<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>2d Session</session><legis-num>S. 5160</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20240924">September 24, 2024</action-date><action-desc><sponsor name-id="S153">Mr. Grassley</sponsor> (for himself and <cosponsor name-id="S388">Ms. Hassan</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To expand the sharing of information with respect to suspected violations of intellectual property rights in trade.</official-title></form><legis-body><section id="id9b606424202a4d4b9f9d30384028cc6a" section-type="section-one"><enum>1.</enum><header>Sharing of information with respect to suspected violations of intellectual property rights</header><text display-inline="no-display-inline">Section 628A of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1628a">19 U.S.C. 1628a</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id1d0c378dba2b49dc9f372fa350ba3b56"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph commented="no" display-inline="no-display-inline" id="id5268e4c99b784575b915eb042c755cdc"><enum>(A)</enum><text>in the matter preceding paragraph (1), by striking <quote>suspects</quote> and inserting <quote>has a reasonable suspicion</quote>; </text></subparagraph><subparagraph id="idc7ed2885f6d4449783b7a3f420e8590a"><enum>(B)</enum><text>in paragraph (1)—</text><clause commented="no" display-inline="no-display-inline" id="id5f94f6d3a5d5436b8d091113060fb32c"><enum>(i)</enum><text display-inline="yes-display-inline">by inserting <quote>, packing materials, shipping containers,</quote> after <quote>its packaging</quote> each place it appears; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id20c3e9430d614d7790dfeb5f29236801"><enum>(ii)</enum><text>by striking <quote>; and</quote> and inserting a semicolon;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd2b8e3b63ca344e98d79013966fb4eb5"><enum>(C)</enum><text display-inline="yes-display-inline">in paragraph (2), by striking the period and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6d6abb5bc50147798545435f33694256"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id11F7D6F924C640BAAB2E8D985408F617"><paragraph id="idb9971fded65b432e909d3c5e8e53a572"><enum>(3)</enum><text>may provide to the person nonpublic information about the merchandise that was—</text><subparagraph id="idc402eacb71dd4f2c97642b9c95ef2679"><enum>(A)</enum><text>generated by an online marketplace or other similar market platform, an express consignment operator, a freight forwarder, or any other entity that plays a role in the sale or importation of merchandise into the United States or the facilitation of such sale or importation; and</text></subparagraph><subparagraph id="id4ae8ac537964449b9246efe8b76a11a1"><enum>(B)</enum><text>provided to, shared with, or obtained by, U.S. Customs and Border Protection.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id9ec8251b6f8f4935872b69396b4bca49"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="idee129534af7a473a9a2d1ff071df2b66"><enum>(A)</enum><text>in paragraph (3), by striking <quote>; and</quote> and inserting a semicolon;</text></subparagraph><subparagraph id="id090bda621f114e0b9013a293644276b9"><enum>(B)</enum><text>in paragraph (4), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="id7bb40ed8c9b146bcac7f75e1ea8d6769"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1b9674703bc84afe9ffa78bbcacd76f4"><paragraph id="id32f45658561242d28d8b9710ede892e0"><enum>(5)</enum><text>any other party with an interest in the merchandise, as determined appropriate by the Commissioner.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section></legis-body></bill>
