which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend subtitle A of title XX of the Social Security Act to fund additional projects that focus on competency-based training for personal or home care aides, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="id787B3C8FD75B47D49EA5BBA633338A7F"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Mollie Baldwin Upskilling of Personal and Home Care Aides Act</short-title></quote>.</text></section><section id="id6DF4C609D94941198CE64F11C08B3501"><enum>2.</enum><header>Expansion of health and human services professions workforce projects</header><text display-inline="no-display-inline">Section 2008 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397g">42 U.S.C. 1397g</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" id="idEAC1775A88E14CB29CFBC88FF8C5ADEA" act-name=""><subsection id="id66126BCA99364391A28D4E5F71A3D077"><enum>(e)</enum><header>Expansion of health and human services professions workforce projects</header><paragraph id="id3DDAAB10DCA141848DEE8B9FFC1CCB62"><enum>(1)</enum><header>Authority to award grants</header><text>The Secretary, in consultation with the Secretary of Labor, shall award grants to eligible entities to conduct projects— </text><subparagraph id="ide74172d5dfa144669f1712a5aa856579"><enum>(A)</enum><text>that employ upskilling training models that focus on competency-based training for— </text><clause id="idB3BD7621EA8D4125BB33A9C64E459880"><enum>(i)</enum><text>personal or home care aides (as defined in subsection (b));</text></clause><clause id="idCAB9CF49A273455293E36C07BF3EA442"><enum>(ii)</enum><text>direct support professionals;</text></clause><clause id="id1E5EA87B470342AD816FB553DFCD72FC"><enum>(iii)</enum><text>home health aides; and</text></clause><clause id="id66D4F9911117437B9BBA86A5F4CAEBDB"><enum>(iv)</enum><text>nursing assistants;</text></clause></subparagraph><subparagraph id="idE1D0185441D14483A68DEA13826B9D78"><enum>(B)</enum><text>that are designed to provide eligible individuals with the opportunity to obtain education and training for positions as personal or home care aides (as so defined), direct support professionals, home health aides, or nursing assistants that pay a living wage and are expected to either experience labor shortages or be in high demand; and </text></subparagraph><subparagraph id="id87C6A8CA7E7F4B6EA96E60AD09472F4A"><enum>(C)</enum><text>for which grants were awarded under subsection (a).</text></subparagraph></paragraph><paragraph id="id2E5A7750BC9242BA9C366AA8E31DED2D"><enum>(2)</enum><header>Selection of projects</header><subparagraph id="id6BB06E0AE9A24009B0900F44925D3D0D"><enum>(A)</enum><header>Requirements for eligible entities</header><text>An eligible entity seeking to receive a grant under this subsection to conduct a project shall demonstrate—</text><clause id="id4310B015EA074684B28A0205B0005B56"><enum>(i)</enum><text>that the eligible entity has successfully conducted the project in the past; and</text></clause><clause id="id4CC0AF3CCEEE4109AF073305CDC4FE24"><enum>(ii)</enum><text>that the project implements the core training competencies for personal or home care aides described in subsection (b)(3)(A). </text></clause></subparagraph><subparagraph id="id8FDBFDD653FE4ADEA47487E6199CF437"><enum>(B)</enum><header>Priority for rural areas and underserved urban areas</header><clause id="id298946DCB1344597A0C3FAE709CB7535"><enum>(i)</enum><header>In general</header><text>In awarding grants under this subsection, the Secretary shall give priority to projects that support— </text><subclause id="idFD0E5FE0B72D441F91844B8BE917DB3B"><enum>(I)</enum><text>rural areas (as defined in section 2007(f)); or</text></subclause><subclause id="id6B1762A8F7764EAB86EAD1A6BACBE4A2"><enum>(II)</enum><text>underserved urban areas (including urban health professional shortage areas (as defined in section 332 of the Public Health Service Act).</text></subclause></clause><clause id="idE3A5F318F7984CF89D1BCEF949D9645A"><enum>(ii)</enum><header>Threshold for prioritized projects</header><text>In awarding grants under this subsection, the Secretary shall ensure that not less than 50 percent of the grants awarded under this subsection shall be for projects described in clause (i).</text></clause></subparagraph></paragraph><paragraph id="ID00BCE7C38B4242BE8855D43C3E0946A8"><enum>(3)</enum><header>Reports and evaluation</header><subparagraph commented="no" display-inline="no-display-inline" id="IDF6AFD128E35B48BE8BFA8A7379BB4996"><enum>(A)</enum><header display-inline="yes-display-inline">Eligible entities</header><text display-inline="yes-display-inline">An eligible entity awarded a grant to expand a project under this subsection shall submit interim reports to the Secretary on the activities carried out under the project and a final report on such activities upon the conclusion of the entities' participation in the project.</text></subparagraph><subparagraph id="idA56DA06278BF4E27A224625E8D2AE051"><enum>(B)</enum><header>Evaluation</header><text>The Secretary shall, by grant, contract, or interagency agreement, evaluate the projects conducted under this subsection. Such evaluation shall include identification of successful activities for creating opportunities for developing and sustaining, particularly with respect to low-income individuals and other entry-level workers, a health and human services professions workforce that has accessible entry points, that meets high standards for education, training, certification, and professional development, that provides increased wages and affordable benefits, including health care coverage, that are responsive to the workforce's needs, and that is responsive to the needs of diverse racial and ethnic communities.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID5FE752CDD34E4DFEAA909016FE1AFAF8"><enum>(C)</enum><header display-inline="yes-display-inline">Report to Congress</header><text display-inline="yes-display-inline">The Secretary shall submit interim reports and, based on the evaluation conducted under subparagraph (B), a final report to Congress on the projects conducted under this subsection.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id61E53E8B57B84D96B36E15B045D0EEE6"><enum>(4)</enum><header>Definitions</header><text display-inline="yes-display-inline">Any term used in this subsection that is also used in subsection (a) shall have the same meaning for purposes of this subsection as such term has in such subsection (a).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id712D49B485A648989F591D9BAECD059A"><enum>(5)</enum><header>Funding</header><text display-inline="yes-display-inline">Out of any funds in the Treasury not otherwise appropriated, there are appropriated to the Secretary to carry out this subsection $5,000,000 for each of fiscal years 2025 through 2034.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
