which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Soil and Water Resources Conservation Act of 1977 with respect to assessments of conservation programs, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H2D037E4814044920A7332EBD534B2AFD"><section section-type="section-one" id="H90B6EC0D07B445D8819E85444C5109A9"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Farmer Driven Conservation Outcomes Act of 2024</short-title></quote>.</text></section><section section-type="subsequent-section" id="H362A12382BA24B60A20B25428A6537D3"><enum>2.</enum><header>Amendments to the Soil and Water Resources Conservation Act of 1977</header><text display-inline="no-display-inline">The Soil and Water Resources Conservation Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/16/2001">16 U.S.C. 2001 et seq.</external-xref>) is amended—</text><paragraph id="idA9DEB2A178F34FD8B94CEE997459AA9E"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating sections 8 through 10 as sections 10 through 12, respectively; and </text></paragraph><paragraph id="id005A425DD5174CAEA956362E2D365C00"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after section 7 the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H41422D66B80849BA8A1BAE0558AEA3EA"><section id="HF1CE54204AEC44A4AC6893EC5984CD28"><enum>8.</enum><header>Conservation programs assessment</header><subsection id="HC80FC7870B8B412085CF60DF855C03D7"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In coordination with the appraisal of soil, water, and related resources and the soil and water conservation program, the Secretary shall carry out a conservation effects assessment project—</text><paragraph id="idC7ACECD8ACF248328173B6A3A0BA40AB"><enum>(1)</enum><text display-inline="yes-display-inline">to quantify the environmental and economic effects of conservation practices; </text></paragraph><paragraph id="idCB6C734EC9C84487B938CE5CC904D8D3"><enum>(2)</enum><text display-inline="yes-display-inline">to develop the science base for managing the agricultural landscape for environmental quality and sustainable productive capacity; and </text></paragraph><paragraph id="idDAF989602D5D4583B81E70B0EE947771"><enum>(3)</enum><text display-inline="yes-display-inline">to improve the efficacy of conservation practices and programs by evaluating conservation effects.</text></paragraph></subsection><subsection id="HD3AF30F6A8EE49D4B2393C2395256EF5"><enum>(b)</enum><header>Scope</header><text>The project under this section may—</text><paragraph id="id4E9AC0F90E554DC498C820A19625F5EF"><enum>(1)</enum><text>be carried out at national, regional, and watershed scales; and</text></paragraph><paragraph id="id51873B60031E4FAEA24F91B733D8841F"><enum>(2)</enum><text>include cropland, grazing land, wetlands, forests, and such other land as the Secretary may determine to be appropriate.</text></paragraph></subsection><subsection id="H886975CAF58642DF834C2419CD8317C2"><enum>(c)</enum><header>Activities</header><text display-inline="yes-display-inline">The project under this section shall include research, literature reviews and bibliographies, modeling, assessment, monitoring and data collection, outreach, extension education, and such other activities as the Secretary may determine to be appropriate.</text></subsection></section><section id="H69BC2237E55D41D7BED0F2081C64EF6D"><enum>9.</enum><header>Goals and assessment process for conservation programs</header><subsection id="HCB7DDA1DA5D6471AAC0F1711F73069B2"><enum>(a)</enum><header>Natural resource and environmental objectives and outcomes</header><paragraph id="HAFCCB06640D945E3B657323089FFA23F"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In coordination with the appraisal of soil, water, and related resources, the soil and water conservation program, and the conservation effects assessment project established under section 8, the Secretary shall identify, and periodically revise, specific natural resource and environmental objectives and anticipated conservation outcomes and results, by resource concern, for—</text><subparagraph id="idCB1D5A8C5AB1468787E60A9278C3CEBF"><enum>(A)</enum><text display-inline="yes-display-inline">the conservation programs established under subtitle D of title XII of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3831">16 U.S.C. 3831 et seq.</external-xref>);</text></subparagraph><subparagraph id="id76C68DA56AB548DF8E19106A1D7CD087"><enum>(B)</enum><text display-inline="yes-display-inline">the agricultural conservation easement program established under subtitle H of that title (<external-xref legal-doc="usc" parsable-cite="usc/16/3865">16 U.S.C. 3865 et seq.</external-xref>);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0980747623444d5dad43f4836fdac383"><enum>(C)</enum><text display-inline="yes-display-inline">the regional conservation partnership program established under subtitle I of that title (<external-xref legal-doc="usc" parsable-cite="usc/16/3871">16 U.S.C. 3871 et seq.</external-xref>); and</text></subparagraph><subparagraph id="id69BE9BA9839E45B8A46A749F3FD1A14D"><enum>(D)</enum><text display-inline="yes-display-inline">the landscape conservation initiatives developed by the Secretary.</text></subparagraph></paragraph><paragraph id="H60368DA839A942818477D5727FB32D05"><enum>(2)</enum><header>Assessments</header><text display-inline="yes-display-inline">To help measure outcomes and results, the Secretary shall, to the maximum extent practicable, make assessments of changes in the status and conditions of natural resources and the environment that result from the application of conservation activities supported directly by the conservation programs and initiatives described in subparagraphs (A) through (D) of paragraph (1).</text></paragraph><paragraph id="H33801B8158E74EBDBA432AEC9E4D4E6E"><enum>(3)</enum><header>Monitoring and program evaluation</header><text display-inline="yes-display-inline">The Secretary shall establish a coordinated monitoring and evaluation process for the programs and initiatives described in subparagraphs (A) through (D) of paragraph (1)—</text><subparagraph id="idE106FF6A32A54E9F87D6D7361C73D121"><enum>(A)</enum><text display-inline="yes-display-inline">to assess progress toward the objectives identified under that paragraph;</text></subparagraph><subparagraph id="id25F2EEF91C8F45C79CAF096C689B2593"><enum>(B)</enum><text display-inline="yes-display-inline">to gather information to improve the implementation of those programs and initiatives in accordance with the outcomes and results identified under that paragraph; and </text></subparagraph><subparagraph id="id1E09A3602CBD40DEACEF516F2A2AA1A1"><enum>(C)</enum><text display-inline="yes-display-inline">to assess the need for modifications to the statutes or regulations for those programs and initiatives.</text></subparagraph></paragraph></subsection><subsection id="HF725893962AD4482AF4CF837E9ADBDC4"><enum>(b)</enum><header>Monitoring and program evaluation</header><paragraph id="HE43E423FA0C44A67BB5F9C905FF8C0A8"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall use not more than 1 percent of the total annual funding from the funds of the Commodity Credit Corporation made available for new annual enrollments for the conservation programs described in subparagraphs (A) through (C) of subsection (a)(1) to establish a comprehensive monitoring and program evaluation process to assess—</text><subparagraph id="id3597BB74E48D4631A8DBF94F3362C896"><enum>(A)</enum><text display-inline="yes-display-inline">progress in reaching natural resource and environmental objectives identified under that subsection;</text></subparagraph><subparagraph id="id39774B2D4CB54CA183FF23F79C8CE7C4"><enum>(B)</enum><text display-inline="yes-display-inline">the contribution of individual programs to that progress; and</text></subparagraph><subparagraph id="id834720AB8FA04AFA8B3777B9E01554FD"><enum>(C)</enum><text display-inline="yes-display-inline">the contribution of those programs collectively to that progress.</text></subparagraph></paragraph><paragraph id="HBB5B1F223E004E7997E5E0FDD593CDE6"><enum>(2)</enum><header>Implementation</header><text>In implementing the comprehensive monitoring and program evaluation process under paragraph (1), the Secretary may consider and incorporate—</text><subparagraph id="id82F275EC19424B9289EBA71CFF71D515"><enum>(A)</enum><text>resource concern inventories; </text></subparagraph><subparagraph id="id3758BA54B59740439C4B3124293FE672"><enum>(B)</enum><text>trends and analyses;</text></subparagraph><subparagraph id="id3474F2E269C042A0AF7237269F6D99DA"><enum>(C)</enum><text>quality and quantity criteria; </text></subparagraph><subparagraph id="id85A936755EE440C280F53C85D15C46C4"><enum>(D)</enum><text>conservation practices and enhancements; and </text></subparagraph><subparagraph id="idD0D8BAE7338E4EDD8E4B54CCA3D94314"><enum>(E)</enum><text>such other information as the Secretary determines relevant for applying the monitoring and program evaluation process across each major land use identified by the Secretary.</text></subparagraph></paragraph><paragraph id="H0FDA2D3C12A4419A891420C4F35F2EEB"><enum>(3)</enum><header>Monitoring and evaluation process</header><subparagraph id="HA238CFC7A4614659974C92F5C6481754"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of the <short-title>Farmer Driven Conservation Outcomes Act of 2024</short-title>, the Secretary shall issue—</text><clause id="id8E9E5C465B52435D98EABECAEADAC93E"><enum>(i)</enum><text display-inline="yes-display-inline">a design for the comprehensive monitoring and program evaluation process under paragraph (1); </text></clause><clause id="id86593FB1E230404A9D94EAC260C252BF"><enum>(ii)</enum><text display-inline="yes-display-inline">a schedule for implementing that process; and </text></clause><clause id="id9BBF3A013BE547D8A95FB32AE4790B88"><enum>(iii)</enum><text display-inline="yes-display-inline">a plan for coordinating that process with—</text><subclause id="idB6209FDEE8C04510905FEF5552FAD772"><enum>(I)</enum><text display-inline="yes-display-inline">the soil and water conservation program; and </text></subclause><subclause id="id79A1C5ECBCF64F33BD716F660723E1E2"><enum>(II)</enum><text display-inline="yes-display-inline">the conservation effects assessment project established under section 8.</text></subclause></clause></subparagraph><subparagraph id="H2F0ADDFDD85F4A499A97078CE8233F6E"><enum>(B)</enum><header>Methodology</header><text>The design for the comprehensive monitoring and program evaluation process described in subparagraph (A)(i) shall—</text><clause id="HEB6563B9B94043A3914B28C86BA0DCDA"><enum>(i)</enum><text>ensure that data made available to cooperators and researchers from the comprehensive monitoring and program evaluation process are transformed into statistical aggregate data at the county level and in a form that protects personally identifiable information; and </text></clause><clause id="H1A008C9325D8476A910230FED204EF9F"><enum>(ii)</enum><text>take into account—</text><subclause id="idAD3E3CD537A4454AB2C415A4179F5A60"><enum>(I)</enum><text>the cumulative impact of conservation over time;</text></subclause><subclause id="id2DD5AA7D50E34308B8F2B07B42327185"><enum>(II)</enum><text>the interactions and sequencing effects between conservation activities;</text></subclause><subclause id="id08733BCDEF65413DA0F10152B70AE3F7"><enum>(III)</enum><text>the differing times for conservation effects to be realized; and </text></subclause><subclause id="idB3EC53A9F9E74E28B2947A47B7B1794D"><enum>(IV)</enum><text>other related measurement challenges.</text></subclause></clause></subparagraph><subparagraph id="HC8F1F31918A14BF592CFD1C5EA2101BA"><enum>(C)</enum><header>Public research</header><clause id="idFD4650BFCBBC49308CE351A5CFC5C472"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, subject to clause (ii), in order to facilitate implementation of the comprehensive monitoring and program evaluation process under paragraph (1), the Secretary shall make available conservation activity and program data to cooperators and researchers engaged in public research and evaluation activities to improve conservation outcomes under this subsection.</text></clause><clause id="id46DF11E0CB2B451698B4EB836538B950"><enum>(ii)</enum><header>Conditions</header><text>The availability of data under clause (i) shall be subject to the conditions that—</text><subclause id="H1054FFB09BC240F9BB74E8B57F6C6F55"><enum>(I)</enum><text>adequate assurances are provided to the Secretary that any resulting research or information will be made publicly available in a form that protects personally identifiable information; and</text></subclause><subclause id="HEE9DF9C5B9B74894BD0322C20A65E611"><enum>(II)</enum><text>the national technical committee established under paragraph (5) finds that the data is likely to generate information that furthers the purpose of this section.</text></subclause></clause></subparagraph></paragraph><paragraph id="HB5D6EBC5B6C7447798FF711A07A44468"><enum>(4)</enum><header>Cooperative agreements</header><text display-inline="yes-display-inline">The Secretary may implement the comprehensive monitoring and program evaluation process under paragraph (1) in part through cooperative or contribution agreements with Federal, State, and local agencies, institutions of higher education, and nongovernmental organizations with requisite expertise, as determined by the Secretary, in consultation with the national technical committee established under paragraph (5).</text></paragraph><paragraph id="HB3B6691CCA04469C8EDAA32F65FE0792"><enum>(5)</enum><header>National technical committee</header><subparagraph id="H9B34A40603DD4F0DB78477771C4E9D8F"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The comprehensive monitoring and program evaluation process under paragraph (1) shall be administered by the Secretary, acting through the Chief of the Natural Resources Conservation Service, with assistance from a national technical committee described in subparagraph (B).</text></subparagraph><subparagraph id="id04960CDC4DCC46889913DD70D82A2016"><enum>(B)</enum><header>Composition</header><text display-inline="yes-display-inline">The national technical committee referred to in subparagraph (A) shall be appointed by the Secretary and composed of individuals with relevant technical and scientific expertise representing—</text><clause id="H572D697618AF4DD2B2CB2D3648D43D59"><enum>(i)</enum><text>the Agricultural Research Service;</text></clause><clause id="H2A726656E34F4109AC3FBC39C1142A7F"><enum>(ii)</enum><text display-inline="yes-display-inline">the Economic Research Service;</text></clause><clause id="H139C41FED5334826A8564B012C127C3F"><enum>(iii)</enum><text display-inline="yes-display-inline">the Farm Service Agency;</text></clause><clause id="HA084B0C7581B47CA8DC4ACD66221EB56"><enum>(iv)</enum><text>the United States Fish and Wildlife Service;</text></clause><clause id="HEFB91DE004084725B155F3B3B107A961"><enum>(v)</enum><text>the Forest Service;</text></clause><clause id="H448EA44557BE43BF91EF68166F50FC9D"><enum>(vi)</enum><text>the National Institute of Food and Agriculture;</text></clause><clause id="H57C3E6BF963449ADB8CD59742DBFDF8C"><enum>(vii)</enum><text display-inline="yes-display-inline">the United States Geological Survey;</text></clause><clause id="HD2B37DCB10854E0FB7BB1E5E0372CDE2"><enum>(viii)</enum><text>the Environmental Protection Agency;</text></clause><clause id="HDBBEE94B94B54C7A936C8971029843A8"><enum>(ix)</enum><text>State and Tribal agencies;</text></clause><clause id="HD3CBC742FB7B46079AC1D82EFEFC0493"><enum>(x)</enum><text>land grant university natural resource research programs;</text></clause><clause id="H72730FD560A947069C7EB1023FF32993"><enum>(xi)</enum><text display-inline="yes-display-inline">nongovernmental organizations with expertise in the full array of conservation issues and measurement and evaluation of conservation outcomes; </text></clause><clause id="id34b0761b92964301abcc25b0f0d75467"><enum>(xii)</enum><text>farmers that reflect a variety of geographic regions, production types, racial and ethnic backgrounds, and farm acreages; and</text></clause><clause id="HA09FC74F0B73445294F8774C312DF22F"><enum>(xiii)</enum><text>such other agencies, institutions, or organizations as the Secretary may determine to be appropriate.</text></clause></subparagraph><subparagraph id="H0410C363980141A49F80B230D3F875C6"><enum>(C)</enum><header>FACA exemption</header><text>The national technical committee shall be exempt from the Federal Advisory Committee Act (5 U.S.C. App.).</text></subparagraph><subparagraph id="HB3FB12F1307641BC88B0DCECE8C9AC01"><enum>(D)</enum><header>Transparency</header><text display-inline="yes-display-inline">The Secretary shall ensure that the proceedings and recommendations of the national technical committee are available to the public.</text></subparagraph></paragraph><paragraph id="H0638B8E2871440FC9F87FC750040239E"><enum>(6)</enum><header>Voluntary participation</header><text display-inline="yes-display-inline">In carrying out this subsection, the Secretary shall ensure that any on-farm monitoring activities that may be included as part of the comprehensive monitoring and program evaluation process under paragraph (1)—</text><subparagraph id="id059E43B532F2414394FC913E6536ED62"><enum>(A)</enum><text display-inline="yes-display-inline">are voluntary on the part of the producer; and </text></subparagraph><subparagraph id="idC1F1E42707C84984859EEE2D39EAB8D5"><enum>(B)</enum><text display-inline="yes-display-inline">may include appropriate compensation for the producer, as determined by the Secretary, subject to the condition that the compensation, for any fiscal year, shall not exceed the lesser of—</text><clause commented="no" display-inline="no-display-inline" id="idc9d9d87e2eee44efb3ace96978f6760c"><enum>(i)</enum><text display-inline="yes-display-inline">10 percent of the net annual income of the producer; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idc49fb55bb4474708a47f09444ce68a59"><enum>(ii)</enum><text display-inline="yes-display-inline">$2,000.</text></clause></subparagraph></paragraph></subsection><subsection id="HFE22CBACE8CB46119685255634131FA1"><enum>(c)</enum><header>Reporting</header><paragraph id="HB7CC95ED8EA944A4B44CC80DE7B0B439"><enum>(1)</enum><header>Report on objectives and methods</header><text>Beginning in the fiscal year that is 3 years after the date of enactment of the <short-title>Farmer Driven Conservation Outcomes Act of 2024</short-title>, and every 2 years thereafter, the Secretary shall submit to Congress, and make publicly available, a report that includes—</text><subparagraph id="HE8A61F75213246CD884F8724A1A7B9BB"><enum>(A)</enum><text display-inline="yes-display-inline">a description of conservation outcome objectives that are, to the maximum extent practicable, quantitative, measurable, and time-bound for each program or initiative described in subparagraphs (A) through (D) of subsection (a)(1);</text></subparagraph><subparagraph id="H99A0261E0E0D4738B8EA696ED52F6FE0"><enum>(B)</enum><text>a description of the approaches, tools, and methods used—</text><clause id="id1085EF6236BF423793D4818BFBD909D8"><enum>(i)</enum><text>to measure or model the conservation outcomes and results; and </text></clause><clause id="idB29E6230222B40B28464E31E4B515AE5"><enum>(ii)</enum><text>to estimate the cost-effectiveness of each of the programs or initiatives; and</text></clause></subparagraph><subparagraph id="H763D5B73B88D43ABA7725DA26466B1E8"><enum>(C)</enum><text display-inline="yes-display-inline">guidance to the conservation project partners working to implement conservation programs within a landscape-level project that provides a description of the approaches, tools, and methods that the partners might consider using to measure and model the conservation outcomes and results of the projects.</text></subparagraph></paragraph><paragraph id="H0945FF4B04074B5CA13730DCAD1A122F"><enum>(2)</enum><header>Report on outcomes</header><text>In conjunction with each of the reports to Congress pursuant to section 7, the Secretary shall submit to Congress, and make publicly available, a report that includes—</text><subparagraph id="H725963C57145488499E9CEF245BDD89C"><enum>(A)</enum><text display-inline="yes-display-inline">an assessment of progress made towards achieving conservation program objectives and anticipated outcomes and results for each program or initiative described in subparagraphs (A) through (D) of subsection (a)(1), individually and collectively;</text></subparagraph><subparagraph id="HE31A3A98EA594146A6F1A19ADDF4D1F0"><enum>(B)</enum><text>an evaluation of the cost-effectiveness of each of those conservation programs and initiatives; and</text></subparagraph><subparagraph id="H385F17AF2DEE4785B36B98834822789B"><enum>(C)</enum><text display-inline="yes-display-inline">recommendations, taking into consideration the assessment and evaluation under subparagraphs (A) and (B), respectively, to improve program implementation and the scientific and economic tools (including any new or revised conservation practices, conservation enhancements, or conservation planning tools) used to achieve stated natural resource conservation and environmental objectives.</text></subparagraph></paragraph><paragraph id="H76790FEDB4514BEE93A85F68413279C3"><enum>(3)</enum><header>Coordination</header><text>The Secretary may coordinate the reports required under paragraphs (1) and (2) with any reports developed as part of the conservation effects assessment project established under section 8 when that coordination is feasible and warranted, as determined by the Secretary.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
