which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Food Security Act of 1985 to direct the Secretary of Agriculture to provide grants to producers to carry out climate-smart conversion projects, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Industrial Agriculture Conversion Act of 2024</short-title></quote>.</text></section><section id="id056f3a497eb746768f4bc3cd47c2644a"><enum>2.</enum><header>Climate-smart conversion grants</header><text display-inline="no-display-inline">Subchapter A of chapter 4 of subtitle D of title XII of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3839aa">16 U.S.C. 3839aa et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idc57f048c1e9847f8a7990b360e414aa8"><section id="id2cb766e3390f441385564148e8257e81"><enum>1240H–1.</enum><header>Climate-smart conversion grants</header><subsection id="idd87e60cabb6843cba32a36f0532ff20e"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="ide72126407e0c48f0be4a0b53c19af8b6"><enum>(1)</enum><header>Animal feeding operation</header><text>The term <term>animal feeding operation</term> means a lot or facility at which—</text><subparagraph id="id1c4755be8c0849d19e63a5df17906db1"><enum>(A)</enum><text>for not less than a total of 45 days in any 12-month period, animals (other than aquatic animals) are—</text><clause id="id04b602c4dcb44c478944b12f1e932cb5"><enum>(i)</enum><text>stabled or confined; and</text></clause><clause id="id95a3af70f711466eb9448900b6e6e3f7"><enum>(ii)</enum><text>fed or maintained; and</text></clause></subparagraph><subparagraph id="idd31b6104cd92423cabe797f05e73ecda"><enum>(B)</enum><text>crops, vegetation, forage growth, or postharvest residues are not sustained in the normal growing season over any portion of the lot or facility.</text></subparagraph></paragraph><paragraph id="idc6474a4b6eaa4242a22ad21de59c11c9"><enum>(2)</enum><header>Climate-smart conversion project</header><text>The term <term>climate-smart conversion project</term> means a climate-smart conversion project described in subsection (d). </text></paragraph><paragraph id="id47a46c053ea4419f84528556d8fcc1af"><enum>(3)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means a producer or non-Federal entity that—</text><subparagraph id="id4e9820f58e3144bda6bad3c6d0b913e1"><enum>(A)</enum><text>has control of the land that is the subject of a grant provided under this section; and</text></subparagraph><subparagraph id="idb553a067fc8a4a8bad8f6e4604baff83"><enum>(B)</enum><text>owns or operates a medium concentrated animal feeding operation or large concentrated animal feeding operation that—</text><clause id="id14c5f7fc3024428ab30f04ee147a05c2"><enum>(i)</enum><text>is in operation for livestock or poultry production at the time of submission of an application for a grant under this section; or</text></clause><clause id="idcf4391f830f3448091ebddd039d85671"><enum>(ii)</enum><text>was in operation for livestock or poultry production not more than 1 year prior to the time of submission of such an application. </text></clause></subparagraph></paragraph><paragraph id="idd594864b30ea450c85f73c29d4c8b876"><enum>(4)</enum><header>Large concentrated animal feeding operation</header><text>The term <term>large concentrated animal feeding operation</term> means an animal feeding operation at which are present not less than—</text><subparagraph id="idc37919c4ac974335bfff27bb1d219ae3"><enum>(A)</enum><text>700 mature dairy cows, milked or dry;</text></subparagraph><subparagraph id="ida1693da644d0416a93304c55f7d37e82"><enum>(B)</enum><text>1,000 veal calves;</text></subparagraph><subparagraph id="idefd1863d9984454da138c59a0b5db51c"><enum>(C)</enum><text>1,000 cattle (including heifers, steers, bulls, cows, and calves) other than mature dairy cows or veal calves;</text></subparagraph><subparagraph id="idedb832bd67b74fb986103c1d228e388f"><enum>(D)</enum><text>2,500 swine, each weighing not less than 55 pounds;</text></subparagraph><subparagraph id="idfb7dbe3c85f744dc85aba9d9ebe1f423"><enum>(E)</enum><text>10,000 swine, each weighing less than 55 pounds;</text></subparagraph><subparagraph id="ide0fb823e56f34f9db04d2e5c974c0662"><enum>(F)</enum><text>500 horses;</text></subparagraph><subparagraph id="idef5bd2ef914e46cda725a4a567c72e2a"><enum>(G)</enum><text>10,000 sheep or lambs;</text></subparagraph><subparagraph id="id7d3342a73bf045348bd6f26e296f211e"><enum>(H)</enum><text>55,000 turkeys;</text></subparagraph><subparagraph id="id367bc1f5826249ccb54388319576a206"><enum>(I)</enum><text>in the case of an animal feeding operation that uses a liquid manure handling system—</text><clause id="id0a17b825f7f5416db071eb92448934b0"><enum>(i)</enum><text>30,000 laying hens or broilers; or</text></clause><clause id="id62b6fe483845436dadcccb5dedf4d6bc"><enum>(ii)</enum><text>5,000 ducks; or</text></clause></subparagraph><subparagraph id="idc1887f4dec2941ac9db89dc492a6a3cc"><enum>(J)</enum><text>in the case of an animal feeding operation that uses a system other than a liquid manure handling system—</text><clause id="id6447b5c8c71c4598bbedc482559f7246"><enum>(i)</enum><text>125,000 chickens (other than laying hens);</text></clause><clause id="id76d05054eec4450e9181abbb2b04a761"><enum>(ii)</enum><text>82,000 laying hens; or</text></clause><clause id="idadff41eb5524425cbede0ae1bf76c343"><enum>(iii)</enum><text>30,000 ducks.</text></clause></subparagraph></paragraph><paragraph id="id8c511d1eef5945b0b2de67eec7ec7b93"><enum>(5)</enum><header>Medium concentrated animal feeding operation</header><text>The term <term>medium concentrated animal feeding operation</term> means an animal feeding operation at which—</text><subparagraph commented="no" display-inline="no-display-inline" id="id80936387f6894a34969e00256719a270"><enum>(A)</enum><text display-inline="yes-display-inline">are present—</text><clause id="id56a2c6ff6a5b480b99e05aef6ae7327f"><enum>(i)</enum><text>not less than 200 and not more than 699 mature dairy cows, whether milked or dry;</text></clause><clause id="id52139f6ace044feabd4100c92aef6649"><enum>(ii)</enum><text>not less than 300 and not more than 999 veal calves;</text></clause><clause id="id3fba4a3dd3dc4f99a71ec49ac4a9ed13"><enum>(iii)</enum><text>not less than 300 and not more than 999 cattle (including heifers, steers, bulls, cows, and calves) other than mature dairy cows or veal calves;</text></clause><clause id="idda389e1b5cd9449490a28654543997e6"><enum>(iv)</enum><text>not less than 750 and not more than 2,499 swine, each weighing not less than 55 pounds;</text></clause><clause id="idfa5ef7ae3fb341d9bb50dd5023052e19"><enum>(v)</enum><text>not less than 3,000 and not more than 9,999 swine, each weighing less than 55 pounds;</text></clause><clause id="id68022cf78877430e881ae2b8fc4bb257"><enum>(vi)</enum><text>not less than 150 and not more than 499 horses;</text></clause><clause id="idca147dcd26b6434e94f967d82534a6db"><enum>(vii)</enum><text>not less than 3,000 and not more than 9,999 sheep or lambs;</text></clause><clause id="idfcb71f22a083455a99b6846ae7e1ff9a"><enum>(viii)</enum><text>not less than 16,500 and not more than 54,999 turkeys;</text></clause><clause id="id5B80A81545BE4BF3AEA5B7AAA942B070"><enum>(ix)</enum><text>in the case of an animal feeding operation that uses a liquid manure handling system— </text><subclause id="id0652576cee0848c8a2a411304b23ca30"><enum>(I)</enum><text>not less than 9,000 and not more than 29,999 laying hens or broilers; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id9bead242ba8342aabc58b1403a98e301"><enum>(II)</enum><text>not less than 1,500 and not more than 4,999 ducks; or</text></subclause></clause><clause id="id0785FB09B4FE41A69477AB6E5D161D6D"><enum>(x)</enum><text>in the case of an animal feeding operation that uses a system other than a liquid manure handling system— </text><subclause id="id7f921dc49cf24184b166f445ec9cd88b"><enum>(I)</enum><text>not less than 37,500 and not more than 124,999 chickens (other than laying hens);</text></subclause><subclause id="id76aa700b5c4044d1bb9e453362be0c00"><enum>(II)</enum><text>not less than 25,000 and not more than 81,999 laying hens; or</text></subclause><subclause id="ide413b5c489374657835496efe2214f47"><enum>(III)</enum><text>not less than 10,000 and not more than 29,999 ducks; and</text></subclause></clause></subparagraph><subparagraph id="id8144ae12b7784504880eaede6c18d5b9"><enum>(B)</enum><text>pollutants are discharged—</text><clause id="id39d82e192aed49bd9546a58dbf372111"><enum>(i)</enum><text>into waters of the United States through a man-made ditch, flushing system, or other similar man-made device; or</text></clause><clause id="idc96dfb3bc0b54794af9b1f4bfcf76f48"><enum>(ii)</enum><text>directly into waters of the United States that originate outside of and pass over, across, or through the animal feeding operation or otherwise come into direct contact with the animals confined in the animal feeding operation. </text></clause></subparagraph></paragraph></subsection><subsection id="idfde6a39a2d074891b78533d6b872c191" commented="no"><enum>(b)</enum><header>Grants</header><text>Using the amounts made available by subsection (h), the Secretary shall provide grants to eligible entities to carry out climate-smart conversion projects in accordance with this section.</text></subsection><subsection id="idcb5ecd43f9084d3ba714bb5314eeb9aa"><enum>(c)</enum><header>Grant application</header><paragraph id="id02358ba664e4477083bac78d4d499595"><enum>(1)</enum><header>Duty of Secretary</header><text>Not later than 180 days after the date of enactment of this section, and annually thereafter, the Secretary shall publish detailed guidelines on how to apply for a grant under this section.</text></paragraph><paragraph id="idd7d4e82b5e0542218e99ce8898af4a1f"><enum>(2)</enum><header>Contents</header><text>An eligible entity seeking a grant under this section shall submit to the Secretary an application at such time, in such manner, and containing such information, including a proposal for a climate-smart conversion project, as are described in the detailed guidelines published under paragraph (1).</text></paragraph></subsection><subsection id="idaba1290d96704b358a175899f65207cd"><enum>(d)</enum><header>Climate-Smart conversion projects</header><paragraph id="id3328d25b0e194ec6a0571e4125aba8b6"><enum>(1)</enum><header>In general</header><text>An eligible entity that receives a grant under this section shall carry out a climate-smart conversion project that converts an existing medium concentrated animal feeding operation or large concentrated animal feeding operation into a climate-smart facility by making 1 or more of the following beneficial, on-farm infrastructure improvements:</text><subparagraph id="id9c6e12d6e91f462280ac564b9591eb35"><enum>(A)</enum><text>Improvements related to providing animals with access to the outdoors or pasture, including purchasing, integrating, or constructing—</text><clause id="ide8b00417f0c9411b82a77ea3f0308539"><enum>(i)</enum><text>fencing and mobile or permanent housing or shelter;</text></clause><clause id="id82f2029113c5453caba3a6de9f7d0b7a"><enum>(ii)</enum><text>enrichment materials for use in indoor shelters;</text></clause><clause id="id72a6ab31968941a991c227883e58c6c1"><enum>(iii)</enum><text>hedgerow and ecosystem enhancement planting and design;</text></clause><clause id="idde789ccd8fe44fa6a64845a700db847a"><enum>(iv)</enum><text>drought-resistant grasses; or</text></clause><clause id="idff30dbee16194cda95b279e0f2f932ed"><enum>(v)</enum><text>water lines and irrigation structures for watering outdoor animals.</text></clause></subparagraph><subparagraph id="id524da8da8c56446bb9382e191f4777f9"><enum>(B)</enum><text>Improvements related to converting to specialty crop or organic production, including—</text><clause id="ide825f4b3e6c0415d92228064cd1a99d3"><enum>(i)</enum><text>purchasing—</text><subclause id="id010d57afe43a4ddfabf771754f43a411"><enum>(I)</enum><text>seeds and starts;</text></subclause><subclause id="id14ac562364fc442f868ee0c3fa6a3f76"><enum>(II)</enum><text>compost and compost structure supplies;</text></subclause><subclause id="id347b78b710eb44189db6f25ab9ab4e1f"><enum>(III)</enum><text>propagation supplies; and</text></subclause><subclause id="id2d0b76a79153477db92b0f561c32653b"><enum>(IV)</enum><text>soil remediation tools, including off-the-ground raised beds, portable pots, or other converted structures; and</text></subclause></clause><clause id="id72bb73dcbb13468a8be4909ae8a7144a"><enum>(ii)</enum><text>establishing or repurposing existing structures or constructing high tunnels or similar protected-environment planting structures.</text></clause></subparagraph></paragraph><paragraph id="ideda8fb4befa64baa97291f90f36cf331"><enum>(2)</enum><header>Exclusions</header><text>An eligible entity shall not use a grant provided under this section to construct, through a climate-smart conversion project—</text><subparagraph id="idc0884056330b45d69fccb30742c37148"><enum>(A)</enum><text>an animal mortality facility;</text></subparagraph><subparagraph id="idcc538f2d8898437ea34bc5504b131ff3"><enum>(B)</enum><text>a manure lagoon or other liquid waste storage or treatment facility; or</text></subparagraph><subparagraph id="idaee46ab6e08340dbbb3b535f85a4b48a"><enum>(C)</enum><text>a manure methane digester system.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida4bae48718a0496099d42dbb9ca7f416"><enum>(3)</enum><header>Requirement</header><text>As a condition of receiving a grant under this section, not later than 180 days after the date on which the eligible entity receives the grant, the eligible entity shall permanently cease any operation of the medium concentrated animal feeding operation or large concentrated animal feeding operation described in subsection (a)(3)(B) where animals are confined entirely indoors on the land and facilities that are the subject of the grant. </text></paragraph></subsection><subsection id="id5f8aae7955e24b0fa688d989e5b35fad"><enum>(e)</enum><header>Grant amounts</header><paragraph id="id5138cd0a6d774d3d8f0c5a992d6c943b"><enum>(1)</enum><header>Federal share</header><text>The Federal share of a grant provided to an eligible entity under this section shall not exceed 90 percent of the total cost of the applicable climate-smart conversion project.</text></paragraph><paragraph id="id13520b475d48464e8e0b3e8fcf0ccc78"><enum>(2)</enum><header>Non-Federal share</header><text>An eligible entity that receives a grant under this section shall provide non-Federal funding, in the form of direct funding or in-kind contributions, equal to not less than 10 percent of the total cost of the applicable climate-smart conversion project.</text></paragraph><paragraph id="iddce1fea946cf4ac6b1129b059dde4dbf"><enum>(3)</enum><header>Lower cost-share requirements for certain eligible entities</header><text>Notwithstanding paragraphs (1) and (2), the Secretary may reduce the amount that would otherwise be required to be provided by an eligible entity under those paragraphs in the case of an eligible entity who is a socially disadvantaged farmer or rancher (as defined in section 2501(a) of the Food, Agriculture, Conservation, and Trade Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/2279">7 U.S.C. 2279(a)</external-xref>)) carrying out the applicable climate-smart conversion project with the assistance of—</text><subparagraph id="id268f83cc841e4854a1be844388c918df"><enum>(A)</enum><text>a community-based organization composed of, representing, or exclusively working with historically underserved producers; or</text></subparagraph><subparagraph id="id6199e0ba4251416692cc58ba9706649d"><enum>(B)</enum><text>a land grant institution, Hispanic-serving institution, or other minority-serving institution, such as a historically Black college or university, a Tribally controlled college or university, or an Asian American and Pacific Islander-serving institution.</text></subparagraph></paragraph></subsection><subsection id="id57b46bca9e8346a2b2eac565661bebe5"><enum>(f)</enum><header>Grant term</header><text>The term of a grant provided under this section shall not exceed 3 years.</text></subsection><subsection id="idce71731a8b13434eaac23cd8f96ee103"><enum>(g)</enum><header>Undue or unreasonable prejudice or disadvantage</header><text>Any refusal by a packer (as defined in section 201 of the Packers and Stockyards Act, 1921 (<external-xref legal-doc="usc" parsable-cite="usc/7/191">7 U.S.C. 191</external-xref>)), to purchase livestock or poultry from an entity on account of that entity having applied for or carried out a climate-smart conversion project under this section shall be considered an undue or unreasonable prejudice or disadvantage under section 202(b) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/7/192">7 U.S.C. 192(b)</external-xref>) and in violation of that Act (<external-xref legal-doc="usc" parsable-cite="usc/7/191">7 U.S.C. 191 et seq.</external-xref>).</text></subsection><subsection id="id2789c80918dd458894340f6bf12abf83"><enum>(h)</enum><header>Funding</header><text>The Secretary shall use to provide grants under subsection (b) amounts appropriated to carry out this subchapter by section 21001(a)(1) of <external-xref legal-doc="public-law" parsable-cite="pl/117/169">Public Law 117–169</external-xref> (136 Stat. 2015) that remain unobligated as of the date of enactment of this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
