<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>2d Session</session><legis-num>S. 5114</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20240919">September 19, 2024</action-date><action-desc><sponsor name-id="S422">Mr. Welch</sponsor> (for himself and <cosponsor name-id="S313">Mr. Sanders</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Marsh-Billings-Rockefeller National Historical Park Establishment Act to expand the boundary of the Marsh-Billings-Rockefeller National Historical Park in the State of Vermont, and for other purposes. </official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Marsh-Billings-Rockefeller National Historical Park Establishment Act Amendments Act of 2024</short-title></quote>.</text></section><section id="id3288ccee37ef4fa2ac10c27d5cfe528e"><enum>2.</enum><header>Boundary expansion</header><text display-inline="no-display-inline">Section 3 of the Marsh-Billings-Rockefeller National Historical Park Establishment Act (<external-xref legal-doc="usc" parsable-cite="usc/16/410vv-1">16 U.S.C. 410vv–1</external-xref>) is amended by striking subsection (b) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5CF49674F1DD491DA3C798A46BDDDB85"><subsection id="id0076b0392e7843c78657463944148ab9"><enum>(b)</enum><header>Boundaries; map</header><paragraph id="idf013fa83eba84e07b5740114fe6a4632"><enum>(1)</enum><header>Boundaries</header><subparagraph id="idc3824312c3f143cfbaf538363e3ba72a"><enum>(A)</enum><header>In general</header><text>The boundaries of the park shall be as generally depicted on the map entitled <quote>Marsh-Billings-Rockefeller National Historical Park, Proposed Boundary Revision</quote>, numbered 456/190,048, and dated August 2023.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id741b4f4e19364aa7b2aa5eb93c56b70d"><enum>(B)</enum><header>Inclusions</header><text display-inline="yes-display-inline">The park shall include the following:</text><clause id="id58beefd1632647e79db5ecede4899a3f"><enum>(i)</enum><text>A historic zone, including—</text><subclause commented="no" display-inline="no-display-inline" id="ide8947db44cdb41fba58159cc7de5490c"><enum>(I)</enum><text display-inline="yes-display-inline">the Marsh-Billings-Rockefeller Mansion;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idb71c1e07b75a439086a03608b23450d9"><enum>(II)</enum><text display-inline="yes-display-inline">surrounding buildings; and </text></subclause><subclause commented="no" display-inline="no-display-inline" id="id1056dde2cbf34719b15721a7cd5d65d1"><enum>(III)</enum><text display-inline="yes-display-inline">a portion of the area known as <quote>Mt. Tom</quote>.</text></subclause></clause><clause id="id2e93d5007a1841b5995f28f34f6bf0ae"><enum>(ii)</enum><text>A protection zone, including the area occupied by the Billings Farm and Museum.</text></clause><clause id="id1c5ba3f9edb04014aa677cdeaf8db232"><enum>(iii)</enum><text>The King Farm, which shall be divided between the historic zone described in clause (i) and the protection zone described in clause (ii), as determined by the Secretary to be appropriate.</text></clause></subparagraph></paragraph><paragraph id="idc2653d5495d34b9d89541a9c1065b4f8"><enum>(2)</enum><header>Availability of map</header><text>The map described in paragraph (1)(A) shall be on file and available for public inspection in the appropriate offices of the National Park Service.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id6b9eae0018da431383614d7fb593c1de"><enum>3.</enum><header>Acquisition of land</header><text display-inline="no-display-inline">Section 4 of the Marsh-Billings-Rockefeller National Historical Park Establishment Act (<external-xref legal-doc="usc" parsable-cite="usc/16/410vv-2">16 U.S.C. 410vv–2</external-xref>) is amended—</text><paragraph id="id7b2189164b8643a388c763f443cf6d9a"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="id31a96c5a24b141a0aaa483dc17f5e550"><enum>(A)</enum><text>by striking paragraphs (1) and (2) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idDAA1860488BA4331B2536168C5F1770A"><paragraph id="idcac7e1692b7d4a5ea9931bd0e001d044"><enum>(1)</enum><header>In general</header><text>The Secretary may acquire land or an interest in land within the boundary of the park by—</text><subparagraph commented="no" display-inline="no-display-inline" id="id832b57870a50496292935df934df4bf9"><enum>(A)</enum><text display-inline="yes-display-inline">donation;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id83e5cdac064e4cb3b3ca47fa6698bdf0"><enum>(B)</enum><text display-inline="yes-display-inline">purchase from a willing seller with donated or appropriated funds;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2643a778fa694250b90b661e6e78a746"><enum>(C)</enum><text display-inline="yes-display-inline">transfer from a Federal agency; or </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2289038c89474f638c882744c31da12f"><enum>(D)</enum><text display-inline="yes-display-inline">exchange.</text></subparagraph></paragraph><paragraph id="idc4d2714e60a14ea1b03976ea46838faa"><enum>(2)</enum><header>King Farm</header><text>Acquisition by the Secretary of the land described in section 3(b)(1)(B)(iii) shall include—</text><subparagraph commented="no" display-inline="no-display-inline" id="idac0b8a4f65ea49f89a69b975e973b522"><enum>(A)</enum><text display-inline="yes-display-inline">a right of access from the land acquired to the park; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id513663135eee4adb8049be215fec9d2b"><enum>(B)</enum><text display-inline="yes-display-inline">a right of access to the land acquired from the park.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id4415dcc34f7448078c9f92e7f9803392"><enum>(B)</enum><text>in paragraph (3), by striking <quote>(3) The Secretary</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idE845D1AB132D46BA9F6A5D1E6EB07ED9"><paragraph id="id7a9f8b4dba9c42f981888021a5ee85d3"><enum>(3)</enum><header>Commercial operation</header><text>The Secretary</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id9fef693f96b2405ca5bbd113fc7201f7"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id366187279d7b44618aada43a844e3f05"><subsection id="idf7f55b07993043ecacccebc36a3f98ab"><enum>(e)</enum><header>King farm</header><text>On acquisition by the Secretary of the land described in section 3(b)(1)(B)(iii), the acquired land may be used for—</text><paragraph id="id1f758a9ef4224002936076dbe9534ff0"><enum>(1)</enum><text>agricultural and forestry purposes, including the growing and harvesting of crops and trees, animal husbandry, and other agricultural operations customary in the State of Vermont;</text></paragraph><paragraph id="id11b5d9edfd264c288707fa815df58950"><enum>(2)</enum><text>conservation purposes in a manner that preserves the historic character of a working farm and forest; and</text></paragraph><paragraph id="idf626a062cd274950bbf4e82f6d5be1f7"><enum>(3)</enum><text>educational purposes relating to agriculture, forestry, and conservation activities, including the study of natural history.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="idc57af75460974ae48eeed67dc11292e8"><enum>4.</enum><header>Scenic zone</header><text display-inline="no-display-inline">Section 5(a) of the Marsh-Billings-Rockefeller National Historical Park Establishment Act (<external-xref legal-doc="usc" parsable-cite="usc/16/410vv-3">16 U.S.C. 410vv–3(a)</external-xref>) is amended by striking <quote><quote>Marsh-Billings-Rockefeller National Historical Park Scenic Zone Map</quote> and dated November 19, 1991</quote> and inserting <quote><quote>Marsh-Billings-Rockefeller National Historical Park, Proposed Boundary Revision</quote>, numbered 456/190,048, and dated August 2023</quote>.</text></section><section id="idea3892b35aa24706acfc5d021eb4e9d1"><enum>5.</enum><header>National Park Service Stewardship Institute</header><text display-inline="no-display-inline">The Marsh-Billings-Rockefeller National Historical Park Establishment Act (<external-xref legal-doc="usc" parsable-cite="usc/16/410vv">16 U.S.C. 410vv et seq.</external-xref>) is amended—</text><paragraph id="id43fc403722304e69bd26112ee17d8329"><enum>(1)</enum><text>by redesignating sections 6 through 10 as sections 7 through 11, respectively; and</text></paragraph><paragraph id="id23d7a0f8516449578cf6c909db13c0c1"><enum>(2)</enum><text>by inserting after section 5 the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3ca5b4ebb9d945a8a66cf84d80e96168"><section id="id3a2d11918eed4c4daa98b866028e8962"><enum>6.</enum><header>National Park Service Stewardship Institute</header><subsection id="idb8f35c7f3b5245be87517c576a0e5156"><enum>(a)</enum><header>In general</header><text>There is established at the park the National Park Service Stewardship Institute (referred to in this Act as the <quote>Institute</quote>).</text></subsection><subsection id="idc1c7e2a6871a4e05be6be585b23e8043"><enum>(b)</enum><header>Purposes</header><text>The purposes of the Institute are—</text><paragraph id="id2ca3223373674ff4a42936c829477f1a"><enum>(1)</enum><text>to highlight and encourage the advancement of stewardship practices through workshops, public programs, learning opportunities, and similar programming;</text></paragraph><paragraph id="id506c315377b04e14a8cd3c0b14d43ce0"><enum>(2)</enum><text>to create opportunities within the National Park Service to identify and share innovation through research, evaluation, and dialogue; and</text></paragraph><paragraph id="id7db960ed8545402190fea3b332f906d5"><enum>(3)</enum><text>to identify and exchange best practices and enhance leadership capacity, partnership development, and community engagement in the fields of conservation and resource stewardship.</text></paragraph></subsection><subsection id="id747bceb48b6f43f585400a4780b8eb2d"><enum>(c)</enum><header>Administration</header><text>The Institute shall be managed as a program of the park.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
