which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Trade Act of 1974 to modify the eligibility requirements for the Generalized System of Preferences to strengthen worker protections and to ensure that beneficiary developing countries afford equal rights and protection under the law, regardless of gender, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Women’s Economic Empowerment in Trade Act of 2024</short-title></quote>.</text></section><section id="id06E7313D3DB140A1BCBDF3532AA8D40A"><enum>2.</enum><header>Modification of eligibility requirements for Generalized System of Preferences</header><subsection id="idFB73FD301C934F33ABCAD67D8F05E033"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 502 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2462">19 U.S.C. 2462</external-xref>) is amended—</text><paragraph id="id87EE434BF4F94A0FA08FFD6E4CF93E40"><enum>(1)</enum><text>in subsection (b)(2)—</text><subparagraph id="id00A151E77B4F41EF96760758F38EF571"><enum>(A)</enum><text>in subparagraph (G), by striking <quote>has not taken or is not taking steps to</quote> and inserting <quote>does not substantially</quote>;</text></subparagraph><subparagraph id="id3B6EAF01A89B478594E3656B15E8DF2A"><enum>(B)</enum><text>by inserting after subparagraph (H) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6510D7675FC84C2D88D18CA5B4536D11"><subparagraph id="idf063a1d0970b463aa65ab2b638983445"><enum>(I)</enum><text>Such country does not substantially afford equal rights and protection under the law, regardless of gender, in the country (including in any designated zone in that country).</text></subparagraph><subparagraph id="id81FB83A0D42649BEB403CF66E58B5A16"><enum>(J)</enum><text>Such country engages in gross violations of internationally recognized human rights in that country (including any designated zone in that country).</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" id="id9ED02B52BB3A4E93A565D0D2776B6344"><enum>(C)</enum><text>in the flush text, by striking <quote>and (H) (to the extent described in section 507(6)(D))</quote> and inserting <quote>(H) (to the extent described in section 507(6)(D)), and (I)</quote>; and </text></subparagraph></paragraph><paragraph id="id211172A1E4714AA194B0FF0BC84ACF71"><enum>(2)</enum><text>in subsection (c)—</text><subparagraph id="id79387F6EBC4E499996488A5AA4428140"><enum>(A)</enum><text>in paragraph (6)(B), by striking <quote>; and</quote> and inserting a semicolon; and</text></subparagraph><subparagraph id="id14177A6111754979A1F50BB2961CC966"><enum>(B)</enum><text>by striking paragraph (7) and inserting the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id2490E806D92A4A4AACDDEB494A8BF44E"><paragraph commented="no" display-inline="no-display-inline" id="IDDA047F94AFC947D987041703A9383BA4"><enum>(7)</enum><text display-inline="yes-display-inline">the extent to which such country affords to workers in that country (including any designated zone in that country) internationally recognized worker rights; and</text></paragraph><paragraph id="idf58e5550b21b4c939b268d2659f6659d"><enum>(8)</enum><text>the extent to which such country affords equal rights and protection under the law, regardless of gender, in that country (including any designated zone in that country).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="idCC8493993D7A41AAB81A54D4C3020D5E"><enum>(b)</enum><header>Collection and dissemination of information on eligibility criteria</header><text>Section 502 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2462">19 U.S.C. 2462</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id23831DC5C0C34ABAA048A5F0A8125A6B"><subsection id="id6a84c4fc1e8a49fe8e8f7f359da6d24c"><enum>(g)</enum><header>Collection and dissemination of information on eligibility criteria</header><text>The President shall—</text><paragraph id="id0D605369EA9143218B9250A6036CE10A"><enum>(1)</enum><text>collect, from the United States embassy in each country designated as a beneficiary developing country for purposes of this title, information on the extent to which the country meets the eligibility criteria described in subparagraphs (G), (H), and (I) of subsection (b)(2); and</text></paragraph><paragraph id="id630B700E5FC147E18D207CA84E116B91"><enum>(2)</enum><text>publish on a publicly accessible internet website of the Office of the United States Trade Representative— </text><subparagraph id="idF5368FE0375B4A228DE1BCF10EAD4417"><enum>(A)</enum><text>the information collected under paragraph (1); and</text></subparagraph><subparagraph id="id915B835D9FE944898C9C42789242AE75"><enum>(B)</enum><text>information on the process for filing a petition for the review of the eligibility of a country for designation as a beneficiary developing country.</text></subparagraph></paragraph></subsection><subsection id="idC8AF740414C34C6C95D935403D332B4A"><enum>(h)</enum><header>Publication of determinations relating to petitions for review</header><text>The United States Trade Representative shall publish in the Federal Register a notice of, and the rationale for, any determination of the Trade Representative with respect to a petition for review of the eligibility of a country for designation as a beneficiary developing country, including a determination—</text><paragraph id="id088A2F047F7E4F28880417090D45CD31"><enum>(1)</enum><text>to accept or deny such a petition;</text></paragraph><paragraph id="id1E5F25F362E7461DB9F294DFB937C8CA"><enum>(2)</enum><text>to continue to review the eligibility of the country; or</text></paragraph><paragraph id="id6E22FF909E9748869B221D87F95BEDA5"><enum>(3)</enum><text>to withdraw, suspend, or limit the application of duty-free treatment under this title with respect to the country.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id4FEA0D7B77674BEBA2145193113486D2"><enum>(c)</enum><header>Definitions</header><text>Section 507 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2467">19 U.S.C. 2467</external-xref>) is amended—</text><paragraph id="idF848F9174ED54C4A99CA9684366C1F96"><enum>(1)</enum><text>in paragraph (4)—</text><subparagraph id="idF494B04EB1EB4E06948D4C67F3031268"><enum>(A)</enum><text>in subparagraph (D), by striking <quote>; and</quote> and inserting a semicolon; </text></subparagraph><subparagraph id="idA04A4DCAC86344E697D29ECC4DFD87F4"><enum>(B)</enum><text>in subparagraph (E), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="idD3EFB6E6F071477097EBCF043C07C315"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id907DFCE604044B20944FC2F2189BB0A5"><subparagraph id="idb27cbb5a9194477b906e2801f5ae0218"><enum>(F)</enum><text>the elimination of all forms of discrimination with respect to occupation and employment; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb3084517bf7145b0bae6c4e98e903f15"><enum>(G)</enum><text>the elimination of all forms of violence and harassment in the world of work, including gender-based violence and harassment.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id110459D614BE498298B7B003BF5B9430"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id47048C6F2340489A9A71EE030032F36E"><paragraph id="idAC82951BE6A84567BB913EB8DD43EA01"><enum>(7)</enum><header>Equal rights and protection under the law</header><text>The term <term>equal rights and protection under the law</term> refers to measures that provide the same rights, privileges, and protections to all citizens, including legal protections to ensure equal access and protections on the basis of gender regardless of marital status, including with respect to—</text><subparagraph id="id05c3ae952dea414d8bce91d28003f3b4"><enum>(A)</enum><text>all internationally recognized worker rights; </text></subparagraph><subparagraph id="idBFD6E3F3AC5142C680E72A36B6657723"><enum>(B)</enum><text>mobility, including obtaining identification that allows for mobility; </text></subparagraph><subparagraph id="idE62B3D0CDCE043E88FB2BE35817D30DD"><enum>(C)</enum><text>employment conditions, including opportunities, remuneration including benefits and equal treatment and pay in respect of work of equal value and protections from dismissal and other adverse employment actions on the grounds of pregnancy; </text></subparagraph><subparagraph id="idBB7909A9D6BB49C4911F023B3961E21E"><enum>(D)</enum><text>access to financial services, including bank accounts, loans, mortgages, and credit; </text></subparagraph><subparagraph id="id3C1FB934D9114388B4EBA99B0D720158"><enum>(E)</enum><text>assets, including property and inheritance rights; </text></subparagraph><subparagraph id="idD18E2D4F533D4269918097E5288EB009"><enum>(F)</enum><text>access to education; </text></subparagraph><subparagraph id="idC72E2B00AE9A457DA8F35163FFB11758"><enum>(G)</enum><text>access to public institutions, including courts; </text></subparagraph><subparagraph id="id36BE970158BC4B89A8DA198B5DF9ADB9"><enum>(H)</enum><text>protections from violence and harassment, including gender-based violence and harassment; </text></subparagraph><subparagraph id="idEB31B5DA423C4C6999C9F5C611093EF3"><enum>(I)</enum><text>marriage, divorce, and child custody; and </text></subparagraph><subparagraph id="id7CDA9874E82046179F8D9AC346F7A2F0"><enum>(J)</enum><text>participation in all levels of government and nongovernmental organizations and associations concerned with the public and political life of the country.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="id512307995D7D4168BF48FD9A3E328BFB"><enum>3.</enum><header>Supplemental review and reporting</header><subsection id="id6fc161a2a3a0444aa04b6bcb44d5dabf"><enum>(a)</enum><header>Policy of the United States</header><text>It is the policy of the United States to support gender equality and worker rights by promoting legal reforms that address legal, structural, and social barriers that constrain the full and free economic participation of all workers in the global economy.</text></subsection><subsection id="id5864C37A36EF4303B6F92A2A39F96C63"><enum>(b)</enum><header>Review of compliance</header><paragraph id="id0460702CE11C422FB7872896636E803B"><enum>(1)</enum><header>In general</header><text>Title V of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2461">19 U.S.C. 2461 et seq.</external-xref>) is amended by inserting after section 504 the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id849379F0AED84E9AA9D9A7133D9793A5"><section id="id8AC7B96143DC4D55BB5434F3494235BB"><enum>504A.</enum><header>Review of compliance relating to internationally recognized worker rights and equal rights and protection under the law</header><subsection id="id3703e76f4fdd439eb1d62ed85ce013b2"><enum>(a)</enum><header>In general</header><text>Not less frequently than annually, the United States Trade Representative and the Deputy Undersecretary of Labor for International Affairs, in consultation with the policy advisory committee on labor established under section 135(c)(1), shall jointly—</text><paragraph id="idE0735DC68DF94055AD98D1D2048E06BA"><enum>(1)</enum><text>review the laws of each beneficiary developing country related to the compliance of the country with internationally recognized worker rights and the affording of equal rights and protection under the law, regardless of gender, in each of the categories described in subsection (b); </text></paragraph><paragraph commented="no" id="id267AB3BE0F4043919879C7C5CD378F0D"><enum>(2)</enum><text>assess the legal rights and protections afforded in such counties and the extent to which the country continues to meet the eligibility criteria described in subparagraphs (G), (H), and (I) of section 502(b)(2); and</text></paragraph><paragraph commented="no" id="idFA55549F19DE43F98ACCE7F80CB495A7"><enum>(3)</enum><text>submit to Congress a report on the laws of and legal rights and protections afforded in such countries.</text></paragraph></subsection><subsection id="idD0F9B172A9014EBAB843C26526CE4075"><enum>(b)</enum><header>Categories described</header><text>The categories described in this subsection are the following:</text><paragraph id="id7EE856A3277F44BC92C90BE05CD455FE"><enum>(1)</enum><text>Internationally recognized worker rights. </text></paragraph><paragraph id="id42201F5555FC4ECE8899976AB5735876"><enum>(2)</enum><text>Mobility. </text></paragraph><paragraph id="id7FA9CB8614C34D999FE8E1A31637B951"><enum>(3)</enum><text>Employment conditions, benefits and pay, including equal pay for equal work and removal of employment restrictions.</text></paragraph><paragraph id="id714927D3D22140BEB2FEAC46D761B883"><enum>(4)</enum><text>Entrepreneurship. </text></paragraph><paragraph id="idCCE8BB820DD1452C824A446EB4521D69"><enum>(5)</enum><text>Assets, including property and inheritance rights. </text></paragraph><paragraph id="idBD697AE0D19A482288EAFDE5A0074EC1"><enum>(6)</enum><text>Equal access to education. </text></paragraph><paragraph id="id0B8C6CF1A97C4E7BB91EFEDC63B7B744"><enum>(7)</enum><text>Access to institutions. </text></paragraph><paragraph id="id68593BB4A3E14A7AB4EEA14A52C94969"><enum>(8)</enum><text>Protections from violence and harassment, including gender-based violence and harassment. </text></paragraph><paragraph id="idFBBDA081A767450D87B6C165D8AFFF9A"><enum>(9)</enum><text>Marriage, divorce, and child custody.</text></paragraph></subsection><subsection id="idB720D991BB6642F58A5BEA9E1840E1DE"><enum>(c)</enum><header>Failure To comply</header><text>If, in the report required by subsection (a) for 5 consecutive years, the Trade Representative and the Deputy Undersecretary, in consultation with the policy advisory committee on labor established under section 135(c)(1), determine that the laws of and legal rights and protections afforded in a beneficiary developing country fail to meet the eligibility criteria described in subparagraphs (G), (H), and (I) of section 502(b)(2), the benefits provided to that country under this title shall be reduced by such amount and in such manner as the Trade Representative considers appropriate.</text></subsection><subsection id="idF9BD8390433D441DA0EF3E9A560AB7E6"><enum>(d)</enum><header>Metrics</header><text>The Trade Representative and the Deputy Undersecretary shall establish metrics for the conduct of reviews and assessments under subsection (a). </text></subsection><subsection commented="no" id="ida0599d463fd946c1a4634b70c3c6a07c"><enum>(e)</enum><header>Measurement of women's economic empowerment</header><text>To support the measurement of women’s economic empowerment, the Trade Representative shall encourage and support the reporting by beneficiary developing countries of sex-disaggregated economic and business data, including the gathering of information consistent with the United Nations Sustainable Development Goals, particularly the goals relating to gender equality and decent work.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="id8524ADE0E45E46198063DCDAB5532905"><enum>(2)</enum><header>Clerical amendment</header><text>The table of contents for the Trade Act of 1974 is amended by inserting after the item relating to section 504 the following:</text><quoted-block style="OLC" id="id5735daf0-1847-48ca-a64c-48b38885037a"><toc><toc-entry level="section" idref="id8AC7B96143DC4D55BB5434F3494235BB">Sec. 504A.
