB9D2BFBC0833F3"><enum>(ii)</enum><text>provide affordable housing, with a priority given to students and staff, and</text></clause></subparagraph><subparagraph id="id8CCA29611AB04E01A281623184B8F24D"><enum>(H)</enum><text>connecting students with transportation to a qualified community college, including partnering with public transit providers to—</text><clause id="id4DC5FAA75AD94BF283D0A1BEBEE3830C"><enum>(i)</enum><text>add bus, rail, or paratransit stops at or within walking distances of the campus,</text></clause><clause id="idCCF478EC7ABF40A19E28934C899AFAF5"><enum>(ii)</enum><text>add bus, rail, or paratransit routes to allow for transportation between the campus and surrounding areas and other cities,</text></clause><clause id="idBF6432AC8B194843A355006ED65013D7"><enum>(iii)</enum><text>increase the frequency of service or adjust the schedules for bus, rail, or paratransit routes to allow students to get to and from their classes, and</text></clause><clause id="id4BCBFD1AA608494C826B2F44DEBA1BD7"><enum>(iv)</enum><text>subsidize bus, rail, or paratransit costs for students.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idaafa862d2d2143d08d36b698f5e7c8eb"><enum>(7)</enum><header>State</header><text>The term <term>State</term> includes the District of Columbia, the Commonwealth of Puerto Rico, the Virgin Islands, Guam, American Samoa, and the Commonwealth of the Northern Mariana Islands.</text></paragraph><paragraph id="idC155C762EC714E12B6A1D73FC5ACF484"><enum>(8)</enum><header>State higher education agency</header><text>The term <term>State higher education agency</term> means the officer or agency primarily responsible for the State supervision of higher education.</text></paragraph></subsection><subsection id="id8336BC58FE584C1BA969047F2758CFC7"><enum>(d)</enum><header>Application of certain labor standards to projects financed with qualified community bonds</header><paragraph id="idC9617E65981844A287C7B05368A05876"><enum>(1)</enum><header>In general</header><text>Each laborer and mechanic employed by a contractor or subcontractor in the performance of construction, alteration, or repair work financed in whole, or in part, with the proceeds of any qualified community college bond issued after the date of enactment of the <short-title>Community College Infrastructure Financing Act</short-title> shall be paid wages at rates not less than those prevailing on work of a similar character in the locality, as determined by the Secretary of Labor in accordance with subchapter IV of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/40/31">chapter 31</external-xref> of title 40, United States Code. </text></paragraph><paragraph id="id1EB117636A004872AB76497B1EF25615"><enum>(2)</enum><header>Authority</header><text>The Secretary of Labor shall have, with respect to the labor standards described in paragraph (1), the authority and functions set forth in Reorganization Plan Numbered 14 of 1950 (64 Stat. 1267; 5 U.S.C. App.) and section 3145 of title 40, United States Code.</text></paragraph></subsection></section></subpart><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idB9C7B15F0F9746CBBF5ACE0A7F824CAB"><enum>(b)</enum><header>Conforming amendment</header><text>The table of subparts for part IV of subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by inserting after the item relating to subpart G the following:</text><toc><toc-entry bold="off" level="subpart"><quote>Subpart H—Qualified Community College Bonds</quote>.</toc-entry></toc></subsection></section><section id="H7034477B0F25471AB5AF6242F2949856"><enum>3.</enum><header>Credit to holders and issuers of Qualified Community College Bonds</header><subsection id="H2CFF7D7A52CD4B2E890B1A7EB765B94B"><enum>(a)</enum><header>Allowance of credit</header><paragraph id="HC8E164FA00CE4EB1A5C1212A916056B9"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/54A">Section 54A</external-xref> of the Internal Revenue Code of 1986, as in effect on the day before repeal by <external-xref legal-doc="public-law" parsable-cite="pl/115/97">Public Law 115–97</external-xref>, is revived.</text></paragraph><paragraph id="HE860CB5734A847F58F967FF8261A22B0"><enum>(2)</enum><header>Credit limited to Qualified Community College Bonds</header><text>Section 54A(d) of such Code is amended—</text><subparagraph id="idBC9BCF287E264B3BA95094FFE14393E2"><enum>(A)</enum><text>by striking paragraph (1) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id01145901BDAF4F03B27178CC3B97A264"><paragraph id="idA2FAF207C06E4E3F8FB09FBDF1E91BDA"><enum>(1)</enum><header>Qualified tax credit bond</header><text>The term <term>qualified tax credit bond</term> means a qualified community college bond which is part of an issue that meets requirements of paragraphs (2), (3), (4), (5), and (6).</text></paragraph><after-quoted-block>, and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id518A06AC3ECF49779298CA7C59D590DA"><enum>(B)</enum><text>in paragraph (2), by striking subparagraph (C) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB592532A80584BD783FE7ECFFC1F4463"><subparagraph id="id05700DE4E60A455DAF73B9B3E7B0268B"><enum>(C)</enum><header>Qualified purpose</header><text>For purposes of this paragraph, the term <term>qualified purpose</term> means a purpose specified in section 54(c)(3).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="HDD5986DC042E4391ABE62DB80AFB15EC"><enum>(b)</enum><header>Credit allowed to issuer</header><paragraph id="H7AEA8E6349784279BD9631EC4DBB1CE2"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/6431">Section 6431</external-xref> of the Internal Revenue Code of 1986, as in effect on the day before repeal by <external-xref legal-doc="public-law" parsable-cite="pl/115/97">Public Law 115–97</external-xref>, is revived.</text></paragraph><paragraph display-inline="no-display-inline" id="H82D152FF482F464D8E995E3BB7F97BFB"><enum>(2)</enum><header>Conforming amendments</header><subparagraph display-inline="no-display-inline" id="idB8F73F0DB1524C0F86D0E96170C65874"><enum>(A)</enum><text display-inline="yes-display-inline">Section 6431(f) of such Code, as revived by paragraph (1), is amended by striking paragraphs (2) and (3) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idC7A75CE025664358BE75C2B6D7258EDE"><paragraph display-inline="no-display-inline" id="id148B98822B8946C5A5B469D116D21CE8"><enum>(2)</enum><header>Specified tax credit bond</header><text>For purposes of this subsection, the term <term>specified tax credit bond</term> means any qualified tax credit bond (as defined in section 54A(d)(1)) if the issuer of such bond makes an irrevocable election to have this subsection apply.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph><subparagraph display-inline="no-display-inline" id="idC855A70CF2ED4AF2BDF6139D3F86E6DA"><enum>(B)</enum><text>Subparagraph (A) of <external-xref legal-doc="usc" parsable-cite="usc/26/6211">section 6211(b)(4)</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>and 6428A</quote> and inserting <quote>6428A, and 6431</quote>.</text></subparagraph></paragraph></subsection></section><section display-inline="no-display-inline" id="id46DE9CFE0E9A40C5817913E3F0C536AC"><enum>4.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by this Act shall apply to obligations issued after the date of the enactment of this Act.</text></section></legis-body></bill>
