<distribution-code display="yes">II</distribution-code><congress>118th CONGRESS</congress><session>2d Session</session><legis-num>S. 5109</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20240919">September 19, 2024</action-date><action-desc><sponsor name-id="S380">Mr. Peters</sponsor> (for himself and <cosponsor name-id="S391">Mr. Young</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend section 3520A of title 44, United States Code, to extend the Chief Data Officer Council's sunset and add new authorities for improving Federal agency data governance, including to enable reliable and secure adoption of emerging technologies and artificial intelligence, and for other purposes.</official-title></form><legis-body style="OLC"><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Modernizing Data Practices to Improve Government Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="idcf6c5d270fb146068910c71edace9850"><enum>2.</enum><header>Amendments</header><subsection commented="no" display-inline="no-display-inline" id="idd391841ccc02419a852eaea7a70b2cf9"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 3520A of title 44, United States Code, is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id427b5980656f4602a296eefd971932cb"><enum>(1)</enum><text>by striking subsections (d) and (e);</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id79912a9cbec74218b79fae9b21b0d3a0"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating subsections (a) through (c) as subsections (b) through (d), respectively;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbbc4f2f1ee474f0c9876632960096f1b"><enum>(3)</enum><text>by inserting before subsection (b), as so redesignated, the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="idBA52661A9FA64615ACFCE44241907382"><subsection commented="no" display-inline="no-display-inline" id="id23c869aeadd94a03b540270057ba67c9"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="ida67e72a8f2634fd7b3b59cd8a7766351"><enum>(1)</enum><header>Artificial intelligence</header><text display-inline="yes-display-inline">The term <term>artificial intelligence</term>—</text><subparagraph commented="no" display-inline="no-display-inline" id="id53a0d590d50542a5982cfde3aacd54a5"><enum>(A)</enum><text display-inline="yes-display-inline">has the meaning given that term in section 5002 of the National Artificial Intelligence Initiative Act of 2020 (<external-xref legal-doc="usc" parsable-cite="usc/15/9401">15 U.S.C. 9401</external-xref>); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb1fc29c377514b30929e0cba7594feef"><enum>(B)</enum><text display-inline="yes-display-inline">includes the artificial systems and techniques described in paragraphs (1) through (5) of section 238(g) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (<external-xref legal-doc="public-law" parsable-cite="pl/115/232">Public Law 115–232</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/10/4061">10 U.S.C. 4061</external-xref> note prec.).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id231bd62954714eafa9b68c67ea2c333c"><enum>(2)</enum><header>Data governance</header><text display-inline="yes-display-inline">The term <term>data governance</term>—</text><subparagraph commented="no" display-inline="no-display-inline" id="id47496cc9bcfd443099d49b498cf3b8c3"><enum>(A)</enum><text display-inline="yes-display-inline">means the approach of an agency to managing data during the lifecycle of the data, from acquisition, to use, to disposal; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc1078bceb89a4b209e7c7cffd29075cb"><enum>(B)</enum><text display-inline="yes-display-inline">includes—</text><clause commented="no" display-inline="no-display-inline" id="id8c182085e136434ba90bab33cf31e8e3"><enum>(i)</enum><text display-inline="yes-display-inline">all actions an agency must take and the technology and processes an agency must use to ensure data is secure, private, accurate, available, and usable; and</text></clause><clause id="idc591a66c0eb74fd7a8c945f7eb28b716"><enum>(ii)</enum><text>authorities, roles, responsibilities, organizational structures, policies, procedures, standards, and resources for the definition, stewardship, production, security provenance, and use of data.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id751cfbd6110f49ad8edc9a5e741e0ff4"><enum>(3)</enum><header>Use case</header><text display-inline="yes-display-inline">The term <term>use case</term> means a description of the ways and circumstances in which a technology is deployed to perform a specific function.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id11cd0f7db80044bd8760744da3830b68"><enum>(4)</enum><text>in subsection (c), as so redesignated—</text><subparagraph commented="no" display-inline="no-display-inline" id="idca00039177e54f2a894c6ed09c57ec94"><enum>(A)</enum><text>by redesignating paragraph (5) as paragraph (6);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idc81275b17519498f8a32528c47337e15"><enum>(B)</enum><text>in paragraph (4), by striking the <quote>and</quote> at the end; and</text></subparagraph><subparagraph id="idc2442711f247426baa503a69c3598e61"><enum>(C)</enum><text>by inserting after paragraph (4) the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id6392F9B76069436CB2F0A521D9D0E949"><paragraph commented="no" display-inline="no-display-inline" id="id57a59b6071be40a3a75ed7d28dcd4e94"><enum>(5)</enum><text>identify opportunities and procedures to improve data governance to—</text><subparagraph commented="no" display-inline="no-display-inline" id="id4dffadea70874365a889c1217ab8a7ba"><enum>(A)</enum><text display-inline="yes-display-inline">ensure the data of agencies are transparent, accessible, and of sufficient quality for the intended use of the data; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8a614fe00b9540d79dcb389d259634b6"><enum>(B)</enum><text display-inline="yes-display-inline">support agency heads and their efforts to reliably and securely leverage emerging technologies and artificial intelligence, to ensure mission outcomes and improve operational efficiency across agencies; and</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id40df9a8cf83342e780e5bce9a3b632ee"><enum>(5)</enum><text>in subsection (d)(3), as so redesignated—</text><subparagraph commented="no" display-inline="no-display-inline" id="id16ba18a59678426f9d2723cf2f8579fa"><enum>(A)</enum><text>by striking <quote>The Administrator</quote> and inserting the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="idBBC80FFF5E8F456CBEF24DC07F8BE76D"><subparagraph commented="no" display-inline="no-display-inline" id="ida4d77cf1961947f189d941fe742f6ed6"><enum>(A)</enum><header>Administrator of the office of electronic government</header><text display-inline="yes-display-inline">The Administrator</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2e0e833b3b914d4388dfff8f680410b6"><enum>(B)</enum><text>by inserting after subparagraph (A), as so designated, the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id9A9C972B39DE44CF9463541128066DEC"><subparagraph commented="no" display-inline="no-display-inline" id="id3b591a7d1e4046c594e039bd3842a124"><enum>(B)</enum><header>Appointed members</header><text>The Director shall appoint a representative from among Chief Artificial Intelligence Officers to serve on the Council.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb91ca0aa49cc43728fbbb7ac055fc07c"><enum>(6)</enum><text>by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id8DD2223D1BC345FDB808082D7692301B"><subsection commented="no" display-inline="no-display-inline" id="id76d39604594b4b1789ad3d29248c0401"><enum>(e)</enum><header>Data governance reports</header><text>The Council shall submit to the Director, the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name>, and the<committee-name committee-id=""> Committee on Oversight and Accountability of the House of Representatives</committee-name>—</text><paragraph id="idb7a3bbde0d874e7e9e24ddea991e87c8"><enum>(1)</enum><text>a biennial report on the work of the Council, including any updates to the recommendations provided in the report required under paragraph (2) of this subsection;</text></paragraph><paragraph id="idd39994994f3442108d99bdbbbbb0fd4c"><enum>(2)</enum><text>not later than 1 year after the date of enactment of this subsection, a report with recommendations and best practices for agencies on developing datasets, data governance policies, and infrastructure to enable adoption and use of emerging technologies and artificial intelligence, including for use in training, testing, and operation of artificial intelligence within agencies that includes—</text><subparagraph id="id31992319723a4aa3b8afb5ef67cc6334"><enum>(A)</enum><text>an assessment of key data governance and sharing challenges preventing adoption of emerging technologies and artificial intelligence across agencies;</text></subparagraph><subparagraph id="id8ca782014936405e919e6a3e23a727b6"><enum>(B)</enum><text>an assessment of ways to strengthen and clarify roles and responsibilities related to data governance between senior agency leaders, including the Chief Information Officer, the Chief Information Security Officer, the Chief Financial Officer, the Chief Privacy Officer, the Chief Artificial Intelligence Officer, and the Chief Acquisition Officer;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id64522e9de97248538737c738135f21da"><enum>(C)</enum><text display-inline="yes-display-inline">recommendations for data governance best practices, including—</text><clause commented="no" display-inline="no-display-inline" id="id752b6b7bfeaf45428cf279b7524b968a"><enum>(i)</enum><text display-inline="yes-display-inline">best practices to ensure data used for testing, training, and operation of artificial intelligence is reliable, relevant to the task, representative of the impacted individuals of the artificial intelligence system, transparent, high quality, and protects the privacy and personally identifiable information of individuals; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idfb17ac12fee543cba6c00f3e77819826"><enum>(ii)</enum><text>defining key data standards, including data quality;</text></clause></subparagraph><subparagraph id="idae3dd8c5ba8746fa83f4d98cc5223b02"><enum>(D)</enum><text>a prioritization of agency artificial intelligence use cases that address a critical need across the Federal Government, for which new or shared datasets are needed to support adoption;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2999991fb5c74b608bf43078c9a6ac39"><enum>(E)</enum><text display-inline="yes-display-inline">identification of existing data available to 1 or more agencies that would benefit other such agencies if the data were shared or made available;</text></subparagraph><subparagraph id="id19b31a46b60f4d16919e162143ae1fe0"><enum>(F)</enum><text>recommendations for ways to address increases in risks, including through training of relevant agency employees, associated with—</text><clause commented="no" display-inline="no-display-inline" id="id58112806d8754a4da6b33ea57fd99b81"><enum>(i)</enum><text display-inline="yes-display-inline">the potential for misuse of, mismanagement of, and unauthorized access to data and personally identifiable information of individuals when an agency leverages data for use in artificial intelligence, including identification of software or hardware solutions, technical processes, techniques, or other technological means of mitigating privacy risks arising from data processing; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id0b0232a48360438fad0e136e23071e1c"><enum>(ii)</enum><text>increasing access to the data of the agency for the purposes of supporting a cross-Government mission;</text></clause></subparagraph><subparagraph id="id9cc360ae1eb7403695d5c31e9d0bccf3"><enum>(G)</enum><text>recommendations for data ownership and retention policies and procedures, including policies and procedures to ensure that agency contracts to procure artificial intelligence include any necessary clauses to ensure that the Federal Government—</text><clause id="id542e8357277043c28518f7d533858399"><enum>(i)</enum><text>retains sufficient rights to data, and any modifications to that data;</text></clause><clause commented="no" display-inline="no-display-inline" id="id8371a814591a490287e0d6c520531840"><enum>(ii)</enum><text display-inline="yes-display-inline">avoids vendor lock-in and retains the ability to facilitate or conduct the continued design, development, testing, and operation of artificial intelligence by the Federal Government; and</text></clause><clause id="idc15be7ad841b4c0e9ed1b3121544b66b"><enum>(iii)</enum><text>can conduct pre-procurement reviews of artificial intelligence to assess potential error issues;</text></clause></subparagraph><subparagraph id="id54a20de6ab6044348641a7d2bd28b5db"><enum>(H)</enum><text>criteria agencies should consider when using data to train artificial intelligence used by agencies, including recommendations for—</text><clause id="id9043b96a8b44481cb8238f39d49a9eac"><enum>(i)</enum><text>ways to increase transparency of training data for the public and for agency employees using the relevant artificial intelligence system software;</text></clause><clause id="id3efb3f1975e64768b462107dd70dc2a4"><enum>(ii)</enum><text>processes and procedures to analyze and test training data for potential risks; </text></clause><clause commented="no" display-inline="no-display-inline" id="id916e3835ffc74458a62ee6588411b8bc"><enum>(iii)</enum><text display-inline="yes-display-inline">criteria for determining how to preserve the interests of the Federal Government; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id94bce11d05c54c4f98de760f62af88c7"><enum>(iv)</enum><text>performance evaluation metrics to ensure that an artificial intelligence system performs as intended;</text></clause></subparagraph><subparagraph id="idf19b9f45d1354a809df9f43e8fdbabf9"><enum>(I)</enum><text>recommendations for ways to expand public access to Federal data assets in a machine-readable format while also taking into account security considerations, including the risk that, while information in an individual data asset may not pose a security risk in isolation, such information could pose a security risk when combined with other data assets;</text></subparagraph><subparagraph id="idc3772aa8c96b4fef8484847b4dac2e3a"><enum>(J)</enum><text>recommendations for defining, generating, using, and ensuring the privacy and security of synthetic data in the Federal Government, including—</text><clause id="idbf1999c997ec4b20b91b89115497d8ce"><enum>(i)</enum><text>a formalized definition of synthetic data generation for government use, including specifying definitions for data which is fully or partially synthetic;</text></clause><clause id="id599cb4cab4584802833f6d05cc182a8c"><enum>(ii)</enum><text>guidance for agencies on best practices around synthetic data generation and use, including tools or techniques agencies should take to—</text><subclause commented="no" display-inline="no-display-inline" id="id636b6d7257db4ce5abb7b9eb36365a02"><enum>(I)</enum><text display-inline="yes-display-inline">mitigate privacy and security risks;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id17af7bc7b0594c4f87c3f846be91631d"><enum>(II)</enum><text display-inline="yes-display-inline">ensure agencies practice appropriate processes to ensure the accuracy and quality of synthetic data and the appropriateness for the intended use of the synthetic data by the agency;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idb64c009ccd034d62a8ecee7357a284c3"><enum>(III)</enum><text display-inline="yes-display-inline">adopt the appropriate techniques to validate synthetic data, including data profiling, data consistency, data integrity, and data documentation; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="id0e45480270e044a88412b92fe1b66b89"><enum>(IV)</enum><text display-inline="yes-display-inline">communicate opportunities, risks, and limitations of synthetic data internally to agencies and externally to the public;</text></subclause></clause><clause id="id44502e78922942978b3511e4fc918c19"><enum>(iii)</enum><text>opportunities across the Federal Government and within specific agencies for embracing or avoiding the use of synthetic data; and</text></clause><clause id="id3f4e4339d976441f88de49f490250d2a"><enum>(iv)</enum><text>opportunities for the Federal Government to partner with public and private sector entities in the development and sharing of data, including synthetic data, to help in the adoption of emerging technologies and artificial intelligence; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide1bc3f1f52e44bd48c8076aec090e461"><enum>(K)</enum><text>for subparagraphs (A) through (J), an indication of how agencies can incorporate the respective recommendations and best practices into existing agency processes and statutory requirements.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idec7c708a95984ecf8c5400ede22de65d"><enum>(f)</enum><header>Data governance guidance</header><text>The Director, upon receipt of a report required under subsection (e), may issue guidance to agencies with respect to the implementation of the recommendations of the report.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idef0feeef6f9d4997a3929b4311d4ba89"><enum>(g)</enum><header>Data management report</header><text>Not later than 270 days after the date of enactment of this subsection, the Director, in consultation with the Council, shall submit to Congress an annual report with recommendations to clarify and enhance the roles of the Chief Data Officers across the Federal Government relating to data governance for artificial intelligence, including—</text><paragraph id="id4855d1cb4e1045edb5fc617f2ae9aa83"><enum>(1)</enum><text>an inventory of all Chief Data Officers of agencies, including, with respect to each agency—</text><subparagraph id="idab96cee57f5e41dc9e547d2ef705ca77"><enum>(A)</enum><text>any additional roles or titles the Chief Data Officer holds at the agency;</text></subparagraph><subparagraph id="idf975dfaf34664a6292111376b1f17c5a"><enum>(B)</enum><text>the organizational structure of the agency, including any official to whom the Chief Data Officer reports to within the agency; and</text></subparagraph><subparagraph id="idaadf7e58de1140f388836e303d5b3470"><enum>(C)</enum><text>the respective roles, responsibilities, and statutory authorities relating to data and artificial intelligence of the Chief Data Officer at the agency;</text></subparagraph></paragraph><paragraph id="id6d71e811082545a998f55ab8123d11f7"><enum>(2)</enum><text>an identification of skills and resources needed by Chief Data Officers and their staffs to support artificial intelligence system adoption at agencies; and</text></paragraph><paragraph id="idcd9ca4bbb778458f91bd6a6082370549"><enum>(3)</enum><text>recommendations for suggested collaboration opportunities between the Council and other interagency councils to improve data governance best practices across government, including—</text><subparagraph id="id3020549b609b42b5989c119b16d2047a"><enum>(A)</enum><text>the Chief Financial Officers Council;</text></subparagraph><subparagraph id="idcab3ba57edad4710a8d1377e91a14d0a"><enum>(B)</enum><text>the Chief Human Capital Officers Council;</text></subparagraph><subparagraph id="id1cb7940843c54621af99751a0d9b9290"><enum>(C)</enum><text>the Chief Acquisition Officers Council;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id19ffcca11fd34d43b7bde3fc63fa3bfd"><enum>(D)</enum><text>the Federal Privacy Council;</text></subparagraph><subparagraph id="id1d096cac82184c298ee11318c67899e6"><enum>(E)</enum><text>the Chief Information Officers Council; and</text></subparagraph><subparagraph id="id6a3c3b813ff14fd287dc063e3bc77a58"><enum>(F)</enum><text>other key groups of the Federal Government.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id5714a30ab6b540c5bda953b03c406cfe"><enum>(h)</enum><header>Evaluation</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this subsection, and not less frequently than once every 2 years thereafter, the Comptroller General shall submit to Congress a report on—</text><paragraph commented="no" display-inline="no-display-inline" id="ida3923af36a314032ba41e02c138800e6"><enum>(1)</enum><text display-inline="yes-display-inline">whether the duties of the Council improved the use of evidence and program evaluation in the Federal Government; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idf26b526f4da84ba190731db8e29adf2a"><enum>(2)</enum><text display-inline="yes-display-inline">any barriers or challenges preventing the Council from accomplishing the objectives under this section or the amendments made by the <short-title>Modernizing Data Practices to Improve Government Act</short-title>.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id343f25cfb1c1401e823c7dfc2a1d9831"><enum>(b)</enum><header>Sunset</header><text>Beginning on the date that is 7 years after the date of enactment of this Act, the amendments made by this Act shall have no force or effect.</text></subsection></section></legis-body></bill>
