<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>2d Session</session><legis-num>S. 5146</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20240924">September 24, 2024</action-date><action-desc><sponsor name-id="S313">Mr. Sanders</sponsor> (for himself and <cosponsor name-id="S362">Mr. Kaine</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To authorize the Secretary of Health and Human Services to award grants to schools of medicine or osteopathic medicine at historically Black colleges and universities and other minority-serving institutions for the purpose of increasing enrollment of medical students.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Medical Graduate Investment Act of 2024</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="idDF40D51B944E44FA965A087BAD74C362"><enum>2.</enum><header display-inline="yes-display-inline">Expanding the number of doctors</header><text display-inline="no-display-inline">Subpart 3 of part E of title VII of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/295f">42 U.S.C. 295f et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5C38AE543A54450780A176B90D114408"><section id="id892bc5dd55af4682954a1352cde8b7ae"><enum>779.</enum><header>Expanding the number of doctors</header><subsection commented="no" display-inline="no-display-inline" id="idA23F66491DB742AF94CC44DF41DCE867"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text>The Secretary shall award grants to eligible entities for the purpose of increasing enrollment of medical students by at least 5 percent each year as compared to the prior year. Grants awarded under this section shall be used for tuition and student fees (excluding living expenses), faculty recruitment and retention (with not more than 20 percent of the cost of salaries covered by such grants), costs associated with equipment (including acquisition of equipment), and costs associated with clinical training of medical students and preparing and encouraging such students to serve as primary care physicians in medically underserved areas, including rural areas, frontier areas, and jurisdictions of Indian Tribes and Tribal organizations, after completing residency training.</text></subsection><subsection id="idfb12366e07044c468aff57c92b0bdbe6"><enum>(b)</enum><header>Eligible entities</header><text>To be eligible to receive an award under this section, an entity shall—</text><paragraph commented="no" display-inline="no-display-inline" id="idf7b4b5ccf41b48aebeb7edfaa4e99fc6"><enum>(1)</enum><text>be—</text><subparagraph commented="no" display-inline="no-display-inline" id="id7ecf0862a8d14614963839f74fccb0c9"><enum>(A)</enum><text display-inline="yes-display-inline">an accredited school of medicine or an accredited school of osteopathic medicine at a minority-serving institution of higher education (defined as an institution described in any of paragraphs (1) through (7) of section 371(a) of the Higher Education Act of 1965) or a minority-serving institution of higher education (as so defined) with plans to establish an accredited school of medicine or an accredited school of osteopathic medicine, if such institution provides documentation of such plans, as the Secretary may require; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd57c04f18b414e58ae52a90a79765954"><enum>(B)</enum><text display-inline="yes-display-inline">an accredited school of medicine or an accredited school of osteopathic medicine that, at the time of the application, has an agreement with a historically Black college or university (as defined in paragraph (1) of section 371(a) of the Higher Education Act of 1965) to enroll, in the school of medicine or school of osteopathic medicine, students who have completed their undergraduate education at such minority-serving institution of higher education, provided that such school of medicine or school of osteopathic medicine intends to use the award under this section to increase enrollment of such students in accordance with the threshold described in subsection (a); or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id908f9d290f4043d794789e0c5be739ea"><enum>(C)</enum><text display-inline="yes-display-inline">an accredited school of medicine or an accredited school of osteopathic medicine that—</text><clause commented="no" display-inline="no-display-inline" id="id1133503d4bcb4034a32d9aa49f2b3a5b"><enum>(i)</enum><text display-inline="yes-display-inline">at the time of the application, has an agreement with an Indian Tribe (as defined in section 4 of the Indian Self Determination and Education Assistance Act) to provide medical education for American Indian, Alaska Native, and Native Hawaiian students; or </text></clause><clause commented="no" display-inline="no-display-inline" id="id770b30f3fb9042cab712ed7f33588bb0"><enum>(ii)</enum><text display-inline="yes-display-inline">an accredited school of medicine or an accredited school of osteopathic medicine that trains in Tribal communities or otherwise has a history of graduating a high number of physicians who, after completion of residency, practice in Tribal communities in rural or frontier areas; and</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1854a65f828f45f6af597d87ec994002"><enum>(2)</enum><text>submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require, including information on how the entity will sustain increased enrollment of medical students following the expirations of grant funds provided under this section.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id80618cad7db14bbebdefa892c2b9e7f9"><enum>(c)</enum><header display-inline="yes-display-inline">Grant amounts</header><paragraph commented="no" display-inline="no-display-inline" id="id930ae5457f204d8da5f73d08436863da"><enum>(1)</enum><header display-inline="yes-display-inline">Minimum award; disbursements</header><text>The Secretary shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="id80989855e9ad492a889163c85bdb1bf9"><enum>(A)</enum><text display-inline="yes-display-inline">determine the amount of each award under this section, provided that each eligible entity receiving such an award shall receive a minimum amount of $1,000,000 per year of the 5-year grant period; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6cb79a94976c435aa41f7d2f7b66efca"><enum>(B)</enum><text>disburse the grant amount to each eligible entity receiving such an award in 5 annual increments.</text></subparagraph></paragraph><paragraph id="idf018dda87c354c6d836fb02e7e69fe1c"><enum>(2)</enum><header>Distribution among types of eligible entities</header><text>In awarding amounts to eligible entities under this section, the Secretary shall disburse grant funding evenly among the following 9 categories (subject to the receipt of applications from eligible entities in each of the categories described in subparagraph (A)):</text><subparagraph commented="no" display-inline="no-display-inline" id="id48db46aa10dd4173bbd5d4ba0293561d"><enum>(A)</enum><text display-inline="yes-display-inline">Eligible entities in each category of minority serving institution of higher education described in paragraphs (1) through (7) of section 371(a) of the Higher Education Act of 1965.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc34993df4a1744339d7f25200d7ba8e2"><enum>(B)</enum><text display-inline="yes-display-inline">Eligible entities described in subsection (b)(1)(B).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1b938d2240d64e74adf622f3da604efc"><enum>(C)</enum><text>Eligible entities described in subsection (b)(1)(C).</text></subparagraph></paragraph><paragraph id="ide665fd15d2a64c99815740e87a7bff84"><enum>(3)</enum><header>Evaluation</header><text>The Secretary may reserve not more than half of one percent of amounts made available under subsection (f) to evaluate the results of the program under this section during and after the grant period, including the number of new medical students enrolled, such students’ progression to participate in an accredited internship or medical residency program, and rates of passing the United States Medical Licensing Examination or the Comprehensive Osteopathic Medical Licensing Examination.</text></paragraph></subsection><subsection id="id50a3d7ba04a8460ebfbf55fca8b32506" commented="no"><enum>(d)</enum><header>Matching requirement</header><text>The Secretary shall require each eligible entity receiving an award under this section to provide non-Federal matching funds for each year of the grant period, which may be in cash or in-kind, in an amount equal to 25 percent of the total amount of funds awarded under this section for the applicable year. An eligible entity may apply to the Secretary for a waiver of not more than 80 percent of the matching fund amount required for each year the entity receives an award under this section. </text></subsection><subsection id="id16aedebbc7e245a6a9ce0cd08e2a96a8"><enum>(e)</enum><header>Reporting</header><paragraph commented="no" display-inline="no-display-inline" id="id3a49568a281b42f1ae1abaa36aa4a33d"><enum>(1)</enum><header>Eligible entity reporting</header><subparagraph commented="no" display-inline="no-display-inline" id="id06a2945a87f04492b9c007a2a68802db"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Each eligible entity receiving a grant under this section shall submit a report to the Secretary, annually for the duration of the grant period, on activities conducted under such grant, including information on the number of new students enrolled, faculty supported, how funds under such grant were used, plans for continuation of the activities in the next budget period, and other information, as the Secretary may require. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id035c408b7df647408e4b2d2a7d792c20"><enum>(B)</enum><header>Contents</header><text>Each report under subparagraph (A) shall include—</text><clause commented="no" display-inline="no-display-inline" id="ide0f89f973cd24f7da07658a4f353958a"><enum>(i)</enum><text display-inline="yes-display-inline">an overview of activities conducted under such grant;</text></clause><clause id="idda3452f712194493b664fd46d97ef796"><enum>(ii)</enum><text>associated costs of equipment purchased;</text></clause><clause id="id85df40ad240b4fa2bdc985d3e569fdb6"><enum>(iii)</enum><text>the number of new students enrolled in the applicable school of medicine or school of osteopathic medicine per year (including the number of students from racial and ethnic groups underrepresented among medical students and health professions, students who were Federal Pell Grant recipients, and first-generation college students);</text></clause><clause commented="no" display-inline="no-display-inline" id="id56948ac79d174fac88cd8f494d5f639c"><enum>(iv)</enum><text>plans for continuation of the activities in the next fiscal year; and </text></clause><clause commented="no" display-inline="no-display-inline" id="id5319fded25814c73936e2a55feeca84f"><enum>(v)</enum><text display-inline="yes-display-inline">any other information the Secretary may require.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5cd84b26fad8422cb3a8ba80ad6bc2c3"><enum>(2)</enum><header>Reports to Congress</header><text>Not later than 2 years after the first grants are awarded under this section, the Secretary shall submit to the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Energy and Commerce of the House of Representatives a report that includes—</text><subparagraph commented="no" display-inline="no-display-inline" id="id14d7550bf2874034bdd591559bb0ff55"><enum>(A)</enum><text display-inline="yes-display-inline">an assessment of the effectiveness of the activities associated with grants made under this section;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc282386090ca4dada76da2f107d188d4"><enum>(B)</enum><text display-inline="yes-display-inline">a summary of outcomes and best practices and recommendations on the recruitment and retention of medical students;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd17b5f98123e41d395356b9292caf3f0"><enum>(C)</enum><text display-inline="yes-display-inline">annual enrollment of students at each school of medicine or school of osteopathic medicine supported by the program; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id776592bda6804133bd597d662b09edb4"><enum>(D)</enum><text display-inline="yes-display-inline">summaries, including justification, of the allocations of grant funds made by the Secretary. </text></subparagraph></paragraph></subsection><subsection id="id43AD432455EA4EC78304ED08679B3CB9" commented="no" display-inline="no-display-inline"><enum>(f)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">To carry out this section, there are authorized to be appropriated $60,000,000 for each of fiscal years 2026 through 2030, to remain available until expended.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id524e5a4fcfae4f2397b19e79410a639b"><enum>(g)</enum><header>Non-Duplication of efforts</header><text display-inline="yes-display-inline">The Secretary shall ensure that activities carried out under this section do not unnecessarily duplicate efforts of any other Federal program.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
