<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>2d Session</session><legis-num>S. 5173</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20240925">September 25, 2024</action-date><action-desc><sponsor name-id="S383">Mr. Sullivan</sponsor> (for himself and <cosponsor name-id="S353">Mr. Schatz</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title XVIII of the Social Security Act to provide for the treatment of critical access hospital services furnished by a critical access hospital located in a noncontiguous State.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Comprehensive Reimbursement Initiative Targeting Investment and Care in rural Locations</short-title></quote> or the <quote><short-title>CRITICAL Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="id45f5b667bc744a0fba029308a2287cbc"><enum>2.</enum><header>Treatment of critical access hospitals located in a noncontiguous State</header><subsection id="id0343aa33d9804661b1d9448a84724aab"><enum>(a)</enum><header>Inpatient critical access hospital services</header><text>Section 1814(l) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395f">42 U.S.C. 1395f(l)</external-xref>) is amended by inserting <quote>(or, in the case of inpatient critical access hospital services furnished on or after January 1, 2025, by a critical access hospital that is located in a noncontiguous State, 105 percent)</quote> after <quote>101 percent</quote>.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id6415d287185342f083065435d776c35f"><enum>(b)</enum><header>Outpatient critical access hospital services</header><text>Section 1834(g)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(g)(1)</external-xref>) is amended by inserting <quote>(or, in the case of outpatient critical access hospital services furnished on or after January 1, 2025, by a critical access hospital that is located in a noncontiguous State, 105 percent)</quote> after <quote>101 percent</quote>.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id7d590cff05f447ab86653febb1ac456b"><enum>(c)</enum><header>Ambulance services</header><text>Section 1834(l)(8) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(l)(8)</external-xref>) is amended by inserting <quote>(or, in the case of ambulance services furnished on or after January 1, 2025, by a critical access hospital that is located in a noncontiguous State or by an entity that is owned and operated by a critical access hospital that is located in a noncontiguous State, 105 percent)</quote> after <quote>101 percent</quote>.</text></subsection><subsection id="idd66f3c45e23640419322705b0e83e6ca"><enum>(d)</enum><header>Skilled nursing facility services</header><text>Section 1883(a)(3) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395tt">42 U.S.C. 1395tt(a)(3)</external-xref>) is amended by inserting <quote>(or, in the case of covered skilled nursing facility services furnished on or after January 1, 2025, under an agreement under this section by a critical access hospital that is located in a noncontiguous State, 105 percent)</quote> after <quote>101 percent</quote>.</text></subsection></section></legis-body></bill>
