which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish the CCP Initiative program, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section id="id6190449cd0174dca9a0489be40c6419a" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protect America’s Innovation and Economic Security from CCP Act</short-title></quote>.</text></section><section id="S1" section-type="subsequent-section"><enum>2.</enum><header>CCP Initiative program</header><subsection id="idB681A436D2CB405BA3E7948D82970DBA"><enum>(a)</enum><header>Establishment</header><text>There is established in the National Security Division of the Department of Justice the CCP Initiative to—</text><paragraph id="id5031E692CAAC425597C4A4F7BFC329CE"><enum>(1)</enum><text>counter nation-state threats to the United States;</text></paragraph><paragraph id="idA8D43DDA60254EE7AAB0AB3F9F286102"><enum>(2)</enum><text>curb spying by the Chinese Communist Party on United States intellectual property and academic institutions in the United States; and</text></paragraph><paragraph id="idFB5F1CE65355439CB6ACACF3371B75AF"><enum>(3)</enum><text>focus on—</text><subparagraph id="id33DC7E6867CA481497C45E2D21AF8904"><enum>(A)</enum><text>identifying and prosecuting those engaged in trade secret theft, hacking, and economic espionage; and</text></subparagraph><subparagraph id="id40BA7957E6EE446E92E8645D71F372B3"><enum>(B)</enum><text>protecting the critical infrastructure in the United States against external threats through foreign direct investment and supply chain compromises. </text></subparagraph></paragraph></subsection><subsection id="id77A1DE2D453B4F5DB734BA0FC041B5E5"><enum>(b)</enum><header>Steering committee</header><text>The CCP Initiative shall be led by a steering committee comprised of—</text><paragraph id="id8CA4B5262BD54234A5F814CB5AF157D1"><enum>(1)</enum><text>the Assistant Attorney General for National Security;</text></paragraph><paragraph id="idC698D13E69CF48A992873522D3A0E42D"><enum>(2)</enum><text>senior officials in the Federal Bureau of Investigation, as determined by the Attorney General;</text></paragraph><paragraph id="id1024E3819D4745BD8518EDDF943C51D5"><enum>(3)</enum><text>the Assistant Attorney General for the Criminal Division of the Department of Justice;</text></paragraph><paragraph id="id4363299EE0FB425AA1031F016DF03DE5"><enum>(4)</enum><text>the Executive Assistant Director of the National Security Branch of the Federal Bureau of Investigation; and</text></paragraph><paragraph id="idE0FBCE890FDE4122B80B2C2177538BB8"><enum>(5)</enum><text>five United States attorneys, appointed by the Attorney General, from the judicial districts with the most cases involving espionage, intellectual property theft, and trade secrets during the preceding 5-year period.</text></paragraph></subsection><subsection id="id6D7C3077F92C438ABDE7D829CDB02247"><enum>(c)</enum><header>Goals</header><text>The CCP Initiative shall have the following goals:</text><paragraph id="id2f40f6c046304259affa2eb671203f58"><enum>(1)</enum><text>Identify priority trade secret theft cases, ensuring that investigations are adequately resourced.</text></paragraph><paragraph id="idAFD092914A034AA696456F2DC06C9983"><enum>(2)</enum><text>Work to bring the cases described in paragraph (1) to fruition in a timely manner and according to the facts and applicable law.</text></paragraph><paragraph id="idc174bf4e8c1d4b2588fc3b37b8465500"><enum>(3)</enum><text>Develop an enforcement strategy concerning nontraditional collectors, including researchers in labs, universities, and the defense industrial base, that are being co-opted into transferring technology contrary to United States interests.</text></paragraph><paragraph id="id1a1e36f3cbcf40429b6ed23d46b13d37"><enum>(4)</enum><text>Educate colleges and universities about potential threats to academic freedom and open discourse from influence efforts on campus.</text></paragraph><paragraph id="ida39afc0fdee04e21a68019b24e91d9a6"><enum>(5)</enum><text>Apply the Foreign Agents Registration Act of 1938, as amended (<external-xref legal-doc="usc" parsable-cite="usc/22/611">22 U.S.C. 611 et seq.</external-xref>) to unregistered agents seeking to advance the political agenda of the People's Republic of China, bringing enforcement actions if appropriate.</text></paragraph><paragraph id="id6d259a897ac345ac88d68756e936c3fa"><enum>(6)</enum><text>Equip United States attorneys with intelligence and materials to be used to—</text><subparagraph commented="no" display-inline="no-display-inline" id="idf1cda48fd4be4e41814eb4e5e6839ed5"><enum>(A)</enum><text display-inline="yes-display-inline">raise awareness of the threats described in this section within their judicial districts; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idd4cbb8a9a7a94b7babee6c3829040475"><enum>(B)</enum><text display-inline="yes-display-inline">support outreach efforts.</text></subparagraph></paragraph><paragraph id="iddd4b0b2fc3a445ef9a9728ba95198260"><enum>(7)</enum><text>Implement the Foreign Investment Risk Review Modernization Act of 2018 (division A of title XVII of <external-xref legal-doc="public-law" parsable-cite="pl/115/232">Public Law 115–232</external-xref>; 132 Stat. 2173) for the Department of Justice, including by working with the Department of the Treasury to develop regulations under that Act and prepare for increased workflow.</text></paragraph><paragraph id="id8c6ff905673540d48ed5f8d519501eb8"><enum>(8)</enum><text>Identify opportunities to better address supply chain threats, especially ones impacting the telecommunications sector, prior to the transition to 5G networks.</text></paragraph><paragraph id="idc33c66c779704e8a9c726413bf524f87"><enum>(9)</enum><text>Identify Foreign Corrupt Practices Act of 1977 (<external-xref legal-doc="public-law" parsable-cite="pl/95/213">Public Law 95–213</external-xref>; 91 Stat. 1494) cases involving Chinese companies that compete with United States businesses.</text></paragraph><paragraph id="ida5945a806cb54369b4b6fea610f01c7e"><enum>(10)</enum><text>Increase efforts to improve Chinese responses to requests under the Mutual Legal Assistance Agreement with the United States.</text></paragraph><paragraph id="idb3c229480cc54345b5b13270eea03522"><enum>(11)</enum><text>Evaluate whether additional legislative and administrative authorities are required to protect United States assets from foreign economic aggression.</text></paragraph></subsection><subsection id="idD1F585FADDD94A939FED69683A588F5F"><enum>(d)</enum><header>Requirement</header><text>Under the CCP Initiative—</text><paragraph id="idF82FB028175B4F03AD6625866C257526"><enum>(1)</enum><text>all investigations and prosecutions shall be set as priority and not based on discretion;</text></paragraph><paragraph id="idE0C9BF408B0940BFBF0D955D3F156A8A"><enum>(2)</enum><text>the Initiative shall be separate from and not under the authority or discretion of any other Department of Justice initiative dedicated to countering nation-state threats; and</text></paragraph><paragraph id="idE75607272CAA47E7B846FEDB8E6D6ED1"><enum>(3)</enum><text>all resources used for the CCP Initiative shall solely be set aside for the CCP Initiative and shall not be combined to support any other Department of Justice program, including other programs and initiatives dedicated to countering nation-state threats.</text></paragraph></subsection><subsection id="id658F781AB15F42E3816DA61A15B87A3B"><enum>(e)</enum><header>Annual briefing</header><text>The Attorney General shall brief the Committee on Homeland Security and Governmental Affairs and the Committee on the Judiciary of the Senate and the Committee on Homeland Security and the Committee on the Judiciary of the House of Representatives annually on the progress and challenges of the CCP Initiative.</text></subsection><subsection id="id4647089551854932B0A4574E365AAFB0"><enum>(f)</enum><header>Sunset</header><text>This Act is effective beginning on the date of enactment of this Act and ending on the date that is 6 years after that date.</text></subsection><subsection id="id6EFD77D51A0F4E068FA85B8F91850812"><enum>(g)</enum><header>Severability</header><text>If any provision of this Act, or the application of such provision to any person or circumstance, is held to be unconstitutional, the remainder of this Act, and the application of the provisions of such to any person or circumstance, shall not be affected thereby.</text></subsection></section></legis-body></bill>
